The Oxford Handbook of International Refugee Law is a comprehensive, critical work, which analyses the state of research across the refugee law regime as a whole. Drawing together leading and emerging scholars, the Handbook provides both doctrinal and theoretical analyses of international refugee law and practice. It critiques existing law from a variety of normative positions, with several chapters identifying foundational flaws that open up space for radical rethinking. The Handbook aspires to be global, both legally and geographically. Contributions assess a wide range of international legal instruments relevant to refugee protection, including from international human rights law, international humanitarian law, international migration law, the law of the sea, and international and transnational criminal law.

This Essay explores the values, limits, and adverse effects of our system of law school examinations. Law school examinations encourage or require students to acquire certain knowledge while measuring a kind of knowledge as well. Importantly, this process occurs within a context of political relationships between law schools, law firms, the legal profession, and the state, as well as between law school administrators, faculty, and students. This system of "power/knowledge"relationships constitutes the law school's basic mechanism of self-regulation or, more generally, a mechanism of social control over legal education. In this era of substantial uncertainty about purposes and methods in legal education, an inquiry into law school examinations and their political contexts is both timely and potentially fruitful. Prior studies have developed important criticisms of law school examinations, but these studies have been partial or limited critiques. These studies have uncritically accepted conventional beliefs about law school practices and have overlooked certain values and disadvantages of the current examination system. This Essay provides a "systemic analysis" and a "total critique" by assessing the structure, contextual relationships, values, and adverse effects of law school examinations. This Essay seeks to improve our understanding of law school exams in three basic ways. First, Part II presents a new interpretation of what the modern law school examination requires and measures of student performance. This interpretation emphasizes the reading and grading methods that are used by most contemporary law professors, the implications of these methods for the thought and writing style of examination writers, and the personal attributes that are required for examination success. Second, Parts III, IV, and V consider the law school examination in context in order to assess the values, limits, and disadvantages of the examination system. Incorporating the Continental philosophical tradition of hermeneutics into legal scholarship appears to be a project relevant only to a few jurisprudes locked away in the uppermost reaches of the ivory tower. Many scholars undoubtedly would argue that the tradition and focus of twentieth-century German philosophy is far removed from the troubling interpretive issues that arise in the American legal system, regardless of any interesting parallels or comparisons that might be drawn., From this perspective, the renewed attention to hermeneutical philosophy by legal scholars is viewed as just one of an increasing number of esoteric, intellectual cul-de-sacs that have diverged from the boulevard of traditional jurisprudence. This not-so-hypothetical attitude toward hermeneutics is interesting for the very reason that it is erroneous. Those who argue that contemporary philosophical hermeneutics holds little practical significance for legal practice demonstrate that they are unmindful of the genealogy of the traditional principles of legal interpretation that they hold so dear. The publication in 1837 of Francis Lieber's Legal and Political Hermeneutics was an important contribution to the effort to define principles of interpretation that could justify and guide the newly created American practice of written constitutionalism. Lieber, a native of Germany, related his knowledge of German hermeneutical philosophy to the political and legal questions facing the young republic. Lieber's attempt to describe a science of textual interpretation that would ensure rule-governed consistency in politics and adjudication helped to formulate the traditional views of interpretation espoused by judges and theorists during the past century.

The purpose of the research was to redefine the concept of social relations from the point of view of its theoretical, administrative and civil aspects of legal regulation, considering, for this purpose, various scientific contributions. The main content is based on the meaning of the concepts of "public relations" and "social relations" as political and legal entities with different paradigmatic essence. The methodological basis of the research was constituted by the comparative-legal and systemic analysis, the formal-legal method, the method of interpretation, hermeneutics and the methods of analysis and synthesis. By way of conclusion the authors have established that the term "public relations" characterizes relations between people, which provide for the unconditional priority of the economy over other spheres of society (political, ideological, cultural), material and symbolic spaces where there is no place for a person with his values, rights and freedoms. At least, the latter do not acquire due regulatory support.

International lawyers typically start with the legal. What is a legal as opposed to a political question? How should international law adapt to the unforeseen? These are the routes by which international lawyers typically reason. This book begins, instead, with the non-legal. In a series of case studies, Fleur Johns examines what international lawyers cast outside or against law - as extra-legal, illegal, pre-legal or otherwise non-legal - and how this comes to shape political possibility. Non-legality is not merely the remainder of regulatory action. It is a key structuring device of contemporary global order. Constructions of non-legality are pivotal to debate in areas ranging from torture to foreign investment and from climate change to natural disaster relief. Understandings of non-legality inform what international lawyers today do and what they refrain from doing. AbstractThe tragic events in Aurora, CO and Newtown, CT have renewed public perception of mentally persons as 'dangerous' and 'criminal.' Unfortunately, this perception is based more on conjecture and fear than research. The following essay takes stock of the empirical research on mental illness and criminal behavior. Three noteworthy trends emerge from this literature. First, the prevalence of mental illness is substantially higher among individuals who have come in contact with the criminal justice system relative to the general population. Second, individuals with psychotic and externalizing behavioral disorders, particularly those who also abuse drugs and alcohol, tend to engage in higher levels of violence than individuals with other forms of mental illness. Third, mental illness does not determine whether someone will break the law; rather, it is but one of many criminogenic risk factors that interact in complex ways to influence individual behavior.
