This dissertation investigates two key transportation policies influencing travel behavior and location decisions in London towards sustainability: bus priority and congestion charging. Traffic congestion is a problem faced by cities worldwide, imposing time delays on travelers and decreasing economic efficiency. Congestion is increasing as cities are successful at attracting population and employment growth. This increasing urban density increases competition for urban road space, resulting in traffic congestion and forcing prioritization among road users. At the same time, sustainability goals increasingly set reduction targets for vehicle miles travelled (VMT). Transportation policy must both reduce congestion and VMT, while maintaining a fair distribution of costs and benefits among residents. London has navigated these challenges through pairing bus priority as a 'carrot' and congestion charging as a 'stick' policy. Beginning in the late 1990s with the introduction of a bus priority network, and continuing with the 2003 introduction of congestion charging in the central business district, London has achieved a decade-long trend of declining VMT and mode shift to transit and non-motorized modes. This research investigates the processes of how they were implemented, including consideration of the necessary politics, financing, and institutional authority. The synergistic impacts of these two policies over a decade is investigated in three dimensions: travel behavior, costs and benefits, and firm location decisions. First, the role of bus priority in the successful implementation of congestion charging is explored. Built from 1994 to 2003, London's regional bus priority network was in place when congestion charging implemented in 2003. The development and scope of this bus priority network is discussed using previously unpublished data. It was found that approximately 15% of London's arterial road network was reallocated to create a 1,100 mile (1,800 km) regional network of dedicated bus lanes. An analysis of Census travel to work data before and after congestion charging showed that declines in driving and increases in bus ridership were highest along bus network corridors. It is argued that bus priority explains why car use and VMT began to decline the London region in 1999, and then played a key role in preparing transport system capacity to absorb drivers switching to transit.Secondly, the costs and benefits of London's congestion charging policy are evaluated over the decade since it was implemented in 2003. Due to the rare implementation of congestion charging, this study is the first longer-term evaluation of a congestion charging policy using empirical data. It is the first to consider impacts on Londoner's culture and attitudes, and reasons why the central charge zone was non-controversial while the western extension zone was removed. The research revealed congestion charging has had wider impacts on traffic levels beyond the charged zone, leading to travel time savings for vehicular traffic throughout Inner London. It had mixed results in meeting its stated goals of reducing traffic volumes, increasing vehicle travel speeds, improving public transit service, reducing vehicle emissions, and improving safety for bicycles and pedestrians. Traffic volumes entering the charged area fell immediately and remained stable, while transit ridership increased and has continued an upward trend. However, travel speeds increased in the short term but fell in the longer term, such that congestion levels today in the charged zone are approximately the same as they were before congestion charging. The study found that this is not considered a negative outcome by city officials. By clearing cars off the roads, congestion charging allowed for a 'capacity grab' where road space and travel time savings were reallocated to buses and pedestrians. Bus speeds and reliability have vastly improved, pedestrian fatality and serious injury rates have plummeted, bicycle use has more than doubled, and air quality has shown some small benefits. City officials assert these outcomes would not have been achievable without the network reconfigurations made possible by released capacity.Thirdly, the longer-term impacts of the accessibility improvements realized in the central charged zone (CCZ) due to bus priority and congestion charging were investigated. It was hypothesized that improved accessibility in the congestion charging zone is being capitalized into higher land and rent costs. Firms valuing accessibility were expected to be the most likely to remain or to move in, in spite of rising rents. This hypothesis was tested using two panels of firms for the period 1997 to 2012 created with microdata from the UK Business Structure Database (BSD). One panel had only micro enterprises with ten or fewer employees, the other had larger firms with more than ten employees. Rent and accessibility data was added to each panel to explore the role of these factors. The study found the concentration of larger firms has been increasing inside the CCZ since 2004. Industry sectors that depend upon agglomeration economies have been concentrating there at the highest rate, especially 'knowledge' industries like Computers/Telecomm/Research & Development and Business Management Consulting. Evidence was found of increased churn, or rates of firm relocation into and out of the CCZ. For larger firms, the ratio of moves in to moves out increased from 1.02 in 1998-2002 to 1.14 in 2008-2012, indicating a preference for locating in the CCZ. Most firms that moved into the CCZ improved their transit accessibility by 20% to 40%. The net flow of jobs moving in to out also increased from .80 in 1998-2002 to 1.16 in 2008-2012. Retention of tourism sector firms increased in the CCZ, including Theatre & Cinema and Sports & Culture. Sectors vulnerable to rising rents and factor costs, including Retail and Restaurants, had increased odds of moving out of the CCZ. Rising rents were a statistically significant factor for firms moving out, and these firms were likely to have reduced accessibility after the move. The pull of accessibility on firms moving into the CCZ was stronger than the push of rising rents on those moving out. The dissertation concludes with a discussion of the findings, policy implications, and next steps for research.

There are three stages of development in the Ukrainian oil and gas science. They were primarily defined by the political position of Ukraine rather than by the needs of industry and the general level of science and technology. The first or primary stage is connected with the establishment of oil and gas, chemical and wood industries and with the specificity of the activities under the conditions of the Austrian and later Polish state system in Western Ukraine. The Austrian period was very favourable to the works of the Ukrainian researchers. However, the work was carried out in the interests of the ruling state, and the Ukrainian writers gained the glory as the Austrian or Polish scientists. The second period was very durable, lasting from 1939 till 1991. It was determined by the establishment of many scientific centers, schools and directions. Its distinguishing feature was the fact that the Ukrainian oil and gas science, as well as other sciences, has been a part of the Soviet (Russian) one. All the main scientific centres, which have directed the research lines and applied their basic results, were located in Moscow and Leningrad.During the period of Ukraine's Independence such summarized works as "Nafta I Gaz Podkarpacia. The Oil and Gas of the Precarpathian Region", "The History of Ukraine's Gas Industry in the Memories of Contemporaries", "Ivano-Frankivsk National Technical University of Oil and Gas. The Names of Glorious Contemporaries", "Ukraine: 20 Years of Independence" and others were published. The collective work "The Ukrainian Oil and Gas Science. 1899-1999" deals with the centenary history of the Ukrainian oil and gas science, the main stages of its development, gives respect to the famous figures of the oil science of the past, and directions of its development in the future. The domestic scientists M. Stasiv, R. Mysyovych, O. Malyarchuk in their publications cover the process of establishment and development of oil and gas industry of the Ukrainian Soviet Socialistic Republic in the XX century.The oldest industry branches in Western Ukraine, together with forest exploitation, are oilfields, which were established almost a century ago and are concentrated round the towns of Boryslav, Drohobych, Nadvirna, Dolyna. In the reconstructive post war period they were recovered and partly rebuilt. In the overall oil production in USSR the relative weight of the Precarpathian oil was low, but its role in the national economy of the Ukrainian SSR was very high. The Western Ukrainian oil and gas region was situated in the considerable distance from basic USSR oil regions. The availability of "own" deposits enabled to refuse from inefficient delivery of oil products.During the period from the late 40-s till the mid 60-s of the XX century in the Western Ukrainian regions the branching network of scientific organizations was established, which have become the background for the scientific and technical potential of the region. At the beginning of the 1960-s at the initiative and direct involvement of Professor T. Yeremenko and at support of the experts of the Committee on science and technology of the Council of the USSR Ministers, the leading scientists of the oil department of Lviv Politechnical Institute (LPI) established the working group for preparation of concept of the gradual transformation of the oil department into independent higher educational establishment of oil and gas profile. With this objective the construction of the separate educational building and dormitories in Lviv was initiated. However, this plan was failed. In 1960 Stanislav general-technical department was established, which in 1963 was reorganized into Ivano-Frankivsk branch of Lviv Politechnical Institute (IFBLPI) with departments of oil and gas industry and general-technical one. During 1963/64 academic year the oil department together with subdepartments, laboratories, equipment and facilities, and geological museum was taken from Lviv to Ivano-Frankivsk. In September 1, 1963 the teaching process for I-III year students began.The development of IFBLPI was determined by the increasing need in masters of oil and gas profile and has put on an agenda an issue on its reorganisation. Under the resolution of the Council of USSR Ministers from December 23, 1966, at the premises of IFBLPI in January 1, 1967 Ivano-Frankivsk Institute of Oil and Gas (IFIOG) was established. The first director of IFIOG was Yevhen Hnatovych Shelepyn. In 1967 in IFIOG the professional training courses for engineers and post graduate training centre, in 1969 - preparatory division, in 1971/72 academic year - extramural department were introduced.The development analysis of the Precarpathian oil and gas industry and scientific-technical potential testifies that in the second half of the XX century the branching network of research centres was established. During these years the qualitative and quantative membership of scientific workers, as well as their experience level has raised. In the research period one of the most burning problems was solved, that is, the centre of scientific-technical work and its industrial relations was established. Ivano-Frankivsk Institute of oil and gas has played the complex and deep scientific policy, the considerable role in accelerating the scientific-technical progress. Today the university is a powerful educational and scientific establishment, which is popular all over the world. During its existence over 45000 masters were trained. Practically all the biggest projects in the oil and gas field have been implemented by its graduates. ; В статье на основе широкого круга исторической литературы и источников освещено развитие нефтегазовой промышленности Прикарпатья и становление ее научно-технического потенциала, достижения, тенденции, перспективы. Diese Dissertation beschreibt Marktverzerrungen auf mehreren Ebenen, die entweder aufgrund von Fehlfunktionen oder durch Interventionen politischer Art entstehen. Die Fehlfunktionen schließen einerseits Märkte mit imperfektem Wettbewerb, und andererseits Versagen auf anderweitig vollkommenen Märkten ein. Die Erstgenannten können durch eine starke Konzentration (beispielsweise aufgrund der geringen Größe des Marktes) verursacht werden, durch Ein- oder Austrittsbarrieren, heterogene Güter und Informationsasymmetrien. Zu den Gründen für Marktversagen gehören die Existenz von Externalitäten, Störungen auf anderen, verlinkten Märkten (z.B. die von Kleinbauern erfahrenen Kreditbeschränkungen), hohe Transaktionskosten, öffentliche Güter und Staatsversagen. Abhängig von den Definitionen unterschiedlicher Autoren kann die ungleiche Verteilung von Einkommen oder Vermögen auch als Versagen des Marktmechanismus verstanden werden. In dem Abschnitt dieser Arbeit der sich Marktstörungen widmet wurde der Fokus auf die Nachfrageseite gesetzt, wo die Marktkonzentration mit der Existenz von Monopsonen, Oligopsonen oder Monopsonistischem Wettbewerb assoziiert wird. Die zweite Klasse von Verzerrungen auf den hier betrachteten Märkten wird durch politische Interventionen verursacht. Diese können verschiedene Beweggründe haben, wie die Korrektur der oben beschriebenen Marktstörungen oder Umverteilung zwischen Bevölkerungsgruppen. Das Instrument, das jeweils eingesetzt wird, um