When under pressure, people revert to their true natures. And insofar as political leadership goes, in the final session of the 2020-24 term of the Louisiana what we saw from the Legislature leadership was ugly, hopefully the last gasp of a mentality that has left Louisiana in tatters.
In the House of Representatives, Republicans Speaker Clay Schexnayder and Pro Tem Tanner Magee have come under much fire for their handling of the session. It all crystallized in the last week of the session, when they muscled through a resolution allowing state government to spend, as opposed to banking, about 10 percent more of transitory revenue generation, and in the final half-hour of the session, when most of the spending bills were presented for members' approval with hardly any of them knowing any details about what they were asked on which to vote.
This failure of leadership occurred at two levels, beginning with their unwise squandering of dollars ahead of a bleaker revenue picture. The Revenue Estimating Conference foresees fiscal year taxes, licenses, and fees falling from $15.277 billion in fiscal year 2024 to $15.103 billion in FY 2025, $14.666 billion in FY 2026, then a bump upwards to $14.936 billion in FY 2027 – a drop of over a billion bucks from FY 2023 just wrapping up. Given that new commitments (at least in intention) of around $320 million annually were doled out for education alone starting in 2024, maintaining this total level of spending will be difficult.
This leads to consideration whether this budget isn't some kind of poison pill left to the next governor and Legislature. Frontrunner GOP Atty. Gen. Jeff Landry has made no secret of wanting to rein in government, and neither is hidden the distaste that Schexnayder and Republican Sen. Pres. Page Cortez have for Landry and those legislators sympathetic to Landry's right-sizing goal, who certainly would gain considerable power in the Legislature with Landry in office.
Of course, one goal with the bloated budget was to allow its backers to puff their chests out with pride in to leave in the history books or as a resume-builder for future elections the fact that they "gave" stuff to the people (as if one can be made a gift of your own resources; it's not legislators' money, it's the people's) – a legacy of Louisiana's liberal populism where politicians seeks to hoard as much money as they can then distribute it as a way that makes themselves seem indispensable to the wellbeing of the polity. But another motive also was using it as a tool of payback against those with a different vision.
It's all right to have competing visions, where the Schexnayders and Magees of the world take the grasshopper version of blowing it all now in the face of a certain looming winter, and the fiscal conservatives who voted against the enabling resolution to do this adhere to the ant version of saving to deal with that future. Realize as well a good portion of the excess spending authority went to non-priority items, mainly transportation infrastructure, while $237 million went towards more critical things such as stabilizing property insurance markets and coastal protection – which could have been afforded without busting the cap. There absolutely was no need to spend so much at this time.
For their trouble, most of the fiscal conservatives had Schexnayder yank their capital projects from the supplemental bill after the successful vote to violate the cap. This turned into a tag team effort when liberal big spender Democrat Gov. John Bel Edwards subsequently used his line item vetoes on those in the regular capital outlay bill.
The grasshopper view is a flawed vision and in and of itself may disqualify those who follow it from being entrusted with elective office. It's why Louisiana has lurched from fiscal crisis to fiscal crisis historically while remaining relatively overtaxed, which manifested in the Edwards era – who backed Schexnayder for Speaker and with whom has cooperated in keeping bloated government – as declining population and stagnant job and wage growth contrary to most other states.
But truly reprehensibly about these people is their avoidance of taking responsibility for this and trying to blame others for their failures. This excuse-making stems not just from bad policy-making, but from bad leadership as an extension of trying to explain away policy mistakes. Remarks by both Schexnayder and Magee after the session attempted to address widespread complaints about budget priorities and the zero transparency involved in its promulgation that hardly was distinguishable from budgeting in the heyday of the Soviet Union.
In a radio interview, Magee (like Cortez before him) adopted the spousal abuser role by blaming the victims in causing the budgetary chaos, saying "You have a group of lawmakers who are more interested in making headlines about obstructing government than they are about doing the people's work." Note the breath-taking arrogance of this remark: equating a desire to spend less as "obstructing … the people's work" and attempting to cancel legitimation of opposition to his big-spending agenda, as well as the avoidance of responsibility for his cabal's cutting $100 million out of health care in the operating budget and $136 million out of Jimmie Davis Bridge funding in the capital outlay budget.
In media remarks, Schexnayder attempted even more vigorously to distance himself from accusations of failure to budget responsibly and transparently. Also assuming the spousal abuser role by calling those who voted against raising the cap "a small group of blockers, instead of helpers" – similar to Magee voicing a sentiment that trying to keep government spending under control was illegitimate – he mischaracterized outside assessments of the budget in trying to defend his actions as the chief budget architect (and who sat on the conference committees that approved removing dissenters' projects, as did Magee, and the bridge money). "Someone sent me PAR [Public Affairs Research Council] and CABL[Council for a Better Louisiana]'s evaluations of the budget. The budget is a good budget; a good, conservative budget that moves our state forward. That has excellent projects in it."
PAR did say the operating, capital, and supplemental bills had "many state priorities and positive developments," but also noted that those "were overshadowed by the messy way lawmakers handled the spending of taxpayer dollars" and "lawmakers wasted tens of millions on favored projects for their districts that don't represent state priorities. They continued unnecessary giveaways through tax break programs with uncertainty about their long-term impact on the state treasury. And they stripped hundreds of millions of dollars from the state health department with no idea what the impact might be on services to the poor, elderly and people with developmental disabilities."
CABL noted that "lawmakers did enact spending bills that make many wise investments in the future of Louisiana" where for the "most part it spends non-recurring revenue on one-time expenses, mostly infrastructure projects." But it also declared "there needs to be more time and transparency when making decisions over such huge sums of money" and "It also remains to be seen what the fiscal impact of this session's spending will mean in a couple of years when some current taxes are removed from the State General Fund."
Regarding these and other critiques of how the process was handled, Schexnayder followed the playbook by saying this could have been avoided if only the fiscal conservatives hadn't dissented. But that's a failure of leadership in that only at the last minute relatively speaking did Schexnayder convince enough of them to back a breach – by promising to retain the majority of dollars to pay down unfunded pensions and use much of the authorized excess on one-time expenses – and then he had an entire day after to clear up everything. Maybe if he hadn't spent so much time trying to find ways to punish dissenters he might not have produced such shoddy results.
And his laughable assertion that dissenters deliberately disengaged themselves from the process so they didn't know about contents is absurd on its face since he went out of his way to punish them, a style of leadership that doesn't invite participation of your opponents. Nor does it address similar complaints from others who voted to bust the cap.
These attitudes and behaviors by Schexnayder and Magee, as representations of legislative leadership and policy-making, reveal everything that is wrong with Louisiana and why it has fallen so far behind other states by squandering its resources. Making mistakes and blaming others, neither wisely nor warily, only continues a long history state politicians of doing the same. As for the future as they and others who think like them seek elective office, voters should know Schexnayder and Magee are the problem and having nothing to do with the solution.
El contrato de SWAP es un producto financiero que ha provocado en los últimos años un notable interés mediático debido, por una parte, a su comercialización masiva y por otra, en un contexto de crisis generalizada, a ciertas dudas que ha generado respecto de su inocuidad para el cliente de crédito y la necesidad de corregir judicialmente determinadas disfunciones frecuentemente debidas a un desconocimiento no solo de su significado y funcionamiento en los mercados crediticios sino también de su estructura jurídica. La tesis pretende diagnosticar lo problemas que más frecuentemente se generan en la práctica, así como de perfilar los caracteres de ésta variedad de permuta financiera cuya modelización queda a la libertad de las partes pues son ellas las que, en uso de su autonomía de la voluntad, han confeccionado todo un régimen jurídico propio ante la ausencia de legislación estatal o internacional en la materia. Debe advertirse que con frecuencia únicamente la vuelta a los principios básicos del Derecho de las Obligaciones contractuales, permite identificar la solución procesal más satisfactoria adecuada a los intereses en conflicto. Sobre estas premisas, el estudio está estructurado en las siguientes tres partes: En la primera parte se define el swap y se enmarca en un contexto económico determinado, analizando la posición jurídica de las partes, la forma habitual del contrato requiere una serie de particularidades debido a su extremada volatilidad y el uso de contratos marco como normativa aplicable ante la ausencia de derecho nacional. Tras el análisis del origen del Swap y de los elementos básicos del contrato, el estudio se centra en el consentimiento y su problemática tanto sustantiva como procesal. En España son numerosas las sentencias que en los últimos años han fallado exigiendo un deber de cuidado a la hora de informar sobre los productos financieros a los clientes, fluctuaciones inesperadas o contrarias a los clientes han revelado que un buen número de contrapartes no conocían bien el funcionamiento y consecuencias de los productos financieros que contrataron. En este punto se analizan tanto el procedimiento para la nulidad del contrato ( legitimación, argumentos recurrentes, procedencia de la sumisión a arbitraje) como las sentencias más relevantes del Tribunal Supremo y de otros países. En la segunda parte aborda el tema de la naturaleza jurídica del contrato de Swap-Irs, que resulta caracterizado como atípico, aleatorio, bilateral, sinalagmático, oneroso, de tracto sucesivo, autónomo y consensual desde el punto de vista de su perfección. La atipicidad del contrato de Swap es la más destacada, aunque no la única, fuente de problemas puesto que el artículo 2 de la Ley del Mercado de Valores reconoce que existen y los incluye dentro de la clasificación pero siguen sin marco legal es específico. Lo dicho anteriormente sobre algunas notas definitorias del contrato de Swap tiene importantes consecuencias en el ámbito de un procedimiento concursal. A título de ejemplo, cabe preguntarse qué pasaría si consideraríamos el contrato Swap como sometido a condición suspensiva, según pretende un sector del la doctrina. La tercera parte posee un larga trayectoria de elaboración pues su origen se remonta al año 2009, tras la sentencia del Juzgado de lo Mercantil nº 3 de Valencia que calificaba los créditos de contratos de Swap como subordinados tanto si el Swap era autónomo (al menos reconocía esa posibilidad) como si estaba vinculado a una operación de activo. El trabajo se centra en la búsqueda de un argumento para defender el punto débil de los créditos derivados de los Contratos de Swap, lo que, ahondando en la materia, condujo a extraer dos conclusiones, en torno a las que gira esta parte del estudio: (i) Que la base de los argumentos recurrentes de los juzgados está en la naturaleza del contrato (ii): Que destruyendo determinados elementos definidores podría cuestionarse la aplicabilidad de dos normas: el articulo sesenta y uno de la Ley Concursal que regula la calificación de los créditos subordinados y el Real Decreto Ley 5/2005 en su aplicación a las operaciones de Swap. De este modo, lo que tenia visos de practicidad se ha convertido en un análisis doctrinal de los elementos del contrato, de su naturaleza, de su posible subsunción en otras figuras típicas y de su problemática jurisprudencial, todo ello, empezando por su origen como cláusula en los contratos de financiación y terminando por el análisis pormenorizado de sus caracteres según la naturaleza jurídica para determinar en cómo influye este análisis en la normativa que aplicamos. A SWAP contract is a financial product that has caused, in recent years, a remarkable media interest due, firstly, to its massive sale, and secondly, in a context of widespread crisis, to some doubts about the benefits for the credit customer. There have been a need for correcting certain legal aspects, often due to a lack not only of their meaning and function in credit markets but also of their legal structure. The thesis aims to diagnose the problems that most frequently are generated in the practice and give shape to the character of this variety of swap, whose modelling is the freedom of the parties who, practising their autonomy, have made an entire legal regime in the absence of national or international legislation. It should be noted that often, only returning to the basic principles of the contractual obligations law is the most satisfactory solution to the conflict of interests. Based on this premise, the study is divided into the following three parts: In the first part, the swap is defined and framed in a particular economic context, analyzing the legal position of the parties. The usual way of the contract requires a number of peculiarities due to its extreme volatility and the use of framework contracts and regulations because of the absence of a national law. After analyzing the origin of the Swap and the basic elements of the contract, the study focuses on the consent and its substantive and procedural problems. In Spain, there have been numerous sentences in recent years, compelling banks to inform about financial products to their customers. Unexpected fluctuations revealed that a number of clients were not familiar with the operation and consequences of the products they contracted. At this point, it is analysed the procedure for annuling the contract (legitimation, recurring arguments, arbitration) as well as the study of some of The most important Supreme Court decisions. The second part addresses the legal nature of the Swap-Irs contract, which is characterized as atypical, randomized, bilateral, synallagmatic, onerous and consensual from the point of view of its perfection. The unusualness of the swap agreement is the most prominent, but not the only one, source of trouble since Article 2 of the Securities Market Act recognizes that there are included within the classification but it has not legal specific framework. What has been mencioned previously about some defining features of the swap agreement has important consequences in the field of bankruptcy proceedings. For example, one wonders what would happen if the Swap contract was considered as subject to condition precedent, as a sector of the doctrine claims. The third part has a long history of development since its origins date from 2009, following the judgment of the Commercial Court No. 3 of Valencia branding Swap contracts' credits as subordinates whether the swap was autonomous (at least it recognized that possibility) as if it was linked to an active operation. The work focuses on the search for an argument to defend the weak point of credit derivatives swaps, which, digging into the matter led to two conclusions, around which turns this part of the study: (I) The basis of the recurring arguments of the courts is in the nature of the contract (ii) by destroying certain defining elements it could be questioned the applicability of two provisions: Article sixty-one of the Insolvency Act regulating rating subordinated claims and the Royal Decree Law 5/2005 in its application to swap transactions. Thus, what had overtones of practicality has become a doctrinal analysis of the elements of the contract, its nature, its possible subsumption in other typical and jurisprudential problematic figures, all beginning with its origin clause in the financing agreements and ending with a detailed analysis of their characters as the legal nature to determine how it affects this analysis in the regulations we appy.
The opening of the Colombian economy, decided in 1990, was supposed to promote a new model of growth and development based on exports (and Foreign Direct Investment). This dissertation argues that the opening was not made in order to promote growth and development, and that these two phenomena did not live up to what was expected. This result is based on an International Political Economy approach: taking into account power relationships may give a better explanation of economic phenomena. The first chapter shows that the structural characteristics of the Colombian economy made its opening unable to generate growth and development. This assertion is based on the analysis of the lack of competitiveness and of the institutional flaws of the Colombian economy, as well as on the potential increase in the spatial inequalities of development resulting from the opening. The second chapter thus highlights that the opening aimed at achieving some objectives peculiar to the United States. These objectives are made of economic considerations (typically the access to foreign markets and to raw materials) as well as political ones (dealing with the threats caused by Marxist guerrilla groups within the framework of the American foreign policy). This second chapter explains a series of means at the disposal of the United States to obtain the opening. These means go from coercion (such as sanction threats) to legitimation (to give rise to a Colombian pro-opening government). The third chapter shows that the opening did not lead to an export-led growth. On the contrary, it led to an unstable growth regime. The latter is based on the foreign capital flows. The latter feed the purchase of real estate assets by credit. The housing sector is thus stimulated, which in turn stimulates other economic activities, within the framework of spill-over effects. However, when foreign capital flows lack, real-estate asset purchases are penalized, thus preventing the expansion of the housing sector and eventually of aggregate production itself (spill-over effects no longer work). However, given the power relationship exercised by the United States, the Colombian government had to purchase American military equipment massively, in order to fight against the Colombian guerrillas. By doing so, the economic policy could not stabilize the economy at that time. Besides, the subsequent intensification of the conflict increased the violence within the Colombian territory, thus leading to the migration of skilled workers and to the destruction of infrastructures. The recession had thus been exacerbated. This scenario occurred a few years after 1990, resulting in the worst economic crisis of the 20th century in Colombia with a -5 % recession in 1999. The fourth chapter questions the changes followed by the production and exchange structures because of the opening, to show that these changes did not really contribute to development. Colombia tends to neglect its historic international specialization in coffee and other cultures like wheat, rice, barley, sorghum or cotton, to privilege other cultures whose positive effects on development are lower. As regards the industries of extraction of raw materials (in particular hydrocarbons), they are oriented toward exportation but they promote few development. In addition, the Colombian productive system may lack of this type of input in the future. Finally, if the manufacturing industry was able to increase at the rate of the growth regime, it owes it to the protection still remaining with the differential treatment for developing countries in the World Trade Organization, and less to the export opportunities given by the opening. When this treatment will be eliminated or at least decreased, a whole part of the Colombian economy will be threatened. ; L'ouverture de l'économie colombienne, décidée en 1990, fut présentée comme un promoteur de croissance et développement sur la base des exportations (et des Investissements Directs Etrangers). Cette thèse soutient que l'ouverture n'a pas été décidée afin de favoriser la croissance et le développement et que ces deux phénomènes n'ont pas été à la hauteur de ce qui était anticipé. Ce résultat est fondé sur une analyse en termes d'Economie Politique Internationale : les relations de pouvoir peuvent être utiles pour répondre à des questions d'ordre économique. Le premier chapitre montre que les caractéristiques structurelles de l'économie colombienne rendaient son ouverture impropre à générer croissance et développement sur la base des exportations. Cette proposition s'appuie sur l'analyse de la compétitivité sectorielle et des carences institutionnelles de l'économie colombienne, ainsi que sur l'accroissement potentiel des inégalités spatiales de développement suite à l'ouverture. Le deuxième chapitre s'attache alors à mettre en évidence que l'ouverture répond à des objectifs propres aux Etats-Unis. Ces objectifs sont à dominante économique (typiquement la création des débouchés extérieurs et l'accès à des matières premières) ou politique (lutte contre les guérillas d'inspiration communiste dans le cadre de la politique étrangère américaine). Le deuxième chapitre expose une série des moyens à la disposition des Etats-Unis afin d'obtenir l'ouverture du gouvernement colombien de l'époque. Ces moyens vont de la coercition (par exemple la menace de sanction) à la légitimation (favoriser l'élection d'un gouvernement pro-ouverture). Le troisième chapitre montre que l'ouverture n'a pas instauré un régime de croissance fondé sur les exportations. Au contraire, elle a instauré un régime instable fondé sur une dynamique spéculative sur les actifs immobiliers à partir des flux de capitaux étrangers venant nourrir l'achat de ces actifs à crédit. Lorsque ces capitaux finissent tôt ou tard par manquer, de tels achats sont pénalisés et viennent interrompre la dynamique. Celle-ci ne peut plus tirer la croissance via des effets d'entrainement du secteur de la construction sur le reste de l'économie. Mais pris au piège de la relation de pouvoir exercée par les Etats-Unis, le gouvernement colombien n'a pas cherché à stabiliser la conjoncture. Il a dû privilégier les dépenses en équipement militaire américain pour lutter contre les guérillas colombiennes. L'intensification subséquente du conflit armé a accentué la violence au sein du territoire. Il en résulta la destruction d'infrastructures, ainsi qu'une migration de travailleurs qualifiés. La récession en a été d'autant plus accentuée. Ainsi l'ouverture débouche-t-elle sur la pire crise économique du XXème siècle en Colombie, avec une récession de -5% en 1999. Le quatrième chapitre enquête sur les changements des structures de production et d'échange suite à l'ouverture, pour ainsi montrer que ces changements n'ont que peu favorisé le développement. La Colombie tend à négliger sa spécialisation internationale historique dans le café et la plupart des cultures transitoires (blé, riz, orge, sorgo, coton, etc.) pour privilégier d'autres cultures dont les effets positifs sur le développement sont moindres. Bien que les hydrocarbures et d'autres matières brutes bénéficient d'un certain potentiel d'exportation, le développement des territoires où l'extraction a lieu reste faible. Se pose en outre un problème de soutenabilité de l'extraction. Enfin, si l'industrie manufacturière a pu croitre au rythme du régime de croissance, elle le doit à la protection dont elle bénéficie encore dans le cadre du traitement différentiel des pays en développement à l'Organisation Mondiale du Commerce et moins aux opportunités d'exportation données par l'ouverture. Le jour où ce traitement sera diminué voire supprimé, toute une partie de l'économie colombienne est menacée.

