The recent publication of Law 3/2014, of 27 of March, by which the recast of the General Law for the Defense of the Consumers and Users is modified and other complementary laws, approved by Real Legislative Decree 1/2007, of 16 of November has meant the transposition to our national right. The Directive 2011/83/UE of the European Parliament and the Council, of 25 of October of 2011, on the rights of consumer, by which the Directive 93/13/CEE of the Council and the Directive 1999/44/CE of the European Parliament and the Council and the Directive 85/577/CEE of the Council and the Directive 97/7/CE of the European Parliament and the Council are been modified, has supposed an impulse to the protection of the European consumers and users and to the consolidation of the domestic market providing both the consumers and the entrepreneur with a greater legal security. It pretends to walk towards the complete harmonization of the domestic legal system of the States and for this reason it has introduced substantial modifications in the matter of contracts with the consumer and users, it has abolished the norm relative to celebrated contracts at a distance contracts and off –premises contracts and certain aspects of the sale and the guarantees of the consumer goods, with a broader regulation of the right of withdrawal. ; La reciente publicación de la Ley 3/2014, de 27 de marzo, por la que se modifica el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, aprobado por el Real Decreto Legislativo 1/2007, de 16 de noviembre ha supuesto la trasposición a nuestro derecho interno de la Directiva 2011/83/UE. La Directiva 2011/83/UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2011, sobre los derechos de los consumidores, por la que se modifican la Directiva 93/13/CEE del Consejo y la Directiva 1999/44/CE del Parlamento Europeo y del Consejo y por la que se derogan la Directiva 85/577/CEE del Consejo y la Directiva 97/7/CE del Parlamento Europeo y del Consejo ha supuesto el impulso a la protección de los consumidores y usuarios europeos y a la consolidación del mercado interior dotando tanto a los consumidores como a los empresarios de una mayor seguridad jurídica. El Nuevo Código Civil y Comercial de la Nación ha receptado el cambio de paradigma social imperante, produciendo así la constitucionalización del derecho privado. En este sentido, para efectivizar el derecho a la tutela judicial efectiva, trae un sistema simplificado en la defensa de las relaciones de poder que se ajusta más a las necesidades de la seguridad jurídica. El régimen de las acciones posesorias dual con el que los operadores jurídicos contábamos hasta la sanción del nuevo código generaba incontables debates en la doctrina, sumándole a aquel engorroso sistema la existencia de los interdictos procesales. El Nuevo Código Civil y Comercial viene a simplificar y mejorar el régimen, siendo una deuda legislativa su recepción en los Códigos Procesales Provinciales. ; The New Civil and Commercial Code of the Argentine Republic has concealed the change in the prevailing social paradigm, causing the constitutionalization of Private Law. In this sense, in order to make the right to effective judicial protection more efficient, the Code provides a simplified system of defense of actual and constructive possession over property, which is more adequate to the needs of legal certainty. The dual regime of possessory actions, which was applicable until the enforcement of the new code, provoked multiple debates in legal theory. Furthermore, the existence of injunctions made this system even more tedious. При множестве международных и межгосударственных соглашений в сфере борьбы с преступностью отсутствуют специальные документы, посвященные ОРД. Соответствующие нормы включены в договоры и конвенции более общего плана (противодействие определенной категории преступлений; правовая помощь по уголовным делам). Критически оцениваются положения отдельных межведомственных и межгосударственных соглашений, высказываются предложения по их совершенствованию. Пробелом остаются вопросы взаимодействия подразделений, осуществляющих ОРД, с аналогичными структурами иностранных государств, а также с международными правоохранительными организациями. В качестве зарубежного опыта приведен пример законодательного регулирования ОРД в Республике Казахстан, которым автор предлагает воспользоваться другим государствам членам Организации Договора о коллективной безопасности. Подчеркивается, что на основе международно-правовых