In the first part of the thesis, a literature review is presented. In this literature review, industrial areas in the Netherlands are discussed, leading to the conclusion that industrial areas are important for realizing sustainable economic growth in the Netherlands. Industrial areas play an important role in accommodating employment, in stimulating local and regional economies, and in creating a high value added. Furthermore, I conclude that process features have a significant influence on the outcome of industrial area (re)development projects. Subsequently, the most important problem aspects of the current industrial area planning approach are discussed, together with several causes of these problems. It is argued that most of these problematic failures can be traced back to one main problem: the rapid obsolescence of the existing stock of industrial areas. The dimensions of the Dutch industrial area redevelopment task affirm this. This creates a large necessity for redevelopment. However, based upon the disappointing figures on yearly realized redevelopment projects and on the low spatial yields of actually realized redevelopment projects, it is concluded that the execution of industrial area redevelopment projects stagnates. When starting up a redevelopment project in the current increasingly complex and rapidly changing environment, interdependent negotiation processes within and among organizations appear to be problematic, consuming substantial time and effort. Focus within this research lies therefore on studying, supporting and accommodating the consensus-building process within redevelopment projects. The point of departure in this research is the postulate that the main cause of the occurring stagnation in industrial area redevelopment is the absence of a well-functioning process governance system. Several authors support this statement; they posit that the regional arena is the appropriate level for executing such governance. Because of a lack of insight into effective ways to implement a governance system, and because of the presumed advantages related to the acceleration of industrial area redevelopment processes when gaining this insight, the general research objective is as follows: 'To explore ways to effectively support the governance of involved stakeholders' choice behavior, in order to stimulate the current decision-making processes in industrial area redevelopment projects'. Thus, governance – and especially meta-governance – is a promising approach for application to complex industrial area redevelopment projects. Several best-practice industrial area redevelopment projects reveal that centrally governing such alliances contributes to project success. The aim of meta-governance within industrial area redevelopment projects is to establish cooperation between relevant parties, in order to realize a number of functions and purposes from a public, social importance, through the establishment of one central governing agency, responsible for the management of the decision-making process. In Dutch industrial area redevelopment, regional development companies seem most appropriate for executing this central governance role. Assuming that meta-governance can be a solution to the occurring problems in the Dutch industrial area redevelopment market, it is essential to analyze the consensusfinding processes, as well as causes of tension and conflict, in order to theoretically support governing agencies in managing decision-making processes. Therefore, the specific goal of the research is to better understand how individual and interactive decision-making of the most important actors in industrial area redevelopment processes can be modeled, in order to analyze and predict the occurrence of cooperation or conflict, and how this decision-making can be influenced by a regional governing agency. A better understanding of these processes is a key requirement for the development of a decision support tool for this regional governing agency, in order to support the acceleration of industrial area redevelopment projects. A formal model of the collaborative decision process has not been developed for this domain, incorporating a governance approach. Therefore, several available techniques for analyzing both individual and interactive decision-making are explored in the second part of the thesis. From this, it is concluded that the discrete choice approach seems applicable for modeling individual choice behavior of actors. Furthermore, the application of game theory seems very interesting for modeling interactive and interdependent choice behavior. In order to make a game-theoretic model that is suitable for studying strategic interactions in industrial area redevelopment, a relatively new approach is advocated in which game theory is combined with a multiattribute trade-off technique. Eventually, the application of game theory leads to an insight in the occurrence of conflicts, and in the causes of these conflicts. The 2x2 game is regarded as most appropriate for application in this research because this game type has been used very often in conflict modeling and conflict management, and it suits the real world negotiation processes in which two players are involved, each roughly having two strategies. Within 2x2 games, three tools are most utilizable for solving conflicts: (1) changing the information of the involved players; (2) changing the payoffs of the players; and (3) changing the rules of the game, focusing on the sequence of decisionmaking and the possible allowance of communication in the game. Because the research focuses on static 2x2 games of complete information, it is concluded that gaining insight in the second tool is most feasible and interesting. In the third part, the results are represented. Firstly, the individual choice behavior of involved actors is modeled, thereby giving a better and more systematical insight in stakeholders' preferences when accepting or rejecting a development plan, in the (dis)similarities between both stakeholder groups' preferences in making that choice, and in the most important points of interest when composing a development plan proposal. Resulting data analysis showed that the plan attributes 'technical quality' and 'cost coverage' are important for both stakeholder groups when choosing a plan proposal. A high level of these attributes in a plan results in a high probability of being chosen, while a low level results in a low choice probability. Besides this, companies find the attribute 'development speed' very important when choosing a plan, and municipalities value 'architectural quality' highly. Furthermore, municipalities proved to be less demanding in accepting industrial area redevelopment plan proposals. Secondly, the interaction between involved stakeholders is modeled as an interdependent process, using a relative novel approach in which conjoint analysis and game theory are combined, in order to explain the occurrence of cooperation or conflict within Dutch industrial areas redevelopment negotiations. Data analysis reveals that there is one major source of conflicts; stakeholders choosing not to cooperate based upon the presented negotiation setting. A more in-depth analysis of negotiation settings ending up in mutual cooperation demonstrated that the appraisal of both stakeholders for the proposed development plan is the most influential factor, together with an eventual absolute difference between both players' appraisals. This leads to the conclusion that the content of proposed plans is very important in such negotiations; factors like power and risks play a secondary role. Thirdly, a model is created that supports the decision-making of a central governing agency. This model is based upon the results of the individual and interactive choice models, giving recommendations on how to put meta-governance into practice in industrial area redevelopment. The model consists of three major steps: (1) giving assistance in assessing the initial state of the negotiation; (2) calculating whether the possible conflict occurrence can be prevented by marginally changing the payoffs of both players; and (3) indicating how the equalizing of appraisals can be put into practice. This final step gives insight in the contribution of specific changes in plan proposals to solving the conflicts that are discovered in the first part. After testing the model, it is concluded that altering payoffs in games in order to avoid conflicts is very effective in these games. Furthermore, these payoffs can often be altered through the use of minimal resources. In cases in which the municipality values the proposed plan lower than the company – raising the levels of the attributes technical quality, architectural quality, and value development results most often in an equaling of both players' appraisals. Furthermore, the attribute architectural quality functions most often as the only solution. Reciprocally, in cases in which the company has a lower plan proposal appraisal, raising the levels of the attributes development speed, technical quality, and cost coverage most often results in an equal plan proposal appraisal. In general, tools are already available for executing interventions on above-mentioned attributes. Thus, focus should be on actual execution of the governance task, not on adding tools to the existing instrumental palette. Concluding, a model is created with which it is possible to give recommendations concerning the decision-making of a central governing agency in different possible industrial area redevelopment negotiations. It entails a new, structured way of solving conflicts, which is empirically testable, and delivers some real world recommendations.

Despite the relative effectiveness of recent reforms to the employment and skills system the Leitch Review (1996)identified some key problems. Welfare to work programmes had few incentives to focus on skills, job retention and progression; the skills system had little focus on employment outcomes; and the targets and incentives in both systems did not encourage a joined-up service for individuals or employers. The UK Commission for Employment and Skills (UKCES) subsequently proposed the integration of employment and skills provision and the use of outcome based commissioning. The Government is now seeking to implement such changes and to ensure that providers' success is defined and measured in terms of their responsiveness to labour market needs and the outcomes from their provision. Debates about outcome based commissioning and contracting, and their application to employment and skills provision, have frequently referred to the experience of other countries, especially the USA and Australia. The USA was the first to introduce explicit performance and outcome standards in its employment and skills system and to connect these with financial incentives and penalties. Australia has sought to create quasi markets in its vocational education and training and is the only OECD country to fully privatise its employment assistance system where a major part of provider income is dependent on securing job outcomes. This report assessed the commissioning and contracting processes through which employment and skills provision is procured in both these countries and sought to identify design and implementation issues that may have implications for the reforms currently being introduced within the British system. The findings reveal that in the USA and Australia respective federal Governments increasingly have set explicit performance and outcome targets within wider reform strategies designed to increase employment rates, reduce welfare dependency and increase skills attainment and utilisation. Performance management systems have been redesigned with public sector employment and skills delivery agencies subject to greater scrutiny and accountability and, where service delivery has been made contestable, challenged by the entry of other providers, including those from the private sector. There are multiple variations in the performance and outcome standards that apply to training and employment services but in the USA they typically include job placement rates, earnings, retention in employment and, for training programmes, skills and qualifications obtained. Studies in both countries show that delivery of employment and skills programmes is subcontracted to a wide range of public and private agencies with performance standards and outcome measures reflected in service delivery agreements and/or contracts with providers. The terms of such contracts differ widely, with varying amounts of provider income dependent on securing agreed outcomes or performance standards. Only in some welfare to work and employment programmes is a major part of provider income dependent on securing sustained job outcomes. It is important to note that these contracts are not exclusively outcome based and typically have other performance and process requirements embedded within them. Views on the success of such contracting systems are mixed and even where the results may appear impressive, it is difficult to disaggregate the impact of the outcome based contracting system from that of other policy changes. Moreover, whilst the cost and efficiency gains claimed for US and Australian models appear significant relatively little is known about how far these gains have been offset by high transaction costs or reduced service quality, especially for the most disadvantaged. There is evidence that minimising cream-skimming, creaming and parking are significant challenges in both public and private sector incentive and target driven delivery systems. Such risks may be reduced through contract design and oversight. The inclusion of measures related to job retention, wages and benefits, and earnings gains, for example, all help diminish any incentive to place participants into poor quality jobs. Measures indicating completion of assessments and activities and regular surveys of participant and employer experience help limit the ability of providers to service clients differently. The challenge is to design such process and outcome measures in ways that do not create unnecessary administrative burdens and allow providers flexibility in how they secure outcomes. The findings show that the implementation of performance and outcome based commissioning and contracting has been dynamic and that government agencies and 'purchasers' frequently have had to revise performance standards and contractual terms as problems have arisen and conditions have altered. In both countries there has been much 'learning by doing' and constant adaptation as officials have sought to establish performance management and payment structures that now aim to increase the duration of job outcomes, reduce creaming, integrate skills provision, improve service quality, and control any potential for perverse incentives or 'gaming' of systems. In this process much knowledge has been gained about different contracting models, the relationships between service delivery and performance incentives, and how to define relevant outcomes. This knowledge, and that developed within the UK, must inform policy makers' efforts as they seek to operationalise employment and skills outcomes, such as those proposed by UKCES, into more effective performance management and contracting systems. The review findings show that in both the USA and Australia there remain legitimate differences in the outcomes sought from 'work first' employment and welfare to work programmes and those sought from vocational education and training systems. Efforts to improve the connections and coordination between these 'work first' and skills development programmes are, however, hampered by these differences and by the distinct funding streams and bureaucratic mechanisms through which such outcomes are sought. Such problems are shared in the UK employment and skills system where variation in Government targets and incentives makes coordination and integration of services more difficult. This is particularly evident in the contrasts between the sustained job outcomes that DWP requires contracted employment providers to secure against the short term employment entries that enable Jobcentre Plus to meet its employment targets. It is also clear in the primacy given to qualification attainments in the skills system with less regard given to subsequent employment or whether the skills acquired are actually valued and utilised in the workplace. In addition to more general findings from this study there are three particular proposals that, when tested, might augment current efforts to better coordinate and integrate employment and skills provision in the UK. The first proposal concerns how to better integrate skills provision within DWP employment programmes for the long term unemployed. It concerns adapting the redesign of job focused outcome payments within the Job Services Australia system for use with FND and other contracted out DWP programmes. It would involve giving incentives to providers to broker training places with employers and rewarding them when participants they have helped access training are placed in jobs that make use of the skills developed. The second proposal concerns enhancements in the assessment of the employment outcomes from skills programmes and of the qualifications gained. This should involve the use of enrolment and destinations data, collected administratively or through leavers' surveys, to establish the employment and wage rates of participants. Such data could be used to establish whether participants improved their employment position as a result of their training and the extent to which they utilise any skills gained in their current employment. Such data could be combined into a measure of workforce quality as suggested in Australia. Finally there would be value in swiftly reviewing the many contrasting outcome requirements that exist within the British employment and skills system, and in how they are measured, with a view to developing 'common performance' or 'return on investment' measures, similar to those being developed in the USA. Such agreed common measures would help minimise different performance, outcome and reporting requirements and facilitate co-commissioning and the alignment of skills and employment funding. They also would help facilitate greater coherence in the performance and outcome standards that providers have to meet. At the same time such a review could critically audit the varying contracting and financial practices of the different public agencies involved in procuring skills and employment provision. The aim should be how to simplify such requirements and, if budgets cannot be integrated, to consider the extent to which 'master contracts' might reduce complexity in the system and assess whether employment and skills purchasing might be better managed by the recently proposed single professional procurement agency.

The training of teachers, particularly those of the first cycle of basic education is at theepicenter of educational issues that arise in Mali. Indeed, measures of macroeconomicadjustment in the 1980s led the country at that time to the closure of schools and teachertraining to early retirement of most experienced teachers. A decade later, theinternational community took a stand Jomtien Education for All (EFA). The pursuit of this objective has required the implementation of alternative strategiesincluding the opening of education to private and community and the use of contractteachers, under the Ten-Year Programme of Development of Education (PRODEC). Contract teachers are theoretically unemployed graduates of various training profiles.But there is also meeting with school leavers without qualifications. They receivetraining from 30 to 45 days before being poured into education. If they have theadvantage of being less expensive than professional teachers, they are also less welltrained. The proliferation of types of schools (public, private, community, basic schools, villageschools, etc.) Induced a policy of opening up education to private and communitycombined with the massive teaching staff with qualifications and skills is variable, andmost often very low, has undoubtedly helped accelerate the pace of enrollment in Mali.However, these measures have led to a de-professionalization of teachers and thesegmentation status of teachers, with the resulting low requirement with respect to thequality of teaching-learning situations. To address this problem, the Ministry of Education has developed and adopted in 2003a policy of initial and continuing training of teachers. This policy develops distancelearning and ICT integration in education as alternatives to the professionalization ofteachers in a relatively short time and at lower cost. Thus, through various partnerships,experiments have been initiated at the institutional level: the program of trainingteachers through Interactive Radio (FIER) with support from USAID in 2004 and theproject in 2006 from Cyber_Edu a partnership agreement between UNCTAD, the Canton of Geneva and the Ministry of Communication and New Technologies (MCNT)acting on behalf of the Government of Mali. The FIER program has positioned relative to the use of radio in the training of primaryteachers and their coaching staff and the integration of ICT in the faculty developmentoffering training to teachers in MFI to offer them opportunities for self-training throughthe use of ICT, as the project Cyber_Edu who has also chosen to promote ICT anddigital pedagogy in the training of teachers and trainers. These projects have undoubtedly saved the results in the pursuit of these goals, but if itremains questionable particularly as regards ICT integration and digital teaching andlearning in the professional practices of teachers. Indeed, the analysis shows that theseexperiments have not been without difficulties, difficulties that have marred the resultsto be achieved. Among the many difficulties that have hampered the operationalizationof one or other of these projects, the study pointed to the quality of the equipment,motivation of players and their effective involvement of beneficiaries, due to a poorlydefined political vision and level of preparation that has not taken sufficient account ofthe socio-economic field from the point of view of the technical architecture andeducational devices. Hence the gap between rhetoric and political stances in favor of the country'sintegration into the information society and knowledge economy in which the schoolshould be the crucible and the integration of this vision into policies and developmentplans in general and particularly in the development of sector education and training. Without the definition of a political vision sufficiently clear and coherent, the goldenage of the Distance Education (ADF) and the Information Technology andCommunication for Education (ICTE) in Mali is not for tomorrow. The first and maincontribution of this research, the second being really not, especially since it is acommonplace on the importation of all initiatives and development activities, withouthowever, that they are likely to spur a real momentum of development. The mainreason, as it appears in the analysis of the devices mentioned here, is that scientific rigorbefitting the establishment and implementation of such innovation is not the most oftenobserved in its principles and its conditionalities. This raises the need to rethink theNorth-South scientific cooperation in the direction of a true intellectual and financial involvement of countries likely to spread, and to the goals of development andempowerment. ; La formation continue des enseignants notamment, ceux du premier cycle del'enseignement fondamental est à l'épicentre des questions éducatives qui se posent auMali. En effet, les mesures d'ajustement macro-économique des années 1980 ontconduit à cette époque le pays à la fermeture des écoles de formation d'enseignants et àla mise à la retraite anticipée des enseignants les plus expérimentés. Une décennie plustard, la communauté internationale réunie à Jomtien prenait position pour l'Educationpour tous (EPT). La poursuite de cet objectif a nécessité la mise en œuvre de stratégies alternatives dontl'ouverture de l'enseignement à l'initiative privée et communautaire et le recours auxenseignants contractuels, dans le cadre du Programme décennal de développement del'éducation (PRODEC). Les enseignants contractuels sont théoriquement des diplômés sans emploi de diversprofils de formation. Mais, on y rencontre aussi des déscolarisés précoces sansqualification. Ils suivent une formation professionnelle de 30 à 45 jours avant d'êtreversés dans l'enseignement. S'ils présentent l'avantage d'être moins coûteux que lesenseignants professionnels, ils sont aussi moins bien formés. La multiplication des types d'écoles (publiques, privées, communautaires, écoles debase, écoles du village, etc.) induite d'une politique d'ouverture de l'enseignement àl'initiative privée et communautaire conjuguée à l'engagement massif de personnelenseignant disposant de qualifications et de compétences variables de fait, et le plussouvent très faibles, a sans doute, permis une accélération du rythme des scolarisationsau Mali. Cependant, ces mesures auront conduit à une déprofessionnalisation desenseignants et à la segmentation des statuts du personnel enseignant, avec commecorollaire une exigence peu élevée à l'égard de la qualité des situations d'enseignement-apprentissage. En vue de répondre à cette problématique, le Ministère de l'éducation nationale aélaboré et fait adopter en 2003 une politique de formation initiale et continue desenseignants. Cette politique conçoit la formation à distance et l'intégration des TIC dansl'éducation comme des alternatives à la professionnalisation des enseignants dans undélai relativement court et à moindre coût. Ainsi, dans le cadre de divers partenariats, des expériences ont été mises en chantier au plan institutionnel : le programme deFormation interactive des enseignants par la radio (FIER) avec l'appui de l'USAID en2004 et le projet Cyber_Edu en 2006 issu d'un accord de partenariat entre la CNUCED,le Canton de Genève et le Ministère de la communication et des nouvelles technologies(MCNT) agissant au nom du gouvernement du Mali. Le programme FIER s'est positionné par rapport à l'usage de la radio dans la formationdes enseignants du primaire et du personnel chargé de leur encadrement et l'intégrationdes TIC dans le perfectionnement des professeurs assurant la formation initiale desenseignants en IFM, en vue d'offrir à ceux-ci des opportunités d'auto-formation parl'utilisation des TIC, à l'instar du projet Cyber_Edu qui a, lui aussi, choisi depromouvoir les TIC et la pédagogie numérique dans la formation continue desenseignants et des formateurs. Ces projets ont, sans doute, enregistré des résultats dans la poursuite de ces objectifs,même si cela reste discutable notamment, en ce qui concerne l'intégration des TIC et dela pédagogique numérique dans les pratiques professionnelles des enseignants. En effet,l'analyse montre que ces expérimentations n'ont pas été sans difficultés, des difficultésqui ont entaché les résultats susceptibles d'être atteints. Parmi ces nombreusesdifficultés qui ont entravé l'opérationnalisation de l'un ou autre de ces projets, l'étude apointé du doigt la qualité des équipements, la motivation des acteurs bénéficiaires etleur implication effective, conséquence d'une vision politique mal définie et d'unniveau de préparation qui n'a pas suffisamment tenu compte des réalités socioéconomiques du terrain du double point de vue de l'architecture technique etpédagogique des dispositifs. D'où le fossé qui sépare les discours et prises de position politique en faveur del'insertion du pays dans la société de l'information et dans l'économie du savoir dontl'école devrait être le creuset et l'intégration de cette vision dans les politiques et plansde développement en général et, en particulier dans le développement du secteur del'éducation et de la formation. Sans la définition d'une vision politique suffisamment claire et cohérente, l'âge d'or dela Formation à distance (FAD) et des Technologies de l'information et de lacommunication pour l'éducation (TICE) au Mali n'est pas pour demain. C'est la première et la principale contribution de cette recherche ; la seconde n'étant vraimentpas une, d'autant qu'il s'agit d'un lieu commun relatif à l'importation de toutesinitiatives et actions de développement, sans pourtant que celles-ci soient enclines àimpulser une véritable dynamique de développement. La principale raison, comme ilapparaît dans l'analyse des dispositifs dont il est question ici, tient au fait que la rigueurscientifique qui sied à l'implantation et à la mise en œuvre de ce type d'innovation n'estpas le plus souvent observée dans ses principes et dans ses conditionnalités. Cela pose lanécessité de repenser la coopération scientifique Nord-Sud dans le sens d'une véritableimplication intellectuelle et financière du pays susceptible de faire tache d'huile etpermettant l'atteinte des objectifs de développement et d'autonomisation.