In this third and final article we will deal with methodological schemes for Power Analysis in IR, while indicating areas for possible innovation using the "Arab Spring" cases as illustrations. Power, Outcomes, and what brings them togetherAs we have seen in the last part, the contribution made by Barnett and Duvall with his taxonomy of four dimensions of power is very helpful as theoretical framework; nevertheless, it is still weak to implement as a methodological tool - it is very difficult to distinguish in a real case what is originated through the structure or the actor, as well as to measure if the specificity is direct or diffuse.But the same could be expressed about the majority of the mentioned schemes. In fact, Dahl itself warned about the difficulties of combining variables to compare power relations and argued that it depends on the requirements of the research.1 This complexity is even larger when normative factors are included; for example, despite the proposal of Nye of measuring soft power through polls and focus groups, he also cautioned about the limits of the intangible variables.2 Hurt addresses certain ways of skipping the difficulties in measuring the power of legitimacy, such as examining: the rates of compliance, the reasons given for compliance and for non-compliance, the support given by the centers of Power and the need for legitimacy argument (akin to a counterfactual technique).3 But, once again, no combined power relations framework is presented.In addition, Lukes argues that power depends on the "significance" of the outcomes, namely, in the capacity of affecting the interests of the agents. He refers to two methods: by changing incentives structures (indoctrination) and by influencing interests (subject freedom). However, Lukes confesses that the main question remains open: how to use certain power to shape certain preferences?4In conclusion, in these approaches no power relation mechanism explains, in a measurable way, how material and normative resources are combined to shape power and influence decisions. Therefore, I would like to subsequently suggest a very simple framework that may allow us to implement the knowledge mentioned hitherto to study specific cases in IR.In line with the majority of the authors, in order to make power measurable I consider that we have to divide it in two variables: material power (or simply Power) and legitimation power (or legitimacy). In international politics, the power of an actor is expressed by its military (backed-by-economical) resources, and for the scheme it would receive "high" or "low" values. The legitimacy of the actors, which is based on their capacity to be perceived as norms-compliers and to build consensus around them5, would receive also "high" or "low" values.A power analysis based on the combination of those two variables, as it is shown below in illustration I, leads us to the taxonomy of four types of cases, each one ascribed to an "outcome". It is important to clarify that, for this paper, the outcomes would reflect the domestic situation of the main agent (the State) given an international system; it is a sort of outside-in analysis if we take into account Gourevitch´s second image reversed.6 Further work has to be done to adapt this scheme so as to explain the conduct of the State vis-à-vis other States as well as to include the domestic sphere of legitimacy.The first actor, which has high power and high legitimacy, could describe his situation as "stable"; that means, the actor would overcome the domestic and external challenges without internal changes and high international costs.The second actor, having high power but low legitimacy, is considered to be in a "changeable" situation. Although this actor is capable of overcoming internal and external challenges, due to the fact that it lacks of support from the other actors he could suffer from high international costs and possibly domestic changes.Illustration I – Taxonomy of Power-Legitimacy outcomesPOWERLEGITIMACYHigh PowerLow Power High Legitimacy "STABLE" "PROTECTABLE" Low Legitimacy "CHANGEABLE" "REVOLUTIONABLE" To the third actor, which has low power but high legitimacy, his situation is defined as "protectable". Due to his incapacity to overcome alone the internal and external challenges, this actor may count on the support of other actors to reduce the possibility of domestic changes; otherwise he will suffer from it.The fourth actor, with low power and low legitimacy, is placed in a "revolutionable" situation; that means, this actor is candidate to suffer from internal changes and high international costs at the time he would face challenges.Testing the Power Analysis framework with the "Arab Spring"The phenomenon known as the "Arab Spring", composed of dozens of countries in which massive protests were held, constitutes an outstanding test for the theory. A large quantity of those cases happened in a very short range of time, with all the variety of domestic conditions, reactions from the regime and from the world, as well as different outcomes. This makes those events ideal for the present examination; even though it is just a "sample" of a more deeply study.7Although no State of those that suffered uprisings is considered in a "stable" situation at all, Saudi Arabia and Jordan could be mentioned as good examples of Arab countries that combined high power (relatively, of course) and high legitimacy. Their regimes faced the uprisings from the beginning (mid-January 2011), but were capable of overcoming the internal challenges through a combination of repression and reforms, without suffering changes in their regime and being supported by the international community.Egypt is probably the best representation of a country whose regime kept high power at the moment of facing domestic challenges but received low legitimacy from the world; this "changeable" situation caused drastic changes at the top of the leadership (including the president, ministers, etc), albeit not of the whole regime (still leaded by the Military Council). Syria seems to be in a similar situation; while the power of the regime is still high, the legitimacy is not low enough to bring to major changes due to the sustained support of Russia, China and Iran. As a result, Syria constitutes today an excellent test for the power of legitimacy (and norms) in international politics.Between those countries that experienced a combination of low power and high legitimacy, experiencing a "protectable" situation, it is possible to mention Bahrain. Despite its regime was not capable of overcoming the internal revolts alone, it counted with the support of most of the Arab countries in the repression, and the Western approval of the "regional intervention" leaded by Gulf countries around the GCC. Yemen was in a comparable position, but at the end of 2011 the legitimacy of its regime was reduced when the region and the world understood the necessity to remove the President to maintain the remaining, in what was denominated later "the Yemenite option".Finally, Libya constitutes the case in which the regime was in a "revolutionable" situation, owing to its low Power to contain the rapid domestic rebellion and its low legitimacy after the first days of tremendous repression. The international costs were so high that included a military intervention leaded by NATO (with the endorsement of the Arab League), that led to the total collapse of the regime. It is possible to say that Tunisia was in an analogous situation while it did not need for a civil war and an external intervention to consummate finally a revolution (i.e., the complete removal of the existing regime).ConclusionsThroughout the paper we were able to observe that the ontological, epistemological and methodological discussions about the complex concept of Power maintain their relevance in the main schools of IR, and in some cases even constitute an essential part of their latest developments.At the same time, the inter-paradigmatic efforts of the last decades are demanding new power analysis approaches; that means, theoretical schemes that would embed a combination of the different factors at stake (material and non-material, resources and interactions, agents and structures) to specific cases of study.Deeper examinations of the "Arab Spring" cases need to be implemented so as to confirm the presented findings, as it was previously said. However, these small samples could possibly reveal that the implementation of a framework that combines both material and non-material resources is possible and, even more, desirable, to a better understanding of the devices of power in IR. 1 Robert A. Das Konzept des demokratischen Rechtsstaates, bisher einigendes Fundament und Leitprinzip der europäischen Einigung, steht heute im Zentrum einer kritischen Debatte, die die Grundlagen des europäischen Friedensprojektes zu gefährden droht. Weltweit und insbesondere in Europa wächst die Sorge um den Erhalt der freiheitlich-demokratischen Werte. Populistische Bewegungen gewinnen an Einfluss, indem sie einfache Antworten auf die komplexen Herausforderungen unserer Zeit anbieten. Diese Bewegungen finden vor allem bei denjenigen Anklang, die sich inmitten des raschen gesellschaftlichen und wirtschaftlichen Wandels nach Sicherheit und Beständigkeit sehnen. Sie neigen dazu, sich Lösungen wie nationaler Abschottung und der Etablierung autoritärer Regime zuzuwenden, um ein Gefühl der Sicherheit zu vermitteln (vgl. Möllers 2018, S. 7).Seit der Flüchtlingskrise 2015 haben populistische Strömungen in verschiedenen europäischen Ländern an Zulauf gewonnen. Ungarn und Polen sind prominente Beispiele, in denen rechtsnationale bis rechtsradikale Parteien an die Macht gekommen sind. Diese Regierungen stehen im Widerspruch zu den Grundprinzipien der Europäischen Union, einschließlich der Achtung der Menschenwürde, der Demokratie, der Freiheit, der Gleichheit und der Rechtsstaatlichkeit. Der Umbau des Staatswesens in diesen Ländern zeigt sich insbesondere in der Einschränkung der Unabhängigkeit der Justiz, der Verfassungsgerichtsbarkeit und der Medien (Bundeszentrale für politische Bildung 2022).Besonders in Ungarn, wo seit Viktor Orbáns zweiter Amtszeit im Jahr 2010 ein schleichender Prozess des Demokratieabbaus zu beobachten ist, wird die Bedeutung der Medienregulierung für die demokratischen Strukturen und die politische Landschaft offensichtlich. Die vorliegende Arbeit widmet sich dieser Problematik und beleuchtet, wie die Regulierung der Medien in Ungarn demokratische Prozesse und die politische Szenerie des Landes beeinflusst.Die Arbeit beginnt mit einer grundlegenden Definition des Begriffs "Medien" und einer Erörterung ihrer primären, sekundären und tertiären Funktionen im politischen Raum. Anschließend wird die Nutzung der Medien als Instrument der Regierungskommunikation und als Mittel der Machtsicherung untersucht. Eine Analyse der aktuellen Medienlandschaft in Ungarn, einschließlich der Einschränkungen der Pressefreiheit, der Meinungsvielfalt sowie der Kontrolle und Einflussnahme der Regierung auf die Medienorgane, bildet den Kern der Arbeit.Besonderes Augenmerk wird dabei auf die Medienregulierung in Ungarn gelegt. Die Auswirkungen dieser Medienregulierung auf die Demokratie in Ungarn werden untersucht, um zu verstehen, wie Veränderungen in der Medienlandschaft die Grundpfeiler der Demokratie beeinflussen - die Bedeutung der Medien für eine demokratische Gesellschaft, die Einschränkungen der Demokratie durch Regulierungen in der Medienlandschaft und die politischen Auswirkungen auf das demokratische System. Abschließend wird in einem Fazit reflektiert, inwiefern die Medienregulierung in Ungarn als symptomatisch für eine Verschiebung weg von demokratischen Idealen gesehen werden kann.Ziel der Arbeit ist es, ein Verständnis der komplexen Wechselwirkungen zwischen Medienregulierung und demokratischen Prozessen in Ungarn zu erlangen und damit einen Beitrag zur aktuellen Debatte über die Bedeutung liberaler demokratischer Werte in Europa zu leisten.Die Rolle der Medien in der PolitikDer folgende Abschnitt befasst sich mit der Rolle der Medien in der Politik. Im Mittelpunkt steht dabei die differenzierte Betrachtung der primären, sekundären und tertiären Funktionen der Medien. Mit Hilfe dieser Unterscheidung ist es möglich, ein tieferes Verständnis dafür zu entwickeln, wie Medien die politische Landschaft gestalten und beeinflussen. Durch die Analyse dieser Funktionen wird untersucht, wie Medien Öffentlichkeit herstellen, Informationen verbreiten, politische Akteure kontrollieren und zur politischen Sozialisation und Bildung beitragen. Dies ist von entscheidender Bedeutung, um die komplexen Wechselwirkungen zwischen Medien und Politik vollständig zu erfassen. Primär-, Tertiär- und SekundärfunktionDie Macht der Massenmedien, bestehende Machtstrukturen herauszufordern, darf nicht unterschätzt werden. Durch die Sammlung, Aufbereitung und Verbreitung von Informationen, Wissen und politischen Ansichten wird die öffentliche Meinung wesentlich beeinflusst (Wittkämper, S. 37). Bereits in der Frühen Neuzeit erkannten der Adel und die Kirche als damalige Machthaber die potenzielle Bedrohung, die von den Medien ausging. Sie reagierten schnell und führten nach der Entdeckung des Buchdrucks Zensurmaßnahmen ein, um die zu druckenden Inhalte vorzuprüfen und ihre Herrschaft zu sichern (Strohmeier 2004, S. 69).In der heutigen Zeit spielen die Medien eine zentrale Rolle bei der Gestaltung der politischen Realitäten, da sie in der Lage sind, die politische Macht entweder zu stärken oder zu untergraben (Strohmeier 2004, S. 69). Ziel der folgenden Ausführungen ist die Veranschaulichung des Einflusspotenzials der Massenmedien durch die Darstellung ihrer grundlegenden Funktionen.Gerd Strohmeier weist auf die Bedeutung der primären, der sekundären und der tertiären Funktion der Massenmedien hin. Die Primärfunktion besteht darin, Öffentlichkeit herzustellen, die entsteht, wenn direkte Kommunikationsformen bevölkerungsbedingt nicht ausreichen. Massenmedien ermöglichen eine schnelle und einfache Verbreitung von Nachrichten und füllen so diese kommunikative Lücke (Strohmeier 2004, S. 72).Die Kontrolle der politischen Akteure und die Verbreitung von Informationen gehören zu der Sekundärfunktion. Ziel ist die umfassende und verständliche Vermittlung von Inhalten und damit die Beeinflussung der Meinungsbildung. Zugleich haben Massenmedien die Aufgabe, das Verhalten der politischen Institutionen zu überwachen, Missstände aufzudecken und Kritik zu üben (Strohmeier 2004, S. 72f.).Die Tertiärfunktion der Medien umfasst drei wesentliche Aspekte. Erstens die Förderung der politischen Meinungs- und Willensbildung, zweitens die Integration und politische Sozialisation und drittens die Vermittlung politischer Bildung. Diese Aspekte unterstützen die Entwicklung der Persönlichkeit des Einzelnen und seine Integration in die Gesellschaft, fördern das Verständnis für das politische System und regen zur aktiven Teilnahme am politischen Leben an. Darüber hinaus haben die Massenmedien einen entscheidenden Einfluss auf die Art und Weise, wie über bestimmte Themen nachgedacht und gesprochen wird, oft ohne dass sich die Menschen der Beeinflussung ihrer Meinungen durch die Medien bewusst sind (Strohmeier 2004, S. 73f.).Medien als InstrumentIm nächsten Schritt unserer Analyse konzentrieren wir uns auf die Rolle der Medien als politisches Werkzeug. Dabei unterteilt sich unsere Betrachtung in zwei Schlüsselaspekte. Einerseits die Nutzung der Medien für Regierungskommunikation, durch die Regierungen ihre Botschaften vermitteln, und andererseits die Anwendung der Medien als Mittel zur Machtsicherung, wodurch Einfluss auf die öffentliche Meinung genommen und politische Macht gefestigt wird.Medien als Instrument für RegierungskommunikationDie strategische Nutzung der Medien durch die Regierung wird vor allem in Bezug auf den Einfluss der Mediengesetzgebung auf die Demokratisierungsprozesse und die Politikgestaltung in Ungarn untersucht. Durch die gezielte Verbreitung politischer Botschaften und Entscheidungen interagieren Regierungen direkt mit der Bevölkerung, was nicht nur die Verbreitung von Informationen fördert, sondern auch die öffentliche Meinung prägt und politische Unterstützung generiert.Um den Rechtspopulismus zu verstehen, ist es notwendig, sich mit Cas Muddes Definition des Populismus auseinanderzusetzen, der Populismus als eine Ideologie betrachtet, die die Gesellschaft in zwei homogene und antagonistische Gruppen teilt: "das reine Volk" gegenüber "der korrupten Elite", wobei Politik als Ausdruck des allgemeinen Volkswillens verstanden wird (Mudde 2004, S. 543). Die Tendenz, dass rechtspopulistische Parteien seit den 1980er Jahren Wahlerfolge erzielen und sich etablieren, zeigt sich nicht nur in westeuropäischen, sondern auch in jungen Demokratien Osteuropas, einschließlich Ungarns (Geden 2006, S. 17f.).Rechtspopulisten positionieren sich als Vertreter der "schweigenden Mehrheit" in direktem Gegensatz zu den politischen und kulturellen Eliten und privilegierten Minderheiten, denen sie die Verfolgung partikularer Interessen vorwerfen (Geden 2006, S. 20f.). Ihre politische Rhetorik ist durch Vereinfachung und Komplexitätsreduktion gekennzeichnet, wobei sie sich organisatorisch von den etablierten Parteien abgrenzen, etwa durch die Zusammenarbeit mit außerparlamentarischen Gruppen, die Initiierung von Volksentscheiden oder die Präsenz charismatischer Führungspersönlichkeiten (Geden 2006, S. 22).Ein zentrales Element rechtspopulistischen Denkens ist der "Ethnopluralismus", der besagt, dass sich ethnisch und kulturell homogene Völker nicht vermischen sollten, was eine inhärente Ungleichheit der Völker suggeriert und kulturelle Begegnungen als konfliktträchtig ansieht (Bruns et al. 2015, S. 12f.).Im spezifischen Kontext Ungarns unter der Führung von Viktor Orbán zeigt sich die kritische Rolle dieser Medienstrategien. Die Regierung Orbán hat Medienregulierung bewusst eingesetzt, um ein medienfreundliches Umfeld für regierungsnahe Nachrichtenquellen zu schaffen und gleichzeitig den Raum für kritische Stimmen einzuschränken (Mudde 2004, S. 543). Dies schränkt nicht nur die Vielfalt und Freiheit der Medien ein, sondern hat auch tiefgreifende Auswirkungen auf demokratische Prozesse, indem es die Möglichkeiten für eine offene politische Debatte einschränkt.Diese strategische Nutzung der Medien für die Regierungskommunikation verdeutlicht die Doppelnatur der Medien in der Politik. Einerseits als Kanäle für die transparente Kommunikation politischer Inhalte und andererseits als Instrumente der Machtkonsolidierung, die die demokratischen Grundlagen untergraben können. Diese Dynamik ist entscheidend für das Verständnis der politischen Situation in Ungarn und der Rolle, die die Medienregulierung dabei spielt (Geden 2006, S. 17f.).Detlef Grieswelle betont in "Politische Rhetorik: Macht der Rede, öffentliche Legitimation, Stiftung von Konsens" die bedeutende Rolle der Rhetorik in der Politik. Rhetorik dient nicht nur der Durchsetzung und Legitimation von Macht, sondern auch der Kontrolle und Repräsentation von Interessen, was ihre Bedeutung als Instrument politischer Führung und Einflussnahme unterstreicht (Grieswelle 2000, S. 33). In diesem Zusammenhang ist die rhetorische Strategie des ungarischen Ministerpräsidenten von besonderer Relevanz, da mit ihr versucht wird, politische Legitimität für diese Vision zu schaffen und die Unterstützung der Bevölkerung zu gewinnen (Bruns et al. 2015, S. 12f.).Medien als Werkzeug zur Sicherung von MachtUm zu verstehen, wie die Medien zum Machterhalt beitragen, ist die Rhetorik von rechtspopulistischen Figuren wie Viktor Orbán besonders aufschlussreich. Orbán nutzt plakative und skandalträchtige Kommunikationswege, um mediale Aufmerksamkeit zu generieren die nicht nur seine Präsenz in der Öffentlichkeit stärkt, sondern auch eine Mobilisierung seiner Anhängerschaft bewirkt (Schnepf 2020, S. 5). In seinen politischen Reden kehren bestimmte rhetorische Muster immer wieder, darunter die Verwendung von Antagonismen, die eine Konfliktsituation erzeugen, insbesondere durch die Gegenüberstellung von "Elite" und "Volk". Dabei wird das "Volk" als unterdrückt dargestellt, während die rechtspopulistische Partei als volksnah inszeniert wird (Mudde 2004, S. 543). Eine charakteristische Einfachheit in den Botschaften rechter Parteien wird von Bischof und Senninger hervorgehoben. Je weiter rechts eine Partei steht, desto einfacher ist ihr Programm (Bischof/Senninger 2018, S. 484). Solche Diskurse verwenden prägnante und leicht verständliche Formulierungen für ansonsten komplexe politische Sachverhalte, suggerieren einfache Lösungen und nutzen Dramatisierungen und Metaphern. Insbesondere werden Migrant*innen durch metaphorische Vergleiche abgewertet (Hogan/Haltinner 2015, S. 533) und es wird auf die Bedrohung der nationalen Identität durch ethnische Minderheiten und Migrant*innen angespielt, ein Vorgehen, das Ruth Wodak als "politics of fear" beschreibt (Wodak 2015, S. 2).Diese Elemente rechtspopulistischer Rhetorik finden sich in Orbáns Äußerungen deutlich wieder, wie einige seiner Reden und Interviews exemplarisch zeigen. Besonders deutlich wird dies in seiner Darstellung von Migration als Bedrohung für das ungarische Volk, wobei er einen alarmistischen Ton anschlägt, um die migrationskritische Haltung der Regierung zu untermauern und ein Klima der Angst zu erzeugen: "Europa wird von einer beispiellosen Masseneinwanderung bedroht. (...) Wir sprechen heute von Hunderttausenden, nächstes Jahr werden es Millionen sein, ein Ende ist nicht in Sicht" (Orbán, zitiert nach Mendelski 2019, S. 8). Orbáns Wortwahl, in der er von der "Wahrheit" spricht, verdeutlicht seine Überzeugung von der Legitimität seiner Politik, wobei er durch Übertreibungen wie "Millionen", "massive Integration" oder "unerwartetes Ausmaß" eine Atmosphäre der Panik schafft.In einer Rede anlässlich seiner Vereidigung als Ministerpräsident präsentierte Orbán seine Vision einer Demokratie, die er als "christdemokratisch im 21. Jahrhundert" bezeichnete und damit ein stark von christlichen Werten geprägtes Bild nationaler Identität entwarf, das traditionelle Familienbilder bevorzugt und Homosexualität ausgrenzt. Diese Ausführungen zeigen, wie Orbán die Medien nutzt, um seine politische Botschaft zu verstärken und wie er die Medien als Instrument zur Sicherung seiner Macht einsetzt, indem er sich einer Rhetorik bedient, die sowohl mobilisiert als auch polarisiert, um seine Position zu festigen und Herausforderungen zu kontrollieren.Analyse der aktuellen Medienlandschaft in UngarnDer folgende Teil der Arbeit befasst sich mit der aktuellen Medienlandschaft in Ungarn. In der ersten Amtszeit Orbáns zwischen 1998 und 2002 gab es kaum Eingriffe in die Pressefreiheit, was auf mehrere Faktoren zurückzuführen ist. Da Ungarn in dieser Zeit noch auf den EU-Beitritt hinarbeitete, vermied Orbán bewusst Auseinandersetzungen mit der Europäischen Union über Fragen der Pressefreiheit. Dies änderte sich jedoch in der darauffolgenden Amtszeit ab 2010 drastisch: Ein neues Gesetz wurde eingeführt, das staatlichen Stellen die Einflussnahme auf die Medien ermöglichte und deren Regulierung legitimierte. Fortan nutzte die Regierung Orbán die Medien gezielt für ihre politischen Ziele.Einschränkungen der Pressefreiheit und Meinungsvielfalt in UngarnDas Beispiel Ungarns zeigt den Übergang von einem Demokratisierungsprozess zu einem schleichenden Verlust demokratischer Strukturen. Ursprünglich galt Ungarn aufgrund seiner politischen Fortschritte und wirtschaftlichen Stabilität in den späten 1990er und frühen 2000er Jahren als Vorbild unter den EU-Beitrittskandidaten. Nach dem Fall der kommunistischen Einparteienherrschaft (1949-1989) und der Etablierung einer parlamentarischen Demokratie (ab 1990) unternahm das Land erhebliche Anstrengungen, um eine demokratische Staatsform zu etablieren. Wichtige Reformen dieser Zeit schufen unter anderem eine klare Trennung der Staatsgewalten (Legislative, Exekutive, Judikative) und die neue Verfassung verankerte Prinzipien wie Rechtsstaatlichkeit und Unabhängigkeit der Justiz (Ismayr 