Das Verhältnis zwischen Staatenverantwortlichkeit und der strafrechtlichen Verantwortlichkeit eines Individuums für so genannte "international crimes", ist ein bisher wenig geklärtes. Ob die normativen Verantwortungssysteme, die das Völkerrecht für den Staat und das Individuum bereithält, tatsächlich zwei verschiedene regulative Systeme sind oder ob beide Systeme nicht doch zwei Seiten ein und derselben Medaille darstellen, ist ungewiss. Das Ziel dieser Diplomarbeit ist, unter Beleuchtung der bestehenden Interrelationen zwischen beiden Systemen, eine Antwort auf die folgende Frage zu liefern: Ist die Regulierung der strafrechtlichen Verantwortlichkeit von Staaten und Individuen im Völkerrecht kohärent?Der erste Teil der Arbeit wird sich auf die Entwicklung der rechtlichen Regime der Staatenverantwortlichkeit und des Völkerstrafrechts fokussieren. Als letzten Teil des ersten Kapitels wird das Konkurrenzverhältnisses zwischen verschärfter Staatenverantwortlichkeit und der strafrechtlichen Verantwortung des Individuums für internationale Verbrechen näher erläutert. Um eine Antwort auf die oben genannte Forschungsfrage zu geben, wird sodann ein normativer Vergleich auf Basis von Kelsen's allgemeiner Normentheorie zwischen den Primärnormen (Obligationen), Sekundärnormen (Sanktionen) und Tertiärnormen (Vollstreckung) der beiden Systeme durchgeführt. Innerhalb dieses Vergleichs wird besonders die Rolle von jus cogens Normen und erga omnes Obligationen hervorgehoben. Außerdem werden einzelne Verbrechenstatbestände, welche in beiden Regimen vorgesehen sind, näher verglichen. Das analytische Ergebnis des durchgeführten Normenvergleichs findet sich unter Anführung der festgestellten Interrelationen und Unterschiede zwischen beiden Systemen im letzten Kapitel der Arbeit. Dieses analytische Ergebnis führt zusammen mit wenigen abschließenden Bemerkungen zu den Entwicklungen in der Rechtsprechung zu diesem Thema, zu einer Schlussfolgerung. ; The emergence of concurrence between state responsibility and individual responsibility for international crimes raises several practical legal issues. The answer to the essential legal question of whether individual criminal responsibility and state responsibility are two different regulative systems or whether they represent two sides of the same coin would constitute important progress in helping to clarify the distinct problems concerning the influence of the two systems on one another. The thesis will investigate the interrelations between the normative systems of aggravated state responsibility and individual criminal responsibility in the field of Public International Law by trying to answer the specific question: Is the regulation of the criminal responsibility of states and individuals coherent?As a starting point, the first chapter of the thesis will be of a more general nature by focusing on the development of the system of state responsibility and International Criminal Law. After dealing with the emerge of concurrence between aggravated state responsibility and individual responsibility as the final part of the first chapter, it will then be continued with by making use of Kelsens general theory of norms comparing the primary (duties/obligations), secondary (procedures + sanctions), and tertiary (enforcement) rules of the systems of collective and individual responsibility in international law with each other. Within the comparison of the primary rules, special emphasis will be put on the role of jus cogens and erga omnes norms for the concept of international crimes. As a next point, particular offences foreseen in both regimes will be examined closer. Since the inception of a state-run criminal justice system, many have debated and critiqued its features and goals. Often this dialogue takes place largely among academics and theorists with limited impact on policy and an even more marginal influence on the day to day reality of those most affected by the system. In every generation or so, however, a consequential movement emerges, for better or worse. These include movements regarding the evolution of the prison system, the creation of a rehabilitative juvenile court system, the implementation of "tough on crime" provisions of the 1980s, as well as others. With these types of exceptions, efforts to truly reshape the justice system often remain theoretical. In contemporary times, however, there is the potential for major reform of the criminal justice system as courts, states, and the federal government take some actions to recalibrate sentencing laws and procedures. Consequently, pundits and scholars author a plethora of books and articles about "criminal justice reform," making it a hot topic for theory and academic discourse. Many of these pieces, however, risk a lack of implementation because they do not recognize all the actors in the criminal justice system, but focus on a subset that is of interest to the author. As for the other actors, if authors recognize them at all, it is to pillory them as the problem "to be fixed," rather than a stakeholder in the system with whom one should collaborate. Thus, some advocates for sentencing reform focus on the incarcerated individuals, often ignoring the offenders' victims to a large part. Some characterize most prosecutors as unethical attorneys focused on conviction at all costs and law enforcement in an equally negative light. Conversely, advocates for a stronger law enforcement approach often focus solely on the victims' experience, not considering the offender, and characterize the system of offender rights as a series of loopholes to impede justice. The result of this polarized discussion is that the needle moves very little to improve our system and the human toll is great. In the midst of this, Samuel H. Pillsbury offers a new book—and a refreshing new perspective—that has the potential to move the needle to an improved criminal justice system. What makes Imagining a Greater Justice—Criminal Violence, Punishment and Relational Justice so potentially impactful is Pillsbury's inclusion of the perspectives of all the actors in the system to produce a thoughtful analysis which understands the practical reality of an authentic criminal justice system, as well as the need to attain more for all.

