The introduction highlights the relevance of the study of migration processes in Ukraine and outlines the problematic circle regarding its regulation. The concept of «migration» in the sciences of the humanitarian block is considered. It is revealed that the number of internally displaced persons has increased since the signing of the Association Agreement and the visa-free regime between Ukraine and the EU. Therefore, statistics on the register at the legislative level of IDPs are provided. Basic research and scholars dealing with this social topic are reviewed. Therefore, the purpose of the article was to outline the purpose of the article, namely to clarify a terminological problem between the concepts of refugees, displaced persons or IDPs.The main part states that the annexation of the Autonomous Republic of Crimea by the Russian Federation and the conflict in the Donbass have caused the mass relocation of people for the second time in Ukraine. For the first time, the state encountered this phenomenon during the Chernobyl disaster. A methodological toolkit for regulating the legal status of IDPs is considered. The differences between the concepts of refugees, displaced persons, IDPs are outlined.As a result, a "refugee" is a person who is not a citizen of Ukraine and, because of a well-founded fear of becoming a victim of persecution on grounds of race, religion, nationality, citizenship (nationality), independence of a particular social group or political beliefs outside the country of his / her nationality and may not enjoy the protection of this country, or does not wish to enjoy this protection because of such fears, or without citizenship (nationality) and being outside the country of his former permanent residence, may or may not return to her because of these concerns. «Internally displaced persons» are people or groups of people who have been forced to flee their homes to escape armed conflict, violence or mass human rights abuses. IDPs are persons or groups of persons within the country who have been forced to flee, or who have left their place of permanent residence as a result of or to avoid the effects of military conflict, mass violence, human rights violations, natural or man-made disasters, and who have not crossed the internationally recognized borders of the state. ; Во введении отражена актуальность исследования миграционных процессов в Украине и обозначен проблемный круг по их регулированию. Рассмотрено понятие «миграция» в науках социогуманитарного блока. Установлено, что после подписания Соглашения об ассоциации и безвизовый режим между Украиной и ЕС количество внутренне перемещенных лиц возросло. Поэтому приведены статистические данные касательно реестра на законодательном уровне ВПО. Рассмотрены основные исследования и ученые, занимающиеся этой социальной тематикой. Следовательно, на основе полученной информации была обозначена цель статьи, а именно – выяснение проблемы терминологического характера между понятиями: беженцы, перемещенные лица или ВПО.В основной части указано, что аннексия АР Крым Российской Федерацией и конфликт на Донбассе вызвали уже второй раз для Украины массовое переселение людей. Впервые государство столкнулось с этим явлением во время катастрофы на Чернобыльской АС. Рассмотрен методологический инструментарий по урегулированию правового положения ВПО. Определены различия между понятиями беженец, перемещенные лица, ВПО.Как результат, «беженец» – лицо, не являющееся гражданином Украины и вследствие вполне обоснованных опасений стать жертвой преследований по признаку расы, вероисповедания, национальности, гражданства (подданства), непринадлежности к определенной социальной группе или политических убеждений находится вне страны своей гражданской принадлежности и не может пользоваться защитой этой страны, или не желает пользоваться этой защитой вследствие таких опасений, или, не имея гражданства (подданства) и находясь вне страны своего прежнего постоянного проживания, не может или не желает вернуться в нее вследствие указанных опасений. «Лица, перемещенные внутри страны» – это люди или группы людей, которые были вынуждены покинуть свои дома, чтобы спастись от вооруженных конфликтов, проявлений насилия или массовых нарушений прав человека. «ВПО» – это лица или группы лиц внутри страны, которых заставили спасаться бегством, или покинувшие свое место жительства в результате или во избежание последствий военного конфликта, массового насилия, нарушений прав человека, стихийного или вызванного человеческой деятельностью бедствия, и которые не пересекали международно-признанных границ государства. ; У вступі висвітлено актуальність дослідження міграційних процесів в Україні та окреслено проблемне коло щодо їх регулювання. Розглянуто поняття «міграція» в науках соціогуманітарного блоку. З'ясовано, що після підписання Угоди про асоціацію та безвізовий режим між Україною та ЄС кількість внутрішньо переміщених осіб1 зросла. Відтак, наведено статистичні дані щодо реєстру на законодавчому рівні ВПО. Розглянуто основні дослідження та науковців, які займаються цією соціальною тематикою. Тому на основі отриманої інформації було окреслено мету статті, а саме – з'ясування проблеми термінологічного характеру між поняттями: біженці, переміщені особи чи ВПО. В основній частині зазначено, що анексія АР Крим Російською Федерацією та конфлікт на Донбасі спричинили вже вдруге для України масове переселення людей. Уперше держава стикнулася з цим явищем під час катастрофи на Чорнобильській АС. Розглянуто методологічний інструментарій щодо врегулювання правового становища ВПО. Окреслено відмінності між поняттями біженець, переміщені особи, ВПО.Як результат, «біженець» – особа, яка не є громадянином України і внаслідок цілком обґрунтованих побоювань стати жертвою переслідувань за ознаками раси, віросповідання, національності, громадянства (підданства), неналежності до певної соціальної групи або політичних переконань перебуває за межами країни своєї громадянської належності та не може користуватися захистом цієї країни, або не бажає користуватися цим захистом унаслідок таких побоювань, або, не маючи громадянства (підданства) і перебуваючи за межами країни свого попереднього постійного місця проживання, не може чи не бажає повернутися до неї внаслідок зазначених побоювань. «Особи, переміщені всередині країни» ― це люди чи групи людей, які були вимушені покинути свої домівки, щоб врятуватися від збройних конфліктів, проявів насильства або масових порушень прав людини. «ВПО» – це особи або групи осіб всередині країни, яких змусили рятуватися втечею або які залишили своє місце постійного проживання в результаті або з метою уникнення наслідків воєнного конфлікту, масового насильства, порушень прав людини, стихійного чи викликаного людською діяльністю лиха, та які не перетинали міжнародно-визнаних кордонів держави.

Зазначено, що створення конкурентоспроможного агропродовольчого виробництва неможливо без посилення ролі держави та підтримки аграрного сектора економіки України. Визначено, що необхідність забезпечення продовольчої безпеки, низька конкурентоспроможність і продуктивність галузі, низький рівень оплати праці працівників села тощо є основними причинами держрегулювання сільського господарства. Описано, що нині є виправданим посилення регулюючого впливу з боку держави на розвиток сільської економіки, якнайшвидше впровадження відповідної програми державного регулювання і підтримки цієї важливої галузі. Зауважено, що існує необхідність істотної зміни стратегії і тактики реформ загалом, аграрної реформи зокрема, що пов'язано з посиленням державного регулювання продовольчого ринку, переорієнтацією капіталу з торгових і фінансових галузей на вкладення у виробничу сферу в АПК і залучення іноземних інвестицій. Підсумовано, що у сучасних умовах чітко простежується прагнення законодавця посилити економічні та соціальні функції державного регулювання продовольчого ринку як керованого і регульованого механізму вільного руху сільськогосподарської продукції і товарів, функціонування якого забезпечується єдиними нормами і правилами, які регулюють підприємницьку діяльність суб'єктів продовольчого ринку. ; Problem setting. Problems of state regulation of the agrarian sector in Ukraine are important in connection with the transition to the market. As you know, agriculture is a special industry whose incomes, based on its no monopoly nature, are always lagging behind other industries. In almost all countries, agriculture is one of the most state-supported industries.State regulation is a system of standard measures of legislative, executive and supervisory nature, carried out by authorized state bodies in order to stabilize and adapt the existing socio-economic system to changing conditions.According to experts, stabilization of agriculture in itself cannot occur by itself. Agriculture is able to revive only with active state support. The most widely practiced in the world measures of state support for the ago-industrial complex, grouped according to the target.Recent research and publications analysis. Тhe problem of research on state support for agricultural production involves many scientists, in particular: V. Andrich, V. Boyce, P. Godowsky, B. Krasnik, Y. Luzon, V. Messel-Visalia, O. Mogilny, A. Stelmashchuk, P. Sabluk, G. Cherkovsky and others, who in their works substantiated the need for state support to the agrarian sector, and also proposed ways to improve the system of budget financing of agriculture.Highlighting previously unsettled parts of the general problem. Despite an active study of this problem, it is expedient to justify the need for state support to agriculture, as well as proposals for improving its budget financing system. Theoretical and methodical aspects of the problem of forming the mechanism of state support of the agrarian sphere remain inadequately investigated and require further in-depth study.Paper main body. An important task of state regulation should be to assist agricultural producers in adapting to market conditions, which should be pursued in two main directions:1) assistance in restructuring the production and assisting commodity producers in entering the market; developing a system of social insurance in the countryside and forming innovative business directions;2) improvement of the skills of employees, creation of advisory services.In the first direction, the state, based on the analysis of the market situation, has either to promote, or, conversely, to hold the formation of individual industries. In addition, it is possible to re-profile the enterprises that produce unpredictable (non-profitable) goods in a competitive manner, while compensations may be paid through reduced production volumes. In subsidized regions where surplus production is produced by objective factors, it is necessary to provide subsidies to commodity producers that compensate for the decrease in profits.It is necessary to stimulate the formation of folk crafts, subsidiary farms, the development of tourism, to contribute to the study of unique resources that are in this area. The state is called on to promote the development of market infrastructure necessary for the existence of a market structure, to support the formation of independent intermediary structures, the organization of wholesale trade, in particular the wholesale food markets, the creation of guarantee service systems that operate on market principles, and improve the information infrastructure of the market.Creating an information system is in fact considered a privilege of the state. It is necessary to improve the state financial and analytical service in the agroindustrial complex, which would allow the economic actors of the industry to function most effectively, orienting themselves in the market situation, and as a result – reasonably and thoughtfully act in modern conditions.Regarding the regulation of foreign economic policy it is necessary to increase the number and variety of tariffs, while taking into account the seasonality of production in improving import duties; it is necessary to use special and mixed duties, as well as to raise the level of tariff policy by types of agricultural products and foodstuffs; to establish the import of a sufficient quantity of products that meets the needs of the population; develop a concept and model of a long-term food program; it is necessary to develop state and local programs that will expand the export of agricultural products and agriculture as an important source of investments, which include the system of state support, that is, the system of export credits and subsidies.Conclusions of the research and prospects for further studies. Almost all publications devoted to the problems of agrarian and industrial complex, shows a lot of facts that indicate the regression observed in the industry, the lack of financial resources to solve the problems faced by the ago-industry complex, the almost universal ubiquity of agricultural production, etc.Almost all economists are talking about the earliest need for stabilization of the food situation, and start solving this issue is necessary with the lifting of the ago-industrial complex.However, most of the farms and the state practically do not have the means to solve this problem. Thus, state regulation of the economy in the agricultural sector is understood as a system for collecting economic information and a mechanism for making economic decisions on the basis of its analysis, which includes a mechanism for resolving acute contradictions, the use of public procurement (government procurement), the impact of emissions and various methods lending, planning (certain types of economic activity) and conducting foreign economic policy, social support.

