AbstractThis article explores the legal writings of Brazilian sociologist and jurist Francisco José de Oliveira Vianna to reveal the global context that shaped Brazil's corporatist experiment in the 1930s. From the Labour Ministry, Oliveira Vianna was at the forefront of legal and political debates over how to create corporatist laws and institutions. He was often cast as an authoritarian and retrograde thinker, yet this article looks beyond those categories to examine how his engagement with the US New Deal inserted corporatism into global debates over the role of the state in economic recovery and social welfare.
Die Arbeit untersucht das Unrecht der privaten Korruption im geschäftlichen Verkehr. Dabei werden drei zentrale, dogmatische und kriminalpolitische Fragen des reformierten Tatbestands des § 299 StGB unter die Lupe genommen, nämlich nach der Strafbarkeit des Geschäftsinhabers de lege ferenda, der Relevanz der Einwilligung des Geschäftsherrn und der Beurteilung der Konstellation der Drittvorteile zugunsten des Prinzipals. Deren unbefriedigende Behandlung – vor allem durch die herrschende Meinung in der Rechtsprechung und in der Literatur – werden als Symptome eines noch fehlenden, korrekten Konzepts zum Unrecht der Korruption im privaten Bereich angesehen.Nach einer kritischen Analyse der herkömmlichen Lösungsansätze, insbesondere des herrschenden Wettbewerbsmodells, wird der eigene Ansatz in Rückbesinnung auf den durch den Prinzipal-Agent-Ansatz geprägten Korruptionsbegriff und auf die normativen Grundlagen eines liberalen Strafrechts entwickelt. Das Unrecht der privaten Bestechung wird sodann in der Beeinträchtigung der wirtschaftlichen Freiheit bzw. der Wettbewerbsfreiheit des Unternehmers (Geschäftsinhabers) gesehen. Schließlich werden die Konsequenzen de lege lata und de lege ferenda dieser Neuorientierung für die Auslegung und Anwendung des § 299 StGB gezogen

The Cultural Heritage Education is accepted as a viable route for understanding the Cultural Heritage concept, allowing for new standards for its definition and spreading of cultural manifestations. In this work we discuss an approach to stimulate understanding and preservation of Cultural Heritage, this attempt was done together with three public schools inCamposdos Goytacazes, northernRio de JaneiroState. El presente trabajo trata de una acción pedagógica junto a tres escuelas públicas en el municipio de Campos dos Goytacazes, norte del Estado de Río de Janeiro, con el objetivo de difundir la noción de Patrimonio Cultural, contribuyendo para su entendimiento y su preservación. Las reflexiones teóricas y los resultados prácticos de esta acción son aquí presentados y discutidos.
Depois de um período em que a secularização, como modelo explicativo – linear e teleológico –afirmou-se hegemonicamente nas ciências sociais, tornou-se necessário encontrar outras vias de acesso aos lugares de reconfiguração do religioso, no contexto das múltiplas modernidades. Nesta situação, tornou-se decisivo reaproximar o olhar científico, em diferentes escalas, dos lugares em que estão a ser construídas novas relações entre a esfera do religioso e os outros mundos sociais, mediadas pelas deslocações do sagrado. O presente artigo explora o terreno da criação musical contemporânea como laboratório para a descoberta destas novas configurações.
In the last decade of his career before his untimely death, António Almodovar's research was very much dominated by an interest in catholic economic thought, apparently an unexpected development in his career. However, it fitted his broader approach to the history of economics, which presented a strong emphasis on the dissemination of economic ideas as in his previous work on the institutionalization of political economy or in the parliamentary debates or in textbooks. His interest in the overlap between religious and economic thought also corresponded to a reflection about the boundaries of economic thought and their evolution.
