The American Bar Association is a voluntary association, organized at Saratoga, New York, in 1878. The object of the Association, as defined by its Constitution, is "to advance the science of jurisprudence, promote the administration of justice and uniformity of legislation and of judicial decision throughout the Nation, uphold the honor of the profession of the law, and encourage cordial intercourse among the members of the American Bar." The Association has at present about 28,000 members, residing throughout all of the United States proper and in Hawaii, China, Porto Rico and the Philippine Islands.

A study of the different applicable normativity in Cauca Department was performed by the author in this article, Special indigenous jurisdiction, protection legislation for Afro-descendant communities and ordinary justice to establish their articulation with the national legal framework for peace. In this socio-legal research through the qualitative method of interviews and documentary and quantitative analysis, it is possible to conclude the existence of legal collisions between the applicable norms in Cauca Department towards the national legal framework for peace. Concluding that the implementation of the agreement between the Government of Colombia and the FARC-EP in Cauca Department must be in harmony with the applicable regulations and communities that inhabit this Department. ; En este artículo se realiza un estudio a la diversa normatividad aplicable en el Departamento del Cauca: Jurisdicción Especial Indígena, legislación de protección a comunidades afrodescendientes y justicia ordinaria, para establecer su articulación al marco jurídico nacional para la paz. Islam is a holistic religion. It means that Islam is a religion which does not only focus on the vertical relation between humans and God but also contains rules of horizontal relation between man and man. Laws with social characteristic lead to the existence of a power as the doer, such as the application of all the punishments and public rewards (al-hudûd wa al-'uqûbât). This article analyzes the thought of Abdullahi Ahmed An--Na'im about syari'ah reformation which is relevant to the constitutionalism standard, criminal law, international law and modern human right, a vision of "syariat modern" which is suitable with the nation state concept which beyond the offering of the Nation of fundamentalist syariah and the offering of Modern Islamic Nation. The method used by Abdullahi Ahmed An--Na'im is the renewal method which is said as legalized evolution with hermeneutic as the main tool to reach the purpose and normative implication of the text as al-Qur'an. According to Abdullahi Ahmed An--Na'im, the failure of syari'ah application in modern country caused by the crisis on the traditional syari'ah methodology which became its base. Therefore, new syari'ah formulation is needed to be built on the new base. Naskh concept which is initiated by An-Na'im is for answering this crisis.Copyright (c) 2016 by Al-Ihkam. ABSTRACT: The review in this paper is to discuss the cause of the child out of wedlock, understanding and the status of illegitimate children, inheritance law of children out of wedlock and custody of the child of adultery under Islamic Law Compilation method used was content analysis (content analysis) of references relevant to the problem discussed. The legal consequences for the child out of wedlock under Islamic Law Compilation is a child born outside marriage has only nasab relationship with her mother and her family alone, so it legally, the child can not be completely attributed to the father father nature, although the real father/natural father (genetic) are the men who impregnate women who gave birth to her it. Concern for the nature of reason has thus become almost synonymous with philosophy. In the past few decades, however, the nature of this concern has changed in a fundamental manner, giving rise to inquiry into the interrelation between different modes of rationality. ========================= MILITARY OBEDIENCE Two major characteristics, the concepts of command responsibility and obedience to orders, distinguish military law from civilian law. In Military Obedience, Professor Keijzer examines the second characteristic. Obviously, U.S. v. Calley was the touchstone which led to the writing of this book but the subject matter is much broader than the "defense of superior orders." He has compiled a definitive work on this aspect of military law.