Inhaltsangabe: Einführung: Die vorliegende Masterarbeit beschäftigt sich im Allgemeinen mit dem Umgang mit Wandel. Der Fokus liegt dabei auf den Mitarbeiterinnen und Mitarbeitern öffentlicher Verwaltungen. Im Speziellen wird ihre Bedeutung für den Erfolg von Veränderungen, welche durch Entwicklungen im Bereich der Informationstechnik (IT) hervorgerufen werden, betrachtet. Dies stellt insofern eine interessante Thematik dar, da die spezielle Mischung aus 'Beschäftigten', 'IT' und 'öffentliche Verwaltung' in der bisherigen Change Management-Literatur noch eine relativ dünn betrachtete Kombination ist. Zu Beginn dieses Kapitels werden die Lesenden zunächst zum Thema hingeführt, bevor anschließend das mit dieser Arbeit verfolgte Ziel dargelegt wird. Die Einführung endet schließlich mit einem Überblick über den Aufbau der Arbeit. 1, Hintergrund und Aktualität: Ob auf Messen für den Öffentlichen Sektor oder in aktuellen Verwaltungszeitschriften, ohne Change Management scheint in der öffentlichen Verwaltung nichts mehr zu gehen. In den letzten Jahren gewann dieser Begriff zunehmend an Bedeutung. Mittlerweile ist er nicht mehr nur in der Privatwirtschaft anzutreffen, sondern hält auch verstärkt im Bereich des Public Managements Einzug. Doch warum dieses neuerlich so starke Interesse am Management von Veränderungen? Wie der Titel des 2008 erschienenen Buches mit den Briefen von Charles Darwin (1822-1859) treffend lautet, gibt es nichts Beständigeres als den Wandel. Und da Wandel also etwas Alltägliches ist, bedarf es auch der Fähigkeit, angemessen auf diesen reagieren zu können. Dies gilt nicht nur für Individuen, sondern auch für Organisationen. Doch gerade im Hinblick auf eine immer dynamischer werdende Umwelt und der damit verbundenen stetig steigenden Veränderungsgeschwindigkeit wird der erfolgreiche Umgang mit Veränderungen noch bedeutsamer. Internationalisierung, aber auch die Globalisierung der Märkte führen zu einem verschärften Wettbewerb und damit zu einem höheren Anpassungsdruck von Organisationen. Doch nicht nur die Privatunternehmen müssen sich zunehmend mit Umwelteinflüssen und damit verbundenem Anpassungsdruck beschäftigen. Auch nimmt der Reformdruck auf die öffentliche Verwaltung weiter zu. So hat sich am negativen Image der öffentlichen Verwaltung nicht viel geändert. Sie gilt unter anderem immer noch als wenig fortschrittlich, kundenunfreundlich und allen voran als unwirtschaftlich. Somit besteht auch für die öffentliche Verwaltung ein Zwang zur Veränderung. Innovative Lösungen sind hier in gleicher Weise gefragt wie in der Privatwirtschaft. Damit verbunden ist die nicht erst seit kurzem erhobene Forderung nach dem Einsatz betriebswirtschaftlicher Konzepte im Bereich des öffentlichen Sektors. So hielten insbesondere seit Anfang der 90er Jahre, mit dem von der KGSt aus dem New Public Management abgeleiteten Neuen Steuerungsmodell, zahlreiche betriebswirtschaftliche Instrumente verstärkt Einzug in die öffentliche Verwaltung. Dazu gehören unter anderem Doppelte Buchführung, Marketing, Controlling sowie Qualitätsmanagement. Doch ist es der technisch induzierte Wandel, der immer mehr an Bedeutung gewinnt. Der rasante Fortschritt im Bereich der Informationstechnik und deren verstärkte Verbreitung und Nutzung erfordert eine ständige Anpassungsfähigkeit der Verwaltungen und der darin tätigen Mitarbeiterinnen und Mitarbeiter. Die Realisierung des vor zehn Jahren aufkommenden Themas Electronic Government (eGovernment) stellt die Verwaltungen vor eine enorme Herausforderung und wird dies auch noch einige Zeit tun. Denn dass in Deutschland noch Nachholbedarf bei der Einführung von eGovernment besteht, zeigt die aktuelle Studie von Capgemini, wo Deutschland auf den 15. Rang von 31 untersuchten Ländern bei vollständig elektronisch verfügbaren Diensten und auf Platz 12 bei der Verfügbarkeit von Online-Diensten zurückfiel. Mit der im Jahre 2006 beschlossenen EG-Dienstleistungsrichtlinie wurde die Umsetzung von eGovernment – zumindest auf dem Gebiet der unternehmensbezogenen eGovernment-Dienstleistungen – forciert. Auch wenn die Umsetzungsfrist bereits Ende 2009 auslief, so haben die Verwaltungen, wie aus einer Studie von MATERNA und der Hochschule Harz hervorgeht, noch einen weiten Weg vor sich. Die Realisierung der EG-Dienstleistungsrichtlinie und allgemein von 'eGovernment' stellt enorme Anforderungen an die Verwaltungen dar. So kommt eGovernment einem fundamentalen Wandel gleich und steht förmlich für ein neues Paradigma des Verwaltungshandelns. Doch gelten gerade Reformen in der öffentlichen Verwaltung als schwer durchführbar. Aufgrund ernüchternder Erfahrungen werden Verwaltungen sogar teilweise als reformresistent dargestellt. Dabei wird doch eine Vielzahl von erfolgreich erscheinenden Strategien und Konzepten erarbeitet, wofür sogar hohe Summen an Beratungsunternehmen gezahlt werden. Doch warum bleiben dennoch zahlreiche Reformen erfolglos und was heißt überhaupt 'erfolgreich'? In aller Regel wird Erfolg an den gesetzten (Projektmanagement-)Zielen (z. B. veranschlagter Zeitrahmen, Budget und geplanter Umfang des Wandels) gemessen. Doch werden diese nicht immer wie gewünscht erreicht. Im schlimmsten Fall werden Reformprozesse während der Umsetzung oder bereits im Vorfeld abgebrochen, sodass sie sprichwörtlich scheitern. Doch ist Erfolg nicht nur an den kurzfristigen, im Vorhinein der Veränderung geplanten Projektmanagement-Zielen zu messen, sondern auch an langfristigen. Denn selbst wenn ein Veränderungsprojekt auf den ersten Blick erfolgreich durchgeführt wurde, kann sich im Nachhinein herausstellen, dass es dies tatsächlich überhaupt nicht oder nur teilweise der Fall war. Veränderungen können sogar im Nachhinein wieder rückgängig gemacht werden. Ebenfalls zu bedenkende, langfristige Ziele sind beispielsweise eine verbesserte Leistungsfähigkeit, die Zufriedenheit mit der eingeführten IT und die Akzeptanz dieser. Diese drei eben genannten Ziele führen zu den Beschäftigten der öffentlichen Verwaltung. So bleiben viele Reformen im öffentlichen Bereich erfolglos, da das Personal die Veränderungen nicht mitträgt. Gerade bei den im Rahmen von eGovernment und der Umsetzung der EG-Dienstleistungsrichtlinie durchgeführten IT-Projekten wird über auftretende Widerstände seitens der Beschäftigten geklagt. Somit wird deutlich, dass es langfristig vor allem ihrer Akzeptanz und Nutzung der IT bedarf. Von der Leistungsfähigkeit der IT kann nur profitiert werden, wenn sie die Mitarbeiterinnen und Mitarbeiter auch in ihrer täglichen Arbeit einsetzen. Hierzu ist in der Literatur eine hohe Anzahl an Modellen anzutreffen, wobei der Ursprung dieser bei Maslows Bedürfnispyramide gesehen wird. Aktueller ist dagegen die Einteilung von Grawe in vier Grundbedürfnisse. Das psychische Bedürfnis nach Kontrolle (und Orientierung) stellt dabei das wichtigste dieser dar. Denn eine Verletzung der anderen drei Bedürfnisse (Bindung, Selbstwerterhöhung, Lustgewinn und Unlustvermeidung) geht meist mit einer Verletzung des Kontrollbedürfnisses einher. Bei diesem Bedürfnis handelt es sich um den Wunsch 'etwas tun zu können, was zur Herbeiführung und Aufrechterhaltung der eigenen Ziele wichtig ist'. Somit ist dieses Bedürfnis immer aktiviert, wenn wichtige Ziele betroffen sind. Es geht nicht nur darum, Wirkungen erfolgreich durch eigenes Verhalten in einer aktuellen Situation zu kontrollieren, sondern auch um die Erhaltung eines größtmöglichen Handlungsspielraums in der Zukunft. Voraussetzung für Kontrolle ist die Orientierung, welche meint, 'dass man einen zutreffenden Überblick über die Situation hat'. Zur Erreichung von Grundbedürfnissen werden motivationale Ziele gebildet, welche wiederum das Verhalten direkt prägen. Werden die motivationalen Ziele erreicht und damit die Grundbedürfnisse ausreichend und ausgeglichen erfüllt, so liegt nach Grawe Konsistenz, andernfalls Inkonsistenz, vor. Inkonsistenz stellt einen Zustand dar, welcher von Menschen vermieden wird. Somit sind sie bestrebt, im Sinne der zur Erreichung der Grundbedürfnisse gesteckten motivationalen Ziele wahrzunehmen. Im Laufe der Zeit entwickeln Menschen auf Basis dieser Ziele und ihrer gemachten Erfahrungen bestimmte Schemata. Die gebildeten motivationalen Schemata sind konkret auf Situationen ausgerichtet und beinhalten neben den Zielen auch Erwartungen und Handlungsanleitungen. Diese Schemata stellen letztendlich Mechanismen zur Vermeidung bzw. Beseitigung von Inkonsistenz dar. Damit sollen also die Grundbedürfnisse befriedigt oder vor Verletzung geschützt werden. Im ersten Fall folgt sozusagen eine Annäherung an die Situation und im zweiten eine Vermeidung dieser. Je nachdem ob sie befriedigt oder geschützt werden sollen spricht Grawe von entwickelten Annäherungs- oder Vermeidungsschemata. Stimmen die Wahrnehmungen der Realität nicht mit diesen überein (und werden somit die zugrunde liegenden motivationalen Ziele verfehlt) so entsteht Stress, den Grawe als Inkongruenz bezeichnet. Bei unerwarteten Ereignissen, bei Unerwünschtem, aber auch wenn etwas erwünscht ist, jedoch nicht eintritt oder verloren zu gehen droht, wird das Kontrollbedürfnis aktiviert. Je nachdem ob der Wandel als kontrollier- oder nicht kontrollierbar bewertet wird, kann Widerstand die Folge sein. Wird der bevorstehende Wandel als eine vorteilhafte und lösbare (kontrollierbare) Herausforderung angesehen, so ist es möglich, dass die Betroffenen ihre Anstrengungen hinsichtlich der Bewältigung erhöhen. In diesem Fall folgt sozusagen eine Annäherung und damit kein Widerstand. Doch ist bei Veränderungen für die Betroffenen nicht immer ein positiver Nutzen erkennbar. Es kann sogar eher Schaden oder eine Bedrohung wahrgenommen werden. Sind wichtige Ziele bedroht und wird die Kontrollierbarkeit aufgrund begrenzter individueller Möglichkeiten als gering eingestuft, so entsteht Angst. Grawe bezeichnet Angst als zentrales 'Alarm- und Abwehrsystem des Organismus'. Angst vor Veränderung gilt als natürliche Reaktion auf eine bedrohliche unkontrollierbare Inkongruenz, also auf Stress. Um den Stress und die damit verbundene Angst abzuwenden, werden Vermeidungsziele aktiviert. Diese bilden die Grundlage für das Verhalten und können sich in aktiver Resistenz bemerkbar machen. Um die mit dem Stress verbundene Angst abzuwenden, leisten die Betroffenen Widerstand. Grundlage von Widerstand können erhebliche Abweichungen zwischen Organisations- und persönlichen Interessen sein. Denn werden die Ziele der Verwaltung als gefährlich oder beeinträchtigend für die persönlichen Interessen gesehen, reagieren die Betroffenen mit Widerstand. Doch auch wenn die Beschäftigten Widerstand leisten, bedeutet dies nicht, dass sie von vornherein gegen den Wandel sind. Denn es ist meist die bestehende Unsicherheit, weshalb Veränderungen negativ gesehen und deshalb vermieden werden. In der Literatur werden eine Reihe von, dem Widerstand zugrunde liegende Ängste aufgeführt. So ist im Zusammenhang mit IT eine Angst vor Überforderung möglich. Diese tritt auf, wenn befürchtet wird, den künftigen Herausforderungen nicht gewachsen zu sein. Gerade bei technischen Neuerungen ist diese Angst verstärkt anzutreffen. Daneben existiert die Furcht beispielsweise vor Versetzung und dem damit verbundenen Verlust sozialer Beziehungen. Neben der Angst spielt auch Wut als Emotion bei der Entstehung von Resistenz eine entscheidende Rolle. Hintergrund kann zum Beispiel sein, wenn sich die später Anwendenden nicht genug in den Veränderungsprozess einbezogen, d. h. ausgeschlossen und übergangen fühlen. Wird nicht das eigene Fachwissen von der Führung genutzt, so kann dies zu Verärgerung aufseiten der Betroffenen führen. Der auf Beseitigung von Stress und der davon begleiteten Wut zielende Widerstand dient dazu, das eigene Selbstbild und damit die eigenen Ideen, Konzepte usw. zu schützen. Hier kann auch vom sog. 'Not invented here'-Syndrom gesprochen werden. Darunter ist eine ablehnende, nicht rationale, sondern emotionale Grundeinstellung gegenüber fremd initiierten Veränderungsprozessen zu verstehen, also Veränderungen, die von anderen und nicht von einem selbst kommen. Wut beseitigender Widerstand kann sich beispielsweise darin ausdrücken, indem versucht wird, zu demonstrieren, dass die Software als fertige Lösung in der speziellen Situation nicht wie prognostiziert funktioniert. Kraus et al. sprechen weiterhin den 'Boykott' der Software an, der sich in einer nur rudimentären Nutzung zeigen kann. Neben dem bereits Gesagten können Widerstände auch auf die durch den Wandel wahrgenommenen Bedrohungen des eigenen Status, des Ansehens und der Macht zurückgeführt werden. Statusverluste können beispielsweise auf dem Verlust der Wissensherrschaft beruhen. Gerade bei Experten mit langjährigen Erfahrungen (z. B. IT-Wissen, Prozesswissen) kann diese aufgrund von Neuerungen verloren gehen. So ermöglichen es gerade Wissensdatenbanken geistiges Kapital anderen zugänglich und damit transparent zu machen. Transparenz bei IT bedeutet auch, dass jegliche Mitarbeiterinnen und Mitarbeiter jederzeit auf sämtliche von anderen produzierte Daten zugreifen können. So werden eigene Fehler besser nach außen erkenn- und nachvollziehbar. Mittels personen- und rollenspezifischer Benutzerkonten besteht zudem durch statistische Auswertung eine höhere Kontroll- und Vergleichbarkeit der Arbeitsleistung. Die Möglichkeit der förmlichen 'Überwachung' kann als Kontrollverlust empfunden werden. Dieser kann wiederum zu Widerstand führen. Widerstand kann darüber hinaus auch aus der Wut heraus entstehen, wenn sich Akteure im Zusammenhang mit der Veränderung ungerecht behandelt fühlen. Ungerechtigkeit kann zum Beispiel bei nicht entschädigter Mehrarbeit empfunden werden. Dasselbe gilt auch bei Lernaufwand, der notwendig ist, um sich IT-Kenntnisse anzueignen. Auch wenn sich Mitarbeiterinnen und Mitarbeiter stärker als andere negativ betroffen sehen, kann ein Gefühl der Ungerechtigkeit entstehen. Dieses Gefühl kann nach der Gleichheitstheorie (Equity-Theory) erklärt werden. Danach besteht Ungleichheit, wenn die subjektive Aufwands-Ertrags-Relation positiv oder negativ im Vergleich zu anderen Individuen oder der Organisation abweicht. Im Falle einer solchen Abweichung wird versucht, die Spannung (Inkonsistenz) zu reduzieren bzw. zu vermeiden. Fühlt sich ein Individuum ungerecht, im Vergleich zu anderen Beschäftigten, von der Veränderung betroffen, da es deutlich höhere Verluste hinnehmen muss, so kann Widerstand die Folge sein. Damit wird sich gegen die subjektiv wahrgenommene Ungerechtigkeit zur Wehr gesetzt. Bei der Gleichheitstheorie beruht das Empfinden einer Ungleichheit auf der subjektiven Wahrnehmung dieser. Doch kann die Wahrnehmung auch erheblich von der Realität abweichen. Als eine weitere Ursache von Widerstand ist daher auch eine verzerrte Wahrnehmung möglich. Resistenzen sind auch auf, in der Vergangenheit bei Veränderungen gemachte Erfahrungen zurückführbar Viele ehemalige als nicht erfolgreich erlebte Projekte können zum Beispiel Grund dafür sein, dass auch nicht an den Erfolg des neuen IT-Projekts geglaubt wird. Zudem können sich diese Erfahrungen nicht nur auf das derzeit aktuelle Veränderungsprojekt, sondern auch allgemein auf die zukünftige Wandelfähigkeit auswirken. Denn die Betroffenen können sich an Erfolge bzw. Misserfolge gewöhnen und daraus lernen. Für das Lernen sind allerdings nicht die tatsächlichen Erfolge oder Misserfolge ausschlaggebend, sondern die persönlich als unangenehm wahrgenommenen Erfahrungen einzelner Betroffener. Nach der Theorie der kognitiven Dissonanz von Festinger erfolgen Konfliktlösungen i. d. R. nicht rational. Vielmehr beruhen sie auf der Vermeidung von Unstimmigkeit und Widersprüchlichkeit. Zur Vermeidung von Dissonanz werden daher Strategien zum Schutz der bestehenden Werte und Einstellungen entwickelt. Aus diesem Grund werden konsonante Informationen auch eher als dissonante wahrgenommen. Durch Filterung, Umdeutung oder Ablehnung der aufgenommenen Reize sollen bei Überzeugung gegen den Wandel, alle für den Wandel sprechenden Argumente usw. abgewehrt werden. Damit wird die negative Einstellung gegenüber dem Wandel verstärkt. Diesen Abschnitt noch einmal kurz zusammenfassend stellt das Streben nach Wahrnehmung im Sinne der eigenen motivationalen Ziele (Kongruenz) zur Erreichung der Grundbedürfnisse (Konsistenz) die Grundlage des 'psychischen Geschehens' dar. Ist die Erfüllung wichtiger Ziele in Gefahr so entstehen Stress und negative Emotionen wie Angst. Zum Schutz der Ziele und Vermeidung von Stress wird mit Widerstand reagiert. Somit stellt dies eine normale Reaktion der betroffenen Akteure dar.