2002, S. 310ff.).Seit 2010 hat Viktor Orbán mit seiner Fidesz-Partei jedoch einen politischen Kurs eingeschlagen der den zuvor eingeleiteten Demokratisierungsprozess nicht nur gestoppt, sondern in einigen Bereichen sogar rückgängig gemacht hat. Ein 2010 verabschiedetes Mediengesetz, das es staatlichen Stellen erlaubt, die Medien zu überwachen und bei Verstößen zu sanktionieren, markiert einen Wendepunkt in der Einschränkung der Pressefreiheit und ist ein zentraler Faktor im Demokratieabbau des Landes (Bajomi-Lazar 2018, S. 273ff.). Freedom House hebt hervor, dass von allen Kriterien zur Bewertung des Zustands von Demokratie und Rechtsstaatlichkeit gerade die Pressefreiheit in Ungarn die dramatischsten Einbußen zu verzeichnen hat (Bajomi-Lazar 2018, S. 273).Die ungarische Medienlandschaft hat sich seit der Regierungsübernahme durch Orbán und Fidesz sukzessive verändert. Die Regierung kontrolliert den öffentlich-rechtlichen Rundfunk, die staatliche Nachrichtenagentur Magyar Tavirati Iroda sowie einen erheblichen Teil der privaten Medien, die sich im Besitz von Orbán nahestehenden Personen befinden. Im Rahmen einer umfassenden Umstrukturierung wurden 570 leitende Angestellte der Rundfunkanstalten durch der Fidesz-Partei loyale Mitarbeiter ersetzt (Bajomi-Lazar 2018, S. 275f.).Für die regionale Berichterstattung sind seit Sommer 2017 ausschließlich unternehmerfreundliche Medien zuständig. Mit der Schließung einiger kritischer Zeitungen, darunter die überregionalen Blätter Nepszabadsag und Magyar Nemzet, ist die kritische Berichterstattung landesweit nahezu zum Erliegen gekommen. Zudem werden Journalisten, die sich kritisch über Orbán und seine Regierung äußern, nicht selten auf "schwarze Listen" gesetzt, eine Praxis, die offensichtlich darauf abzielt, Kritiker einzuschüchtern (Bajomi-Lazar 2018, S. 280).Kontrolle und Einflussnahme der Regierung auf MedienorganeEin neues Medienpaket mit Änderungen des Medien- und Pressegesetzes trat am 01.01.2011 durch die Regierung Orban in Kraft. Dieses sorgte damals europaweit für Schlagzeilen. Die Rechtsstaatlichkeit des Gesetzes wurde von der EU-Kommission angezweifelt. Auf einige Aspekte soll im Folgenden kurz eingegangen werden.Die Unabhängigkeit der Medien wurde durch das Mediengesetz erheblich geschwächt. Das Mediengesetz sah unter anderem ein Verbot bestimmter Äußerungen vor und legte eine Registrierungspflicht für alle Medien fest. Es drohte die Löschung und der Entzug der rechtlichen Möglichkeit, in Ungarn zu publizieren, wenn der Registrierungspflicht nicht nachgekommen wurde. Dies galt auch für Medienunternehmen, die außerhalb Ungarns in anderen Staaten der Europäischen Union (EU) tätig waren.Die Aufsicht über die Medien wurde nicht mehr von verschiedenen Behörden, sondern von einem einzigen Medienkontrollgremium ausgeübt. Das Medienkontrollgremium war für die Verhängung von Geldstrafen bei "politisch unausgewogener Berichterstattung" (Möllers 2018, S. 47) zuständig. Hinzu kam, dass viele Journalistinnen und Journalisten, die für den staatlichen Rundfunk arbeiteten, entlassen wurden und beispielsweise privaten, regierungskritischen Medien erschwert wurde, eine Rundfunklizenz zu erhalten. Die EU konnte durch die Androhung eines Vertragsverletzungsverfahrens zumindest eine Änderung der "EU-Ausländer betreffenden Aspekte" (Möllers 2018, S. 47) erreichen.MediengesetzgebungNoch bevor Ungarn seine neue Verfassung verankerte, stand die Regierung aufgrund der Verabschiedung eines restriktiven Mediengesetzes unter Beschuss. Das Gesetz, welches im Januar 2011 in Kraft trat, beschränkt deutlich die Freiheit der Medien und Presse (Salzborn 2015, S. 76). Das Hauptziel dieser Maßnahme ist die Dominanz der Regierung Orbáns über das Mediengefüge. Zu diesem Zweck wurde die Nationale Kommunikations- und Medienbehörde ("KESMA") ins Leben gerufen. Diese Behörde und der Medienrat erhielten erweiterte Befugnisse zur Überwachung und Lizenzierung von Medienangeboten. Unter anderem ist die Nationale Kommunikations- und Medienbehörde verantwortlich für die Vergabe von Sendelizenzen und übernimmt Aufgaben im Bereich des Verbraucher- und Wettbewerbsschutzes. Eine der Hauptaufgaben des Medienrates ist die Gewährleistung einer Berichterstattung (Bos 2021, S. 38). Neben der Neustrukturierung des Medienwesens führte die Regierung ein Fördermodell ein, das regierungsnahe Medien durch staatliche Werbeverträge finanziell unterstützt.Nach den Wahlen im Jahr 2014 erwarben Unternehmer, die der Regierung nahestehen, zunehmend Medien der Opposition, die anschließend in die neu geschaffene "Mitteleuropäische Presse- und Medienstiftung" eingebracht wurden (Bos 2021, S. 38). So schaffte es die Regierung Orbán, einflussreiche Medien der Opposition zu marginalisieren oder vollständig vom Markt zu nehmen. Ebenso wurden Online-Nachrichtenplattformen in das System eingegliedert (Bos 2021, S. 39).Samuel Salzborn kritisiert insbesondere den rechtlichen Charakter des neuen Mediengesetzes, das vage Generalklauseln beinhaltet, welche sich auf unbestimmte Konzepte wie "gute Sitten" berufen. Diese Klauseln sind offen für Interpretationen und ermöglichen damit eine gewisse Willkür. Die Definition dessen was als "gute Sitte" gilt kann staatlich bestimmt und gegen kritische Berichterstattung eingesetzt werden, was deren Sanktionierung zur Folge haben kann (Salzborn 2015, S. 77).Auswirkungen der Medienregulierung auf die Demokratie in UngarnNachdem im vorangegangenen Kapitel die aktuelle Medienlandschaft in Ungarn dargestellt wurde, widmet sich der folgende Abschnitt den Auswirkungen der Medienregulierung auf die demokratische Verfasstheit Ungarns. Anhand konkreter politischer Maßnahmen der ungarischen Regierung wird untersucht, wie die Visionen Orbáns umgesetzt wurden. Darüber hinaus wird analysiert, inwiefern die rechtspopulistische Politik die Qualität der ungarischen Demokratie beeinflusst und verändert hat.Bedeutung der Medien für die demokratische GesellschaftIm Zentrum der Debatte um die Rolle der Medien in der demokratischen Gesellschaft Ungarns steht die Transformationspolitik Viktor Orbáns und seiner Fidesz-Partei, die seit ihrem Regierungsantritt eine umfassende Kontrolle über die Medienlandschaft ausüben. Die Regierung nutzt diese Kontrolle strategisch als Instrument der Regierungskommunikation, um eine fast ausschließlich positive Berichterstattung über ihre Handlungen und Entscheidungen sicherzustellen. Regierungskritische Stimmen finden kaum Gehör, stattdessen wird Kritik systematisch unterdrückt und negative Nachrichten werden in einem für die Regierung vorteilhaften Licht dargestellt. Die gezielte Durchführung von Desinformationskampagnen, die Bajomi-Lazar als "Propaganda" bezeichnet, ist ein weiterer Baustein dieser Medienpolitik (Bajomi-Lazar 2018, S. 280f.).Die Verpflichtung von Arthur J. Finkelstein, einem erfahrenen Kampagnenstrategen aus den USA, durch Viktor Orbán unterstreicht den gezielten Einsatz der Medien zur Meinungsbildung. Das Phänomen der Verbreitung von teilweise oder vollständig gefälschten Nachrichten ist zwar kein Alleinstellungsmerkmal der ungarischen Medienlandschaft, die offene Zurschaustellung dieser Praktiken durch die ungarische Regierung ohne den Versuch, ihre Aktivitäten zu verschleiern, stellt jedoch einen klaren Bruch mit demokratischen Normen dar (Bajomi-Lazar 2018, S. 281).Diese Entwicklung wirft grundsätzliche Fragen nach den Auswirkungen der Medienregulierung auf die Demokratie in Ungarn auf. Die Einflussnahme auf die Medien und die damit einhergehende Unterdrückung pluralistischer Diskurse hat unmittelbare Folgen für die demokratische Gesellschaft. Indem die Medien als verlängerter Arm der Regierungskommunikation fungieren und kritische Berichterstattung marginalisiert wird, werden demokratische Grundwerte wie Meinungsvielfalt und Pressefreiheit massiv untergraben. Die strategische Manipulation der Medienlandschaft durch die Regierung Orbán verdeutlicht die Herausforderungen vor denen die Demokratie in Ungarn steht und unterstreicht die zentrale Rolle der Medienfreiheit als Grundpfeiler einer lebendigen und funktionierenden demokratischen Gesellschaft. Einschränkung der Demokratie durch Regulierungen in der MedienlandschaftDie Regulierung der Medienlandschaft in Ungarn durch Viktor Orbán und seine Fidesz-Partei hat weitreichende Folgen für die Demokratie im Land. Durch die systematische Übernahme und Anpassung der Medien an ihre Vorstellungen, insbesondere durch die Besetzung der Führungspositionen in den wichtigsten Medienorganisationen mit Verbündeten der Regierung, haben sie die Medien zu einem Instrument der Machtsicherung gemacht. Die Aufhebung der Unabhängigkeit der Medien ermöglicht es der Orbán-Regierung, die Berichterstattung vollständig für ihre politischen Ziele zu instrumentalisieren. Es dominiert eine einseitige Berichterstattung, die den Bürgern vor allem in den ländlichen Regionen wenig Spielraum lässt die Authentizität und Richtigkeit der präsentierten Nachrichten zu überprüfen. Die Bürger Ungarns stehen vor der Herausforderung, dass sie kaum Zugang zu alternativen Perspektiven oder kritischen Stimmen haben, was sie quasi dazu zwingt, den regierungsgesteuerten Nachrichten Glauben zu schenken (Bajomi-Lazar 2018, S. 281/282).Diese Einschränkung der Medienfreiheit und die Manipulation der Informationslandschaft durch die Regierung Orbán untergraben grundlegende demokratische Prinzipien, indem sie den freien Zugang zu Informationen einschränken und eine fundierte öffentliche Meinungsbildung verhindern. Durch die gezielte Meinungsmache und die Abschottung gegenüber kritischen Debatten werden die natürlichen demokratischen Kontrollmechanismen geschwächt und die Bevölkerung als Kontrollinstanz der Regierung faktisch entmachtet. Die Strategie, die Macht über die Medien zu festigen und dafür zu sorgen, dass keine Gegenmeinungen an die Öffentlichkeit gelangen oder Widerstand gegen politische Entscheidungen leisten können, ist ein deutliches Zeichen für den Missbrauch von Medienmacht zur Festigung autoritärer Strukturen.Diese Entwicklungen in Ungarn verdeutlichen die zentrale Bedeutung einer unabhängigen und pluralistischen Medienlandschaft für den Erhalt einer gesunden Demokratie. Die Einschränkung der Pressefreiheit und die gezielte Manipulation der Medien durch die Regierung stellen eine ernsthafte Bedrohung für die demokratischen Prozesse und die politische Freiheit im Land dar. Politische Auswirkungen auf das demokratische System UngarnsDie politischen Auswirkungen der Regulierung der Medien auf das demokratische System in Ungarn sind tiefgreifend und haben zu einer Verschlechterung der Qualität der Demokratie im Land geführt. Diese Veränderungen spiegeln sich in verschiedenen internationalen Indizes wider, die die demokratische Stabilität Ungarns bewerten. Der "Freedom in the World Index" von Freedom House stuft Ungarn als "teilweise frei" ein, da die Fidesz-Partei die Kontrolle über unabhängige Institutionen erlangt hat, was zu einer Schwächung der Aktivitäten von Oppositionellen, Journalisten, Universitäten und NGOs geführt hat (Freedom House 2021). Der "Nations in Transit Index" bezeichnet Ungarn sogar als "Transitional or Hybrid Regime" mit einem Wert von 49 von 100 Punkten, wobei 100 Punkte für eine funktionierende Demokratie stehen (Freedom House 2021b). Der Bertelsmann Transformationsindex beschreibt Ungarn als "defekte Demokratie", in den demokratischen Institutionen zwar existieren, aber eingeschränkt und ineffektiv sind (Bertelsmann Stiftung 2020, S. 13).Deutlich verschlechtert hat sich zudem die Platzierung Ungarns in der Rangliste der Pressefreiheit von "Reporter ohne Grenzen", wo das Land nur noch auf Platz 92 von 180 Ländern rangiert und die Situation der Pressefreiheit als problematisch eingestuft wird (Reporter ohne Grenzen 2021). Der "Rule of Law Index" des World Justice Project weist Ungarn den niedrigsten Wert in Osteuropa zu, weltweit liegt es auf Platz 60 von 128 (World Justice Project 2020).Diese Indizes und Bewertungen zeigen, dass die von Viktor Orbán vorangetriebene politische Transformation direkte negative Auswirkungen auf die Qualität der Demokratie in Ungarn haben. Einige Autoren wie Attila Ágh sprechen von der "ungarischen Krankheit" als antidemokratischer Herausforderung für die EU und beschreiben das Land als "worst case scenario" einer "elected autocracy" (Ágh 2015, S. 4, S. 16). János Kornai sieht in der Entwicklung seit Orbáns Amtsantritt eine Abkehr von Demokratie und Errungenschaften des Systemwechsels Ende der 1980er, einen "U-Turn" (Kornai 2015, S. 1). Samuel Salzborn identifiziert eine transformatorische Entwicklung hin zu einer Diktatur, bedingt durch rechtliche Veränderungen und eine zunehmende Ethnisierung der Innenpolitik (Salzborn 2015, S. 81).Andere Forscher sprechen von einem "hybriden Regime" und positionieren Ungarn in einer Grauzone zwischen Demokratie und Autokratie. András Bozóki und Dániel Hegedüs betonen, dass hybride Regime eine eigenständige Kategorie darstellen, die weder als Unterform der Demokratie noch der Diktatur zu verstehen ist (Bozóki/Hegedüs 2018, S. 1183). Attila Antal betont, dass das Orbán-Regime seine politische Anhängerschaft gezielt repolitisiert und den Rest der politischen Gemeinschaft depolitisiert hat (Antal 2017, S. 18).SchlussfolgerungDas Phänomen des Demokratieabbaus, beobachtet nicht nur in Ungarn, sondern weltweit und innerhalb Europas, unterstreicht eine kritische Herausforderung für die demokratische Ordnung vieler Staaten. Die systematische Einschränkung der Presse- und Meinungsfreiheit in Ungarn seit Viktor Orbáns zweiter Amtszeit im Jahr 2010 zeichnet ein beunruhigendes Bild der Degradierung demokratischer Werte, das weit über die Grenzen Ungarns hinausreicht und die europäische Gemeinschaft insgesamt betrifft (Möllers 2018, S. 7; Ismayr 2002, S. 309ff.).Die zentrale Rolle der Medien in einer Demokratie, hervorgehoben durch ihre vielfältigen Funktionen wie die Schaffung von Öffentlichkeit, Informationsvermittlung, Kontrolle der Macht, soziale Integration und Bildung, unterstreicht die Bedeutung der Medienfreiheit für das Funktionieren einer demokratischen Gesellschaft (Strohmeier 2004, S. 69ff.). Die Kontrolle über die Massenmedien zu haben bedeutet, einen entscheidenden Einfluss darauf zu besitzen, welche Informationen die Bevölkerung erhält und wie sie die politische Realität wahrnimmt.Ungarns Entwicklung seit 2010 unter der Fidesz-Regierung ist besonders alarmierend, da sie zeigt, wie gezielt Propaganda eingesetzt wird, um die Regierungsperspektive zu stärken und oppositionelle Stimmen effektiv zum Schweigen zu bringen. Die offene Ausführung dieser Maßnahmen und das scheinbare Desinteresse der Regierung, ihre Aktionen zu verbergen, verdeutlichen eine besorgniserregende Gleichgültigkeit gegenüber demokratischen Standards (Bajomi-Lazar 2018, S. 281f.). Trotz der Transparenz dieser Aktivitäten hat die Europäische Union bisher wenig Einfluss auf eine positive Veränderung nehmen können, was den Demokratieabbau in Ungarn weiter vorantreibt.Die Situation in Ungarn ist nicht isoliert zu betrachten, sondern stellt ein ernstes Problem für die EU dar, da es die konstitutionellen und demokratischen Grundlagen der Gemeinschaft untergräbt. Die aktuellen Entwicklungen in Ungarn sind ein Warnsignal und erfordern eine dringende und koordinierte Reaktion auf europäischer Ebene, um die Demokratie zu schützen und zu fördern. Die Frage, wie die Medienregulierung in Ungarn die demokratischen Prozesse und die politische Landschaft des Landes beeinflusst, lässt sich klar beantworten: Sie führt zu einer erheblichen Einschränkung der Demokratiequalität, indem sie die freie Meinungsäußerung untergräbt, die politische Pluralität einschränkt und die Kontrollfunktion der Medien schwächt.Die Hoffnung liegt nun darauf, dass die internationale Gemeinschaft und europäische Institutionen wirksame Maßnahmen ergreifen, um die demokratischen Prinzipien in Ungarn zu stärken und einen weiteren Demokratieabbau zu verhindern. Die Bewahrung der Medienfreiheit und die Sicherstellung einer pluralistischen und unabhängigen Medienlandschaft sind essenziell für die Aufrechterhaltung einer lebendigen und gesunden Demokratie, nicht nur in Ungarn, sondern in allen demokratischen Staaten. 1. Kapitel: Einleitung Das Kapitel der Einleitung erläutert die Zielsetzung und Fragestellung dieser Arbeit unter Angabe der verwendeten Primärquellen, zu denen die Zeitungsartikel, Archivdokumente, die Transkriptionen der qualitativen Interviews gehören sowie den aktuellen Forschungsstand. Ziel dieser Arbeit ist es zum einen, auf inhaltlicher Ebene die Auto- und Heterobilder sowie Stereotype in der westdeutschen und britischen überregionalen Presse herauszuarbeiten und diese vor dem Hintergrund des außenpolitischen bilateralen Verhältnisses zu interpretieren. Zum anderen sollen jene Eigen- und Fremdbilder strukturell in die Argumentationen der jeweils nationalen Pressetexte eingeordnet werden und auf ihre Funktion hin überprüft werden. In der vorliegenden Dissertation wird angenommen, dass Stereotype und Bilder "des Anderen" gezielt in die Argumentationen der nationalen Pressetexte eingebettet sind und dort argumentative Funktionen erfüllen, wie etwa die Verstärkung eines Arguments oder die Herstellung von Plausibilität, Interpretation und Einordnung eines Ereignisses oder dessen gesellschaftliche Legitimation. Daher verbindet diese Arbeit die Methodik der "Kritischen Diskursanalyse" (KDA) mit der "Imagologie". Das Forschungsparadigma der KDA lautet nach Siegfried Jäger, den Diskurs auf seine ikonographischen Mittel hin zu untersuchen. Manfred Beller und Joep Leerssen definieren den Forschungsanspruch der Imagologie wie folgt: "Imagology aims to understand a discourse rather than a society". Weder die KDA gelangt zu einer näheren Klassifizierung der zu untersuchenden "ikonographischen Mittel", noch unternimmt die "Imagologie" den Versuch, den Begriff "discourse" näher zu bestimmen. Daher wird in dieser Arbeit diese Lücke geschlossen und beide Methodiken an ihrer Schnittstelle miteinander verbunden. Es ist das Hauptanliegen dieser Arbeit, die diskursive Konstruktion des deutsch-britischen Verhältnis im jeweiligen Pressediskurs beider Länder im Untersuchungszeitraum dieser Arbeit tiefgreifend zu analysieren und die dem jeweiligen Diskurs zugrundeliegenden "Aussagen" im Sinne Foucaults herauszuarbeiten. Zudem sollen allgemein-gültige Ergebnisse zur Tradierung von Stereotypen und dem positiven und negativen Tenor der überregionalen Berichterstattung unter Berücksichtigung des außenpolitischen Kontextes in Betracht gezogen werden. Die Auswirkungen des Pressediskurses auf das öffentliche Denken soll anhand von Archivdokumenten bzw. von qualitativen Interviews punktuell gezeigt werden. 2. Kapitel: Diskurs und Kritische Diskursanalyse Im zweiten Kapitel wird zunächst der Diskursbegriff nach Michel Foucault mit den Wirkmechanismen und Strukturen von Diskursen begründet. Wichtig dabei ist der "Wissen/Macht-Komplex", der die diskursive Aushandlung von "allgemein gültigem Wissen" innerhalb einer Gesellschaft beschreibt. Dieses "Wissen" enthält die Tradierung gültiger Argumentationsformen inklusive Eigen- und Fremdbilder in der Presse. Der Begriff "Aushandlung" impliziert dabei, dass es sich um einen diffizilen diskursiven Prozess handelt. "Wissen und Macht" sind laut Foucault intrinsisch miteinander verbunden. Macht generiert Wissen, Wissen impliziert Macht. Demnach haben die als gültig ausgehandelten Argumentationsformen und Bilder in den Pressetexten eine Wirkungsmacht, Bewusstsein innerhalb einer Gesellschaft formen. In Foucaults diskursanalytische Theorien, die selbst keine konkreten Analyseschemata zur Untersuchung von (Medien-) Diskursen beinhalten, fließen die Weiterführungen von Sara Mills, Ruth Wodak und Norman Fairclough mit ein. Konkrete Vorgaben zur praktischen Analyse von Mediendiskursen legte der Linguist Sigfried Jäger des Duisburger Instituts für Sprach- und Sozialforschung vor. Jäger definiert verschiedene Diskursebenen innerhalb einer Gesellschaft, bei denen der Mediendiskurs zwischen der Politiker- und Alltagsebene angesiedelt ist. Jäger beschreibt, dass der Mediendiskurs in sich relativ homogen ist, da die großen Leitmedien ihre Informationen von wenigen offiziellen Presseagenturen beziehen. Dies bedeutet, dass die Nachrichten zur Aktualität im Fernsehen relativ gleich denen im Radio oder den Zeitungen sind. Im Fall dieser Arbeit ist bestätigt, dass die Presse den dominanten Mediendiskurs sowohl in der BRD als auch in GB zur politischen Information darstellt. Die Pressetexte mit ihren Argumenten, ihrem Tenor und den Selbst- und Fremdbildern zu den Ereignissen der zweiten Berlin-Krise hatten demnach eine große Wirkung auf ihre Leser, zu denen nachweislich auch die Regierungsoberhäupter Adenauer und Macmillan zählen. Trotz der angenommen Homogenität des Mediendiskurses besitzt jede Presse- und Medieninstitution eine eigene "diskursive Position" gemäß ihrer Ausrichtung, die nachhaltig den Tenor ihrer Nachrichten bestimmen. Grundsätzlich teilt man in einer Gesellschaft Wissen darüber, welche Ausrichtung die "großen Zeitungen" haben. So ist etwa der Guardian und die SZ sozialliberal, die Times, FAZ, Die Welt und der Daily Telegraph konservativ eingestellt. Darüber hinaus teilt Jäger die Presseberichterstattung in ihre Bestandteile. Diese sind etwa die Berichterstattung über ein bestimmtes Thema, den "Diskursstrang". Pressetexte, die ein bestimmtes Thema behandeln, nennt er "Diskursfragmente". Demnach bilden alle Diskursfragmente zu einem Thema den Diskursstrang, der sich diachron gemäß der (außen-)politischen Situation entwickelt. Jäger bezeichnet ihn metaphorisch als "Fluss von Wissen durch die Zeit". Analysiert man ein Ereignis, über das in den Medien viel berichtet wird, stellt dies ein "diskursives Ereignis" dar. Für Jäger stellen diese Orientierungspunkte dar, da sie eine "Momentaufnahme" des Diskursstranges abbilden und zeigen, welche Bilder, Argumente und diskursiven Mechanismen zu einem bestimmten Zeitpunkt tradiert wurden bzw. "gültig" waren. Die diachrone Aneinanderreihung von Ergebnissen aus mehreren diskursiven Ereignissen zeigt dann Entwicklungen und Veränderungen in einem Diskursstrang auf, dessen Einwirkungen vor dem Hintergrund der politischen Ebene interpretiert werden können. 3. Kapitel: Imagologie und Stereotypenforschung Das Kapitel behandelt die Bildung, Funktionen und Tradierung von Eigen- und Fremdbildkonstruktionen als kulturelle Konstrukte im öffentlichen Diskurs, dem die Berichterstattung angehört. Ursprünglich in der vergleichenden Literaturwissenschaft situiert, weiten Beller & Leerssen das Untersuchungsfeld der Imagologie von literarischen Texten auf Texte "as forms of cultural representation" aus. Dem sind Zeitungsartikel überregionaler Qualitätszeitungen ebenso zuzuordnen. In diesem Kapitel werden die "Images" als Oberbegriff erläutert, aus denen sich das Bild, Stereotyp, Vorurteil und Feindbild ableiten. Zudem wird das Nationenbild behandelt. Der Schwerpunkt der Darstellungen in dieser Arbeit liegt dabei auf dem Stereotypenbegriff. Eingehend erläutert dieses Kapitel die identitätsstiftende Funktion von Eigen- und Fremdbildern, wobei ebenso die Aspekte des Wandels und der Beständigkeit von Stereotypen beleuchtet werden. Die Eigen- und Fremdbildkonstruktionen werden in den Kontext der Presseberichterstattung, insbesondere der Auslandsberichterstattung, eingebettet und deren Merkmale skizziert. Demnach wird die Struktur der Presseberichterstattung erläutert, in dem die Stereotype und Bilder eingebettet werden. Ebenso wird die Relation zwischen verbalem Ausdruck eines Stereotyps und dessen kognitive Assoziierung behandelt, wobei der konturierte Charakter eines Stereotyps gezeigt werden soll. 4. Kapitel: Methodische Vorgehensweise Dieses Kapitel fasst, basierend auf der erläuterten Methodik der Kritischen Diskursanalyse aus Kapitel 2 und den Grundlagen der Stereotypenforschung in Kapitel 3 die konkrete Vorgehensweise und methodische Anwendung dieser Arbeit zusammen. Behandelt wird die konkrete Auswahl relevanter Pressetexte für die quantitative und qualitative Analyse von westdeutschen und britischen Zeitungsartikeln der jeweils drei großen überregionalen Tageszeitungen, die das Korpus dieser Dissertation bilden (Times, Daily Telegraph, Manchester Guardian, FAZ, SZ und Die Welt). Die diskursiven Ereignisse des Untersuchungszeitraumes werden erläutert, ebenso wie die Klassifizierung der drei untersuchten Diskursstränge, die das deutsch-britische Verhältnis zur Zeit der zweiten Berlin-Krise von 1958 bis 1962 diskursiv aushandeln. Die konkrete Vorgehensweise aus Struktur- und Feinanalyse, die auf die drei Diskursstränge angewandt wird, wird geschildert. Dabei wird bereits der "Tenor der Berichterstattung" geschildert, der die drei untersuchten Diskursstränge dominiert. Neben der Tradierung von negativen, neutralen oder positiven Stereotypen im überregionalen Pressediskurs eines Landes entscheidet auch die subtilere "Stimmung" im Pressetext über die Formulierung eines positiven oder negativen Fremdbildes. Die Ergebnisse dieser Untersuchung zeigen in Abgleich mit den Archivdokumenten zum politischen Hintergrund, dass der Tenor der Berichterstattung eines Landes über die fremde Nation an das außenpolitische Verhältnis gebunden ist – zur Zeit von Macmillans Moskau-Reise im Februar 1959 stellt die britische Außenpolitik eine Bedrohung für den Kurs Adenauers dar mit der Konsequenz, dass in beiden Pressediskursen ein negativer Tenor mit einer großen Anzahl negativer Fremdbilder zirkulierte. Als Macmillan 1960 von seiner Entspannungspolitik in Zentraleuropa Abstand nimmt und sich der kontinentaleuropäischen Wirtschaftsbeziehungen zuwendet, verbessert sich sowohl der Tenor als auch die wechselseitigen Heterobilder über den Anderen in beiden Pressediskursen. Demnach hängt die negative Tradierung von Fremdbildern von der diskursiven Konstellation ab, die in den überregionalen Leitmedien dem außenpolitischen Kurs der jeweiligen Regierung folgt. 