Afforestation is a significant component of the state strategy of environment conservation, rational use and increasing Ukraine's natural resource potential, solving problems of its ecological and food security. Implementation of the afforestation strategy in Ukraine will increase the sustainability of the forest component of agricultural landscapes; significantly reduce soil erosion and degradation processes; preserve and enrich biological and landscape diversity; accelerate the processes of natural restoration of agricultural landscapes; to optimize the forest-meliorate component of ecological and landscape arrangement of agro-landscapes; increase forest cover; ensure filtration and purification of surface runoff from harmful ingredients; improve the ameliorative properties of shelterbelts ; increase crop yields; provide additional carbon sequestration that will mitigate climate changes; to increase the efficiency of state environmental programs implementation. For the successful implementation of strategic tasks at the legislative level, it is necessary: to free the land transferred for afforestation from paying compensation for losses to the local budget, and to land users from paying tax on the land if it is conserved for environmental use; provide for compensation for losses of land users' incomes from the shortage of agricultural products on lands transferred for the protective afforestation, before they begin to perform protective functions; introduce a reduction in the land tax on agricultural land on which afforestation is carried out in the volumes stipulated by the project for the period until the introduction of protective forest plantations into operation; to abolish value added tax and profit on additional products received as a result of positive effect of protective forest plantations restoration. For effective management of the implementation of afforestation measures it is necessary to prepare the appropriate staffing with the formation of regional forest management services. It is needed to restore the training of specialists in agroforestry in the higher educational institutions, to provide retraining of managerial and engineering personnel. Implementation of the main strategic areas of afforestation in Ukraine in general will increase the ecological and economic potential of agricultural landscapes, diversify agro-industrial production, and improve the living conditions and production activity of the local population. It would be provided a comprehensive approach to the creation of the necessary area of protective forest plantations and proper maintenance of existing plantations; there will be a significant improvement in the microclimatic conditions of the reclaimed territories, increase the productivity of agro-landscapes, prevention of climate changes. The annual estimated afforestation cost related activities is estimated at approximately UAH 3 billion. Along with this, the loss of net annual income from agricultural production, due to huge plowing of the territory, the lack of forests and protective forest plantations amounts to almost $3 billion, that far exceeding the annual cost of afforestation. ; Лесоразведение является важной составляющей государственной стратегии сохранения окружающей природной среды, рационального использования и приумножения природно-ресурсного потенциала Украины, решение проблем ее экологической и продовольственной безопасности. Реализация стратегии лесоразведения в Украине позволит повысить устойчивость лесной компоненты агроландшафтов; существенно уменьшить процессы эрозии и деградации почв; сохранить и обогатить биологическое и ландшафтное разнообразие; ускорить процессы естественного воспроизводства агроландшафтов; оптимизировать лесомелиоративную составляющую эколого-ландшафтного обустройства агроландшафтов; повысить уровень лесистости; обеспечить фильтрацию и очистку поверхностного стока от вредных ингредиентов; улучшить мелиоративные свойства защитных насаждений линейного типа; увеличить урожайность сельскохозяйственных культур; обеспечить дополнительный объем поглощения углерода, замедлит процессы изменения климата; повысит эффективность внедрения государственных экологических программ. Для успешной реализации стратегических задач на законодательном уровне необходимо: освободить земли, переданные под лесоразведение, от уплаты возмещения потерь в местный бюджет, а землепользователей – от уплаты налога на земельный участок в случае его консервации для природоохранного использования; предусмотреть возмещение потерь доходов землепользователей от недополучения сельскохозяйственной продукции на землях, переданных под создание защитных лесонасаждений, до начала выполнения ими защитных функций; ввести уменьшение земельного налога на сельскохозяйственные угодья, на которых осуществляют лесоразведение в предусмотренных проектом объемах на период до введения защитных лесных насаждений в эксплуатацию; отменить налог на добавленную стоимость и прибыль с дополнительной продукции, полученной в результате положительного мелиоративного влияния защитных лесных насаждений. Для эффективного управления реализацией мероприятий по лесоразведению необходимо подготовить соответствующее кадровое обеспечение с образованием районных лесомелиоративных служб. В высших учебных заведениях восстановить подготовку специалистов по агролесомелиорации, обеспечить переподготовку управленческого и инженерно-технического персонала. Выполнение основных стратегических направлений лесоразведения в Украине в целом повысит эколого-экономический потенциал агроландшафтов, диверсификацию агропромышленного производства, улучшит условия проживания и производственной деятельности местного населения. При комплексном подходе к созданию в необходимом объеме защитных лесных насаждений и надлежащего содержания существующих, произойдет существенное улучшение микроклиматических условий мелиорированных территорий, повышение производительности агроландшафтов, предотвращение изменения климата. Ежегодные общие ориентировочные расходы на все мероприятия, связанные с лесоразведением, приближенно оценены в 3 млрд грн. Наряду с этим, потери чистого годового дохода сельскохозяйственного производства из-за значительной распаханности территории, недостатка лесов и защитных лесных насаждений, составляют почти 3 млрд долл. США, что значительно превышает годовые расходы на лесоразведение. ; Лісорозведення є вагомою складовою державної стратегії збереження навколишнього природного середовища, раціонального використання та примноження природно-ресурсного потенціалу України, вирішення проблем її екологічної та продовольчої безпеки. Реалізація стратегії лісорозведення в Україні дасть змогу підвищити стійкість лісової компоненти агроландшафтів; суттєво зменшити процеси ерозії та деградації ґрунтів; зберегти і збагатити біологічне та ландшафтне різноманіття; пришвидшити процеси природного відтворення агроландшафтів; оптимізувати лісомеліоративну складову еколого-ландшафтного облаштування агроландшафтів; підвищити рівень лісистості; забезпечити фільтрацію та очищення поверхневого стоку від шкідливих інгредієнтів; поліпшити меліоративні властивості захисних насаджень лінійного типу; збільшити врожайність сільськогосподарських культур; забезпечити додатковий обсяг поглинання вуглецю, що уповільнить процеси зміни клімату; підвищити ефективність впровадження державних екологічних програм. Виконання основних стратегічних напрямів лісорозведення в Україні загалом підвищить еколого-економічний потенціал агроландшафтів, диверсифікацію агропромислового виробництва, поліпшить умови проживання і виробничої діяльності місцевого населення. За умови комплексного підходу до створення у необхідному обсязі захисних лісових насаджень та належного утримання існуючих, відбудеться істотне поліпшення мікрокліматичних умов меліорованих територій, підвищення продуктивності агроландшафтів, запобігання змінам клімату. Щорічні загальні орієнтовні витрати на всі заходи, пов'язані з лісорозведенням, можуть сягати 2,3 млрд грн. Поряд з цим, втрати чистого річного доходу сільськогосподарського виробництва через значну розораність території, недостатню кількість лісів та захисних лісових насаджень, сягають майже 3 млрд дол. США, що значно перевищує річні витрати на лісорозведення.

