The idea of judicial democracy in the European Union (EU), which assumes that the European Court of Justice functions to ensure that European citizens are guaranteed their rights & have a say in the EU's decisions, is held to be faulty. An examination of the Court's practices demonstrates that a European's access to the courtroom seems to be greatly influenced by knowledge of the European Union & by nationality. Only a limited number of persons have recourse to the Court, & it is suggested that the EU's judges are not especially bothered by this, guaranteeing that the situation is unlikely to change in the near future.