Aus der Einleitung: Wer mag es nicht, gelobt und ausgezeichnet zu werden? Lob und Anerkennung lösen nicht nur Gefühle in einem aus, sondern können Erfolg mit sich bringen, wenn man dieses Lob anderen mitteilt bzw. öffentlich macht. Im Falle von Agenturen und Kreativwettbewerben ist das Präsentieren des Erfolgs, hier Awards, ein optimaler Nährboden für ein wachsendes Image. Dies erfolgt i. d. R. automatisch durch die Presse, da diese bei Wettbewerbsverleihungen oder Festivals anwesend ist und durch seitens der Kreativwettbewerbe, welche oftmals Jahrbücher oder anderweitige Publikationen herausbringen. Am Anfang des 20. Jahrhunderts gab es bereits erste Kreativwettbewerbe wie z. B. den Art Directors Club New York. Diese fanden jedoch nur in Amerika statt, denn in den goldenen Zwanzigern stand die deutsche Werbebranche erst an ihrem Anfang, wenn man sich den Kontrast zu heute vor Augen hält. Werbeagenturen, so wie man sie heute kennt, u. a. als Full-Service-Dienstleister, gab es damals noch nicht. Im bald darauf folgenden 2. Weltkrieg konnte sich auch kein selbstständiger Werbemarkt entwickeln, so dass die bedeutenden Anfänge erst auf die Zeit nach Ende des Krieges zurückzuführen sind. Beispielsweise ist 1948 der Deutsche Dialogmarketing Verband e. V. (kurz: DDV) gegründet worden, welcher zu jener Zeit noch ADV (Arbeitsgemeinschaft der Adressenverleger) hieß und erst ab 1985 durch ein erweitertes Verständnis und technische sowie methodische Fortschritte des Direktmarketings umbenannt wurde. Mit der steigenden Entwicklung der Wirtschaft fing auch der deutsche Werbemarkt an zu blühen und die Anzahl der Kreativwettbewerbe wuchs, was zugleich bedeutet, dass die Nachfrage an Awards damals bereits schon präsent war. Einige Werbeagenturen, die aus dieser Zeit entstanden und auch heute noch beständig sind, wie z. B. McCann Erickson, investieren seitdem regelmäßig in Kreativwettbewerbe und nehmen somit hohe Kosten, Stress und Zeitaufwand in Kauf, um eventuell einen Award zu erhalten, denn inzwischen sind Einreichungen aus allen Nationen an der Norm und die Konkurrenz ist groß. Da stellt sich einem Außenstehenden die Frage: Warum machen die das? Neben Awards existieren auch Rankings für Agenturen, kategorisiert in Kreativ- und Agenturrankings, welche z. B. durch Zeitungen Zeitschriften wie wv, Horizont oder manager magazin veröffentlicht werden. Steht eine Agentur in einem Ranking, so zählt diese i. d. R. zu den erfolgreichen Werbeagenturen in Deutschland. Dass Awards die Position in einem Ranking fördern, ergibt sich aus der Tatsache, dass viele Rankings auf der Anzahl der erzielten Awards mit jeweiligem Punktewert beruhen. Diese Anzahl bezieht sich teilweise nur auf das jeweilige Jahr, manchmal aber auch auf die bestehende Existenz der jeweiligen Agentur. "Für einen Top-Platz im jährlichen Kreativranking investieren Agenturen wie Jung von Matt oder DDB Germany bis zu siebenstellige Beträge. Und darin sind Kosten für Aufbereitung, Übersetzungen oder die Produktion von Gold-Ideen nicht enthalten. Sie verdoppeln bis verdreifachen den Kostenblock". Hält man sich das Ausmaß dieser Kosten vor Augen, so wird die Frage nach dem "Warum" intensiviert. Welchen Nutzen haben Werbe-/Kommunikationsagenturen in Deutschland davon, beachtliche Beträge "riskant" in etwas zu investieren, wo sie möglicherweise auch verlieren können. Warum sind Awards so begehrt und was bewirken Sie in einer Agentur? Dienen Sie nur einem Ranking und dem damit verbundenen Image oder gibt es auch andere Nutzfaktoren von Awards, die den Erfolg einer Agentur beeinflussen? Werden Werbekunden durch Auszeichnungen einer Agentur potenziell beeindruckt? Werbekunden, die hohe Summen in Ihre Werbung investieren, verlangen im Gegenzug Professionalität, Know-How und kostenbewusstes Denken, denn "eine gute Werbeagentur sollte in erster Linie nicht nur kreativ, sondern auch in der täglichen Arbeit perfekt sein". Diese Kompetenzen werden von vielen Agenturen in Deutschland mitgebracht, sofern die bezugnehmende Messlatte, bei der Bewertung einer Agentur, einem gesunden Mittelwert entspricht. Denn für den Einen ist eine Werbeagentur ab einem gewissen Grad schon professionell, für den Anderen reicht dieser Grad für eine Zusammenarbeit mit der Agentur nicht aus. Werbeagenturen werden von Unternehmen vor allem als ausführende Dienstleister und Berater gesehen. Doch durch welche Faktoren wählen Unternehmen ihre Agenturen aus? Diese Frage wissenschaftlich zu belegen, ist nicht Teil dieser Untersuchung, dennoch muss sie gestellt werden, um auf die folgende Frage eingehen zu können: Spielen Awards eine Rolle bei der Auswahl der Agentur? Denn dieser Fakt würde den Erfolg der Agentur aus einer Richtung positiv beeinflussen. Obwohl eine Studie von Unternehmensbefragten aus wv zeigt, dass es unwichtig ist, "ob die Agentur immer wieder gut für Awards oder international (im Ranking) aufgestellt ist", ist es nur schwer vorstellbar, dass Awards, teilweise mit Gold, Silber oder Bronze belegt, prämiert von renommierten Jurys, keine oder nur wenige Beweggründe für die Auswahl einer Werbeagentur darstellen. Denn eine Auszeichnung bedeutet eigentlich etwas Positives. Darüber hinaus müssen Agenturen häufig hohe Beträge für ihre erzielten Awards bezahlen, was eigentlich darauf schließen lässt, dass diese in irgendeiner Weise erfolgreich sein müssen, da sie es sich leisten können, in Kreativwettbewerbe zu investieren. Andererseits kann ein Werbekunde aber auch denken, die Agentur sei aufgrund der erzielten Awards in ihren Leistungen teurer geworden und wählt diese aufgrund ihrer Auszeichnungen nicht aus. In diesem Fall wären Awards eher contraproduktiv. Desweiteren können Profilierung und Persönlichkeit ein Grund für die Teilnahmen an Kreativwettbewerben sein, gerade in der Spitze der Kreativsten im Land, z. B. bei Jung von Matt, wie auch eine Umfrage des Handelsblatt Absatzwirtschaft und Innofact bestätigt. Diverse Gründe scheinen jedenfalls zu bestehen, denn die Einreichungen an Kreativwettbewerbe belaufen sich pro Jahr teilweise auf 8689 pro Wettbewerb. Auch für internationale Kreativwettbewerbe wie z. B. der Eurobest, weisen deutsche Agenturen ein großes Interesse auf. "Mit zwei Grand Prix, elf Gold-, 29 Silber- und 38 Bronze-Awards ist Deutschland die erfolgreichste Nation bei Eurobest. Allerdings reichten hiesige Werbe auch am Fleißigsten ein". Obwohl dabei internationale Jurys werten und für den deutschen Markt, sowie für die psychologische Beschaffenheit der deutschen Konsumenten internationale Maßstäbe angelegt werden, stellt die Teilnehmeranzahl ein großes Potential dar. Denn deutsche Werbung wird dann etwa so bewertet, als ob sie Engländern gefallen sollte, wobei die Deutschen selten gut dabei wegkommen . Doch das hält viele Agenturen nicht davon ab, es immer wieder zu versuchen und regelmäßig an Kreativwettbewerben teilzunehmen. In den letzten Jahren hat es massig Einreichungen an Kreativwettbewerbe gegeben, was auch die Referenzen diverser, erfolgreicher Agenturen belegen. Und wie sieht es mit der aktuellen Wirtschaftskrise 2008/2009 aus? Hat diese einen Einfluss auf erfolgreiche Agenturen und damit auch auf deren zukünftiges Teilnahmeverhalten an Kreativwettbewerben, was letztlich auch einen Einfluss auf die Kreativwettbewerbe selbst nehmen würde? Oder sind Awards unerlässlich und quasi "notwendig", weshalb Agenturen trotz Krise, trotz eventuell niedrigerer Gewinne, Budgets und ebenso trotz steigendem Leistungsdruck weiterhin (genauso) in Wettbewerbe investieren? Dabei investieren, je nach Größe und Umsatz des Unternehmens, Agenturen mit Awards zwischen vier- und sechsstellige Beträge in Kreativwettbewerbe. Die, die keine direkte Erfahrung mit Awards haben (Agenturen ohne Awards), würden hingegen max. drei- bis vierstellige Summen für Wettbewerbe ausgeben. Die meisten "normalen" Agenturen, ob mit oder ohne Awards, können die verbundenen Kosten der Wettbewerbe nur bedingt nachvollziehen und finden diese überwiegend teilweise gerechtfertigt, während mehr als die Hälfte der befragten Top-Agenturen kein Verständnis dafür aufbringen. Die hauptsächlichen Beweggründe für Teilnahmen an Kreativwettbewerben sind der Drang und die Notwendigkeit zur Profilierung, der Mehrwertnutzen durch Awards für die Agenturen und ihre Mitarbeiter und weil Awards einen großen Einfluss auf das Image und somit auch auf den Erfolg der Agenturen haben. Des weiteren spielen Awards für Agentur-/Kreativrankings eine sehr wichtige Rolle, was für Top-Agenturen mit zur Hauptmotivation für eine Teilnahme an Wettbewerben gehört, da sie häufig in Rankings vertreten sind und dies auch versuchen zu bleiben. Für Agenturen ohne Awards bzw. für kleine Agenturen ist dieser Aspekt eher unbedeutend, da sich die Listen der Rankings fast ausschließlich aus Top-Agenturen zusammensetzen und diese somit für "normale" Agenturen eher uninteressant sind. Zudem fehlen hier auch oftmals die Budgets, um den vollen Kostenapparat eines Awards auffangen zu können. Sollte dies dennoch der Fall sein, so landen diese Agenturen zwar eventuell einen "Knüller", werden aber bei unregelmäßiger Investition in Wettbewerbe ziemlich schnell wieder von der Bildfläche verschwinden und nicht beachtet werden. Deshalb zählen Awards fast überwiegend nur bei Agenturen mit bisher erzielten Awards und Top-Agenturen zur Unternehmenskultur bzw. -vision. Ein Beweggrund für manche Agenturen am Wettbewerb teilzunehmen, ist auch, weil dieser Award der Angesagteste in der Kreativbranche ist (z. B. Cannes oder Effie), was jedoch nur ein geringer Teil der Befragten bestätigt. Dass ein bestimmter Award noch fehlt bzw. bisher am Wenigsten erzielt wurde, stellt nur vereinzelt einen Teilnahmegrund an einem Kreativwettbewerb dar. Laut aller Befragten erschließt sich, dass Awards immens das Selbstbewusstsein der Agentur, das Image, die Anerkennung bei Kunden und in der Branche sowie die Aufmerksamkeit der Presse stärken und die Agentur zu einer Qualitätsmarke werden lassen. Des Weiteren bringen Sie Neukunden und aufgrund des Images einen Zuwachs an Bewerbungen bzw. potentiellen Mitarbeitern. Außerdem steigen die Anfragen an die Agentur im Allgemeinen. Awards sind zudem sehr interessant für Nachwuchskreative, denn die werden im Bezug auf ihre Karriere gefördert, da prämierte Arbeiten z. B. in Jahrbüchern, Ausstellungen und im Internet veröffentlicht werden. Zudem können Awards die jeweilige Kundenbeziehung (bezogen auf gemeinsam eingereichte Arbeiten) vertiefen, was jedoch sehr unterschiedlich ausfällt, denn jede Agentur und jeder Kunde ist anders. Mal haben Awards diese vertieft, mal nicht und vereinzelt sogar verschlechtert. Aus den Auswertungen geht dennoch eine leichte Tendenz zur Vertiefung hervor. Dabei spielt die sog. Grundchemie sowie die Kommunikation zwischen Kunde und Agentur eine wesentliche Rolle. Was ein Zugewinn von Budgets durch Awards anbelangt, so sind die Meinungen sehr geteilt: Für einige Agenturen ist ein Zugewinn spürbar, ggf. zurückzuführen auf ein wachsendes Image oder Neukunden, für die anderen herrscht Budget-Neutralität oder eher eine Abnahme, u. a. aufgrund hoher Investitionskosten in Wettbewerbe. Diese Investition zahlt sich jedoch, langfristig gesehen, aus.Zudem bringen Awards auch persönlichen Erfolg bei den Mitarbeitern, nachgewiesen durch mehr Motivation und Power, steigende Kreativität sowie Selbstbewusstsein bzw. Stärkung der eigenen Persönlichkeit. Ergänzend identifizieren sich Mitarbeiter durch Awards mehr mit dem Unternehmen und erzielen insgesamt höhere Leistungen bzw. bessere Ergebnisse. Sollten an eingereichten Arbeiten mehrere Mitarbeiter beteiligt sein, so kann die Teamfähigkeit verstärkt und die Beziehung untereinander vertieft werden, was an dieser Stelle jedoch auch wieder sehr variabel ausfällt, aufgrund natürlich, unterschiedlicher Persönlichkeiten und Harmonien. Letztlich wirkt persönlicher Erfolg der Mitarbeiter unterstützend zum betriebswirtschaftlichen Erfolg, denn eine Agentur "lebt" von motiviertem, kreativem und engagiertem Personal. Sind Mitarbeiter aufgrund von Awards zu Höchstleistungen bereit und fähig, und "ziehen mit dem Unternehmen an einem Strang", so kann eine Agentur ihren Standard bzw. ihre Marke halten oder sogar ausbauen. Denn für eine hervorragende externe Kommunikation ist eine noch bessere interne Kommunikation notwendig. Von ihr hängt maßgeblich der Erfolg einer Agentur ab. Wie sich die aktuelle Wirtschaftskrise auf Agenturen laut der Befragten auswirkt, wird in Punkt 4.2 erläutert. Den Favoriten aller Awards stellt für Agenturen mit Awards, wegen seines verbundenen Images und seiner Bedeutung, der Cannes Lions dar. Dabei ist anzumerken, dass es einen zweiten Favoriten gibt, den GWA Effie, dieser jedoch für Agenturen ohne Awards gilt. Vielleicht, weil diese Agenturen auch schlechte Kritik über Kreativwettbewerbe bewerten und zudem keine eigenen, direkten Erfahrungen mit Awards haben. Der Status des Effies sowie dessen Teilnahmevoraussetzungen und Aussagekraft prämierter Arbeiten, bezogen auf einen tatsächlichen Markterfolg/Effizienz, sind in der Werbebranche allgemein bekannt. Da liegt es nahe, dass diese Agenturen letztlich den Effie bevorzugen, da dieser für eine Teilnahme einen bereits nachgewiesenen Erfolg voraussetzt, während Agenturen mit Awards aus ihren Erfahrungen her, den Cannes Lions bevorzugen. Welche Kategorie dabei, ob national oder international, für den Erfolg einer Agentur bedeutsamer ist, hält sich relativ in Balance. Nur eine leichte Tendenz zu internationalen Awards ist zu erkennen. Die meisten Agenturen geben an, dass es weniger auf die Herkunft, sondern mehr auf den Award an sich ankommt. Aufgrund dieser Auswertungen ist die These dieser Untersuchung bereits belegt, denn Awards bringen nachweislich Erfolg, in dem sie mehrere Nutzen für Agenturen, sei es betriebwirtschaftlich oder persönlich für deren Mitarbeiter aufweisen. Die soll zusätzlich durch die Interviews bestärkt werden.

