Maģistra darba tēma "Ģenerālklauzulas "valsts un sabiedrības intereses" iztulkošana un tās saistība ar personas tiesībām uz īpašumu" izvēlēta šī temata aktualitātes dēļ. Pēdējā laikā pieņemti divi būtiski Satversmes tiesas spriedumi attiecībā uz Satversmes 105. panta pārkāpumiem (tā saucamajā Nacionālās bibliotēkas lietā un Īres griestu lietā). Autors uzskata, ka Latvijā vēl joprojām ir jāturpina attīstīt ģenerālklauzulas izpratne un pareiza piemērošana, lai novērstu nepamatotu un pārmērīgu personu tiesību uz īpašumu ierobežošanu. Tikai tādā veidā var stiprināt demokrātisku sabiedrības un valsts iekārtu. Svarīgs darba aspekts ir ģenerālklauzulā ietverto jēdzienu ģenēzes Latvijā izpēte. Darba izstrādē izmantots plašs ārvalstu literatūras klāsts, kā arī nozīmīgi Eiropas Cilvēktiesību tiesas un Satversmes tiesas spriedumi. ; The title of the Master Thesis "The Interpretation of the General Clause "State and Public Interest" and its Relation to the Person's Right to Property" has been chosen because of its topicality. The Constitutional Court has passed two decisions regarding breach of the paragraph 105 of the Constitution recently. The development of the appropriate understanding and correct adaptation of the general clause has to be continued for prevention of unreasonable limitation of person's right to property. This is the only way for strengthening democratic structure of the state and society. Important aspect of the Thesis is research on genesis of the terms included in the general clause. Wide spectrum of literature and significant decisions of the European Court of Human Rights and the Constitutional Court have been used in developing this Thesis.

Pastāv grūtības definēt ES gan no politiskā, gan no akadēmiskā viedokļa. Līdz šim ES pētniecībā galvenokārt izmantota politikas (policy) analīzes teorijas vai arī īpaši radītas integrācijas teorijas. Manuprāt, ES pētniecībai tomēr vispiemērotākā ir starptautisko attiecību teorija. Līdz šim gadījumos, kad ES analizēta no starptautisko attiecību teorijas viedokļa, dominējušas pieejas, kuras kopumā var raksturot kā ideālistiskas. Taču savā darbā esmu izmantojis reālisma pieeju. Darbā izvirzītas divas hipotēzes: (1) vēsturiski kontekstuālā – Eiropas Savienība spēja pastāvēt tās nedefinētajā formā tikai kā kara produkts un tikai kara apstākļos; (2) futūristiskā – Eiropas Savienības ilgstoša pastāvēšana, nesākoties tās dezintegrācijas procesam, iespējama tikai valsts formā. Darbs iedalīts četras nodaļās. Pirmajā nodaļā (I) īsumā pamatota starptautisko attiecību teorijas reālisma skolas atziņu piemērotība ES fenomena pētniecībai. Otrā nodaļa (II) atvēlēta starptautisko attiecību teorijas reālisma paradigmas būtiskāko konceptu un principu apskatam. Šajā nodaļā pamatots, ka Aukstā kara bipolaritāte nav unikāla, kodolieroču pastāvēšanas izraisīta parādība, bet gan stāvoklis, kas tradicionāli novērojams plaša mēroga konflikta apstākļos. Trešajā (III) nodaļā ES analizēta kā starptautisko attiecību aktieris. Šīs nodaļas pirmajā (1.) daļā ES analizēta kā tradicionāls starptautisko attiecību aktieris, bet otrajā (2.) – kā sui generis parādība. Šajā nodaļā secināts, ka, saglabājoties starptautiskās sistēmas līdzšinējai – anarhiskajai – struktūrai, ES nevar pastāvēt kā sui generis aktieris un tai jāpieņem tradicionālā valsts forma. Pēdējā (IV) nodaļā piedāvāts iespējamais Eiropas pašdefinēšanās scenārijs. Darba būtiskākais secinājumi ir, ka (1) Beidzoties Aukstajam karam, izzuda līdzšinējais ES pastāvēšanas raison d'étre; (2) Nepastāvot kopīgam apdraudējumam un nepastāvot kopīgām interesēm, katra no ES dalībvalstīm realizēs savām partikulārajām interesēm atbilstošu politiku, kas neizbēgami novedīs pie anarhiskās sistēmas atgriešanās ES iekšienē; (3) Nepastāvot kādiem sui generis apstākļiem, ES jākļūst par tradicionālu aktieri, tas ir, valsti un jāīsteno tradicionālas stratēģijas. ; From the political as well as from the academic point of view, it is difficult to define the EU. Until