European immigration policy making has often been characterized either as a largely spill-over driven process or as "venue shopping," a way to escape from the confines of national capitals. This article suggests that success in policy creation hinges crucially on the presence of a policy entrepreneur; while the European Commission faced propitious conditions for acting in this fashion, it did not always manage to do so. Drawing on the creation of key directives on asylum and labor migration as empirical case studies, the argument is developed that only when the European Commission exhibits the core characteristics of successful policy entrepreneurs does it succeed in shaping migration directives. L'élaboration de la politique migratoire européenne a souvent été caractérisée comme un processus piloté par spillover ou encore comme « venue shopping » d'évasion aux confins des capitales nationales. Cet article suggère que le succès de l'élaboration d'une politique dépend crucialement de la présence d'un entrepreneur politique ; et que, bien que la Commission européenne ait eu des conditions favorables pour agir dans ce sens, elle ne l'a pas toujours fait. This article takes the move from the recognition that the law of EU external relations is fragmentary. EU foreign affairs are conducted through a Common Foreign and Security Policy (CFSP), a Common Commercial Policy, and other competences with external implications. This article is dedicated to one of such competences, whose external side has been hitherto largely underexplored: the monetary policy of Member States whose currency is the Euro. With a view of offering a first assessment of this 'banking diplomacy' law, the article outlines the main legal features of the external aspects of Banking Union (BU) and their interactions with other external relations competences. It does so by following four themes: investment, external representation, prudential supervision, and resolution.

Als Reaktion auf die europäische Finanzkrise implementierten die Europäische Union und ihre Mitgliedstaaten im Bereich der europäischen Finanzaufsicht Mechanismen der Verwaltungskooperation, die in der europäischen Verbundverwaltung eine einheitliche und kohärente Rechtsanwendung gewährleisten sollen. Anhand von drei klassischen Bereichen des Aufsichtsrechts, namentlich der Gewinnung von Informationen sowie präventiven und repressiven Aufsichtsmaßnahmen, werden die geschaffenen Mechanismen mit Blick auf ihre Rechtsverbindlichkeit und die jeweiligen Einflussmöglichkeiten auf die europäische respektive die mitgliedstaatliche Finanzaufsicht analysiert und Strukturen für effektive Kooperationsmechanismen herausgearbeitet. Die Untersuchung trägt damit zur Systematisierung und zum besseren Verständnis der europäischen Mehrebenenverwaltung bei und zeigt Parameter für zukünftige Neu- und Umgestaltungen der Verwaltungszusammenarbeit im europäischen Aufsichtsrecht auf.

Over the past decade almost all developing countries have established energy planning activities in response to the grave problems that have arisen as a result of the drastic increase in energy prices, of the burden of energy related investment debt service, and of the problems of deforestation. Although the insti tutional and organizational responses are quite varied, it is largely engineers and economists who have been called upon to provide the necessary analytical capability to support policy decisions in the energy area. However, as evidenced by the recent participants in the Energy Management Training Program (EMTP), many of the analytical techniques now regarded as appropriate go beyond the usual background of those who are now assigned to such tasks. Indeed, this monograph is based on the material presented in the first ·part of the course, whose purpose is to bring the often diverse group to some common ground. Some of the material, such as Chapter 4 on the basics of energy pricing, is intended primarily for engineers. Other sections, such as Chapter 2 on energy balances, is primarily a vehicle for a discussion of the problems of units and differences in approach by different international bodies. The intent, then, is to provide in a single work a primer on a large number of different analytical tools.

It shows the attractiveness of the Chinese initiative for the host countries but also the political and economic challenges it involves: the sudden massive presence of Chinese companies, the new financial dependence on Chinese loans that will have to be paid back, and the political ties it establishes with China's diplomacy. This may destabilise both ASEAN and the EU, which are ill-prepared to defend a common attitude vis-à-vis China. Confronted with the creation of the "Cooperation between China and Central and Eastern European Countries" (China-CEE, China-CEEC) initiated in 2012, the EU struggled to maintain its unity like ASEAN before in the South China Sea conflict. The EU policy in Southeast Asia and towards ASEAN lacks ambition and means and is a poor alternative to China's BRI. We conclude that the EU must change its policy towards ASEAN and propose more than new free trade agreements ; La stratégie chinoise des "nouvelles routes de la soie" (NRS) L'initiative des nouvelles routes de la soie 1 a été annoncée en septembre 2013 par le Président Xi Jinping au Kazakhstan, pour ce qui concerne les routes terrestres, et en octobre en Indonésie pour ce qui concerne les routes maritimes.