The article, based on the analysis of scientific views of researchers and norms of the current legislation of Ukraine, describes the legal principles of ensuring the protection and maintenance of public order in the courts and identifies the place among them of administrative and legal regulation. It has been established that the principles of ensuring the protection and maintenance of public order in the courts are fundamental (basic, starting), general, imperative requirements, rules on which the functioning of the legal mechanism for ensuring the protection and maintenance of public order in the courts is based. These principles are formed on the basis of scientific knowledge of objectively existing patterns of social life. It is established that today in Ukraine the basic legal principles necessary for an effective assurance and maintenance of public order in courts are laid. It is proved that the importance of administrative and legal regulation for ensuring the investigated order is due to the fact that the branch of administrative law regulates public relations that contain an element of public power.

This book focuses on the way in which legal historians and legal scientists used the past to legitimize, challenge, explain and familiarize the socialist legal orders, which were backed by dictatorial governments. The volume studies legal historians and legal histories written in Eastern European countries during the socialist era after the Second World War. The book investigates whether there was a unified form of socialist legal historiography, and if so, what can be said of its common features. The individual chapters of this volume concentrate on the regimes that situate between the Russian, and later Soviet, legal culture and the area covered by the German Civil Code. Hence, the geographical focus of the book is on East Germany, Russia, the Baltic states, Poland and Hungary. The approach is transnational, focusing on the interaction and intertwinement of the then hegemonic communist ideology and the ideas of law and justice, as they appeared in the writings of legal historians of the socialist legal orders. Such an angle enables concentration on the dynamics between politics and law as well as identities and legal history. Studying the socialist interpretations of legal history reveals the ways in which the 20th century legal scholars, situated between legal renewal and political guidance gave legitimacy to, struggled to come to terms with, and sketched the future of the socialist legal orders. The book will be a valuable resource for academics and researchers working in the areas of Legal History, Jurisprudence and Philosophy of Law and European Studies.

Custom was fundamental to medieval legal practice. Whether in a property dispute or a trial for murder, the aggrieved and accused would go to lay court where cases were resolved according to custom. What custom meant, however, went through a radical shift in the medieval period. Between the twelfth and thirteenth centuries, custom went from being a largely oral and performed practice to one that was also conceptualized in writing. Based on French lawbooks known as coutumiers, Ada Maria Kuskowski traces the repercussions this transformation - in the form of custom from unwritten to written and in the language of law from elite Latin to common vernacular - had on the cultural world of law.