recently, political analysis or a particular integration theory were mainly used in EU research. I think that the most appropriate theory for EU research is the theory of international relations. Until now, when the EU was analysed from the viewpoint of the theory of international relations, the dominating approach was what can be called idealistic. But in my thesis I have used the realism approach. In the theses there are two main hypothesis: (1) the historical-contextual – the European Union could exist in its non-defined form only as a product of war or in war circumstances; (2) the futuristic – the long-term existence of the European Union without the beginning of the process of disintegration is only possible in the form of a state. The thesis is divided into four parts. In the first (I) part I demonstrate the appropriateness to use the Realism School of the international relations theory for the study of the EU phenomenon. The second (II) part is dedicated to the overview of the main concepts and principles of the paradigm of realism in the theory of international relations. In this part it is proven that the bipolarity of the Cold War was not a unique phenomenon, caused by the existence of nuclear weapons, but a situation, which can be traditionally seen in the circumstances of extensive conflicts. The third (III) part analyses the EU as an actor on the international relations system. Firstly (1) the EU is analysed as a traditional actor in international relations, secondly (2) – as a sui generis phenomenon. It concludes that, if the present – anarchic – structure of the international system persists, the EU cannot stay a sui generis actor, it has to achieve a traditional stately form. The last (IV) part provides a scenario for a possible self-definition of Europe. The main conclusions of the thesis are that (1) with the end of the Cold War the raison d'être of the existence of the EU disappeared; (2) without a common threat and common interests each member state of the EU will develop independent policies according to its particular interests, which inevitably will lead to the return of the anarchic system within the EU; (3) without sui generis circumstances, the EU has to become a traditional actor, that is, a state and has to realise traditional strategies.

Maģistra darbs "Pašvaldību un valsts institūciju interneta resursi: iedzīvotāju rīcībspējas nodrošināšanas aspekts" veidots ar mērķi noskaidrot, vai Latvijas valsts pārvaldes institūciju – pašvaldību un ministriju interneta resursi ir pietiekami attīstīti un kā tie tiek izmantoti, proti, - vai tie tiek izmantoti iedzīvotāju interesēs kā informatīvais resurss un resurss iedzīvotāju rīcībspējas nodrošināšanai un palielināšanai vai institūcijas interesēs savas informācijas publicēšanai, tēla un popularitātes veidošanai. Darbs strukturēts divās daļās. Pirmajā – teorētiskajā daļā tiek aplūkoti faktori, kas ietekmē cilvēka rīcības iespējas - tīkla sabiedrības veidošanās, virtuālās kopienas, jauno tehnoloģiju ietekme uz demokrātijas attīstību, virtuālās valsts pārvaldes piedāvātās un nodrošinātās indivīdu rīcības iespējas. Otrajā daļā kvantitatīvi un kvalitatīvi analizēti dažādu līmeņu Latvijas valsts pārvaldes institūciju – pašvaldību un ministriju mājas lapas/portāli tādās kategorijās kā saturs, saitējums, interaktivitātes iespējas, formālie raksturojumi un vizualitāte un dizains un skaidroti indivīda rīcībspējas nodrošināšanas kontekstā. Atslēgas vārdi: cilvēku rīcībspēja, pārvaldība, internets ; The Master's paper "Internet resources of local governments and state institutions: the aspect of providing inidvidual capability" investigate how developed are internet resources of Latvian institutions of state administration. Author is interested also in the purpose how institutions of state administrations in different level – ministries and local governments – are using their homepages - in interests of citizens like resource of information and development