Internet Content Governance and Human Rights
The Internet has become an essential tool for various life-related purposes, and it is an instrument necessary for the proper enjoyment of a series of rights-including the right to access knowledge and information and the right to communicate. This new paradigm also implies that all people should have access to the Internet at affordable conditions, and any restrictions should be strictly limited and proportionate. As a consequence, any regulatory and policy measures that affect the Internet and the content that flows over it should be consistent with basic rights and liberties of human beings. This Article intends to explore the challenges and opportunities for freedom of speech and human rights on the Internet. In particular, it examines how Internet content governance is posing provocative and fascinating regulatory issues directly related to the growing possibilities offered by computer-mediated communication. This debate is not simply "technical," but also political, legal, and social since it involves sustainable and value-oriented solutions, but also--more importantly--the awareness of the human-rights dimension of Internet governance. The possible answers to these issues are at the center of the ongoing discussion concerning the regulation of digital content and communication technologies. Finally, drawing upon comparative and case-study material, this Article analyses the functional relationship between modern communication technologies, legislative reforms in the area of digital communications, and constitutional freedoms.

"Die beschriebenen Regulierungsverfahren - insbesondere das Fallbeispiel ICANN - zeigen, dass es möglich ist, Internet-Koregulierung global zu implementieren. Gleichzeitig werden bei der Legitimierung ICANNs noch große Schwächen deutlich. Überträgt man das ICANN-Prinzip auf andere Institutionen, dann müssen bestimmte grundlegende Konstruktionsmerkmale gewährleistet sein: die unmissverständliche und trennscharfe Formulierung ihrer Aufgabe; eine dafür ausreichende Handlungsreichweite; angemessene und transparente Arbeitsabläufe; die angemessene Integration und Repräsentation der Betroffenen; die Bereitstellung der notwendigen Freiräume zur öffentlichen Debatte; und die Schaffung geeigneter Berichts- und Rechenschaftspflichten. Es ist dabei nicht zwingend notwendig, dass alle Regulierungsfragen in der Hand einer Institution oder einer zusammenhängenden 'Reguliererfamilie' liegen. Der Vorteil der Problemlösung im Internet besteht gerade darin, dass es zwar ohne weiteres denkbar ist, das Mandat einer Organisation wie ICANN auf verwandte Themen auszuweiten - gleichermaßen denkbar ist es allerdings, dass andere Regulierungsgegenstände auch anders geartete Organisation und eine andere institutionelle Struktur mit sich bringen. Die Möglichkeit der sachorientierten Flexibilität ist eine der großen Stärken global ausgerichteter Internet-Koregulierung. Ähnlich wie das Experiment ICANN die globale Diskussion zu einem relevanten Einzelthema zumindest angeregt hat, muss es auch hinsichtlich der anderen Themen sowie der grundlegenden Regelungsprinzipien für die Internet-Regulierung einen öffentlichen Raum geben, in dem die Diskussion zu den konstituierenden Fragen des globalen Kommunikationsmediums Internet stattfinden kann. Versucht man, diese einzelnen Regelungsgegenstände voneinander unabhängig institutionell wie organisatorisch zu verankern, so übersieht man, wie stark all diese Themen voneinander abhängen. Das Internet kann in diesem Zusammenhang zur Bildung einer globalen, sachgebildeten Öffentlichkeit beitragen. Das Netz ist nicht nur Regulierungsgegenstand, sondern gleichzeitig Kommunikationsinstrument, über das Regulierungsfragen behandelt werden können. Wie aus diesen unterschiedlichen Koregulierungsbeispielen deutlich wird, kann ein Regulierungsund Regelungswettbewerb stattfinden, mit dem das Gesamtsystem der Internet-Regulierung permanent verbessert wird. Das Internet ist ein durch und durch dezentrales System - diese Dezentralität auch auf die Regelung der einzelnen Problembereiche zu übertragen, bedeutet, einen produktiven Pluralismus von Regulierungsstrukturen zu schaffen, wie er auf nationaler Ebene bislang kaum möglich war." Uncertainty, perception and the Internet
Macroeconomic uncertainty consists of three components: the unobservable, the heterogeneous and the "uncertain". We are unaware of exactly when economic agents perceive uncertainty and which type of uncertainty interests them. This paper introduces and outlines a way of conducting large-scale data searches on the Web. We create the EURQ index of "economic uncertainty related queries" for both the USA and Italy. We show that the EURQ encapsulates agents' need to gather more information during periods of uncertainty. This need either spontaneously arises in the case of macro-real and political uncertainty, or is induced by the media in the case of normative and financial uncertainty. This distinction is extremely important when trying to understand the immediate impact of fiscal policy uncertainty on economic variables, and how financial shocks can produce a significant short-term impact on economic activity. It is also helpful when trying to solve the identification and endogeneity issues encountered in the literature when assessing the role of uncertainty.