Актуальность. Основной целью государственной политики в области здравоохранения и демографии любого государства является снижение смертности и увеличение продолжительности жизни за счет повышения ее качества. Особое значение для достижения этой цели заключается в проблеме сохранения и укрепления здоровья населения и особенно подрастающего поколения, поскольку «хорошее здоровье населения является важным условием обеспечения экономического и социального прогресса любой страны». Целью настоящей работы является обобщение опыта ФЗОЖ в Республике Молдова и выявление основных тенденций в состоянии здоровья подрастающего поколения и возможности продвижения европейского опыта в сфере укрепления здоровья. Материалы и методы. Было проведено описательное исследование, которое включает анализ международной и национальной законодательной базы в области формирования здорового образа жизни, опыт экономически развитых государств по укреплению здоровья населения и обзор научных исследований в данной области. Результаты. Представлена характеристика проблем и достижений в области формирования здорового образа жизни (ФЗОЖ) у подрастающего поколения Республики Молдова на современном этапе. Выявлены приоритеты и ключевые принципы политики здравоохранения, фундаментальные стратегии формирования здорового образа жизни, элементы и главные задачи этой деятельности. Приведена законодательная база Республики Молдова, в которой отражены цель, задачи, необходимые меры по формированию ЗОЖ. К сожалению, формирование ЗОЖ еще не полностью осознана как приоритетная деятельность центральными и местными административными органами. Поэтому необходимы важные и настойчивые действия по созданию и внедрению решений Правительства и Программ ЗОЖ на всех уровнях. Выводы. Социально-экономические преобразования, которые произошли в Республике Молдова с момента объявления независимости, отрицательно сказывались на показателях здоровья населения в целом, в том числе подрастающего поколения. В Республике Молдова принимаются важные, но неполные меры по реализации европейских приоритетов в области формирования здорового образа жизни. Тем не менее, необходимо не только разработка, но и реализация всех правительственных решений и учебных программ в области ФЗОЖ на всех уровнях. Необходимо мобилизовать все заинтересованные стороны для действий по ФЗОЖ на индивидуальном, семейном, административном уровнях. ; Актуальність. Особливе значення для досягнення цієї мети полягає в проблемі збереження і зміцнення здоров'я населення і особливо підростаючого покоління, оскільки «гарне здоров'я населення є важливою умовою забезпечення економічного і соціального прогресу будь-якої країни». Метою цієї роботи є узагальнення досвіду ФЗОЖ в Республіці Молдова і виявлення основних тенденцій в стані здоров'я підростаючого покоління і можливості просування європейського досвіду в сфері зміцнення здоров'я. Матеріали та методи. Було проведено описову дослідження, яке включає аналіз міжнародної та національної законодавчої бази в області формування здорового способу життя, досвід економічно розвинених держав по зміцненню здоров'я населення і огляд наукових досліджень в даній області. Результати. Представлена характеристика проблем та досягнень в області формування здорового способу життя (ФЗСЖ) у підростаючого покоління Республіки Молдова на сучасному етапі. Виявлено пріоритети і ключові принципи політики охорони здоров'я, фундаментальні стратегії формування здорового способу життя, елементи і головні завдання цієї діяльності. Наведено законодавча база Республіки Молдова, в якій відображені мета, завдання, необхідні заходи по ФЗСЖ. На жаль, ФЗСЖ ще не повністю усвідомлена як пріоритетна діяльність центральними і місцевими адміністративними органами. Тому необхідні важливі і наполегливі дії по створенню і впровадженню рішень Уряду та Програм ФЗСЖ на всіх рівнях. Висновки. Соціально-економічні перетворення, які відбулися в Республіці Молдова з моменту оголошення незалежності, негативно позначалися на показниках здоров'я населення в цілому, в тому числі підростаючого покоління. У Республіці Молдова приймаються важливі, але неповні заходи по реалізації європейських пріоритетів в області формування здорового способу життя. Проте, необхідно не тільки розробка, а й реалізація всіх урядових рішень і навчальних програм в області ФЗСЖ на всіх рівнях. Необхідно мобілізувати всі зацікавлені сторони для дій по ФЗСЖ на індивідуальному, сімейному, адміністративному рівнях. ; Background. Of particular importance for achieving this goal is the problem of preserving and strengthening the health of the population and especially the younger generation, since "the good health of the population is an important condition for ensuring the economic and social progress of any country." The purpose of this work is to summarize the experience of healthy lifestyle development in the Republic of Moldova and to identify the main trends in the health of the younger generation and the possibility of promoting the European experience in health promotion. A descriptive study was carried out, which includes an analysis of the international and national legal framework in the area of healthy lifestyle development, the experience of economically developed countries in improving public health and a review of scientific research in this area. Results. A description of the problems and achievements in the field of healthy lifestyle development in the younger generation of the Republic of Moldova at the present stage is presented. The priorities and key principles of health policy, the fundamental strategies of healthy lifestyle development, the elements and main objectives of this activity are identified. The legislative base of the Republic of Moldova is given, which reflects the goal, objectives, necessary measures for healthy lifestyle development. Unfortunately, the formation of healthy lifestyles is not yet fully understood as a priority activity by central and local administrative authorities. Therefore, important and persistent actions are needed to create and implement decisions of the Government and healthy lifestyle development programs at all levels. Conclusions. Socio-economic transformations that have occurred in the Republic of Moldova since the declaration of independence. In the Republic of Moldova, important but incomplete measures are being taken to implement European priorities in the area of promoting a healthy lifestyle. Everything is not only the development, but also the implementation of all government decisions. It is necessary to mobilize all interested parties for actions on HLMF at the individual, family, and administrative levels.

Unlike many other EU Member States, the higher education system in Luxembourg is marked by a particular characteristic, namely the fact that the University of Luxembourg is the only public university in the country. Established by law in 2003, the University of Luxembourg is therefore the main actor in the higher education system and hosts the large majority of international students in Luxembourg. In addition to the University of Luxembourg, two more types of institutions complement the higher education system in Luxembourg and are recognised by the Ministry of Higher Education and Research as higher education institutions (hereafter referred to as 'HEIs'), namely: 1. Secondary educational institutions offering educational programmes that award an advanced technician's certificate ('Brevet de technicien supérieur' – 'BTS'); 2. Private foreign universities having infrastructures or campus in Luxembourg. In order to be able to award higher education diplomas as well as to host international students, all HEIs are mandatorily required to be approved by the Ministry of Higher Education and Research, with the exception of the University of Luxembourg because it was established by law. The admission conditions for international students to study at a HEI in Luxembourg are twofold: First, the international student must apply and be accepted at an approved HEI or at the University of Luxembourg. Second, once accepted at a HEI, s/he needs to apply for a temporary authorisation of stay, and subsequently, if applicable, a Visa D (valid for 3 months), from his/her country of origin before being authorised to travel to Luxembourg and before being issued a 'student' residence permit (valid for minimum 1 year and renewable) in Luxembourg. To conclude, the HEIs in Luxembourg, under the overall auspice of the Ministry of Higher Education and Research, as well as the immigration authorities are the main stakeholders in the context of international students studying in Luxembourg. Luxembourg transposed the Directive (EU) 2016/801 by the Law of 1 August 2018, which amended the amended 'Immigration Law' and entered into force on 21 September 2018. In this context, the study highlights in particular the introduction of a new residence permit for 'private reasons' in view of seeking employment or establishing a business in Luxembourg. This residence permit was newly introduced by the transposition of the Directive and allows international graduates to remain in the country for a maximum duration of nine months in order to find a job or establish a business in relation to their academic training. Prior to the transposition, international students were only able to change their immigration status to 'salaried worker' immediately after their graduation. Moreover, the transposition modified a number of legal dispositions, such as the increase of the maximum amount of hours that students are authorised to work, from 10 hours to 15 hours per week. Furthermore, Bachelor students enrolled in their first year of academic studies as well as students enrolled in a study programme awarding them a 'BTS' are no longer excluded from exercising a salaried activity as allowed by law. Lastly, the transposition also facilitates the intra-European mobility of international students who follow a European or multilateral programme that contains mobility measures or a convention between two or more HEIs. The attraction and retention of international students are not considered as a national political priority per se by the Luxembourgish authorities, but have to be perceived in an overall national political priority of attracting "talents" to Luxembourg, i.e. (highly) qualified persons, regardless of their nationality and in the interest of the country and its economy. The stakeholders consulted in the context of this study identified several factors that may have positive effects on the attraction and retention of international students. These include, among others: - the geographical position of Luxembourg with an important financial sector and several European institutions - the multilingual environment of the country as well as the University of Luxembourg - the HEI ranking of the University of Luxembourg - the comparatively low levels of tuition fees, particularly of the national public HEIs - the fact that the level tuition fees is the same for every student, no matter his/her nationality, with the exception of examples from private HEIs Furthermore, the consulted stakeholders identified several examples of good practices in the context of this study, such as for example: - A close and diligent collaboration between all stakeholders, in particular between the Directorate of Immigration, the Ministry of Higher Education and Research and the University of Luxembourg - Quality management of private HEI (mainly through the approval procedure) in view of the best interest of students - Affordable tuitions fees in the higher education system At the same time, the consulted stakeholders have identified several challenges, such as: - the languages of instruction (with a strong emphasis on French and German especially at the Bachelor/'BTS' levels) and the primary working languages (French and Luxembourgish) - socio-economic factors, particularly the high costs of living and the challenge of finding affordable housing - authenticity and veracity of transmitted diplomas in the context of a diploma recognition - a challenging procedure related to the entrance exam for international students who hold a high school diploma issued in a country that is not a signatory country of Paris/Lisbon conventions - potential misuse of the 'student' residence permit in view of trying to stay in the country instead of succeeding in the studies. In addition to the major legislative change introduced by the transposition of the Directive and the various factors and challenges mentioned above, the study also highlights a number of initiatives, offered in particular by the University of Luxembourg, aiming to support international students after their graduation and to encourage them to establish and/or maintain a connection to the national labour market. The study concludes with a section on bilateral and multilateral cooperation with third countries, both at the level of the Luxembourgish State as well as at the level of HEIs, particularly of the University of Luxembourg.