of capability or in interests of state administration for distribution and providing own information and formation of good image of state institutions. The paper consist of two parts. First one look to the main factors which influence possibilities of inidvidual capability development for example formation of network society, different virtual communities, impact to democracy etc. In the second part of this paper author in quantitive and qualitive ways analyze internet resorces of Latvian state institution. Analyze is made in different categories like content, interactivity, links, formal characteristics and are explained in aspect of individual capability providing. Maģistra darbs "Nikolajs Plāte (1915-1983) – padomju Latvijas luterāņu baznīcas darbinieks un teologs" apskata N. Plātes darbību padomju varas radītā izolācijas kontekstā. N. Plāte bija viens no ražīgākajiem padomju laika teologiem, kas sarakstījis vairākus kompendijus – mašīnrakstā sarakstītas rokasgrāmatas teoloģijas studentiem. Darba sākumā ir raksturota teoloģiskā vide laikā, kad N. Plāte studēja teoloģiju LU Teoloģijas fakultātē, kā arī parādīta spriedze, kas pastāvēja starp t.s. liberālo un konservatīvo teoloģiju. Nodaļā par luterāņu baznīcas sociāli politisko stāvokli ir aprādīta tā laika baznīcas situācija, kad luterāņu baznīca bija nonākusi sarežģītos izolācijas apstākļos un tās darbība bija ļoti ierobežota. Turpmākajās nodaļās ir aprakstīts N. Plātes darbs draudzēs un grūtības, kuras radīja padomju antireliģiskā politika attiecībā pret baznīcu. Tāpat ir raksturota viņa akadēmiskā darbība un pasniedzēja darbs Akadēmiski teoloģiskajos kursos. Būtiska N. Plātes teoloģijas daļa bija cīņa par Bībeles dievišķās autoritātes nostiprināšanu un pret liberālo vēsturiski kritisko Bībeles pētniecības metodi. Tas atklājas diskusijā starp luterāņu mācītājiem 60. gadu beigās. Nodaļā, kas veltīti kompendijiem, ir dots tikai konspektīvs ieskats N. Plātes teoloģiskajā pieejā, šo darbu saturā, kā arī to vēsturiskajā nozīmībā. Izpētot N. Plātes darbību padomju varas laikā, var secināt, ka viņa teoloģiskā reakcija uz padomju laika izolāciju un baznīcas locekļu skaita sarukšanu bija konservatīva, uzsverot Bībeles dievišķo autoritāti un vēršoties pret liberālo Bībeles kritiku. ; Master's theses "Nikolajs Plāte (1915-1983) – clergyman and theologian of the Lutheran Church of Soviet Latvia" deals with his work in the Church during the Soviet ghetto. N. Plāte was one of the most fruitful theologians during Soviet times who produced several theological treatises – compendiums. The author of these theses starts with a description of the theological background of the time when N. Plāte had his theological training at the Faculty of Theology in Latvian University. There was a deep tension between so called theological liberalism and conservatism during this time. The chapter about the social political situation of the Lutheran Church in Soviet Latvia shows that the Church was isolated and its activities very limited. In the following chapters is given description of the parish work of N. Plāte and hardships he had to suffer under Soviet anti-religious policies directed against the Church. The outline of his academic efforts and his activities as a professor at the Lutheran Seminary is given in the next chapter. An important part of N. Plāte's theological work was his struggle against the higher criticism of the Scripture. His efforts were directed to uphold the divine authority of the Bible. It is revealed during a discussion among Lutheran pastors at the end of 1960's. In the chapter on compendiums there is given only a short summary of N. Plāte's theological approach, an overview of the content of his works, and their historical significance. The conclusion follows that N. Plāte's theological reaction to the situation of Soviet ghetto and shrinking of the Church was conservative as he emphasised the divine authority of Scripture and opposed criticism of the Bible.