This dissertation addresses five fundamental resource allocation problems on networks, all of which have applications to support Homeland Security or industry challenges. In the first application, we model and solve the strategic problem of minimizing the expected loss inflicted by a hostile terrorist organization. An appropriate allocation of certain capability-related, intent-related, vulnerability-related, and consequence-related resources is used to reduce the probabilities of success in the respective attack-related actions, and to ameliorate losses in case of a successful attack. Given the disparate nature of prioritizing capital and material investments by federal, state, local, and private agencies to combat terrorism, our model and accompanying solution procedure represent an innovative, comprehensive, and quantitative approach to coordinate resource allocations from various agencies across the breadth of domains that deal with preventing attacks and mitigating their consequences. Adopting a nested event tree optimization framework, we present a novel formulation for the problem as a specially structured nonconvex factorable program, and develop two branch-and-bound schemes based respectively on utilizing a convex nonlinear relaxation and a linear outer-approximation, both of which are proven to converge to a global optimal solution. We also investigate a fundamental special-case variant for each of these schemes, and design an alternative direct mixed-integer programming model representation for this scenario. Several range reduction, partitioning, and branching strategies are proposed, and extensive computational results are presented to study the efficacy of different compositions of these algorithmic ingredients, including comparisons with the commercial software BARON. The developed set of algorithmic implementation strategies and enhancements are shown to outperform BARON over a set of simulated test instances, where the best proposed methodology produces an average optimality gap of 0.35% (compared to 4.29% for BARON) and reduces the required computational effort by a factor of 33. A sensitivity analysis is also conducted to explore the effect of certain key model parameters, whereupon we demonstrate that the prescribed algorithm can attain significantly tighter optimality gaps with only a near-linear corresponding increase in computational effort. In addition to enabling effective comprehensive resource allocations, this research permits coordinating agencies to conduct quantitative what-if studies on the impact of alternative resourcing priorities. The second application is motivated by the author's experience with the U.S. Army during a tour in Iraq, during which combined operations involving U.S. Army, Iraqi Army, and Iraqi Police forces sought to interdict the transport of selected materials used for the manufacture of specialized types of Improvised Explosive Devices, as well as to interdict the distribution of assembled devices to operatives in the field. In this application, we model and solve the problem of minimizing the maximum flow through a network from a given source node to a terminus node, integrating different forms of superadditive synergy with respect to the effect of resources applied to the arcs in the network. Herein, the superadditive synergy reflects the additional effectiveness of forces conducting combined operations, vis- -vis unilateral efforts. We examine linear, concave, and general nonconcave superadditive synergistic relationships between resources, and accordingly develop and test effective solution procedures for the underlying nonlinear programs. For the linear case, we formulate an alternative model representation via Fourier-Motzkin elimination that reduces average computational effort by over 40% on a set of randomly generated test instances. This test is followed by extensive analyses of instance parameters to determine their effect on the levels of synergy attained using different specified metrics. For the case of concave synergy relationships, which yields a convex program, we design an inner-linearization procedure that attains solutions on average within 3% of optimality with a reduction in computational effort by a factor of 18 in comparison with the commercial codes SBB and BARON for small- and medium-sized problems; and outperforms these softwares on large-sized problems, where both solvers failed to attain an optimal solution (and often failed to detect a feasible solution) within 1800 CPU seconds. Examining a general nonlinear synergy relationship, we develop solution methods based on outer-linearizations, inner-linearizations, and mixed-integer approximations, and compare these against the commercial software BARON. Considering increased granularities for the outer-linearization and mixed-integer approximations, as well as different implementation variants for both these approaches, we conduct extensive computational experiments to reveal that, whereas both these techniques perform comparably with respect to BARON on small-sized problems, they significantly improve upon the performance for medium- and large-sized problems. Our superlative procedure reduces the computational effort by a factor of 461 for the subset of test problems for which the commercial global optimization software BARON could identify a feasible solution, while also achieving solutions of objective value 0.20% better than BARON. The third application is likewise motivated by the author's military experience in Iraq, both from several instances involving coalition forces attempting to interdict the transport of a kidnapping victim by a sectarian militia as well as, from the opposite perspective, instances involving coalition forces transporting detainees between interment facilities. For this application, we examine the network interdiction problem of minimizing the maximum probability of evasion by an entity traversing a network from a given source to a designated terminus, while incorporating novel forms of superadditive synergy between resources applied to arcs in the network. Our formulations examine either linear or concave (nonlinear) synergy relationships. Conformant with military strategies that frequently involve a combination of overt and covert operations to achieve an operational objective, we also propose an alternative model for sequential overt and covert deployment of subsets of interdiction resources, and conduct theoretical as well as empirical comparative analyses between models for purely overt (with or without synergy) and composite overt-covert strategies to provide insights into absolute and relative threshold criteria for recommended resource utilization. In contrast to existing static models, in a fourth application, we present a novel dynamic network interdiction model that improves realism by accounting for interactions between an interdictor deploying resources on arcs in a digraph and an evader traversing the network from a designated source to a known terminus, wherein the agents may modify strategies in selected subsequent periods according to respective decision and implementation cycles. We further enhance the realism of our model by considering a multi-component objective function, wherein the interdictor seeks to minimize the maximum value of a regret function that consists of the evader's net flow from the source to the terminus; the interdictor's procurement, deployment, and redeployment costs; and penalties incurred by the evader for misperceptions as to the interdicted state of the network. For the resulting minimax model, we use duality to develop a reformulation that facilitates a direct solution procedure using the commercial software BARON, and examine certain related stability and convergence issues. We demonstrate cases for convergence to a stable equilibrium of strategies for problem structures having a unique solution to minimize the maximum evader flow, as well as convergence to a region of bounded oscillation for structures yielding alternative interdictor strategies that minimize the maximum evader flow. We also provide insights into the computational performance of BARON for these two problem structures, yielding useful guidelines for other research involving similar non-convex optimization problems. For the fifth application, we examine the problem of apportioning railcars to car manufacturers and railroads participating in a pooling agreement for shipping automobiles, given a dynamically determined total fleet size. This study is motivated by the existence of such a consortium of automobile manufacturers and railroads, for which the collaborative fleet sizing and efforts to equitably allocate railcars amongst the participants are currently orchestrated by the \textit{TTX Company} in Chicago, Illinois. In our study, we first demonstrate potential inequities in the industry standard resulting either from failing to address disconnected transportation network components separately, or from utilizing the current manufacturer allocation technique that is based on average nodal empty transit time estimates. We next propose and illustrate four alternative schemes to apportion railcars to manufacturers, respectively based on total transit time that accounts for queuing; two marginal cost-induced methods; and a Shapley value approach. We also provide a game-theoretic insight into the existing procedure for apportioning railcars to railroads, and develop an alternative railroad allocation scheme based on capital plus operating costs. Extensive computational results are presented for the ten combinations of current and proposed allocation techniques for automobile manufacturers and railroads, using realistic instances derived from representative data of the current business environment. We conclude with recommendations for adopting an appropriate apportionment methodology for implementation by the industry. ; Ph. D.

Tese de doutoramento em História (Arqueologia) apresentada à Faculdade de Letras da Universidade de Coimbra. ; Tout comme leurs prédécesseurs romains, les archéologues ont mis un certain temps à saisir les différentes structures politiques et sociales des habitants du NO de la péninsule ibérique, les englobant dans un même ensemble culturel : la culture des castros. On désigne généralement par ce nom les agglomérations fortifiées indigènes de l'ensemble de cette région. L'unité culturelle, sociale et politique d'un ensemble aussi vaste n'est aujourd'hui réellement défendue par personne. Dans l'état actuel des recherches, on sait désormais appréhender la spécificité de la culture matérielle et de la structure sociale et politique de chacune des régions du NO péninsulaire. L'une d'entre elles semble se confondre avec les limites du territoire du futur conventus bracarensis, qui s'étend entre le fleuve Douro et le sud de la Galice et au centre de laquelle la capitale, Bracara Augusta, est fondée sous le règne de Auguste. Les indigènes voient maintenant leur terre natale occupée par les ennemis qu'ils ont combattu pendant plus d'un siècle. S'ils veulent continuer à combattre, ils doivent s'enrôler dans les corps d'auxiliaires indigènes que les romains commencent à recruter dans la région. Le contact avec la culture romaine est maintenant plus direct et plus intense, ce qui provoque rapidement des changements significatifs du mode de vie des populations autochtones. C'est la compréhension de l'impact sur les populations autochtones de ce processus de changement culturel déclenché par l'occupation romaine qui a motivé l'élaboration de cet ouvrage. Les synthèses qui ont été publiées au long des trente dernières années sur le thème de la culture des castros, apportent régulièrement des idées nouvelles qui enrichissent l'analyse de cette problématique. L'objet de cette étude ne se renouvelle malheureusement pas à la même vitesse. En effet, une partie substantielle de la documentation archéologique sur la quelle s'appuie la recherche, a été élaborée à la fin du XIXe siècle ou au début du siècle suivant. Une surface importante des grandes agglomérations de la région a alors été fouillée. Les plans, dressés à cette époque, ont révélé à la communauté scientifique de l'époque l'ampleur de certains de ces gisements. On ne connaît malheureusement pas le contexte stratigraphique de la plupart des artefacts provenant des fouilles de cette période, aujourd'hui conservés dans les musées portugais et galiciens. Il faudra en effet attendre la fin du vingtième siècle pour disposer de résultats d'interventions archéologiques effectuées selon le principe stratigraphique. On privilégie à présent la lecture verticale par rapport à la lecture horizontale du gisement archéologique, le sondage étant préféré à l'intervention en surface, plus coûteuse en ressource et pour cela hors de portée des chercheurs locaux. À partir de la dernière décennie du XXº siècle, la généralisation des interventions de sauvetage menées à bien dans le cadre des grands chantiers de travaux publics redonne aux chercheurs l'opportunité d'effectuer des interventions qui permettent de concilier la lecture verticale et horizontale de ces gisements. L'une de ces agglomérations indigènes située sur la rive droite de l'estuaire du Rio Lima a ainsi été récemment affectée sur près des deux tiers de la totalité de sa surface par le corridor de l'Autoroute A28 (Viana do Castelo/Caminha), donné sous forme de concession à l'entreprise Euroscut SA par l'Instituto de Estradas du Portugal. J'ai eu la chance d'assurer personnellement la direction de la fouille de la surface affectée par le corridor, donnée en adjudication à l'entreprise AMS – Análise e Consultadoria Arqueológica Ld.ª, dont je suis le gérant. Cette intervention s'est prolongée de juin 2004 au mois de juillet 2005. Au long des trois années suivantes, cette entreprise a financé intégralement le travail de recherche que je présente maintenant, celui-ci étant fondé sur les données recueillies au cours de cette intervention. L'encadrement académique de ce travail a été assuré par le Centro de Estudos Arqueológicos das Universidades de Coimbra e do Porto (CEAUCP), et cette thèse de Doctorat en Archéologie a été dirigée par Jorge de Alarcão et Maria da Conceição Lopes, membres de ce centre de recherche. Comme le titre l'indique, ce qui suit est un portrait de la communauté villageoise qui a un jour habité le Castro du Vieito, établi à partir des résultats de l'intervention archéologique que j'ai menée sur ce gisement. Comme tout portrait, ce texte ne transmet qu'une image incomplète de cette communauté, que l'information archéologique révélée par la fouille du Castro do Vieito m'a permis de recréer. Je ne peux pas prétendre que ce portrait soit exhaustif, puisque de nombreux aspects de la structure sociale, économique et spirituelle de cette communauté n'ont pas laissé de traces matérielles, que je puisse ou que je sache lire. J'ai consciemment minoré d'autres aspects, documentés par le registre archéologique à ma disposition afin de former une image équilibrée de la communauté, qui soit le reflet de la dialectique entre la permanence et le changement. Le lecteur spécialiste en numismatique, en amphores, etc., pourra trouver le plan de l'ouvrage un peu brouillon, l'information relative aux différents types de documents étant distribuée au long de plusieurs chapitres. Il pourra également regretter l'absence de certaines données utiles à la construction de son propre objet d'étude. Je le prie de m'en excuser. J'ai en effet renoncé à présenter les différents documents archéologiques par « catégories-tiroirs » telles que les sigillées, les amphores, les métaux, etc. J'ai préféré au contraire introduire les différentes lectures que l'on peut faire de ces documents (chronologie, signification sociale, économique, etc.) pour permettre au lecteur de comprendre tel ou tel aspect de la communauté villageoise, objet d'étude assumé de mon ouvrage. Cet objectif explique également l'hétérogénéité de la documentation utilisée à cette fin, et notamment l'importance parfois assumée par des documents tels que le patrimoine ethnologique régional ou les formes du paysage de la région, d'un intérêt à première vue improbable pour un ouvrage qui traite d'un thème de nature archéologique. Le caractère transversal de ce texte peut suggérer au lecteur que je suis un spécialiste dans les diverses disciplines sur lesquelles j'appuie la construction de ce portrait. Ce n'est pas le cas. Je ne suis en réalité qu'un spécialiste de mon objet d'étude : la communauté qui a un jour habité le Castro du Vieito. Mon savoir relatif à chacune de ces disciplines, se limite aux connaissances qu'il m'a paru nécessaire d'accumuler pour aborder convenablement mon objet d'étude. Le lecteur pourra également juger inopportune l'importance donnée au long du texte au débat sur les questions théoriques ou méthodologiques pour un ouvrage, qui ne dépasse pas, somme toute, le seuil d'une monographie. Je prie encore une fois le lecteur de m'en excuser. Tout comme un portrait esquissé par un peintre, l'image que je forme de mon objet est fortement conditionnée par la manière dont je peins et la conception que je me fais de la peinture, c'est-à-dire, dans mon cas, des théories et des méthodes sur lesquelles j'appuie ma construction mentale. Pour ces raisons, le chapitre « Les règles de l'art », particulièrement consacré à ce sujet, intervient immédiatement après cette brève introduction. L'organisation du reste du texte est plus arbitraire, puisque les autres chapitres abordent différents aspects relatifs à la communauté étudiée, à mes yeux tout aussi importants les uns que les autres. Dans le chapitre « Le village ou la structure d'un système complexe : la communauté villageoise », j'aborde la question de la relation qui existe entre la structure sociale et économique de la communauté et la structure spatiale de son habitat. Le chapitre « Une identité en construction » présente certains aspects de la culture matérielle mis au jour durant la fouille et révélés par l'analyse du mobilier archéologique qui permettent de mieux cerner son importance comme vecteur de valeurs culturelles, indispensables à la construction de l'identité des villageois. Le chapitre « Communauté et territoire » traite la difficile question des liens de la communauté villageoise avec son territoire et avec les autres communautés voisines. Finalement, le chapitre « Appartenir à l'orbis Romarum » est une tentative de comprendre l'impact de l'occupation romaine de la région dans la vie quotidienne des villageois. Le lecteur ne trouvera pas non plus de conclusion à la fin de cet ouvrage, car comme la plupart des peintres, je ne me sens pas capable de condenser un tableau entier en un seul coup de pinceau. Je n'en vois pas d'ailleurs la nécessité.

