Toleranz im Islam
In: Transit: europäische Revue, Heft 31, S. 69-88
ISSN: 0938-2062
(ICA2)
ONTOLOGI PENDIDIKAN ISLAM : HAKIKAT PENDIDIKAN DALAM PERSPEKTIF ISLAM
Education in Islam covers totality of three aspects of life, namely, ruhiyah (spirit), fikriyah (understanding, brain), and amaliyah (deed, body) that are performed gradually in all lines of life. Indonesia government is enthusiastically encouraging a societal-based education, an education that is based on character building. However, ironically we are exposed to a sickness society phenomenon, for example, pornographic video case. The pornographic video was blasphemed and blamed by various society elements, but on the other hand, many people were even hunting for the pornographic video. It proves that our society has no strong moral protective power. Purposes of this article are to know and to prove essence of Islam as a syamil-mutakammil (comprehensive) religion in explaining the importance of education in building characters of Islam.

Branding Islam: Islam, law, and bureaucracies in Southeast Asia
In: Journal of current Southeast Asian affairs, Band 37, Heft 1, S. 27-56
ISSN: 1868-1034
Islam plays a pivotal political role in Southeast Asian countries, where the governments that have ruled since independence have been concerned with influencing the trajectory, content, hermeneutic and style of the legal traditions of their Muslim citizens and reconciling them with the states' wider policy objectives. This contribution looks at one particular tool for this form of 'guiding' Islam - the codification of Islam - comparing the codes in two Muslim-majority countries (Malaysia and Brunei) and two Muslim-minority countries (Singapore and the Philippines). Utilising comparative law methodologies, this article explores the structure, style and content of the codes in order to explicate their explicit and implied function. These codes are less concerned with being a statement of substantive Islamic law than with setting up a state-sanctioned bureaucracy for the administration of law for Muslims. These bureaucratic institutions were the key instruments for the states to develop their own brand of Islam. In doing so, the state's approach towards socially engineering Islam oscillates among appropriation, accommodation, control and subjugation of Islam in different political and legal frameworks. The problem of liberty of religion
; One of the major divergences between Western and Islamic Culture is their different concept of law: indeed, the source of Islamic law is religion, whereas the source of Western Law is the non-confesional State. That's why we will examinate some cases of Islamic states (specially Pakistan) and of convivence between Islamic law and European law. It is particularly interesting the presence of sharia Courts in Great Britain, which have caused as a reaction the emergency of the movement "One Law for All". In regard to fundamental rights, the liberty of religion in its western shape finds nearly insourmantable difficulties within the Islamic State, since it is possible to enter the Islam, but not to go out, unless you have dead before. Apostasy is therefore one of the most difficult issues for the convivence of both legal systems. Thus, after the so called "Arabic Spring", many hopes in the Western world focus on the way through which Islamic religion might be reconciled with democracy and respect to International Treatises, specially those concerning human rights. An interesting case is the new constitution that Morocco enacted on 2011, which settle Islam as State religion on its article 3: although this constitution explicitly makes reference to the "moderate" Islam, only the practice will tell us, in the following years, how liberty of religion may be arranged with Islam.