Der Beitrag zur politischen Kultur in der Bundesrepublik Deutschland formuliert und erörtert folgende Hypothesen zur Entwicklung und Ausgestaltung kapitalismuskritischer sozialer Bewegungen seit dem 19. Jahrhundert: (1) Soziale Bewegungen sind zunächst offen für linke und rechte, emanzipatorische oder konservative Entwicklungen und reflektieren gesellschaftliche Konfliktlinien vor allem in Umbruchsphasen. (2) Die Auflösung fordistisch geprägter Produktions- und Lebensweisen führt zur Ausprägung neuer politisch-kultureller Konflikte, in deren Kontext sich neue soziale Bewegungen herausbilden. Ihr Selbstverständnis als soziale und kulturell gesellschaftsverändernde Kraft und ihr Verhältnis zu traditionellen Bewegungen bestimmt ihre politische Handlungsfähigkeit. (3) Die sich als Gegenmacht zum globalisierten Kapitalismus entwickelnden sozialen Bewegungen müssen sich mit der neoliberalen Aufnahme, Integration und Umdeutung ihrer Forderungen im globalisierten Kontext auseinander setzen. (4) Für die sozialen Bewegungen in Deutschland und Europa bedeutet der Widerstand gegen neoliberale Politik die Europäisierung und Internationalisierung ihres Protestes gegen Privatisierung öffentlicher Daseinsvorsorge, gegen den Abbau sozialer und politischer Rechte. (5) Die Europäisierung neoliberaler Strategien und deren konkrete Umsetzung in den einzelnen Ländern befördert den nationalen und europäischen Widerstand. Auch in Deutschland wird die neoliberale Hegemonie brüchig. (6) Mit der Entwicklung der Sozialforen kann in Anknüpfung an Erfahrungen früherer gesellschaftlicher Bündnisse und Allianzen auch in Deutschland der Raum für neue gesellschaftliche Bündnisse geschaffen werden. (7) Die grundsätzliche Schwäche der sozialen Bewegungen in Deutschland muss - trotz aller Bemühungen um ein neues Verhältnis zueinander - im verbleibenden Nebeneinander der Akteure und in der bisher fehlenden gesellschaftlich wirksamen Gegenstrategien gesehen werden. (8) Entscheidend für die Formierung eines neuen gesellschaftlichen Blocks gegen neoliberale Politik ist gewerkschaftliche Ablösung von der Sozialdemokratie - als Voraussetzung neuer Allianzen. (9) Gesellschaftliche Bündnisse gegen neoliberale Politik müssen eine neue Parlamentarismuskritik und ein konstruktives Verhältnis zu linken Parteien entwickeln, so wie linke Parteien ihrerseits die gesellschaftsverändernden Potenziale nur gemeinsam mit sozialen Bewegungen verwirklichen können. Diskriminācijas un neiecietības problēmas ir aktuālas mūsdienu pasaulē un var skart ikvienu no mums. Kā liecina pasaules valstu prakse un daudzi pētījumi, mūsdienās neiecietība un diskriminācija var izpausties pēc šādām pazīmēm: rase, ādas krāsa, tautība, etniskā piederība, valoda, dzimums, vecums, reliģija, invaliditāte, seksuālā orientācija, sociālais stāvoklis un izcelsme, manta, dienesta stāvoklis, politiskā pārliecība un citi līdzīgi apstākļi. Galvenās neiecietības un diskriminācijas formas Latvijā skar etnisko piederību, seksuālo orientāciju un dzimumu. Tāpat kā citur Eiropā, arī Latvijā ir antisemītisma un aizspriedumu pret musulmaņiem piemēri, tomēr kā īpaša riska grupa atzīmējami čigāni. Attieksmē pret čigāniem liela daļa Latvijas iedzīvotāju vadās no stereotipiem un aizspriedumiem. Kā svarīgu problēmu var pieminēt Latvijā plaši izplatīto diskrimināciju uz dzimuma pamata. Īpaši spilgti tā izpaužas sieviešu tiesībās darba tirgū. Kā īpaši bīstamu apstākli var atzīmēt to, ka atšķirīga attieksme pret cilvēkiem noved pie konkrētas agresīvas rīcības. Vēsture liecina, ka, saskaroties ar pasaules mēroga problēmām, pie kurām neapšaubāmi var pieskaitīt arī diskrimināciju, sabiedrība parasti nonāk pie diviem pamatsecinājumiem: 1. nepietiek cīnīties tikai ar problēmas sekām, bet vitāli svarīgi novērst tās kodolu un izskaust to pamatā un 2. globālas problēmas ir iespējams atrisināt tikai ar kopīgiem spēkiem. ; The problem of discrimination is very topical in our society nowadays; however, most of the apprehensions are concerned with discrimination on account of ethnical origin, nationality, sexual orientation (this mainly occurs during labour relations), and gender. All of the mentioned grounds are recognized by non-discrimination principle of Article 14 of European Convention of Human Rights and Article 91 of Latvian Republic Satversme. The differences in the proceedings of the interpretation of non-discrimination principle are caused by the competence of European Court of Human Rights and Constitutional Court of Latvian Republic. The Article 14 covers namely those rights and freedoms which are recognized only by the Convention. On the other hand, the Article 91of Satversme deals with discrimination in general, but according to the national law system, the Constitutional Court of Latvian Republic reviews cases concerning the compliance of laws and other legal norms with the Constitution. Thus, the author of the present paper finds it necessary to explore the application and interpretation of non-discrimination principle, as well as to outline the particular features of this process.

