Abstract: Kennzeichen der Moderne sind ein säkulares Verständnis von Staat und Recht und das Konzept des Rechtspositivismus. Staat und Recht sind von Religion unabhängig. Das Grundgesetz ist eine Verfassung, die durch Rechtsetzungsakt in Geltung gesetzt worden ist, geändert und wieder aufgehoben werden kann. Trotz seiner Positivität und Säkularität enthält das Grundgesetz Bezüge auf transpositive Normativität. Dazu gehören die nominatio dei in der Präambel, die Unantastbarkeit der Menschenwürde und das Bekenntnis zu den Menschenrechten. Durch diese Bezüge wird das Andere des Rechts im Recht repräsentiert, ohne dessen Positivität und Säkularität infrage zu stellen. Der besondere Regelungsbedarf für religiöse Fragen wird durch Normen aufgegriffen, die ihrerseits als säkulares Rahmenrecht zu interpretieren sind.