The rise of high-stakes, standardized, teacher performance assessments (TPAs) is central to the industry being created out of the regulation, policing, and evaluation of university-based teacher education In addition to reinforcing a narrow and counter-critical framework, TPAs can shift responsibility for the evaluation of teacher candidates from university-based teacher educators with a comprehensive and nuanced fluency in candidates' preparedness to external scorers trained to standardize and depersonalize effective practice. In this article, four social justice-oriented teacher educators from three different states examine the practical and political effects of TPAs in their local contexts. By analyzing the curricular, pedagogical, and political implications of this high-stakes standardization of their field, they speak back to a policy landscape that too often marginalizes the voices of the teachers and students it purports to serve. Throughout, they examine the dilemmas of practice created by TPAs, as teachers and teacher educators seek to redefine what it means to enact justice-oriented professional agency in an increasingly regulated context. A critical counternarrative methodological approach was used to collect and process the authors' lived stories and then to collaboratively reflect upon each other's personal/professional experiences with TPAs. Several strategies are identified for enacting agency in response to TPAs, including curricular acts of resistance, resistance through participation in state legislative processes, policymaking within teacher education programs, the production of activist scholarship, and refusal to participate at all. Ways are suggested for teacher educators to minimize, mitigate, and resist unjust policy through curricular, political, and scholarly activism. ; Uno de los aspectos centrales de la industria que se ha creado alrededor de la regulación, normativa y evaluación de la formación de maestros es el incremento de herramientas estandarizadas y tasadas en un criterio unívoco tales. Un ejemplo de estas herramientas son las TPAs. Estas TPAs se basan en una visión cerrada y carente de pensamiento crítico. No solo eso, estas herramientas restan de algún modo validez a las evaluaciones que hace el profesorado que trabaja en los programas de formación de maestros. Este profesorado tiene la capacidad y competencia para deterrninar si los candidatos están preparados para iniciar su carrera como maestros. Antagónico al criterio del profesorado, las TPAs se califican desde una perspectiva estandarizada, impersonal y carente de contexto. En este artículo, cuatro educadores que comparten una visión de justicia social analizan el impacto tanto político como educativo de las TPAs en cada una de sus demarcaciones. Al analizar, desde un punto vista curricular, pedagógico y político, el impacto que tienen estas herramientas en la estandarización de la formación de maestros, los cuatro educadores refutan un marco normativo que a menudo ha marginado las voces de los maestros y de los estudiantes a los cuales debería proteger y valorar. Se analizan los dilemas de enseñanza impuestos por las TPAs. Este análisis es una búsqueda que maestrxs y educadores inician para apoyar la idea de un maestro comprometido, activista y agente de cambio dentro de un contexto cada vez más regulado. Utilizando una metodología de tipo crítico y dialéctico se colectaron y procesaron las experiencias de cada uno de los maestrxs y educadores. Trabajando en equipo analizaron y reflexionaron en cada una de sus narrativas. Todo este proceso ayuda a identificar una serie de estrategias para impulsar activismo como respuesta a las TPAs. Entre estas estrategias se enumeran: actividades de resistencia al curriculum, resistencia al participar en los procesos legislativos establecidos por el estado, creación de normativas que regulen los programas de formación de maestros, producción de artículos que fomenten el activismo, y la negación a participar en las TPAs. Desde una perspectiva curricular, política y académica se sugieren modos de minimizar, mitigar y resistir normativas, TPAs, que se presentan injustas. ; Um dos aspectos centrais da indústria que foi criado em torno da regulamentação, regulação e avaliação da formação de professores é o aumento de ferramentas padronizadas e avaliadas em um critério tão unívoco. Um exemplo dessas ferramentas são os TPAs. Esses TPAs são baseados em uma visão fechada e falta de pensamento crítico. Não só isso, essas ferramentas de alguma forma prejudicam as avaliações feitas por professores que trabalham em programas de treinamento de professores. Esta faculdade tem capacidade e competência para determinar se os candidatos estão preparados para iniciar suas carreiras de ensino. Antagônicos ao critério do corpo docente, os TPAs são qualificados de uma perspectiva padronizada, impessoal e desprovida de contexto. Neste artigo, quatro educadores que compartilham uma visão de justiça social analisam o impacto político e educacional dos TPAs em cada uma de suas demarcações. Ao analisar, do ponto de vista curricular, pedagógico e político, o impacto que essas ferramentas têm sobre a padronização da capacitação de professores, os quatro educadores refutam um quadro normativo que muitas vezes marginalizou as vozes dos professores e estudantes. que deve proteger e valorizar. Estas estratégias incluem: atividades de resistência curricular, resistência à participação nos processos legislativos estabelecidos pelo estado, criação de regulamentos que regulam os programas de treinamento de professores, produção de artigos que incentivem o ativismo e a recusa em participar os TPAs. Do ponto de vista curricular, político e acadêmico, sugerimos maneiras de minimizar, atenuar e resistir aos regulamentos, TPAs, que parecem injustas.

Low efficiency of state regulation of medicines in Ukraine led to the disruption of prescription drugs, which led to negative effects on the system of the pharmaceutical provision of the population: the improper prescribing, dispensing violation of pharmacies, significant proliferation of self and polypharmacy. Purpose ‒ a survey of pharmaceutical workers who are directly involved in practical activities, to establish their views on the problems and ways to improve the prescription drugs on the example of the regional pharmaceutical market and review of the literature on the study of international experience of prescription drugs for introduction in Ukraine. To achieve this goal in the used scientific methods: information search, graphic, studies and surveys. The experts were 66 managers and pharmacists pharmacy network of municipal and private ownership of Lugansk region, controlled by Ukraine. The studies reflected the main cause of the problem of prescription drugs: the spread of self-medication and polypharmacy, lack of an effective mechanism for monitoring compliance with the rules of prescribing, the lack of a sufficient number of prescription forms in health facilities, the lack of knowledge by doctors nomenclature of drugs, the presence of oschibok in obtaining prescriptions, errors in names, dosage and drug holidays rules, the existence of unresolved problems for the introduction of prescribing by INN. Most pharmacists (71%) the cause of the implementation of prescription drugs without a prescription from a pharmacy institutions referred to the need to provide medical aid to the patient, and 21% of the experts ‒ the need to increase turnover and profit pharmacy. According to respondents, the problem of prescription in Ukraine can be solved by reforming the regulatory framework prescription and the establishment of an effective mechanism of its control, as well as through the introduction of compulsory medical insurance reimbursement and implementation mechanism. Taking into account international experience, one of the most effective ways to solve the problem of prescription is the introduction of e-prescribing system that will avoid errors in prescribing, relieve doctors' offices and medical, neutralize the problem of shortage of prescription forms. But for Ukraine could be to introduce a system of electronic recipes, you must create an electronic document standards in the health care system, to determine the groups of drugs, what system of electronic formulations can be extended, to work out a list of relevant legislative and normative ‒ legal documents. It should also take into account the experience of foreign countries in prescribing by INN. But given the factors inherent in the Ukraine ‒ the lack of evidence of bioequivalence of a significant number of generic drug companies lobbying in prescribing drugs and leave doctors and pharmacists, there is a risk for the patient to obtain an improper choice of pharmacotherapy at independent pharmacist trade name drugs. Therefore, the introduction of this system in Ukraine should be addressed quality and safety issues, bioequivalence and therapeutic equivalence of generics, which will eliminate the negative impact on patients' health. At the same time, it must be nayavnoy open publication of the level of evidence of therapeutic equivalence and effectiveness of all drugs that are allowed on the pharmaceutical market of Ukraine (as an example, the US Orange Book). ; Низкая эффективность государственного регулирования оборота лекарственных средств в Украине привела к нарушению рецептурного отпуска лекарств, что стало причиной негативных последствий в системе фармацевтического обеспечения населения: несоблюдения правил выписывания рецептов, нарушения отпуска лекарств из аптек, значительного распространения самолечения и полипрагмазии. Цель работы ‒ анкетирование фармацевтических работников, непосредственно осуществляющих практическую деятельность, для установления их взглядов на проблемы и пути усовершенствования рецептурного отпуска ЛС на примере регионального фармацевтического рынка и обзор литературы по изучению мирового опыта рецептурного отпуска лекарственных средств для внедрения в Украине. Для достижения поставленной цели в работе использованы научные методы: информационный поиск, графический, обоснования, анкетирования. В качестве экспертов выступили 66 руководителей и провизоров аптечной сети коммунальной и частной формы собственности Луганской области, подконтрольной Украине. Проведенные исследования отразили основные причины возникновения проблемы рецептурного отпуска лекарственных средств: распространение самолечения и полипрагмазии, отсутствие действенного механизма контроля за соблюдением правил выписывания рецептов, отсутствие достаточного количества рецептурных бланков в лечебно-профилактических учреждениях, недостаточное знание врачами номенклатуры лекарственных средств, наличие ошибок в оформлении рецептов, ошибок в названиях, дозировке и нормах отпуска лекарственных средств, существование нерешенных проблем для внедрения выписывания рецептов по международным непатентованным названиям. Большинство фармацевтических работников (71%) причиной реализации рецептурних препаратов без рецепта из аптечных учреждений называют необходимость оказания медицинской помощи больному, а 21% экспертов – необходимость увеличения товарооборота и прибыли аптеки. По мнению респондентов, проблема рецептурного отпуска в Украине может быть разрешена путем реформирования нормативной базы рецептурного отпуска и создания действенного механизма его контроля, а также путем внедрения обязательного медицинского страхования и реализации механизма реимбурсации. Учитывая мировой опыт, одним из эффективных путей решения проблемы рецептурного отпуска является внедрение электронной системы выписывания рецептов, что позволит избегать ошибок в выписывании рецептов, разгрузить врачебные кабинеты и врачей, нивелировать проблему нехватки рецептурных бланков. Но для того, чтобы в Украине можно было внедрить систему электронной рецептуры, необходимо создать стандарты электронного документооборота в системе здравоохранения, определить группы лекарств, на какие может быть распространена система электронной рецептуры, отработать перечень соответствующих законодательных и нормативно-правовых документов. Следует также взять во внимание опыт зарубежных стран в выписывании рецептов по международным непатентованным названиям. Но учитывая факторы, присущие Украине – отсутствие доказательной биоэквивалентности на значительное количество генериков, лоббирование интересов фармацевтических компаний в выписывании и отпуске лекарственных средств врачами и провизорами, возникает риск для пациента в получении ненадлежащей фармакотерапии при самостоятельном выборе провизором торгового названия лекарственного средства. Поэтому при внедрении этой системы в Украине должны быть решены проблемы качества и безопасности, биоэквивалентности и терапевтической эквивалентности генериков, что позволит исключить негативные последствия для здоровья пациентов. При этом должна быть открытая публикация уровня доказательной терапевтической эквивалентности и эффективности всех лекарственных средств, которые допускаются на фармацевтический рынок Украины (как пример, американская Orange Book).