5. Kapitel: Das britische und westdeutsche Pressewesen Im 5. Kapitel wird das westdeutsche Pressewesen dem britischen gegenübergestellt. Zunächst soll gezeigt werden, dass die Zeitungen im Untersuchungszeitraum dieser Arbeit das dominante Leitmedium zur politischen Information darstellen, da die "ephemeren" Medien wie Radio und Fernsehen zwar in beiden Ländern zahlenmäßig (bereits) weit verbreitet waren, sich zur intensiven politischen Information jedoch (noch) nicht durchgesetzt hatten. Dies hat zur Folge, dass der Presseberichterstattung über die britische und westdeutsche Außenpolitik zur zweiten Berlin-Krise eine noch größere Wirkungsmacht zukommt, deren inhaltliche Analyse sich eignet, dominante Grundaussagen des britischen und westdeutschen Pressediskurses in Form von Argumentationsmustern und der Tradierung von Fremdbildern zu Legitimierungszwecken herauszuarbeiten. Von diesen kann angenommen werden, dass sie eine sehr starke Wirkmacht zur Bewusstseinsbildung über die jeweils fremde Nation bei den Lesern hatten, zu denen nachweislich auch die führenden Politiker beider Länder zählten. Danach werden die sechs überregionalen Zeitungen in ihrer Pressegeschichte sowie ihrer zahlenmäßigen Verbreitung vorgestellt und ihre "Diskursposition", d.h. in ihrer (politischen) Ausrichtung im gesellschaftlichen Diskurs, genannt. Da diese Arbeit eine relative Homogenität der überregionalen Leitmedien annimmt, wird die Diskursposition der einzelnen Tageszeitungen in dieser Untersuchung vernachlässigt. Es werden zudem wesentliche Unterschiede des westdeutschen und britischen Pressewesens erläutert und die Kriterien einer "überregionalen Tageszeitungen" definiert. Abschließend werden beide Pressewesen miteinander verglichen und in den historischen Kontext der zweiten Berlin-Krise eingeordnet. 6. Kapitel: Die zweite Berlin-Krise als diskursiver Kontext Dieses Kapitel erläutert die außen- und weltpolitischen Hintergründe des längsten Konfliktes des Kalten Krieges, die im August 1961 zur sichtbaren Teilung Deutschlands in Ost- und West führte. Der historische Hintergrund wird mit Archivdokumenten aus dem Bundesarchiv Koblenz sowie dem Politischen Archiv des Auswärtigen Amtes gestützt. Gezeigt werden die Rollen und Verantwortlichkeiten der alliierten Siegermächte Großbritannien, den USA und Frankreich gegenüber den sowjetischen Forderungen Chruschtschows, das Viermächteabkommen aufzukündigen und die alliierten Truppen aus Westberlin abzuziehen. Mit der Schilderung des historischen Hintergrundes wird zudem der Untersuchungszeitraum dieser Arbeit festgelegt, der mit dem Chruschtschow-Ultimatum vom 27.11.1958 beginnt und mit dem Beginn der Kuba-Krise im Oktober 1962 endet. Neben der Schilderung des Verlaufes der zweiten Berlin-Krise wird das deutsch-britische Verhältnis in diesem Zeitraum eingehend geschildert. Betont werden die Rolle Großbritanniens in der Außenpolitik Adenauers sowie umgekehrt, Deutschland bzw. Berlin in der britischen Außenpolitik. Darüber hinaus behandelt dieses Kapitel dominante Deutschlandbilder der britischen Öffentlichkeit sowie die Englandbilder der westdeutschen Bevölkerung. Inhalte politischer Dokumente stützen vorherrschende Haltungen beider Regierungen zueinander, die dem Zweck dienen, Einflüsse auf den jeweiligen Pressediskurs eines Landes zu erkennen, bzw. aus diskursanalytischer Sicht, die Politikerebene von der Medienebene zu trennen. 7. Kapitel: Kategorisierung der Diskursstränge Hier werden die drei in dieser Arbeit analysierten Diskursstränge inhaltlich umrissen. Diskursstränge, die Bilder des Anderen enthalten, jedoch nicht wechselseitig in beiden auftreten, werden in Punkt 7.4 genannt. Dabei handelt es sich um Diskursstränge, die spezifisch für ein Land stehen, die fremde Nation jedoch thematisieren. So behandelt Großbritannien verstärkt das Thema "NS-Prozesse" im eigenen spezifischen Diskurs anders als dies in der westdeutschen Presse geschieht. 8. Kapitel: Diskursstrang 1: Der Staatsbesuch von Theodor Heuss: Oktober 1958 Mehrere Faktoren begründen den Staatsbesuch von Theodor Heuss als ersten offiziellen Empfang eines deutschen Regierungsoberhauptes durch die britische Monarchin seit 1907 als diskursives Event zu behandeln und in die Analyse miteinzubeziehen, obwohl er Ende Oktober 1958, knapp einen Monat vor dem Beginn der zweiten Berlin-Krise, durch das Chruschtschow-Ultimatum stattfand. Erstens repräsentieren sowohl der Bundespräsident als auch die britische Monarchin die Bevölkerung ihres Landes und nicht die außenpolitische Linie. Demnach steht das Verhältnis beider Bevölkerungen zueinander im Mittelpunkt der Berichterstattung. Zweitens bestätigen mehrere Quellen, dass der Heuss-Besuch das Ende der Nachkriegsära im deutsch-britischen Verhältnis einläutete. Demnach stand dem Besuch eine große diskursive Aushandlung über die Presse beider Länder bevor, das deutsch-britische Verhältnis, das sich insbesondere durch den Zweiten Weltkrieg zu einer Feindschaft wandelte, neu auszuhandeln. Von britischer Seite bestand eine große Reserviertheit und Kühle gegenüber dem westdeutschen Gast, die die britische Presse dominierte. Die westdeutschen Zeitungen berichteten ausführlich über die Ehrung und Würde des königlichen Empfangs und bezogen sich anschließend auf das negative Echo der britischen Zeitungen. Die britische Presse zeichnete dabei das Bild des "deutschen Charakters" als obrigkeitshörigen, gefügigen, materialistischen und unmoralischen Deutschen, der seine Vergangenheit mit dem Konsum des Wirtschaftswunders verdrängt. Heuss dagegen sei "not this kind of German". Von deutscher Seite seien "Engländer auch keine Italiener". Nationale Bilder des Anderen dienen der Legitimierung und Einordnung in den eigenen diskursiven Kontext, die Haltung und Reaktion des Anderen logisch zu interpretieren. Sowohl die qualitative als auch quantitative Analyse der Presseartikel in den westdeutschen und britischen Zeitungen ergeben, dass das Bild vom Anderen in seiner Anzahl negativ ist, was auf ein vorherrschend negatives Bild und Grundaussauge insbesondere im britischen Diskurs gegenüber den Deutschen schließen lässt. Es zeigt sich zudem, dass die dominanten Unterthemen der britischen und westdeutschen Presse analog zu der Hierarchie der am meisten verwendeten negativen Fremdbildern sind. Demnach überwiegt zahlenmäßig in der britischen Presse das Bild des unmoralischen und militanten Deutschen, das in Analogie zum am meisten vorhandenen Unterthema der NS-Vergangenheit steht. Von deutscher Seite ist das Bild der kühlen, reservierten und unhöflichen Briten dominant, das am gewichtigsten das Unterthema der "Reaktion der britischen Bevölkerung und der britischen Presse" interpretierend unterstützt. Heterobilder und -stereotype sind demnach in die Struktur der Presseberichterstattung eingebettet und erfüllen bestimmte Funktionen, meist die der Verstärkung der Argumentationen zur Herstellung von Plausibilität und Logik. Indem die westdeutsche Presse die Briten als "arrogant allem Fremden gegenüber" charakterisiert, dient dies der Einordnung und Erklärung für die berichtete kühle Reaktion der britischen Bevölkerung auf den deutschen Gast. Indem die britische Presse ein Kontinuitätsbild der Deutschen als "militant und unmoralisch" tradiert, ist die reservierte Haltung der eigenen Bevölkerung gegenüber den unmoralischen Deutschen gerechtfertigt. Zugleich stilisieren sich die Briten selbst als "moralisch" im Hinblick auf ihre politische Tradition und Konstitution. Die diskursive Aushandlung des deutsch-britischen Verhältnis zum Heuss-Staatsbesuch dient der "Aktualisierung" des jeweiligen Fremdbildes, wodurch aus diskursanalytischer Sichtweise "viel Wissen produziert wird". Die mediale Neuaushandlung der deutsch-britischen Beziehungen wird durch Berichte etwa des deutschen Botschafters in London sowie von Heuss selbst ergänzt, die erläutern, dass es sich um eine berichtete kühle Reserviertheit der britischen Bevölkerung gegenüber dem deutschen Staatsgast handelt und nicht um eine tatsächlich erlebte Ablehnung aus Sicht beider Politiker. Theodor Heuss berichtigte diese Tatsache sogar in seiner Neuansprache an das deutsche Volk vom 31.01.1958, bei der er sagte, dass er viel Wärme erfahren habe und dass verantwortliche Journalisten einberufen wurden. Trotz der überwiegend negativen Tradierung der Bilder des Anderen während des Heuss-Besuchs ist eine Verbesserung des Tenors in beiden nationalen Pressediskursen zu erkennen, die etwa im Januar bei den wohlwollenden Berichten über die Assoziierung Großbritanniens an den europäischen Markt deutlich erkennbar ist, jedoch durch die Herausforderungen der zweiten Berlin-Krise ab Januar 1959 deutlich in den Hintergrund rückt. 9. Kapitel: Bilaterale Krise zwischen Adenauer und Macmillan: 1959 Der Diskursstrang der bilateralen Krise zwischen Adenauer und Macmillan im Jahr 1959 bildet den "Kern" der in dieser Arbeit durchgeführten Diskursanalyse. Dies ist damit zu begründen, dass der Diskursstrang von Oktober 1958 bis Januar 1959 eine positive Entwicklung aufzeigt, die durch das zunächst relativ harmonische persönliche Verhältnis zwischen Adenauer und Macmillan aufgrund außenpolitischer Übereinstimmung gekennzeichnet ist. Adenauers Position als Befürworter des britischen Anliegens, sich wirtschaftlich in Europa nicht zu isolieren durch die Schaffung einer Freihandelszone als Gegengewicht zur 1957 gegründeten EWG der Kontinentaleuropäer stößt zunächst auf Wohlwollen der außenpolitischen Interessen Macmillans und Adenauers, der stets eine engere Einbindung Großbritannien an Europa anstrebte. Durch das Chruschtschow-Ultimatum Ende November 1958 und der sich Mitte Januar 1959 herauskristallisierenden entgegengesetzten Positionen im Ost-West-Konflikt verschlechterte sich das bilaterale Verhältnis um ein Vielfaches, das nach der unilateralen Moskau-Reise Macmillans Ende Februar 1959 im April 1959 seinen Höhepunkt nimmt. Der bilaterale Konflikt wird auf den polarisierenden Charakterisierungen des weichen Macmillans gegenüber eines starren Adenauers auf die Personen des britischen und westdeutschen Regierungsoberhauptes übertragen. Von westdeutscher Seite wird dem Misstrauen gegenüber der britischen Außenpolitik mit Beschwichtigungen reagiert. Zugleich tritt Amerika als "Beschützer" vor den Russen ins Zentrum der westdeutschen Argumentation. Macmillans ergebnislose Moskau-Reise wird in der westdeutschen und britischen Presse unterschiedlich interpretiert: die Briten sehen sie weitestgehend als Erfolg, da Chruschtschow gegen Ende doch noch einer Außenministerkonferenz zustimmte, die ab Mai in Genf stattfand. Die Zeitungen der BRD werten sie einschlägig als "Fehlschlag". Macmillans einseitige Initiative wirft zugleich die Frage einer "Paris-Bonn-Achse" auf, da die Moskau-Reise noch stärker zu einer Polarisierung innerhalb der westlichen Allianz führt: de Gaulle steht entschieden zur starren Haltung Adenauers gegenüber der UdSSR, Amerika befürwortet eher Verhandlungen wobei die britische Regierung vollkommen auf Verhandlungen mit Chruschtschow setzt, um die Berlin-Frage zu lösen. Die Begriffe "schwach" in der westdeutschen Presse und "suspicious" in der britischen sind die im Verlauf des Jahres 1959 am häufigsten tradierten Bilder des Anderen. Die deutschen Zeitungen stilisieren Macmillans Außenpolitik und Großbritannien als schwächste Alliierte wohingegen die britische Presse Adenauer als "misstrauisch" gegenüber britischen Motiven charakterisiert. Im April äußerte sich Adenauer im Rundfunk über "Drahtzieher", die bewusst das deutsch-britische Verhältnis in Großbritannien verschlechtern. Ohne direkt die "Wire-Pullers" zu nennen, bezieht die britische Presse Adenauers Anschuldigungen Mitte April 1959 auf sich. Es kommt zum Times-Artikel: "Anglo-German relations at low ebb" sowie zur Bemerkung im Daily Telegraph: "No conspiracy is needed since anti-German feelings exist without being artificially inspired". Adenauers kritische Äußerungen halten von Juni bis September 1959 an. Während der ersten Phase der Genfer Außenministerkonferenz bleibt ein negativer Tenor in der westdeutschen Presse gegenüber britischen Motiven bestehen, wobei Adenauers Kritik an der britischen Außenpolitik in Zusammenhang mit der (ergebnislosen) Genfer Konferenz zu sehen ist. Ab September ist eine eindeutige Distanzierung sowohl der britischen als auch deutschen Presse zu Adenauers Äußerungen zu bemerken. Dies liegt in der quantitativen Anzahl von Artikeln begründet als auch in der qualitativen Analyse der Presseartikel. Über die dritte Adenauer-Kritik an Großbritannien wird verhältnismäßig wenig und sehr "nüchtern" berichtet. Daher ist eine Einflussnahme der Regierungen auf eine Verbesserung des bilateralen Verhältnisses in der Presseberichterstattung zu verzeichnen. Als Adenauer im Oktober 1959 bekannt gibt, Ende November 1959 zu bilateralen Gesprächen mit Macmillan nach London zu reisen, richtet sich der Tenor beider Pressediskurse auf die Hoffnung und Zuversicht, dass beide Staatsmänner ihre Differenzen beseitigten. Insbesondere in der britischen Presse ist eine stark betonte Verbesserung des Tenors gegenüber Deutschland zu vermerken, die etwa in Berichten wie "the prospects for next week's talks are excellent" zum Ausdruck kommt. Die deutsche Presse bezeichnet die Verschlechterung des deutsch-britischen Verhältnis als "unnötigen Hader". Auch die Nachbereitung der bilateralen Gespräche hinterlässt einen positiven Einschlag. Die öffentliche Haltung des westdeutschen Außenministers sowie Adenauers selbst, eine Assoziierung der neu gegründeten EFTA mit der EWG zu befürworten, sowie Macmillans Distanzierung von einem Disengagement in Zentraleuropa führt zu jener bilateralen Verbesserung. Die Analyse ergab, dass die britische Presse Adenauer negativ als "old, suspicious, rigid und authoritarian" im April, Juni und September im Rahmen seiner Kritik an Macmillan charakterisiert. Britische Außenpolitik wird in der zweiten Hälfte von 1959 als "nüchtern" und "pragmatisch" stereotypisiert, in der ersten als "weich, schwach und flexibel". Auffallend ist, dass, je mehr über die verschlechterten deutsch-britischen Beziehungen berichtet wird, desto stärker das deutsch-französische hervortritt. Die Dominanz der Unterthemen in beiden Pressediskursen im Jahr 1959 zeigt, dass das Gewicht vom außenpolitischen Prinzip bestimmt ist. Für die deutsche Presse sind dies die deutsch-französischen Beziehungen und die außenpolitische Haltung Großbritanniens im Ost-West-Konflikt, für die britische Presse sind dies die Thematik um die Freihandelszone bzw. EFTA sowie die erstarkende Position der BRD als ("gleichberechtigter", "dominanter") NATO-Partner. Die überregionalen Leitmedien folgen demnach den außenpolitischen Kurs der jeweiligen Regierung. 10. Kapitel: Hinwendung zu Europa? Großbritannien und die EWG ab 1960 Der dritte Diskursstrang behandelt schwerpunktmäßig die diskursive Aushandlung des britischen Selbstbildes in seiner Hinwendung zu Europa gemäß der britischen Außenpolitik. Mit der zunehmenden und schnell wachsenden Europäischen Wirtschaftsgemeinschaft, die zur politischen Union werden soll, verliert die von Großbritannien gegründete EFTA an Kraft. Neben Kennedys Wunsch nach einer Europäischen Integration, die Großbritannien als Mitglied der EWG sehen will, wird die Einheit der westlichen Allianz gegenüber der Sowjetunion auf die Wirtschaft übertragen. Bei Macmillans Besuch in Washington im April 1961 wird dieser Prozess beschleunigt, als der britische Premier am 31.07.1961 im Unterhaus verkündet, ein Beitrittsgesuch zur EWG in Brüssel zustellen. Der Diskursstrang ist zunächst in drei Phasen zu teilen: 1) Deutsch-britische Annäherung zwischen EWG und EFTA von Januar 1960 bis Februar 1961, 2) Erwägung und Beschluss des britischen EWG-Beitrittes: März bis Dezember 1961, 3) Wachsende Skepsis und Distanz Adenauers zum britischen EWG-Beitritt: Januar bis Oktober 1962. Das der Diskursstrang eine starke Fokussierung auf dem britischen Selbstbild besitzt und das Verhältnis Großbritannien vermehrt gegenüber den EWG-Staaten und weniger bilateral behandelt wird, wurde hier auf eine Feinanalyse verzichtet. Ziel der Strukturanalyse ist es, vor dem Hintergrund der zeitweiligen Abwesenheit außenpolitischer Differenzen zwischen beiden Ländern eine starke Verbesserung des Tenors in der britischen und westdeutschen Presseberichterstattung festzustellen, wobei es im Februar 1961 zu einem berichteten "Höhepunkt" im deutsch-britischen Verhältnis beim bilateralen Treffen zwischen Adenauer und Macmillan in London kommt, der neben dem positiven Tenor auch gerade in der positiven Darstellung Adenauers in der britischen Presse zeigt. Die positive Darstellung Adenauers ist mit seiner Befürwortung eines britischen EWG-Beitrittes verbunden. Auch hier kommt das deutsch-französische Verhältnis zum Tragen: die britische Presse erhofft sich mit Adenauer einen Fürsprecher gegenüber de Gaulle zu haben bzw. die deutsch-französische Achse aufzuweichen. Adenauer dagegen ist über die positive Haltung der Briten gegenüber einer Europäischen Integration positiv gestimmt. Während sich in der zweiten Phase des Diskursstrangs die bilaterale Aushandlung der deutsch-britischen Beziehungen entfernt, da die britischen Zeitungen etwa das Selbstbild um den Verlust der eigenen Souveränität aushandeln und die Berlin-Krise mit dem zweiten Chruschtschow-Ultimatum vom Juni 1961 und der darauf folgenden Abriegelung des Ost-Sektors von Berlin im August 1961 die Aufmerksamkeit der westdeutschen Zeitungen auf den Ost-West-Konflikt richten. Die dritte Phase ab Januar 1962 wird eingeleitet durch Macmillans Besuch in Bonn Anfang Januar 1962. Dabei werden erste Verschlechterungen in der beiderseitigen Berichterstattung deutlich, die sich um die Stationierungskosten der britischen Rhein-Armee ranken, die aufgrund der Teilung Deutschlands im Rahmen der NATO aufgestockt werden muss. Im März äußert sich Adenauer erstmals öffentlich gegenüber einem französischen Journalisten kritisch dem britischen EWG-Beitritt gegenüber. Politische Dokumente vom Dezember 1961 belegen, wie sehr Adenauer de Gaulles distanzierter Haltung zu einem britischen EWG-Beitritt zustimmt, da sonst das politische Konzept der EWG nicht umgesetzt werden könne. Im Juni 1962 äußerte sich der Bundeskanzler erneut konkret kritisch, indem er behauptet, dass eine wirtschaftliche Assoziierung Großbritanniens zur EWG nicht gleich eine Vollmitgliedschaft des Vereinigten Königreiches bedeuten muss. Die westdeutsche Presse distanziert sich zunehmest von Adenauers kritischen Äußerungen wohingegen die britischen Zeitungen Ludwig Erhards und von Brentanos Zustimmung zitieren. Mit Adenauers Staatsbesuch in Paris Anfang Juli und der zelebrierten deutsch-französischen Aussöhnung in der Kathedrale von Reims kommen Feindbilder gegenüber den militanten Deutschen in der britischen Presse erneut hervor. Adenauer wird für die britische Europapolitik zur Bedrohung, da eine demonstrierte Aussöhnung mit de Gaulle gleichbedeutend sei mit einer Distanzierung Bonns vom britischen Anliegen und von einer Fürsprache Adenauers bei de Gaulle für die britische Sonderstellung. Weitere kritische Äußerungen Adenauers im August 1962 verstärken diese Haltung. Die westdeutsche Presse distanziert sich dabei nachweislich von den Äußerungen des "alten Herrn" und folgen dem Konsens der Bonner Außenpolitik. Mit dem Beginn der Commonwealth-Konferenz in London im September und dem aufkommenden Konflikt der Kuba-Krise endet der Untersuchungszeitraum dieser Arbeit. 11. Kapitel: Ergebnisse und diskursanalytische Schlussfolgerungen Zu den zentralen Schlussfolgerungen zählt die Aussage, dass die britische und westdeutsche überregionale Presse den allgemeinen Konsens der Außenpolitik verfolgt. Abweichende Haltungen einzelner Personen, auch gerade die der Regierungsoberhäupter, werden gegebenenfalls ausgegrenzt. Somit hält der überregionale Pressediskurs die Funktion einer Korrektur inne. Einflussnahmen der Politikerebene auf den Tenor der überregionalen Berichterstattung wurden kenntlich gemacht, etwa ab September 1959 vor dem Adenauer-Besuch in London. Die Formulierung negativer Fremdbilder und Stereotype ist in den Zeiten des außenpolitischen Konfliktes quantitativ erhöht. Ein interessantes Ergebnis ist die Dichotomie der tradierten Bilder von Adenauer und Macmillan: im April 1959 stilisiert die westdeutsche Presse Macmillan als "weich" und "flexibel" wohingegen die britischen Zeitungen Adenauer als "rigid" und "authoritarian" charakterisieren. Die Herausbildung negativer Stereotype ist damit zu begründen, dass die fremde Nation zur Bedrohung für die eigenen Interessen wird, wie im Fall von Macmillans Moskau-Reise oder Adenauers zunehmender Distanzierung zum britischen EWG-Beitritt. In Zeiten der akuten Bedrohung ist zusätzlich eine quantitative wie qualitative Abhängigkeit der britischen und westdeutschen Presseartikel festzustellen. So verlaufen beide Diskursstränge parallel zueinander. Aus qualitativer Sicht finden zahlreiche direkte und indirekte Bezüge der westdeutschen Presse zu britischen Artikeln sowie umgekehrt statt. Im dritten Diskursstrang, der vor dem Hintergrund der vorläufigen Abwesenheit von bilateralen Spannungen artikuliert wurde, treten die direkten Bezugnahmen zwischen der britischen und westdeutschen Presse zurück. Darüber hinaus verbessert sich der Tenor nachhaltig. In dem Moment, als erneut Spannungen auftraten, wie ab Juni 1962, tritt sogar das Bild des militanten Deutschen erneut in der britischen Presse auf. Somit hängen negative Fremdbilder vom außenpolitischen Kurs der Regierung und der Position der anderen Nation im bilateralen Verhältnis in den überregionalen Zeitungen ab. Zudem werden Forschungsausblicke vorgelegt, die sich auf einen Vergleich etwa des dritten Diskursstrangs mit dem gegenwärtigen EU-Austritt Großbritanniens beziehen oder sich mit den Dynamiken des deutsch-französischen Verhältnisses beschäftigen. 