Marktversagen zu korrigieren, hängt von der beobachteten Störung ab. Wenn externe Effekte vorhanden sind, kann beispielsweise eine Steuer (Subvention) angewendet werden, um die externen Kosten (Nutzen) zu internalisieren. Umverteilung kann ebenfalls auf verschiedene Arten erreicht werden, beispielsweise durch die Direktzahlungen auf der Ebene der einzelnen Betriebe welche die europäischen Landwirte unterstützen. Um die Ergebnisse von Mikro- und Makroperspektive systematisch zu kombinieren wird die Dimension der Skalen in den theoretischen Rahmen eingeführt. Dies ist notwendig, da sowohl die Auswirkungen von Mikroprozessen auf größere Zusammenhänge, als auch der Einfluss von Makroprozessen auf das Mikroniveau nicht immer offensichtlich sind. Dieser Rahmen wurde auf a) den lokalen Kautschukmarkt in Jambi, Indonesien, der durch starke Nachfragemarktmacht auf allen Ebenen gekennzeichnet ist und b) den europäischen Markt für Zucker angewandt, der stark reguliert ist. Kapitel zwei und drei liefern eine Analyse der Fehlfunktionen innerhalb des indonesischen Kautschukmarkts, von denen sich Kapitel zwei mit einer Mikro- und Kapitel drei mit der Mesoebene befasst. Die Analyse auf Mikroniveau zeigt, dass Kleinhändler von Gummi in Jambi Marktmacht ausüben. Der Preis, den sie ihren Lieferantinnen und Lieferanten bezahlen liegt deutlich unter den Wertgrenzprodukten dieses Inputs. Diese Marktmacht ist größer in abgelegenen Regionen und schwächer mit zunehmender Marktgröße. Auch auf dem größeren Maßstab der verarbeitenden Industrie existiert Marktmacht in beträchtlichem Umfang. Die Fabriken betreiben asymmetrische Preistransmission, was bedeutet, dass Preisänderungen auf dem Weltmarkt schneller auf die Inputpreise übertragen werden wenn der Weltmarktpreis sinkt als in Zeiten von Preissteigerungen. Die asymmetrische Übertragung der Preise allein führt zu einer jährlichen Umverteilung von rund drei Millionen US-Dollar in Jambi. Es lässt sich davon ausgehen, dass die gesamte Umverteilung aufgrund von Marktmacht deutlich größer ist, was aber mit den verfügbaren Daten nicht beurteilt werden kann. Das vierte Kapitel untersucht die Auswirkungen von politischen Interventionen auf der Mesoebene. Der Schwerpunkt der Analyse liegt auf den Ergebnissen einer Marktintervention auf Drittländer, nämlich die Senkung des Interventionspreises auf dem europäischen Zuckermarkt. Diese Preissenkung war von den Auswirkungen der bisherigen Politik, sowie Veränderungen des institutionellen Rahmens, in dem die gemeinsame Marktorganisation für Zucker eingebettet ist, motiviert. Dies sind die Einführung des 'Everything But Arms' Abkommens, sowie Verpflichtungen die sich aus den multilateralen Verhandlungen im Rahmen der Welthandelsorganisation ergaben. Die Ergebnisse zeigen, dass die Afrikanischen, Karibischen und Pazifischen Staaten in der Tat negativ beeinflusst worden sind, das heißt dass die Erosion von Präferenzen stattgefunden hat. Die Ergebnisse dieser Arbeit sind für künftige Entscheidungen darüber, ob und wie auf den Agrarmärkten interveniert werden soll, relevant. Die entscheidenden Fragen bestehen darin, wann zu intervenieren ist, und durch welche Maßnahme. ; This dissertation discusses market distortions on several scales. According to the overarching theoretical framework, distortions arise either from malfunctions in one market, or are introduced by policymakers. The malfunctions include non-competitive markets, and failure of otherwise perfectly competitive markets. The former ones can be caused by a strong concentration (for example due to the small size of a market), by entrance or exit barriers, heterogenous goods, and information asymmetries. Reasons for market failure include most prominently the existence of externalities, failures on other markets that are interlinked with the market under consideration (e.g. credit constraints incurred by smallholders), high transaction costs, public goods, and government failure. Depending on different authors' definitions, highly dispersed distributions of income or wealth can also be understood as a failure of the market mechanism. In the part of this work that delved into market malfunctions, the focus was set on the demand side, where concentration is associated with the existence of monopsons, oligopsons, or monopsonistic competition. The second class of distortions on markets which are considered here are caused by political interference. They can have different motivations: the correction of market malfunctions as described above or redistribution . The instrument that is employed to correct for market failure depends on the observed failure. If externalities are present, for example, a tax (subsidy) can be used to internalize the external costs (benefits). Redistribution can also be achieved in various ways. The instrument that is currently under use to support European farmers are direct payments on the level of individual farms. The scale dimension was introduced into the theoretical framework in order to systematically combine the results from a micro- and a macro-perspective. This is important because the implications of micro processes for a greater scale, as well as the tickling down of macro processes to the micro-scale are not always obvious. This framework was applied to a) the local rubber market in Jambi, Indonesia, which is characterized by strong monopsonistic market power on all levels and b) the European common market order for sugar, which is regulated heavily. More specifically, chapters two and three provide an analysis of malfunctionings within the Indonesian rubber market, of which chapter two looks at a micro- and chapter three at a meso-scale. The micro-scale analysis shows that village traders of rubber in Jambi do exercise market power. The price that they pay to their providers lies significantly below this input's marginal value product. This market power is amplified in situations of extreme remoteness, and weakens with increasing market size. For the larger scale of the processing industry, market power does exist as well, and is substantial. The factories engage in asymmetric price transmission, which means that price changes on the world market are transmitted to the input providers faster if the international price decreases than in times of price hikes. The asymmetric transmission of prices alone leads to an annual redistribution of around three million U.S. dollars in Jambi (the total redistribution due to market power can be assumed to be much larger, but could not be assessed with the available data). Chapter four analyses the effects of policy intervention on a meso-scale. The focus of the analysis is set on the results of a market intervention on third countries, namely the reduction of the intervention price of the European sugar market. This price reduction was motivated by the effects of previous policies, as well as changes in the institutional framework in which the common market organisation for sugar is embedded. These are the introduction of the Everything But Arms agreement, as well as obligations resulting from multilateral trade negotiations within the World Trade Organisation. Results indicate that the African, Caribbean and Pacific countries were indeed negatively affected, i.e. that preference erosion did occur. The results of this dissertation are relevant for future decisions on whether or not, and how to politically intervene on agricultural markets. The key questions are when to intervene, and by which measure.

PENGANTAR REDAKSIi bulan September tahun ini aktivitas Tri Dahrma di Univeritas Udayana terlihat sangat menggeliat. Hal ini terjadi karena sebagian besar kegiatan terkonsentrasi pada bulan September yang merupakan bulan perayaan Dies Natalis ke 52 Universitas Udayana yang jatuh pada tanggal 29 September 2014. Seminar hasil-hasil penelitian, lokakarya, diskusi politik sampai pada pelayanan kepada masyarakat terlaksana meriah pada bulan ini. Ditambah lagi Ikatan Alumni Universitas Udayana (IKAYANA) menyelenggarakan reuni agung dengan berbagai kegiatan yang juga dikaitkan dengan perayaan dies. Menjadi meriah karena kebetulan ketua IKAYANA juga rektor Unud, Prof. Dr. Dr. Ketut Suastika, Sp. PD.KEMD sangat gesit menyemangati para panitia berbagai kegiatan tersebut. Salah satu kegiatan yang terkait dengan pengabdian kepada masyarakat adalah pemberian anugrah Udayana kepada penulis yang sangat gigih memperhatikan dan mempertahankan permainan tradisional Bali yaitu Made Taro. Perhatian lain dari Rektor Unud melalui LPPM adalah pemberian insentif bagi penulis buku, artikel ilmiah dan penerima HAKI, termasuk artikel yang dimuat dalam Jurnal Udayana Mengabdi (JUM) ini. Suatu bentuk apresiasi yang patut diapresiasi.Sidang pembaca yang terhormat, Peraturan Menteri Pendidikan Dan Kebudayaan Republik Indonesia Nomor 49 Tahun 2014 Tentang Standar Nasional Pendidikan Tinggi dalam salah satu pasal menyebutkan bahwa hasil pengabdian kepada masyarakat harus didesiminasikan. Salah satu bentuk desiminasi adalah mempublikasikannya dalam jurnal ilmiah. Selanjutnya Dikti juga mensyaratkan agar penerima hibah pengabdian kepada masyarakat Dikti harus mempublikasikan hasil pengabdiannya dalam jurnal nasional maupun internasional. Dalam nomor ini JUM memuat beberapa hasil pengabdian yang didanai dari Dikti, khususnya program Iptek bagi Wilayah yang lebih populer dengan istilah IbW.Industri sablon memerlukan inovasi diversifikasi produk dengan mengembangkan desain berbasis kebutuhan masyarakat yang menjadi perkembangan fashion terkini. Berdasarkan analisa distribusi rantai markov perkembangan motif fashion mengalami keadaan mantap tergantung dari trend pengaruh lingkungan dan siklus tersebut akan berulang tergantung dari pengaruh tokoh atau brand image promotor. Oleh karena itu motif desain untuk Usaha Kecil dan Menengah yang bergerak di bidang percetakan dan sablon di Madura memerlukan motif yang mempromosikan kekayaan budaya dan pariwisata berbasis kearifan lokal Madura sebagai pusat oleh-oleh dan promosi wisata Madura. Dengan kondisi usaha yang dialami kelompok usaha ini memerlukan sentuhan dari pihak lain agar terjadi pengembangan usaha yang signifikan. Budi Dwi Satoto dan Bain Khusnul Khotimah dari Universitas Trunojoyo Madura telah melakukan pemberdayaan masyarakat Kepulauan Talango Kabupaten Sumenep yang bergerak di bidang usaha percetakan dan sablon digital printing melalui program IbW Dikti.Masih dalam lingkup program IbW, I G.A. lani Triani dan kawan-kawan dari Jurusan Teknologi Industri Pertanian, Fakultas Teknologi Pertanian, Unud mengangkat bumbu tradisional Bali Suna Cekuh, sebagai bumbu penyedap dalam pembuatan kripik pisang. Suna Cekuh adalah bawang putih dan kencur yang sering digunakan sebagai bumbu dapur. Bawang putih merupakan kelompok rempah-rempah yang memiliki khasiat sebagai antimikroba dan antioksidan, demikian juga dengan kencur. Kedua bumbu dapur ini sudah sering dipakai sebagai bahan penyedap untuk berbagai jenis masakan, khususnya masakan Bali bumbu Suna Cekuh sudah sangat populer???????????????????????????????????????????????????????Udayana Mengabdi Volume 13 Nomor 2 Tahun 2014iidikalangan masyarakat, dengan rasa gurih dan enak serta merangsang selera makan. Hasil dari kegiatan pengabdian tersebut selengkapnya disajikan dalam nomor ini.Optimalisasi pengembangan usaha peternakan sapi Bali yang lebih kompetitif dan berkelanjutan saat ini perlu dilakukan mengingat luasan lahan yang tersedia terus mengalami penyusutan. Salah satu cara adalah dengan menerapkan teknologi. I Made Mudita, dkk. dari Fakultas Peternakan Unud memproleh hibah IbW dari Dikti untuk kegiatan pengabdian kepada masyarakat yang menerapkan teknologi aplikatif. Sebenarnya kegiatan ini merupakan penerapan hasil penelitian yang dilakukan oleh yang bersangkutan sebelumnya. Desiminasi teknologi produksi bioinokulan berbasis cairan rumen "Bali-bio", teknologi produksi silase pakan berbasis limbah dan pakan suplemen Urea Molases Blok/UMB, teknologi produksi pupuk organik dan biourine serta pemberian motivasi dan kiat-kiat pengembangan usaha peternakan yang menguntungkan adalah langkah yang telah dilakukannya. Melalui kegiatan sosialisasi/penyuluhan, pelatihan singkat dan pembentukan demplot di kedua mitra yang dipilih diharapkan tercipta peternakan yang kompotitif dan berkelanjutan.Peleburan bahan gamelan merupakan proses pencairan unsur logam Cu (tembaga) dan unsur logam Sn (timah putih) sehingga menjadi logam paduan perunggu (bronze) yang terbentuk pada temperatur peleburan mencapai ± 10830 C. Proses ini dilakukan di tungku peleburan (prapen) melalui pembakaran bahan bakar berupa arang kayu serta tambahan udara pembakaran sehingga menghasilkan energi panas. Untuk kebutuhan udara pembakaran perajin gamelan yang ada di Dusun Tihingan memanfaatkan tenaga mekanik yang disebut blower sebagai penghembus udara melalui pipa distribusi (injektor) sehingga kapasitas dan laju aliran udara kontinu. Bentuk laluan injektor dan penampungan udara dari blower ke ruang bakar bahan bakar sangat berperan dalam menentukan kecepatan proses peleburan, hal ini dipengaruhi oleh tekanan, volume udara serta pengarah udara. IGN.Priambadi, dkk. dari Jurusan Teknik Mesin Fakultas Teknik Universitas Udayana melakukan modifikasi untuk mendapatkan laju alir udara yang lebih stabil dan menerapkannya di Desa Tihingan Klungkung yang merupakan sentra kerajinan gamelan sangat terkenal.Usaha mengurangi pemakaian insektisida dalam pengendalian hama tanaman telah banyak dilakukan melalui sistem pengendalian hama terpadu (PHT) yang penerapannya didasari oleh pendekatan ekologi. PHT adalah tindakan pengelolaan hama yang mempertimbangkan secara seksama