El Derecho público se desarrolló bajo un paradigma en el que la intervención del Estado sobre la economía era aún reducida y fundamentalmente se proyectaba de manera individualizada sobre los ciudadanos y empresas, lo que determinó que sus técnicas respondieran a este enfoque. Cuando comenzó a desarrollarse la macroeconomía, a partir de los años treinta del siglo pasado, desde el Derecho público no se supo ver la profundidad de la transformación que aquella supuso para el Estado. Por lo que el Derecho público continuó su desarrollo conforme a un enfoque que ya se había visto parcialmente superado, sin adaptarse a la nueva realidad. Sólo recientemente se ha cobrado conciencia de la extraordinaria importancia que tiene la política macroeconómica en el Derecho, por lo que se ha iniciado una regulación tendente a reducir la discrecionalidad de las autoridades económicas. Sin embargo, el resultado se antoja insuficiente para las exigencias de un Estado social y democrático de Derecho contemporáneo y plantea el reto de una renovación en importantes parcelas del Derecho público ; Public law was developed under a paradigm where state intervention in the economy was still limited and was conceived to affect citizens and companies on individual basis, which also determined the features of the legal techniques. When macroeconomics surged, in the thirties of the last century, the profound transformation that it meant for the State was not yet noticed. Therefore, public law remained under an approach which had already been partially overcome, without adapting to the new requirements stemming from macroeconomic policies. Only recently the awareness of the extraordinary relevance of macroeconomic policies for law has triggered an incipient regulation in order to fetter macroeconomic discretion. But the outcome is still insufficient to meet the demands of a contemporary social and democratic State under the rule law, and it is requiring a renewal of public law

This article concerns itself with the kind of legal conflicts that broke out in the Atlantic New World between merchant interests from different parts of Europe. Case studies are made of two disputes: one between Samuel Argall of the Virginia Company and a factor on behalf of Antoinette de Pons at the Île des Monts-Déserts, and the other between the Compagnie de Caën and the Kirke brothers at the Saint Lawrence River. Together, these case studies reveal how important it was for merchant interests to have resident ambassadors and state officials advancing their interests in England and France. Procedural difficulties and jurisdictional uncertainty often impeded the road to redress. Additionally, this article suggests that the peacetime reckoning of events associated with warfare provided an optimal opportunity for disaffected private actors to have their claims for redress recognised. The extent to which private overtures for restitution relied upon public acts of diplomacy reveals some of the reasons why it is not possible to date the origins of private international law before the long nineteenth century. Rather we might profitably identify, in events such as these, the prehistory of private international law.

The thesis is dedicated to researching of the Bill of lading. The manuscript gives the legal characteristic on the Civil law of the Bill of lading in the doctrine, its notion, the requisits of the Bill of lading and the classification of its kind is done as well. Special attention is paid to the problems of Bill of lading relations. The question of issuing, distributing and cashing is considered in details. The functional meaning of the Bill of lading is formulated. The drawbacks in lawful regulating of the relation of the Bill of lading are pointed out. The proposals on their clearing and improving of the present Civil legislation, are moved.

Исторический анализ развития уголовной политики Германии конца XIX — середины XX вв. вызывает немалый интерес, прежде всего, потому, что это период становления науки уголовной политики, выявление ее содержания, целей и задач. Разработка понятия и функций уголовной политики приобрели особую остроту в связи с попытками построения демократического правового государства в период Веймарской республики. Это выразилось в осознании необходимости реформирования уголовного законодательства с целью смены парадигм, отказа от излишней репрессии и экономии расходов на уголовную юстицию. Под влиянием различных концепций уголовной политики, преобладавших в Веймарской республике, была сделана попытка привести уголовное законодательство в соответствие с веяниями времени и потребностями общества. Перед уголовным правом стояла прежде всего задача защитить общество от преступных посягательств, перевоспитать и ресоциализировать преступника. Уголовное законодательство также претерпевало ряд изменений, связанных с идеями и принципами, сформированными уголовно-правовой наукой того времени, которая опиралась на криминологические и социологические исследования в области преступления и наказания. Споры и дискуссии, принятые законодательные решения, разработки в области уголовной политики, безусловно, повлияли на становление и развитие уголовно-политических стратегий страны, стали основой формирования современной концепции уголовной политики Германии. После установления национал-социалистического режима постепенно снижается роль превенции и ресоциализации преступника как функций уголовного права, наказание становится, прежде всего, карой, правопорядок обеспечивается через устрашение граждан. Ретроспективный анализ уголовной политики Германской империи, Веймарской республики и национал-социалистического режима показывает, насколько быстро можно перейти от либерального мышления к репрессивному регулированию всех сфер человеческой жизни. В статье рассмотрены те изменения в немецком уголовном законодательстве, напрямую связанные с новыми приоритетами уголовной политики государства. Исследование указанных изменений направлено на выявление непосредственной зависимости уголовного права от внутренней и внешней политики правящих кругов, от навязанной и господствующей в социуме идеологии. ; The historical analysis of the German criminal policy from the end of the 19th century to the middle of the 20th century presents a significant interest. This is the period when criminal policy was being formed, with clear-cut identification of its content, aims and objectives. The development of the concept and functions of criminal politics got acute with the attempts of establishing a democratic constitutional state in period of the Weimar Republic. The necessity was expressed in reforming criminal legislation to alter paradigms, rejecting excessive repression, harmonizing and softening the legislation and cutting costs of the criminal justice. Criminal law experiences alterations due to the ideas and principles established by the then criminal law science which relied on criminological and social research of crime and punishment. With the establishment of national socialistic regime in 1930s the role of prevention as a function of criminal law starts to decrease significantly, and law and order is ensuring by threatening citizens. The retrospective analysis of criminal politics in the German Empire, Weimar Republic and national socialistic regime (Third Empire) shows the transmission from liberal frame of mind to repressive regulation of all spheres of human life. The paper features the alterations in the German criminal law related to the proprieties of criminal politics. The research of the changes aims to find the correlation of the dependence of criminal law from internal and foreign policy of ruling strata and the imposed in society ideology.

