Der interdisziplinäre Beitrag behandelt erstmalig Stand und Perspektiven der Arbeitsbeziehungen im Profifußball, wobei die Spielergewerkschaft besondere Berücksichtigung findet. Der erste Hauptteil analysiert ausführlich die Mitgliedschaftslogik (Verbandsstrukturen, Mitgliedschaft, Dienstleistungen für Mitglieder als Lösung des Kollektivgutproblems). Dieser umfangreiche Teil der Verbandspolitik ist auf die Besonderheiten des Arbeitsmarktes abgestimmt. Der zweite Hauptteil analysiert die Einflusslogik (Beziehungen zu korporativen Akteuren von sportspezifischer oder allgemeiner Bedeutung sowie Lobbying). Kollektivverhandlungen finden nicht statt, da die institutionellen Voraussetzungen fehlen, so dass die Einflusslogik weniger entwickelt ist als die Mitgliedschaftslogik. Das Fazit lautet, dass die Entwicklung dualer Arbeitsbeziehungen unwahrscheinlich ist, monistische entstehen allenfalls bei einigen Vereinen. In methodischer Hinsicht basiert der Beitrag auf einer umfassenden Dokumentenanalyse aller zugänglichen Verbandsmaterialien sowie Interviews mit Hauptamtlichen des Verbandes.

The article examines the orientation of the European press during the recent crisis in the Persian Gulf by analysing coverage of the event, attitudes towards the contending parties and the presentation of Saddam Hussein. The study focuses specifically on the months preceding the intervention of the coalition led by the United States. The evidence indicates that, in all the dailies examined, the coverage of the crisis went through different and basically predictable stages, `surprise', `interest', `routine', `waiting' and the `flood', i.e. like those of a media event. The differences observed among the dailies were significant with respect to three issues. The first is whether the attitude towards military intervention led by the United States was favourable or unfavourable. Secondly, some dailies were more militaristic while others were more pro-Arab. Finally, contrary to expectations, not all the dailies defined as `conservative' were the most interventionist and militaristic, whereas several considered `progressive' were.

This article studies the role of the African Union (AU) as an instrument for providing legal certainty to foreign investors in the African continent. Africa has failed to attract foreign investment since the business environment and market conditions do not even appeal to national investors. One of the biggest problems contributing to this situation is a low level of legal certainty which makes it too risky for foreign investors to invest in the region. Therefore, the development and adoption of policies and actions aimed at the provision of a higher level of legal certainty is necessary. This article precisely proposes the usage of the AU as an instrument to achieve this goal. This regional integrationist experience groups several elements that can positively contribute to the provision of legal certainty to foreign investors. For instance, it has an institutional structure that allows its institutions to work coordinately in the adoption of policies and laws, which makes possible the development and adoption of coherent and stable laws and policies. Likewise, the AU's structure allows the exchange of opinions, ideas, and experiences between African governments and foreign investors during the decision-making process by means of an institution such as ECOSOCC and the private sector Forum. This communication promotes transparency and predictability to foreign investors for the development of their economic activities. In addition, AU also has the power to create legal instruments that serve to regulate the activity of foreign investors, limiting the power of the host country to interfere in the investment, and promote the progress and respect of matters such as the rule of law, transparency and good governance in the continent. Uno de los problemas más grandes que contribuyen a esta situación es un bajo nivel de certeza legal que hace muy riesgoso para los inversionistas extranjeros el invertir en la región. Por ende, el desarrollo y la adopción de políticas y acciones apuntando a la provisión de un nivel más alto de certeza legal es necesario. Este artículo propone precisamente el uso de la UA como un instrumento para conseguir este objetivo. Esta experiencia integracionista regional agrupa varios elementos que pueden contribuir posiblemente a la provisión de certeza legal a los inversionistas extranjeros. Por ejemplo, tiene una estructura institucional que permite a sus instituciones trabajar coordinadamente en la adopción de políticas y leyes, que hacen posible el desarrollo y la adopción de leyes y políticas coherentes y estables. Del mismo modo, la estructura de la UA permite el intercambio de opiniones, ideas y experiencias entre los gobiernos africanos e inversionistas extranjeros durante el foro de decisión. Esta comunicación promueve la transparencia y previsibilidad a los inversionistas extranjeros para el desarrollo de sus actividades económicas. Esta situación es una consecuencia de múltiples razones como la baja defensa de los derechos de propiedad, bajos niveles de capacidad técnica y de habilidad de administración y empleados, la existencia de varias barreras afectando el acceso de los inversionistas extranjeros y costos de transacción crecientes, infraestructura insuficiente (en áreas como el transporte, las comunicaciones, suministro eléctrico), corrupción y políticas inefectivas para promover la inversión extranjera en el continente. De todas maneras, uno de los problemas más grandes que afectan la inversión extranjera en la región es un bajo nivel de certeza legal que hace muy riesgoso para los inversionistas extranjeros el invertir en la región. La certeza legal es un principio que "expresa la premisa fundamental que aquellos sujetos a la ley deben saber lo que la ley establece para ser capaces de planear sus acciones de acuerdo con ello". Consecuentemente, la certeza legal existe cuando la ley es pública, clara, no-retroactiva, estable y respetada por la gente y las autoridades nacionales.Esta situación hace el desarrollo y la adopción de las políticas y acciones apuntando al mejoramiento del ambiente legal necesario en la región, particularmente la provisión de un nivel más alto de certeza legal para los inversionistas extranjeros. Como los mecanismos tradicionales para implementar este objetivo, es posible identificar varios mecanismos como los Tratados de Inversión Bilateral o acuerdos de estabilidad legal. Sin embargo, este artículo quiere proponer una alternativa diferente, que es el uso de la UA. Esta experiencia integracionista regional agrupa varios elementos que pueden contribuir posiblemente a la provisión de certeza legal a los inversionistas extranjeros. Por ende, los partidos miembros de la UA pueden usarla como un mecanismo para la atracción de inversión extranjera en sus territorios.Bajo estas consideraciones, este artículo se divide en dos partes principales. La primera estudia el papel que la ley de la UA tiene en la provisión de certeza legal a los inversionistas extranjeros. La segunda, con el mismo objetivo que la primera, estudia el papel de la estructura institucional de la UA. A través del análisis de estos elementos, el artículo identifica los elementos principales de la UA que contribuyen y hacen posible el mejorar los niveles de certeza legal para los inversionistas extranjeros en el continente africano.