Nicht nur die Nutzung von Medien, sondern auch die Nutzung von Waren und Produkten kann Aufschlüsse über die innere Verfassung von Generationen zu geben. Der vorliegende Beitrag modelliert Produkte als Medien der Kommunikation. Über Produkte findet ein intergenerationeller Erfahrungstransfer statt und über Produktmedien werden generationelle Diskontinuitäten und Distinktionen wahrgenommen. Generationstypische Produkthorizonte ermöglichen damit die Identifizierung von Generationenlagerungen. Ähnliche Waren- und Produktpräferenzen markierten auch im Sozialismus gleichgesinnte und gleichgestimmte Gruppen und Generationen. Eine politische Indienststellung der Warenkommunikation in der DDR muss als misslungen gelten. Das Kontrolldefizit in der Konsumkommunikation eröffnete daher gute Chancen für Selbstverständigungen von Gruppen und auch von Generationen über die alternativen Warenmedien. Symbolisch dominierten Formen von Verständigung kam gerade in Gesellschaften mit parteilich "durchherrschten" öffentlichen Diskursen eine große Bedeutung zu. Ein Austausch von Informationen über Symbole konnte sozusagen unterhalb derjenigen Sphäre stattfinden, in welcher das parteiliche Kommunikationsmonopol seinen Machtanspruch durchsetzte. Angehörige unterschiedlicher DDR-Generationen vermochten es, sich auf diesem Wege selbst bestimmten Zusammenhängen zuzuordnen und andere als Angehörige einer differenten Generation zu erkennen. Darbā ir aplūkots pārstāvniecības institūts konstitucionālajās tiesībās, tā īpatnības, vēsturiskā attīstība un saturs. Pārstāvniecība tiek analizēta gan, balstoties uz teorētisko bāzi, gan arī dažādu pasaules valstu normatīvajiem aktiem, kā arī statistiku par vēlēšanu rezultātiem, dalību vēlēšanās, dažādu tehnoloģiju izmantošanu vēlēšanu procesā. Darbā tiek analizētas pārstāvniecības izpausmes proporcionālajā, jauktajā un mažoritārajā vēlēšanu sistēmās, izmantojot kā vērtēšanas kritērijus autorizēto pārstāvniecību (vēlētāju skaits procentuālā izteiksmē no reģistrētajiem, kas nobalsojuši par valdībā pārstāvētajām partijām), nodoto balsu attiecību pret reģistrēto vēlētāju skaitu, proporcionalitāti, kā arī, kā konkrētā normatīvā regulējuma situācijā realizējas vēlētāja saikne ar deputātu periodā starp vēlēšanām, ņemot vērā to, ka pārstāvniecība ir nepārtraukts process. Balstoties uz konstitucionālo normatīvo regulējumu, tiek salīdzināti un analizēti pārstāvniecības ierobežojumi, kas attiecas uz piederību konkrētai sabiedrībai, kompetenci un autonomiju. Liela uzmanība darbā tiek pievērsta paša pārstāvniecības institūta izpētei, analizējot tā struktūru, dimensijas, efektivitātes nosacījumus. Tiek pētīts arī, kā pārstāvniecības kvalitāti ietekmē tādi faktori kā obligātā balsošana, elektroniskā balsošana, vēlēšanu apgabalu lielums, procentu barjera. Darbā ir pamatota pārstāvniecības konstitucionalitātes, nepārtrauktība laikā, cikliskais process, kā arī zināma paražu tiesību ietekme uz vēlētāja un deputāta sadarbības procesu periodā starp vēlēšanām. Sieviešu un nacionālo minoritāšu pārstāvniecība tiek aplūkota salīdzinošā aspektā, balstoties uz pieredzi valstīs ar atšķirīgu demokrātijas attīstības ilgumu un procesu, dažādām vēlēšanu sistēmām. Kopsavilkumā ir iekļautas vairākas rekomendācijas par pārstāvniecības regulējuma pilnveidošanai Latvijā. Tā kā pārstāvniecības proporcionalitāte esošās vēlēšanu sistēmas ietvaros visumā ir atbilstoša proporcionālās vēlēšanu sistēmas prasībām, uzlabojama ir vēlētāju un deputātu sadarbība, kas pārstāvniecību padarītu efektīvāku. ; The present paper examines the institution of representation in constitutional law, its peculiarities, historical development and contents. Representation is analysed from different points of view: based on the theoretical framework, and on the laws and regulations of different countries in the world, as well as on the statistical data of the election results, participation in elections, and the application of different techniques in the process of elections. The work analyses the manifestations of representation in the proportional, mixed and plurality system applying the following criteria for evaluation: authorized representation ( the number of voters in per cent of the votes cast and the number of registered voters), the proportion, as well as the form of the relationship peculiar to each situation of the normative regulation between the voter and the parlamentarian within the time between the elections, taking into consideration that representation is a continuous process. The restrictions of representation concerning affiliation to a particular group of society, competence and autonomy are compared and analysed on the basis of the constitutional regulation. Great attention in this work is paid to the investigation of the very institution of representation through the analysis of its structure, dimensions, terms of effectivity. It is studied as well how the quality of representation is influenced by such factors