2007/2008 ; Abstract. Questo studio analizza la relazione esistente tra la produzione del caffè ed il clima, con l'obiettivo di stimare il potenziale impatto economico del cambiamento climatico. A tal fine, si è sviluppato un approccio integrato a livello interdisciplinare, combinando insieme le tematiche legate agli aspetti della meteorologia, della climatologia, della biologia, dell'ambiente e dell'economia. Il case study di riferimento è la produzione di caffè Robusta in Uganda. In un contesto di globale esaurimento delle risorse e del repentino cambiamento climatico, non si può più prescindere dall'impatto economico che si determina sulla produzione agricola in generale. Gli eventi atmosferici estremi, quali le tempeste tropicali, gli uragani e i tifoni, insieme alle progressive alterazioni nei cicli delle stagioni, delle piogge e delle temperature, espongono sempre più spesso il territorio e la collettività a siccità, frane, alluvioni e inondazioni che possono distruggere o danneggiare considerevolmente i raccolti. Il caffè costituisce la principale fonte di sussistenza per circa 25 milioni di coltivatori e per le loro famiglie, oltre che la principale fonte di occupazione per molti dei paesi in via di sviluppo, come in Uganda. La dipendenza economica di questo paese dal caffè risulta, infatti, particolarmente evidente: la sua è un'economia di tipo monoculturale e tuttora il 30% degli introiti derivanti dalle esportazioni proviene da questa commodity agricola. In termini di occupazione, più di 5 milioni di persone sono impiegate nella coltivazione e lavorazione di caffè, che viene prodotto in 52 distretti tra gli 80 presenti nel Paese. La produzione coinvolge circa oltre un milione di piccoli coltivatori, dei quali il 90% possiede fattorie la cui dimensione varia da meno di 0,5 a 2,5 ettari. La piccola dimensione di questi appezzamenti evidenzia anche la loro debolezza strutturale e la necessità di un serio riequilibrio del potere tra gli attori della global coffee chain, che punti a tutelare e a valorizzare la coltivazione del caffè. Il clima potrebbe essere visto quale elemento che può mutare la redistribuzione del reddito lungo la catena di produzione caffeicola (coffee supply chain), poiché potrebbe modificare nel medio termine i processi decisionali dei principali attori della global coffee chain, anche promuovendo una necessaria innovazione tecnologica, nell'ottica di fornirsi di strumenti più adeguati per sopravvivere in un ambiente che potrebbe risultare profondamente mutato. Il percorso di analisi seguito in questo lavoro è suddiviso in quattro parti. Nella prima si è provveduto a fornire una descrizione dettagliata dei concetti e degli elementi di base che regolano le complesse dinamiche oceano-terra-atmosfera. In seguito, ci si è occupati di descrivere il clima e di fornire una sintesi dei cambiamenti climatici in atto e degli scenari futuri per il 21° secolo, con grande enfasi per la scala regionale (Africa Orientale) e locale (Uganda). Nella seconda parte si è voluto fornire un'analisi dettagliata dei parametri fisico-biologici della pianta Coffea Canephora Pierre – Robusta. In particolare, si è trattato di descriverne i requisiti climatici e ambientali, nonché le caratteristiche agro-meteorologiche come il regime delle precipitazioni, le temperature, i venti, l'insolazione e la copertura agroforestale, l'altitudine, le caratteristiche del terreno e l'umidità del suolo, il sistema delle radici e così via. La trattazione comprende anche un'analisi delle fasi fenologiche della Robusta, nelle condizioni climatiche dell'Uganda, oltre ad una descrizione dei metodi di coltivazione adottati dai produttori. Nella terza parte sono stati descritti gli impatti del clima sulla coltivazione della Robusta in Uganda, integrando le risultanze ottenute a livello fenologico con gli scenari climatici futuri. Infatti, è ben noto che tutti i rapporti sul clima dell'Intergovernmental Panel of Climate Change (IPCC) mettono in evidenza un incremento preoccupante della temperatura del pianeta dovuto prevalentemente ad effetti antropogenici. Le proiezioni regionali e sub-regionali per il 21° secolo dell'ultimo Assessment Scientifico pubblicato nel 2007 (IPCC AR4, 2007) indicano un incremento medio di temperature, soprattutto per quel che riguarda l'intero continente Africano. In particolare, in tutte e quattro le sub-regioni dell'Africa (Africa Occidentale e Orientale, Sud Africa e Africa Sahariana) e in tutte le stagioni, si prevede un incremento medio delle temperature compreso tra i 3°C e i 4°C, circa il 50% (oppure 1.5 volte) in più rispetto all'incremento della media globale. Le previsioni scaturite dalla metà dei modelli numerici globali indicano un riscaldamento della temperatura rispetto a questi valori medi intorno a 0.5°C. Allo stesso modo, i valori in percentuale medi ottenuti tra i modelli, che indicano la frequenza delle stagioni di caldo estremo, umido estremo e siccità estrema, segnalano una probabilità assoluta che si incontrino stagioni estremamente calde e umide in Africa Orientale. Anche le previsioni relative all'incremento delle precipitazioni nella sub-regione si presentano piuttosto attendibili, con un aumento nella media annuale pari a circa il 7%. In particolare, le simulazioni dei modelli numerici globali indicano un'intensificazione delle precipitazioni durante la stagione invernale, insieme ad una modificazione della struttura dipolare delle precipitazioni stesse. L'importanza del caffè per l'economia dell'Uganda richiede, pertanto, uno studio accurato per valutare l'impatto del clima evidenziando gli effetti delle variazioni stagionali della temperatura e delle precipitazioni, che hanno un'influenza determinante sulla produzione caffeicola. Fondamentale è stato il lavoro teso a determinare la correlazione esistente tra le condizioni del clima e i diversi stadi di crescita e di produzione del Robusta, che conta per circa l'80% dell'intera produzione di caffè del paese. Infatti, le variazioni stagionali del clima potrebbero alterarne lo sviluppo fenologico e, di conseguenza, alterare la stagione del raccolto, dalla semina alla maturazione delle ciliegie. A tal proposito, sulla base della letteratura esistente in materia di fenologia della Robusta e, anche in seguito ad una visita compiuta in Uganda nel distretto caffeicolo di Mubende, situato nella parte centro-occidentale del paese, si è tentato di costruire uno schema dei principali stadi fenologici della pianta. In tal modo, è stato possibile determinare il processo di sviluppo e maturazione dei frutti e, quindi, effettuare uno studio sugli impatti dei cambiamenti climatici derivanti alla produzione di caffè. Ad esempio, l'incidenza di temperature più elevate o un eccesso di caldo durante la fase della fioritura della pianta costituirebbero le cause principali che promuovono l'aborto dei fiori. Al contrario, intense precipitazioni durante questo stadio potrebbero parimenti comportare un danno alla fioritura, con conseguente riduzione della produttività. Inoltre, un incremento previsto delle precipitazioni, insieme a temperature più elevate, potrebbe intensificare la propagazione della coffee wilt disease (CWD), specialmente durante la fioritura che ha luogo dopo la stagione delle piogge. Seppur in modo approssimativo, si è tentato di determinare il livello di umidità del suolo in alcune delle zone di produzione di Robusta in Uganda. La metodologia utilizzata si è basata sul calcolo dei bilanci idrici totali come medie mensili di più anni, ovvero considerando tre periodi temporali storici diversi, utilizzando i valori elaborati dal modello globale Echam5/MPI – OM, atmosfera (2004), per il Quarto Rapporto ONU sul clima (IPCC-AR4, 2007). Da ciò è stato possibile dedurre che, un tasso più alto di precipitazioni durante la stagione invernale potrebbe diventare una grande minaccia per la coltivazione di caffè in Uganda, a causa di una maggiore erosione del suolo dovuta al ruscellamento. A seconda poi delle caratteristiche del terreno, il contenuto di umidità del suolo potrebbe risultare insufficiente per la pianta, nel caso dovesse verificarsi un periodo di assenza di precipitazioni relativamente lungo. Pertanto, eventi climatici estremi, come le siccità o le alluvioni, hanno un impatto negativo sulla produzione caffeicola, con perdite importanti nei rendimenti produttivi totali, oltre che in termini di un deterioramento qualitativo del caffè . Nell'ultima parte del progetto di ricerca si analizzano alcuni aspetti economici. Dopo aver descritto la struttura ed il funzionamento del settore caffeicolo in Uganda, si è provveduto a valutare il possibile impatto delle variazioni della produzione attuale e futura rispetto ai cambiamenti che intervengono nelle principali variabili climatiche anche per valutare l'attendibilità di certe previsioni che vedono una drastica riduzione dei raccolti nell'area a seguito dell'innalzamento della temperatura media. In questa prospettiva si è cercato di vedere se una risposta può venire dall'analisi dei modelli noti, come l'approccio Ricardiano, che stimano relazioni funzionali che collegano la produzione alle variabili climatiche. In questa prospettiva è stato adottato un modello stimato per la produzione del caffè in Messico che sembra essere l'unico studio sistematico presente in letteratura. In effetti, le funzioni di risposta rispetto alla temperatura implicate suggeriscono un impatto cospicuo sulla produzione che può diminuire anche di quasi il 30% in seguito ad un aumento di un grado e mezzo nella stagione estiva. ; XXI Ciclo ; 1973

Benessere delle popolazioni, gestione sostenibile delle risorse, povertà e degrado ambientale sono dei concetti fortemente connessi in un mondo in cui il 20% della popolazione mondiale consuma più del 75% delle risorse naturali. Sin dal 1992 al Summit della Terra a Rio de Janeiro si è affermato il forte legame tra tutela dell'ambiente e riduzione della povertà, ed è anche stata riconosciuta l'importanza di un ecosistema sano per condurre una vita dignitosa, specialmente nelle zone rurali povere dell'Africa, dell'Asia e dell'America Latina. La natura infatti, soprattutto per le popolazioni rurali, rappresenta un bene quotidiano e prezioso, una forma essenziale per la sussistenza ed una fonte primaria di reddito. Accanto a questa constatazione vi è anche la consapevolezza che negli ultimi decenni gli ecosistemi naturali si stanno degradando ad un ritmo impressionate, senza precedenti nella storia della specie umana: consumiamo le risorse più velocemente di quanto la Terra sia capace di rigenerarle e di "metabolizzare" i nostri scarti. Allo stesso modo aumenta la povertà: attualmente ci sono 1,2 miliardi di persone che vivono con meno di un dollaro al giorno, mentre circa metà della popolazione mondiale sopravvive con meno di due dollari al giorno (UN). La connessione tra povertà ed ambiente non dipende solamente dalla scarsità di risorse che rende più difficili le condizioni di vita, ma anche dalla gestione delle stesse risorse naturali. Infatti in molti paesi o luoghi dove le risorse non sono carenti la popolazione più povera non vi ha accesso per motivi politici, economici e sociali. Inoltre se si paragona l'impronta ecologica con una misura riconosciuta dello "sviluppo umano", l'Indice dello Sviluppo Umano (HDI) delle Nazioni Unite (Cfr. Cap 2), il rapporto dimostra chiaramente che ciò che noi accettiamo generalmente come "alto sviluppo" è molto lontano dal concetto di sviluppo sostenibile accettato universalmente, in quanto i paesi cosiddetti "sviluppati" sono quelli con una maggior impronta ecologica. Se allora lo "sviluppo" mette sotto pressione gli ecosistemi, dal cui benessere dipende direttamente il benessere dell'uomo, allora vuol dire che il concetto di "sviluppo" deve essere rivisitato, perché ha come conseguenza non il benessere del pianeta e delle popolazioni, ma il degrado ambientale e l'accrescimento delle disuguaglianze sociali. Quindi da una parte vi è la "società occidentale", che promuove l'avanzamento della tecnologia e dell'industrializzazione per la crescita economica, spremendo un ecosistema sempre più stanco ed esausto al fine di ottenere dei benefici solo per una ristretta fetta della popolazione mondiale che segue un modello di vita consumistico degradando l'ambiente e sommergendolo di rifiuti; dall'altra parte ci sono le famiglie di contadini rurali, i "moradores" delle favelas o delle periferie delle grandi metropoli del Sud del Mondo, i senza terra, gli immigrati delle baraccopoli, i "waste pickers" delle periferie di Bombay che sopravvivono raccattando rifiuti, i profughi di guerre fatte per il controllo delle risorse, gli sfollati ambientali, gli eco-rifugiati, che vivono sotto la soglia di povertà, senza accesso alle risorse primarie per la sopravvivenza. La gestione sostenibile dell'ambiente, il produrre reddito dalla valorizzazione diretta dell'ecosistema e l'accesso alle risorse naturali sono tra gli strumenti più efficaci per migliorare le condizioni di vita degli individui, strumenti che possono anche garantire la distribuzione della ricchezza costruendo una società più equa, in quanto le merci ed i servizi dell'ecosistema fungono da beni per le comunità. La corretta gestione dell'ambiente e delle risorse quindi è di estrema importanza per la lotta alla povertà ed in questo caso il ruolo e la responsabilità dei tecnici ambientali è cruciale. Il lavoro di ricerca qui presentato, partendo dall'analisi del problema della gestione delle risorse naturali e dal suo stretto legame con la povertà, rivisitando il concetto tradizionale di "sviluppo" secondo i nuovi filoni di pensiero, vuole suggerire soluzioni e tecnologie per la gestione sostenibile delle risorse naturali che abbiano come obiettivo il benessere delle popolazioni più povere e degli ecosistemi, proponendo inoltre un metodo valutativo per la scelta delle alternative, soluzioni o tecnologie più adeguate al contesto di intervento. Dopo l'analisi dello "stato del Pianeta" (Capitolo 1) e delle risorse, sia a livello globale che a livello regionale, il secondo Capitolo prende in esame il concetto di povertà, di Paese in Via di Sviluppo (PVS), il concetto di "sviluppo sostenibile" e i nuovi filoni di pensiero: dalla teoria della Decrescita, al concetto di Sviluppo Umano. Dalla presa di coscienza dei reali fabbisogni umani, dall'analisi dello stato dell'ambiente, della povertà e delle sue diverse facce nei vari paesi, e dalla presa di coscienza del fallimento dell'economia della crescita (oggi visibile più che mai) si può comprendere che la soluzione per sconfiggere la povertà, il degrado dell'ambiente, e raggiungere lo sviluppo umano, non è il consumismo, la produzione, e nemmeno il trasferimento della tecnologia e l'industrializzazione; ma il "piccolo e bello" (F. Schumacher, 1982), ovvero gli stili di vita semplici, la tutela degli ecosistemi, e a livello tecnologico le "tecnologie appropriate". Ed è proprio alle Tecnologie Appropriate a cui sono dedicati i Capitoli successivi (Capitolo 4 e Capitolo 5). Queste sono tecnologie semplici, a basso impatto ambientale, a basso costo, facilmente gestibili dalle comunità, tecnologie che permettono alle popolazioni più povere di avere accesso alle risorse naturali. Sono le tecnologie che meglio permettono, grazie alle loro caratteristiche, la tutela dei beni comuni naturali, quindi delle risorse e dell'ambiente, favorendo ed incentivando la partecipazione delle comunità locali e valorizzando i saperi tradizionali, grazie al coinvolgimento di tutti gli attori, al basso costo, alla sostenibilità ambientale, contribuendo all'affermazione dei diritti umani e alla salvaguardia dell'ambiente. Le Tecnologie Appropriate prese in esame sono quelle relative all'approvvigionamento idrico e alla depurazione dell'acqua tra cui: - la raccolta della nebbia, - metodi semplici per la perforazione di pozzi, - pompe a pedali e pompe manuali per l'approvvigionamento idrico, - la raccolta dell'acqua piovana, - il recupero delle sorgenti, - semplici metodi per la depurazione dell'acqua al punto d'uso (filtro in ceramica, filtro a sabbia, filtro in tessuto, disinfezione e distillazione solare). Il quinto Capitolo espone invece le Tecnolocie Appropriate per la gestione dei rifiuti nei PVS, in cui sono descritte: - soluzioni per la raccolta dei rifiuti nei PVS, - soluzioni per lo smaltimento dei rifiuti nei PVS, - semplici tecnologie per il riciclaggio dei rifiuti solidi. Il sesto Capitolo tratta tematiche riguardanti la Cooperazione Internazionale, la Cooperazione Decentrata e i progetti di Sviluppo Umano. Per progetti di sviluppo si intende, nell'ambito della Cooperazione, quei progetti che hanno come obiettivi la lotta alla povertà e il miglioramento delle condizioni di vita delle comunità beneficiarie dei PVS coinvolte nel progetto. All'interno dei progetti di cooperazione e di sviluppo umano gli interventi di tipo ambientale giocano un ruolo importante, visto che, come già detto, la povertà e il benessere delle popolazioni dipende dal benessere degli ecosistemi in cui vivono: favorire la tutela dell'ambiente, garantire l'accesso all'acqua potabile, la corretta gestione dei rifiuti e dei reflui nonché l'approvvigionamento energetico pulito sono aspetti necessari per permettere ad ogni individuo, soprattutto se vive in condizioni di "sviluppo", di condurre una vita sana e produttiva. È importante quindi, negli interventi di sviluppo umano di carattere tecnico ed ambientale, scegliere soluzioni decentrate che prevedano l'adozione di Tecnologie Appropriate per contribuire a valorizzare l'ambiente e a tutelare la salute della comunità. I Capitoli 7 ed 8 prendono in esame i metodi per la valutazione degli interventi di sviluppo umano. Un altro aspetto fondamentale che rientra nel ruolo dei tecnici infatti è l'utilizzo di un corretto metodo valutativo per la scelta dei progetti possibili che tenga presente tutti gli aspetti, ovvero gli impatti sociali, ambientali, economici e che si cali bene alle realtà svantaggiate come quelle prese in considerazione in questo lavoro; un metodo cioè che consenta una valutazione specifica per i progetti di sviluppo umano e che possa permettere l'individuazione del progetto/intervento tecnologico e ambientale più appropriato ad ogni contesto specifico. Dall'analisi dei vari strumenti valutativi si è scelto di sviluppare un modello per la valutazione degli interventi di carattere ambientale nei progetti di Cooperazione Decentrata basato sull'Analisi Multi Criteria e sulla Analisi Gerarchica. L'oggetto di questa ricerca è stato quindi lo sviluppo di una metodologia, che tramite il supporto matematico e metodologico dell'Analisi Multi Criteria, permetta di valutare l'appropriatezza, la sostenibilità degli interventi di Sviluppo Umano di carattere ambientale, sviluppati all'interno di progetti di Cooperazione Internazionale e di Cooperazione Decentrata attraverso l'utilizzo di Tecnologie Appropriate. Nel Capitolo 9 viene proposta la metodologia, il modello di calcolo e i criteri su cui si basa la valutazione. I successivi capitoli (Capitolo 10 e Capitolo 11) sono invece dedicati alla sperimentazione della metodologia ai diversi casi studio: - "Progetto ambientale sulla gestione dei rifiuti presso i campi Profughi Saharawi", Algeria, - "Programa 1 milhão de Cisternas, P1MC" e - "Programa Uma Terra e Duas Águas, P1+2", Semi Arido brasiliano.

