While French jails are facing the double-bind of an increasing number of prisoners to manage efficiently, and pressures to humanize their treatment, the development of judicial procedures and the role of legal professionals in the daily functioning of the prison changes practices of custody. Through the ethnographic survey of two jails (observations and interviews with prisoners, staff, parole judges, lawyers, etc.), the dissertation contributes to a sociology of institutions and of law in action. It investigates the often contradictory aspects of law in prison : a tool of mass management and of individualization of sentences ; an expression of the coercive power and a guarantee of the rights of the administration's subjects ; a neoliberal framing of reentry and a fundamental reference to human dignity. The outline follows the prisoner's trajectory and various moments of his evaluation (intake, disciplinary hearings, parole boards) : these practical uses of law are embedded into interactions between agents of the institution and their clients (men, mostly young, from lower socio-economic backgrounds and belonging to racial minorities). Multiple professional fields (custody, the judicial, the social) are involved, but also moral feelings pertaining to how notions like dangerousness, responsibility or vulnerability are framed in the public sphere. Circulating between different scales (the local jail, the prison administration, public policies) this research offers, through the case study of prison, a contribution to an anthropology of the State. ; Alors que les maisons d'arrêt françaises sont soumises à la double injonction de gérer efficacement un nombre croissant de personnes et d'humaniser le traitement pénal, le développement des procédures juridiques et de la place des professionnels du droit dans le quotidien de la prison modifie les pratiques de prise en charge. À travers l'ethnographie de deux établissements (observations et entretiens avec détenus, personnels pénitentiaires, juges d'application des peines, avocats, etc.), cette thèse contribue à une sociologie de l'institution et du droit en actes, étudiant les multiples facettes du droit en prison : instrument de gestion de masse comme d'individualisation de la peine, expression du pouvoir coercitif et garantie des droits des administrés, formulation d'une conception libérale de la réinsertion et du principe de dignité individuelle. Le développement suit le parcours carcéral du détenu et les différents moments de jugement (accueil des arrivants, commissions de discipline, audiences d'aménagement de peine) : ces mises en œuvre pratiques du droit sont encastrées dans des interactions entre les agents de l'institution et leur public (des hommes, souvent jeunes, issus de milieux populaires et des minorités ethnico-raciales) ; elles font intervenir des enjeux de champs professionnels multiples (sécuritaire, juridique, social) ainsi que des sentiments moraux relatifs aux formulations dans l'espace public des notions de dangerosité, responsabilité, vulnérabilité. Circulant entre l'échelle de l'établissement, de l'institution, et des politiques publiques, cette recherche propose, à partir du cas de la prison, une contribution à une anthropologie de l'État.

The bases of humanitarian assistance, beyond a legal norm–which appears to be essential given the inalienable obligations that result for all participating bodies–are influenced by philosophical and political conceptualizations framed in an ethics of justice. Actors in the humanitarian field who adhere to the Rawlsian social contract model their actions based on a philosophy that assistance is a noble and desirable option that remains in the hands of those who offer aid, and who can freely choose to not offer such assistance. Peter Singer and Thomas Pogge propose nuances to the understanding of the duty of assistance. Not assisting would be bad, basically tantamount to killing. Assistance is no longer a caring act deserving of praise, but rather a moral obligation. The financial imperatives of associations, the growing complexity of activities and the development of an important element of communication lead to a professionalization of humanitarian medicine. A modern vision of humanitarian assistance requires an understanding of justice and solidarity and global outreach. We believe that ethics need to be embedded firmly in humanitarian actions that have clear political implications.