as compulsory voting, electronic voting, the size of the electoral district, the percentage threshold. The work justifies the temporal continuity of the constitutionality of representation, its cyclic process, as well as the impact of traditional practice-based rights upon the process of collaboration of the voter and the parlamentarian during the period of time between elections. The representation of women and national minorities is treated comparatively on the basis of the experience of the countries with different duration and process of democracy and various electoral systems. The summary of the work contains several recommendations about the improvement of the regulation of representation in Latvia. Since the proportion of representation within the existing system generally meets the requirements of proportional electoral system, improvement might be carried out within the sphere of collaboration between the voters and parlamentarians in order to make the representation more effective.

Šis darbs ir par pretendentu tiesībām un pienākumiem publiskajā iepirkumā. Publiskais iepirkums ir preču un pakalpojumu kopums, ko valsts pasūtītājs iepērk, lai varētu nodrošināt savu funkciju izpildi. 2006. gada 01. maijā spēkā stājās jaunais Publisko iepirkumu likums, kurā par pamatu ņemta Eiropas Savienības dalībvalstu pieredze iepirkumu procedūru piemērošanā, ietvertas jaunāko Eiropas Savienības direktīvu prasības, kā arī ietverti Eiropas Kopienu tiesas spriedumos esošie skaidrojumi, jo līdz šim spēkā esošais likums "Par iepirkumu valsts vai pašvaldību vajadzībām" vairs neatbilda jaunās sistēmas prasībām. Publisko iepirkuma likuma mērķis ir nodrošināt iepirkuma procedūras atklātumu, pretendentu brīvu konkurenci un vienlīdzīgu un taisnīgu attieksmi pret tiem, kā arī valsts un pašvaldību līdzekļu efektīvu izmantošanu, maksimāli samazinot pasūtītāja risku. Likumā pastiprināts regulējums tādiem Eiropas Savienības tiesību principiem, kā vienādas attieksmes, diskriminācijas aizlieguma, savstarpējās atzīšanas, proporcionalitātes un samērīguma, brīvas konkurences, un atklātības principiem. Pretendentam nav jāskaidro izdevīgas iespējas, ko piedāvā publiskie iepirkumi. Daudzas mazas un lielas kompānijas cieši seko līdzi publisko iepirkumu konkursiem un padara publiskos tenderus par savas biznesa politikas neatņemamu sastāvdaļu. Viņiem pievienošanās Eiropas Savienība paplašina apvārsni un rada jaunas iespējas. Publisko iepirkumu likums attiecas tikai uz tiem iepirkumiem, ja to līgumcena sasniedz 10000 latu. Minētais regulējums ir balstīts uz Eiropas Savienības dalībvalstu pieredzi attiecībā uz līgumcenu sliekšņiem, no kuriem piemērojamas formālās iepirkuma procedūras, mainīti pretendentu atlases noteikumi un ieviesti jauni efektīvi iepirkumu mehānismi. Tas ļauj samazināt ar publisko iepirkumu saistītās administratīvās izmaksas, tomēr politiķiem un uzņēmējiem ir atšķirīgi uzskati šajā sakarā. Visumā jaunais Publisko iepirkumu sistēmas modelis satur virkni pozitīvu izmaiņu attiecībā uz pretendentiem un valsts iestādēm, tomēr problēmu risinājumam darbā ir tiek piedāvāts saglabāt līdzšinējos iepirkuma procedūru cenu sliekšņus, pagarināt lēmumu pārsūdzēšanas termiņus, paplašināt pretendentu tiesību apjomu un caurspīdīguma principu. Daudz uzmanības darbā veltīts jaunā Publiskā iepirkuma likuma un iepriekšējā likuma tiesību normu salīdzināšanai, iepirkumu koncepcijas maiņas analīzei. Darbā pētīts iepirkuma metožu izvēles un piemērošanas procesa saturs un tiesiskais pamats. Tāpat darbā tiek analizēti pretendentu tiesības un pienākumi, izvērtēts šo tiesību un pienākumu izlietojums un doti papildinājumi Latvijas publisko iepirkumu sistēmas modelim. Tāpat darbā apskatīta Latvijas un Eiropas Savienības tiesu prakse publisko iepirkumu kontekstā. ; The following work deals with the rights and obligations of tenderers in public procurement. Public procurement is the aggregate of goods and services that a state client buys in order to insure the performance of its duties. The new public procurement law based on the application of the experience in the purchase procedure of European Union states started to function on May 1, 2006. The newest European Union guidelines as well as the existing comments found in European Community Court verdicts have been incorporated in the new law because the previous Law on Procurement for the needs of the state and municipality does not comply with the requirements of the new system. The aim of Public Procurement Law is to insure the transparency of purchase procedure, freedom of competition, equal and just attitude towards all tenderers, as well as, the effective usage of state municipal funds. The control of the following principles such as equal attitude, the prohibition of discrimination, mutual acknowledgement, proportionality and pro rata, free competition and the principle of transparency are strengthened in the new law. There is no need to describe the profitable