12. Kapitel: Ausblick: Wandel der Stereotype in der deutsch-britischen Presseberichterstattung(?) Das Kapitel möchte einen Ausblick zum Wandel bzw. zur Beständigkeit von den hier untersuchten Bildern des Anderen im gegenwärtigen deutsch-britischen Verhältnis liefern. Dazu werden einerseits Parallelen zum gegenwärtigen EU-Austritt Großbritanniens gezogen. Andererseits werden mittels der Aussagen von Interviewpartnern aus dem deutsch-britischen Verhältnis Ergebnisse und Ausblicke vorgelegt, die zur weiteren Erforschung der deutsch-britischen Pressebeziehungen einladen sollen. ; This doctoral dissertation examines the use of national stereotypes used in British and West German quality newspapers during the second Berlin Wall Crisis (1958 to 1962). As the Berlin Wall Crisis represents the tensest controversy within Cold War history, the national press coverage of West Germany and Great Britain is highly defined by reports on the political events. These are temporarily characterised by the direct confrontation between the West German chancellor Konrad Adenauer and the British Premier Harold Macmillan. The density and acuteness of this Cold War crisis, however, reduces the respective press releases on German and British affairs to a mere political coverage; thus, the analysis of the prevailing British and German newspapers can be regarded as a political discourse analysis. The methodological approach employed in this work follows the Critical Discourse Analysis according to Ruth Wodak [1], Norman Fairclough [2] and Sara Mills [3] with the aim of displaying the mutual use of auto- and hetero-images of "the Germans" and "the British" in the respective national media and consequently, the discursive construction of national identity. The discourse analysts' view is supplemented here by the imagologist approach of Manfred Beller [4], which concerns the construction of national images of the Self and the Other in public national discourse. Referring to the above-mentioned dominance of politically related reports in past national press coverage, Critical Discourse Analysis represents a highly suitable methodological approach as it aims at examining the discursive mechanisms of power and ideology in which a text is set. Considering this, Sara Mills defines Critical Discourse Analysis as a "political analysis of text" [5]. The time period examined in this work does not only mark the peak of the East-West conflict but also implements the substantial formation and structure of the European Union as it is still prevalent today. Major negotiations in the national press of that time, such as the entrance of Great Britain into the European Economic Community (EEC) beginning in the late 1950s, reveal arguments, attitudes and images in national press coverage about European affiliation of which many are still valid today. This can be currently noticed in British demands for a European reform as well as in a possible exit from the European Union in 2017. Accordingly, the diachronic view from the news coverage between Germany and Britain during the Berlin Wall Crisis is accomplished by this present outlook on German-British relations. This double-tracked approach allows both a complex portrayal of the historical development of German-British relationship and a definition of the mechanisms of auto- and hetero-images as they occur and change in trans-national media discourse. Die zweite Berlin-Krise (1958 bis 62) repräsentiert dabei eine schicksalhafte Zeit sowohl für die Bundesrepublik als auch für das Vereinigte Königreich. Themen wie die Suche nach einer gemeinsamen westlichen Strategie als Antwort auf sowjetische Ultimaten und die Teilung Deutschlands, die ambivalente britische Außenpolitik gegenüber Berlin, die deutsch-französischen Annäherungen und die Einbindung des Vereinigten Königreiches in die kontinentaleuropäische Wirtschaft dominieren die Pressediskurse beider Nationen. Diese Studie untersucht die diskursiven Mittel, mit denen die überregionale Presse außenpolitische Ereignisse in den eigenen nationalen Referenzrahmen integriert, und welche Rolle dabei textuelle Stereotype und Charakterisierungen spielen. Mithilfe der Methode der Kritischen Diskursanalyse will diese Arbeit anhand qualitativer und quantitativer Darstellungen jeweils diskursive Mechanismen der westdeutschen und britischen Tagespresse aufzeigen und damit ein kleines Stückchen Licht in die mediale Tradierung eines komplexen deutsch-britischen Verhältnisses bringen.
Aquest número comença amb l´article de Mireia Alcón i José Luis Menéndez sobre el paradigma de l´avaluació autèntica i la contribució específica de les rúbriques al disseny i implantació de sistemes d´avaluació coherents amb el paradigma esmentat. La literatura especialitzada ha insistit en la vinculació de l´avaluació autèntica amb la idea d´una avaluació posada al servei de l´aprenentatge. Així ho demostra l´èmfasi en que l´avaluació se centri en l´acompliment dels estudiants respecte de problemes rellevants en entorns socials i professionals. També, l´èmfasi en que l´avaluació estigui alineat amb els altres components del context educatiu donat que, sense aquesta coherència, és impossible aconseguir els aprenentatges que suposa una educació basada en competències. Tanmateix, hom ha insistit menys en el potencial que té l´avaluació autèntica per reorganitzar l´activitat docent del professorat i per a la millora dels currículums. Aquest model requereix una reflexió compartida del professorat sobre l´àmbit professional i la pròpia cultura acadèmica de la disciplina, sobre el perfil del titulat, sobre els objectius d´aprenentatge i llur integració coherent en el pla d´estudis, i sobre els entorns didàctics més adequats per tal que l´estudiant assoleixi els resultats previstos. Perquè només des d´aquesta perspectiva pot implantar-se una avaluació autèntica. En l´article, els autors insisteixen en una idea similar en relació amb les rúbriques. A banda d´ésser instruments d´avaluació, aquestes han d´ésser considerades també recursos educatius que permetin a l´estudiant enjudiciar i resoldre problemes importants del seu àmbit disciplinari en diàleg constant amb els seus companys i professors. Pel professorat, el disseny i la utilització de rúbriques són un motiu d´anàlisi i discussió concret, però activen simultàniament una consciència més profunda i una major responsabilitat sobre la seva pràctica professional. L´autenticitat segueix present en l´article d´Eva Gregori sobre la validesa d´un model de carpeta d´aprenentatge utilitzat en el grau de Belles Arts. La validesa no és una condició suficient per afirmar l´autenticitat d´un sistema d´avaluació, però sí que en constitueix una de les seves condicions necessàries. Un sistema d´avaluació pot ésser perfectament vàlid perquè les inferències que genera respecte els aprenentatges dels estudiants són adequades i útils per aconseguir aquests aprenentatges. No obstant, aquest sistema d´avaluació pot valorar resultats d´aprenentatge que no són rellevats en contextos socioprofessionals reals. De fet, la transferència i generalització dels judicis vàlids sobre l´aprenentatge dels estudiants depèn de la pertinença, importància, amplitud i profunditat dels citats aprenentatges, cosa que confereix interès a aquells judicis vàlids en contextos educatius més amplis. L´autora aborda l´assumpte des de la perspectiva contrària: d´acord amb la literatura especialitzada, reconeix l´autenticitat de la carpeta per ser un recurs en el que l´estudiant justifica i exemplifica el seu procés i resultats d´aprenentatge per, acte seguit, demostrar la validesa del model de carpeta emprat. L`anàlisi inclou un examen dels constructes en els quals es va organitzar la carpeta i de la seva consistència interna, per demostrar la coherència amb els objectius d´aprenentatge i la seva adequació al context educatiu. Un examen de la càrrega de treball dels estudiants en llur elaboració i de les qualificacions obtingudes li serveixen per justificar la seva adequació al perfil de l´estudiant de nou ingrés en la titulació analitzada. L´assumpte de l´avaluació autèntica està també implícit en l´article de María Isabel Arbesú i Leticia Reyes sobre l´eficàcia docent. Per bé que l´article se circumscriu a un estudi de la percepció que tenen estudiants de grau i postgrau de ciències i arts per al disseny, aquest estudi forma part d´una investigació més àmplia que involucra altres actors del sistema educatiu. Investigacions d´aquesta mena són encara més importants en l´actualitat, quan la literatura especialitzada ha plantejat seriosos dubtes sobre la validesa i fiabilitat de les enquestes habituals sobre la qualitat docent, i quan hom reafirma la tendència a descarregar exclusivament en les espatlles del professorat la responsabilitat d´uns resultats educatius insuficients. És significatiu que l´anàlisi no versi sobre l´eficiència del professor sinó sobre l´eficàcia; és a dir, l´adequació dels resultats de l´activitat del professorat al paper que han de jugar en la institució educativa, i que no és altre que el de generar oportunitats d´aprenentatge pels seus estudiants. En aquest sentit, és de particular interès que els propis estudiants identifiquin dimensions d´avaluació que no acostumen a recollir-se en els qüestionaris. De confirmar-se això, aquests resultats subratllarien un cop més el risc cert d´incórrer en insuficiències que posarien en entredit la validesa d´aquests instruments. D´aquesta manera, hom posa de manifest com els problemes de validesa menyscaben l´autenticitat del sistema avaluador. Els dos darrers articles provenen de l´àmbit de la Teoria de l´Art. El signat per Bibiana Crespo realitza un decurs històric del concepte de dibuix des de l´antiguitat greco-romana fins a les avantguardes històriques. No s´ha de cercar una anàlisi exhaustiva de les reflexions d´artistes i teòrics sobre el tema, cosa impossible en un article; l´autora es basa en una selecció de textos de diferents èpoques per a demostrar la presència d´un fil condcutor en la idea de dibuix com activitat intel•lectual i com aquesta idea va evolucionant en els diferents períodes de la història de l´art. Sobre aquesta base, s´afirma el valor específic del dibuix com a art, però també el seu paper rellevant com activitat artística i, en aquest sentit, la seva contribució a la resta de les arts plàstiques. En l´article s´observen les relacions canviants entre els diferents aspectes del dibuix segons hom consideri la seva relació amb la naturalesa; la seva relació amb les altres arts plàstiques; amb la pròpia activitat mental de l´artista i el seu correlat amb el procés d´ideació, d´una banda, i amb el d´execució de l´altra; amb el seu vincle amb diferents facultats mentals –sigui l´intel•lecte, la intuïció, la imaginació, l´enginy o el sentiment–; o amb la seva pròpia naturalesa lingüística que esdevé motiu central de reflexió en el tram final de la modernitat. L´article de Ricard Ramon adopta l´enfocament més sociològic dels estudis de cultura visual per examinar el paper desenvolupat per l´art i el discurs artístic en les estratègies de legitimació i en les campanyes publicitàries de les principals empreses i corporacions. L´autor presenta el cas de l´empresa de ceràmica Lladró per a plantejar l´existència de relacions entre la seva activitat industrial i comercial, el seu interès en el col•leccionisme d´obres d´art, la col•laboració amb reconeguts especialistes del camp de la història de l´art i la creació del propi museu Lladró. L´interès de l´article rau en que el seu objecte d´estudi està molt poc tractat en el camp de la Història de l´Art perquè, des d´una concepció tradicional de la disciplina, aquest objecte queda fora del seu àmbit. És innegable que una de les funcions que l´art ha exercit històricament és ser mitjà de representació i legitimació pública dels valors i grups de poder dominants. Tanmateix, en les societats democràtiques avançades, concorren aspectes nous que suposen un salt qualitatiu. La qüestió rau en el procés d´acceleració històrica, les conseqüències de la naturalesa tecnològica de la societat de la informació i comunicació, i la crisi d´altres metarelats que fan de contrapès als arguments exclusivament econòmics. Tot plegat explica la proliferació de les interferències entre els discursos i fenòmens artístics, aquells altres que es desenvolupen en el disseny i la publicitat, i els interessos comercials i financers del món dels negocis. Aquest fet dóna especial rellevància al debat sobre els límits i les juxtaposicions entre aquests discursos i interessos, sobre llurs diferències i finalitats respectives, i sobre les repercussions recíproques que tindran en cadascun d´aquests àmbits. ; This issue begins with an article by Mireia Alcón and Jose Luis Menendez on the paradigm of authentic assessment and the specific contribution of rubrics to the design and implementation of assessment systems within this paradigm. The specialist literature strongly advocates the linking of authentic assessment with the idea of assessment at the service of learning. For example, it emphasizes the fact that assessment should focus on students' performance with respect to relevant problems in social and professional settings, and also that assessment should be closely aligned with the other components of the educational context because otherwise it is impossible to achieve the learning that a competency-based education requires. However, less attention has been paid to the potential of authentic assessment to reorganize teaching activities and improve curricula. A model of this requires a shared reflection of teachers on their professional environment and the academic culture of the discipline, on the graduate profile, on learning objectives and their integration into the curriculum, and on the learning environments that can help students to obtain the desired results. Only from this perspective can an authentic assessment be put in place. In the article, the authors put forward a similar idea in relation to rubrics. Besides being assessment tools, rubrics should be considered as educational resources that allow students to tackle important problems in their discipline, in constant dialogue with peers and teachers. For teachers, the design and use of rubrics is a source of analysis and discussion, but simultaneously activates a deeper awareness and a greater collective responsibility for their professional practice. The question of authenticity is also present in the article by Eva Gregori on the validity of a learning portfolio model used in the degree of Fine Arts. Validity is not a sufficient condition to affirm the authenticity of an assessment system, but it is a necessary component. An assessment system can be perfectly valid because the inferences it generates regarding students' learning are appropriate and useful for this learning; however, it may evaluate learning outcomes that are not relevant to real socioprofessional contexts. The transfer and generalization of valid judgments on students' learning depends on the relevance, breadth and depth of this learning. The author addresses the issue from the opposite perspective: in accordance with the specialist literature, she recognizes the authenticity of the portfolio as a resource in which students justify and exemplify the learning process and results, and then demonstrates the validity of the portfolio model used. The analysis includes an examination of the constructs in which the portfolio was organized and its internal consistency in order to demonstrate its suitability with regard to the learning objectives and its relevance in the educational context. On the basis of a review of students' workload in the preparation of the portfolio and of the test scores obtained, the author concludes that the portfolio is a highly useful instrument for students in the first years of the Fine Arts degree. The issue of authentic assessment is also implicit in the article by Maria Isabel Arbesú and Leticia Reyes on teacher effectiveness. Although the article is limited to a study of the perceptions of science and fine arts undergraduates and graduates, the study is part of a wider investigation involving other actors in the education system. Investigations of this type are particularly important today, at a time when the specialist literature has raised serious questions about the validity and reliability of the surveys currently used to assess teaching quality, and when there is a tendency to lay all the responsibility for poor educational outcomes at the door of the teachers. Significantly, the analysis does not focus on teachers' efficiency but on their effectiveness; that is, the relevance of the results of their activity to the role they should play in the school, that is, to generate learning opportunities for their students. In this context, it is particularly important that the students themselves identify dimensions of assessment which are not usually included in questionnaires. If confirmed, these results underline once again the risk of certain deficiencies that call into question the validity of these instruments. Thus, it becomes clear how problems of validity undermine the authenticity of the assessment system. The last two articles are from the field of art theory. The piece by Bibiana Crespo takes a historical view of the concept of drawing, from the Graeco-Roman world until the early-20th-century avant-garde movement. An exhaustive analysis of the reflections of artists and theorists on the subject would be beyond the scope of the article; the author bases her contribution on a selection of texts from different periods to demonstrate the presence of an underlying thread in the idea of drawing as an intellectual activity and to trace the evolution of this in different periods of art history. On this basis, she affirms the specific value of drawing as art, but also stresses its important role as an artistic activity and, in this respect, its contribution to the rest of the Fine Arts. The article reflects the changing relationships between different aspects of drawing according to a consideration of their relationship with nature; its relationship with the other arts; its relationship with the artist's mental activity and its correlation with the process of ideation on the one hand and with the process of execution on the other; its link with various mental faculties such as the intellect, intuition, imagination, ingenuity or feeling; and with its own linguistic nature which becomes the central cause for reflection in the final stage of modernity. Ricard Ramon article adopts a more sociological approach to the studies of visual culture to examine the role of art and artistic discourse in the strategies of legitimation and advertising campaigns of major companies and corporations. The author presents the case of Lladró, the ceramics company, to exemplify the existence of relations between its industrial and commercial activities, its interest in collecting works of art and in collaborating with renowned experts in the field of art history, and the creation of the Lladró museum. The article is important because its subject lies outside the scope of the traditional conception of art history and has been largely neglected inside the discipline. It is undeniable that one of art's historical functions has been as a means of representation and public legitimation of the dominant values and power groups inside a community. However, in advanced democratic societies, new aspects come together that represent a qualitative leap forward. The key lies in the process of historical acceleration, the consequences of the technological nature of the information and communication society, and the crisis of other metanarratives that act as a counterweight to the purely economic arguments. All this explains the proliferation of interferences between artistic discourses and phenomena, other discourses that are at work in design and advertising, and the commercial and financial interests of the business world. This confers special relevance on the debate about the limits and juxtapositions between these discourses and interests, their differences and their respective aims, and on the reciprocal repercussions that they have in each of these areas. ; Este número comienza con el artículo de Mireia Alcón y José Luis Menéndez sobre el paradigma de la evaluación auténtica y la contribución específica de las rúbricas al diseño e implantación de sistemas de evaluación coherentes con dicho paradigma. La literatura especializada ha insistido en la vinculación de la evaluación auténtica con la idea de una evaluación puesta al servicio del aprendizaje. Así lo demuestra el énfasis en que la evaluación se centre en el desempeño de los estudiantes respecto de problemas relevantes en entornos sociales y profesionales. También, el énfasis en que la evaluación esté alineada con los otros componentes del contexto educativo puesto que, sin esta coherencia, es imposible alcanzar los aprendizajes que supone una educación basada en competencias. Sin embargo, se ha insistido menos en el potencial que tiene la evaluación auténtica para reorganizar la actividad docente del profesorado y para la mejora de los currículos. Dicho modelo requiere una reflexión compartida del profesorado sobre el ámbito profesional y la propia cultura académica de la disciplina, sobre el perfil del egresado, sobre los objetivos de aprendizaje y su integración coherente en el plan de estudios, y sobre los entornos didácticos más adecuados para que el estudiante alcance los resultados previstos. Porque solo desde esta perspectiva puede implantarse una evaluación auténtica. En el artículo, los autores insisten en una idea similar en relación con las rúbricas. Además de ser instrumentos de evaluación, estas deben ser consideradas también recursos educativos que permitan al estudiante enjuiciar y resolver problemas importantes de su ámbito disciplinario en diálogo constante con sus compañeros y profesores. Para el profesorado, el diseño y la utilización de rúbricas son un motivo de análisis y discusión concreto, pero activan simultáneamente una conciencia más profunda y una mayor responsabilidad colectiva sobre su práctica profesional. La autenticidad sigue presente en el artículo de Eva Gregori sobre la validez de un modelo de carpeta de aprendizaje utilizado en el grado de Bellas Artes. La validez no es una condición suficiente para afirmar la autenticidad de un sistema de evaluación, pero sí que constituye una de sus condiciones necesarias. Un sistema de evaluación puede ser perfectamente válido porque las inferencias que genera respecto de los aprendizajes de los estudiantes son adecuadas y útiles para conseguir tales aprendizajes. Sin embargo, ese sistema de evaluación puede valorar resultados de aprendizaje que no son relevantes en contextos socioprofesionales reales. De hecho, la transferencia y generalización de los juicios válidos sobre el aprendizaje de los estudiantes depende de la pertinencia, importancia, amplitud y profundidad de tales aprendizajes, lo que confiere interés a aquellos juicios válidos en contextos educativos más amplios. La autora aborda el asunto desde la perspectiva contraria: de acuerdo con la literatura especializada, reconoce la autenticidad de la carpeta por ser un recurso en el que estudiante justifica y ejemplifica su proceso y resultados de aprendizaje para, a continuación, demostrar la validez del modelo de carpeta empleado. El análisis incluye un examen de los constructos en que se organizó la carpeta y de su consistencia interna, para demostrar su coherencia con los objetivos de aprendizaje y su adecuación al contexto educativo. Un examen de la carga de trabajo de los estudiantes en su elaboración y de las calificaciones obtenidas le sirven para justificar su adecuación al perfil del estudiante de reciente ingreso en la titulación analizada. El asunto de la evaluación auténtica está también implícito en el artículo de María Isabel Arbesú y Leticia Reyes sobre la eficacia docente. Aunque el artículo se circunscribe a un estudio de la percepción que tienen estudiantes de grado y posgrado de ciencias y artes para el diseño, dicho estudio forma parte de una investigación más amplia que involucra otros actores del sistema educativo. Investigaciones de este tipo son aun más importantes en la actualidad, cuando la literatura especializada ha planteado serias dudas sobre la validez y fiabilidad de las encuestas al uso sobre la calidad docente, y cuando se reafirma la tendencia de descargar exclusivamente en los hombros del profesorado la responsabilidad de unos resultados educativos insuficientes. Es