It is a pattern of space contestation that leads to the affirmation and strengthening of identity or a pattern that leads to the fusion of identities. As a consequence, the first pattern creates social friction or conflict. On the contrary, the second pattern is directed towards acculturation and assimilation of culture which can strengthen social harmony. The important finding of this research is that it can be known the real issue, so that problems related to all parties can be found a solution as well as a resolution. This research also proves that social mechanism preparedness is considered urgent to prevent negative excesses (negative things) from the space contestation. So the space contestation that occurs dynamically proves that the plural society in Lasem has found a valuable experience, namely social resilience in facing all possible emergence of social disintegration. Keywords: contestation, space, social mechanisms and an plural society REFERENCE: Abercrombie, Nicholas, at.all., 2010. Law in its nature is not only used to control conduct that already occurs in society and sustain established behaviors patterns, but the law often contributes to its use as a means. The study revealed 1). Corporate Criminal Liability was an attempt to put the company in the sense of Equality Under the law with a view to achieving legal certainty, fairness and usefulness, 2) Control of corporate criminal penalties was implemented in several laws through a common formulation of the key criminal fines, 3) law enforcement against corporate crime can be achieved through a) Normative Approach. Therefore, it is required that the state will specifically articulate the responsibility for corporate criminal liability through legislative and executive agencies and what kind of liability can be formally demanded of the corporation as the object of criminal liability (legal policy), since the assessment of corporate errors is the basis of material for the demand of corporate criminals.
Maqasid al-shariah is not new, but the study of Maqasid al-shariah is very much needed in Islamic law. This is because Islamic law, whose main source is the Koran and hadith, is given to Muslims or all beings on earth. Allah always gives development to all his creatures, both his behavior and the way he takes Islamic law as his support. Jassser Auda offers methods in a systems approach as an effort to form a new frame of mind in understanding Islamic law in the current era. It is hoped that religious approaches and interpretations can produce legal products that are in accordance with the stated intentions of Islam. This paper will briefly describe what Maqasid al-Syari'ah is and how the concept of a systems approach proposed by Jasser Auda. This type of research used in this research is a library (Library Research). This research is aimed at collecting data and information with the help of various materials in the library room, such as books, magazines, document notes and other historical stories. Maqashid is a theory of fiqh which is holistic, not limited to text or partial laws. However, this lies in more universal principles and goals. This mode uses a high-value understanding of Machasid and can overcome many differences, such as Sunni and Shia and Muslim politics. Makasid is a mode that is needed by society to make peace or live side by side in peace.
International audience The relationship of culture and religion is reciprocal. Cultures are under the impact of religions and these also undergo the impact of cultures. So sometimes these are the cultural elements of an ethnic group manifested more prominently in the religion of the latter, and sometimes it is the religious teachings that influence the culture. The right and left sides form an opposition which has repercussions in the two fields of culture and religion. By their existence in religious texts, this couple acquires a fairly strong religious connotation; it also has an important place in different cultures, whether monotheistic or even pagan. In this article, we will try to focus first on the origin and influence of this couple in one or other of the areas of religion and culture where a physical pattern becomes the criterion of Good and Evil. We will question its multidimensional aspect and study the specifics of this couple evoking a strong dualism. Thus we will study the mutual impacts of the religious and cultural connotations of this couple and this through the study of different cultures. In the second time, we will be interested in the sacred texts of different religions in order to identify the evocations to this dualism. We could then take a comparative look at the texts from different religions and we will dwell in particular on the Shiite jurisprudence which turns out to be fertile ground for the existence of this dualism which would serve as a benchmark between Good and Evil . ; La relation de la culture et de la religion est réciproque. Law No. 12 of 2017 concerning the Guidance and Oversight of the Administration of Regional Governments apparently has not provided sufficient power for the implementation of regional autonomy in Indonesia. In fact, a number of cases that undermine the implementation of regional autonomy still occur frequently. There are many contributing factors, including the current regional autonomy oversight system. The Regional Autonomy Implementation Monitoring Committee (KPPOD), for example, noted implementing regulations related to sanctions for regional governments that commit violations or disobey, such as delays in preparing regional budgets, negligence in national programs, or noticeless overseas travels, were not firm yet. On the other hand, guidance and oversight were still considered weak. Therefore, this study intended to provide an overview of regional autonomy oversight models in Denmark and Zimbabwe while trying to provide a solution for the regional autonomy oversight model in Indonesia. To achieve this goal, this study used a literature study method to gather various relevant information with a qualitative approach. This approach was considered appropriate because regional autonomy oversight was multidimensional. The results showed that such a regional autonomy oversight model as applied in Denmark was needed to control regional governments from implementing policies that could harm public interest. Furthermore, the oversight must be carried out by looking at the problems and the actual conditions in the regions in more detail. This study also offered a regional autonomy oversight model, which has dimensions of human resources, acceptance, development, and innovation. ; Ditetapkannya UU No. 12 Tahun 2017 tentang Pembinaan dan Pengawasan Penyelenggaraan Pemerintahan Daerah, ternyata belum cukup memberikan kekuatan bagi penyelenggaraan otonomi daerah di Indonesia. The existence of small lakes, lakes, public ponds, and reservoirs for the Indonesian people is significant and has been used for various basic needs. The conditions of small lakes, lakes, public ponds and reservoirs generally show negative tendency namely pollution, silting, environmental damage and even some of them have been shifted function to land. This study aims to determine the importance of land registration for small lakes, lakes, public ponds, and reservoirs. The research method is descriptive qualitative. Data was collected through field observation for several samples and secondary data collection for several cases. Furthermore, the data are analyzed empirically by referring to the regulations and practices of the policy. The results obtained indicate that the sustainability of situ, lakes, reservoirs, and reservoirs (SDEW) is disturbed due to human activities. Land registration is one of the efforts to protect the existence of these public water areas. However, not all public water areas can be registered because of their land status. The area of public water to be registered includes the surface area of the water and its buffer zones. The stages of land registration for the area, lakes, reservoirs, and reservoirs are generally the same as for other land registrations. Following the registration of land for the territorial waters, the holder of land rights must actively maintain the control boundary and monitor the physical condition of the lake, reservoirs, and reservoirs from illegal exploitation efforts. In addition, the Government and Regional Governments must be able to raise community participation in maintaining territorial waters and establish cooperation with other parties related to the provisions governed by laws and regulations. This study concludes that land registration for the SDEW area is beneficial due to the improved management, monitoring, and maintenance system through the availability of accurate data and the strong legal basis.