2007/2008 ; E' rintracciabile, nell'attuale sistema processualpenalistico, un paradigma del diritto alla "informazione sull'accusa", quale consacrato nell'art. 111 comma III Cost.? La risposta a simile quesito – cui si propone di giungere la presente ricerca – impone di saggiare gli istituti funzionali, nella fase investigativa, a concretizzare tale diritto alla luce del connotati del "giusto processo", mediante un duplice percorso che, per un verso, esplora la possibilità di reductio ad unum dell'apparato informativo e, per altro verso, ne sonda il grado di effettività. L'opera si articola nelle tre parti di seguito illustrate. La prima sezione è dedicata alla definizione del concetto di "diritto all'informazione sull'accusa" nella teoria delle fonti. Il primo capitolo è dedicato alla Convenzione europea per la salvaguardia dei diritti dell'uomo e al Patto internazionale sui diritti civili e politici che, per primi, hanno configurato una organico modello di fair trial, ove il diritto all'informazione sull'accusa partecipa della duplice natura di precipitato del diritto di difesa e presupposto per l'esercizio, all'interno del processo, delle singole facoltà difensive. A fronte della laconica previsione dell'art. 6 § 3 lett. a CEDU – che, al pari dell'omologa disposizione contenuta nell'art. 14 § 3 lett. a ICCPR si risolve in una mera enunciazione dei caratteri della comunicazione –, si impone la ricostruzione del paradigma informativo attraverso l'analisi della giurisprudenza della Corte europea dei diritti dell'uomo. La giurisprudenza di Strasburgo affronta la tematica senza atteggiamenti preconcetti e sviluppa un modello di informazione, per un verso, dinamico e duttile, atto a modularsi attraverso le diverse fasi procedimentali, e, per altro verso, conforme ai canoni della tempestività e della efficienza. A tal fine, il concetto stesso di accusation, cui il diritto all'informazione è ancorato, non pare postulare formule o atti sacramentali, ma si traduce nella attività dell'organo inquirente che, nel caso concreto, sia abbia a determinare «ripercussioni importanti» sulla sfera personale della persona sottoposta alle indagini: l'avvio del procedimento, l'iscrizione della notizia di reato, l'esecuzione di una perquisizione o di un sequestro. Il secondo capitolo è dedicato alla definizione del diritto all'informazione sull'accusa all'interno della nostra Carta costituzionale, muovendo dalla sua "archeologia". Invero, sin dai primi anni '60, la dottrina e la giurisprudenza si sono interrogate in ordine alla possibilità di enucleare un modello di fair trial dalle disposizioni contenute nella Costituzione. Lo sforzo euristico degli interpreti si è inizialmente incentrato sull'art. 24 Cost., fino a giungere, nel 1996, all'esplicitazione, ad opera della giurisprudenza costituzionale, di un canone del "giusto processo" quale formula scaturente dal coordinamento dei «principi che la Costituzione detta in ordine tanto ai caratteri della giurisdizione, sotto il profilo soggettivo e oggettivo, quanto ai diritti di azione e difesa in giudizio». Parallelamente al consolidarsi di una via costituzionale ante litteram al due process of law, si assiste al progressivo manifestarsi dell'influenza delle norme contenute nelle convenzioni internazionali in materia di diritti della persona e processo penale. Simile fenomeno – che intreccia la tematica del rango rivestito, nella gerarchia interna delle fonti, dalle disposizioni pattizie – assume particolare rilievo nelle pronunce della Consulta, ove l'art. 6 § 3 CEDU viene evocato, con crescente frequenza, quale parametro "ausiliario" nel giudizio di conformità delle norme subordinate alla Costituzione. L'escalation culmina, nel 1987, con l'inserzione dell'ossequio ai principi enunciati nelle convenzioni internazionali di riferimento tra i criteri direttivi atti guidare, ai sensi dell'art. 76 Cost., il legislatore delegato alla redazione dell'attuale codice di procedura penale. La questione della diretta precettività, nel nostro ordinamento, delle norme pattizie – elette a principio informatore del codice di rito – viene, peraltro, messa in secondo piano dalla introduzione, ad opera della l. cost. n. 2 del 1999, della disciplina del giusto processo nel tessuto costituzionale. In controtendenza rispetto alla concezione "minimalista" postulata dai giudici costituzionali, da ultimo, con la sentenza n. 361 del 1998, il legislatore del 1999 introduce, nell'art. 111 Cost., un concetto "forte" di contraddittorio, che partecipa della duplice natura di canone oggettivo di esercizio della funzione giurisdizionale, in quanto fulcro del giusto processo, e di garanzia soggettiva operante nell'ambito penale. La centralità del diritto di contraddire consente di attribuire spessore teleologico alla prerogativa, riconosciuta a ogni persona sottoposta a procedimento, di essere informata, nel più breve tempo possibile e in via riservata dell'accusa elevata a suo carico: si attua in tal modo quel "diritto a difendersi conoscendo" che costituisce imprescindibile prodromo per imbastire qualsivoglia tutela processuale delle ragioni dell'imputato. Esaurita la disamina dei principi, la ricerca si impernia sulla ricognizione della fenomenologia informativa nell'attuale sistema codicistico, con riferimento a quegli istituti che sono funzionali a consentire la conoscenza "sul processo" e "nel processo" nella fase investigativa, che, sulla scorta dell'esegesi operata sull'art. 111 comma III Cost., costituisce la naturale sedes materiae del diritto all'informazione sull'accusa. Viene in rilievo l'istituto della informazione di garanzia, funzionale nell'impianto originario del codice di rito, a squarciare la segretezza investigativa con una seppur embrionale parentesi di discovery connessa all'espletamento di un atto cui il difensore abbia diritto ad assistere. Lo strumento informativo in argomento permette di focalizzare l'attenzione sul canone della riservatezza, oggetto di positivo richiamo da parte dell'art. 111 comma III Cost. Dotato di un requisito interno atto, in tesi, a consentire il massimo riserbo – ossia l'invio mediante piego chiuso raccomandato – l'istituto in argomento ha patito, nei primi anni novanta, una sistematica strumentalizzazione che, da presidio di garanzia per la persona sottoposta alle investigazioni quale era stato concepito, l'ha trasformato in veicolo di condanna anticipata. Il conseguente tentativo, operato dal legislatore del 1995, di restituire respiro all'informazione di garanzia ha, invece, finito per comprimere il diritto della persona indagata alla conoscenza della sussistenza di un'investigazione a suo carico attraverso la compressione dell'ambito di operatività dell'art. 369 c.p.p. Contestualmente alla modifica della disciplina dell'informazione di garanzia, in una logica di "pesi e contrappesi" si è inteso recuperare uno spazio di discovery mediante la modifica della disciplina del registro delle notizie di reato, regolato dall'art. 335 c.p.p., il cui accesso, nella lettera originaria del codice di rito, era interdetto sino alla formulazione dell'imputazione. Il riconoscimento del diritto della persona cui il reato è attribuito di ricevere comunicazione delle iscrizioni a proprio carico non ha, invero, sortito un effetto compensativo, atteso che la disciplina dell'accesso – lungi dal configurare una inviolabile prerogativa – patisce due testuali eccezioni. La prima, connessa alla tipologia della notitia criminis, è funzionale ad interdire ex ante la conoscibilità delle iscrizioni relative a procedimenti che abbiano ad oggetto reati di particolare gravità. La seconda è ricondotta al potere, attribuito al pubblico ministero, di secretazione delle inscrizioni in presenza di specifiche esigenze investigative. In una logica di disorganica stratificazione degli istituti, nel 1999 – dopo il fallimento dell'esperienza della contestazione della "imputazione provvisoria" di cui alla l. n. 234 del 1997 – fa il suo ingresso, sulla scena processuale, l'avviso di conclusione delle indagini preliminari, ai sensi del quale si onera il pubblico ministero, nell'ipotesi in cui non intenda richiedere l'archiviazione, di provvedere, a pena della nullità del successivo atto di esercizio dell'azione penale, di notificare alla persona sottoposta alle indagini un'informativa in cui l'ostensione degli atti di indagine si coniuga al riconoscimento di un corredo di facoltà difensive. L'avviso in argomento, contrariamente agli auspici del legislatore, lungi dall'attestarsi quale strumento principe per l'attuazione del diritto all'informazione sull'accusa, si è rivelato un «garanzia incompiuta» che, seppur dotata dei requisiti della comprensibilità e del dettaglio, contraddice il richiamo al «tempo più breve possibile», in tal modo deprivando il suo destinatario (anche) del beneficio della fruizione del tempo e delle facilitazioni necessarie per la predisposizione della strategia difensiva. A tale aporia funzionale si assomma la progressiva compressione, anche sulla scorta dell'esegesi giurisprudenziale, dell'ambito di operatività dell'istituto che, pertanto, non è idoneo a fungere da paradigma del diritto all'informazione sull'accusa. Dopo una breve analisi della disciplina dell'informazione sul diritto di difesa, regolato dall'art. 369-bis c.p.p., e sugli strumenti informativi operanti nel procedimento per l'accertamento della responsabilità amministrativa degli enti dipendente da reato (d.lgs. n. 231 del 2001), il presente lavoro si chiude con un bilancio sulla funzionalità dell'apparato informativo configurato nel codice di rito penale alla concretizzazione del principio consacrato nell'art. 111 comma III Cost. Sul profondo deficit della strumentazione – al di là della mancata rispondenza ai singoli connotati della tempestività, del dettaglio e della riservatezza – pare pesare la carenza di organicità nell'affidare l'attuazione del diritto all'informazione ad una pluralità di istituti privi di coordinamento e suscettibili di applicazione solo eventuale. ; XIX Ciclo ; 1973

Die Debatte über den Einsatz von Biotechnologien in der Landwirtschaft ist eine der lautstärksten und emotionalsten der letzten Jahre, da kaum ein Gebiet wissenschaftlich und gesellschaftlich so umstritten ist, wie die moderne Gentechnik. Grund hierfür sind die stark divergierenden Ansichten der Verbraucher und Regierungen bezüglich der aktuellen und potentiellen Gefahren und Vorteile, die Produkte der landwirtschaftlichen Biotechnologie – GVO und Produkte hieraus – mit sich bringen können. Der Bereich der gv landwirtschaftlichen Produkte hat erst kürzlich großes öffentliches Aufsehen durch die bevorstehenden Genehmigung der ersten gv Kartoffel erregt. Die Bundesregierung hat die Biotechnologie sogar zur Strategie des Monats August 2007 erklärt. Die Einführung der Gentechnik in der Landwirtschaft hat zu kontroversen Diskussionen geführt, die neben der ökologischen auch eine große wirtschaftliche Dimension haben. Trotzdem sind die Auswirkungen der Gentechnik bisher weitgehend unbekannt, womit sich die dringliche Frage nach einem geeigneten, anpassungsfähigen Rechtssystem stellt, das diesen Anforderungen – dem schnellen Wandel der Technik, der Ungewissheit über die Risiken, dem Druck der Öffentlichkeit, insb. in Europa, den gegensätzlichen Verbraucherinteressen weltweit sowie den divergierenden Zielen der EG, WTO und des Cartagena-Protokolls – gerecht werden kann. Deutschland ist das Land mit den meisten Biotechnologiefirmen in Europa, die 2006 einen Umsatz von ca. 1,5 Mrd. Euro erzielten und auf 947 Hektar gv Pflanzen, die über eine Zulassung zum IVB verfügen, anbauten. Weltweit wurden ca. 102 Mio. Hektar gv Pflanzen in 22 Ländern angebaut, davon rund 82% in den USA, Argentinien und Brasilien. Gang der Untersuchung: Der rechtliche Hintergrund genmanipulierter landwirtschaftlicher Produkte als Gegenstand des Öffentlichen Wirtschaftsrechts ist eine sehr weitreichende Materie, die für eine zielgerichtete und informative Darstellung der Thematik einiger Einschränkung bedarf. Bei 'genmanipulierten landwirtschaftlichen Produkten' handelt es sich um gv landwirtschaftliche Erzeugnisse, die zunächst im allgemeinen Kontext des Öffentlichen Wirtschaftsrechts eine Konkretisierung erfordern: Ursprung des Regelungsbedarfs bezüglich gv landwirtschaftlicher Erzeugnisse ist die Problematik des nationalen und internationalen Handels mit diesen Produkten. Dieser stellt gleichzeitig auch Dreh- und Angelpunkt der verschiedenen Interessengruppen wie Unternehmen, Landwirte und Verbraucher dar und beansprucht somit die höchste Notwendigkeit an Rechtssicherheit. Aus diesem Grund sollen sich die folgenden Ausführungen vornehmlich auf das Außenhandelsrecht als Zweig des Öffentlichen Wirtschaftsrechts beziehen. Nicht alle Erzeugnisse sind von Sonderregelungen betroffen. Daher bleibt ein beträchtlicher Teil der Ein- und Ausfuhr den allgemeinen Regeln des Außenhandelsrechts unterworfen, z. B. der Bereich des Zollrechts. Dies gilt für gv landwirtschaftliche Produkte aber gerade nicht: Diese sind sowohl auf nationaler bzw. europarechtlicher Ebene durch ein gemeinschaftsrechtliches System als auch auf internationaler Ebene, insb. durch das Protokoll von Cartagena und das SPSÜ, handelspolitischen Sonderregelungen unterworfen. Da die vorliegende Arbeit die rechtliche Situation für den Handel mit gv landwirtschaftlichen Erzeugnissen darstellen soll, liegen die ganz allgemeinen Vorschriften des Außenhandelsrechts, die bei Nichtvorliegen einer Sonderregelung greifen, außerhalb des Betrachtungsfeldes. Weiterhin abzugrenzen sind die unterschiedlichen Anwendungszwecke gv landwirtschaftlicher Produkte: Für den Handel mit GVO werden nur die Vorschriften untersucht, die den Anwendungszweck des IVB und der Aus-, Ein- und Durchfuhr gv landwirtschaftlicher Produkte regeln. Zur Abgrenzung des Begriffs des IVB ist die positive Definition in Art. 2 Nr. 4 S.1 RL 2001/18/EG bzw. die Negativ-Abgrenzung in Art. 2 Nr. 4 S. 2 RL 2001/18/EG heranzuziehen, da diese Regelungen europaweit Geltung beanspruchen und darüber hinaus auch die internationalen Vorschriften des Protokolls von Cartagena umsetzen. Abzugrenzen ist der Begriff des IVB in zweierlei Hinsicht, und zwar einerseits gegen Systemverwendungen und andererseits gegen Freisetzungen: Die Anwendung in geschlossenen Systemen beinhaltet den Forschungsaustausch zur Weiterverwendung im Labor oder die Weitergabe von GVO im Rahmen eines Patentierverfahrens, aber auch gewerbliche Weitergabe von GVO, jedoch lediglich für die industrielle Produktion in geschlossenen Systemen. Die FreisetzungsRL und die SystemRL bilden systematisch eine Einheit, in dem die Systemverwendung von GVO deren Freisetzung und diese wiederum dem IVB von GVO aufgrund des Stufenprinzips zeitlich vorgeordnet sind. Ziel ist es, die gesamte Produktionskette bezüglich des Umgangs mit GVO rechtlich zu erfassen: Solange keine sektoralen Vorschriften greifen, wird jede Tätigkeit mit GVO entweder von der SystemRL oder der FreisetzungsRL erfasst. Da der Umgang mit GVM in geschlossenen Systemen aufgrund der Einschließungsmaßnahmen als weniger risikoreich und grundsätzlich leichter kontrollierbar angesehen wird, sind weniger restriktive Genehmigungsregelungen und kein aufwendiges Zulassungsverfahren wie beim IVB von GVO vorgesehen. Daher sind die Verwendung von GVO in geschlossenen Systemen und die entsprechenden Regelungen nicht Teil dieser Arbeit. Weiterhin ist gegen den Begriff der Freisetzung abzugrenzen, dem in der FreisetzungsRL zunächst zwei unterschiedliche Bedeutungen zukommen: Die Legaldefinition des Begriffs in Art. 2 Abs. 3 RL 2001/18/EG beschreibt die Freisetzung als 'jede Art von absichtlichem Ausbringen (von GVO) in die Umwelt […]'. Hierunter wäre also das IVB von GVO, das Ausbringen von bereits genehmigten GVO in die Umwelt sowie auch Freisetzungen i.e.S. zu verstehen. Die Freisetzung gv landwirtschaftlicher Produkte i.e.S. betrifft eher die experimentelle Freisetzung zu Forschungszwecken als die Verfolgung kommerzieller Profitziele. Die Zulassung zum Zwecke des IVB ist wesentlich strengeren Voraussetzungen unterworfen als die zum Zwecke der Freisetzung. Somit sind die Regelungen zur Freisetzung weniger stark regulierend und haben demnach geringere Auswirkungen auf den Handel. Zudem soll diese Arbeit den Handel, also das 'auf den Markt bringen' von GVO als in der Praxis relevantere Form der kommerziellen Nutzung untersuchen, die sich in Form des IVB der Produkte vollzieht. Sie steht daher im Mittelpunkt dieser Untersuchung. Die Einbeziehung der Regelungen zu gv Arzneimitteln, die im allgemeinen Handel mit GVO sicherlich eine wichtige Rolle spielen, verbietet sich schon durch den Titel der Arbeit, der explizit nur landwirtschaftliche Produkte umfasst, zu denen Arzneimittel nicht zählen. Bezüglich des nun definierten Rechtsgebietes sollen sich die Ausführungen auf den europarechtlichen Rechtsrahmen, der auf die nationale Situation indirekt durch Richtlinien und direkt durch die jeweiligen Verordnungen stark Einfluss ausübt, sowie den internationalen Rechtsrahmen beziehen. Auf das deutsche Gentechnikrecht soll aus diesem Grund nur knapp eingegangen werden. Darüber hinaus werden in einer vergleichenden Darstellung Kernpunkte der US-amerikanischen Vorschriften mit einbezogen, die aufgrund ihrer Divergenz gegenüber den europarechtlichen Vorschriften den rechtlichen Gegenpol zur Vorbereitung einer abschließenden Analyse bilden. Die vorliegende Arbeit besteht aus vier Teilen. Teil 1 bildet mit einer kurzen Einführung in das Thema, der Abgrenzung und Vorgehensweise sowie der Begriffsdefinition den einleitenden Teil der Arbeit. Anschließend wird in Teil 2 der Stand der Forschung und Entwicklung im Bereich der Gentechnik sowie deren Vor- und Nachteile dargestellt. Teil 3 befasst sich mit der Darstellung der derzeit existierenden Vorschriften bezüglich des Handels mit gv landwirtschaftlichen Produkten. Da der Rechtsrahmen für gv Erzeugnisse in Fachkreisen als kompliziert gilt, aber dennoch für die Praxis äußerst relevant ist, bildet dieser Punkt den Hauptteil der Arbeit. Den Schlussteil der Arbeit bildet in Teil 4 die Analyse des Rechtsrahmens unter Berücksichtigung wichtiger Probleme aus der Praxis, wobei der Versuch gemacht wird, durch Vergleich gewonnene Verbesserungsvorschläge integrativ darzustellen. In Sachen Gentechnik ist die USA den Europäern einen Schritt voraus: Vor allem die Gesetzeslage ermöglicht der Forschung einen größeren Spielraum. Dies ist eine Folge der unterschiedlichen Rechtskulturen. Die Diskrepanzen der Rechtssysteme spiegeln die unterschiedlichen Ansätze und Einstellungen der Verantwortlichen der US-Regierung, der Verbraucher und der Industrie gegenüber GVO und gv Lebensmitteln. Das US-amerikanische Rechtssytem bezüglich GVO unterscheidet sich also stark von dem europäischen Rechtssystem. Der Grund: Die EU handelt nach dem Vorsorgeprinzip. In Europa gilt das Gentechnik-Verfahren grundsätzlich als risikoreich. Erst wenn man Schäden durch Gen-Pflanzen ausschließen kann, erlaubt Brüssel die Nutzung. Anders in den USA: Die Vorreiter auf dem Gebiet der Gentechnik forschen schon seit drei Jahrzehnten. Das Vorsorgeprinzip wird aufgrund seiner Fähigkeit, gesetzeswidrige Handelsbeschränkungen zu rechtfertigen und zu schützen, nur mit größter Vorsicht angewendet. Eine zentrale Kontrollstelle wie bspw. die EFSA gibt es ebenso wenig wie ein einheitliches Gentechnikrecht: Basierend auf dem Ansatz, dass gv Produkte im Grunde genommen nur eine Erweiterung herkömmlicher Produkte darstellen, machte sich die US-Regierung ursprünglich die bereits existierenden Gesetze zunutze, um die Sicherheit der gv Produkte zu garantieren. 1986 erließ die US-Administration dann das 'Coordinated Framework for Regulation of Biotechnology' und setzte damit den rechtlichen Grundstein für die folgenden 20 Jahre US-amerikanischer Regelungen zur Biotechnologie. Dieses Rahmenkonzept, das mit unwesentlichen Änderungen bis heute gilt, stellt einen vertikalen, risikobezogenen Verfahrensansatz bei der Regulierung der Gentechnik in den USA dar. Nach diesem Rahmenwerk sind Behörden, die für die Aufsicht über bestimmte Kategorien von Produkten oder bestimmte Arten der Produktverwendung verantwortlich waren, auch zuständig für die Bewertung gleichartiger gv Produkte. Es sind demnach keine neuen Behörden speziell für den Bereich gv Produkte errichtet worden, wie dies bspw. nach europarechtlichen Regelungen bei der ESFA der Fall war. So ist die 'Food and Drug Administration' (FDA) verantwortlich für die Lebens- und Futtermittelsicherheit, auch im Bereich der GVO. Im US-amerikanischen Landwirtschaftsministerium (United States Department of Agriculture, USDA) ist der 'Animal and Plant Health Inspection Service' (APHIS) verantwortlich für die Risikobewertung gv Pflanzen; und die 'Environmental Protection Agency' (EPA) ist zuständig für die Entwicklung und Freisetzung gv Pflanzen. Die derzeitigen rechtlichen Vorschriften für Produkte der modernen Biotechnologie sind der 'Plant Protection Act' (PPA), der 'Federal Food, Drug, and Cosmetic Act' (FFDCA), der 'Federal Insecticide, Fungicide, and Rodenticide Act' (FIFRA) und der 'Toxic Substances Control Act' (TSCA). Neue Vorschriften wurden - sofern notwendig – nach Maßgabe dieser Gesetze entwickelt, um der Entwicklung neuer gv Produkte gerecht zu werden. Leitlinien zur Genforschung schreiben die National Institutes of Health (NIH) vor. Die einzelnen Bundesstaaten überprüfen die Nutzung. Außerdem werden US-Unternehmen über ein einheitliches Haftungsrecht direkt zur Verantwortung gezogen, wohingegen gerade die Haftungsproblematik in Europa noch nicht einheitlich geregelt ist. In den USA ist die Gentechnik längst im Alltag angekommen. Gentechnisch veränderte Lebensmittel finden sich in jedem gut sortierten Supermarkt – ursprünglich ohne Kennzeichnung. Allerdings ist in den letzten Jahren der Widerstand der Verbraucher gegenüber gv Lebensmitteln auch in den USA angewachsen, so dass auch die US-amerikanische Öffentlichkeit immer stärker nach einer angemessenen Kennzeichnung gv Lebensmittel verlangt. Im US-Kongress hat der Abgeordnete Kucinich seit 2000 die Gesetzgebung bezüglich der freiwilligen Kennzeichnung von gv Lebensmitteln vorangetrieben und 2003 sechs Reformvorschläge zu Rechtsvorschriften über gv Pflanzen erarbeitet und eingeführt. Der vorgeschlagene 'Genetically Engineered Food Right to Know Act of 2006' sowie weitere fünf Vorschriften zu gv Produkten sollen den Schutz der Verbraucher stärken, insb. durch die Verpflichtung der Lebensmittelindustrie, alle Lebensmittel, die GVO enthalten oder mit GVO hergestellt sind, als solche zu kennzeichnen. Desweiteren soll die FDA Kontrollen durchführen, um die Einhaltung der Vorschriften zu gewährleisten. Der seit 2001 bestehende 'Pre-market notice concerning bionegineered foods' verlangte eine Anmeldung zur Genehmigung bei der 'agency of data and information' bezüglich gv Lebens- oder Futtermittel, mindestens 120 Tage vor dem IVB, allerdings nur auf freiwilliger Basis. Diese Vorschriften sollen nun ersetzt werden durch strengere Vorschriften zur Kennzeichnung, Überwachung und Genehmigung, angeregt durch das USDA. Diese Verstärkung der Gentech-Vorschriften soll auch ein mehrstufiges, risikobasiertes Zulassungsverfahren enthalten, um das derzeitige Zulassungs-/Genehmigungsverfahren zu ersetzen. Amerikanische Verbraucher haben offensichtlich weniger Angst vor Gen-Food. Sie scheinen eher der Wirtschaft zu vertrauen, und die Europäer eher den staatlichen Behörden, die sich auf Verbraucherschutz und auf die Freiheit, zwischen genmanipulierten und konventionellen Lebensmitteln wählen zu können, berufen.

