Die wettbewerbsrechtliche Schadensersatzrichtlinie hat in der Literatur viel Aufmerksamkeit erhalten. Vernachlässigt wurden indes die Regelungen zu Gesamtschuld und Regress. Und das obwohl – oder vielleicht gerade weil – die Richtlinie mit ihrem Art. 11 und Art. 19 in vielerlei Hinsicht rechtliches Neuland betritt: Zwar kannten die Mitgliedstaaten der Union bereits zuvor die gesamtschuldnerische Haftung und den anschließenden Innenausgleich mehrerer gemeinsamer Rechtsverletzer. Gänzlich neu sind jedoch Ausnahmeregelungen für Kronzeugen, KMU (kleine und mittlere Unternehmen) sowie im Anschluss an einen Vergleich. Tabea Bauermeister nimmt sich der Lücke an. Inwiefern wird das von der Richtlinie geregelte Haftungsregime für die Rechtsverletzung den Vorgaben des europäischen Unionsrechts und ihrer eigenen Zielsetzung gerecht? Die Autorin beleuchtet dazu die einzelnen Regelungen der Richtlinie zur Haftung mehrerer Rechtsverletzer sowie ihre Ausnahmen.

Von Patentgemeinschaften spricht man, wenn sich mehrere Patentinhaber vertraglich mit dem Ziel verbinden, gesamte "Pakete" ihrer jeweiligen patentierten Technologien an Dritte zu lizenzieren. Mit Rücksicht auf die ansteigende Relevanz dieser Geschäftsmethode, erörtert diese Arbeit die entscheidenden Züge und die strategischen Überlegungen, die der Gründung von Patentgemeinschaften zugrunde liegen, sowohl in rechtlicher als auch empirischer Hinsicht, um die optimalen Bedingungen zur erfolgreichen Umsetzung in einem wettbewerblichen Umfeld zu identifizieren. Damit sollen die besten Voraussetzungen zur Förderung von Innovation geschaffen werden. In dieser Hinsicht werden zunächst die Zusammensetzung und der Aufbau innerhalb derartiger Gemeinschaften, unter besonderer Berücksichtigung der Natur der beinhalteten Technologien (wie zum Beispiel "complementary" im Gegensatz zu "substitute" Technologien), untersucht. Um die Arbeit um einen rechtsvergleichenden Blickwinkel zu ergänzen, wird außer der Regulierung der Europäischen Union auch die der Vereinigten Staaten von Amerika berücksichtigt

In: Exploring the political in South Asia
The importance of individual politicians and leadership in South Asian politics is easily visible in the functioning of political parties and movements, as well as in media coverage. Yet there is a noticeable paucity of academic work on the subject. This volume, a collection of articles documenting the leadership styles of individual politicians in the region, seeks to address this lack. By exploring such aspects of leadership as symbolic action, rhetorical usage, moral conviction, alliance-building, and modes of distribution, the articles illustrate the opportunities and constraints experienced by the politically ambitious. The spectrum of leadership strategies thus uncovered leads the editors to propose a tripartite arrangement of leader-types most commonly seen in the region: boss, lord and captain. In so doing the volume is able to provide important insight into the nature of South Asian democracies and electoral politics, and explain the relative stability of the body politic of what is a very large and complex socio-economic region. --Book Jacket.
What place does the caste system have in modern India with its globally-integrating market economy? The most influential anthropological approaches to caste have tended to emphasize caste as India's traditional religious and ritual order, or (treating such order as a product of the colonial encounter) as shaped politically, especially today by the dynamics of caste-based electoral politics. Less attention has been paid to caste effects in the economy. This article argues that the scholarly framing of caste mirrors a public policy 'enclosure' of caste in the non-modern realm of religion and 'caste politics', while aligning modernity to the caste-erasing market economy. Village-level fieldwork in south India finds a parallel public narrative of caste either as ritual rank eroded by market relations, or as identity politics deflected from everyday economic life. But locally and nationally the effects of caste are found to be pervasive in labour markets and the business economy. In the age of the market, caste is a resource, sometimes in the form of a network, its opportunity-hoarding advantages discriminating against others. Dalits are not discriminated by caste as a set of relations separate from economy, but by the very economic and market processes through which they often seek liberation. The caste processes, enclosures and evasions in post-liberalization India, suggest the need to rethink the modernity of caste beyond orientalist and postcolonial frameworks, and consider the presuppositions that shape understanding of an institution, the nature and experience of which are determined by the inequalities and subject positions it produces.

В данной статье рассматриваются причины обращения к метатеории в рамках современного знания о политике,а также ее возможные формы. ; The main question of this article is the question of the borders and the princi ples of reflection on politics. Discussion of the possibilities and forms,metatheoretical reflection in the structure of political science cannot be limited to the analysis of the internal logic of knowledge. Because political thought is an integral part of political reality,then the question about the possibility of a metatheory here is inevitably involved in discussions about the nature of politics. This article discusses the reasons to the metatheory within the current knowledge about the policy and its possible forms.