At the turn of the last century, Argentina, like other Latin-American countries, began a political process with governments characterised as "new sign governments," tending to increase the value of policy against the market's "invisible hand" and making progress in the expansion of rights ensuring the access to social protection to groups that have been historically excluded from them. The so-called "kirchnerista" period (2003-2015), which starred on that stage in Argentina, was distinguished by putting up new regulations on the educational field aimed at expanding schooling through interventions that sustained state responsibility regarding new school publics' trajectories that had to be included by law in secondary level (National Education Law 26.206). Although the legislative advances and policies that accompanied that process were significant public efforts towards the achievement of that right, the available measures have not managed to challenge a sector of young people in a situation of extreme social vulnerability who are outside the school system and, many of them also, outside the social protection systems reoriented in the last stage of these governments. In this article we discuss how the official categories that account for this phenomenon are insufficient to understand the complex problem of school exclusion, and therefore, to build appropriate alternatives of action for these population groups. The empirical source stemmed from the research results on the so-called "inclusion policies" in secondary schools. Developed during the years 2014 and 2015 in the province of Buenos Aires, these policies entailed an extensive set of measures aimed at improving the integration process for the so-called '"new secondary school'" through devices to youth groups who had not completed compulsory education. This article presents an analysis, from the perspective of young people excluded from the access to school, of the processes leading to that situation and the capacity of the current policies to intervene. ; Argentina, al igual que otros países de América Latina, con el cambio de siglo inicia un proceso político que algunos autores han caracterizado como de "nuevo signo", en el que los gobiernos de este período avanzan en la revalorización de la política frente a la "mano invisible" del mercado y en la ampliación de derechos a partir de garantizar el acceso a mecanismos de protección social a grupos históricamente excluidos. El denominado periodo "kirchnerista" (2003-2015) que protagonizó esa etapa en la Argentina, se distinguió por la puesta en marcha de nuevas regulaciones tendientes a ampliar la escolaridad a través de intervenciones que sustentaron la responsabilidad estatal frente a las trayectorias de los nuevos públicos escolares que debían, por ley, integrarse al nivel secundario (Ley de Educación Nacional Nro. 26.206). Si bien los avances legislativos y las políticas desplegadas que acompañaron ese proceso, significaron un importante esfuerzo público hacia la consecución de ese derecho, las medidas dispuestas no han logrado interpelar a un sector de lxs jóvenes en situación de extrema vulnerabilidad social que se encuentran fuera del sistema escolar y, muchos de ellxs también, fuera de los sistemas de protección social. En este artículo nos interesa someter a discusión cómo las categorías oficiales que dan cuenta de este fenómeno resultan insuficientes para comprender de forma compleja el problema de la exclusión escolar, y, por ende, para construir alternativas de actuación apropiadas para estos grupos poblacionales .Toma como fuente empírica los resultados de investigación sobre las llamadas "políticas de inclusión" en la escuela secundaria, desarrollada durante el año 2014 y 2015 en la Provincia de Buenos Aires, jurisdicción que precisamente se caracterizó por el desarrollo en el período bajo estudio de un extenso conjunto de medidas tendientes a mejorar los procesos de integración a la denominada "nueva secundaria" a través de dispositivos hacia los grupos juveniles que no habían completado la educación básica obligatoria. El objetivo de este artículo será presentar desde la perspectiva de esxs jóvenes, un análisis de los procesos conducentes a la desescolarización y la capacidad de las políticas vigentes de intervenir sobre ellos. ; A Argentina, como outros países da América Latina, com a virada do século inicia um processo político que alguns autores caracterizaram como um "novo signo", no qual os governos desse período avançam na revalorização da política contra a "Mão invisível" do mercado e a expansão dos direitos de garantir o acesso aos mecanismos de proteção social aos grupos historicamente excluídos. O chamado período "Kirchnerista" (2003-2015) que protagonizou essa etapa na Argentina, foi distinguido pela implementação de novas regulações no campo da escola tendendo a expandir a escolaridade através de intervenções que apoiam a responsabilidade do Estado em relação a trajetórias dos novos públicos escolares que deviam, por lei, serem integrados no nível secundário (Lei Nacional de Educação nº 26.206). Embora os avanços legislativos e as políticas implementadas que acompanharam esse processo, significaram um esforço público significativo para alcançar esse direito, as medidas disponíveis não foram capazes de interpelar um setor de jovens em situação de extrema vulnerabilidade social que estão fora do sistema escolar e, muitos deles também, fora dos sistemas de proteção social reorientados na última etapa desses governos.Neste artigo, estamos interessados em discutir como as categorias oficiais responsáveis por esse fenômeno são insuficientes para compreender de forma complexa o problema da exclusão escolar e, portanto, para construir alternativas de ação adequadas para esses grupos de população. Como fonte empírica foram utilizados os resultados da pesquisa sobre as chamadas "políticas de inclusão" na escola secundária, desenvolvidas durante os anos de 2014 e 2015, na Província de Buenos Aires, jurisdição que se caracterizou precisamente por ter implantado no referido período um conjunto amplo de medidas que tendem a melhorar os processos de integração ao denominado "novo secundário" através de dispositivos para os grupos juvenis que não completaram a educação básica obrigatória. O objetivo deste artigo será apresentar, na perspectiva dos jovens excluídos do acesso à escola, uma análise dos processos que conduzem a essa situação e sua relação com as políticas vigentes.

