The concept that man must be protected against the ills of war is not a recent one. It may be likened to a clear spring gushing out from time immemorial, increasing gradually in volume as it surges forth until its swollen waters are borne down upon us today. The sum of efforts that idea has aroused has grown, parallel to the rise of civilization with which it is indissolubly linked.

Cet événement eut lieu à Bruxelles, le 12 décembre 1974.Protéger l'homme contre les maux de la guerre n'est pas une idée nouvelle. Source d'eau vive jaillie dans la nuit des temps, elle a grandi sans cesse pour venir aujourd'hui, telle une vague immense, déferler à nos pieds. La somme d'efforts qu'elle a suscités suit la courbe ascendante de la civilisation, à laquelle elle est indissolublement liée.

Le 12 août 1949 est une date marquante dans l'histoire du monde. C'est le jour où les plénipotentiaries de quelque soixante Etats ont mis leur signature au bas de ces chartes fondamentales de l'humanité qui s'appellent les Conventions de Gèneve. Au nombre de quatre, elles assurent une meilleure protection aux victimes des conflits armés: la première aux blessés et malades des armées, la seconde aux victimes des hostilités sur mer, la troisième aux prisonniers de guerre et la quatrième, entièrement nouvelle, aux personnes civiles. Après les tragiques souffrances endurées par la population des pays occupés pendant la seconde guerre mondiale, l'établissement d'un tel traité apparaissait d'une importance première et d'une urgence extrême. Car, selon le mot saisissant de Max Huber, « le développement de la guerre vers une forme de plus en plus totale avait pratiquement nivele, dans le danger et la douleur, les armées et la population ».

August 12, 1949 was an important date in world history. It was on that day that the plenipotentiaries of some sixty States signed the fundamental charters of humanity which are known as the four Geneva Conventions, and which protect the victims of armed conflicts: the first, the military wounded and sick; the second, the victims of war at sea; the third, the prisoners of war; and the fourth—which was entirely new—civilians. After the suffering of the population in occupied countries during the Second World War, such a treaty appeared to be vitally necessary and urgent. As Max Huber said, the development towards total war has made danger and hardship equal for armies and population.

The promotion of world peace, although of concern to the Red Cross, was for a long time outside the purview of its programme of action. However, after the First World War the International Red Cross, sharing the hopes of the nations, declared its intention to work thenceforth, not only in time of peace, but also for peace. Since that time, nearly all International Conferences of the Red Cross have adopted resolutions on the contribution which the Red Cross could make to this noble cause.

La neutralité est une notion essentiellement négative: elle qualifie avant tout l'abstention de celui qui demeure à l'écart d'un conflit, qui ne se prononce pas ouvertement pour l'une ou l'autre partie.En droit international, la neutralité est le contraire de la belligérance: c'est la position qu'adopte, vis-à-vis de deux puissances en guerre, un Etat qui ne prend point de part à la lutte. Le statut de neutralité, régi par des règles juridiques et notamment par les Conventions de La Haye, comporte des droits et des devoirs. Indiquons sommairement qu'il implique l'abstention de toute participation offcielle, directe ou indirecte aux hostilités. C'est donc tout d'abord une conception d'ordre essentiellement militaire.

The word "neuter" comes from the Latin ne-uter, which means, neither the one, nor the other. Neutrality is an essentially neutral notion. It qualifies above all the abstention of someone who remains outside a conflict who does not openly express an opinion of either side.In international law, neutrality is the opposite of belligerency. It is the position adopted, in relation to two Powers at war, by a State not taking part in the struggle. The status of neutrality regulated by juridical rules and in particular by the Hague Conventions involves rights and duties. In short, it implies refraining from taking part officially, either directly or indirectly, in hostilities. In the first place, therefore, it is a concept of an essentially military character. However, as a result of a recent evolution in events and thought, some people tend to think that neutrality should also have effect in the economic sphere, in view of its importance today in the war potential of countries.

"Certain ideas formulated with deliberate imprecision occupy a privileged position in treaties which describe them as being creative elements of law".

Depuis quelques lustres, on a pris l'habitude d'appeler «droit humanitaire» cette portion considérable du droit international qui s'inspire du sentiment d'humanité et qui est centrée sur la protection de la personne. Cette expression de droit humanitaire paraît unir deux notions de nature différente, l'une d'ordre juridique et l'autre d'ordre moral. Or, les dispositions qui font l'objet de notre étude sont précisément, ainsi que nous le verrons plus loin, une transposition dans le droit international de préoccupations d'ordre moral et, plus spécialement, d'ordre humanitaire. From the very beginning, the Red Cross has been closely linked, with doctors and with all whose task it is to heal, the finest of vocations.The Red Cross was in fact created a hundred years ago to provide against deficiencies in the Army Medical Services. This was an essentially medical factor which has continued to exist in every facet of Red Cross work, even when this work has exceeded its bounds and extended not only to the various victims of conflicts, but also in time of peace to life's victims—the sick.Both the Red Cross and doctors have the same aim: to struggle against suffering and death. There can therefore never be too close co-operation between them. Without doctors the Red Cross would be nothing. The Red Cross, for its part, has obtained bases for doctors rendering their action possible in time of war and which are precisely contained in the Geneva Conventions.