This article considers the significant increase in wine consumption in Britain in the period 1965–85. It explores the social and cultural meanings attached to wine through a case study analysis of Good Housekeeping, a women's magazine aimed at a mainly middle-class readership. The vast majority of wine consumed in Britain at this time was European, the appeal of which was, for many, rooted in an idealised evocation of continental sophistication. In illuminating the development of new socio-cultural habits, this article reveals the influence of continental tourism is bolstering enthusiasm for wine, as well as the impact of greater availability and affordability in popularising consumption.

The lack of enthusiasm for the European Union and its proposed constitution among the
European people surprised the political elite of Europe. Codifying common beliefs and values
seemed to be a good way to represent the European identity in written form. The signing of
the constitutional treaty should have become an important symbolic act, demonstrating the
willingness of the people to bond together. Instead, a so-called Reform Treaty was passed in
Lisbon in 2007 (to be ratified by all member states by 2009) that specifically abandoned any
allusion to symbolic forms of European representation such as the term
constitution, the flag, or a European anthem.

In den letzten 15 Jahren richteten beinahe alle europäischen Staaten Fachorgane zur Bekämpfung von Rassismus und rassistischer Diskriminierung ein. Sowohl die Europäische Kommission gegen Rassismus und Intoleranz (ECRI) des Europarats als auch die Europäische Union erstellten Standards, die einen gemeinsamen europaweiten Grundkonsens in der Bekämpfung von Diskriminierung widerspiegeln. Neben materiellrechtlichen Diskriminierungsverboten wurden auch neue Rechtsschutzwege entwickelt.Die Diplomarbeit zeigt, dass die Standards sich teilweise überschneiden und gegenseitig verstärken. Das Verhältnis der europäischen Standards und nationaler Gesetzgebung stellt den Kernpunkt der Diplomarbeit dar. Während EU-Richtlinien für EU-Mitgliedsstaaten verbindlich sind, stellen ECRIs Allgemeine Politikempfehlungen soft law dar. Nicht-Mitgliedsstaaten der EU sind nicht an die Richtlinien gebunden, die auch nicht Teil des EWR-Abkommens sind. In diesem vielschichtigen Kontext stellt sich die Frage, wie Österreich, Norwegen und Serbien die Europäischen Standards umgesetzt haben, die sich mit der Kompetenz von Fachorganen zur Behandlung von Einzelfällen auseinandersetzen? Wie haben sie die Standards in Bezug auf die Bereitstellung von Unterstützung, aktives Klagerecht, die Erlassung nicht verbindlicher oder verbindlicher Entscheidungen und die Zuerkennung von Schadenersatz umgesetzt? Welche Auswirkungen hat die Umsetzung der europäischen Standards auf die Menschenrechtssituation in den drei Staaten? ; Specialised bodies to combat racism and racial discrimination have been created in almost all European States in the past 15 years. Following increased awareness of issues of racism and racial discrimination, the Council of Europe?s European Commission against Racism and Intolerance (ECRI) and the European Union each introduced a set of standards for the whole continent providing a common baseline for protection against discrimination in material and institutional terms. Material prohibitions of discrimination are complemented by procedural provisions responding to the need for effective remedies.This diploma thesis will show that the standards on specialised bodies partly overlap and are mutually reinforcing. The interaction between these European standards and their implementation in national legislation will be the central topic. EU law is binding on EU member States, whereas ECRI?s recommendations constitute soft law. The EU Directives are not part of the EEA Agreement, nor are they binding on non-EU member States. In this multi-layered context it is legitimate to ask how and to what extent Austria, Norway and Serbia have implemented the European legal standards regarding the capacity of specialised bodies to combat racial discrimination in relation to deal with individual cases, i.e. in cases with an identifiable victim.