significativo que el análisis no verse sobre la eficiencia del profesor sino sobre la eficacia; esto es, la adecuación de los resultados de la actividad del profesorado al papel que deben desempeñar en la institución educativa, y que no es otro que generar oportunidades de aprendizaje para sus estudiantes. En este sentido, es de particular interés que los propios estudiantes identifiquen dimensiones de evaluación que no acostumbran a estar recogidas en los cuestionarios. De confirmarse, estos resultados subrayarían una vez más el riesgo cierto de incurrir en insuficiencias que pondrían en entredicho la validez de estos instrumentos. De este modo, se pone de manifiesto cómo los problemas de validez menoscaban la autenticidad del sistema evaluador. Los dos últimos artículos provienen del ámbito de la Teoría del Arte. El firmado por Bibiana Crespo realiza un decurso histórico del concepto del dibujo desde la antigüedad greco-romana hasta las vanguardias históricas. No hay que buscar un análisis exhaustivo de las reflexiones de artistas y teóricos sobre el tema, cosa imposible en un artículo; la autora se basa en una selección de textos de diferentes épocas para demostrar la presencia de un hilo conductor en la idea de dibujo como actividad intelectual y como esta idea va evolucionando en los diferentes períodos de la historia del arte. Sobre esta base, se afirma el valor específico del dibujo como arte, pero también su papel relevante como actividad artística y, en este sentido, su contribución al resto de las artes plásticas. En el artículo se observan las relaciones cambiantes entre los diferentes aspectos del dibujo según se considere su relación con la naturaleza; su relación con las otras artes plásticas; con la propia actividad mental del artista y su correlato con el proceso de ideación, por un lado, y con el de ejecución por el otro; con su vínculo con diferentes facultades mentales –sea el intelecto, la intuición, la imaginación, el ingenio o el sentimiento–; o con su propia naturaleza lingüística que pasa a ser motivo central de reflexión en el tramo final de la modernidad. El artículo de Ricard Ramon adopta el enfoque más sociológico de los estudios de cultura visual para examinar el papel desempeñado por el arte y el discurso artístico en las estrategias de legitimación y en las campañas publicitarias de las principales empresas y corporaciones. El autor presenta el caso de la empresa de cerámica Lladró para plantear la existencia de relaciones entre su actividad industrial y comercial, su interés en el coleccionismo de obras de arte, la colaboración con reconocidos especialistas del campo de la historia del arte y la creación del propio museo Lladró. El interés del artículo radica en que su objeto de estudio está muy poco tratado en el campo de la Historia del Arte porque, desde una concepción tradicional de la disciplina, dicho objeto queda fuera de su ámbito. Es innegable que una de las funciones que el arte ha desempeñado históricamente es ser medio de representación y legitimación pública de los valores y grupos de poder dominantes. Sin embargo, en las sociedades democráticas avanzadas, concurren aspectos nuevos que suponen un salto cualitativo. La clave radica en el proceso de aceleración histórica, las consecuencias de la naturaleza tecnológica de la sociedad de la información y comunicación, y la crisis de otros metarrelatos que actúan de contrapeso ante los argumentos exclusivamente económicos. Todo ello explica la proliferación de las interferencias entre los discursos y fenómenos artísticos, aquellos otros que se desarrollan en el diseño y la publicidad, y los intereses comerciales y financieros del mundo de los negocios. Este hecho confiere especial relevancia al debate sobre los límites y las yuxtaposiciones entre estos discursos e intereses, sobre sus diferencias y fines respectivos, y sobre las repercusiones recíprocas que tendrán en cada uno de estos ámbitos.

Plekhanov/Labriola As a bit of an experiment, coupling my interest in André Tosel and my work on translation, I have decided to try my hand at a few translations of the former when I get the time. These are totally unauthorized, and rough drafts posted for edification and entertainment purposes only. I started on this piece because it is short, and because it works on an area that I need to learn more about, the history of Marxist-Spinozism before Matheron or Althusser. However, the more I worked on this piece, the more I thought that this split between Plekhanov and Labriola, still exists, in the divide between neo-enlightenment Spinozists and what some might call post-modern, but I prefer to call Marxist Spinozists. The Marxist Uses of Spinoza: Lessons of Method The history of the role of Spinoza's thought in the formation and the development of the work of Marx remains to be written, as is that of the history of the diverse Marxist usage (from different Marxisms) of Spinozist philosophical elements. This double history would reveal the work of Marx, and its contradictions, as much it would open up the work of Spinoza himself. Marxisms have reflected their aporias and their hopes onto Spinoza without necessarily truly thinking them through. In other words this is a domain of misunderstandings and equivocations. In order to undertake this history it would be useful to draw some lessons from the encounter of Marx and Marxist thought with Spinoza. First remark. The encounters of Spinoza by Marxists are discontinuous and contradictory. This discontinuity is initially characterized by the lack of a definitive encounter between Marx himself and Spinoza. Marx is formed through the reading of Spinoza, of the Tractatus Theologico-Politicus, and the correspondence. Not to learn the lessons of materialism, but an ethico-political lesson. Spinoza is considered as philosopher of freedom and autonomy, modern incarnation of Prometheus and continuation of Epicurus, all at once. Marx, in is progression from Kantian-Fichtean idealism to the speculative communism of the 1844 Manuscripts, develops three theses which are the practical theses of philosophical materialism, without the epistemological and ontological theses of this materialist tradition. Thesis One: Philosophy has a fundamental interest in the liberty of humanity, understood as autonomy and as the end of all heteronomies. Thesis Two: Philosophy is critical of all transcendental authorities of all principle of domination which justify and represent their domination through this principle. Thesis Three: Philosophy is eminently a science, knowledge, but knowledge of life, of the simple life of spirit of bodies rendered by their power. All particular sciences and knowledge must be thought from the point of view of science of life and its forms, as forms of life. When Marx elaborates the materialist conception of history he revolutionizes materialism but he does this without ever connecting it to the spinozist theory of nature, of the relations of extension and thought, of bodies and mind. He integrates and modifies the strong ontological and epistemological thesis of materialism, but these theses are taken more from Hobbes and other materialists of the eighteenth century than from Spinoza. Let us state these theses which are capable of a Spinozist formulation, without however assuming such a formulation. Thesis Four: Nature is the original reality and it is organized as matter at different objective levels. Thought cannot be separated from matter. Thesis Five: Nature in its diverse senses is intelligible. It emerges only from itself, excluding all creation. The human order is not a kingdom within a kingdom and susceptible of being understood. Thesis Six: All knowledge presupposes the reality of its object outside of thought. The appropriation by the knowledge of its own object of knowledge presupposes the reference to a real object. It is necessary to pay attention to the debates in Marxism of the Second International in order to see how the question of "Spinoza precursor of Marxist materialism appears." Emerging in the years of the crisis of revisionism the debate engages above all the German and Russian theorists of social democracy: Bernstein, Kautsky, and Plekhanov. It is in part based on the Anti-Dühring of Friedrich Engels and puts into play the complex questions of the relationship between the materialist theory of history with the sciences of nature with the political problem of the alliance of the intellectual groups in the perspective of socialist transition. This debate between 1896-1900 is inscribed in a theoretical problematic, such of Marxist orthodoxy that will find a new actualization with the problems proper to Soviet philosophy between 1917 and 1931, when it is a matter of specifying what would be called "Marxism-Leninism." If the question of materialism assumes the continuity between the Spinoza of the Second International and that of the Third, nothing would be more erroneous than to let oneself be taken in by the apparent continuity of an imaginary history of philosophy. These occurrences are in effect specific, they constitute theoretical and political conjunctures which must be grasped in a way that takes into account the strategic dimensions of the class struggle whether or not it is led by Marxist parties, the problem of alliances, that of the intellectual division of labor. Marxist philosophy, as it is officially constituted, is part of the practice of parties, and the reference to Spinoza is overdetermined by the political and theoretical stakes that have to be elucidated in each specific situation. Here we touch on the second lesson of method: it is necessary to historically specify the conjunctures where Spinoza intervenes and where and how there is a specific usage of this prestigious and troubling reference. This method makes it possible to determine what falls under ideological legitimation, and what is inserted at the level of the practical politics of the party, of the state, of the level of specialized intellectuals. Spinoza does not only appear only in the emergence of Marxist orthodoxy. He intervenes, in a subterranean manner, in the elaboration of theorists where the considerable theoretical importance has never been associated with an actual political importance. This can be found in the crisis over revisionism in the last century, such that Antonio Labriola in his Essays on the Materialist Conception of History (1895-1898) attests to the presence of a different Spinoza than that of his contemporary Plekhanov and a fortiori than that which was celebrated in Soviet Philosophy in 1927 and 1932. Spinoza intervenes as a critic of the same orthodoxy which returns as elements of an older materialism in another theoretical configuration that has solicited different aspects of his philosophy: no longer the parallelism between extension and thought, not a determinist ontology but the mode considered to be at once conceptual and experimental, the same geometrico-genetic method, in that it now excludes the guarantees of teleological philosophies of history. A contradictory intervention which is not without analogies to another occurrence, the most recent, that of Spinoza in the work of Louis Althusser which can be considered as a systematic deconstruction of the Marxist orthodoxy of the Second and Third International. Between Labriola (1898) and Althusser (1965), if we except the Soviet Spinoza, there is little except Ernst Bloch's remarks that no one has yet taken into account for a history of materialism oriented in the direction of a utopian ontology. This appearance of a Spinoza critical of stated and intended Marxist orthodoxies gives a third lesson of method: the diverse contradictory Marxist uses of Spinoza are situated between two poles, the first is that of an orthodoxy elaborated by the intellectuals of the social democratic and communist parties at the end of an a party/state conception of a finalist world and at the other is from thinkers situated in a problematic relation to the party, who look in Spinoza for other ways to make sense of the world and other practices then the becoming state of the worker parties. This opposition can appear to be schematic. It can be developed into provisional and schematic path of investigation. Such an investigation takes one central question: What is it in the philosophy of Spinoza that authorizes these discontinuous usages, determined by their conjunctures, and perhaps violently opposed? Confronting therefore these different usages of Spinoza that can be considered historically significant in the course of history, that is to say in terms of their specific conjunctures. This can be seen with the orthodox use of Spinoza by Plekhanov and the critical usage of Spinoza by Labriola at the heart of the second international. Plekhanov gave himself the task of elaborating the originality of Marx's philosophy and defending it in the face of revisionists who, with Bernstein, contest the self-sufficiency of Marx's philosophy, dividing into an evolutionary sociology and a Kantian inspired ethics. For Plekhanov there is very much a Marxist philosophy. It is inscribed in the materialist current which it revitalizes by giving it a historical dialectical dimension. Spinoza is the direct ancestor of Marx in that it is through the monism of the former that one can unify the science of nature and the science of history of the latter. Marx has revitalized substance as historical-social matter, metabolism of humanity with nature, and has inherited his realist theory of knowledge, thought is nothing other than a moment or function of matter. There is a Spinozism of Marx that is the realization of historical Spinozism as a the affirmation of the materialist conception of the world, one predicated on the knowability of matter in terms of its organization at diverse levels. Only this conception of the world can give the workers' movement its organization and which would permit it to avoid the disorganization that revisionism introduces, neo-Kantian idealism cannot organize the class struggle without harmful compromises. Spinoza is one part of orthodox Marxism returned to during this period. This Spinoza can authorize the theses of Friedrich Engels, in some sense simplifying the complexity of the Anti-Dühring. Concerned to think together the development of the sciences of nature, the materialist conception of history, and developing a philosophy capable of correct reflection and the movement of the specialization of sciences and the political struggle of classes (alliance with the intellectual stratum), Engles had proposed the idea of a materialist dialectic that oscillates between an ontological conception and a methodological conception of this dialectic. These two conceptions are apparently unified in the idea of "the science of the general laws of motion, both of the external world and of human thought — two sets of laws which are identical in substance, but differ in their expression in so far as the human mind can apply them consciously, while in nature and human history (at least up to now), these laws assert themselves unconsciously, in the form of external necessity, in the midst of an endless series of seeming accidents." This parallelism between (laws of) movement of the external world and (the laws of) thought has a Spinozist connotation which reinforces the idea of liberty as the comprehension of necessary laws. However, it remains above all intended to make possible a representation of the dialectic under materialism, without examining its own difficulties. Plekhanov is not interested in these difficulties in elaborating a general materialist conception that Marx completes and fulfills through the mediation of Hegel. Antonio Labriola, who wrote "Origin and Nature of the Passions According to Spinoza's Ethics" at a young age (1866), refuses this ontologization or methodolization of the dialectic in order to develop the idea of a philosophy of praxis as a philosophy immanent to a new conception of history, reflecting the constitution of history as a complex unifying ground and surface. In this sense, the Plekhanov project, apparently Spinozist, of thinking the continuity of nature and society at the heart of a substantial and homogenous causality loses its sense. The process of social life must be desubstantialized at with it the philosophy that is presented as a hyperphilosophy or super science organized as "theosophic or metaphysic of the totality of the world, as if by an act of a transcendent knowledge we can arrive at a vision of substance and all of the phenomena and processes under it." Antonino Labriola as much as he refuses to make man an 'kingdom in a kingdom' refuses the naturalization of history and the transformation of Marxism into a naturalist ontology where social practice becomes a species of being in general. Labriola denounces a matter found on things as a form of metaphysical superstition. Spinoza is evoked as a hero in the struggle against the imagination and ignorance that resurfaces in Marxist orthodoxy under the form of universal materialism. It is necessary above all to think of the diverse levels of the "animation" of matter, and therefore the specificity of the "artificial terrain" which constitutes practice. What Spinoza knew how to do for the theory of passions must be done for praxis: each one, the relations of affects and and those that constitute praxis, are not ruled by a subject and for this reason must be studied through a genetic method. Labriola speaks of a genetic method that also defines the method of Marx in Capital. The genetic method takes its distance from the dialectic and its teleological philosophy of history and established guarantees. For Labriola the turn to Spinoza is less about the strengthening of a materialist monism than it is about the possibility of reinterpreting Marx's Capital as a geometry of capitalist social being. The geometrical method is an instrument of internal purification destined to eliminate the finalism of productive causes and biological predetermination from Marxist orthodoxy. The philosophy of praxis manifests the basic critical and formal tendency of monism: everything is conceivable as a the causal genesis of a complex totality. The materialist dialectic is neither a universal method nor a logic of being, but constitutes the critical movement internal to knowledge which acts on the practice of philosophy and makes it a "conceptual form of explication" parallel to contemporary science. The reference to Spinoza intervenes in the critique of a Marxist orthodoxy which is supposed to include in a dogmatic manner Spinoza's own materialism. Marx and Spinoza are considered as two practitioners of philosophy who refuse the closure of knowledge in favor of the immanent self-reflection of knowledge. The lesson of Spinoza is not to find the unity of knowledge under a principle but to demystify the fetishes which substitute imaginary principles for the movement of practice. One could develop a similar analysis of the confrontation of the Soviet Spinoza of the Third International to the Spinoza of Louis Althusser. The Soviet Spinoza is an impoverished and petrified version of the Spinoza of Plekhanov. With respect to Althusser, Spinoza's critique is referenced constantly and augmented, infinitely better elaborated than in Labriola, since it acts this time not as a critique of metaphysical fetishism, even materialist, but of the metaphysics of the juridical subject characteristic of occidental rationalism. The contributions of R. Zapata and J.-P. Cottent have clarified these points, but it seems opportune to underly the paradox of this history: it is possible to tie together the diverse uses of Spinoza, one against the other. If Spinoza is enrolled in the constitution of a "conception of the world" which intends to complete a current of philosophy and which cannot at any time criticize its presuppositions, it is also possible, as with Althusser, to think the structure of ideological interpellation that constitutes the ideological subject and invalidates philosophy considered as a theory of knowledge. If Spinoza makes possible a conception of the world in which the State Party is supposed to be the subject of history accomplishing its ultimate ends, it also makes it possible for Althusser to try to reconstruct Marxist theory on the ruins of the triple myth of origin, subject, and the end. The Labriolian critique of imaginatio and ignorantia is radically interiorized in the destruction of Marxisms of the Second and Third International. The recourse to structural causality supposed to have been developed in the theory of modes and substance serves as an incomplete program to develop the theoretical revolution of Marx. However, it goes further still: there are two Spinoza's in Althusser himself. The Spinoza critical of any theory of knowledge ultimately occludes the Spinoza of structural causality: the denunciation of the triple myth of origin, subject, and end is lead to the liquidation of the rational modernism present in Marx. However the pars destruens always prevails over the pars construens. The idea of structural causality (such that of substance as the absent cause over the modes and affects) is accompanied with the affirmation of an unknown radicality of Marxist science, but the critique of the metaphysics of subjectivity in the teleology of Marxism that accompanies it announces the crises of Marxist liberation in the last interventions of Althusser. Everything comes to pass as if Althusser deconstructs a dogmatic Spinoza in the name of another Spinoza, more secret and more enigmatic. Drawing on the current debates, both political and academic, this doctoral research deals with the political legitimacy of European integration. Although political legitimacy is not a new concept in political science, it has attracted increased attention over the last two decades in the context of reflections on democracy, governance and the "crisis" of legitimacy at the European level, the sphere on which this research is founded. This thesis takes a sociopolitical approach to legitimacy, beyond any normative considerations. More specifically, it focuses on legitimacy understood as the acceptance of a changing political order by ordinary citizens, this acceptance being more or less conscious and active. The specificity of this approach lies in addressing this problem in all its complexity, analyzing both its latent and its manifest aspects. As a result, it contributes to the study of the processes of acceptance and/or resistance to the current process of European integration and its possible or desirable politicization. More precisely it is focused on the indifference of ordinary citizens to this process. Indeed the politicization of the European political order is at the heart of many academic debates and as a result a better understanding of this indifference is essential. Ameliorating our understanding of the lack of salience of European issues for a growing part of the public is the fundamental task tackled in this thesis. Beginning with a critical review of the literature on European legitimacy that underlines some of its weak points, the first chapter of this thesis provides a synthesis of the different theoretical models of legitimation that have been used in the course of European construction. The presentation of these different models provides the backdrop against which we are able to understand how citizens' attitudes towards European integration have been analyzed in the existing literature. This first chapter demonstrates how the citizen, from being a simple spectator, has been constructed as a key actor in the processes legitimizing European integration. Mobilizing a new longitudinal analysis of Eurobarometer data, the results of the second chapter lead us to conclude that the principal limitation of the way the notion of support is used in the literature is its over-reliance on a one-dimensional understanding of citizens' attitudes towards European integration. Contrary to this, we defend the idea that these attitudes are much more complex. The evolution of the post-Maastricht period cannot simply be reduced to an increase in "euroscepticism", particularly amongst lower socio-economic groups. This chapter concludes that it is necessary to take into account indifferent or undecided citizens to fully comprehend the question of the legitimacy of European integration, in all its components. The non-polarization of a significant number of citizens is indeed an overwhelming phenomenon. However, the study of this non-polarized category of citizens is not without posing substantial methodological problems. The third chapter thus deals with the issues surrounding the choice of methodology for the analysis of ordinary citizens' lack of polarization. With the goal of contributing to the renewal of research on citizens' attitudes towards European integration, we chose to put into place a methodology that is both qualitative and exploratory, whilst continuing with efforts to quantify the different processes observed, along the lines of existing European studies. This research therefore adopts a triangulation strategy that commonly comes under the term of mixed-methods. In this chapter we outline the reasons for our choice of focus groups as a research tool and set out our comparative research design in detail. 