Evidence itself is the main content of criminal procedure in both the pre-trial investigation and in the judicial stages of criminal proceedings in most countries.The authors note that the Constitution of Ukraine as one of the main principles of justice provides for adversarial parties and freedom in providing the court with their evidence and proving their persuasiveness before the court. Factor The Criminal Procedure Code of Ukraine has significantly expanded the scope of this principle of the do-mestic criminal process, including in the field of evidence. Thus, the defense, as well as the prosecution, was given the opportunity to collect evidence during the pre-trial investigation, as a result of which the right of the parties and other participants in criminal proceedings to submit evidence (things and documents) is becoming increasingly important.The article also examines that the principles of criminal procedure in France include: the principle of formality, prosecution, legality, equality, dignity, protection of the victim, urgency of the trial, presumption of innocence, publicity, oral and adversarial proceedings. And the main principles of the criminal process in Germany include: the principle of formality (publicity); the principle of charge; the principle of legality and the principle of compulsory research. A characteristic feature of modern law in the field of criminal procedure in the United States is the consis-tent expansion of the institution of delegated legislation. The US Congress has delegated to the Supreme Court the right to establish rules of criminal procedure that have the force of federal law. ; Одним із завдань кримінального провадження передбачає захист особи, суспільства та держави від кри-мінальних правопорушень, досягнення якого здійснюється через реалізацію інших завдань, зокрема, шля-хом забезпечення швидкого, повного та неупередженого розслідування і судового розгляду. Досліджується стан економічної злочинності в Україні на основі SWOT- та PESTEL-аналізів при визначенні її як загрози економічній безпеці України, а також використання цих аналітичних методик для визначення шляхів протидії економічній злочинності та руйнування кримінальної інфраструктури органом, уповноваженим здійснювати протидію таким проявам. ; The article examines the state of economic crime in Ukraine based on SWOT and PESTEL analysis when determining economic crimes as a threat to the economic security of Ukraine as well as using these analytical methods to identify the ways of combating economic crimes and destruction of criminal infrastructure.It is determined that the SWOT analysis is a process of establishing the links between the most common for the system, including law enforcement one, opportunities, threats, strengths (advantages), weaknesses, the results of which can be later used to formulate and choose the strategies of the activities. The SWOT analysis is carried out to study the possibility of the impact of a law enforcement agency as a part of law enforcement system on particular criminal environment. SWOT analysis is a kind of tool which does not contain the ultimate information on decision-making, but allows to organize the process of consideration of all available information using their own opinions and estimates.SWOT analysis makes it possible to form a common range of strategies for combating crime in accordance with their features – mutual influences of a law enforcement agency and criminal environment. Wide application and development of the SWOT analysis is explained by the fact that strategic management is associated with large volumes of information which should be collected, processed, analyzed, used, and, therefore, there is a need to find, develop and apply the methods of such work.The essence of PESTEL analysis is to identify and assess the impact of macro factors on the results of current and future activities of the authorized body to counter criminal activity in the economy.The purpose of the PESTEL analysis is tracking (monitoring) the changes of macro environment on key areas and identifying the trends, events which are outside the control of the body, but still have an influence over strategic decisions on ensuring economic security and combating economic crimes.The political factor of the external environmental is studied primarily in order to have a clear idea of the intentions of the government to carry out reforms in the fiscal, legal and judicial systems, political will to fight corruption and of the means by which the state assumes to implement its policy.The analysis of the economic aspect of the external environment allows us to understand how economic resources are generated and distributed on the state level as well as state fiscal policy, the state of economic crisis, income and savings of the population, the existence and nature of the government programs to support entrepreneurship, the tools of influence on enterprises, regulation measures, business support (existing exemptions and subsidies), the prevalence of prohibitive principles of economic regulation on stimulating ones, redistribution of property and others.The study of the social component of the external environment is aimed at understanding and assessing the impact of such social phenomena as poverty, people's trust in the authorities, in particular law enforcement agencies, migration, people's opinion regarding anti-social behavior and others on the system of combating crime.The analysis of the technological component allows to foresee the opportunities associated with the development of science and technology, timely adapt to the dynamic criminal environment and fast upgrading of their own information technology resources, learn quickly the achievements of different sciences and industries by combining the efforts of specialists in various disciplines, competencies, know-how implementation in the management and organization and others.The analysis of the legal component allows to provide the opportunities associated with the changes in current legislation or those that exclude the systemic approaches for its formation; eliminate artificial gaps that make it impossible to conduct an effective investigation and bring the perpetrators to justice; implement innovative approaches to ensure criminal and legal protection of public relations and others.The analysis of environmental component allows to determine the environmental problems in the region, the possibility of specific production in a particular region, a system of direct administrative restrictions that limit the development of environmentally hazardous industries, and in some cases, their closure and others. ; Исследуется состояние экономической преступности в Украине на основе SWOT- и PESTEL-анализов при определении ее как угрозы экономической безопасности Украины, а также использование данных аналитических методик для определения путей противодействия экономической преступности и разрушения криминальной инфраструктуры органом, уполномоченным осуществлять такое противодействие.

