Prawo rolne łączy w sobie dwa przeciwstawne kierunki rozwoju prawa. Z jednej strony zawiera element lokalny lub regionalny. Jak mało która dziedzina jest ono związane z określonym regionem, kulturą i tradycją, a także z określonym językiem. Jest to konsekwencją swoistego charakteru prawa rolnego. Z drugiej strony jest ono dziedziną prawa funkcjonującą na poziomie Unii Europejskiej, którą cechuje największy stopień integracji. Wspólna Polityka Rolna zeuropeizowała tę dziedzinę prawa, która jest zakorzeniona lokalnie i regionalnie, a przy tym stworzyła specyficzny język techniczny europejskiego prawa rolnego. Prowadzenie badań prawnoporównawczych w dziedzinie prawa rolnego staje zatem przed wyzwaniem połączenia lokalnej i regionalnej specyfiki językowej oraz europejskiego języka technicznego prawa rolnego. Relatywizm technicznego języka prawa rolnego nie stoi na przeszkodzie komparatystyce prawniczej. Jednak poza znajomością języka wymaga ona od badacza również dogłębnej wiedzy kulturowej, społecznej i ekonomicznej na temat innego państwa. Profesor Budzinowski wykorzystuje te umiejętności w swoich badaniach prawnoporównawczych jak mało który uczony. ; Agricultural law combines two opposing directions of development of law in general. One is connected with the local or regional element and indeed, like no other discipline, is linked to a specific region, culture, tradition and linguistic specificity, being a consequence of the specific nature of agricultural law. On the other hand, at the level of the European Union it is characterised by the greatest degree of integration. The Common Agricultural Policy has made agricultural law locally and regionally rooted but, at the same time, it has created a specific technical language of European agricultural law. Therefore, conducting a comparative legal research into the field of agricultural law faces a particular challenge as it requires combining both local and regional linguistic specificities with the European technical language of agricultural law. This relativism of the technical language of agricultural law does not, however, stand in the way of legal comparativism. However, apart from the linguistic knowledge, it requires the researcher to possess thorough cultural, social and economic knowledge of another country. Professor Budzinowski, unlike many other scholars, embodies these skills in his comparative legal research. ; Il diritto agrario combina due direzioni opposte di sviluppo del diritto in generale. Da un lato, si tratta di un aspetto locale o regionale. Infatti, come nessun'altra disciplina, essa è legata a una specificità regionale, culturale, tradizionale e infine linguistica. Ciò consegue dalla sua particolare natura. Dall'altro, il diritto agrario è quell'area del diritto a livello dell'Unione europea che si caratterizza per il maggior grado di integrazione. La politica agricola comune è riuscita a far europeizzare questo ambito del diritto, radicato a livello locale e regionale, e al tempo stesso ha fatto nascere un linguaggio tecnico specifico del diritto agrario europeo. Quindi, le ricerche giuridiche comparate di diritto agrario si trovano costrette a dover affrontare una sfida del tutto particolare, vale a dire devono saper combinare le specificità linguistiche, locali e regionali, con il linguaggio tecnico europeo del diritto agrario. Fortunatamente, il relativismo del linguaggio tecnico del diritto agrario non va a ostacolare gli studi giuridici comparati, anche se, oltre alle conoscenze linguistiche, richiede al ricercatore pure una approfondita conoscenza culturale, sociale ed economica di un altro Paese. The purpose of the deliberations presented in this paper is 'confrontation' of the past and the future of agricultural law. A look to the future through making references to the past experiences allows us to wrap up the whole area of study and then adopt another perspective: agricultural law between tradition and modernity. By doing so we also determine a new direction of the development of agricultural law, moving from traditional to modern agricultural law, where the latter is a reflection of today's need for the legal regulations to become adapted to the changing social and economic environment and goals. This takes the form of a still increasing although already huge number of legislative acts covering yet newer areas of legislation which is now expanding to the public law sphere as well. Modern agricultural law is a great challenge facing agricultural scholars today, who must not only recognise the need for further development of regulation, but also account for the changes taking place in agriculture itself and its social and economic environment. Research cannot be reduced to the development of new legal institutions only but ought to be accompanied with a wider theoretical reflection on the subject of the legislation as well as the new boundaries and the position of agricultural law in the legal system. Doing this will facilitate the process of the creation and enforcement of agricultural law. ; L'obiettivo delle considerazioni è di "mettere a confronto" il passato con il futuro del diritto agrario. Rivolgere uno sguardo al futuro facendo riferimento alle esperienze storiche permette, nel quadro conclusivo, di formulare affermazioni che portano a sviluppare il tema definito nel seguente modo: il diritto agrario tra tradizione e modernità. Tale impostazione del tema esprime la direzione dell'evoluzione che procede dal diritto agrario tradizionale a quello moderno. Quest'ultimo, in quanto espressione dell'adattamento delle regolazioni giuridiche a nuove condizioni socio-economiche ed a obiettivi prefissati, è caratterizzato da un enorme aumento del numero di atti giuridici, una significativa estensione dell'oggetto di applicazione (espansione) e un'attività pubblicazionale. Il diritto agrario moderno costituisce una sfida enorme per la scienza. Un agrarista, per far fronte alle novità, deve prendere in considerazione non solo lo sviluppo di regolazioni giuridiche, ma anche cambiamenti dell'agricoltura stessa e dell'ambiente socio-economico di essa. Le ricerche non possono essere limitate solo ad una elaborazione di vari istituti giuridici. Esse dovrebbero essere accompagnate da una riflessione teorica più ampia che riguardi l'oggetto, i nuovi confini e il posto del diritto agrario nel sistema giuridico.