beberapa teknik pengendalian yang tersedia, sehingga dapat mengendalikan populasi hama pada tingkat yang tidak merugikan dan mengurangi resiko terhadap kesehatan manusia dan lingkungan. Tanaman jeruk di Desa Taro Gianyar akhir-akhir ini banyak yang terserang hama yang berdampak pada kerugian ekonomi yang tidak sedikit. Permasalahannya adalah 1) Apakah petani jeruk di Dusun Sengkaduan, Desa Taro sudah mengetahui seranggga D. citri sebagai hama dan sebagai vektor penyakit CVPD. 2) Apakah petani jeruk di Dusun Sengkaduan Desa Taro gejala serangan penyakit dan faktor-faktor yang mempengaruhi perkembangan penyakit CVPD. 3) Apakah petani jeruk di Dusun Sengkaduan, Desa Taro sudah mengetahui pengendalian D. citri dan penyakit CVPD. Celebrity Humanitarianism: The Ideology of Global Charity.By ILAN KAPOOR. Routledge, 2013. $44.95Reviewed by Sonja Killoran-McKibbinThe back cover promised a "hyper-critical porpoise with a purpose," and though I wasn't entirely sure what to expect, I was not disappointed by this book. In Celebrity Humanitarianism: The Ideology of Global Charity, Ilan Kapoor cleverly and humorously attacks the celebrity charity peddlers, the "coffee-pusher philanthropists," and the NGO superstars who dominate our conception of international aid. Using a Žižekian framework to carry out a refreshing ideology critique, Kapoor prods the assumptions implicit within celebrity humanitarianism to reveal its ideological basis and the underlying interests such actions serve. While Kapoor focuses on only a handful of notorious celebrity humanitarians, he insists that the individual celebrities in his book are merely some of the more colourful examples of a broader trend. Most importantly, Kapoor avoids the trite and banal and refuses to return to the all too easy suggestion that something is better than nothing. Instead, Kapoor's text skilfully addresses the role of celebrity charities by systematically deconstructing the manner in which they justify and support the very inequities that they purport to challenge.By asking "Do they know that it's Christmas?" almost thirty years ago, Band Aid set off the growing role of celebrities as an authoritative voice on global poverty. Yet the issue is under-discussed and rarely critiqued, making Kapoor's cutting and insightful analysis long overdue. The book begins by exploring the hyper-celebrities who claim to speak for, witness, or represent poverty. Using Bono, Bob Geldof, Madonna, and Angelina Jolie as examples, Kapoor demonstrates how such celebrity charity work is used for individual profit and to mask the root causes of inequality. By offering the opportunity to do good through consumerism, such work feeds into the capitalism's elusive promise of jouissance—or the eternal promise of enjoyment. Celebrity humanitarianism showcases the excessive lifestyles of celebrities, supporting their individual brand but also glorifying and marketing their excessive lifestyles as the ultimate promise of capitalism. Celebrities in this way are used to embody a justification of the current economic system at the same time as they claim to work to change it. Support for the decadence of the rich glorifies the inequality on which capitalism is based and obfuscates the very conditions that create poverty. Moreover, these stars act as witnesses and authorities on the poverty of the third world and situate third world subjects as victims, perpetuating the issues of inclusion and exclusion within such actions.Next to come under Kapoor's gaze are the private foundations established and maintained by billionaires, such as the Bill and Melinda Gates Foundation and George Soros' Open Society Institute. Calling such endeavours "decaf capitalism," Kapoor argues that they allow people to continue with business as usual and that "it is charity that helps decaffeinate capitalism. It masks and purifies corporate ills, acting as a countermeasure to socioeconomic exploitation." Foundations highlight the benevolence of corporate moguls and effectively hide the mechanisms through which they obtain such wealth. These acts keep people engaged and complicit with the corporate order and effectively depoliticize systems of inequality while undermining public mechanisms to improve social conditions and situating private initiatives as appropriate solutions.Finally, the book addresses those non-governmental organizations that have situated themselves as types of celebrities in their own right. From Médecins Sans Frontières (MSF) to Oxfam, such charities not only seek celebrity endorsements but have also developed their own personae and brand. Kapoor suggests that such charities, in many ways, represent an element of commodity fetishism in our late capitalist culture—distancing ourselves from elements of poverty while at the same time providing us with an outlet for our anxieties about global injustice. By constructing a "permanent emergency regime" these charities thrive on the spectacle of disaster and demand immediate action. They cultivate an anti-theoretical activism by suggesting that crisis makes immediate action essential—and unquestionably benign — leaving no time for analysis and portraying such reflection as inactive and necessarily detrimental. In this fashion such organizations encourage us to allow them to do the work for us, effectively delegating our beliefs to commodities. The absence of theorizing and the urgency of action effectively glosses over the manner in which the forms of new humanitarianism that such charities engage in are neoimperial endeavours. The complicity of NGOs in "humanitarian war" is made invisible by the parade of spectacularized emergencies.While Kapoor points to some of the ways the celebrity charity regime might be transformed, he is also quite clear that these reformist proposals are limited. They result in nothing more than a compromise with the system and do not address the depoliticizing tendencies of such international action. Drawing again on Žižek, Kapoor calls for an uncompromising politics that demands revolutionary change. While I welcome Kapoor's call for a revolutionary overthrow of the current global order and his rejection of sanctioned resistance, I must admit that I was left feeling somewhat unsatisfied by his insistence on revolutionary inaction. What of confronting antagonisms through unsanctioned resistance? While Kapoor advocates the imagining of new political possibilities that are distinct from inaction, as they ultimately must be followed by the material work for their creation, Kapoor deals with a lot in his last few pages, and perhaps that is part of the problem. While he urges the reader to see the opportunities in the contradictions it is difficult not to wish for more than a few pages to bring together his revolutionary proposal. Nonetheless, this could also be seen as Kapoor not letting his readers off the hook for their own complicity by pushing them to consider these tendencies beyond the bound pages. Overall Kapoor has crafted an engaging and entertaining text that deftly employs an all too familiar and visible phenomenon to bring to light the ideology embedded within it.~SONJA KILLORAN-MCKIBBIN is a PhD Candidate in the Faculty of Environmental Studies at York University. In these three essays collectively entitled "Essays on Externalities and Agriculture in the United States and Brazil", I discuss three topics. In the first essay, I review the economic literature on diversification in farming systems and comment on the economic incentives and disincentives for diversification in 21st century agriculture. In the second essay, I focus on deforestation in Brazil, which is an externality associated with the expansion of agricultural production at forest frontiers. Using a natural experiment (changes in international Foot-and-Mouth Disease certification), I identify the portion of annual deforestation that can be attributed to changes in disease status, and suggest that the mechanism for new deforestation may be due to increased prices when beef is considered to be safe for export. In my third essay, I discuss the production economics behind the use of sub-therapeutic antibiotics in U.S. pork and poultry production, and comment in detail on the potential for heterogeneity in the returns to antibiotic use (and costs of regulation). A more detailed summary of each essay follows.Chapter 1: Economic Factors Affecting Diversified Farming SystemsIn response to a shift toward specialization and mechanization during the 20th century, there has been momentum on the part of a vocal contingent of consumers, producers, researchers, and policy makers who call for a transition toward a new model of agriculture. This model employs fewer synthetic inputs, incorporates practices which enhance biodiversity and environmental services at local, regional, and global scales, and takes into account the social implications of production practices, market dynamics, and product mixes. Within this vision, diversified farming systems (DFS) have emerged as a model that incorporates functional biodiversity at multiple temporal and spatial scales to maintain ecosystem services critical to agricultural production. This essay's aim is to provide an economists' perspective on the factors which make diversified farming systems (DFS) economically attractive, or not-so-attractive, to farmers, and to discuss the potential for and roadblocks to widespread adoption. The essay focuses on how a range of existing and emerging factors drive profitability and adoption of DFS, and suggests that, in order for DFS to thrive, a number of structural changes are needed. These include: 1) public and private investment in the development of low-cost, practical technologies that reduce the costs of production in DFS, 2) support for and coordination of evolving markets for ecosystem services and products from DFS and 3) the elimination of subsidies and crop insurance programs that perpetuate the unsustainable production of staple crops. This work suggests that subsidies and funding be directed, instead, toward points 1) and 2), as well as toward incentives for consumption of nutritious food. Chapter 2: Foot-and-Mouth Disease and Deforestation in the Brazilian AmazonDeforestation in the Brazilian Amazon released approximately 5.7 billion tons of CO2 to the atmosphere between 2000 and 2010, and 50-80% of this deforestation was for pasture. Most assume that increasing demand for cattle products produced in Brazil caused this deforestation, but the empirical work to-date on cattle documents only correlations between cattle herd size, pasture expansion, cattle prices, and deforestation. This essay uses panel data on deforestation and Foot-and-Mouth Disease (FMD) status--an exogenous demand shifter--to estimate whether changes in FMD status caused new deforestation in municipalities in the Brazilian Amazon and cerrado biomes during the 2000-2010 period. Becoming certified as FMD-free caused annual deforestation to be 42% to 85% higher than deforestation rates in infected municipalities, on average, during the 2000-2010 period. Chapter 3: Potential for heterogeneity in the returns to sub-therapeutic antibiotics in U.S. pork and poultry operationsEach year, more than 50,000 people in the U.S. die from hospital-acquired bacterial infections, millions experience episodes of foodborne illness, and reported cases of "superbugs" such as Methicillin-resistant Staphylococcus aureus (MRSA) and vancomycin-resistant enterococci (VRE) are on the rise. For those who acquire a resistant infection in their food, in their community, or in a hospital, resistance is associated with a longer duration of treatment, the use of more potent antibiotics, and longer hospital stays. This, in turn, means increased health care costs and costs to society due to antibiotic-resistant infections. Antibiotic resistance is contributing to the scope and severity of this health care crisis, and at least some of the responsibility for antibiotic resistance sits on the shoulders of industrial livestock production. In livestock operations, low or sub-therapeutic doses of antibiotics (STAs) are used to promote growth, in addition to their use to prevent and control disease. Today, more antibiotics are used in livestock production and the production of milk and eggs than in humans. While the use of sub-therapeutic doses of antibiotics is regulated less stringently in the United States than in the European Union, there is movement toward and potential for such regulation. Beginning in the 1970s, economic researchers began to study the potential impacts of bans on the use of sub-therapeutic antibiotics on the pork, poultry, and beef sectors and on U.S. consumers, but there has been little study of how heterogeneity impacts antibiotic use, and in turn, how it impacts returns to using antibiotics in U.S. livestock operations. I concentrate on U.S. pork and poultry operations since they are the largest users of sub-therapeutic antibiotics by volume in the U.S., and explore the existing literature on the economics of sub-therapeutic antibiotic use for glimpses of heterogeneity in the returns to antibiotic use. Perhaps the most interesting source of heterogeneity in returns to antibiotic use may be heterogeneity in management and/or the use of potential substitutes for antibiotics, such as improved sanitation practices and more modern facilities. Productivity and use of technologies that substitute for STA use vary amongst producers, and likely by region and farm size. Thus, the marginal abatement costs of reducing STA use vary across industries, producers, production systems, and regions.