Prior Out-of-Court Insolvency Proceedings under the Prepackaged Chapter Eleven of the United States Bankruptcy CodeO processo de falência extrajudicial prévio no Código de Falências dos Estados Unidos (o 'Prepackaged Chapter Eleven' do U.S. Code)The study examines the Prepackaged Chapter Eleven (hereinafter referred to as the PCE), which is an out-of-court, alternative bankruptcy procedure where a restructuring plan is agreed in advance of a company declaring its insolvency. These so-called "pre-packaged" bankruptcy plans can be used in a Chapter Eleven filing under the US Bankruptcy Code. They are part of the bankruptcy system in the United States that covers preventive solutions to insolvency in that country, the purpose of which is to preserve and virtually save a company from disappearance, both economically and as a legal entity. It is known by the name of its respective chapter; namely, Chapter Eleven of Title Eleven of the United States Bankruptcy Code, a federal norm on insolvency that covers a range of subjects in its different chapters. The following topics are addressed in the study: the PCE in the context of United States law on bankruptcy; the variables that justify choosing between the PCE and the traditional bankruptcy process provided for in Chapter Eleven; the other extrajudicial or out-of-court ways to reorganize a business; a description of the PCE and the scope of its application; its historical background; the legislative policy in the Bankruptcy Reform Act of 1978; the possibilities and advantages of the procedures prior to a Chapter Eleven filing; a comparison between the out-of-court process of the PCE and the judicial process outlined in Chapter Eleven; cases in which the PCE is not convenient or pertinent; types or variations of the PCE; techniques for a successful PCE; the procedural requirements for soliciting a pre-insolvency vote; the risks in a PCE; some recent developments; the effects of the 2005 bankruptcy reform, and the effectiveness of the PCE. Observation of legal and legislative standards of the company activities is the fundamental principle of social responsibility (SR). The results of the literature analysis show the lack of fundamental research of regulatory and legal support of formation of socially responsible conduct of pharmacists (SRCPh).AIM: modeling the legal framework and determining the completeness and content of the current regulatory and legal framework on formation of a system of SRCPh throughout the professional lifespan development.Materials and methods. The materials of the study were national and international regulatory legal acts, regulating SR, the activities of pharmaceutical organizations (PhO) and getting a pharmaceutical education. During the work, such methods as searching information, systematization, content analysis, comparison and generalization were used.During the investigation, we summarized the legal framework that in various aspects forms the socially responsible conduct of the pharmacists throughout the lifespan professional development; and a model of the legal field of this process was formed. A content analysis of this regulatory framework in aspect of responsibility of the PhO and pharmacists with a description of the problem legal questions in the context of SR was carried out. In this article, attention is paid to the basic level of the legal field, within which general principles of social relations are formed in all spheres of the economy.Conclusions. We have formed a model of the legal field formation of a SRCPh system throughout the professional lifespan development. The model is a complex, multilevel system. The regulatory framework in the model is distributed according to two criteria (hierarchical and regulating relations in the system of socially responsible conduct of the pharmacists) and includes 27 basic normative legal acts.We have identified problems in the legal field of the basic level of SRCPh formation: the indistinctness of the conceptual-categorical apparatus of social standards and guarantees; contradiction between normative legal acts; unfavorable conditions for small business, created by the Tax Code of Ukraine; the neglect of legal norms, the determination of a priority exclusively by receiving a profit, ignoring the PhO and pharmacists moral and ethical principles; inadequate level of political and legal culture in the society; the rejection of the law rule by the political elite and the interpretation of legal norms in their favor; passive behavior of public organizations in the pharmaceutical sector; weak control of the public authorities compliance with standards of current legislature. All specified problems stipulate difficulties in the effective SR implementation. ; Фундаментальным принципом социальной ответственности (СО) является соблюдение правовых и законодательных норм деятельности предприятия. Результаты анализа данных научной литературы свидетельствуют о недостаточной фундаментальности исследований нормативно-правового обеспечения процесса формирования социально ответственного поведения специалистов фармации (СОП СФ).Цель работы – моделирование правового поля и определение полноты и содержательности действующей нормативно-правовой базы (НПБ) по формированию системы СОП СФ на протяжении всего жизненного цикла профессионального развития.Материалы и методы. Материалами исследования послужили национальные и международные нормативно-правовые акты (НПА), регламентирующие СО, деятельность фармацевтических организаций (ФО) и получение фармацевтического образования. В ходе работы использованы методы информационного поиска, систематизации, контент-анализа, сравнения и обобщения.В ходе исследования обобщена НПБ, которая по различным аспектам формирует СОП СФ в течение всего жизненного цикла профессионального развития, и сформирована модель правового поля данного процесса. Осуществлен контент-анализ указанной НПБ в аспекте ответственности ФО и СФ с описанием проблемных вопросов правового характера в контексте СО. В данной статье внимание уделяется базовому уровню правового поля, в рамках которого формируются общие принципы общественных отношений во всех сферах экономики.Выводы. Создана модель правового поля формирования системы СОП СФ в течение всего жизненного профессионального цикла, которая является сложной, многоуровневой системой, НПБ в модели распределена по двум критериям (иерархическому и регулирования отношений в системе СОП СФ) и включает 27 основных НПА.Определены проблемы в правовом поле базового уровня формирования СОП СФ: нечеткость понятийно-категориального аппарата социальных стандартов и гарантий; противоречивость между НПА; неблагоприятные условия для малого предпринимательства, созданные Налоговым кодексом Украины; пренебрежение правовыми нормами, определение приоритетом исключительно получение прибыли, игнорирование ФО и СФ морально-этических принципов; ненадлежащий уровень политико-правовой культуры в обществе; неприятие принципа верховенства права политической элитой и толкование правовых норм в свою пользу; пассивное поведение общественных организаций фармацевтического направления; слабый контроль государственных органов за соблюдением норм действующего законодательства. Результати аналізу даних наукової літератури відзначають недостатню фундаментальність досліджень нормативно-правового забезпечення процесу формування соціально відповідальної поведінки фармацевтичних фахівців (СВП ФФ).Мета роботи – моделювання правового поля та визначення повноти й змістовності чинної нормативно-правової бази (НПБ) щодо формування системи СВП ФФ протягом усього життєвого циклу професійного розвитку.Матеріали та методи. Матеріалами дослідження стали національні та міжнародні нормативно-правові акти (НПА), які регламентують СВ, діяльність фармацевтичних організацій (ФО) та отримання фармацевтичної освіти. Під час роботи використали методи інформаційного пошуку, систематизації, контент-аналізу, порівняння та узагальнення.Під час дослідження узагальнена НПБ, котра за різними аспектами формує СВП ФФ упродовж всього життєвого циклу професійного розвитку, та сформована модель правового поля цього процесу. Виконали контент-аналіз зазначеної НПБ в аспекті відповідальності ФО та ФФ з окресленням проблемних питань правового характеру в контексті СВ. У статті приділено увагу базовому рівню правового поля, в рамках якого формуються загальні принципи суспільних відносин в усіх сферах економіки.Висновки. Створено модель правового поля формування системи СВП ФФ протягом усього життєвого професійного циклу, котра є складною, багаторівневою системою, НПБ у моделі розподілено за двома критеріями (ієрархічним і регулюванням відносин у системі СВП ФФ) і включає 27 основних НПА. Визначено проблеми у правовому полі базового рівня формування СВП ФФ: нечіткість понятійно-категоріального апарату соціальних стандартів і гарантій; суперечливість між НПА; несприятливі умови для малого підприємництва, що створені Податковим кодексом України; нехтування правовими нормами, визначення пріоритетом винятково отримання прибутку, ігнорування ФО та ФФ морально-етичних принципів; неналежний рівень політико-правової культури в суспільстві; несприйняття принципу верховенства права політичною елітою та тлумачення нею правових норм на свою користь; пасивна поведінка громадських організацій фармацевтичного спрямування; слабкий контроль державних органів за дотриманням норм чинного законодавства. Все зазначене зумовлює труднощі щодо ефективної реалізації СВ.

Учитывая, что социальная ответственность бизнеса – добровольный вклад предпринимателей в развитие общества, детального изучения требуют этические вопросы, личные мотивы и другие составляющие формирования социально ответственного поведения субъектов фармации с учетом уровней его формирования: личный – коллективный – общественный.Цель работы – определение уровня понимания сути понятия «социальная ответственность» специалистами фармации, их мнения относительно существующих препятствий для развития социальной ответственности фармацевтическими организациями в Украине и мотивов внедрения практик социальной ответственности в фармацевтическую деятельность.Материалы и методы. Проанализировали результаты социологического опроса специалистов фармации нескольких областей Украины. В ходе работы использованы методы информационного поиска, систематизации, сравнения, анкетирования и обобщения.В ходе исследования респондентам предложена анкета с комбинированными вопросами относительно понимания представителями практической фармации понятия «социальная ответственность фармацевтической организации», препятствий для развития практик социальной ответственности фармацевтическими организациями и мотивов внедрения социальной ответственности в фармацевтическую деятельность.Выводы. Большинство специалистов практической фармации знакомо с понятием «социальная ответственность», но полнота его определения разнится. Современные специалисты не имеют единого мнения относительно проявления фармацевтической организацией социальной ответственности. Обнаруженная существенная разобщенность в исходных дефинициях понятия обусловливает необходимость в разъяснении и распространении информации о концептуальных основах социальной ответственности с акцентом на отраслевые особенности ее проявления. Необходимо разработать единый подход (образовательные стандарты) в преподавании отдельных тем организационно-управленческих дисциплин на до- и последипломном уровнях.Основными препятствиями в развитии социально ответственного поведения фармацевтических организаций специалисты фармации видят в неэффективной поддержке государства и отсутствии системы поощрения такого поведения фармацевтических организаций, в отсутствии финансовых возможностей для социальных вложений, а также в отсутствии соответствующей законодательной базы по вопросам социальной ответственности. Большинство респондентов считают «осознание и принятие обязательств перед обществом» важным стимулом для широкого внедрения практик социальной ответственности фармацевтическими организациями.