Freiräume für kulturelles Schaffen und wissenschaftliches Forschen geraten in vielen Teilen der Welt massiv unter Druck. Im nationalen Raum wird Kultur immer diverser und muss alltäglich neu verhandelt werden. Auf diese Herausforderungen kultureller Vielfalt und wissenschaftlicher Freiheit muss die Auswärtige Kultur- und Bildungs­politik (AKBP) neue Antworten finden. Es genügt nicht mehr, auf das eigene kulturelle Leitbild zu verweisen, gewachsene Strukturen einer ausufernden Vielfalt von Zuwen­dungsempfängern und föderalen Koordinationsinstanzen werden den Herausforde­run­gen nicht gerecht. Neue (digitale) Räume für die kulturgeleitete Verhandlung von Werten und Normen, für Verständigung und Zusammenleben sind notwendig. Erfor­derlich sind auch ein neues politisches Mandat, eine bessere Zuordnung von Aufgaben und die Nut­zung der Chancen, die die Kreativindustrie bietet. Darauf sollte sich Deutschland mit einer politischen und institutionellen Neuaufstellung vorbereiten. Finding appropriate mechanisms for the state to adequately confront certain criminal offenses is manifested through the prescription of various special investigative actions. This paper deals with the institute of an agent provocateur as a person acting under the alias in a criminal environment and whose knowledge of relevant facts from that area has a significant place in bringing to justice the perpetrators of criminal offenses later in the proceedings. After the introductory part, the author will present the national regulation of this institute in the Republic of Serbia, with an overview of the specifics of the Anglo-Saxon and Continental legal system. Comparing legislations will provide an overview of normative regulation, basic legal requirements and practical application of this institute, with an interpretation of the problem of committing crimes by an agent provocateur. The paper will examine both criminal material and process aspect of the institute of agent provocateur, through the framework for its engagement, the type of criminal acts for which it can be engaged, the principle of subsidiarity, and other issues that may arise as controversial in its engagement. Special attention was devoted to the objectives of determining this particular special investigative action and examining the agent provocateur as a witness. Finally, concluding observations are made, with a comparative approach.

Die Rolle des Nationalstaates wird im Zeitalter der Globalisierung neu bestimmt. In einer globalen Welt wird der Nationalstaat zwar nicht gänzlich verschwinden, aber er hat viele Mit- und Gegenspieler. Davon ist auch sein Gewaltmonopol betroffen, wie das auf Clausewitz zurückgehende Verständnis vom "Krieg als Fortsetzung der Politik mit anderen Mitteln". Die Autoren problematisieren die Entstehung von neuen Kriegen, den globalen Markt der Kriegsführung mit seinen Risiken und Gefahren, die neuen Grenzverläufe zwischen den Staaten und die Entstehung einer neuen Kriminalität. Sie erörtern ferner die Frage, ob es überhaupt einen "gerechten Krieg" geben kann. Eine globale Wirtschaft, die nicht mehr zurückzunehmen ist, wird nach ihrer Meinung nicht zu einem Wohlstand für alle führen. Innerhalb dieses Systems sollte man sich vielmehr auf soziale Verwerfungen, Unsicherheiten, anomische Entwicklungen und Ausgrenzungen einstellen. Sie werden die Völker vor ganz neue Herausforderungen stellen, und dies wird die Welt nach dem 11. September sein, der zu einem symbolischen Datum zu werden scheint. Ob es sich dabei um eine Medienrhetorik oder um ein "Geschichtszeichen" handelt, bleibt noch abzuwarten. (ICI2)