документов действуют Национальное центральное бюро Интерпола МВД России, Антитеррористический центр государств участников СНГ, Бюро по координации борьбы с организованной преступностью и иными видами опасных преступлений на территории государств участников СНГ, выполняющие важные функции в сфере межгосударственного взаимодействия по борьбе с преступностью, в том числе с ее организованными формами. Подчеркивается необходимость законодательно закрепить полномочия правоохранительных органов по осуществлению негласного контроля за поведением иностранных граждан в период их пребывания на территории России, а также предусмотреть общую правовую возможность проведения оперативно-розыскных мероприятий, не ограничивающих конституционные права и свободы, в отношении всех прибывающих в Российскую Федерацию иностранцев. Предлагается дальнейшая детализация законодательных предписаний, регламентирующих ОРД, в ведомственных нормативных правовых актах в целях соблюдения требований защиты государственной тайны. ; Among many international agreements on fighting crime there are no special documents devoted to the detective activities. Relevant norms are included in general treaties and conventions (on the counteraction to certain categories of crime; legal aid for criminal cases). The provisions of some inter-departmental and interstate agreements are criticized. The proposals on their improvement are made. The issues of cooperation between the divisions, conducting detective activities, analogous foreign organizations and international law enforcement agencies, remain unresolved. The legislative regulation of the detective activities in Kazakhstan is considered. It's recommended to other member states of the Collective Security Treaty Organization to use this foreign experience. Such organizations as the Russian National Central Bureau of Interpol, the Counterterrorism Centre of the CIS Member States, Bureau for Coordination of Fight Against Organized Crime and Other Types of Dangerous Crimes on the Territory of the CIS Member States, performing important functions in the sphere of international cooperation in fighting crime (including organized crime), act basing on the international legal agreements. The author proves the necessity to fix the powers of law enforcement agencies to exercise undercover control over the behaviour of foreign individuals during their staying on the Russian territory, as well as to provide legal possibility for conducting detective actions (not limiting the constitu tional rights and freedoms) with respect to all the foreign citizens arriving in Russia. Further specification of the legislative prescriptions, regulating the detective activities, in departmental normative acts in order to comply with the state secret security requirements, is proposed.

The ban on State aid as laid down by Article 107 (1) TFEU requires any advantage to be selective, meaning that it must be granted to only certain undertakings or to the production of certain goods. The jurisprudence of the European courts on this notion has been anything but coherent and straightforward in recent times. In 2001 the European Court of Justice accepted in its famous Adria-Wien ruling a so-called objectives-based approach, meaning that a Member State is justified to pursue different policies, such as environmental, social, or other objectives, without necessarily rendering a given measure materially selective. The General Court in two judgments handed down some years later built on this precedent and enlarged (to a considerable) extent the freedom enjoyed by Member States to pursue such objectives without falling under the State aid prohibition. In a more recent ruling the Court of Justice set aside one of those decisions, basing its conclusions on the premiss that the ban on State aid is purely effects-based. The analysis provided in this article takes this trias of rulings from the Luxemburg courts as the starting point to perform two main tasks. First, it looks into whether the objectives-based approach initiated by Adria-Wien can still be regarded as "good law". Second, it then aims to present its own solution for exiting the current status of legal uncertainty and in this has, hopefully, struck an equitable balance between the goal of State aid to prevent distortions of competition and a sensible degree of freedom to be enjoyed by Member States to pursue (legitimate) goals of policy without any need to justify them in terms of State aid control.