Anotācija Mazie uzņēmumi veido lielāko daļu uzņēmumu Latvijā, un tajos ir nodarbināti vairāk nekā puse iedzīvotāju darbspējīgā vecumā. Mazo uzņēmumu attīstības jautājumi ir īpaši aktuāli situācijā, kad globalizācijas rezultātā pieaugusi starptautiskā konkurence, augušas kvalitātes prasības produktiem un pakalpojumiem, pieaudzis bezdarbs. Pasaulē veiktie zinātniskie pētījumi liecina, ka vāja mazo uzņēmumu vadīšana ir viens no galvenajiem iemesliem, kādēļ uzņēmumu darbības rezultāti pasliktinās un uzņēmumi tiek likvidēti. Promocijas darba mērķis ir izpētīt mazo uzņēmumu vadīšanu nozīmīgi ietekmējošos faktorus un to savstarpējās ietekmes kopsakarības, izpētīt mazo uzņēmumu vadītāju uzskatus par izglītības un prasmju uzņēmuma vadīšanā nozīmīgumu, atklāt iespējas mazo uzņēmumu vadīšanas pilnveidošanai. The development issues of the small enterprises are particularly topical in the situation when as a result of globalization international competition has increased, higher quality is required from products and services, qualification requirements towards businesses are becoming tenser, and there has been a rise in unemployment. The globally conducted scientific research suggests that poor management of small businesses is one of the key reasons why the performance of these enterprises is deteriorating and the businesses are liquidated. The aim of the promotion paper is to study the factors which considerably influence the management of small businesses and regularities of their mutual interaction and to study the opinions of the managers of small businesses about the role of education and skills in corporate management and identify the opportunities for the improvement of corporate management. The first chapter of the promotion paper analyses academic literature and latest scientific research on the role of a small business managers' knowledge and skills of corporate management, the importance of the manager's personal qualities, key actions of small business managers in managing their enterprises as well as the influence of the external environment on the management of small businesses. The chapter analyses the research on the corporate climate in small enterprises and the factors influencing the climate as well as the importance of knowledge management as well as the role of knowledge management in organizations and the need for knowledge management in small businesses. The second chapter explores the development and peculiarities of small businesses in Latvia and studies the government policy for the support of small businesses as well as analyses the national support measures and EU support to small enterprises. The chapter also deals with the implementation of business administration education in the tertiary and vocational education institutions in the study programmes not focusing on economics and business administration. In the third chapter of the promotion paper the Author has studied the possibilities of improving the management of small businesses in Latvia. The research has also been made of the opinions of the small business managers about the importance of business management education and experience. The Author has studied and identified the opinions and differences in the opinions of small business managers about the role of training, motivation and communication in an enterprise. The differences of opinions have been examined in the cross-section of the regions of Latvia and industries as well as depending on the size of the enterprise and the manager's gender. The Author has studied the mutual correlations and relations of the assessments of training, motivation and communication importance on the innovative performance of a company. Other aspects under study are the intensity of the use of the Internet in small enterprises, differences in the intensity of using the Internet in the regions of Latvia as well as depending on the industry and size of the enterprise. The chapter analyses the opinions of small business managers about 54 the influence of state support measures, tax policy, availability of financial resources, stability of the external environment, influence of administrative procedures as well as availability of information on support measures. The Author has identified the key forces influencing small enterprises. Based on the analysis of scientific literature and empirical research results improvement opportunities of small business management have been revealed. Die fünf Essays dieser Dissertation behandeln Themen aus dem Bereich der Entwicklungs- und Umweltökonomie. Alle Essays analysieren wie die Produktion von CO2 Emissionen beeinflusst oder reguliert werden kann. Das Treibhausgas CO2 ist eine der größten Externalitäten der Geschichte menschlicher Entwicklung. Die einzelnen Essays zeigen wie lokale Klimaveränderungen das menschliche Wohlbefinden beeinflussen und welche monetären Kosten mit einem Anstieg der Durchschnittstemperatur in Lateinamerika verbunden sind. Außerdem betrachten die Essays Hauptdeterminanten von CO2 Emissionen auf haushalts- oder nationalem Niveau, und bestimmen den Erfolg aktueller Klimapolitik um CO2 Emissionen zu reduzieren. Das letzte Essay betrachtet die momentane und zukünftige Verteilung von CO2 Emissionen wenn verschiedene Politikszenarien realisiert werden würden. Das erste Essay befasst sich mit dem Effekt von klimatischen Veränderungen auf das Wohlfahrtsniveau in Lateinamerika. Als Wohlfahrtsmaß kommen dabei subjektive Selbstaussagen zum Einsatz. Subjektive Wohlfahrt erfasst nicht nur Veränderungen im Einkommen, sondern auch Veränderungen in anderen Lebensbereichen wie dem Zugang zu Bildung oder Gesundheitseinrichtungen. Generell kommt die Studie zu dem Schluss, dass eine Temperatur im Bereich von 20 Grad Celsius und Niederschlag bis 247mm optimal sind. Höhere monatliche Durchschnittstemperaturen oder Niederschläge sind mit Wohlfahrtsverlusten verbunden. Eine globale Erwärmung von mehr als 2 Grad Celsius wird mit Wohlfahrtsverlusten in Lateinamerika einhergehen. Das zweite Essay analysiert Haushaltsemissionen in Form des Kohlenstoff-Fußabdrucks in Indien. Dabei liegt das Augenmerk auf dem Effekt von Einkommenswachstum und sozio- ökonomischen Veränderungen innerhalb der Haushalte. Ein höheres Haushaltseinkommen führt zu einem stärkeren Konsumverhalten aber gleichzeitig auch zu weniger CO2- intensiven Konsummustern. Dennoch kann der Mehrkonsum an CO2-armen Gütern, wie zum Beispiel Bildung, den Anstieg der Haushaltsemissionen, aufgrund höheren Einkommens, nicht kompensieren. Das dritte Essay betrachtet in wie fern aktuelle internationale Klimapolitik einen Einfluss auf CO2 Emissionen genommen hat. Dabei zeigt sich, dass Länder, welche Verpflichtungen im Rahmen des Kyoto Protokolls eingegangen sind, im Durschnitt 6.5% weniger CO2 emittiert haben, als vergleichbare Länder mit ähnlichem Einkommens- und Bevölkerungswachstum aber ohne Verpflichtungen. Das vierte Essay geht auf die Hauptdeterminante des CO2 Emissionswachstums ein, nämlich Einkommen. Dabei wird aber nicht nur der Effekt von Veränderungen im Einkommen, sondern auch der Effekt von Veränderungen in der Einkommensverteilung auf CO2 Emissionen untersucht. Einkommensungleichheit wirkt sich abhängig vom gegenwertigen Ungleichheitsniveau auf CO2 Emissionen aus. Für Länder mit einer hohen Einkommensungleichheit ist der Effekt positiv, das heißt mit sinkender Einkommensungleichheit sinken CO2 Emissionen. Für Länder mit niedriger Ungleichheit ist der Effekt negativ. Ein weiterer Abbau der Einkommensungleichheit würde dort mit steigenden CO2 Emissionen einhergehen. Das fünfte Essay befasst sich mit der globalen Verteilung von pro Kopf CO2 Emissionen. Dabei geht es darum inwiefern der Energiemix und der sektorale Aufbau einzelner Volkswirtschaften zu dieser ungleichen Verteilung von pro Kopf CO2 Emissionen beigetragen haben. Der Abbau schwerer Industrie in OECD Ländern und der verstärkte Einsatz von Kohle in nicht-OECD Ländern haben dabei zu einem Rückgang der globalen Ungleichheit in CO2 Emissionen geführt. Langfristig gesehen kann es sein, dass die Emissionsungleichheit ab 2040 wieder steigen wird. Jedes Essay trägt in seinem Feld zur betreffenden Literatur bei. Die Essays analysieren wie jegliche ökonomische Aktivität (hauptsächlich Konsum) CO2 Emissionen verursachen, welche wiederum für Veränderungen im Klima verantwortlich gemacht werden. Diese Veränderungen im Klima gehen mit lokalen Wohlfahrtsverlusten einher. Nationale Politikmaßnahmen wie zum Beispiel Maßnahmen zur Einkommensumverteilung können einen ambivalenten Einfluss auf CO2 Emissionen haben. Politikmaßnahmen um das Konsumverhalten und Konsummuster zu beeinflussen könnten ein effizientes Mittel zur Regulierung von CO2 Emissionen in reichen Ländern darstellen. Generell könnten internationale Klimapolitikmaßnahmen nationale Politikmaßnahmen katalysieren. ; The five essays of this dissertation combine topics from development and environmental economics. All essays treat the overall topic on how to influence and regulate the production of CO2 emissions. The green house gas CO2 is one of the biggest externalities from human development during the last century. The essays give insight on how changes in local climate conditions affect human wellbeing and what are the potential monetary loses from a rise in average temperature in Latin America. They further analyze the major drivers of CO2 emissions at the household as well as national level and assess how current international climate policy has contributed to reduce CO2 emissions. The last essay gives an overview on how unequal emissions are globally distributed and what will be the future distribution of CO2 emissions when taking different policy scenarios into account. The first essay analyzes how changes in local climatic conditions affect the level of welfare in Latin America. Self reported wellbeing levels are used as a proxy for individual welfare. Subjective wellbeing does not only account for changes in individual income but also for changes in other areas, which determine overall welfare, such as the access to health care or schooling. The study finds that a temperature up to 22 degrees Celsius and rainfall up to 247mm are beneficial for human wellbeing. Higher temperatures or rainfall go in line with welfare loses. A global average warming of 2 degrees Celsius would go in line with welfare loses in Latin America. The second essay analyzes household emissions from consumption, the so-called carbon footprint, in India. The study focuses on the effect of changes in income and the socio- economic composition of the household. A higher household income leads to higher consumption but at the same time the goods, which are consumed change towards lower carbon intensive goods. Still the change in the consumption pattern does not offset the higher carbon footprint due to overall higher consumption rates with rising income. The third essay evaluates how current international climate policy did influence CO2 emissions. Countries with obligations from the Kyoto Protocol did indeed emit on average 6.5% less CO2 than comparable countries with similar income and population growth but without any commitments from Kyoto Protocol. The fourth essay analyzes the main determinant of rising CO2 emissions, namely income. The focus is not on changes in income but on changes in the income distribution within a country and its effect on CO2 emissions. The relationship between carbon dioxide emissions per capita and income inequality is U-shaped: for countries characterized by high income inequality, reductions in income inequality are associated with lower per capita emissions. For less unequal societies, reductions in income inequality are associated with increases in carbon emissions per capita. The fifth essay studies the global distribution of per capita CO2 emissions. The focus is on the effect the energy mix and the sectoral composition have on emission inequality. The decline of heavy manufacturing in OECD countries and the rise of using coal in non- OECD countries led to a decline of global inequality in per capita CO2 emissions. In the long run there is the possibility that emission inequality will rise again. Each essay contributes to the literature in its specific field. They analyze how economic activities (mostly consumption) influence CO2 emissions, which are considered responsible for changes in climatic conditions. At the same time those changes in climatic conditions affect human wellbeing and go in line with monetary loses. National policies such as redistributive policies can have an influence on national CO2 emissions in both directions and have to be well planned. Policies to influence consumption habits towards less CO2 intensive goods could be efficient to regulate CO2 emissions but might only be feasible in richer countries. International climate policies have shown an impact on CO2 emissions among participating countries. International policies can help to get national policies to reduce CO2 emissions on the way.

