National hearing This article addresses the intertwining of religious and environmental issues in judicial proceedings in India. It examines cases which show the complexity of certain problems which judges have to resolve. The preferred approach here is anthropological rather than legal and the emphasis is placed on the plurality of dimensions of phenomena envisaged in the context of the transformations in Indian society. In addition to a presentation of the role of the High Courts of Justice in India, the authors examine how development projects that could harm the environment are challenged before the courts using religious arguments as well. ; This article addresses the way issues of religion and the environment are embedded in judicial procedure in India. It examines specific cases which reveal the complexity of certain problems that the judges have to settle. The increasing vitality and variety of religious identities in Europe give rise to new claims and demands by religious minorities. This generates new challenges for the articulation of the religious and the secular in European democracies, which become especially salient in public institutions such as hospitals, prisons, and schools. This special issue focuses on public institutions with the aim to examine how state and religion encounter one another in contemporary Western societies. We take public institutions as privileged observatories for understanding the changing place of religion but also as laboratories in which new arrangements are experimented. The articles analyse the presence, regulation, and negotiation of religion and religious diversity in public institutions across Europe combining innovative empirical enquiries with theoretical and methodological reflections.

Este articulo tiene por objetivo la identificación de ciertos temas y probematicas cuya emergencia ha empezado ya a modificar el panorama de las investigaciones en la sociologia de las religiones. Este panorama, dominado hasta los anos 60 por el analisis del funcionamento de las denominaciones cristianas, ha vacilado frente al desarollo de las teorias del conflicto, a la influencia de la fenomenologia y del interaccionismo simbólico, y al ascenso de las teorias sobre las elecciónes racionales. Sin embargo la misma coyunctura socio-religiosa ha provocado la diversificación actual de las tematicas de investigación. La renovación teórica y metodológica de esta esfera particular de la sociologia, necesita tener en cuenta problemas como el de la religión informal, de los vínculos entre religión y etnicidad, del lugar de las mujeres en el campo religioso, y tambien el de las relaciones entre religión, cuerpo y emociones.

El poco interés manifestado por el estudio de los ritos de la mayor parte de los historiadores griegos y romanos se explica por dos perspectivas teóricas. Por una parte, la mayoría de los historiadores se refieren, siguiendo a L. Deubner, G. Wissiwq y M.P. Nilsson, a las teorías primitivistas desarrolladas por Tylos y la Escuela de Cambridge que sitúan el sistema ritual en una época primitica y predeista. Por otra parte, historiadores como G. Rohde reproducen consciente o inconscientemente las teorías románicas sobre el origen de las religiones tal como K.O. Müller las ha definido : el ritualismo sería el resultado de la ruptura de la relación original e inmediata a la divinidad. Estas posi-ciones hicieron que los investigadores no sintiesen la necesidad de interrogarse sobre el sentido de los ritos en su contexto cotidiano, lo que llevó a numerosos investigadores a especular, no sin ambigüedad, sobre los ritos de origen o a contentarse de estudiar los ritos establecidos como «fósiles » de dicho período. Nuevas corrientes se han manifestado después de la guerra (Dumézil, Vernant, Burket) y se han desarrollado posteriormente, pero en la mayor parte de los casos el rito ha sido pensado como intermediario para plantear otros interrogantes.

Defining religion, defying tradition? Concord and conflict about the role of religion in a Costa Rican indigenous community
When approaching the issue of power, some fundamental questions always arise: Who is in a position to define? When, where, for whom, and why? These are also underlying questions in the particular case that is discussed in this article: Discourses about the role of religion among Bribris in Talamanca, the indigenously dominated area in south-eastern Costa Rica. The author looks at how 'religion' is defined by different actors, and into how the same actors understand religion in relation to what they see as other aspects of society and culture – in particular what the Bribris refer to as siwá, a concept they often translate into Spanish as tradición. In doing so, the it is highlighted how different actors discuss and negotiate the role of 'religion' in a particular cultural and historical context. For analytical purposes, it is proposed that defining should be seen as a practice that delimits something and gives it a certain place or space in relation to something else. To define is then to exercise power. As a consequence, discourses about the definition and role of religion in Talamanca are seen as both practices of, and contests about power.
