In this work, in accordance with international and European legal standards, the regulatory development and issues of institute of forms of work organisation in Lithuania are analysed. The basic form of work organisation is a non-term employment contract. From other forms of employment it is distinguished by the following characteristics: the relations between parties are bilateral (employee and employer), constant, based on remuneration, subordination and are performed in the premises of employer. These abovementioned relations can be called as typical and conventional. It should be noted that they reflect the best interests of both parties. However, due to the changes of labor market in the 21st century, standard rules, created in the first half of the 20th century, are dysfunctional and must be adapted to the modern labor relations. The development of flexible employment policy of the European Union, the economic globalization and related changes of employment, the need to promote employment, to integrate women, young and elderly people into the labor market and various other socio-economic factors inspire the emergence and implementation of flexible forms of organisation of work in the Lithuanian labor law. Next to a common employment contract more flexible forms of employment are distinguished in Labour Code of Republic of Lithuania. These forms are analysed in this work as well: a part-time work, fixed-term contracts, teleworking, etc. Legal regulation of the employment through temporary employment agencies and such work relations is also the intention. Due to the practical need for more flexible forms of employment, the aim of this thesis is to find our whether international standards and European Union regulations, governing major non-standard forms of work organisation, are properly implemented. The work is comprised of three parts that consistently owerview the main aspects of forms of employment: the concept of forms of work organization, the main legal form of employment is identified, the evolution of forms of legal regulation is summarized and factors that influence the emergence of new forms of forms of employment. The paper mostly focuses on the analysis of legal framework of flexible forms of organisation of work, the peculiarity and the problems. The need of obvious and accurate regulation of forms of employement organisation is presented. The analysis and conclusions submitted should be useful for further examination of theoretical and practical issues of forms of work organization, the regulatory challenges in pursuit for the harmonization of national legislation with the international and European law, as well as for the development and improvement of national legislation.

Hochschulen gelten in der Organisationstheorie als unvollständige Organisationen, professionelle Bürokratien oder schlicht als organisierte Anarchien. Doch die Forschung über sie ist eher rar und besitzt eine Vielzahl von Leerstellen. Und über die in der Schweiz gerade erst gegründeten Fachhochschulen hat sich die Organisationsforschung noch keine systematischen Gedanken gemacht. Diesen Umstand hat sich die vorliegende Arbeit zu eigen gemacht und die spezifische Frage nach dem Führungsverständnis auf der mittleren Managementebene in Fachhochschulen gestellt. Diese Ebene interessierte, denn dass Organisationseinheiten wie Instituten oder Kompetenzzentren formelle Leitungen vorstehen, kann als neuartig bezeichnet werden. Deren Aufgabe ist nach innen gerichtet, indem sie die Unternehmensziele für die Mitarbeitenden übersetzen; aber sie ist auch nach aussen gerichtet, denn die Leitungspersonen müssen die pluralen Umweltbedingungen, denen Fachhochschulen heute ausgesetzt sind, erkennen, bewerten und in ihr Führungshandeln einbeziehen. In der Organisationsforschung wird der plurale Kontext im Konzept "Pluralistische Organisationen" verhandelt und das Führen in solchen Kontexten als "multirationales Führen" bezeichnet. Für die neue Linie der Leitenden von Organisationseinheiten bietet sich der Begriff der manager-academics an: Personen, die selbst aus dem Umfeld der Forschung kommen, die Rationalität der Wissenschaft internalisiert haben und nun vor der Aufgabe stehen, Umweltbedingungen mit ihren je spezifischen und zumeist widersprechenden Rationalitäten für die Organisation produktiv miteinander zu verknüpfen und dabei die nach Autonomie strebenden Mitarbeitenden als Expertinnen und Experten nicht zu verlieren. Die vorliegende Arbeit fragt also einerseits nach der aktuellen Verfassung der Schweizer Fachhochschulen als pluralistische Organisationen. Und andererseits nach den Konzepten und Verständnissen, mit denen die manager-academics führen. Erstere Frage wurde über die Literatur beantwortet, die zweite Frage mithilfe von Interviews. 11 Leitende von Organisationseinheiten aus 6 Hochschulen der Schweiz und 8 Disziplinen wurden befragt. Zusammenfassend zeigen sich einflussreiche Kontexte, auf die Leitende von Organisationseinheiten an Schweizer Hochschulen ihre Zielsysteme referenzieren müssen. Die Steuerungsansprüche von Politik und der eigenen Hochschule stellen sich dabei als besonders gewichtig dar. Aber auch die Scientific Community, die Professional Community, die Studierenden, die Mitarbeitenden sowie die Gesellschaft allgemein diffundieren mit ihren Logiken in die einzelnen Organisationseinheiten. Deutlich wird auch, dass die manager-academics diese Logiken vielfach als sich widersprechend wahrnehmen; wenn in der Forschung beispielsweise ein marktwirtschaftliches Verständnis erwartet wird oder die Weiterbildung sowohl den Vorgaben der Berufsverbände als auch den eidgenössischen Stellen genügen soll. In solchen Situationen zeigt sich auch, dass eine ungeklärte Unternehmenspolitik der eigenen Hochschule Führungsentscheide unsicherer macht. Zu den Führungsinstrumenten, die die manager-academics beim multirationalen Management nutzen, gehören die Gründung von Führungsteams, die partizipative und prozessfokussierte Ausarbeitung von Strategien für die Organisationseinheit aber auch das Bestreben, die Mitarbeitenden mit möglichst verschiedenen Rationalitäten unmittelbar zu konfrontieren (z.B. durch deren Einsatz in Lehre und Forschung). Im Sinne eines Leadership-Verständnisses bezeugen die Aussagen vor allem eine "Bescheidenheit" des Führungsanspruchs: Die befragten Leitungspersonen realisieren maximale Formen der Mitentscheidung, beteiligen sich als Mitarbeitende im operativen Geschäft (z.B. in der Lehre) und verstehen Leadership als kontinuierlichen Lernprozess.
