AbstractWhile many nationalism theorists define nationalism in terms of the desire for an independent state, empirical study shows that many nationalists make demands that not only fall short of statehood, but explicitly abjure claims to political independence. We document non‐state‐seeking nationalism with three case studies: Welsh national politics in the decades before the First World War, Catalan national politics related to the 2006 Status law, and Slovak national politics in response to Magyarization at the time of the 1867 Settlement. The phenomenon of non‐state‐seeking nationalism calls into question the utility of initial definitions in nationalism studies. Instead of imposing definitions by fiat, we argue that nationalism theorists should analyze the explicit or implicit definitions of historical actors.

The judgment of the Supreme Administrative Court of 8 May 2018 concerns the issue of relations of property rights to public interest, in connection with the resolution of the commune council, regarding the creation of a culture park. The resolution introduces a specific public-law regime in a given area, taking into account the general needs, which simultaneously causes interference in the sphere of subjective rights, in particular through a system of prohibitions and restrictions. The judgment is based on the conviction that there is a need in the public space to protect cultural values. In the aspect of the constitutional principle of proportionality, it is also important to consider the private interest in the area covered by protection in the form of a culture park.

In Barbara Ferman's collection, The Fight for America's Schools, grassroots resistance to neoliberal education reform holds the spotlight. Her geographic lens is the Pennsylvania/New Jersey region. In this article, the geographic focus shifts to Memphis, Tennessee, and Washington, D.C. Experiences in these two cities show how the neoliberal agenda is protected in the face of disappointing results. The Memphis case centers on a state takeover driven by a market ideology. Its experience underscores that reducing local representation to an inconsequential advisory role also diminishes what education policy leaders believe they need to consider. D.C. offers a more complex narrative, one haunted by the corrupted metrics of Campbell's Law. In both cities, the neoliberal toolbox proved unable to deliver in practice what the drawing board had promised.

Abstract

A "lucky strike"? Gaius meets Demosthenes. In D. 50,16,233,2 Gaius explains the expression telum (missile). As the fragment derives from his commentary on the twelve tables, the majority of modern scholars tends to refer this to 12 Tab. 8,12–13, which deals with the justified killing of the armed thief. But regarding the context, it seems to be more reasonable to connect the fragment with 12 Tab. 8,24a (which deals with unintended killing with a spear). This interpretation can be supported by the fact that one passage of the commentary shows great similarities with an old Athenian law that at least can be ascribed to Solon and that Gaius could have cited as he did on other occasions in his commentary.

El objetivo de este trabajo es compartir mi experiencia con el uso del cine como complemento didáctico en la enseñanza de ciertos apartados del programa de derecho constitucional. En concreto, señalaré algunas de las películas que he utilizado para discutir con los alumnos aspectos relacionados con el contractualismo, la Transición política española, y la evolución histórica del Estado. ; The objective of this work is to share my experience with the use of cinema as a didactic complement in the teaching of certain sections of the constitutional law program. In particular, I will point out some of the films I have used to discuss with students aspects related to contractualism, the Spanish political transition, and the historical evolution of the State.

Este trabajo ofrece un sucinto análisis de las seis Directivas sobre garantías procesales de sospechosos y acusados en procesos penales aprobadas en el marco del Plan del Consejo de la Unión Europea 2009, con especial consideración de las modificaciones legislativas que ha requerido su transposición en el ordenamiento español. ; This paper offers a brief analysis of the six Directives on procedural safeguards of suspected and accused persons in criminal proceedings adopted in the framework of the Roadmap for strengthening procedural rights of suspected or accused persons in criminal proceedings of the Council of the European Union (2009), with particular consideration given to the legal amendments that have been required to implement them into the Spanish national law.

This study measures how the internal audit units play a role in a Legal Entity University in fulfilling their tax obligations so that they fall into the category of compliant taxpayers. The Legal Entity University is a domestic tax subject because it does not meet the criteria of certain units of a government agency that are excluded as domestic subjects, as referred to in Article 2 paragraph (3) letter b of the Income Tax Law. In the case of a Legal Entity University having a business in the form of a separate legal entity, each separate legal entity has its own taxation obligations. With that status, the role of internal audit in LEU is very important, especially in overseeing the implementation of income tax deductions and collection.

