En el contexto actual de arremetida neoliberal y de la ampliación de las fronteras extractivas, continúa una espiral de violencia, contra quienes se oponen a la imposición de megaproyectos mineros en sus territorios, a casi treinta años de políticas neoliberales en Perú. Los conflictos sobre la gestión de los bienes comunes aumentan, y con ello emergen historias de luchas y resistencias por la defensa de la vida y el cuidado de la naturaleza. A partir de la serie documental participativa: Tejiendo resistencias (2013) y otras obras audiovisuales, se pone en diálogo, la emergencia de prácticas audiovisuales colaborativas y sus vínculos con las luchas por la defensa del territorio en Cajamarca - Perú.

Between 1678 and 1688, an indian public notary, whose name appears in the padrones de indios of the "town of indians" of Cajamarca, wrote down more than three hundreds wills of indigenous men and women. The analysis of the unique registry that corresponds to his writing activity in the Departamental Archives of Cajamarca, allows a reconstruction of the social and political role of he who was in charge of recording and keeping the "people's voice". Moreove, it enables to cuestion the exceptionality of this documental corpus in the historical context of the mutation of Cajamarca. The "town of indians" settled by the spanish in the XVIth century turns into a colonial town through an complex process during the XVIIth century. ; En Cajamarca, entre 1678 y 1688, un escribano, cuyo nombre aparece registrado en los padrones de indios del pueblo, redactó más de trescientos testamentos de habitantes indígenas. El estudio minucioso del único legajo correspondiente a su actividad, conservado en el Archivo Departamental de la ciudad, permite reconstituir el papel social y político del encargado de registrar y guardar la "voz del pueblo". El objetivo de estudio fue proponer el plan de participación ciudadana para la gestión de los residuos sólidos, en el distrito de Jesús, Cajamarca. La investigación es de tipo descriptiva propositiva con diseño no experimental, estudia dos variables: el plan de participación ciudadana con sus dimensiones organización, ejecución y evaluación, amparada en los aportes teóricos del enfoque de la participación ciudadana desde una perspectiva socio estado y democracia. Y la variable gestión de residuos sólidos con sus dimensiones acondicionamiento, segregación, almacenamiento primario, transporte, almacenamiento final y tratamiento de los residuos sólidos basados en los aportes de la logística inversa y la sociología ambiental. La conclusión que arribó el estudio fue: El 42,1 % de los ciudadanos de la zona urbana del distrito de Jesús, muestran un saber medio respecto a la gestión de residuos sólidos, 38,6% lo catalogan como saber bajo y 19,3% lo asumen como alto. Estos resultados indican la necesidad que tienen los ciudadanos para obtener conocimientos y actitudes que conlleven a mejorar la capacidad de gestión de los residuos sólidos, para cuidar la salud y obtener una mejor calidad de vida.

This research starts with a literature synthesis on risk and its measurement; then, as a second point, presents the methodological process for the construction of an index to measure social risk for Cajamarca's department in Peru, which has been based on the application of probability theory. The estimation methodology addresses two approaches: i) the probability of occurrence of an event that generates a total or partial paralysis of the private sector activity for a specific month, and ii) the probability of occurrence of at least one day of paralysis for a specific month. The data used has been recorded for the period between January 1992 and December 2022, based on journalistic information. The results are plotted in two-time series which show the evolution of the Cajamarca Social Risk Index in basis points for both methodological approaches. Additionally, I present a comparison of the annualized probability of occurrence of Cajamarca's private sector total or partial paralysis for five-year periods, regional governors, and political parties.
The article aims to present the following aspects: to approach the incidence of the characteristics of good living with respect to Colombian regulations regarding tourism planning and elements of transformation in the development of the tourist undertakings "Urapanes del Bosque" and "Finca la Florida" of the Municipality of Ibagué and Cajamarca of the Department of Tolima. The present study was developed around two types of research, exploratory and descriptive, chosen for the little information regarding the planning and regulations that govern the development of tourist activities in Cajamarca. The results show that Good living and rural tourism generate conditions of justice and equality, the importance of the Nature-Society relationship. Thus, as the emergence of alternatives to development from the local, through the production chain, maintaining its rural identity from the historical context and generating greater participation and democracy regarding the development of the Municipality of Cajamarca. ; El artículo tiene como objetivo presentar los siguientes aspectos: 1.Incidencia de características del buen vivir respecto de la normatividad Colombiana en materia de planificación del turismo, 2. Elementos de transformación en el desarrollo de los emprendimientos turísticos "Urapanes del Bosque" y "Finca la Florida" del Municipio de Ibagué y Cajamarca del Departamento del Tolima. El estudio se desarrolló alrededor de dos tipos de investigación, exploratorio y descriptivo, escogidos por la poca información respecto a la planificación y normatividad que rige en el desarrollo de las actividades turísticas de Cajamarca. Los resultados muestran que el buen vivir y el turismo rural, generan condiciones de justicia e igualdad, importancia de la relación Naturaleza-Sociedad. Así, como el surgimiento de alternativas al desarrollo desde lo local, mediante la cadena de producción, manteniendo su identidad rural a partir del contexto histórico y generando mayor participación y democracia respecto al desarrollo del Municipio de Cajamarca.