학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

In this e-book I have collected some papers written for and presented at conferences and seminars during the latter years. Together with Working Papers published at the Department of Thematic Studies–Technology and social change, Linköping University, they were all part of a larger scheme of writing a history of the Swedish electricity system circa 1880–2010. That project sought to fulfil three aims: A discussion around Hughes' theory of "system" and "momentum"; A critical focus on deregulation; A critical study of the role of electricity in the conversion of the Swedish energy system towards "sustainability". As that book was intended to be written in Swedish, and papers have been written in English, it seems as a good idea to collect the English papers in one volume. So, the following texts can be seen as a draft of a book yet unwritten, but they are too disparate to be completely integrated. Therefore, papers are still individual papers in this volume. The first two papers deals with the long-term development of Swedish electricity production and the advantages and short-comings of Hughes' theory on sociotechnical systems: Did the electricity system become an unstoppable and growing force in society? Well, yes, but it met resistance. The following two focuses on deregulation: What happened when expectations of homo economicus hit real consumers? And: Can theory become reality? In short, my answer is that institutions changed, but people did not, at least not very much. The last one focus on total energy use and the role of electricity in that: Are improvements in energy efficiency useless? No, energy use has stagnated since the 1970s. After the papers I have added some afterthoughts. The main points of the first paper is that I present the many different meanings Thomas Hughes put into the concept of "momentum". Here I suggest that one of these is the most promising, but also that optimization through the pooling of power resources is based on fundamental characteristics of power production which I call "coping with variations". Another aspect on investments in electric power facilities, especially during the early period, was the heavy prime costs for the network, which explains why cables were laid out first in densely populated areas. I try to explain why these distribution costs fell dramatically from the 1920s to the 1950s. This has implications for the diffusion of the use of electricity outside big consumers like large industries, but also for pricing and purposes of pricing. The second paper is quite close to the momentum-discussion of the first paper, but here I suggest a distinction between "system growth" on one hand and "capacity growth" on the other. The basic idea is simple: The former refers to extensions of the electricity network from local to regional to national and international levels, the latter refers to the growth in size and capacity of power stations. While the network has continued to grow through interconnections without interruption, capacity growth met resistance from the environmental movement, especially in the 1960s and 1970s. This calls for a change in Hughes' idea of momentum as a purely internal mechanism leaving the relation to the political environment aside. The third and fourth papers discusses deregulation of the electricity industry in Sweden. The third has a focus on households as customers, and their propensity to act as the homo economicus expected of them. This analysis is done in terms of transaction costs. The result is, of course, a contrast to the abstract consumer in the liberal economic and neoclassical vision. There are always transaction costs, this is no surprise really, but it is still necessary to point at this fact as liberal and neoclassical economics has no room for such costs. However, I also point at the possibility of householders adapting to homo economicus. As this abstraction is necessary for the alleged self-regulating mechanisms of the perfect market, learning to act on the deregulated market opens for the neoclassical market to be realized despite its unrealistic character. The fourth paper takes this idea further. In discussion with the concept of "performativity" I point at facts supporting the notion of implementation of neoclassical ideas into the real market. There was close interaction between the practice of pricing electricity within the industry and academic economist's ideas of pricing principles. However, interactions does not necessarily lead to complete integration, there seem to be a fundamental difference between a preference for stable prices among "engineer-economists" and the preference for fluctuating prices in the short term among academic economists. The last paper is focused on the problems of energy efficiency. Improving efficiency is often mentioned in policy documents and research reports as one of the most important areas of action to solve environmental problems of today. Let me remind the reader here that I do not reduce environmental problems to the problem of global warming as "sustainable" energy sources also have negative environmental effects, albeit of a milder kind. In this paper I point at the role of all those energy-converting gadgets that we use daily, at least in the Western world, such as cars, dwellings and lamps. This study has its origin in my project on efficient lighting and the phase-out of the incandescent light bulb. The phase-out solves the problem of lock-in to a preferred and low-cost technology, and directs the change of the lighting stock to low-wattage alternatives. The paper is an effort in generalization to cars and heating of dwellings of this focus on a changing stock. The reason for doing so is that data on energy intensity falls in many countries from the 1970s onwards, at a time when environmental problems became prominent in policies. After the fifth paper follows a few afterthoughts brought to mind when papers were put together: On the character of sociotechnical system; On the role of the environmental movement and policies; And on the alleged importance of householders' "behaviour" when improvements in energy efficiency is discussed.

Objetivo:el presente artículo se propone exponer la aplicabilidad de la Norma Terminológica Internacional ISO 29383, y su influencia positiva, en el contexto de las exportaciones en Colombia. Por otro lado, busca mostrar parte del trabajo desarrollado en la tesis ''Aplicación de normas terminológicas internacionales en el sector exportador colombiano'', presentada en la Universidad de Viena, Austria. La sección que se expone en este artículo hace parte igualmente del trabajo al interior del Comité Técnico Internacional ISO/TC 37, en cuanto al desarrollo de normas termino-lógicas que buscan tener una aplicabilidad general en los más diversos contextos. Uno de ellos es el planteamiento e implementación de políticas terminológicas al nivel gubernamental, a partir de la aplicación de normas terminológicas.Método:mediante el análisis de la Norma ISO 29383 ''Políticas terminológicas'', se presentan los aspectos más relevantes que permitan entender sus objetivos, enfoque, orígenes y planteamientos esenciales. Teniendo una visión clara de la norma, se lleva a cabo un análisis comparativo de la misma, contrastándola con elPlan estratégico exportador(Ministerio de Comercio Exterior y Servicio Nacional de Aprendizaje -SENA-, 2001), que define los lineamientos de la política exportadora colombiana.Resultados:se presentan proyecciones de la norma en el contexto colombiano, es decir, de qué manera se beneficiaría el sector exportador si allí se aplicara una política terminológica nacional.Conclusiones:el esfuerzo internacional en torno a la normalización terminológica puede influir positivamente en el desarrollo de economías en vías de desarrollo. The exposed section in this article is also part of the work of the International Technical Committee ISO / TC 37, in relation to the development of terminology standards that seek to have general applicability in many different contexts. One of them is the planning and implementation of terminology policies at government level, by the application of terminology standards.Method:Through the analysis of ISO 29 383 ''Terminology Policies,'' the most relevant aspects are presented, which help to understand its objectives, approaches, origins and essential points. Having a clear vision of the Standard, a comparative analysis is carried out contrasting with the Plan Estratégico Exportador (Strategic Export Plan) (Ministry of Trade, Industry and Tourism and the National Learning Service -SENA, 2001), which defines the guidelines for the Colombian export policy.Results:projections of the Standard in the Colombian context are presented, i.e. how would it benefits the export sector would if a national terminology policy is implemented.Conclusions:The international effort on the standardization of terminology can positively influence the improvement of developing economies. The application of terminology standards is a development factor not only in specialized communication of a given sector, but also as a necessary element in the process of quality management, within which standardization is increasingly becoming a part of success in the international trade. Inhaltsangabe:Einleitung: Arbeit und Umwelt gehören in unserer Gegenwart mit zu den wichtigsten Themen, die unser Handeln und gleichzeitiges Suchen nach zukunftsfähigen Lösungen bestimmen, um das Wirtschaftswachstum zu fördern und gleichzeitig die weitere einseitige Verschwendung des Naturraumes, der natürlichen Ressourcen und somit unserer Lebensgrundlagen verhindern. Die Bedeutung des Schutzes der Umwelt und ihrer natürlichen Regeneration hat hinsichtlich seiner globalen und nachhaltigen Bedeutung zunehmend auch weltweit an Beachtung gewonnen. Dies findet seinen Niederschlag in vielfältigen Absichtserklärungen, Plänen