L'abstract Lo studio dell'economia islamica è considerabile uno degli strumenti più importanti per comprendere la natura della storia del mondo musulmano, in virtù della sua enorme influenza nella formazione degli eventi storici. I fattori economici, accanto ad altri fattori, hanno, infatti, un peso fondamentale sull'evoluzione dei fatti storici. L'argomento di tale ricerca si incentra sull'aspetto finanziario come parte dell'ambito economico. Tale scelta è motivata dal fatto che la maggior parte delle ricerche e dei saggi sul periodo dei "califfi retti" (al-Khulafà al-Ràshidùn) si concentrano sull'aspetto politico-religioso senza soffermarsi su quello economico, cosa che si riflette negativamente sulla giusta comprensione di quel periodo: nonostante l'importanza dei fattori politico-religiosi, essi non sono, però, sufficienti ad avere una quadro chiaro degli eventi, in assenza di studi specifici sui fattori socio-economici che ne influenzano il corso. Per questo abbiamo tentato di concentrarci in questa ricerca sull'aspetto finanziario, per provare una lettura il più possibile completa degli eventi storici. Non ci è stato possibile trattare l'intera realtà finanziaria dello Stato islamico, cosa che comporterebbe un tempo molto più lungo, e una serie molto più articolata di studi. Abbiamo perciò preferito concentrarci sulla politica finanziaria dello Stato islamico nel periodo del califfato di Ali bin Abi Talib, e tramite ciò effettuare una comparazione tra la politica finanziaria del califfo Ali e dei suoi predecessori. A questo ci ha spinto la scarsità di studi su tale periodo: la maggior parte dei saggi che trattano di questa fase si concentrano sull'aspetto militare e sugli eventi bellici vissuti dallo Stato islamico in tale epoca, al punto da credere, leggendo alcune di queste opere sul califfato di Ali bin abi Talib, che egli abbia realizzato ben poco di concreto per lo Stato islamico. In questo, Ali bin Abi Talib ha subito un doppio torto: una prima volta con la rivolta immotivata di alcuni gruppi di musulmani contro il suo califfato, e una seconda volta, con l'astensione della maggior parte degli studiosi dall'esame degli aspetti sociali, politici, amministrativi e religiosi del suo periodo. Possiamo scusare tali studiosi in considerazione della scarsità di versioni e di fonti islamiche su questi aspetti, a fronte di una abbondanza di fonti e narrazioni che riportano eventi militari e bellici. Inoltre vi è da considerare anche la mancanza di neutralità da parte di alcuni ricercatori: considerare gli aspetti economici, finanziari e amministrativi del califfato di Ali bin Abi talib vuol dire, infatti, studiare i cambiamenti da lui apportati alle politiche fino ad allora in voga, evidenziando gli aspetti negativi delle fasi precedenti al suo governo, cosa che potrebbe portare ad una dura critica dei califfi che hanno adottato alcune politiche errate, volutamente o per incapacità di comprensione. Un critica di tale genere molto spesso rappresenta un tabù intoccabile per gran parte dei ricercatori, visto il grado di rispetto, che a volte sfiora la santità, di cui godono quei califfi presso la massa dei fedeli musulmani. Per questo la maggior parte dei ricercatori si è astenuta dal toccare tali argomenti, e anche chi li abbia trattati lo ha comunque fatto in maniera concisa, spesso distorcendo la realtà con analisi lontane dalla logica e dalla realtà. Per questo abbiamo deciso di focalizzare il discorso su tale argomento, data la sua importanza storica, con l'obiettivo di proporre un'immagine chiara e nitida di tale importantissima fase della storia islamica, i cui effetti sono ancora oggi presenti. Questo nonostante la difficoltà di svolgere una tale ricerca, data la scarsità delle fonti e la brevità del periodo preso in considerazione, ovvero il califfato di Ali bin Abi Talib, a fronte di una abbondanza di narrazioni sulle battaglie intestine da lui affrontate in tale epoca. La ricerca è divisa in quattro capitoli. Il primo esamina la presa di potere dell'imam Ali, attraverso uno studio sui meccanismi dell'avvicendamento politico tra i musulmani dopo la morte del Profeta (PBL), il criterio di scelta dei tre califfi precedenti, i problemi sorti prima del suo califfato e le ripercussioni di tali problemi sulle politiche finanziarie dello Stato islamico. Quindi vi è l'esame del programma politico ed economico annunciato dal califfo Ali bin Abi Talib al momento della sua nomina alla guida del califfato. Lo studio dei meccanismi di avvicendamento del potere e del califfato in questo capitolo è motivato dal fatto che, pur essendo questo un argomento politico-religioso, è innegabile la presenza di uno stretto, indissolubile legame tra la politica e l'economia in tale fase; non potremmo dunque capire l'argomento della tesi senza toccare tale ambito, specialmente se consideriamo che la maggior parte della legislazione finanziaria all'interno dello Stato islamico si era già formata prima del califfato dell'imam Ali stesso, ovvero sotto i califfi a lui precedenti. Per questo abbiamo esaminato in tale capitolo questi ambiti, analizzando le cause alla radice dei problemi sorti all'interno dello Stato islamico in tale periodo. Nel secondo capitolo vi è uno studio delle risorse finanziarie dello Stato islamico, a partire dall'istituzione centrale preposta alle finanze dello Stato islamico, ovvero il Bayt al-Màl (Erario). In questo abbiamo presentato lo sviluppo di tale istituzione dai tempi del Profeta (PBL), passando per l'era dei primi tre califfi fino al governo di Ali bin Abi Talib, considerando gli aspetti finanziari, amministrativi e politici di tale istituto, e focalizzando il discorso sui cambiamenti apportati dall'imam Ali su di essa. Quindi abbiamo preso in considerazione le tipologie di tassazione applicate dallo Stato islamico, come l'imposta fondiaria sul demanio statale (kharàg); l'imposta personale (gizya) sui non musulmani della Gente del Libro, la questua (zakàt), sui redditi eccedenti ai bisogni dei musulmani, da rilevare su base annuale; le spoglie (fay'), ovvero i beni ottenuti dai musulmani senza combattere, il bottino (ghanàim), ovvero i beni conquistati dai musulmani combattendo contro nemici; la decima ('ushr), divisa in due categorie: la decima terriera, ovvero una percentuale calcolata sulla base dei terreni posseduti dai musulmani, e la decima commerciale, calcolata sui redditi da commercio. Queste tipologie di tassazione sono state esaminate secondo il metodo adottato nel descrivere il Bayt al-Màl, con una analisi del metodo di esizione e di erogazione delle imposte all'epoca del Profeta (PBL), quindi la loro evoluzione e le prime aggiunte e innovazioni sotto i primi tre califfi, e gli sviluppi e le riforme addottate nell'era dell'imam Ali. Il terzo capitolo è, invece, un esame delle voci di spesa dello Stato islamico, con una descrizione delle politiche statali di distribuzione di tali risorse, politiche che variano con il variare dei periodi storici, a partire dall'epoca del Profeta (PBL) e i primi tre califfi, per poi passare a discutere delle riforme apportate dal califfo Ali sulle politiche di spesa dello Stato islamico. Tale capitolo è forse uno dei più importanti della ricerca, in quanto i cambiamenti adottati dall'imam Ali nella distribuzione dei salari dei musulmani impiegati presso lo Stato islamico (ambito in cui innoverà fortemente rispetto ai califfi suoi predecessori, introducendo un elemento di uguaglianza per tutti i musulmani nell'accesso agli emolumenti statali) sarà uno delle cause fondamentali della rivolta affrontata dal califfato di Ali, in quanto la politica di eguaglianza sociale e finanziaria da lui promossa susciterà la protesta di alcuni beneficiari delle politiche finanziarie precedenti. Il capitolo esamina anche le altre voci di spesa introdotte dall'imam Ali, come la previdenza sociale e altre pratiche di assistenza, oltre alle spese pubbliche relative alla riforma agraria e le campagne di urbanizzazione del territorio. Il quarto capitolo è, invece, incentrato sull'amministrazione dei beni nell'epoca del califfato di Ali bin Abi Talib, con in primo piano la suddivisione amministrativa delle province islamiche e le modifiche da lui apportate nell'amministrazione finanziaria, tramite la scelta di un gruppo di governatori e preposti famosi per la loro onestà e competenza nell'amministrazione delle risorse statali, e l'allontanamento dai posti di amministrazione finanziaria di tutti gli elementi di corruzione. Quindi vi è la descrizione dei requisiti posti dal califfo Ali stesso per la scelta di tali funzionari, dall'esperienza amministrativa alla competenza, alla fedeltà allo Stato e alle sue politiche. Quindi si passa ai mezzi di controllo amministrativo messi in essere dal califfo Ali all'interno del sistema di governo dello Stato islamico, compreso il sistema di ispezioni nelle province islamiche, il controllo popolare concesso dal califfo al consesso dei Musulmani e degli altri cittadini dello Stato sui funzionari governativi all'interno dei propri territori, e l'istituzione del sistema di ispettori segreti governativi ('uyùn), qualcosa che ricorda molto da vicino il moderno sistema di intelligence. L'elaborazione dei primi due capitoli è pressoché completata, mentre si è provveduto ad una prima stesura completa dei capitolo terzo e quarto. L'operazione di aggiunta e approfondimento di informazioni è ancora in corso, così come la modifica e lo spostamento di alcuni paragrafi. Siamo comunque riusciti a reperire un buon numero di ottime fonti storiche sufficienti alla stesura della ricerca, di cui prevediamo di completare a breve anche gli ultimi capitoli in maniera definitiva.

Emerging economies and the behaviour of firms domiciled in these markets is beginning to develop as a research area; yet little empirical work exists (Bruton, Ahlstrom, & Obloj, 2008; Hoskisson, Eden, Lau, & Wright, 2000; Meyer & Peng, 2005; Peng, Wang, & Jiang, 2008; Wright, Filatotchev, Hoskisson, & Peng, 2005). An extensive and critical review of the literature revealed that there was limited research that focused on the internationalisation of emerging economy firms to other emerging and developed economies. In order to address this clear gap in our understanding, the broad research problem that this thesis sets out to investigate is 'how do institutions, organisational governance and managerial intentionality effect the internationalisation of smaller Indian firms'? It is argued that in order for research in strategy to make a lasting contribution, there is a need to contemplate whether the theories and methodologies developed in primarily mature and developed economies are applicable to the emerging economy context (Wright et al., 2005). In addressing this concern, this study draws on institutional theory, transaction cost theory, the resource-based view and aspects of the organisational capabilities perspective in order to understand the internationalisation of smaller Indian firms. In particular, the aim of this research was to understand the effect of institutions (Research Question One), organisational governance (Research Question Two) and the moderating effect of managerial intentionality (Research Question Three) on the internationalisation of smaller Indian firms. India was chosen as the context for the study due to its rapid growth in recent years which places it among the four big emerging economies of the world (Wilson & Purushothaman, 2003). The relatively recent liberalisation of the Indian economy in 1991 provides an interesting context within which to study the internationalisation behaviour of firms. Prior to its liberalisation India adopted what was known as an inward-focused, socialist-style, economic framework (Wilson & Keim, 2006). The liberalisation of the Indian economy has increased the country's trade linkages with other emerging and developed countries, yet little research has been conducted on the internationalisation of Indian firms (Peng et al., 2008; Wright et al., 2005). Further, India's linguistic distance but geographic closeness to emerging markets, yet western Commonwealth past and geographic distance to developed markets makes it a unique context. The research methodology adopted in this study entailed a qualitative design conducted through multiple case studies. The case study firms comprised four smaller manufacturing and four smaller service firms. Cases for the study were selected theoretically (Eisenhardt, 1989) using intensity sampling, snowball sampling, criterion sampling and opportunistic sampling techniques (Patton, 1990). To determine the size of the firms, the definition proposed by the Government of India was used. One key growth region in India was chosen due to the institutional diversity in India. Bangalore was chosen as it is considered a high growth region of the country that is well reputed for its service sector, as well as a competitive manufacturing sector (Ahya, Xie, Roach, Sheth, & Yam, 2006). The adoption of a multiple case study design facilitated an aggregated cross-case analysis. The data was collected through in-depth, semi-structured interviews with senior management in the selected case study firms. In addition, documentary evidence was collected through newspaper articles, information from trade journals and information from the company websites. The interviews were guided by an interview protocol and a case study database was created for each firm in order to increase the reliability and validity of the data. The data was coded using NVivo (version 7) and analysed using the 'template approach' (Crabtree & Miller, 1999). To date, literature originating out of mature markets has regarded institutions as background information due to the stability and maturity of institutions in these markets (Ingram & Silverman, 2002). However, when studied in an emerging market context, the role of institutions is argued to be pushed to the forefront of strategy research due to its relative underdevelopment (Meyer & Peng, 2005). This study used Scott's (1995) three institutional pillars (regulative, normative and cognitive) to gain an institution-based view of the business strategies pursued by the smaller Indian firms (Peng et al., 2008). The findings highlighted regulatory institutional influences at the home country, host country and trade policy levels. The findings from this study shed light on the notion of institutional entrepreneurship, thereby extending institutional theory to take into account the strategic behaviour of firms. The findings further emphasised the need to gain legitimacy in international markets as a means to gain access to resources and overcome the liabilities of foreignness and newness. In doing so, the findings from this study extended Mathews' (2006) 'linkage, leverage and learning' strategy to a 'linkage, leverage, learning and legitimising' strategy. Next, the findings from Research Question One extended the U-Model of internationalisation to highlight the importance of domestic market experience when gained in an institutionally complex market such as India. Finally, the findings highlighted the interaction between the path-dependent experience of the founders and the various dimensions of their managerial intentionality in managing the institutional influences on the firm. In studying organisational governance decisions (Research Question Two), transaction cost theory was used as the key conceptual perspective. This study used Williamson's (1975) governance continuum to understand the organisational governance decisions of smaller Indian firms. Interestingly, the findings emphasised a move away from the narrow comparative-efficiency framework developed by Williamson (1975), towards a more eclectic understanding of the effect of transaction costs. The findings highlighted the choice of governance modes not as discrete designs, but as those that overlap as a result of being influenced by institutions, the experience of the firm with a particular mode, the propensity to trust, the constraints on firm behaviour, the managerial intentionality of the founders and the need to gain local knowledge from network partners. In adopting this broader perspective, the findings addressed the call by Madhok (1997) to understand the choice of governance modes from more than a cost minimisation perspective. Hutzschenreuter, Pedersen and Volberda (2007) suggested that the role of managerial discretion to date is downplayed in existing IB literature and hence called for research to focus on the role of managerial intent in the strategies of established multinationals rather than on the process of 'becoming a multinational'. Research Question Three highlighted the moderating effect of managerial intentionality in managing the institutional influences and governance decisions of the firm. This study extended Hutzschenreuter et al.'s (2007) conceptualisation of managerial intentionality by emphasising the resilience as well as the reluctance of the founders (due to past experiences) as important in the emerging economy context. This study has practical implications for the case study firms as well as for potential entrants into India. Firstly, for the case study firms it is important to develop clear internationalisation strategies (as opposed to a reactive approach) due to the increasing competition both locally and internationally. Second, for the manufacturing firms, it is important to move beyond their pure low cost advantage. Partnering with other companies to leverage their resources and capabilities in international markets is one possibility. Third, for these firms to remain globally competitive, the sourcing of international talent is likely to increase their legitimacy and reduce their liability of foreignness. Finally, the continued liberalisation of the Indian economy has made it an attractive destination for foreign firms. While the case study companies have recognised the opportunities overseas, they should not ignore their domestic market where they enjoy a 'home court advantage'. For potential entrants into India, it is important to recognise the potential competitive advantage that local incumbents have with regard to the environment. Second, foreign firms entering India and competing with smaller players need to understand the subtleties of the market and tailor their strategies to meet local needs. Finally, while this study has made contributions to the field, the findings must be interpreted in light of the limitations of the study. First, this study focused on one key big emerging market; India. Further, within India only one key region was examined. The findings reflect the business strategies by firms domiciled in Bangalore. Hence future studies could extend this research to other emerging markets and other regions of India to gain a more detailed perspective. Second, given the qualitative nature of the study, only analytical generalisations can be made. However, these insights can provide a basis for future researchers to develop quantitative measures to test the inferences drawn. Finally, this study was cross sectional in nature. In order to gain a more detailed analysis on the effect of institutions, future researchers may consider a longitudinal design to capture the institutional transitions over time.