24 focus groups were conducted in the context of the research project Citizens Talking About Europe in (francophone) Belgium, in France, and in Great Britain. The additional perspective gained by the use of focus groups in three countries leads us in the fourth chapter to refute the underlying premise of the "constraining dissensus", already visible in the model of the "permissive consensus": the premise of the uniformity of national attitudes towards European integration. Building on the work of Juan Diez Medrano, in his book Framing Europe, the systematic coding analysis of our collective interviews leads us to confirm that different groups have different structures of perception and therefore of evaluation of European integration. Having radically questioned the uniformity of national attitudes towards the European Union, the fifth chapter demonstrates that the plurality of perceptions not only differs from one country to another but also within a given national context. In each of the three countries we studied, we observed the same increase in the number of citizens who expressed neither explicit support nor rejection of integration. In this chapter we focus our analysis on these undecided or indifferent citizens, distinguishing three forms of non-polarization: ambivalence, distance and exteriority, and fatalism. These three forms correspond to different framings in three different national categories however. In conclusion, our overall results lead us to interrogate the relevance of the affirmation according to which the permissiveness as understood in the thesis of the "permissive consensus" ended with the ratification of the Maastricht Treaty. We propose an alternative interpretation, which argues that the acceptance of a European political order stems from at least two rationales. On one hand, amongst the elites (understood in a broad sense as political or economic or even simply citizens interested in the political sphere) we observe a polarization of opinion characterized by a decline in support and a reinforcement of opposition to the processes of European integration. This tendency is emphasized and explained by the model of "constraining dissensus". On the other hand, we observe the reinforcement of indifference and/or indecision amongst ordinary citizens not expert in political matters, faced with this same process. The first rational of appropriation is linked to an active form of contentment or rejection, whereas the second demonstrates a mode of tacit acceptance, illustrating that the "permissive consensus" has not disappeared in the post-Maastricht era, although it has been transformed over the course of the integration process. In this respect, European legitimacy must be understood as both direct and indirect: as a double process. It must be seen as the extension and/or transformation of the acceptance of the national political order. Our results therefore suggest that we reconsider two commonly accepted premises, firstly that the European Union has become a salient issue for citizens and secondly that European public opinion has become polarized on the question of Europe. More generally, the conclusion of this thesis invites us to question the acceptance of change in the political order by investigating not only the degree of support citizens have for the European political system and the type of support they express, but also at the intensity of this support. Although the contrast between the pre- and post- Maastricht periods in terms of the parallel growth of the competences of the European Union and the publicity around European issues is not called into question, an interpretation based on the binary permissive consensus/euroscepticism appears incomplete if not erroneous. In emphasizing the complexity of the dynamics of politicization, this thesis suggests that the alleged break in the "permissive consensus" amongst citizens needs to be put into perspective. Thus, it is not clear that the "popular mood" towards Europe is the mirror image of the level of dissensus amongst elites . Notre travail adopte donc une stratégie de triangulation, qu'on désigne couramment sous le terme de mixed-methods. Nous justifions dans ce chapitre du choix de recourir au focus group comme outil d'enquête et détaillons notre design de recherche comparatif. 24 focus groups ont été réalisés dans le cadre du projet de recherche Citizens Talking About Europe en Belgique (francophone), en France et en Grande-Bretagne. Ils permettent d'appréhender dans toutes leurs composantes les rapports des citoyens ordinaires à l'intégration européenne. Le regard complémentaire porté grâce à l'utilisation de focus groups réalisés dans ces trois pays nous amène dans le quatrième chapitre à réfuter le postulat, sous-jacent à la thèse du « dissensus contraignant », déjà présent dans le modèle du « consensus permissif », d'une uniformité des attitudes nationales à l'égard de l'intégration européenne. Inspirée des avancées réalisées par Juan Diez Medrano dans son ouvrage Framing Europe, l'analyse systématique par codage de nos entretiens collectifs amène à confirmer que des publics différents ont des structures de perception, et donc d'évaluation, différentes à l'égard de l'intégration européenne. Après avoir remis en cause l'uniformité des attitudes nationales à l'égard de l'Union européenne, le cinquième chapitre démontre que la pluralité de perceptions diffère non seulement d'un pays à l'autre, mais qu'elles peuvent également par ailleurs coexister au sein d'un même contexte national. Dans chacun des pays enquêtés, on observe la même croissance de la catégorie de citoyens n'exprimant ni soutien explicite, ni rejet du processus d'intégration. En conclusion, l'ensemble de nos résultats nous conduit à interroger la pertinence de l'affirmation selon laquelle la permissivité telle que comprise dans le cadre de la thèse du « consensus permissif » a pris fin avec la ratification du Traité de Maastricht. Nous proposons une interprétation complémentaire, qui souligne que l'acceptation de l'ordre politique européen relève de deux logiques au moins. D'un côté, on assiste parmi les élites, entendues au sens large, tant politiques, qu'économiques, voire tout simplement les citoyens qui portent un intérêt à ce qui se joue dans le champs politique, à une polarisation des opinions marquées par un déclin des opinions favorables et un renforcement des oppositions au processus d'intégration européenne, tendance soulignée et expliquée par le modèle du « dissensus contraignant ». D'un autre côté, on constate un renforcement de l'indifférence et/ou de l'indécision des citoyens profanes en matière politique face à ce même processus. Là où la première logique d'appropriation renvoie à un mode actif de consentement ou de rejet, la seconde relève d'un mode d'acceptation tacite actualisant le modèle du « consensus permissif » dont nous montrons qu'il n'a pas disparu dans l'ère post-Maastricht, même s'il s'est transformé au fil de l'intégration. A cet égard, la légitimité européenne doit être comprise comme étant, à la fois, directe et indirecte, dans un double processus. Elle doit être perçue comme l'extension et/ou la transformation de l'acceptation de l'ordre politique national. Plus généralement, la conclusion de cette thèse invite à aborder la question de l'acceptation d'un changement dans l'ordre politique en s'intéressant non seulement au degré de soutien des citoyens au système politique européen et au type de soutien exprimé, mais également à son intensité. Si le contraste entre les périodes pré et post-Maastricht en termes de croissance concomitante des compétences de l'Union européenne et de publicisation des enjeux européens n'est pas remis en cause, la lecture basée sur le diptyque consensus permissif / euroscepticisme semble incomplète sinon erronée. En soulignant la complexité des dynamiques de politisation, cette thèse amène à relativiser la rupture du « consensus permissif » des citoyens. Ainsi, il n'est pas évident que l' « humeur populaire » à l'égard de l'Europe et le niveau de dissensus des élites se répondent en miroir . A cet égard, la légitimité européenne doit être comprise comme étant, à la fois, directe et indirecte, dans un double processus. Elle doit être perçue comme l'extension et/ou la transformation de l'acceptation de l'ordre politique national. L'ensemble de nos résultats invite par conséquent à reconsidérer deux postulats communément perçus comme acquis, à savoir non seulement que l'Union européenne serait devenu un enjeu saillant pour les citoyens, mais aussi que les opinions publiques européennes se seraient polarisées. Plus généralement, la conclusion de cette thèse invite à aborder la question de l'acceptation d'un changement dans l'ordre politique en s'intéressant non seulement au degré de soutien des citoyens au système politique européen et au type de soutien exprimé, mais également à son intensité. Si le contraste entre les périodes pré et post-Maastricht en termes de croissance concomitante des compétences de l'Union européenne et de publicisation des enjeux européens n'est pas remis en cause, la lecture basée sur le diptyque consensus permissif / euroscepticisme semble incomplète sinon erronée. En soulignant la complexité des dynamiques de politisation, cette thèse amène à relativiser la rupture du « consensus permissif » des citoyens. Ainsi, il n'est pas évident que l' « humeur populaire » à l'égard de l'Europe et le niveau de dissensus des élites se répondent en miroir . La politisation des enjeux européens ne menant pas nécessairement à une polarisation des opinions des citoyens, nous soutenons qu'il convient d'intégrer l'indifférence dans toute réflexion portant sur la légitimité du processus d'intégration européenne. ; (POL 3) -- UCL, 2010
La presente tesi non è solo l'esito di una ricerca su un precetto giuridico controverso, ma è anche la narrazione di un processo personale di scoperta, che a partire dallo studio di una specifica norma ha fatto emergere la complessità delle interazioni nell'ambito delle politiche in materia penale, economica, e finanziaria. Partendo da un approccio microsociologico focalizzato sull'analisi di una determinata norma penale, il reato di riciclaggio,1 la ricerca ha dovuto confrontarsi con temi di interesse macrosociologico, al fine di inserire l'analisi della legge all'interno di un contesto più ampio di politiche nazionali, europee e internazionali, di attori e di governance transnazionale. Per mantenere la scientificità dell'elaborato ho omesso di esprimere opinioni personali sui temi, talvolta di carattere fortemente politico, e ho cercato, invece, di presentare aspetti critici e discussioni aperte fornendo una visione completa e imparziale delle contrastanti argomentazioni in modo da lasciare il lettore libero di trarre le proprie conclusioni. Il riciclaggio di denaro sporco è il processo tramite cui a proventi di reati viene data un'apparenza di essere stati guadagnati in modo illecito. È un reato tipico della cosiddetta 'zona grigia', poiché avviene al confine tra la sfera della legalità e quella dell'illegalità. Nel momento in cui profitti realizzati illecitamente si mescolano ai flussi di denaro lecito è molto difficile discernere ciò che ha un'origine legale da ciò che è stato guadagnato illegalmente. Il reato di riciclaggio di denaro sporco è stato introdotto proprio per affrontare questa difficoltà ed impedire che le strutture legittime dell'economia e della finanza globale venissero abusate da trasgressori al fine di ripulire i proventi di reato. Infatti i flussi di denaro sporco utilizzano spesso gli stessi canali usati per le transazioni lecite; la loro riuscita dipende dalla cooperazione di professionisti quali avvocati commerciali, agenti finanziari, commercialisti, la cui reputazione è raramente sospetta. Data questa promiscuità spesso la gravità del fenomeno è sottovalutata dal pubblico che non ha gli strumenti per riconoscerne la pericolosità, anche a causa dell'assenza di vittime dirette. Dall'altra parte le stime sulla quantità di proventi di reato riciclati a livello mondiale (che oscillano tra il 2,5 % e il 5,5 % del PIL globale) richiamano l'attenzione su quella che Dalla Chiesa definisce la mitologia del volume dell'economia criminale,2 e una parte della letteratura descrive il riciclaggio come il lato oscuro della globalizzazione,3 e come uno dei maggiori problemi dell'era moderna.4 Con questa ricerca ho voluto mettere in discussione l'efficacia del reato di riciclaggio nel far fronte al fenomeno dell'infiltrazione dei flussi di denaro sporco nell'economia lecita. Sebbene la pratica di nascondere i proventi di reato in modo da evitare la persecuzione giudiziaria risalga probabilmente a molto tempo addietro, il concetto giuridico di riciclaggio è relativamente recente ed è stato introdotto nei codici penali nella maggior parte del mondo a partire dalla fine degli anni 80.5 Nel frattempo un gran numero di autori si è scagliato contro la scarsa efficacia delle legislazione anti-riciclaggio6, nonostante le innumerevoli novità introdotte e i cospicui ammendamenti che hanno in larga parte espanso il campo di applicazione della normativa. La decisione di scegliere il contesto tedesco come caso di studio deriva dal fatto che il paese è considerato avere un rischio particolarmente alto di riciclaggio di denaro sporco. Secondo il rapporto emesso dal 2010 dal GAFI (Groupe d'Action Financière), dal FMI (Fondo Monetario Internazionale) e dall'OCSE (Organizzazione per la Cooperazione e lo Sviluppo economico)7 ci sono alcuni fattori che rendono la Germania propensa ad essere usata al fine di riciclaggio di denaro sporco: il volume del sistema economico-finanziario, la locazione strategica al centro dell'Unione Europea con forti legami internazionali, l'uso diffuso di denaro contante,8 l'apertura delle frontiere, la vastità del settore informale, l'importante ruolo a livello di economia globale, e il coinvolgimento nei flussi di denaro transfrontalieri. Anche i media, a partire soprattutto dalla pubblicazione del citato rapporto, hanno attirato l'attenzione del pubblico sul fenomeno, descrivendo la Germania come "paradiso" o "Eldorado" per i riciclatori. Alcuni recenti scandali hanno visto coinvolte prominenti banche tedesche, come la Deutsche Bank, la Commerybank e l'Hyopovereinsbank, contro cui procure straniere hanno sollevato l'accusa di riciclaggio di denaro sporco.9 La legislazione in atto, ed in particolare l'articolo 261 del codice penale tedesco, non sembra essere sufficientemente efficace per contrastare il fenomeno, nonostante gli abbondanti emendamenti e il continuo processo di aggiornamento e di espansione del campo di applicazione della norma. Al fine di spiegare questa per lo meno apparente incapacità della norma di fare fronte al fenomeno del riciclaggio, ho costruito l'ipotesi di ricerca sulla base delle teorie sociologico-giuridiche relative all'efficacia del diritto, alle funzioni manifeste e latenti delle norme e quindi alle intenzioni espresse e non dal legislatore, all'efficacia simbolica del diritto e di singole legislazioni e all'impatto, inteso come comprensivo degli effetti indesiderati o collaterali. L'ipotesi di ricerca è che la norma esplichi una funzione simbolica di allineamento dell'ordinamento nazionale a quello europeo e transnazionale, di compromesso tra gli interessi politici in gioco, e di creazione di consenso pubblico verso il legislatore per essersi occupato della questione. Si ipotizza che il legislatore abbia quindi consapevolmente accettato o addirittura scelto di formulare una norma strumentalmente poco efficace, ma simbolicamente capace di raggiungere i suoi obiettivi latenti. Si solleva inoltre l'ipotesi che la norma sia stata appositamente approvata con lo scopo di non modificare lo status quo delle relazioni e strutture economiche, e di permettere quindi l'ingresso di capitali sporchi nel paese, sulla base del motto pecunia non olet. La suddetta ipotesi viene parzialmente smentita dai risultati della ricerca empirica. La ricostruzione del processo di produzione legislativa mette in risalto l'esistenza di svariati e contrastanti interessi e della forte pressione esercitata dagli organismi internazionali per l'introduzione e lo sviluppo del reato di riciclaggio, e conferma, quindi, l'argomentazione che la norma sia stata approvata in un contesto di pressione politica esterna e di necessità di trovare un compromesso tra diverse parti politiche. Anche l'analisi degli aspetti problematici dell'articolo 261 del codice penale tedesco messi in risalto dalla dottrina supporta l'ipotesi della simbolicità della norma. Il fatto che il legislatore abbia formulato un reato così complesso crea evidenti problemi di integrazione dello stesso all'interno del sistema penale tedesco, e quindi di accettazione da parte degli studiosi e potenzialmente da parte degli operatori del diritto. Inoltre, la scelta di costruire un reato così complesso riflette la necessità di venire a compromesso con opposti interessi, ma potrebbe essere anche essere interpretata come un disinteresse al raggiungimento di un'efficacia materiale. La ricerca empirica sull'implementazione dell'articolo 261, invece, smentisce l'idea che la norma abbia un'efficacia puramente simbolica. Infatti il numero di condanne, di investigazioni, ed in generale l'uso ricorrente della legge riscontrato nelle statistiche criminali provano che essa conduca ad effetti strumentali, oltre che simbolici. Inoltre, nella prospettiva di alcuni degli operatori del diritto e degli esperti intervistati, l'articolo 261 è percepito come una norma particolarmente efficiente, sia in relazione alle quote di chiarimento, che come strumento di demarcazione tra comportamenti leciti e illeciti, in un contesto di deregolamentazione del settore finanziario. Da un'analisi piè ravvicinata delle statistiche e di altri rapporti emessi da enti internazionali e nazionali emerge però un quadro non così univoco: La norma sembra colpire più le vittime dei network criminali che operano a livello transnazionale che gli autori, perché spesso i colpevoli sono coinvolti in transazioni sospette in cambio di guadagni monetari. Le cospicue indagini finanziarie non riescono a raggiungere coloro che operano dietro gli esecutori dei reati minori, ed infatti la maggior parte di esse si concludono senza una condanna per riciclaggio. Questo a fronte di un volume di denaro sporco circolante nel paese che rimane allarmante, secondo alcuni degli studi analizzati. Se da una parte i risultati dell'applicazione della norma, sebbene strumentali, non possono considerarsi soddisfacenti, perché non sono riusciti ad evitare l'ingresso di capitali illeciti nell'economia nazionale, dall'altra parte sembra che l'esistenza di interessi profondamente contrastanti in gioco renda quasi impossibile la formulazione di un reato piè efficace. La tesi è composta da cinque capitoli, un'introduzione e una conclusione. Nel primo capitolo espongo le teorie sociologiche adottate per la valutazione di efficacia della norma e il metodo della ricerca. Inizialmente richiamo concetti di efficacia forniti da discipline affini alla sociologia del diritto - tra cui per esempio il concetto di efficienza e di efficienza indipendente rispetto allo scopo (zielunhabhängige Effizienz) riferito agli apparati amministrativi - che torneranno utili per l'interpretazione dei risultati delle interviste. Successivamente procedo con una panoramica sulle definizioni di efficacia del diritto fornite in sociologia del diritto, sulla ci base adotto una nozione "elastica" -riprendendola da Ferrari- di efficacia di una norma che guarda alle funzioni della norma e alle intenzioni del legislatore, in una prospettiva "intenzionalistica": "la corrispondenza fra un disegno politico di utilizzo di uno strumento normativo e i suoi effetti". Tale nozione, oltre a prestarsi ad un'analisi critica del diritto, fornisce indicazioni utili per l'analisi empirica dell'efficacia della legge in questione. In particolare ritengo utile considerare le seguenti variabili: le intenzioni latenti e manifeste del legislatore, gli scopi diretti e ed indiretti, l'eventuale efficacia simbolica del diritto, l'implementazione, la ricezione della norma nel senso di accettazione nel sistema giuridico e di interpretazione e percezione da parte degli operatori giuridici. Nella seconda parte si evidenzia il rilievo di tali variabili con riferimento specifico al diritto penale. In conclusione, sulla base delle riflessioni teoriche, formulo l'ipotesi sull'efficacia simbolica del reato di riciclaggio nell'ordinamento tedesco, che verrà poi verificata nei capitoli successivi. Nello specifico, presumendo che il reato di riciclaggio, introdotto come strumento fondamentale della lotta alla criminalità organizzata, così com'è formulato non adempie agli scopi dichiarati, nonostante gli innumerevoli emendamenti finalizzati proprio ad aumentarne l'efficacia, ipotizzo un'efficacia simbolica della norma, introdotta per offrire un'immagine di efficienza al pubblico (elettori). Inoltre sollevo l'ipotesi che la norma sia stata emanata appositamente inefficace per neutralizzarne le aspirazioni di punizione delle condotte illecite tipiche dei colletti bianchi, in una lettura moderna del conflitto sociale che avviene tramite l'emanazione di norme, con la volontà di decriminalizzare secondariamente comportamenti tipici delle classi forti. Nel secondo capitolo analizzo il processo legislativo a livello internazionale, europeo e nazionale. Il processo che ha portato alla creazione del reato di riciclaggio a livello internazionale viene ricostruito tramite dichiarazioni di intenti degli attori partecipanti, opinioni pubblicate, trascrizioni dei dibattiti parlamentari. Una particolare attenzione è posta sulle diverse intenzioni degli attori che hanno partecipato alla formulazione del reato. Il processo legislativo che ha portato alla formulazione dell'attuale legislazione anti-riciclaggio è un processo complesso, in cui diversi attori partecipanti hanno contribuito con differenti aspettative e dunque attribuendo diverse funzioni alla criminalizzazione del riciclaggio. Al fine di permettere svariate interpretazioni del dettato normativo in modo da soddisfare i differenti bisogni, e con lo scopo di trovare un compromesso tra gli interessi divergenti, il reato di riciclaggio è stato formulato in modo vago. Mentre alcuni Stati (ad esempio la Francia) inizialmente sostenevano l'introduzione del reato con lo scopo di combattere i paradisi fiscali e rafforzare la lotta all'evasione fiscale, altri Stati, come la Svizzera, hanno accettato di firmare l'accordo internazionale sulla criminalizzazione del riciclaggio solo a condizione che l'evasione fiscale non fosse inserito nella lista dei reati antecedenti. Con la nascita del GAFI la policy viene usata allo scopo di difendere l'integrità del sistema finanziario dall'infiltrazione di capitale illecito e dal 2001 si aggiunge la funzione