und Maßnahmen. Die Frage dabei ist, was unter Berücksichtigung der politischen, technischen, ökonomischen und sozialen Bedingungen unmittelbar und mittelbar zu tun ist und was zielgerichtet und schrittweise auch realisiert werden kann. Der Anteil der in der Volkswirtschaft für den Umweltschutz Tätigen wird sich dann auch folgerichtig kontinuierlich weiter erhöhen. Das Anliegen dieser Arbeit ist es zu untersuchen, inwieweit und welche Beschäftigungspotentiale bestehen oder neu entstehen, wenn auf der Grundlage des derzeitigen Erkenntnisstandes die Möglichkeiten der Umweltentlastung durch eine ökologische Modernisierung genutzt und ausgeschöpft werden. Es wird zugrundegelegt, dass jede Maßnahme der ökologischen Modernisierung direkt oder indirekt Möglichkeiten der Beschäftigung in sich birgt. Schon die innovative Auseinandersetzung mit der Thematik, das Herausarbeiten der Problemstellung und der Lösungsansätze erwecken und beanspruchen menschliche, geistige und körperliche Aktivitäten. Das setzt sich fort, wenn die Aufgabenstellung vorbereitet, daran gearbeitet und diese dann schließlich umgesetzt wird. Ihren Anteil daran haben nicht nur die Forscher und Erfinder, die eine Innovation auslösen und zum Tragen bringen, sondern begleitend und in der Folge eine Vielzahl von Beschäftigten verschiedener Qualifikation und Wirtschaftsbereiche. Die Vorhaben müssen schließlich geplant, durchgeführt, verwaltet und letztlich stabilisiert und betrieben werden. Der Umweltschutz hat Querschnittscharakter. Nahezu alle wirtschaftlichen Bereiche haben irgendeinen Bezug zum Umweltschutz. Es ist sehr problematisch, die für den Umweltschutz Tätigen durchgehend als solche zu identifizieren, abzugrenzen und in die volkswirtschaftliche Gesamtrechnung einzuordnen. Daraus erklärt sich, dass die Aussagekraft der Statistik dahingehend noch sehr unzureichend ist. Der Umweltschutz hat auch in der Literatur entsprechend den in den letzten Jahrzehnten zugenommenen Erkenntnissen, Einsichten und bedeutenden nachhaltigen Aktivitäten in einer Vielzahl von Beiträgen Berücksichtigung gefunden. Diese Beiträge enthalten eine Fülle von Angaben mit Analysen und vor allem Ermittlungen, wie sie weiträumig und vom Aufwand her nur von einschlägigen Institutionen dargelegt werden können. Damit steht aus den verschiedensten Quellen wohl umfangreiches Zahlenmaterial zur Verfügung, wenn auch mit dem Nachteil, dass dieses häufig nicht oder nur bedingt vergleichbar ist. Auf einige Gründe, worauf dieses zurückzuführen ist, werde ich im Rahmen dieser Arbeit eingehen. Auf diese Zahlen muss ich mich aber stützen; eigene Erhebungen, Ermittlungen bzw. Befragungen sind selbstverständlich schon aus zeitlichen Gründen nicht möglich. Nach der Darlegung der Grundlagen werde ich auf die einzelnen Handlungsfelder der ökologischen Modernisierung eingehen. Schwerpunkt ist dabei der Energiesektor. Die Mobilität, die Abfallwirtschaft, die Entwicklung des ländlichen Raumes sowie die umweltorientierten Dienstleistungen und der ökologischer Tourismus werden als weitere Ausgangsbasen für Innovationen und Beschäftigungseffekte abgehandelt. Im letzten Abschnitt werden die aufgefundenen Beschäftigungszahlen auf ihre Aussagefähigkeit hin kritisch untersucht. Anschließend werden die Beschäftigungspotentiale aus ökologischer Modernisierung in den Handlungsfeldern hinsichtlich ihrer Chancen und Hemmnisse beurteilt. Gesondert ausgewiesen wird der Export von Umweltschutzgütern. Das weite Handlungsfeld der politischen und ökonomischen Einflussnahme und deren Auswirkungen auf die Beschäftigung sind für die Entstehung von Beschäftigungspotentialen von großer Bedeutung. In diesem Zusammenhang werden die Rahmenbedingungen der Ökologisierung des Finanzsystems sowie einige Förderprogramme angeführt. Die Aufgabe, bestehende Arbeitsplätze auf dem Land zu erhalten und neue zu schaffen, muss auch Bereiche wie Vermarktung, Tourismus, Natur und Umweltschutz einbeziehen. Die Bundesregierung widmet diesem Anliegen größte Aufmerksamkeit und hat umfangreiche Projekte und Förderungsmitteln in Höhe von mind. 45,5 Mio. Euro im Zeitraum 2002 - 2005 initiiert, um u.a. durch Schaffung von Modellregionen innovative Entwicklungskonzepte durchzusetzen. Inhaltliche Schwerpunkte sind sowohl die Regional- und Direktvermarktung als auch die Förderung eines sanften und landschaftsbezogenen Tourismus. Die ökologisch - ökonomische Revitalisierung ländlicher Räume ist eine große Chance für die Erschließung neuer Beschäftigungs- und Einkommensfelder. Dabei geht um die Erzeugung nachwachsender Rohstoffe und erneuerbarer Energien und weiterhin um die Rückverlagerung von Verarbeitungs- und Vermarktungsstrukturen auf die landwirtschaftlichen Betriebe und um die Diversifizierung und Kombination ihrer Dienstleistungen, wozu auch der ländliche Tourismus zählt. Im Rahmen der Gemeinschaftsaufgabe "Verbesserung der Agrarstruktur und des Küstenschutzes (GAK)" sollen innovative Wirtschaftskonzepte für den ländlichen Raum, eine umweltverträgliche Bewirtschaftung, artgerechte Tierhaltung sowie Umwelt- und Naturschutzmaßnahmen schwerpunktmäßig unterstützt werden. Dabei ist die Förderung des ökologischen Landbaus allein nicht ausreichend. Die Umweltbilanz muss auf der gesamten landwirtschaftlichen Nutzfläche verbessert werden. Folgende Instrumente sind hier erforderlich: die finanzielle Aufstockung der Agrarumweltprogramme, die Einführung von Abgaben auf den Düngemittel- und Pestizidgebrauch, die Stärkung des Vertragsnaturschutzes und die weitere Konkretisierung des Standards der Guten Fachlichen Praxis im landwirtschaftlichen Fachrecht und im Naturschutzrecht. Von zentraler Bedeutung ist eine Reform des europäischen Prämiensystems, hier müssen Fördergelder in den Bereich der ländlichen Entwicklung umgeschichtet werden. Der ländliche Raum besitzt in seiner Gesamtheit ein beträchtliches, noch weiter entwicklungsfähiges Wirtschaftspotential. Eine nachhaltige positive wirtschaftliche Entwicklung ist jedoch nur dann zu erwarten und auf die Zukunft hin tragfähig, wenn es gelingt, die Motivation der Menschen im ländlichen Raum für Entwicklungsaktivitäten zu verstärken und zu unterstützen. Dazu gehört die Erfahrung, dass wirksame Ansätze und positive Erfahrungen aus erfolgreichen Maßnahmen und Projekten noch nicht hinreichend öffentlichkeitswirksam transportiert werden. Das Erscheinungsbild des ländlichen Raumes ist vielerorts dadurch gekennzeichnet, dass mittels Windkraftanlagen erneuerbare Energie erzeugt wird. Zunehmend geht man aber dazu über, aus Biomasse pflanzlichen und tierischen Ursprungs durch Gärung Methangas zu gewinnen. Es werden Wärme, Kraftstoffe und Strom erzeugt, zurzeit hauptsächlich Wärme. (siehe Abschnitt II 1.2.5) Ökolandbau: Seit Jahrzehnten nimmt die Zahl der Beschäftigten in der Landwirtschaft ab (Verringerung der Anzahl der Betriebe um jährlich 3%). Trotz der etwa gleichbleibenden landwirtschaftlich genutzten Fläche sinkt die Zahl der Arbeitskräfte in der deutschen Landwirtschaft kontinuierlich. Im Jahre 1994 waren dort 740.000 Menschen tätig, im Jahre 2000 nur noch 600.000 (siehe Tabelle 5: Innovative Ansätze zur Schaffung von Arbeitsplätzen im Umweltschutz). Einziger Wachstumsbereich ist der ökologische Landbau. Die Zahl der Ökobetriebe betrug 2002 15.626. Mittlerweile werden 4% der gesamten landwirtschaftlich genutzten Fläche im Ökolandbau bewirtschaftet. Ökobetriebe haben einen um 35% höheren Bedarf an Arbeitskräften als konventionelle Höfe. Im Zeitraum 1994 - 2000 ist die Zahl der Beschäftigten von 19.000 auf 30.000 gestiegen. Eine Untersuchung des Verbandes "Bioland" besagt, dass der ökologische Landbau bis zu 60% mehr Arbeitsplätze schaffen kann als der konventionelle Landbau. Die Umstellung auf Biolandbau erzielt positive Beschäftigungseffekte. Die Zahl der Beschäftigten steigt um 50 - 60% sowohl bei den Auszubildenden und Praktikanten, bei Saisonarbeitern als auch bei den Festangestellten. Der größte zusätzliche Arbeitsplatzeffekt wird durch den Ausbau der hofnahen Verarbeitung und intensiverer Vermarktungsformen erreicht. Grundsätzlich bietet der Ökolandbau beste Voraussetzungen für weitere neue Arbeitsplätze. Dazu ist zusätzliches, gut ausgebildetes Personal unabdingbar. Ausgehend vom Erreichen des Agrarwendeziels (10% bebaute Fläche nach ökologischen Kriterien bis 2005, 20% im Jahre 2010) prognostiziert das Öko - Institut zusätzlich brutto etwa 52.000 Arbeitsplätze. Um dieses hochgesteckte Ziel zu erreichen, sollten auf der Nachfrageseite alle Absatzwege für ökologische Produkte gestärkt werden. In anderen Bereichen in diesem Zusammenhang wegfallende Arbeitsplätze (z.B. in der chemischen Industrie, die Dünge- und Pflanzenschutzmittel herstellt) dürften damit mehr als kompensiert werden. Vermarktung von Bioprodukten: Im Lebensmittelhandel haben sich die Naturkostwaren infolge der stärkeren ökologischen Ausrichtung zu einem eigenständigen Marktsegment entwickelt. Die Produkte werden sowohl von den landwirtschaftlichen Betrieben direkt angeboten als auch über die verschiedenen anderen Angebotsformen, vom Naturkostgeschäft bis zum Supermarkt oder Bauernmarkt. Viele Betriebe haben sich hiermit ein zweites Standbein geschaffen. In der Naturkostbranche wurde im Jahre 2001 ein Umsatz von 890 Mio. Euro erwirtschaftet. Man rechnet mit jährlichen Steigerungssätzen von zwischen 5 bis 10 %.Vom Bundesverband Naturkost Naturwaren e.V. (BNN) wurden für das Jahr 2001 wurden folgende neugeschaffene Arbeitsplätze angegeben: 9.000 Beschäftigte im Naturkosteinzelhandel, 1.200 im Großhandel und 23.000 in der Naturkostverarbeitung. Angesichts der geringeren Produktivität in der Naturkostkette und deshalb, weil die Kunden dann andere Produkte weniger kaufen, ist an anderer Stelle ein Rückgang der Beschäftigten zu berücksichtigen. Belastbares Zahlenmaterial liegt nicht vor. Insgesamt gesehen würde der Nettoeffekt gering sein. An anderer Stelle wird für das Jahr 2003 eine Zahl von 40.000 Beschäftigten im Naturkosthandel angegeben.