Анализируются изменения, внесенные в Уголовный кодекс Российской Федерации Федеральным законом «О внесении изменений в статью 148 и отдельные законодательные акты Российской Федерации в целях противодействия оскорблению религиозных убеждений и чувств граждан» в связи с нашумевшим делом «Пусси Райот». Исследуются дефекты редакции статьи, дается разъяснение оценочных категорий, объясняется несоответствие отдельных ее положений правилам логики и юридической техники, обосновывается необходимость изменения формулировки нормы. Указывается на отсутствие в российском законодательстве федерального уровня определений понятий, необходимых для адекватного и справедливого нормативно-правового регулирования отношений, связанных с религиозной сферой человеческой деятельности. Предлагаются авторские определения понятий «публичность», «религиозное учение», «верующие», «религиозные чувства», «оскорбление религиозных чувств верующих». Говорится о необходимости совершения деяния с прямым умыслом и определенной целью, а именно посредством «оскорбления религиозных чувств верующих», поясняются сложности, связанные с наличием оценочных, не разъясненных категорий, которые неизбежно должны возникнуть в деятельности правоохранительных органов (следствия, прокуратуры, суда) при установлении наличия или отсутствия данной цели для объективного, полного и беспристрастного расследования, рассмотрения уголовного дела, а также вынесения законного, обоснованного и справедливого судебного решения. Предлагается новая редакция рассматриваемой статьи, устанавливающей уголовную ответственность за нарушение законодательства о свободе совести и вероисповеданий в виде воспрепятствования законным формам реализации права на свободу совести и вероисповеданий и нарушения положений законодательства об отделении религиозных организаций от государства. ; The changes made to the RF Criminal Code by the Federal law "On amendments to article 148 and certain legislative acts of the RF to counter insulting religious beliefs and feelings of citizens" in connection with "Pussy Riot" case are analyzed. The defects of the article's wording are studied, evaluation categories are explained, discrepancy between its individual provisions and the rules of logic and legal technique is analyzed, the need to change the wording of the norm is proved. The author indicates the lack of definitions of the concepts necessary for an adequate and fair legal regulation of relations connected with the religious sphere of human activity in the Russian federal legislation. The author's definitions of "publicity", "religious doctrine", "believers", "religious feelings", "insulting religious feelings of believers" are proposed. The necessity of committing the act with deliberate intent, namely, by "insulting religious feelings of believers" is described. The author analyzes the difficulties connected with evaluation categories (which aren't explained) that should inevitably arise in law enforcement agencies' activities (investigation, prosecution, court) when establishing the presence or absence of such intent for the objective, complete and impartial investigation of the criminal case and criminal proceedings, as well as passing a lawful, reasoned and fair court decision. A new wording of the considered article, establishing criminal liability for violation of legislation on freedom of conscience and religion by preventing legal forms of realization of the right to freedom of conscience and religion, as well as on separation of religious organizations from the state, is proposed.

Проведено сравнительно-правовое исследование российского и нидерландского законодательства в области культивирования наркосодержащих растений. Сопоставлены правовые последствия совершения на территории Королевства Нидерландов деяния, аналогичного деянию, предусмотренному ст. 231 УК РФ, показано сходство и различие отечественного и зарубежного подходов к вопросу. Сравнение составов преступлений, закрепленных ст. 231 УК РФ и частично ст.ст. 2 и 3 Опиумного закона Нидерландов, позволило сделать следующие выводы: 1) объективная сторона состава преступления, предусмотренного ст. 231 УК РФ, описывает исключительно культивирование растений, содержащих наркотические средства, психотропные вещества либо их прекурсоры. Согласно нидерландскому Опиумному закону культивирование является одним из возможных способов совершения незаконного оборота наркотиков; 2) в нидерландском праве предусмотрена ответственность за совершение двух преступлений, характеризующихся одинаковыми объективными сторонами составов преступлений и различающихся по предмету (какие именно наркотические вещества содержатся в выращиваемых растениях). Для квалификации деяния по ст. 231 УК РФ это не имеет значения; 3) общий принцип регулирования общественных отношений, являющихся объектом данного преступления, един для обеих правовых систем: деятельность по культивированию таких растений потенциально опасна, поэтому нуждается в особом регулировании. Для ее осуществления в научных, учебных, медицинских и других целях необходимо получить специальное разрешение либо лицензию, предусматривающие, какие именно растения, для каких именно целей, на каких условиях можно культивировать. Нарушение правил получения такого разрешения (лицензии) или нарушение ограничений, указанных в разрешении (лицензии), является преступным. ; The comparative legal study of the Russian and the Dutch legislation in the field of narcotic plants cultivation is provided. The legal responsibility for committing related crime in the Netherlands being analogous to an act stipulated by the Article 231 of the RF Criminal Code is analyzed. Similarities and differences of Russian and Dutch approaches to this legislative issue are shown. Basing on comparison of the elements of crime provided by the Article 231 of the RF Criminal Code and partially by the Articles 2 and 3 of the Dutch Opium Act some conclusions are made, notably: 1) the objective side of the elements of crime, provided by the Article 231 of the RF Criminal Code, implies only cultivation of plants containing narcotic drugs, psychotropic substances and their precursors. The Dutch Opium Law considers cultivation as one of possible means for conducting drug trafficking; 2) the Dutch Law provides criminal responsibility for committing two crimes characterized by similar objective sides of the elements of crimes as well as by different subject (what kinds of narcotic drugs are contained in cultivated plants). It is of no importance in the Russian legislation; 3) both legal systems have general principle of regulating public relation being an object of this crime: narcotic plants cultivation activity is dangerous and needs specific regulation. Conducting such activity for educational and medical purposes requires special permission/license specifying types of plants, purposes and terms of cultivation. Violating the rules of obtaining such permission/license or its restrictions is punishable.