La prison est, sous la III e République, l'objet de nombreuses discussions entre les philanthropes et les hommes politiques car les élites voient dans la réforme pénitentiaire un moyen de résoudre la question sociale. Le projet de réforme est constitutif, majeur, prédominant, pour cette jeune République en quête de légitimité, qui témoigne ici d'une capacité inventive dans la création du politique. C'est la réforme qui initie nombre de projets en cette période et ce n'est pas tant la prison en soi qui est discutée que ce qui peut en éviter l'accès ou le retour. Nous nous attacherons spécifiquement à la loi du 27 mai 1885 sur les récidivistes et à la loi du 14 août 1885 sur les moyens de prévenir la récidive, et nous montrerons en quoi elles sont révélatrices d'une société républicaine en construction, et en quoi elles permettent de comprendre les dynamiques de changement et de régulation à l'œuvre dans l'État républicain . Ces lois, ainsi que le débat national qui présida à leur adoption, se trouvent au cœur même de l'édifice qui aboutira à la constitution d'un État-providence moderne où la loi pénale, base même du lien politique républicain, apparaît comme la seule alternative aux carences d'un pacte social ébréché. La loi pénale devient ainsi un instrument privilégié dans la construction de l'État, et s'installe au fondement de l'identité démocratique.
Institutional Justice, Democratic Justice. Professionals and Laypeople : The "Maison de justice et du droit" Reveals Tensions between Political Models of Justice Legal institutions in France are facing new challenges in terms of the partnership and territorial dimensions of their action, and the "Maison de justice et du droit" is part of this context. The collaboration between actors of various social backgrounds reveals contradictions with regard to the definition of the activities (jurisdictional or not) and the public (residents of the "districts" or not) of this legal structure of proximity. These contradictions display tensions between two models of justice : institutional and democratic. Finally, they reactivate the recurring question of the respective legitimacy of law professionals and lay actors. ; Peer reviewed

The quest for social justice is a powerful crusade of our time, with an appeal to many different people, for many different reasons. But those who use the same words do not always present the same meanings. Clarifying those meanings is the first step toward finding out what we agree on and disagree on. From there, it is largely a question of what the facts are. Résumé Selon le président de la République Nicolas Sarkozy, « les mineurs de 1945 (c'est-à-dire ceux visés par l'ordonnance sur l'enfance délinquante) n'ont rien à voir avec les géants noirs des banlieues d'aujourd'hui ». Cette assertion stigmatisante, « racialisante » et pour le moins discutable selon les statistiques, correspond au vieux refrain de la dégradation du sens moral de la jeunesse, déjà déplorée par Socrate. Mais les récentes réformes de la justice des mineurs l'ont repris à leur compte, facilitant le fichage des mineurs et le recours à l'emprisonnement. Bientôt, le seul fait d'être en groupe, qualifié d'emblée de « bande délinquante », relèvera du droit pénal pour les mineurs. La justice, si prompte à considérer l'enfant soit comme un délinquant potentiel, soit comme une victime, peut aussi être totalement indifférente à la qualité de mineur. C'est le cas des enfants étrangers de familles sans papiers, qui sont placés en centre de rétention comme leurs parents ; c'est aussi le cas dans certains commissariats, où la police est peu respectueuse des règles légales concernant la garde à vue des mineurs, selon le dernier rapport de la Commission nationale de déontologie de la sécurité.
Recidivism has been debated as a public issue since the end of the 1990's. Criminal laws are enacted in order to contain this phenomenon. As of 2002 they start growing significantly repressive and ever more numerous. This criminal policy leads to major protestation among the legal, academic and intellectual worlds, as in the political opposition parties or among political figures disagreeing with the government though in the majority.Policies, laws and the debate or reactions they generate in the society hardly go without their mediatic side. Hence, we shall analyse some media to understand the meaning they give to the governments' legislative activity against criminal recidivism and what meaning these media give to the reactions this activity creates.This dissertation shows by which means the media of our corpus set both the issue of criminal recidivism and the way it is taken care of as a double-cycle. One cycle goes from a criminal re-offense in the back page news to a criminal law. The other goes from the policy about recidivism to its contesting. It also explains wherein media exposure – along which several players are involved - proceeds with this recurrence. This two-sided hypothesis points out two questions. First of all what is the meaning within this journalistic content and what does it tell about the evolution of our criminal justice ? Then, how is this meaning made ?Thus, this dissertation shall first observe the « media scene » delimited by the corpus, and then examine the mechanism of its co-production by journalists and the different players coping with criminal recidivism. ; Depuis la fin des années 1990, la question de la récidive criminelle est présente dans le débat public. Des lois pénales visant à endiguer ce phénomène judiciaire sont promulguées. À partir de 2002, elles deviennent significativement répressives et leur production s'accélère.