Gegenstand dieser gesellschaftsgeschichtlichen Forschungen zur preußischen Freimaurerei des 18. Jahrhunderts sind die Logengeschichte, die Mitglieder und die Mitgliederstruktur, das gesellschaftliche, soziale und kulturelle Leben der Logen und ihre Außenwirkung, also die reale gesellschaftliche Bewegung in der spätfeudalen Gesellschaft Brandenburg-Preußens gegen Ende der Frühen Neuzeit. Die ideologische Ausprägung der Freimaurersysteme (Rituale u.a.), die philosophische und literarische Kritik und die freimaurerisch inspirierte Kunst erscheinen nur am Rande. Die Darstellung beruht auf dem überlieferten Archivgut, der meist nur unikal erhaltenen alten sowie auf der neueren masonischen Literatur, des weiteren auf der sozialgeschichtlichen, landesgeschichtlichen und biographischen Literatur. Ausgewertet werden vor allem die im Geheimen Staatsarchiv Preußischer Kulturbesitz, Berlin-Dahlem, aufbewahrten, ab 1990 zugänglichen reichen Freimaurerbestände der Altpreußischen Logen, ferner Quellenbestände des Orde van vrijmetselaren onder het Grootoosten der Nederlanden, Den Haag, des Den danske Frimurerorden, Kopenhagen, des Landesarchivs Berlin, des Landesarchivs Magdeburg - Landeshauptarchiv, des Brandenburgischen Landeshauptarchivs, Potsdam, des Stadtarchivs Potsdam, des Thüringischen Hauptstaatsarchivs, Weimar, des Österreichischen Staatsarchivs, Abteilung Haus-, Hof- und Staatsarchiv, Wien, sowie die Bibliotheken des Deutschen Freimaurer-Museums Bayreuth, der Großen Landesloge der Freimaurer von Deutschland, Berlin, der Großen National-Mutterloge "Zu den drei Weltkugeln" zu Berlin, der Biblioteka uniwersytecka w Poznaniu, Pracownia Zbiorów Masonskich, Poznan, und der Großen Loge der alten freien und angenommenen Maurer von Österreich, Wien. Die Darstellung ist chronologisch und regional gegliedert unter jeweils gleichen Sachpunkten; die kommentierten alphabetischen Mitgliederlisten sind den Logen nachgeordnet. Behandelt werden die Preußischen Staaten in den Grenzen von 1795 (Frieden von Basel, Dritte Polnische Teilung). Das vorliegende Manuskript hat die preußischen Logen zwischen Oder und Niederrhein zum Gegenstand; geplant sind weitere Bände zu Berlin sowie Pommern, Ost- und Westpreußen und Schlesien Die positive Logenpolitik der preußischen Könige markierte den politischen Rahmen für eine ungestörte kontinuierliche Entwicklung der Freimaurerei, beginnend 1740 mit der Legitimierung der Freimaurer durch Friedrich II. und gipfelnd im Allgemeinen Landrecht für die preußischen Staaten und in dem auf ihm beruhenden Edikt wegen der geheimen Verbindungen (1794, 1798). In den mittleren und westlichen Provinzen, ohne Berlin, sind in 30 Städten 47 rechtmäßig konstituierte Johannislogen als Gliederungen großer Logenbünde ermittelt. Bis zum Siebenjährigen Krieg blieben die wenigen Logen auf die großen Städte beschränkt. Der Siebenjährige Krieg belebte die Freimaurerei lediglich in den Festungen (Logen kriegsgefangener Offiziere). Nach dem Krieg nahm die Freimaurerei während eines langen Friedens trotz interner Auseinandersetzungen, des Logenkrieges, und Spaltungen einen großen Aufschwung. Sie erfasste das ganze Land, alle Groß-, die meisten Mittel- und viele Landstädte und auch das platte Land. Ein Vorzug der Logen gegenüber anderen Sozietäten war ihre soziale Offenheit und Breite. Die Logen organisierten in wachsender Zahl Männer unterschiedlichen Standes und (christlicher) Konfession aus den neuen, das friderizianische Preußen tragenden und mit seinem Aufstieg verbundenen sozialen Schichten und Gruppen: Adlige und Bürger, Behördenbeamte und Offiziere, Finanz- und Manufakturunternehmer, Intellektuelle und Künstler. Sie leisteten einen wichtigen Beitrag zur Emanzipation und zur Grundlegung der bürgerlichen Gesellschaft des 19. Jahrhunderts. Die Logen organisierten 3665 Männer, die 32 Prozent aller preußischen Freimaurer ausmachten, außerdem 220 Dienende Brüder (Logenangestellte aus den Mittel- und Unterschichten). Die Vollmitglieder kamen zu einem Drittel aus dem überwiegend in Staatsdiensten stehenden Adel und zu zwei Dritteln aus dem neuen Bürgertum. Die Behördenbeamten und die Offiziere stellten etwa je ein Drittel, die Kaufleute, Finanz- und Manufakturunternehmer, Fabrikanten, Verlagsbuchhändler und -drucker, Gastwirte, Schiffskapitäne u.a. etwa ein Viertel und die Theologen, Hochschul- und Gymnasiallehrer, Ärzte, Apotheker, Studenten sowie die Künstler etwa ein Zehntel der Logenmitgliedschaft. Die preußischen Logen des Zeitalters der Aufklärung waren rechtlich geschlossene Vereine. Sie waren weder schlechthin aufgeklärte, politische oder Geheimgesellschaften. Sie grenzten sich als Verein und im maurerischen Selbstbewusstsein (freimaurerisches Geheimnis) von der Öffentlichkeit ab, öffneten sich ihr aber sozial und kulturell. Sie halfen bedürftigen Freimaurern und ihren Familien, beteiligten sich am sozialen Engagement des Staates und der Kirchen, unterstützten oder unterhielten Waisenhäuser und Schulen, organisierten bei Brandkatastrophen und Überschwemmungen landesweite Geldsammlungen und errichteten eine der frühesten öffentlichen Badeanstalten. Die Logen initiierten und belebten das kulturelle Leben der Stadt mit öffentlichen Festen und Konzerten, stellten Denkmäler auf und richteten Bibliotheken, Lesegesellschaften und Ressourcen ein. Bisher beschränkte sich die wissenschaftliche Literatur im Wesentlichen auf einzelne Personen und auffällige Erscheinungen. Über die reale Existenz der Logen und ihren einflussreichen Platz in der altpreußischen Gesellschaft war wenig bekannt. Damit fehlte ein wesentliches Element der Geschichte Brandenburg-Preußens. Die Untersuchung will diese Lücke schließen helfen. ; In the centre of the present research on the social history of the Prussian freemasonry in the 18 century are the history of the lodges, the membership and its structure, the social and cultural life of the lodges and their influence on society, i.e. the actual societal situation of the lodges in the late feudal society of Brandenburg-Prussia towards the end of the Early Modern Age. The ideological aims and practice of the systems of freemasonry (rituals etc.), the philosophical and literary critique as well as the arts rooted in freemasonry are delt with only in passing. The sources of this research are the traditional manuscripts from archives, mostly unique old scripts and modern masonic literature, as well as the literature of socio-historical, regional-historical and biographical origin. The following sources have been searched and analyzed: the opulent masonic sources of the ancient Prussian lodges of the Geheimes Staatsarchiv Preußischer Kulturbesitz, Berlin-Dahlem, having been made available since 1990; the sources of the Orde van vrijmetselaren onder het Grootoosten der Nederlanden, Den Haag, of the Den danske Frimurerorden, Kopenhagen, of the Landesarchiv Berlin, of the Landesarchiv Magdeburg - Landeshauptarchiv, the Brandenburgisches Landeshauptarchiv, Potsdam, the Stadtarchiv Potsdam, the Thüringisches Hauptstaatsarchiv, Weimar, the Österreichisches Staatsarchiv, department Haus-, Hof- und Staatsarchiv, Vienna, as well as the libraries of the Deutsches Freimaurer-Museum, Bayreuth, the Great Lodge of Freemasons of Germany, Berlin, the Great National Mother Lodge "To the Three Globes" in Berlin, the Biblioteka uniwersytecka w Poznaniu, Pracownia Zbiorów Masonskich, Poznan, and the Great Lodge of the Old Free and Accepted Freemasons of Austria, Vienna. The Handbook is structured chronologically according to regions and with analogue topics; the alphabetic commented lists of the entire membership follow the chapters of every lodge. Regionally the research covers the Prussian states within their borders of 1795 (Peace of Basel, Third Polish Partition), but without territories that followed a relative autonomous way in their history, or belonged to Prussia only a short term, or came to Prussia after 1795. This manuscript deals with Prussian lodges between the Oder river and the Lower Rhine; the envisaged volumes for publication will include Berlin, Pomerania, Eastern and Western Prussia as well as Silesia. The favourable policy of the Prussian kings formed the external political basis for a continuous development of the freemasonry in the monarchy. This began 1740 with the legitimation of the freemasons by Frederic II and led to the "Common Law of the Prussian States" and the following "Edict on Secret Associations" in 1798. Between 1739 and 1806, 47 legally constituated Johannis lodges as parts of the larger Lodges have been registered in 30 towns in the middle and western provinces, but without Berlin. Until the Seven Year War (1756-1763) the small number of isolated lodges was restricted to the larger cities. A stimulating influence for the freemasonry came only from the garnisons (lodges of the captured officers). After the war, during a long peaceful period, the freemasonry took a steep upsurge, despite the internal struggles, called the "Lodge Wars", and the splittings. The freemasonry extended over the entire country, to the big cities and medium-sized towns and many rural towns. The Lodges distinguished themselves from other associations by their social openness and broadth of membership. They organized a rising number of men from different classes, social strata, groups or trades, (christian) confessions, education and ages. The freemasons belonged to the newly emerging social strata and groups which formed the Prussian state of Frederic II and were closely connected with its progress. These were the nobility and the middle class, the clerks and officers, bankers and manufacturers, intellectuals and artists. Their contribution to the foundation and the emancipation of the bourgeois society of the 19 century was essential. The Prussian lodges between the Oder river and the Lower Rhine organized 3,665 freemasons, these are 32 percent of the number of the presently registered freemasons, as well as 220 Serving Brothers (members of the middle and lower social strata). The members with full rights from the nobility formed one third, those from the new middle classes two thirds of the membership. According to their trades, the office clerks and the officers equally comprised one third, the entrepreneurs (merchants, bankers and manufacturers, publishers and booksellers, pub owners, ship owners) made up about one fourth, and the intellectuals (theologians, lecturers at university and gymnasiums, physicians, chemists, students) and the artists about one tenth of the memberships. The Prussian freemasonry was characterized mainly by their social aims. Although the lodges were closed associations, they were neither political nor secret societies, nor were they enlightened, but they were part of the era of Enlightenment. As an association and in their masonic self-assurance (masonic secrecy) they separated themselves from the public, but in social and cultural terms they were open to the public. They helped needy members and their families, took part in the social engagement of the state and the churches, ran or assisted orphanages and schools, organized countrywide donations after fire catastrophies and floods, and they built one of the first public swimming baths and public monuments, and they organized public libraries, reading societies and ressources. Public festivities and concerts, initiated by the lodges, enlivened the cultural life of the cities. In the past scientific literature usually confined itself to single persons and prominent events. Nevertheless, little was known about the actual existence of the lodges and their influential place in the civic society. Thus an essential element of the bourgeois society in Brandenburg-Prussia had been missing. The present book is meant to fill this gap.

보건학과/박사 ; [한글]이 논문은 질병과 음주로 인해 개인 및 사회가 부담하는 사회경제적 손실을 질병비용(cost-of-illness, COI) 연구에 기초하여 추계한 두 개의 연구로 구성하였으며, 주요 내용은 다음과 같다.첫 번째 연구 '연도별 전체 질병과 주요 질병의 사회경제적 비용 추이 분석'은 질병으로 인해 발생하는 의료비 및 소득 손실 등을 화폐단위로 추계함으로써 건강의 가치가 경제 및 사회에 미치는 영향을 분석하는데 초점을 두었다. 연구방법은 우리나라 전체 질병을 20개 범주로 분류한 후, 각 질병군에 대한 사회경제적 비용을 성, 연령, 비용 항목, 질병군에 따라 세분화하여 6개 연도(1999~2004년)에 대해 추계하였다. 비용 항목은 크게 직접비와 간접비로 구분하였으며, 직접비에는 직접 의료비와 직접 비의료비(교통비, 간병비), 간접비에는 조기사망으로 인한 미래소득 손실, 의료이용에 따른 생산성 손실을 포함하였다. 연구 결과, 첫째 우리나라의 질병 비용은 2004년 불변가격 기준으로 1999년 55조 1,896억 원부터 2004년 61조 5,965억 원까지 지속적으로 증가하는 추세를 보였다. 둘째, 상해(전체 질병비용의 18.5~20.6%), 신생물(13.4~16.1%), 소화기계질환(11.2~13%), 순환기계질환(10.8~12%), 호흡기계질환(8.9~11.5%) 순으로 질병 비용이 큰 것으로 추계되었다. 셋째, 남자가 전체 질병비용의 65~67.2%로 여자의 약 2배로 추계되었다. 넷째, 연령대별로는 40대, 30대, 50대, 60대 순으로 질병 비용이 크며, 전반적으로 40대 이상에서는 증가, 반면에 30대 이하에서는 질병비용 비중이 감소하는 추세이다. 끝으로, 조기사망으로 인한 손실(전체 질병비용의 47.1~49.3%), 의료비(31.1~37.2%), 의료이용에 따른 생산성 손실(7~10.9%), 교통비 및 간병비(7.9~10.1%)순으로 질병비용 비중이 큰 것으로 추계되었으며, 전반적으로 생산성 손실과 교통비 및 간병비는 증가, 반면에 의료비는 감소, 조기사망으로 인한 미래소득 손실은 소폭의 증감추세를 반복하는 것으로 추계되었다. 결론적으로, 우리나라는 40대 이상과 남자에서 질병으로 인한 사회경제적 비용이 크고, 다른 국가에 비해 상해(injury), 신생물, 소화기계질환의 질병비용 비중이 큰 것으로 추계되었다. 따라서, 질병으로 인한 사회경제적 손실을 줄이기 위해서는 성, 연령, 비용 항목, 질병군 별로 고비용 발생군에 대한 지속적인 검진 및 감시가 이루어져야 하며, 보건의료정책에 있어서도 우선순위 부여와 자원배분이 이루어져야 할 것이다.두 번째 연구 '음주로 인한 사회경제적 비용 추계'에서는 질병발생의 주요 위험요인인 음주의 사회경제적 비용을 2004년 기준으로 추계하였다. 이 연구에서는 음주로 인한 모든 건강문제와 알코올과의 관련정도를 나타내는 알코올기여율(alcohol attributable fraction, AAF) 산출을 위해 호주의 성 및 연령별 비교위험도와 우리나라의 중․고위험 음주자 비율을 이용하여 한국형 AAF를 산출하였다. 비용 항목은 크게 직접비, 간접비, 기타 비용으로 구분하고, 직접비에는 직접 의료비, 직접 비의료비(교통비, 간병비), 간접비에는 조기사망으로 인한 미래소득 손실, 의료이용에 따른 생산성 손실, 음주숙취로 인한 생산성 저하, 기타 비용에는 재산피해액, 행정처리비용을 포함하였다. 조기사망으로 인한 손실은 인적자본접근법에 기초하여 추계하였다. 연구 결과, 우리나라의 음주로 인한 사회경제적 비용은 15조 6,261억 원으로 GDP 대비 2.25% 수준이며, 과도한 음주로 인한 생산성 저하 50%, 조기사망으로 인한 손실 34.6%, 직접 의료비가 6.9%, 의료이용으로 인한 생산성 손실 3%, 직접 비의료비 2.4%, 기타 비용(재산피해 및 행정비용)이 3.2%를 차지하였다. 이는 국내 선행연구들에 비해 음주로 인한 사회경제적 비용이 증가한 것이며, 다른 국가와 비교해도 우리나라의 음주로 인한 손실이 큰 것으로 추계되었다. 특히, 과도한 음주로 인한 생산성 저하와 의료이용에 따른 생산성 손실이 큰 것으로 나타났다. 따라서, 우리나라의 음주로 인한 사회경제적 손실과 지속적인 음주율 증가를 감안할 때 적정음주 유도를 위한 건강증진 및 보건의료정책 마련이 시급한 실정이다.급속한 고령화, 만성질환으로의 질병구조 변화, 음주 등의 건강위험요인 증가에 따라 질병 및 음주로 인한 사회경제적 비용은 더욱 증가할 것으로 예상된다. 따라서, 질병 및 음주로 인한 경제적 손실 감소와 효율적인 국민건강증진 달성을 위해서는 고비용 발생군을 대상으로 하는 건강증진·검진·치료 프로그램 개발 및 정부지원방안이 조속히 수립되어야 할 것이다. [영문]Based on a cost-of-illness(COI) study on socioeconomic losses accrued in individual and society due to disease and alcohol drinking, this article consisted of 2 papers that addressed the estimation of those losses, and major considerations of this study can be outlined as follows:The first essay 'Analysis on the Annual Profile of Total Diseases and Trends of Socioeconomic Costs of Major Diseases' focused on estimating medical expenses, income losses, etc accrued from diseases in domestic currency to analyze possible effects of health's value upon our economy and society. In terms of methodology, this essay classified current prevalent diseases in Korea into 20 categories, and thereby subdivided socioeconomic costs assumed by each disease group according to sex, age, cost and disease group for the estimation over 6 years(1999 to 2004). Cost was broadly divided into direct and indirect cost. Direct cost included direct medical cost and direct non-medical cost(traffic cost, caregiver's cost), while indirect cost included future income loss due to early death as well as productivity loss from use of medical services. As a result, first, it was found that Korea's COI tended to keep increasing from 55 trillion 189.6 billion KRW(in 1999) to 61 trillion 596.5 billion KRW(in 2004) on the basis of constant dollar in 2004. Second, the largest part of COI was represented by injury(18.5~20.6% of total COI), which was followed by neoplasm(13.4~16.1%), digestive tract disease (11.2~13%), cardiovascular disease(10.8~12%), respiratory disease(8.9~11.5%) respectively. Third, male group accounted for 65~67.2% of total COI, which was estimated about twice more than female group. Fourth, in terms of age distribution, 40's group accounted for largest percentage of COI, which was followed by 30's, 50's and 60's. Overall, 40's or older groups tended to spend more COI, on the contrary to 30's or younger groups. Finally, loss from early death accounted for largest part of total COI(47.1~49.3%), which was followed by medical expenses(31.1~37.2%), productivity loss from using medical services(7~10.9%), and traffic and caregiver's cost(7.9~10.1%) respectively. Overall, it was estimated that both productivity loss and traffic/nursing expenses tended to rise, while medical expenses tended to decrease year by year, but the future income loss from early death tended to rise and fall slightly again and again. In conclusion, it is estimated that both 40's or older group and male group in Korea bear higher socioeconomic costs of illness than other groups, and Korea assumes total COI based on more percentage of COI from injury, neoplasm and digestive tract disease than other countries. Hence, in order to reduce socioeconomic loss from illness, it is required to steadily perform medical examination and monitoring for high cost group by sex, age, cost and disease group, and also prioritize current health and medical policies with corresponding resource distributions.The second and last essay 'the Estimation of Socioeconomic Cost of Drinking Alcohol' estimated socioeconomic cost of drinking alcohol as major onset risk factor of disease as of Year 2004. In order to calculate alcohol attributable fraction(AAF) as an index of possible associations between all drinking-induced health problems and alcohol, this essay estimated Korean type AAF using Australia's relative risk by sex and age as well as Korea's moderate/high risk drinker ratio. Cost was classified broadly into direct cost, indirect cost and other expenses. Direct cost included direct medical cost and direct non-medical cost(traffic and caregiver's cost), while indirect cost included future income losses from early death, productivity losses from using medical services, and lower productivity due to drinking and hangover. Other expenses included property damage and public administrative expenses. Loss from early death was estimated on the basis of Human Capital Approach. As a result, Korea's socioeconomic cost of drinking alcohol amounted to 15 trillion 626.1 billion KRW(2.25% of total GDP). It was represented mostly by lower productivity due to excessive drinking(50%), which was followed by losses from early death(34.6%), direct medical cost(6.9%), productivity loss from using medical services(3%), direct non-medical cost(2.4%), and other expenses(property damage and public administrative expenses)(3.2%). This finding indicates that socioeconomic cost of drinking alcohol is estimated more than in related domestic previous studies, and it is estimated that Korea bears more losses from drinking alcohol than other countries. In particular, it is found that lower productivity due to excessive drinking and productivity loss from using medical services comprise more percent of total losses from drinking alcohol than any other losses. Thus, in regard to Korea's socioeconomic losses from drinking and ever-increasing drinking rate, it is very urgent to develop health promotion and medical health policies in order to control national drinking habits to the moderate extent.As there are ever-increasing health risk factors such as rapid aging, transition to chronic diseases, and drinking alcohol, it is expected that Korea will bear more socioeconomic cost of illness and drinking alcohol in future. Hence, in order to reduce national economic losses from illness and drinking alcohol, and achieve efficient national health promotion, it is required to develop health promotion/medical examination/treatment programs for high cost group, and establish governmental support measures as soon as possible. ; prohibition