В рамках данной статьи раскрывается содержание дополнительных признаков специальных субъектов составов преступлений, предусмотренных статьей 328 Уголовного кодекса РФ. Формулируется их понятие с целью правильной квалификации в правоприменительной практике. Рассматривается проблема призыва на военную службу и направления на альтернативную гражданскую службу граждан РФ, осужденных по указанной статье, вне зависимости от наличия у них судимости. Указывается на необходимость закрепления в законе «О воинской обязанности и военной службе» соответствующего положения. ; In the article the content of the additional features of the special subjects of the bodies of crimes stipulated by Article 328 of the Criminal Code of the Russian Federation is revealed. Their notion with the purpose of right classification in law-enforcement practice is formulated. The problem of conscription and assigning to alternative civilian service of the citizens of the Russian Federation convicted according to the mentioned article regardless of the presence of previous conviction is considered. The necessity to fix an appropriate proposition in the law "On Military Obligation and Military Service" is pointed out.

This paper provides an overview of animal rights legislation in Latin America. The purpose of this paper is to clarify existing standards and concepts in the matter as well as highlighting pending issues. Therefore, in order to start this discussion, it's necessary to describe the current status of the legislation in the subject and the position of Latin countries regarding the principle of equality before the law and animal consecration. ; El presente artículo, sintetiza el reconocimiento de los derechos animales en la legislación latinoamericana, con el objeto de precisar los estándares existentes, los conceptos validados por el derecho y los temas pendientes en la materia. Para iniciar la discusión respecto a la procedencia de nuevos sujetos de derecho, es necesario conocer el estado actual y la postura normativa de los países respecto al principio de igualdad ante la ley y la consagración animal.