opportunities that public procurement offers. Many of large and small companies closely follow the procurement competition and make public tenders an integral part of their business politics. Following such European Union principles broadens horizons of collaboration and new opportunities. The Public Procurement Law is applied only to those purchases which contractual price is higher than 10000 lats. The following regulation is based on the European Union States experience in connection to contractual price threshold, from which the formal purchasing procedure is applied, the conditions of tenderers selection criteria and the new effective purchases mechanics are introduced. Despite the fact that it allows to reduce the expenses on administration, politicians and businessmen have dissimilar attitudes towards it. On the whole, the model of the new public procurement system contains the chain of positive changes in relation to tenderers and state institutions, but it is suggested for the problem solution at work to retain the previous price threshold of purchase procedure, to prolong the appeal time and transparency principle. In the following work a lot of attention is paid to the comparison of the new Public Procurement Law and the old Law on Procurement for the needs of the state and municipality, as well as, the analysis of the changes in the purchasing conception. The choice of purchasing methods and the content of process application as well as legal basis are under the research in the following work. Also, the rights and liability and their application are analyzed and some supplements to the model of public procurement model in Latvia are given. In addition, the court practice in Latvia and the European Union related to public procurement is examined.

Viena no Eiropas Savienības prasībām valsts pārvaldes reformas procesa īstenošanas gaitā Latvijā bija veikt valsts pārvaldē vispārēju tās modernizāciju un izveidot elektronisko pārvaldi jeb e-pārvaldi. E-pārvalde ir veids, kā valsts un pašvaldība var izmantot jaunās tehnoloģijas savā labā, lai nodrošinātu iedzīvotājiem un uzņēmumiem ērtāku pieeju informācijai un pakalpojumiem, kā arī lai uzlabotu sniegto pakalpojumu kvalitāti un radītu plašākas iespējas piedalīties pārvaldes darbā. Internets šobrīd kļūst par vienu no galvenajiem līdzekļiem informācijas un pakalpojumu sniegšanai un saņemšanai, ko veiksmīgi savas darbības uzlabošanai jau izmanto komercstruktūras. Līdz ar to ir ļoti būtiski informācijas tehnoloģiju sniegtās priekšrocības izmantot arī valsts pārvaldes darbības atvieglošanai. Šis ir viens no aspektiem, kas pierāda izvēlētā temata aktualitāti, jo maģistra darbā vispārīgi tiek aplūkots elektroniskais paraksts un vairākas tā izmantošanas jomas – tādas kā elektroniskie iepirkumi, e-izsoles, elektroniskā deklarēšanās sistēma, kā arī datorizētā zemesgrāmata. Kopš 2003. gada par valsts pārvaldes politikas veidošanas funkciju ir atbildīga Latvijas Republikas Valsts kanceleja, pārņemot to no Īpašu uzdevumu ministra valsts reformu lietās sekretariāta. Līdz ar to īpaša vērība darbā tiek pievērsta dokumentu aprites un uzdevumu kontroles sistēmai jeb DAUKS, kas nodrošinās vienotu dokumentu integrācijas vidi valsts sektora dokumentu apritei starp Valsts kanceleju un ministrijām un kuru jau paredzēts ieviest ekspluatācijā, sākot ar 2007. gadu. ; From the middle of 1990 becoming a part of the international environment has been actual to Latvia, along with other Central and Eastern European countries, in order to prove itself to be an equivalent partner. In order to realize this, fundamental reforms needed to be carried out on all levels, including public government. The public government reforms were primarily linked to the desire to become part of the European administrative sphere and to develop the state administrative capacity to effectively implement the European Union body of rights and obligations. As a result of the implementation of the reforms, the Latvian state government administrative capacity is being improved according to European Union principles; a state government operation long-term development plan is being agreed upon; public involvement and influence on the activities of the state government are being increased; the legislative basis, financial management and control systems of the government are being improved; state government operational systems and procedures are being developed; a modern ministry and state government establishment system is being created; and state civil service is being introduced. Currently a general modernization is being carried out in the state government and an e-government is being created. E-government is a way in which the state and municipality can utilize new technologies to provide easier access to information and services for the inhabitants and businesses, to improve the quality of services rendered and to create broader opportunities to be involved in government activities.