ABSTRACT - The authors' main purpose is to present ideas on defining Health Law by highlighting the particularities of the field of Health Law as well as of the teaching of this legal branch, hoping to contribute to the maturity and academic recognition of Health Law, not only as a very rich legal field but also as a powerful social instrument in the fulfillment of fundamental human rights. The authors defend that Health Law has several characteristics that distinguish it from traditional branches of law such as its complexity and multidisciplinary nature. The study of Health Law normally covers issues such as access to care, health systems organization, patients' rights, health professionals' rights and duties, strict liability, healthcare contracts between institutions and professionals, medical data protection and confidentiality, informed consent and professional secrecy, crossing different legal fields including administrative, antitrust, constitutional, contract, corporate, criminal, environmental, food and drug, intellectual property, insurance, international and supranational, labor/employment, property, taxation, and tort law. This is one of the reasons why teaching Health Law presents a challenge to the teacher, which will have to find the programs, content and methods appropriate to the profile of recipients which are normally non jurists and the needs of a multidisciplinary curricula. By describing academic definitions of Health Law as analogous to Edgewood, a fiction house which has a different architectural style in each of its walls, the authors try to describe which elements should compose a more comprehensive definition. In this article Biolaw, Bioethics and Human Rights are defined as complements to a definition of Health Law: Biolaw because it is the legal field that treats the social consequences that arise from technological advances in health and life sciences; Bioethics which evolutions normally influence the shape of the legal framework of Health; and, finally Human Rights theory and declarations are outlined as having always been historically linked to medicine and health, being the umbrella that must cover all the issues raised in the area of Health Law. To complete this brief incursion on the definition on Health Law the authors end by giving note of the complex relations between this field of Law and Public Health. Dealing more specifically on laws adopted by governments to provide important health services and regulate industries and individual conduct that affect the health of the populations, this aspect of Health Law requires special attention to avoid an imbalance between public powers and individual freedoms. The authors conclude that public trust in any health system is essentially sustained by developing health structures which are consistent with essential fundamental rights, such as the universal right to access health care, and that the study of Health Law can contribute with important insights into both health structures and fundamental rights in order to foster a health system that respects the Rule of Law. --- RESUMO – O objectivo principal dos autores é apresentar ideias sobre a definição de Direito da Saúde, destacando as particularidades desta área do direito, bem como do ensino deste ramo jurídico, na esperança de contribuir para a maturidade e para o reconhecimento académico do mesmo, não só como um campo juridicamente muito rico, mas, também, como um poderoso instrumento social no cumprimento dos direitos humanos fundamentais. Os autores defendem que o Direito da Saúde tem diversas características que o distinguem dos ramos tradicionais do direito, como a sua complexidade e natureza multidisciplinar. O estudo do Direito da Saúde abrangendo normalmente questões como o acesso aos cuidados, a organização dos sistemas de saúde, os direitos e deveres dos doentes e dos profissionais de saúde, a responsabilidade civil, os contratos entre instituições de saúde e profissionais, a protecção e a confidencialidade de dados clínicos, o consentimento informado e o sigilo profissional, implica uma abordagem transversal de diferentes áreas legais, incluindo os Direitos contratual, administrativo, antitrust, constitucional, empresarial, penal, ambiental, alimentar, farmacêutico, da propriedade intelectual, dos seguros, internacional e supranacional, trabalho, fiscal e penal. Esta é uma das razões pelas quais o ensino do Direito da Saúde representa um desafio para o professor, que terá de encontrar os programas, conteúdos e métodos adequados ao perfil dos destinatários, que são normalmente não juristas e às necessidades de um currículo multidisciplinar. Ao descrever as várias definições académicas de Direito da Saúde como análogas a Edgewood, uma casa de ficção que apresenta um estilo arquitectónico diferente em cada uma de suas paredes, os autores tentam encontrar os elementos que deveriam compor uma definição mais abrangente. No artigo, Biodireito, Bioética e Direitos Humanos são descritos como complementos de uma definição de Direito da Saúde: o Biodireito, dado que é o campo jurídico que trata as consequências sociais que surgem dos avanços tecnológicos na área da saúde e das ciências da vida; a Bioética cujas evoluções influenciam normalmente o quadro jurídico da Saúde; e, por fim, a teoria dos Direitos Humanos e as suas declarações as quais têm estado sempre historicamente ligadas à medicina e à saúde, devendo funcionar como pano de fundo de todas as questões levantadas na área do Direito da Saúde. Para finalizar a sua breve incursão sobre a definição de Direito da Saúde, os autores dão ainda nota das complexas relações entre este último e a Saúde Pública, onde se tratam mais especificamente as leis aprovadas pelos governos para regular os serviços de saúde, as indústrias e as condutas individuais que afectam a saúde das populações, aspecto do Direito da Saúde que requer uma atenção especial para evitar um desequilíbrio entre os poderes públicos e as liberdades individuais. Os autores concluem afirmando que a confiança do público em qualquer sistema de saúde é, essencialmente, sustentada pelo desenvolvimento de estruturas de saúde que sejam consistentes com o direito constitucional da saúde, tais como o direito universal ao acesso a cuidados de saúde, e que o estudo do Direito da Saúde pode contribuir com elementos importantes para a realização de um sistema de saúde que respeite o Estado de Direito e os Direitos Fundamentais. ; publishersversion ; published

Aus der Einleitung: 'Nachfolger dringend gesucht', so lautete der Titel eines Artikels im Mai 2007 des manager magazines. Beschrieben wurden die Probleme der Unternehmensnachfolge und drohender Schließungen, die mangels Nachfolger und aufgrund der schlechten Vorbereitungen seitens der Unternehmen in Deutschland bevorstünden. Aktuell und innerhalb der kommenden zwei Dekaden muss in Deutschland in einer Vielzahl von Unternehmen ein Generationswechsel vollzogen werden. Allein in den Jahren 2005 bis 2009 steht pro Jahr in 71.000 Unternehmen die Übergabe der Unternehmensleitung bevor. Die Gründergeneration der Nachkriegszeit erreicht nun vermehrt das Rentenalter und in den damals errichteten Betrieben muss der Generationswechsel vollzogen werden. Hieraus erwächst eine Fülle an Problemen, die vor, während und zum Teil noch nach der Übergabe zum Tragen kommen. Zu den allgemein diskutierten Schwierigkeiten einer Betriebsübergabe, wie z.B. steuerliche und rechtliche Gesichtspunkte, der richtige Übergabezeitpunkt und die optimale Nachfolgestrategie, spielen der fehlende oder nicht ausreichend qualifizierte Nachwuchs für die Alt-Unternehmer eine immer größere Rolle. Es steht die Annahme im Raum, dass es aufgrund des demografischen Wandels zukünftig immer häufiger zur Stilllegung von Betrieben kommen wird, verbunden mit negativen Auswirkungen für die deutsche Volkswirtschaft. Der Nachfolgermangel macht sich v.a. in kleinen und mittleren inhabergeführten Handwerksbetrieben bemerkbar, die aufgrund mangelnder Verfügbarkeit eines Nachfolgers die Geschäftstätigkeit werden einstellen müssen. Unternehmensschließungen sind besonders problematisch, wenn wirtschaftlich leistungsfähige Unternehmen aus dem Wettbewerbsprozess ausscheiden und hierdurch Arbeitsplätze und Betriebsvermögen verloren gehen. Diese Gefahr besteht insbesondere im Zusammenhang mit Unternehmensnachfolgen im Handwerk, da Handwerksbetriebe oft stark auf ihre Inhabergeschäftsführer zugeschnitten sind. Um den Fortbestand des Unternehmens zu sichern, muss die Nachfolge deshalb frühzeitig und umfassend geplant werden. Hier gilt es Lösungen und Konzepte zu finden, um den damit verbundenen Betriebsaufgaben und volkswirtschaftlichen Problemen von Arbeitsplatz- und Ausbildungsplatzverlusten entgegenzuwirken und den Unternehmern eine Perspektive für die Zukunft zu geben. Dabei müssen bei der Nachfolgersuche neue Wege beschritten werden und neue Bevölkerungsgruppen, wie z.B. Ältere, Frauen und Migranten durch spezielle Förderprogramme stärker berücksichtigt werden, um den Kreis der potentiellen Nachfolger für Handwerksbetriebe zu vergrößern. Zielsetzung: Die vorliegende Arbeit behandelt die Einflussfaktoren des demografischen Wandels auf das Handwerk und hierbei insbesondere auf die Betriebsnachfolge. Der Schwerpunkt der Arbeit liegt darauf, einen Überblick über die aktuelle Situation und mögliche zukünftige Entwicklungen in diesem Bereich zu geben. Dabei soll geprüft werden, ob staatliche und private Fördermaßnahmen bezüglich dieser Problematik ausreichend sind und in welchen Bereichen noch Verbesserungspotential zu finden ist. Die Betrachtung konzentriert sich ausschließlich auf die Entwicklung der Angebotsseite an potentiellen Selbstständigen und Nachfolgern im Rahmen des demografischen Wandels. Nachfrageseitige Effekte sind nicht Gegenstand der Untersuchung. Gang der Untersuchung: Im ersten Abschnitt wird das Handwerk in Deutschland betrachtet und die Rahmenbedingungen, in welchen die Unternehmensübertragungen stattfinden vorgestellt. Hierzu werden die Ergebnisse von 25 Studien – deren Übersicht im Anhang zu finden ist – aus den Jahren 1997 bis 2006, die zumeist auf Umfragen im Handwerk bzw. in Familienunternehmen und dem produzierenden Gewerbe beruhen, zusammengefasst und mit den jeweiligen Sachverhalten der Kapitel 2 und 3 in Zusammenhang gebracht. In einem zweiten Schritt wird geprüft, welche Veränderungen es in der demografischen Entwicklung Deutschlands gibt und wie sich diese auf das Arbeitskräftepotential und damit auf das Nachfolgerpotential bereits auswirken und zukünftig auswirken könnten. Im dritten Abschnitt werden verschiedene Lösungsansätze zur Bekämpfung der Nachfolgeproblematik im Handwerk aufgeführt, wobei insbesondere auf bildungsbezogene Ansätze und Lösungen bezüglich besonderer Bevölkerungsgruppen, wie z.B. Migranten, Frauen und Ältere eingegangen wird. Letzteren wird in der Literatur ein großes Potential bezüglich der Lösung des personellen Engpasses bei der Nachfolgeproblematik zugeschrieben. Zuletzt werden aktuelle Instrumente und Fördermöglichkeiten für Existenzgründer und Unternehmensnachfolger im Bundesland Bayern dargestellt, die der Entschärfung der Nachfolgeproblematik dienen (könnten). Dabei wird im Anschluss an eine Kategorisierung der Angebote versucht, Ansatzpunkte für Verbesserungen in der Beratungslandschaft aufzuzeigen. Aufbau der Arbeit: Nach der Einführung (Kapitel 1) folgt eine einleitende Abgrenzung des Begriffs Handwerk und eine Darstellung der Rahmenbedingungen (Kapitel 2). Zusätzlich zum Schrumpfungs- und Alterungsprozess der Bevölkerung leiden bestimmte Regionen Deutschlands – v.a. in den neuen Bundesländern – überproportional unter der Abwanderung von jungen Menschen. Es zeigt sich, dass nicht allein die Höhe der ostdeutschen Abwanderung problematisch ist, sondern eher die zeitliche Konstanz über viele Jahre hinweg und v.a. die Selektivität, mit der sie abläuft. Wenn berufliche Perspektiven fehlen, wandern besonders jüngere und qualifizierte Arbeitskräfte ab (sog. Brain Drain), wodurch die Geburtenzahlen in der jeweiligen Region weiter absinken, da die Abwandernden die zukünftige Elterngenerationen darstellen. Somit schrumpft und altert die Bevölkerung in wachstumsschwachen Regionen überdurchschnittlich gegenüber derjenigen in Regionen mit hoher Wirtschaftskraft und -dynamik. Zusätzlich zum Wettbewerb um Zuwanderungswillige wird in Zukunft die Bindung bereits vorhandener qualifizierter Fachkräfte an eine Region immer stärker zum Erfolgsfaktor für die jeweilige wirtschaftliche Entwicklung werden. Der Mangel an Fachkräften könnte für viele Kommunen zu einem Standortnachteil werden und dadurch bestehende Betriebe in ihrer Existenz gefährden bzw. bei der Auswahl eines Firmenstandortes als K.O.