The article analyzes the Rondas campesinas as a self-defense institution created by indigenous and Mestizo peasant communities of highland Peru. The case study is the Rondas of the rural highland community of La Toma, located in Cajamarca, northern Peru. Rondas campesinas were created during the 1970s to prevent aggressions both from the State and from private landowners to communal lands and other property in a context of the agrarian reform in force then. In addition, the Rondas served as a powerful institution during the internal war against Sendero Luminoso from 1980 through the 1990s. In such processes, the Rondas of La Toma proved to be a really representative institution of the rights of its community and this is the hypothesis this article demonstrate. ; Este artículo analiza las rondas campesinas como instituciones de autodefensa creadas por las comunidades serranas del Perú. El caso en estudio trata de las rondas de la comunidad La Toma, Cajamarca, en la sierra norte del Perú. Las rondas campesinas fueron creadas durante la década de 1970 para evitar las agresiones a la propiedad comunal tanto de parte del Estado como de los terratenientes. Además, las rondas campesinas sirvieron como una organización poderosa durante el conflicto interno contra Sendero Luminoso desde 1980 hasta entrada la década de 1990. En tales procesos, las rondas de La Toma demostraron ser una institución verdaderamente representativa de los derechos de su comunidad y esta es la hipótesis que se busca demostrar.

Analiza el ámbito de dos grandes proyectos mineros y cuatro regiones relacionadas con estos. En primer lugar, el proyecto La Granja, concesionado a la corporación Río Tinto, que se encuentra localizado en el distrito de Querocoto, región Cajamarca, y cuya influencia política abarca también la región Lambayeque. En segundo lugar, el proyecto Las Bambas, concesionado a la corporación Xstrata, que se encuentra en el distrito de Challhuahuacho, región Apurímac, y cuya influencia abarca también la región Cusco. Ambos casos han sido tema de estudio en los capítulos anteriores de este libro.
ABSTRACT This research work aims to determine the causes of daily conflicts, existing between the judiciary and the peasant rounds. However, the Rounds have special jurisdiction granted by law, problems arise daily, including clashes between peasant rounds, the judiciary and law operators. Our goal is to propose a solution in order to avoid conflicts between two institutions: The peasant rounds recognized by law and the constitution and the judiciary, a state agency responsible for the administration of ordinary justice. Throughout our investigation we have established that the conflict of competences is generated because there is no legislation that delimits the competition of peasant rounds. Although the judiciary is seriously questioned because of the little procedural speed, as well as the lack of transparency in the administration of justice, it is also true that the peasant rounds in their eagerness to administer justice in the scope of their jurisdiction create discomfort to the judges who try to ignore customary law and customs and customs of the peasant rounds. More abundantly, the rounds resolve conflicts in different aspects, civil, criminal, family, etc. In many cases they exceed and generate problems with the same members of their community, resulting in frequent cases reported by kidnapping, coercion, usurpation of functions, etc. In this context, the present investigation consists in describing and explaining the formative process, the mechanisms and procedures used in the resolution of conflicts, the rural development activities promoted by the peasant rounds of Chota, within the framework of respect for human rights and organizational development; actions that in many cases generate controversy because the integrity of the investigated person is not guaranteed, that is, in the inquiries within the hovering organization a due process is not respected, the procedures and inquiries are consistent with their uses and customs, it is more Our Magna Carta guarantees the due process, with the presumption of innocence, the pro-probation and the defense of the accused, rights that are not exercised within the organization hovering. It is good to note that in order to formalize this work, the investigator has used interviews with the ronderos, interviews with judges, prosecutors and other law operators working in chota-Cajamarca. ; RESUMEN El presente trabajo de investigación tiene como objetivo determinar las causas de conflictos diarios, existentes entre el Poder Judicial y las rondas campesinas. No obstante, las Rondas tienen jurisdicción especial otorgada por la ley, diariamente se suscitan problemas, incluso enfrentamientos entre las rondas campesinas, el Poder Judicial y operadores del derecho. Se tiene como objetivo proponer una solución a fin de evitar conflictos entre las rondas campesinas reconocidas por la ley y la constitución y el ¨Poder Judicial, organismo estatal encargado de la administración de justicia ordinaria. A lo largo de la investigación se ha establecido que el conflicto de competencias se genera por cuanto no existe una legislación que delimite la competencia de las rondas campesinas. Si bien el Poder Judicial se encuentra seriamente cuestionado por la poca celeridad procesal, así como por la poca transparencia en la administración de justicia, es cierto también que las rondas campesinas en su afán de administrar justicia en el ámbito de su jurisdicción crean malestar a los jueces quienes intentan desconocer el derecho consuetudinario y los usos y costumbres de las rondas campesinas. A mayor abundamiento, las rondas resuelven conflictos en diferentes aspectos, civil, penal, de familia, etc. En muchos casos se exceden y generan problemas con los mismos miembros de su comunidad, resultando en frecuentes casos denunciados por secuestro, coacción, usurpación de funciones, etc. En este contexto, la presente investigación describe y explica el proceso formativo, los mecanismos y procedimientos utilizados en la resolución de conflictos, las actividades de desarrollo rural promovidos por las rondas campesinas de Chota, en el marco del respeto a los derechos humanos y desarrollo organizacional; acciones que en muchos casos generan controversia por cuanto no se garantiza la integridad de la persona investigada, En las indagaciones dentro de la organización rondera no se respeta un debido proceso, los procedimientos e indagaciones son acordes a sus usos y costumbres, es más, la carta magna garantiza el debido proceso, la presunción de inocencia, el principio indubio pro reo y la defensa del imputado, derechos que no son respetados dentro de la organización rondera. Con el sano propósito de llenar vacíos legales y comprometer una estrecha relación entre rondas campesinas y el Poder Judicial, se recomienda una norma que delimite la competencia tanto territorial como competencia de materia para las rondas campesinas, al mismo tiempo se sugiere un programa de educación en derechos humanos y desarrollo organizacional para mejorar el desempeño ronderil en la resolución de conflictos, con respeto a un debido proceso, a fin de evitar procesos penales contra los ronderos. Conociendo la eficiencia en la administración de justicia de las rondas campesinas, en ámbito de su jurisdicción se recomienda a la vez, la modificación del código procesal penal en lo referente a la investigación preliminar, en cuyo estadío de indagación deben participar los ronderos y, al ser así deben ser considerados como medios probatorios válidos las actas y esclarecimientos que se hace en las comunidades campesinas. Es bueno acotar que para formalizar este trabajo el investigador se ha valido de entrevistas a los ronderos, entrevista a jueces, fiscales y otros operadores del derecho que laboran en la Provincia de Chota, distrito judicial de Cajamarca. ; Tesis