На підставі проведеного дослідження зроблено висновки про наявні прогалини у праві та можливі шляхи їх подолання шляхом вдосконалення діючого законодавства України.

The article deals with the problems of definition of cultural values under civil law of Ukraine. The author studies specific legislation in the field of cultural values and made appropriate conclusions about the need for its improvement. ; В статье рассмотрены проблемные вопросы определения понятия и сущности культурных цінностей в соответсвии с гражданским законодательством Украины. В результате проведенного исследования специального законодательства в сфере охраны культурних ценностей автором сделаны выводы о необходимости его усовершенствования, и внесены конкретные предложения. ; У статті розглянуто проблемні питання визначення поняття і сутності культурних цінностей у відповідності з цивільним законодавством України. У результаті проведеного дослідження спеціального законодавства у сфері охорони культурних цінностей автором зроблені висновки про необхідність його удосконалення та внесені конкретні пропозиції.

The study investigates the government policies in the waqf's regulation in Indonesia and the essence of waqf as an important instrument of economic empowerment in Islam. The study aims to provide solutions to the lack of the benefits of waqf for people's welfare, especially in terms of economic empowerment. It is qualitative research with a normative approach. The research data used is the secondary data from library resources. An analysis of the data is by interpreting the concept. The result of this study shown that waqf has played a major role in citizen empowerment from the time of God's messenger, Muhamad peace be upon him until now, even the benefits of a waqf can still be felt up to today. The purpose of writing this article is to understand the legal protection for people against the management of slaughterhouse waste in Indonesia. Animal slaughterhouse management waste is waste resulting from the cutting process and if not managed properly will have an impact on the surrounding environment. Pollution of animal slaughterhouse waste management can occur if not properly managed. The method of approaching research is normative juridical. The results of the study provide an answer that the protection of the law against the community is a fundamental thing to be accommodated by the surrounding government. Attempts to accurately measure the monetary velocity or related properties of Bitcoin have often attempted to either directly apply definitions from traditional macroeconomic theory or to use specialized metrics relative to the properties of the Blockchain such as bitcoin-days destroyed. In this paper, it is demonstrated that beyond being a useful metric, bitcoin-days destroyed has mathematical properties that allow one to calculate the average dormancy (time since last use in a transaction) of the bitcoins used in transactions over a given time period. In addition, transaction volume and average dormancy are shown to have unexpected significance in helping estimate the average size of the pool of traded bitcoins by virtue of the expression Little's Law, though only under limited conditions.

In 2015, the General Court's Rules of Procedure introduced for the first time an EU closed evidence procedure that allows the use of closed or semi-closed evidence, i.e. reliance on evidence that is not, or not fully, disclosed to the applicant. This article shows that the EU closed evidence procedure does not comply with the requirements of the ECHR where even the essence of the evidence is kept from the applicant. It also identifies procedural ambiguities where compliance with the ECHR depends on the interpretation of the Rules by the GC.The article further argues that as the Rules were not introduced through publicly debated law, but were drafted and developed mostly behind closed doors, they lack democratic legitimacy.

Many women in the Unites States have difficulty getting pregnant or carrying a baby to term. As a result, many couples turn to gestational surrogacy. Surrogacy became public in the United States in the late 1970s. In the mid 1980s, disputes began to arise and are still prevalent today. Courts first attempted to resolve these disputes by looking for public policy guidelines. However, the results were inconsistent. Still today, there is no uniform law. Even in states where surrogate contracts are legal, courts have refused to order specific performance to enforce abortion or reduction provisions. However, courts should not shy away from this. This Note proposes a federal statute mandating that gestational surrogate contracts be enforced thus protecting the rights of intended parents.

The Canadian legal community finds itself in the midst of a debate about whether victims of crime deserve greater rights in its justice system. A stunning report, for example, from The Globe and Mail in 2017 that details the high rate of sexual assault reports dismissed by police forces across the country was met with calls for investigators to pursue justice on behalf of victims more forcefully. Parliament, meanwhile, enacted legislation designed to better prepare sexual assault survivors who may face credibility-impeaching evidence on the witness stand. Dubbed "the Ghomeshi law" by legal commentators (as it arrived not long after the high-profile acquittal, on sexual assault charges, of CBC Radio host Jian Ghomeshi), the legislation has proved to be controversial.