Борьба с организованными преступными группами и контроль за их развитием и лицами, которые являются ячейкой организованной преступности и всей ее инфраструктуры, признанная приоритетным направлением борьбы с преступностью Особенную опасность для общества представляет деятельность организованных преступных групп, которая заключается не в количестве краж, грабежей, вымоганий, а в объединении преступных групп в преступные организации, которые посягают на органы управления и власти, заражают их коррумпированностью, влияют на состояние общества, их растущие масштабы негативно отражаются на экономическом процессе развития государства, демократизации и общественной жизни страны. На протяжении последних десятилетий отсутствие эффективной законодательной базы для борьбы с организованной преступной деятельностью и даже четкого, пригодного для работы правоохранительных органов определения организованной преступности и групповых образований, которые принадлежат к ее структуре, обусловили низкий уровень противостояния этому виду преступности. В этой сфере наше государство значительно отстает от стран, в которых борьба с организованной преступностью длится уже десятки лет и основывается на четких законодательных нормах. ; The stages of origin and development of criminal group that develops constantly are investigated, her quantitative and quality descriptions change, and not only under one-sided influence of changes of social environment but also in co-operating with him. In criminal groups their leaders constantly support a corresponding microclimate with the purpose of permanent feasance by them particular criminal acts. Fight against the organized criminal groups and control after their development and persons that are the cell of the organized crime and all her infrastructure, confessed by priority direction of fight against criminality The special danger for society is presented by activity of the organized criminal groups, that consists not in an amount thefts, robberies, shakedowns, and in the association of criminal groups in criminal organizations, that trench upon the organs of management and power, infect them corrupted, influence on the state of society, their growing scales negatively affect economic process of development of the state, democratization and public life of country. During the last decades absence of effective legislative base for a fight against the organized criminal activity and even clear, suitable for work of law enforcement authorities determinations of the organized crime and group educations, that belong to her structure, stipulated the low level of opposition to this type of criminality. In this sphere our state considerably falls behind from countries in that a fight against the organized crime lasts already ten of years and is base on clear legislative norms. Organized crime of group, it is confessed by a world concord, carry out legalization (washing) of the profits got a criminal way, that became a global threat to economic and political security to society. At the same time, in connection with active development of the banking system, technological improvement of realization of financial operations, there is a presence of criminal transnational organizations, that use the world banking system for financing of terrorism and investment of «dirty» money in a world economy that causes the origin of the system of threats for the financial markets of Ukraine.

Investigated regulatory framework review and approval of the Law on State Budget of Ukraine for the plan year, taking into account recent changes in legislation in the public sector. Analyzed by a special procedure under which the Verkhovna Rada of Ukraine considers this question. Highlighted the characteristics of the Law on State Budget of Ukraine, which distinguish it from other laws in the state. This article assesses how legal institutions affect the influence of politically active criminal organisations on the human capital of elected politicians using data from over 1,500 Southern Italian municipalities in the period 1985-2011. It exploits municipal government dissolutions imposed by the national government for (presumed) mafia infiltration as a source of exogenous variation in the presence of politically active criminal organisations. The results support theoretical predictions that the average education level of local politicians significantly increases when active mafia infiltration of local politics is remedied through the implementation of a stricter legal-institutional framework.