This thesis is an ethnographic study of the political agency of campesinos, rural inhabitants, who live in the area of many large mining projects in the Andean region of Cajamarca, Peru. The main focus is on gold mining projects called Yanacocha and Conga. Yanacocha is currently the largest gold producer in South America, and Conga is a proposed offshoot of the current mine. The Conga project was halted, yet not cancelled in 2011 partly due to local resistance. Since the locals were able to affect halting the project, Cajamarca has become an ideal context to study the strategies of social movements. Also, there is a need for a study that draws attention to the still ongoing conflict and the violations of political rights of the local campesinos. Their experiences are of central importance, because the locals bear the immediate effects of a global mineral trade in their natural and social surroundings. Basing on material collected with a local campesino during two months of ethnographic fieldwork, this study intends to capture those experiences surrounding the gold mining projects. Using the ethnographic material, I analyse the views of the local campesinos on their political agency. I also investigate how these views are reflected and turned into action in the social movement against Conga and other mining projects. As a theoretical framework, I use conceptions of citizenship, understood as political agency that encompasses local, regional, national and international levels (Lazar 2013). I will also connect citizenship with social movement studies, because social movements, especially in Latin America, are at the global forefront in questioning and shaping understandings of citizenship (Roniger & Sznajder 2012). In short, I analyse, How do the campesinos construct and negotiate citizenship in the context of mining projects in Cajamarca, Northern Peru? This question is further clarified by two sub-questions: How do the locals understand their citizen position in relation to the mining activities? How do they act and use citizenship in the social movement against mining? The study results in findings of local understandings of citizenship that are deeply rooted in the local bioregion (Nixon 2011), local customs and communality. However, these understandings are processual (Werbner 1998) and imperfect (Clarke et al 2014), and also conflicting ideas were found among the locals. Nevertheless, the social movement against mining in the area has been able to take on these local citizenship imaginaries and bring people together through actions that challenge the economy-based discourse of the mining company and the state. Combining the strengths of already existing local citizen practices, on the one hand, and some tools that the national citizen status provides, on the other, enables social movements to grow stronger in their pursuits.

Este artículo expone cómo el surgimiento y el despliegue de un movimiento social en contra del modelo de desarrollo extractivista modula un territorio. A partir de la minería de datos, del trabajo etnográfico y el análisis del conflicto territorial presente en el municipio de Cajamarca (Tolima), se discute sobre cómo la movilización social funge como columna vertebral en la interpelación a las lógicas estatales del gobierno colombiano en torno a la construcción de país desde la otredad. De esta manera, el capital cognitivo y las capacidades que tienen los diversos actores sociales de cooperar en el marco de la movilización no se agotan en ésta y, están en constante juego a partir de la superposición de instituciones y la negociación de poderes. ; This article explains how the emergence and deployment of a social movement against the extractivist development model modulates a territory. Based on data mining, ethnographic work and the analysis of the territorial conflict in the municipality of Cajamarca (Tolima), it discusses how social mobilisation acts as the backbone of the questioning of the Colombian government's state logic regarding the construction of the country from the other side. In this way, the cognitive capital and the capacities that the diverse social actors have to cooperate in the framework of the mobi- lization are not exhausted in this one and, they are in constant game from the superposition of institutions and thenegotiation of powers.