-Kriterium die Ansiedelung neuer Unternehmen verhindern. Eine weitere Folge des verstärkten Bevölkerungsschwundes in den ländlichen Problemzonen ist, dass manche Dörfer und Kleinstädte aufgrund der extrem geringen Anzahl dort lebender Menschen langfristig kaum am Leben gehalten werden können. Hier wären auch die übrig gebliebenen KMU in ihrer Existenz bedroht. In den besonders von Abwanderung betroffenen Regionen im Osten der Republik werden die Auswirkungen des demografischen Wandels früher als in anderen industrialisierten Ländern zu spüren sein. Ergebnisdarstellung des Wandels bezüglich des Nachfolgerpotentials im Handwerk: Die Darstellung und Analyse des demografischen Wandels hat gezeigt, dass die deutsche Bevölkerung weniger, älter und multikultureller wird. Im Folgenden soll betrachtet werden, welche Auswirkungen diese Entwicklungen auf das Nachfolgerpotential des Handwerks haben. Wie in Kapitel 3 aufgezeigt wurde, rekrutieren sich die potentiellen Nachfolger im Handwerk aus der Gruppe der jungen Erwerbstätigen (s. Abbildung 3-10) im Alter von etwa 25 bis 35 Jahren. Diese Altersgruppe schrumpft jedoch aufgrund des immer weiter fortschreitenden Geburtenrückganges am stärksten und wird dies auch aufgrund zukünftig kleinerer Muttergenerationen weiter tun. Daraus folgt, dass grundsätzlich mit einem Rückgang der Anzahl an Erwerbstätigen zu rechnen ist. Zusätzlich wird die Bevölkerung auf Grund rückläufiger Sterbezahlen bzw. einer immer weiter steigenden Lebenserwartung immer älter. Diese Entwicklung hat natürlich auch Auswirkungen auf die Selbstständigen bzw. die potentiellen Nachfolger eines Betriebes, denn eine zahlenmäßig kleinere und zudem ältere Bevölkerung bringt auch weniger potenzielle Selbstständige hervor. Ein lebhaftes Unternehmensgründungsgeschehen und sichere Nachfolgeregelungen sind jedoch wichtig, da eine 'Kultur der Selbstständigkeit' Voraussetzung für einen funktionierenden Strukturwandel ist. Gleichzeitig mit der Verknappung der Anzahl der potentiellen Übernehmer steigt jedoch die Zahl der Übergeber in Zukunft an. Wie anhand Abbildung 5-2 zu erkennen ist und in Kapitel 3 gezeigt wurde, werden sich insbesondere in den Jahren 2013 bis 2030 die Unternehmensnachfolgen häufen, da hier besonders geburtenstarke Jahrgänge das Rentenalter erreichen werden und somit tendenziell mehr Selbstständige ihre Betriebe übergeben müssen. Kapitel 4 hat dargelegt, dass schon heute in einigen Regionen, v.a. Ostdeutschlands, aufgrund der Abwanderung junge und qualifizierte Arbeitskräfte fehlen. Sie zeigen damit bereits gegenwärtig die zukünftigen Entwicklungen für weite Teile Deutschlands auf. Den Handwerksbetrieben mit ihrer vergleichsweise schwachen Arbeitsmarktposition (mangelnde Aufmerksamkeit und Attraktivität, s. Kap. 3) wird es in Zukunft schwer fallen, in Konkurrenz zu Industrie und Dienstleistungsbranche aus den kleiner werdenden Nachwuchsjahrgängen qualifizierte Kräfte im gewünschten Umfang zu rekrutieren. Dadurch wird es dem Handwerk zukünftig kaum mehr möglich sein, wie bisher über den eigenen Bedarf hinaus auszubilden. Die unzureichende Vorbereitung der Unternehmen auf den demografischen Wandel zeigt die aktuelle Studie 'Pro 50 – Arbeit mit Zukunft' der Wirtschaftsprüfungs- und Beratungsgesellschaft PricewaterhouseCoopers (PwC), die 53 Unternehmen aus verschiedenen Branchen über ihre Maßnahmen zur Zukunftssicherung befragt hat. 'Ein Großteil der von uns befragten Unternehmen hat das Problem des Demografiewandels zwar erkannt. Zu wenige agieren aber auch entsprechend', sagt Holger Leckebusch, Direktor des Servicebereichs People and Change bei PwC in Deutschland'. Ebenso steht es um die handwerklichen Betriebe, in denen das Problembewusstsein hinsichtlich der langfristigen Folgen des demografischen Umbruchs für die Arbeitswelt noch kaum entwickelt ist. Dies ist fatal, da die Weichen für eine erfolgreiche Nachwuchsplanung, die Grundlage für eine erfolgreiche Nachfolgeregelung ist, frühzeitig gestellt werden müssen. So wie Regionen oder Städte und Landkreise zukünftig in einem Wettbewerb um junge und qualifizierte Arbeitskräfte stehen werden, so werden vermehrt auch die Handwerksbetriebe um diese kämpfen müssen ('war of talents'). Hierzu wird es erforderlich sein, z.B. im Rahmen der Personalpolitik neue Wege zu gehen, um genügend leistungsfähige Nachwuchskräfte rekrutieren zu können.

Iam pleased to know that Vilnius University is publishing a volume containing papers presented at the 2nd Indology conference for the Central and Eastern European region held at Vilnius University on the 24–26 August 2006. There is no doubt that the Indology Department at Vilnius University acted as a wonderful host for the conference and contributed immensely to strengthening the academic and scholarly ties of departments of Indology all over Central and Eastern Europe. The Indology Department in Vilnius can proudly claim to have strengthened the long-lasting relationship between India and Lithuania.The departments of Indology in Central and Eastern Europe have not only facilitated the spread of Indian studies in their respective countries but also reinvigorated and strengthened ties between India and Central and Eastern Europe. They have helped in the widespread dissemination of knowledge about India and expanded scholarly and academic interactions between departments of Indology throughout this region. Today these departments boast of several eminent scholars whose knowledge of Indian subjects, including languages and literature and history and culture, is of a high standard.The study of Indology directly contributes to the importance of India—its history, civilisation and culture—in today's globalised world. India, and therefore Indology, is also important in the study of the economy, science and technology and for technological exchanges in today's context. India remains the fourth largest economy in the world in terms of purchasing power parity. The Indian economy is currently growing at the rate of nearly 9 per cent per annum, making it one of the fastest growing economies in the world. India's foreign trade in 2006–7 is expected to surpass US $200 billion, as compared US $30 billion in the early 1990s. The country's foreign exchange reserves reached a healthy US$196 billion in March 2007. India is one of the most favoured destinations for foreign direct investment—close to US $12 billion a year. For knowledge processing industries, as well as back office processing, India has emerged as a major hub of global research and development analysis and scientific inventions. The strengths of India in the new economy—which consists of information technology, bio-technology, nanotechnology and material sciences—are now known all over the world. Indian manufacturing strength is now coming to fruition and these strengths are visible also in the Central and East European market. Several important investments from India have taken place in the steel, electronics, automobile, pharmaceutical, packaging and information technology sectors, to namea few. It is quite evident that this trend will strengthen in the future. Similarly, trade between India and Central and Eastern Europe is increasing between 20–30 per cent a year and is expected to flourish in the near future as more countries from Central and Eastern Europe join the European Union. India has warmly welcomed the recent accession of Bulgaria and Romania to the European Union.All this makes India not only a viable subject of study for its history and culture but also fascinating for its growing economic, scientific and technological strength. These new developments require added attention. It is essential for the course curriculum of Indology studies to be standardised across Central and Eastern Europe as far as is feasible on the basis of cooperation between the universities of the region. I am glad that a website and a network for this purpose have been set up and are functional, with funding from the Embassy of India in Warsaw. The course curriculum for Indology needs to be updated. The knowledge imparted at the Indology centres needs to be well-rounded and contemporary; this will provide the necessary additional tools to the students to understand not only India's past glories but also its present strengths and future prospects. The Indian Council for Cultural Relations (ICCR ) and the government of India are convinced that this is the course that centres for Indology studies should follow in Central and Eastern Europe, as well as in other regions of the world. India is no longer a country known only for its ancient literature, drama and complex society. It is a nation on the move. Studies on ancient India and modern India should be complementary. I certainly hope that those who impart the knowledge of Indology will themselves catch up with modern developments to be able to contribute to the betterment of the students, who, in all fairness, deserve up-to-date information and knowledge of India.The papers published in the volume cover diverse areas and they are well researched and documented and could become a useful source of reference material for various institutions who offer courses on India. The organisation of the conference in Vilnius has already given exposure to the strength of Indian studies in Lithuania and Central and Eastern Europe. It is remarkable that during this conference a Central and Eastern European Network of Indian Studies (CEENIS) was founded with the participation of institutions at universities from 10 countries in this region.I would sincerely like to thank the faculty and staff, particularly Prof. Audrius Beinorius, the head of the department, for organising the conference and for publishing this volume. I also wish to place on record sincere appreciation to contributions made by a number of other scholars and professors at the Indology Department in Vilnius, as well as to the scholars from other countries, some of whom participated in the conference, for spreading Indian studies in Central and Eastern Europe over the pastfew decades.