Полученные результаты свидетельствуют о низком уровне личной (персональной) ответственности специалистов, несформированной социальной компетенции современных специалистов фармации и желании переложить ответственность на других (преобладание внешнего локус-контроля). ; In respect that the social responsibility of business is employers' voluntary contribution to the development of society, detailed study requires ethical issues, personal motives and other components of the formation of socially responsible behavior of the pharmacy's subjects, taking into account the levels of its formation: personal - collective - public.The aim of the study is to determine the level of understanding of the essence of the concept of "social responsibility" by pharmacy specialists, their views on existing obstacles to the development of social responsibility by pharmaceutical organizations in Ukraine and the motives for introducing social responsibility practices in pharmaceutical activities.Materials and methods. The materials of the study were the results of a sociological survey of pharmacy specialists from several regions of Ukraine. In the course of the work, methods of information retrieval, systematization, comparison, questioning and generalization were used.In the course of the study, the respondents were asked a questionnaire with combined questions regarding the understanding by representatives of practical pharmacy of the concept of "social responsibility of a pharmaceutical organization", obstacles to the development of social responsibility practices by pharmaceutical organizations and the motives for introducing social responsibility in pharmaceutical activities.Conclusions. Most experts in practical pharmacy are familiar with the concept of "social responsibility", but the completeness of its definition is different. Modern specialists do not have a common opinion regarding the manifestation of social responsibility by the pharmaceutical organization. A significant disunity in the initial definitions of the concept is found to necessitate the clarification and dissemination of information on the conceptual foundations of social responsibility with an emphasis on the branch features of its manifestation. It is necessary to develop a unified approach (educational standards) in teaching certain topics of organizational and managerial disciplines at the pre- and post-graduate level.The main obstacles in the development of socially responsible behavior of pharmaceutical organizations are seen by pharmacy specialists in the ineffective support of the state and the absence of a system to encourage such behavior of the pharmaceutical organization, lack of financial opportunities for social investments, and lack of an appropriate legislative framework for social responsibility. An important incentive for widespread implementation of social responsibility practices by pharmaceutical organizations, most respondents consider "awareness and commitment to society."The obtained results testify to the low level of personal (personal) responsibility of specialists, the unformed social competence of modern pharmacists and the desire to shift responsibility to others (the predominance of the external locus of control). ; Оскільки соціальна відповідальність бізнесу є добровільним внеском підприємців у розвиток суспільства, то етичні питання, особисті мотиви й інші складові формування соціально відповідальної поведінки суб'єктів фармації потребують детального вивчення з урахуванням рівнів її формування: особистий – колективний – суспільний.Мета роботи – визначення рівня розуміння сутності поняття «соціальна відповідальність» фахівцями фармації, їхньої думки щодо наявних перешкод для розвитку соціальної відповідальності фармацевтичними організаціями в Україні та мотивів впровадження практик соціальної відповідальності у фармацевтичну діяльність.Матеріали та методи. Проаналізували результати соціологічного опитування фармацевтичних фахівців декількох областей України. Протягом роботи використали методи інформаційного пошуку, систематизації, порівняння, анкетування та узагальнення.Під час дослідження респондентам запропонували анкету з комбінованими запитаннями щодо розуміння представниками практичної фармації поняття «соціальна відповідальність фармацевтичної організації», перешкод для розвитку практик соціальної відповідальності та мотивів впровадження соціальної відповідальності у фармацевтичну діяльність.Висновки. Більшість фармацевтичних фахівців знайома з поняттям «соціальна відповідальність», але повнота його визначення доволі різниться. Сучасні фахівці практичної фармації не мають сформованої одностайної думки щодо прояву фармацевтичною організацією соціальної відповідальності. Виявлена розбіжність у вихідних дефініціях поняття зумовлює необхідність у роз'яснені та поширенні інформації щодо концептуальних основ соціальної відповідальності з акцентуванням на галузеві особливості її прояву. Необхідно розробити єдиний підхід (освітні стандарти) у викладанні окремих тем організаційно-управлінських дисциплін на до- і післядипломному рівнях.Основними перешкодами у розвитку соціально відповідальної поведінки фармацевтичних організацій фармацевтичні фахівці вбачають у неефективній підтримці держави та відсутності системи заохочення до такої поведінки фармацевтичних організацій, у відсутності фінансових можливостей для соціальних вкладень, а також у відсутності відповідної законодавчої бази з питань соціальної відповідальності. Більшість респондентів вважають «усвідомлення та прийняття зобов'язань перед суспільством» важливим стимулом для широкого впровадження практик соціальної відповідальності фармацевтичними організаціями.Результати, що одержали, свідчать про низький рівень особистої (персональної) відповідальності фахівців, несформовану соціальну компетенцію сучасних спеціалістів фармації та бажання перекласти відповідальність на інших (переважання зовнішнього локус-контролю).

The high rate of Infant and child mortality, much of which is preventable, especially in developing countries, continues to be a global public health concern. Improving the numbers and competencies of child nurse professionals is vital for health system strengthening. Child nurses are important group of health professionals who are responsible for delivering effective health care services to infants and children at all levels of the health system, yet their training situation is being under-investigated. It is documented in various literatures that the high rate of under-five morbidity and mortality in South Africa can be prevented by strengthening the training needs of child nurses, in order to ensure that their competencies adequately align with the priority health needs of children who present at the health facilities. This dissertation is organized into three parts. Part A is the research protocol which outlines the background and the study methodology. Mixed methods comprising qualitative and quantitative methods is adopted for the study. Documentary review and self-administered structured questionnaire is used for the data collection. The questionnaire is designed by applying the basic principles that informs a good questionnaire design. Purposive sampling method is used for sampling the nursing institutions and research participants for inclusion into the study. Defined inclusion and exclusion criteria are used to identify and select the Nursing Education Institutions and key informants suitable for the study. The nursing institutions that are accredited with the South African Nursing Council and conducts child health nursing is an inclusion criterion for the study. In addition, key informants who are nursing educators with expertise knowledge in children's nursing are identified as an inclusion criterion for the study. Documentary review is used to extract secondary data that identifies the South African policy and legislative framework for general nursing and children nursing in particular. Documents will include appropriate policy and strategy documents. The workshop minutes of a sentinel Nurse Educator Forum that took place at Groote Schuur hospital in December of 2016 will be included as an important secondary data source. In addition, primary data collection will be done using a self-administered structured questionnaire where key informants will address a combination of qualitative and quantitative questions. The self-administered questionnaire is used to thoroughly investigate the current situation of children's nursing training in South Africa, with the aim of identifying the numbers trained annually for a five-year period and the curriculum foci of children nursing training across the nursing institutions that host children nursing programs in South Africa. Part B is the literature review which examines the preventable causes of under-five mortality in South Africa and the need to train up suitable, well qualified and competent Child Nurse Professionals needed to improve the health of infants and children in South Africa. Part C is the journal article manuscript which begins with the background and the study methods, followed by the results, discussion and conclusion. The result indicates that a total of five relevant policy and strategy documents were identified for the documentary review. Of the five documents, three documents suggest strategies for improving the nursing education and training programmes in South Africa. The strategies include increasing the supply of the nurse specialists, transforming all nursing colleges to Higher Education Institutions and improving the curriculum guidelines of the nursing programme, in order to ensure that the competencies taught to the nurses aligns with the health care needs of the communities. The two other documents posit the primary roles of the nursing professionals, which is to provide effective care and respect the rights of the health care users. The findings from the documentary review recommends that the nursing education in SA can be strengthened by identifying all nursing colleges as Higher Education Institutions, reviewing curricula and producing more numbers of competent nurses in South Africa. For the primary data collection, out of the seven accredited nursing institutions which conducts children nursing training in South Africa, five respondents from five institutions completed and forwarded their questionnaires. The completed questionnaires provided details on the profile of children's nursing training, including the annual numbers of children nurse trainees and graduates over a five-year period and details of their curriculum components. The results showed that a total of 637 children nurses were enrolled from 2012-2016. Of the 637, 587 graduated successfully which indicates that the number of child nurse trainees and those who successfully graduated over a five -year period across five nursing institutions were very impressive, although the number of child nurses produced annually are still few to address the child health needs in South Africa. In addition, the findings from the questionnaire reveals that the curriculum of children's nursing training across the five institutions are similar and contains topics that are capable of equipping the child nurses with the relevant skills necessary for improving the health of infants and children. However, they exist some variations in the degree the courses are covered by the institutions, as well as variations in the way the courses are conveyed to the nurse learners. For example, some topics where covered to a high degree by some institutions, while some where not covered at all, or where covered to some extent via classroom and clinical placement and assessments. This suggests that the curricula of child nursing in South Africa requires standardization and frequent reviewing to ensure it coincides with the child health needs in South Africa. The dissertation is likely to increase the knowledge of the current training situation of children's nursing in South Africa, and also identify gaps for future research. In addition, the dissertation also provides a better understanding of the curriculum foci of children's nursing training in South Africa and can help inform the human resource training plans for child health nursing in the country.

