The aim of this paper is to analyze the political implications posed by the consolidation of the contemporary crime theory from a perspective that includes the study of the penalty as a result of power technologies. From genealogical tools provided by the work of Zaffaroni around the emergence of criminal law, some cultural overtones involved in the everyday life of penal power, so that from the criminological analysis of the work of Christie on man images in criminal law, explain the tensions and effects aroused in contemporary penal theory. In that sense, this documentary research, which represents a qualitative approach, involves providing tools for understanding and explanation of the social effects of systematic crime; that is, an analysis that is articulated within the framework of the penalty sociology, reviewing the constituent uses of the criminal legal knowledge. ; El objetivo de este trabajo es analizar las implicaciones políticas que supone la consolidación de la teoría del delito contemporánea desde una perspectiva que comprende el estudio de la penalidad como efecto de las tecnologías de poder. A partir de las herramientas genealógicas que aporta la obra de Zaffaroni en torno a la emergencia del derecho penal, se expondrán algunos matices culturales que supone la cotidianidad del poder penal, para así, desde el análisis criminológico de la obra de Christie sobre las imágenes del hombre en el derecho penal, explicar las tensiones y efectos que suscita en la teoría penal contemporánea. En ese sentido, esta investigación documental, la cual supone un enfoque cualitativo, implica brindar herramientas para la comprensión y explicación de los efectos sociales de la sistemática del delito; es decir, un análisis que se articula dentro de los marcos de la sociología de la penalidad, revisando los usos constitutivos del saber jurídico-penal.

Auf neuem Stand Die Neuauflage berücksichtigt die aktuelle Rechtsentwicklung im Bereich der Betriebsprüfung und Steuerfahndung. Ein Schwerpunkt der Überarbeitung ist ein neues Kapitel zur Einführung von innerbetrieblichen Kontrollsystemen (Tax Compliance), mit deren Hilfe latente steuerstrafrechtliche Risiken auf ein Minimum reduziert werden können. Ein weiterer Schwerpunkt sind die Neuregelungen zur Vermögensabschöpfung im Steuerstrafrecht, wobei hier die unternehmerischen Risiken wegen der ausufernden Verjährungsregelungen kaum noch zu kalkulieren sind. This socio-legal study of town and country planning draws upon the examples of the Israeli system and its predecessor of Mandatory Palestine, and studies them in the light of the British parent system. The underlying thesis is that statutory planning functions as a special component in a complex system of social control. Beyond its immediate concern with regulating the utilisation of the physical environment, statutory planning is designed and implemented with the aim of supporting the prevailing social order. The application to statutory planning systems of the concept of social control - which elucidates the regulation of behaviour in society and the phenomenon of social order - leads to the identification of three inter-related roles. These can be classified loosely as: 1) political role, to serve as a tool for effective government; 2) economic role, to utilise scarce resources efficiently; 3) social role, to advance human welfare. Their cumulative exercise contributes to the maintenance of the prevailing social order. This analysis shows that the social order throughout the history of Palestine and Israel. 1917-1980's was in constant flux. It is claimed that the Mandatory system, motivated by colonial ideology, attached excessive importance to statutory planning's political role in order to establish the authority of the British government over Palestine's rival communities. Planning's economic and social roles were relegated to secondary importance. During the Israeli system's formative stage, this political role, which suited the prevailing perception of representative democracy, was important in establishing and legitimising the new government. However, the social and economic roles were of paramount importance due to the prevailing ideology of collectivism. This led to a unique process of social engineering through physical planning. The current Israeli system reflects some new trends towards participatory democracy in planning organisation and individualism in the planning process and provisions, and a move away from narrow physical land use perceptions towards an integrated physical-economic-social outlook. Nevertheless, the basic principles of the early 1920's can Still be seen in the system of the 1980's.

Ever since the creation of the General Court ("GC"), the effectiveness of judicial review in European Union ("EU") competition cases has sparked intense scholarly debates. This paper seeks to further contribute to this discussion in three ways. First, it devotes some space to fundamental, yet often overlooked questions, such as the goals or functions of judicial review and why judicial review of administrative decisions is important; particularly so in competition law matters. Second, this paper attempts to throw some empirical light on the GC's judicial review of European Commission ("Commission") decisions in the field of competition law. Third, it places a specific emphasis on the particular situation of abuse of dominance law, where the GC has exercised its judicial review power with more restraint than in other areas of competition law (such as restrictive agreements and mergers). With these goals in mind, this paper follows a five-stage progression. First, on the basis of a survey of the relevant legal, economic and political science literature, it defines the functions of judicial review and identifies a set of indicators which can be used to assess the performance of the GC's judicial scrutiny (Part I). Second, it explains why judicial review in EU competition law cases is of critical importance notably given the institutional and procedural deficiencies of the EU enforcement structure (Part II). Third, it discusses the nature and standard of review currently applied by the GC with a particular focus on the degree to which the GC is willing to review "complex economic matters" (Part III). Fourth, it provides some quantitative data on the case-law of the GC to assess whether several goals or functions attributed to judicial review by the scientific literature are met (Part IV). Finally, this paper takes a closer look at the (controversial) case-law of the GC in the field of Article 102 of the Treaty on the Functioning of the European Union ("TFEU") (Part V).

This article makes a political-criminal analysis of criminal law as ultima ratio, with a criminal procedural approach in relation to the abbreviated criminal procedural; this is achieved thanks to a general study on the theory of ´Legally protected interest´ that is grounded in the specific problematic of the formation of laws. In addition, it examines the antecedents of the incorporation of the abbreviated procedure and the private accuser to the Colombian Constitution and Law, for which purpose - and from a utilitarian perspective - it makes a comparative analysis of the national regulations with the Spanish and Chilean legislations. ; Este trabajo hace un análisis político-criminal del derecho penal como ultima ratio, con un enfoque procesal penal en lo atinente al rito penal abreviado; ello se logra gracias a un estudio general sobre la teoría del bien jurídico que se aterriza a la problemática específica de la formación de las leyes. Además, examina los antecedentes de la incorporación del procedimiento abreviado y el acusador privado a la Constitución y a la ley colombianas, a cuyo efecto –y a partir de una óptica utilitarista– hace un análisis comparado de la normativa nacional con las legislaciones española y chilena.

Анализируются последние законодательные изменения ст. 171 УК РФ «Незаконное предпринимательство». Внесенные в диспозицию данной статьи изменения связаны с повышением эффективности борьбы с незаконным предпринимательством уголовно-правовыми мерами. Между тем, эта проблематика не перестала быть актуальной, ведь результативное применение позволяет сдерживать незаконную предпринимательскую деятельность уже на ранней стадии и обуславливает более высокую степень предупредительного эффекта при совершении преступлений. Проводится анализ некоторых точек зрения на совершенствование уголовного законодательства, предусматривающего ответственность за незаконное предпринимательство. Рассмотрены специальные основания освобождения от уголовной ответственности за преступление, предусмотренное ст. 171 УК РФ. ; The author analyzes the latest changes in Art. 171 of the Criminal Code of the Russian Federation "Illegal Entrepreneurship". Changes introduced into this Article's disposition aim at enhancing the efficiency of fighting illegal entrepreneurship through criminal law measures. Meanwhile this problem remains topical as effective enforcement of the law allows to restrain illegal entrepreneurship already at an early stage and offers a higher degree of crime prevention. The author analyzes some opinions regarding the improvement of criminal legislation that stipulates liability for illegal entrepreneurship. The author also examines special grounds for exemption from criminal liability for the crime stipulated by Art. 171 of the Criminal Code of the Russian Federation.