Die politischen Entwicklungen der letzten Jahre in diesem Teil Europas bewirkten einerseits eine verstärkte wissenschaftliche Beschäftigung mit Südosteuropa, andererseits auch ein vermehrtes öffentliches Interesse vor allem durch den von 1992 bis 1995 andauernden Krieg in Bosnien-Herzegowina und die seither weiter bestehenden politischen Turbulenzen in der Region. Gerade die Frage nach der politischen Kultur, der Identität - den Identitäten? - und den Loyalitäten der Bürger dieses Landes hinsichtlich der Weiterexistenz Bosniens als einem einheitlichen Gebilde - auch wenn es fragil und vielfach instabil ist - besitzt enorme Bedeutung für den weiteren Weg Bosnien-Herzegowinas und stellt ein eminent politisches Thema dar. Die Autorin setzt sich mit den Grundlagen für die Ausbildung und Ausformung von Identität und Loyalität auseinander. Für diesen Zweck zieht sie reichhaltiges historisches Material heran, das die Entwicklungen seit dem 12. Jahrhundert bis hin zur Gegenwart veranschaulicht. Sie geht von der These aus, dass die Rolle des Osmanischen Reiches prägend für die kulturelle Dynamik des Landes ist. Bosnien-Herzegowina war das Kernland des Islam im Balkanraum. Die Beziehung zwischen Bosniaken und Osmanen war dabei ambivalent: Einerseits war Bosnien eine stets zur Rebellion bereite Provinz, wenn man an den alten Vorrechten des bosnischen Landadels rüttelte; andererseits war Istanbul das Zentrum islamischer Gelehrsamkeit und Kultur, die auch in die westlichen Teile des Reiches, darunter Bosnien, ausstrahlte. Dies soll keineswegs dahingehend zu verstehen sein, dass Bosnien heute als Land des jihad zu bezeichnen ist. Die jahrhundertelange Herrschaft des Osmanischen Reiches mit seiner am Islam orientierten und verfassten Staats- und Gesellschaftsordnung hat aber doch sehr stark die Herausbildung gesellschaftlicher und mentaler Strukturen in Bosnien-Herzegowina beeinflusst. Zugleich ist Bosnien-Herzegovina ein gutes Beispiel für die religiöse Vielfalt einer europäischen historischen Landschaft. Bosnien-Herzegowina, eine alte europäische historische Landschaft, zählt zu den Regionen des Balkanraums, in denen im Lauf der Geschichte vielfältige geistige und kulturelle Strömungen aufeinander trafen, was diese Region auch zu einer Herausforderung für verschiedene Wissenschaftsdisziplinen machte. Die Autorin argumentiert, dass insbesondere in Zeiten wachsender Instabilität die konkurrierenden Eliten auf Geschichts- und Konfessionsbilder zurückgreifen, um ihre Ansprüche zu legitimieren. Sie kommt zu der Schlussfolgerung, dass die Herausbildung eines gesamtstaatlichen Bewusstsein und die Überwindung nationalistischer Gräben die wichtigste Aufgabe für die Zukunft ist. (ICG)
