AbstractThis article argues that, in the arrangements for the public provision of welfare for the poor and a basic education for all in both biblical and post‐biblical times, Judaism is more closely in accord with classical liberalism than it is with those variants of liberalism which favour no more than the minimal night‐watchman state as well as those which favour the extensive welfare states of contemporary Western social democracies. To the extent that Israel's ultra‐orthodox Jews (its Haredim) have been able to secure more by way of state subsidies (through exploiting the leverage their country's national system of proportional representation has given them, which often leaves them holding the balance of power), not only are they endangering Israel's viability as a vibrant, developed liberal democracy, they are also guilty of departing from the religious teachings and tradition of Jewish orthodoxy.

La politique a eu, dès l'origine, un statut ambigu dans le monde juif. Reconnu comme une instance spécifique et nécessaire pour organiser la cité, le politique a pourtant, au niveau idéologique, un statut périphérique par rapport au spirituel, à l'éthique, au religieux. Cette mise à distance du politique, encore renforcée durant la période diasporique, explique les réticences profondes que le projet sioniste a rencontrées au sein même du judaïsme. Le sionisme s'est en effet proposé d'inscrire les Juifs au cœur même du politique moderne en les dotant d'un Etat. Cet objectif prioritaire de construction d'un Etat séculier a eu affaire à une critique d'essence religieuse qui a rejeté radicalement le sionisme ou s'en est accommodé, pragmatiquement d'abord, puis en le légitimant théologiquement (Rav Kook). Pour le sionisme religieux, un problème majeur subsiste néanmoins : l'extrême difficulté de reconnaître l'Etat d'Israël comme la matérialisation d'un projet avant tout politique.

At the present time, when so-called Islamic radicalism, terrorism and Jihadism occupy major media space, with Islam often depicted as the main culprit, the book attempts a tour de force. It proposes that Islam is as much victim as culprit in the history that has led to the current hostility. This is because the common claims of both mainstream and radical Islam that Islam represents the high point of the Abrahamic tradition, and therefore a purification of Judaism and Christianity, have been largely ignored, misunderstood or blatantly rejected by these faiths and therefore by 'the West' in general. This rejection has effectively rendered Islam as the poor cousin, if not the illegitimate sibling, of the tradition. In turn, this has created long-term resentment and hostility within Islam as well as robbed the 'Judaeo-Christian West' of a rich, inter-faith understanding of the wider Abrahamic tradition. The book explores these claims through textual, historical and theological analyses, proposing that many of them stand up better to critical scrutiny than has been commonly acknowledged. It further proposes that seeing Islam in this way has potential to re-awaken its self-understanding as a leader of accord among the Abrahamic faiths, of the kind that characterized the era of Convivencia when, in medieval Spain, Islam constructed and contributed to advanced civilizations characterized by relatively harmonious co-existence between Muslims, Christians and Jews. The book focuses on the role that a more respected and self-confident Islam could play in forging enhanced inter-faith relations in a world that desperately needs them as it struggles to understand and deal with modern and particularly vicious forms of radical Islamism

The concept of general interest is firmly implanted in our Constitution and in our legal texts. The clause "general interests" legitimizes the action of government and the very existence of the State as well as its powers to limit the spheres of freedom of citizens. However, our legal system does not offer a definition of what general interests are. In this study we try to find the characteristics that allow us to orient the administrative action towards the satisfaction of the general interests as well as to identify the elements that construct the concept. ; El concepto de interés general está sólidamente implantado en nuestra Constitución y en nuestro textos legales. La cláusula "intereses generales" legitima la acción de gobierno y la existencia misma del Estado, así como sus poderes de limitación de las esferas de libertad de los ciudadanos. Sin embargo, nuestro ordenamiento jurídico no ofrece una definición de lo que son los intereses generales. En este estudio se intentan encontrar las características que permiten orientar la acción administrativa hacia la satisfacción de los intereses generales, así como identificar los elementos que construyen el concepto.

Der vorliegende Beitrag setzt sich kritisch mit dem Buch "Die Unsichtbare Religion" von Thomas Luckmanns aus dem Jahr 1963 auseinander. Zunächst werden die zentralen Aussagen vorgestellt und auf ihre wichtigsten Kritiken eingegangen. Im nächsten Schritt werden einige empirische Arbeiten und theoretische Fortentwicklungen genannt. Abschießend werden die Konturen dieser neuen Sozialform der Religion umrissen. Die "Unsichtbare Religion" ist weder bloß eine theoretische Abhandlung noch ist sie eine empirische Arbeit; Luckmann nennt sie einen Essay. Er stellt darin an die Stelle der kirchlichen oder organisierten Religiosität einen Begriff der Religion, der sich aus der Kirchensoziologie heraus begibt, um andere Formen des Religiösen in den Blick zu bekommen, wodurch der Blick frei wird auf das Verhältnis von Individuum und Gesellschaft. Der Autor kritisiert, dass der essayistische Stil der Rezeption viele Schwierigkeiten bereitet. Einzelne Begriffe bleiben unscharf. So wird etwa der Begriff der "unsichtbaren Religion" lediglich im Titel genannt. Der Essay biete zwar einen theoretischen Entwurf, der sich durch die Bezugnahme auf die zeitgenössische empirische Forschung abstütze. Doch wird die Unsichtbare Religion, bar systematischer Daten, lediglich provisorisch in groben Umrissen skizziert. Der Beitrag geht dann auf die funktionalistische, anthropologische Definition der Religion bei Luckmann ein und benennt die kritischen Punkte. Im weiteren Verlauf des Beitrags setzt sich der Autor mit den Thesen Luckmanns zur Säkularisierung und der Sozialform der Religion sowie der neuen Sozialform der Religion kritisch auseinander. Der Autor kommt zu dem Schluss, dass der besondere Reiz des Buches darin liegt, dass es Konturen religiöser Formen vorzeichnet, die erst später erkennbare Formen annahmen. Religiöse Funktionen werden zunehmend von nicht-religiösen Strukturen getragen. Hierzu zählen zum "cultic religion", politische Einstellungen und Protesthandlungen sowie neue Gemeinschaftsformen und Therapien. Diese neuen Sozialformen der Religion zeichnen sich vor allem durch einen Verlust der Sichtbarkeit auf verschiedenen Ebenen aus. (ICD2)