En la última década de su carrera antes de su inesperada muerte, la investigación de António Almodovar estuvo dominada por su interés en el pensamiento económico católico, aparentemente una derivación inesperada en su trayectoria. Sin embargo, encajaba en su enfoque más amplio de la historia de economía, que enfatizaba la diseminación de ideas económicas como en su trabajo anterior sobre la institucionalización de economía política o de los debates parlamentarios o manuales. Através de uma análise das atividades desenvolvidas pelos terapeutas da zooterapia, apresentado pela experiência de um trabalho de observação de longa duração, este artigo se propõe a colocar em questão a associação do homem e do animal, em um corpus de conhecimentos vindo de uma "etologia" empírica e de um corpus elaborado e estruturado de saberes antropológicos. A zooterapia enquanto mediação animal é uma técnica de cuidado para além de uma constatação trivial interespecífica ou de uma projeção antropomórfica sobre os animais de categorias universalmente reconhecidas como humanas. Ela permite nos interrogarmos sobre o recurso à participação animal e seu estatuto de sujeito dotado de capacidades agentivas, ao lado de um terapeuta humano e face à uma pessoa doente. Por ocasião de três estudos de caso contextualmente situados nas cidades de Porto Alegre, Rio de Janeiro e São Paulo, destacamos a questão mais geral da interação entre os dados empíricos que a zooterapia acumula e as representações sociais que são implicitamente mobilizadas para situar o animal dentro de uma cadeia operativa. De modo geral a problemática de interesse deste artigo trata das práticas e horizontes relacionais que atravessam vários grupos sociais e indivíduos contemporâneos que apostam na direção de uma relação interespecífica. Essa problemática é também empírica e epistemológica, pois demarca uma remodelação das diferenças entre natureza e cultura, baseada em uma conjunção de fenômenos invocados a caracterizar os sujeitos (conduta, ações, afetos, comportamento).Palavras-chave: Antropologia da natureza. Modalidades de ações.The interspecific relations for human care in the conventional health system: an anthropological analysis of the dynamics of zootherapyAbstractThrough an analysis of the activities developed by zootherapy therapists, presented by the experience of a long-term work of observation, this article proposes to put in question the association of man and animal, in a corpus of knowledge coming from an empirical "ethology" and an elaborate and structured anthropological knowledge corpus. The zootherapy as an animal care mediation is a technique other than an interspecific trivial finding, or an anthropomorphic projection on animals of universally recognized as human categories. It allows us to interrogate about the use of animals and their status as subjects endowed with agentive capacities, alongside a human therapist and in face of a sick person. Based on three case studies contextually located in the cities of Porto Alegre, Rio de Janeiro and São Paulo, we highlight the more general question of the interaction between the empirical data that zootherapy accumulates and social representations that are implicitly mobilized to locate the animal inside of an operative chain. More comprehensively the issue of interest in this paper deals with the practical and relational horizons that cut across social groups and contemporary individuals who bet on the direction of an interspecies relationship. This problem is also empirical and epistemological because it marks a remodel of the differences between nature and culture, based on a combination of phenomena invoked to characterize the subjects (behavior, actions, feelings).Keywords: Anthropology of nature. A Geographic Information System (GIS) is a digital technology that integrates hardware and software to analyze, store, and map spatial data. GIS allows users to visualize (i.e., map) geographic aspects of data including locations or spatial concentrations of phenomena of interest. Though public health and other social work related fields have embraced the use of GIS technology in research, social work lags behind. Recent technological advancements in the field of GIS have transformed what was once prohibitively expensive, "experts only" desktop software into a viable method for researchers with little prior GIS knowledge. Further, humanist and participatory geographers have developed critical, non-quantitative GIS approaches that bring to light new opportunities relevant to social workers. These tools could have particular utility for qualitative social workers because they can help us better understand the environmental context in which our clients reside and give credence to their assessments of strengths, weaknesses, and opportunities for intervention. This article provides an introductory overview of the history of GIS in social work research and describes opportunities to use spatially informed approaches in qualitative social work research using a case study of a participatory photo mapping research study.
Este trabalho pretende refletir sobre o comentário enquanto prática jornalística a partir de um corpus de dezoito textos jornalísticos, etiquetados com os marcadores autorreferenciais opinião e comentário. Conjugando uma análise dos elementos verbais e não verbais, enquadrada pelas abordagens do Interacionismo Sociodiscursivo e da Gramática do Design Visual, considera-se que as imagens indiciam uma ação de linguagem individual decorrente da atividade de linguagem comentar. Para a análise dos elementos verbais do corpus, propõe-se a observação de três aspetos, enunciativos, temporais e de construção da referência, que apontam uma prática de agir de comentário sobre o quotidiano nacional ou político.