The study entitled «the I&D transfer, innovation and entrepreneurship in universities (Clay, 2015)» ran through the decade of 2000 to 2010 refers that the binary system of higher education in Portugal was responsible for 40% of the investment in innovation and development (I&D) of all the Portuguese economy.Students are a fundamental and indispensable part of an educational institution from the point of view of citizenship and social development. For this reason, a reflection on its economic difficulties, when they join in higher education institutions, is transferred to these institutions and responsible its leaders towards the pursuit of educational goals related to the school, providing students a better well-being, both mental, social and economic.This design has, slowly, over the last four decades, been provided with greater range and with increased equity, very under the legislative changes proposed by the educational institutions, as well as by the demands expressed by receivers who attend this school level, the students.It is important to stress that the School Social action in the Portuguese higher education appears associated with the concept of effective equal opportunities that are produced through legislation or through other information sources that discuss the subject, as has occurred in the last four decades analyzed.The approach of social benefits in this level of education shall examine the multiple facets that it takes given their link to the educational success and welfare of trainees and therefore to the enhancement of a meritocratic society.Also due to the important contribution of territorial cohesion, especially in areas of Portugal, in the case of Portugal, with a lower population density and lower socio-economic levels, as well reflected in the study entitled «the I&D transfer, innovation and entrepreneurship in universities (Clay, 2015)» ran through the decade of 2000 to 2010 refers that the binary system of higher education in Portugal was responsible for 40% of the investment in innovation and development (I&D) of all the Portuguese economy. ; Los estudiantes son una parte fundamental e imprescindible de una institución educativa desde el punto de vista de la ciudadanía y del desarrollo social. "Leave Nothing to the Imagination: Global Forms of Atrocity After 1945" argues that in the wake of the Nuremberg trials of 1945-1946, through the Eichmann trial in 1961, concern about how to establish evidence for atrocity becomes the major preoccupation for legal representations of human rights violations. I trace how legal discourse becomes dependent on literary modes of representation in order to substantiate the reality of large-scale violence and human suffering in the context of post-1945 human rights legislation. I argue that at key moments, legal arguments turn to fictions and figurations in their attempts to establish the facts of atrocity. Since fiction can create narrative cohesion that the facts themselves cannot support, legal attempts at redress borrow from the imaginative possibilities of fictional techniques for making atrocity legible. Figuration, moreover, fortifies unstable evidence by enlisting facts from other contexts through a logic of resemblance. Herein, I investigate how the dynamic between factual, fictional, and figurative modes of establishing evidence migrates from its epicenter in post-1945 Europe to diverse geographical spaces and geopolitical contexts, where it takes on internationally recognizable markings of atrocity. I look at the intersections between these geographical and geopolitical sites of atrocity, examining the way they borrow, refer to, and complicate one another, and I identify how these aesthetic exchanges constitute attempts to establish evidence in cases where empirical evidence lacks. I look at how the literature of atrocity after 1945 comes to center around this concern about proving the reality of atrocity, and how this happens simultaneously as atrocity becomes an increasingly international concern, subject to new international human rights legislation.This dissertation stands at the intersection of three interdisciplinary conversations: first, how human rights defines a concept of universal personhood; second, comparative genocide studies and, more broadly, comparative atrocity; and third, the nature of evidence in law and literature. The central literary figures that this project engages include Kurt Vonnegut, Antjie Krog, M. NourbeSe Philip, Paul Celan, and Indra Sinha; the central theorists I engage include Hannah Arendt, Dipesh Chakrabarty, Gayatri Spivak, and Jacques Derrida. The case studies I include trace out a global trajectory of a discourse of human rights, alongside concern about establishing evidence for human rights violations. In each chapter, I pair literary texts with archival sources, in order to identify how texts in each of these categories maneuver between factual and figurative terms. The formal category that has determined my grouping of primary texts is the category of "legal testimony." My first chapter, "Factuality on Trial: The "Real" Eichmann, The Authenticity of Atrocity, and the Evidence of Evil," examines the Eichmann trials in 1961 and Hannah Arendt's coverage of the trials in her landmark thesis, Eichmann in Jerusalem: Thesis on the Banality of Evil. This chapter focuses on the Holocaust as a new archetype of atrocity in which the idea of "authentic" representation of atrocity becomes unstable. I chronicle a turning point in the concept of legal evidence as it relates to and is used to establish the reality of atrocityMy next chapter, "Fictions of Evidence: Reconciling Truth in Country of My Skull," examines the South African Truth and Reconciliation Amnesty Hearings of 1996-1997. The TRC self-consciously fashioned itself against the Nuremberg and Eichmann trials, and did so in front of a global audience. In in the context of the TRC, truth becomes fragmented, and reconciliation requires fictions to supplement those fragments. I examine a particular piece of testimony from Antjie Krog's Country of My Skull to illustrate how legal truth in the TRC hearings may be governed by fictions. I show how at the core of the TRC, the concept of evidence itself is located in a specifically literary imaginary. My third chapter, "Seeing Double in Animal's People: Local Toxins, Global Toxicity and the Universal Bhopal," turns to industrial disaster of 1984 in India caused by an American multinational corporation. Bhopal showcases the challenges of providing evidence for and addressing local mass suffering in that global context. Focusing on Indra Sinha's Animal's People, my chapter examines how this atrocity in Bhopal veers between authenticating itself as atrocity by evidencing its universality, borrowing from facts and stylizations of antecedent atrocity to put Bhopal within the legislative purview of International Human Rights, and simultaneously evidencing its uniqueness, thus taking it outside of the global economy. My fourth chapter, "Textimony: Zong! and the Poetics of Evidence" pushes my argument into poetic form. M. NourbeSe Philip's Zong!, a collection of language poetry, is what the author calls an "untelling." It "untells" the 1781 slave massacre aboard the ship, an atrocity followed by an egregious legal case that framed the atrocity as a property compensation claim pressed by the slave owners. Zong! uses the aesthetic conventions developed by a specifically post-1945 mode of representing atrocity, and a contemporary mode of thinking about human rights and atrocity, and projects these conventions onto a historical event of atrocity—the transatlantic slave trade—that may stand both at the gateway of modern globalization, and as an archetype of atrocity. I consider the politics of comparative memory in a globalized legal context, and the representational and political consequences of a comparative approach to memory that may become competitive. My research intervenes into the discourses of contemporary international human rights concerns, policy development, and the discursive development of moral pedagogy addressing the lessons and the legacy of global atrocity for future responses and ethical import. My intervention into these conversations seeks to understand how, in the context of post-1945 human rights, which I will argue is inherently comparative, modes and methodologies of comparison typically associated with literary discourse—analogy, figuration, and metaphor—alongside fictions themselves, become forms of evidence, and how they come to mobilize some of the great human rights projects of the twentieth and twenty-first centuries.

This is a compact review and analysis of the state of equality law in South Africa . Specific reference is made to what has been called "remedial" or "restitutionary" equality. From the analysis it appears that current equality law shows certain imbalances that are difficult to reconcile with the provisions of the Constitution. To point out shortcomings in equality law which is well intended to resolve the burning problems of inequality, can easily be misunderstood in the contemporary circumstances as a reactionary resistance against a necessary process of a justifiable drive for equality. Such is certainly not the purpose of this review. The intention is however to argue the position that striving for equality must be a balanced process in order to ensure that the boundaries of equality themselves are not transgressed, since that would contradict the very essence of equality. In the first section the constitutional provisions on equality are briefly described. It is noted that the Constitution does not establish "a right to equality", but that it consistently deals with equality as a value. The wording of section 9 does however justify a term such as "the equality right." Next the approach of the judiciary to equality, in which the analytical steps of interpretation that were developed by the Constitutional Court are set out, is reviewed with special mention of the role that has been allocated to the value of human dignity in the interpretation and application of equality rights. In the third section an answer is sought to the question what "equality" means. As opposed to the choice of equality jurisprudence in the USA for a formal notion of equality, the South African courts operate with the concept of substantive equality. It is in this context that mention is made of "remedial or restitutionary equality". Equality is given a meaning which implies action. This is supported partly by the wording of sections 1 and 9(2) of the Constitution, but not by the formulation of sections 7(1), 9(1), 36(1) or 39(1). The only constitutional provision which imparts meaning directly to the notion of equality, is section 9(2), providing that "equality includes the full and equal enjoyment of all rights and freedoms." This gives meaning to equality as a value, to the equality rights and to equality as a description in the Constitution of the nature of the society that is being striven for. The complexity and multi-faceted nature of equality does not allow for a simplistic approach to its meaning. The boundary between equality and inequality is quite sharp and the mobilization of equality for the achievement of political, ideological or pragmatic goals can readily lead to inequality and injustice. Against this background the most important pieces of equality legislation, the Employment Equity Act, 1998 and the Promotion of Equality and Prevention of Unfair Discrimination Act, 4 of 2000, are discussed. These Acts were adopted "to promote the achievement of equality, legislative and other measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination" in terms of section 9(2) of the Constitution. Both however contain provisions that go beyond the scope of the Constitution by e.g. the addition of grounds upon which unfair discrimination is prohibited and by excluding affirmative action measures from the meaning of unfair discrimination. The Constitution can not be interpreted in a manner that would allow unfair discrimination for any purpose. The legislation however seem to disregard the possibility of affirmative action becoming discriminatory in itself. This resonates with the view that "substantive equality" allows for measures "that favour relatively disadvantaged groups at the expense of those who are relatively well off". It is however submitted that not the current ideology behind affirmative action, nor one's preferred understanding of equality or the analytical model that is being used, can determine what the justifiable content of equality law should be: the question is rather what may be justified in law, specifically under the Constitution. The form in which elements of the equality legislation are cast, viz. guidelines for its application and illustrative lists of unfair practices, harbours the danger that uncareful interpreters of the law could be seduced to give precedence to the legislation above the Constitution. This would result in a persecutory application of equality law in terms of examples in stead of the constructive and principled approach required by the Constitution. The equality laws also attempt to extend the list of grounds contained in section 9(3) of the Constitution upon which discrimination is presumed to be unfair by the addition of HIV status, family responsibility, political opinion, socio-economic status, nationality and family status. The constitutionality of amending section 9(3) in this manner by means of ordinary legislation is suspect, especially if it is considered that differentiation which is justifiable under the Constitution may be rendered unfair discrimination under ordinary legislation. It is concluded that an emphasis on only the restitutionary element causes a conceptual tension to occur within the multi-faceted notion of equality. This can not be explained only in terms of the distinction between formal and substantive equality, since an over-emphasis of restitution will inevitably bring about imbalances in the outcome of equality actions, i.e. within the framework of striving for substantive equality. Some commentators, courts and the legislature tend to attempt to improve on the Constitution insofar as the achievement of equality is concerned. It is submitted that such attempts are unnecessary, since the Constitution makes sufficient provision for the restitutionary process while the balance of a comprehensive notion of equality is maintained in the form of equality as core value. The limitation of the concept of equality to restitutionary equality will unjustifiably impoverish and partially neutralize the constitutional text. Lessons must in this regard be learnt from the pre-constitutional errors of positivistic legal interpretation.