This paper intends to convey the concept of Islamic moderation in preaching both in theory and practice, with a thematic interpretation study approach method. There may be quite a lot of writings on moderate Islam or moderation of Islam, but the delivery of moderate Islam in the field of da'wah, seems to be something whose presence is much awaited. The problem of moderate Islamic da'wah is often discussed, especially because of the accusation of a group of people who politically accuse Islam of being a radical religion (al-ghuluw). Of course this accusation is no more than mere figment, because this kind of talk is rejected in concept and practice. But how does moderate Islam actually preach both in concept and practice.
Benchmarking with other regions of the world, MENA is considered as one of the least globally and regionally integrated regions of the world. Home to 5.5 percent of the world's population while having 3.9 percent of the world's gross domestic products (GDP), the region's share of non-oil world trade is only 1.8 percent. How can a new social contract along with the processes of institutionalization and deeper integration change the current status for the region towards further and more effective contribution to the global economy? Designed in three distinct yet interrelated Parts, this dissertation is to answer this pivotal question with its main attempt to establish that economic integration—regionally and globally—can make an important contribution to growth, job creation, and poverty reduction within the MENA region provided that some major efforts would be focused on institution-formation within the national and regional contexts in an enabling peaceful environment away from regional conflicts. Hence, as the first step to deeper regional integration, such regional conflicts and civil wars need to be settled within a cooperative environment involving the major powers of the region. Secondly, the theory of institutional change along with social contract theory have been suggested at the core theoretical part of this dissertation aimed at establishing the rule of law, well-defined property rights, good democratic polity while bringing more freedoms along with individual and citizenry rights into the socio-political and economic spheres which together can bring about the necessary voice and accountability to the citizens and the governments respectively. Traditional economic analysis based on institutional economics blended with empirical economic surveys and scientific findings on economic structure of the MENA region as well as comparative analysis of institutions constitute the core part of the methodology for this thesis. Along with this methodology, a correlation-tringle is established among the three important factors namely integration, institutions, and social contract that together bring sustainable development with freedom and stronger role for individuals as well as those of private sectors. It is suggested that the countries of the MENA region can expand such progress through regional cooperation and deeper integration processes. In other words, adequate institutions and proper social contract may serve as two pivotal pillars for a successful regional integration which in turn can reward such national efforts. The thesis stresses that institutions greatly matter for economic integration processes. With better policies, adequate strategies, and inclusive institutions, a desirable growth and sustainable development can be attained in the MENA region. Last but not least; studying legal aspects of economic integration in different regions of the world including the EU, MERCOSUR and NAFTA, ASEAN, and AFRICA as all explained in Part (II) render valuable lessons and experiences along with more lessons that can be learned by success and failure stories of countries within the MENA region (Chapter 9). Such historically evolved models can also help achieve a successful model for the MENA region as expounded through this dissertation. To achieve such economic success, and inclusive growth within a regional context; building infrastructures, fostering diversification away from the curse of natural resources while attracting FDIs are of paramount importance. Moreover, PTAs coupled with behind-the-border trade facilitation as well as logistic services are also crucial along with deeper integration to be aligned with the global value chains. To attain that success, it is important to have the regional integration processes as complementary to the process of global integration and vice versa.
Abstract More and more companies are using chatbots in customer service. Instead of with a human employee, customers interact with a machine. Many companies give these chatbots human traits through names, human-like appearances, a human voice or even character descriptions. Intuitively such a humanization strategy seems to be a good idea. Studies show, however, that the humanization of chatbots is perceived in a nuanced way and can also backfire. Especially in the context of customer complaints, human-like chatbots can intensify negative reactions of angry customers, because their performance is judged more critically compared to non-humanized chatbot variants. Service managers should therefore consider very carefully whether and in which situations they should use humanized service chatbots.