di lotta al finanziamento del terrorismo. Tramite la soft law emanata dal GAFI per la prevenzione del riciclaggio, si trasferiscono compiti solitamente pubblici al settore privato: banche e istituti finanziari devono segnalare alla polizia ogni transazione sospetta, devono raccogliere e mantenere informazioni sui clienti e verificare le identità dei clienti. L'Unione Europea finora ha emanato quattro direttive nell'ambito del riciclaggio, l'ultima risale al 20 maggio 2015. Inizialmente la CE non aveva competenza in ambito penale, perciò la materia riciclaggio fu assorbita nella sfera economica (DG Economia e industria). La funzione dichiarata dal legislatore è la protezione del mercato interno, con particolare riguardo al fatto che i criminali possano sfruttare la libera circolazione dei capitali e l'eliminazione delle frontiere. Le direttive esprimono anche la volontà di impedire agli stati membri di emanare regolamentazioni che possano bloccare il libero mercato al fine di difendere le proprie economie dall'infiltrazione di capitale illecito. Emerge dunque un ulteriore conflitto di interessi. Nella seconda parte ricostruisco il processo legislativo e le evoluzioni interne alla Germania fino al momento della scrittura e fornisco il quadro del sistema repressivo e di prevenzione anti-riciclaggio. L'articolo 261 StGB è stato introdotto con legge Gesetz zur Bekämpfung des illegalen Rauschgifthandels und anderer Erscheinungsformen der Organisierten Kriminalität, quindi nell'ambito della lotta alla criminalità organizzata. Il dibattito parlamentare rileva che la norma è il frutto di un compromesso sotto diversi aspetti, non ultimo il fatto che è stata emanata del 1992, a pochi anni dalla riunificazione, e che quindi è parte del processo di negoziazione per la formazione di un diritto penale adattabile alle due culture giuridiche. Il legislatore tedesco evidenzia alcune funzioni della norma: la lotta al consumo di eroina e al traffico di stupefacenti, la diffusione e la pericolosità della mafia alla luce dei fatti recenti italiani, la volontà di proteggere l'amministrazione della giustizia e di isolare i criminali puntando alla criminalizzazione dei cosiddetti gate-keepers. Nel terzo capitolo individuo alcuni dei problemi sollevati dalla dottrina tedesca sul piano teorico con riferimento alla criminalizzazione del reato di riciclaggio nel contesto del sistema penale tedesco. Uno dei temi più discussi è relativo al bene giuridico protetto. La dottrina non ha ancora trovato un accordo su quale interesse sia protetto dall'articolo 261 StGB, le ipotesi sono: gli interessi dei reati antecedenti, l'amministrazione della giustizia, il sistema finanziario e la sicurezza. La vaghezza del dettato normativo non aiuta a trovare un interpretazione dottrinale univoca. La questione del bene giuridico protetto, lungi dall'essere una mera questione teorica, risente delle diverse funzioni attribuite alla norma dagli attori partecipanti al processo legislativo. Finora la giurisprudenza, che pur è intervenuta a chiarire altre questioni relative alla norma, non è intervenuta sul tema. Un altro tema su cui il dibattito è ancora aperto è il fatto di aver previsto al comma 5 l'ipotesi di colpa lieve, in controtendenza rispetto al legislatore europeo. Questo, secondo alcuni studiosi porta all'assurdo per cui anche il panettiere Tizio che vende del pane ad un evasore fiscale Caio potendo aver riconosciuto che Caio fosse un evasore, si rende colpevole di riciclaggio. La questione del livello di mens rea richiesto per una condanna per riciclaggio era sorta anche durante il dibattito parlamentare e l'introduzione del comma 5 è stato sostenuto da un emendamento della SPD che avrebbe voluto criminalizzare anche l'ipotesi di colpa lievissima. Questo, secondo la CDU avrebbe messo un freno al mercato e alle transazioni, poiché avrebbe costituito una minaccia per chiunque avesse intrapreso operazioni economiche. Essendo la funzione della norma incerta, la dottrina si divide tra chi sostiene che questa vasta criminalizzazione faccia perdere il senso del reato che sarebbe invece colpire i criminali che agiscono con intento, e chi invece sostiene che la norma abbia lo scopo di impedire qualsiasi infiltrazione di denaro illecito e quindi richieda una responsabilizzazione di tutti colori i quali prendano parte in operazioni finanziarie o economiche. Ancora una volta l'indeterminatezza del precetto legislativo è di ostacolo ad un'interpretazione univoca. Il quarto capitolo offre un'analisi qualitativa delle statistiche officiali sull'implementazione della legge dal 1992 ad oggi da parte delle istanze repressive e di prevenzione. Tra i dati analizzati i più rilevanti sono per esempio il numero di segnalazioni di transazioni sospette ricevuto dalle procure, il numero delle investigazioni condotte, il numero di condanne effettivamente inflitte ed eseguite e per quale delle ipotesi di riciclaggio, il volume di denaro confiscato. Essendo tali numeri indici del funzionamento del sistema penale e non del fenomeno del riciclaggio per sé, in conclusione si confrontano tali statistiche con le stime sul volume di flussi illeciti in Germania. Tale analisi, non potendo dare conto del numero dei reati evitati, sulla base dell'efficacia deterrente della norma, non intende esaurire il giudizio di efficacia della legislazione. Tra i risultati più rilevanti vi sono il fatto che il 60% delle persone condannate vengono condannate per l'ipotesi di colpa lieve, che solitamente consiste in casi in cui una persona poco abbiente ha accettato di far usare il proprio conto a terzi per operazioni sospette in cambio di un guadagno. Nel 5% dei casi le condanne sono inflitte per le ipotesi aggravate di commissione da membro di un'associazione criminale o in forma commerciale. Nel 90% dei casi le transazioni sospette segnalate alle procure portano a una chiusura dei procedimenti per mancanza di indizi che possano sostenere un rinvio a giudizio. La norma sembra colpire delinquenti minori e non grandi gruppi criminali, né altri delinquenti più potenti. Si ipotizza inoltre che l'incapacità di sostenere un rinvio a giudizio nonostante le informazioni acquisite e le indagini preliminari riduce la capacità deterrente della norma e permette, invece, ai criminali di conoscere le modalità di funzionamento del sistema repressivo e agire di conseguenza. Inoltre, le transazioni sospette sono segnalate nel circa 90% dei casi sa parte di istituti di credito, mentre gli altri enti obbligati dalla legislazione non sembrano partecipare attivamente al processo preventivo, in particolare il settore forense e immobiliare e del gioco d'azzardo. Sulla base di questi dati si ipotizza un effetto spill-over, ossia un trasferimento di illegalità dai settori più controllati a quelli meno controllati. I rapporti pubblicati dalla polizia, invece, considerano l'articolo 261 StGB come una norma con una delle più alte quote di chiarimento (ca 90%), quota calcolata sul numero di casi chiariti dal sistema penale, a prescindere dalle modalità di chiarimento. Per quanto riguardo il volume di denaro riciclato, il capitolo richiama alcune delle stime pubblicate da diversi enti, tra cui il Fondo Monetario Internazionale, il GAFI e la polizia criminale federale. Essendo il fenomeno del riciclaggio un campo in cui la cifra oscura è stimata essere molto alta, tali dati non possono essere presi come misura obiettiva del fenomeno. Infine il capitolo si conclude richiamando alcune analisi del tipo costi-benefici per misurare l'efficacia delle politiche anti-riciclaggio o alcune delle sue norme, condotte da enti terzi. Tali analisi sembrano concordare nel considerare i costi di implementazione della politica più alti rispetto ai benefici conseguenti. Nel quinto capitolo, infine, vengono discussi i risultati della ricerca empirica con gli operatori giuridici e con alcuni osservatori privilegiati, in modo da fornire una prospettiva interna sul funzionamento della norma. Tramite le interviste condotte si mettono in luce aspetti della prassi giuridica non fotografati dalle statistiche, allo scopo di offrire un'immagine dell'impatto della legge quanto più vicina possibile alla realtà. La ricerca empirica si avvale di interviste con operatori del diritto e con osservatori privilegiati che siedono in posizioni ministeriali rilevanti nella lotta al riciclaggio. La metodologia adottata è di tipo qualitativo, è stato fatto uso di interviste semi-strutturate a operatori del diritto e a osservatori privilegiati. Il capitolo presenta le percezioni degli intervistati su quattro temi principalmente: la dimensione del fenomeno del riciclaggio, l'adeguatezza tecnica della legislazione, i conflitti di interesse intrinseci alla legge e sorti dall'applicazione della norma e l'efficacia delle legge. A fronte di un rapporto emesso da quattro ONG nel novembre 2013, sulla base di statistiche prodotte dall'UNODC e dal Fondo Monetario Internazionale, e immediatamente riprese dai media, che descrive il paese come "Eldorado" per i riciclatori,10 le interviste sono dirette a cogliere l'opinione dei rispondenti sulle dimensioni del fenomeno del riciclaggio in Germania. Un intervistato ritiene inaccettabile desumere dal PIL tedesco il volume di affari del crimine organizzato nel paese, e obietta che non si possa, sulla base del giro d'affari del centro finanziario di Francoforte, definire lo stesso come centro di riciclaggio di denaro sporco. Un altro intervistato, dichiara, al contrario, che sicuramente il fatto che la Germania abbia un'economia stabile ed un settore bancario affidabile attiri coloro che vogliano investire proventi illeciti, neppure quest'ultimo possiede, però, dati affidabili sulla quantità di denaro riciclato. Il riciclaggio, come altri fenomeni legati alla criminalità organizzata, è una fattispecie che per definizione sfugge alle autorità e ai confini nazionali. Lo scopo dello stesso è nascondere proventi di reato e sottrarli in questo modo al sistema repressivo, questo è sicuramente un elemento che rende complessa, se non impossibile, la sua quantificazione. D'altra parte, osservano i soggetti intervistati autori del Rapporto del 2013, l'incapacità di fornire statistiche rilevanti dopo più di 20 anni di lotta al riciclaggio, sembra essere un sintomo di una carente volontà politica nel contrastare efficacemente il fenomeno. Secondo gli osservatori privilegiati se la Germania fosse davvero un paradiso per i riciclatori, ciò non sarebbe collegabile ad un deficit legislativo, dato l'impegno del governo nella lotta al riciclaggio, negando, quindi, l'accusa rivolta dai media per cui i criminali sceglierebbero il paese tedesco ai fini di riciclaggio di denaro sporco sulla base delle lacune normative. Agli intervistati è stato chiesto di evidenziare aspetti positivi e problematici della legislazione. Tra i più rilevanti vi sono: la necessità di bilanciare il bisogno di punire la condotta di riciclaggio e rispettare i principi fondamentali del sistema giuridico, il disinteresse da parte degli istituti finanziari nell'indagare l'origine del capitale investito dai clienti, anche in caso di sospetto di provenienza criminale, a causa della possibile conseguente perdita di reputazione nell'ipotesi di apertura di investigazioni da parte delle autorità sul cliente sospetto. Vi è poi una difficoltà materiale nel condurre indagini finanziarie, che spesso, conducono a condotte illecite commesse all'estero; sul punto si osserva che le condotte di riciclaggio, intese come operazioni atte ad ostacolare la provenienza delittuosa, non avvengono su territorio tedesco, bensì all'estero, il denaro che entra in Germania, è, quindi, già "pulito". Inoltre, l'articolo 261 è stato introdotto nel sistema tedesco come trasposizione di una direttiva Europea e non rifletteva una necessità interna dello Stato; la formulazione così vaga, infatti, si presta più per il sistema giuridico degli Stati Uniti, in cui non vige l'obbligo dell'azione penale, mentre in Germania, dove i pubblici ministeri hanno l'obbligo di azione penale, tale norma porta ad iniziare numerose indagini senza avere la capacità di proseguirle. In generale, gli intervistati rappresentanti dei Ministeri rilevano la forte pressione subita da parte del GAFI e dell'Unione Europea per l'emanazione della legge anti-riciclaggio e concordano nel dire che se la norma fosse stata creata sulla base di una necessità e di un dibattito nazionale sarebbe stata scritta diversamente. C'è chi individua nel sistema penale le cause di inefficacia dell'articolo 261, nello specifico, la limitata possibilità di effettuare intercettazioni telefoniche, le restrizioni in materia di inversione dell'onere probatorio, e lo scarso utilizzo della confisca dei proventi di reato a causa del disinteresse da parte delle procure (gestite a livello di Bundesländer) nell'investire risorse in tal senso dato che i beni confiscati non resterebbero in mano al Bundesland ma verrebbero raccolti in un fondo federale e poi spartiti. Si osserva una generale mancanza di risorse pubbliche che porta ad una carenza di personale coinvolto nelle investigazioni e, quindi, ad una incapacità di far fronte ai processi in corso in modo efficace. Per questo motivo, i pm non hanno la capacità di indagare più a fondo casi di riciclaggio all'apparenza semplici, ma che potrebbero portare alla luce organizzazioni criminali operanti nell'ombra. Alla totalità degli intervistati è stata chiesta un'opinione sull'efficacia della legge. L'articolo 261 del codice penale tedesco è stato definito da un soggetto "una legge scritta in modo indecente, che produce risultati banali sul piano delle statistiche criminali, soprattutto con riferimento alle condanne per riciclaggio in grossi casi di criminalità economica". Il reato è così difficile da provare in giudizio, che risulta facile, per la difesa, sfruttare le lacune legislative per evitare una condanna per riciclaggio. I rappresentanti dei Ministeri confermano che la lettera dell'articolo 261 crea confusioni e che quindi l'accusa, pur trovandosi di fronte ad un caso di riciclaggio spesso preferisca perseguire i delitti presupposto. Questo non è, però, un sintomo di inefficacia, dato che l'effettività a cui mira il Ministero dell'interno non è data dal numero di condanne per riciclaggio, ma dal numero di casi risolti, e quindi dal numero di condanne in generale, a prescindere dall'imputazione. D'opinione opposta un altro intervistato che ritiene che l'articolo 261 non abbia alcuna capacità deterrente nei confronti della criminalità organizzata, "la norma ricorre così raramente nella prassi giudiziaria che di fatto non rappresenta una "minaccia" per i potenziali criminali". I soggetti intervistati esprimono più soddisfazione a riguardo della legislazione di prevenzione (GWG); in particolare, con riferimento alle piccole e medie imprese, per le quali è difficile riconoscere tra i partner commerciali coloro i quali investono denaro di provenienza illecita, la possibilità di affidarsi alle autorità investigative, in caso di sospetto è fondamentale. Un avvocato specializzato in compliance per società, descrive la norma preventiva come molto efficace e severa, tanto che è impossibile per le aziende, specialmente per quelle di medie o piccole dimensioni, adempiere a tutti gli obblighi prescritti dalla norma, ma, egli osserva, l'efficacia del sistema sta proprio nel fatto che le autorità di controllo, consapevoli dell'elevata rigorosità della legge, chiudono un occhio di fronte a lievi inadempienze. Una legge meno severa e un controllo più fiscale non otterrebbero la stessa efficacia, perché la norma non avrebbe lo stesso potenziale deterrente. L'efficacia all'interno delle amministrazioni responsabili per la lotta al riciclaggio è interpretata come efficienza dell'apparato, per questo motivo, non ci sono verifiche sull'efficacia degli strumenti giuridici sulla base degli scopi dichiarati, quanto piuttosto sulla correttezza del funzionamento dell'amministrazione e sulle possibilità di migliorarlo; il punto è capire come migliorare, non se il sistema sia efficace o no. Agli intervistati è stata chiesta un'opinione sull'eventuale efficacia simbolica della legislazione. La maggioranza delle risposte è stata negativa, gli sforzi compiuti da parte dello Stato -e quindi delle procure, della autorità competenti e della polizia- nel contrastare il riciclaggio e la criminalità economica non possono essere considerati simbolici. Alcuni intervistati ritengono assolutamente necessaria e strumentale – e quindi non simbolica- l'esistenza del reato nel codice penale come demarcazione di illegalità di tali condotte e come strumento atto a contrastare la criminalità economica perché mette in chiaro entro quali limiti le società possano perseguire profitti in modo legittimo. Di opinione diversa, invece, gli avvocati penalisti i quali si sono detti favorevoli a tale definizione sulla base dello scarso numero di condanne e soprattutto sulla mancata previsione da parte del Governo di mezzi adeguati per l'implementazione della legislazione. Lo stesso è osservato dal terzo settore, il quale sostiene che, a fronte di una legge complessa, oggetto di svariati emendamenti nel corso degli anni, non c'è stato un sufficiente impegno sul versante dell'implementazione; il coinvolgimento del GAFI e dell'OECD nella lotta al riciclaggio è percepito come un modo per creare posti di lavoro e nuove figure professionali, più che un'arena dove discutere efficaci strumenti di lotta ai reati economici. Altri elementi interessanti riscontrabili nelle interviste sono i conflitti di interessi che emergono dall'applicazione delle leggi anti-riciclaggio. Tra essi, vi è il dibattito tra il Ministero dell'Interno e quello di Giustizia in riferimento all'adeguatezza dello strumento penalistico nel contrastare la criminalità economica, dibattito già affrontato dalla dottrina, a cui, però finora, non è stata data una risposta univoca. Da una parte il Ministero dell'Interno auspica un intervento giuridico più deciso, che, per esempio, ricomprenda il reato di riciclaggio nella responsabilità penale degli enti (non ancora esistente in Germania) e sollecita una svolta politica generale in tema di criminalità economica dalla deregolazione del mercato finanziario all'intervento dello Stato in ambito economico ai fini di chiarire i comportamenti leciti e quelli illeciti. Dall'altra parte, il Ministero della Giustizia considera erroneo il ricorso al diritto penale ai fini di risolvere problemi di tipo economico o finanziario e cerca di frenare la tendenza moderna alla proliferazione penale, a favore di un intervento di tipo preventivo-sociale. A tal proposito, si osserva che agli incontri del GAFI a cui partecipano i rappresentanti dei Ministeri di Giustizia, coloro che provino a richiamare l'attenzione sulla necessità di rispettare i principi fondamentali costituzionali e di limitare l'intervento penale a tutela dei cittadini, vengano tacciati di non voler combattere la criminalità organizzata in modo efficace. In conclusione riapro la prospettiva a livello globale ed inserisco il reato di riciclaggio in una riflessione più ampia sulla governace finanziaria. In una prospettiva storica di analisi delle politiche economiche recenti si osserva come vi sia stata una tendenza a deregolare il mercato per mano delle istanze tradizionali pubbliche, e al contempo un aumento di strumenti transnazionali di cosiddetta soft-law che si sono fatti portatori di interessi particolari. Finché questa conflittualità non verrà risolta sarà impossibile impedire il riciclaggio di denaro sporco. Con particolare riferimento al contesto europeo, si prende atto che è stato molto più facile chiudere le frontiere per le persone fisiche e non a quelle giuridiche o ai capitali. ; This paper aims to question the sociolegal1 effectiveness of the money laundering offence.2 The literature that assesses the effectiveness of the anti-money laundering system is abundant. While most of it does not question the regime's goals this paper takes a step back and critically looks at the law-making process. In addition, while most studies have assessed the effectiveness of anti-money laundering law by looking at statistical outcomes, this paper takes a step forward and tries to explain those statistics by looking at legal praxis and at indirect effects. The significance of the research derives from the insertion of the analysis on money laundering offence in a broader political, economic and historical context. The methodology adopted is qualitative, with the intended purpose of underlining the complexity of the issue tackled, rather than reducing it through a quantitative approach. While most of the existing literature has quantitatively assessed the effectiveness of the anti-money laundering regimes on the basis of statistical data and other quantitative indexes and has tried to reduce the complexity of the issue by measuring it numerically, this research adopts a qualitative methodology, which instead highlights the entanglement and the different perspectives on the question. Money laundering is the process of giving profits originated illegally an appearance of having been made lawfully.3 Due to the tightening of economic criminal policies that limit the possibility of integrating ill-gotten gains in the legitimate economy, offenders have developed more and more complex methods and subterfuges to launder proceeds of crime, so the rise of a proper 'money laundering industry' (industria del riciclaggio) is mentioned.4 The total volume of money laundered is estimated to amount to between 2,5 and 5, 5 % of the world GDP.5 Due to the borderline nature of money laundering, which happens between the so-called 'legitimate economy' and the 'dirty economy', and thus involves different actors such as banks, the financial sector, certain professions and businesses, offenders, victims and law enforcement agencies, the legal response needs to compromise with all the various economic, political, social and financial interests at play. Furthermore, where legitimate business intermingles with illegal business and legitimate funds with illicit funds, it is very difficult to distinguish what is legal from what is not. The criminalisation of money laundering was specifically supposed to tackle this fine line. The goal of this research is to assess whether the choice of criminalising money laundering has been effective to tackle this fine line. In order to assess the impact of the domestic implementation of the existing legal framework, the research uses a case study that specifically questions the effectiveness of the money laundering offence in the German national criminal legal system. The interest in the German case derives from the fact that, according to the IMF, the OECD and the FATF, Germany might have 'a higher risk profile for large scale money laundering than many other countries'.6 There are some factors identified as enablers of money laundering activities, such as the large economy and financial centre, the strategical location in the middle of Europe, with strong international links, the substantial proceeds of the crime environment involving organised crime operating in most profit generating criminal spheres, the open borders, the large informal sector and a high use of cash, the large and sophisticated economy and financial sector, the important role in world trade, and finally the involvement in large volumes of cross-border trade and financial flows. The media have kept on reporting the fact that Germany is an ideal country, or even a paradise for money launderers.7 According to most recent media reports, corruption is increasing in Germany along with money laundering and organised crime,8 and illicit financial flows are estimated to amount to 50 Billion Euros annually.9 Renowned banks such as Commerzbank, Deutsche Bank, and Hypovereinsbank have been the focus of recent scandals due to their involvement in large tax evasion and money laundering schemes, investigated mostly by US law enforcement agencies.10 The legal framework has been considered as not being sufficient to tackle the estimated volume of money laundering. In 2007 and 2010 the European Commission initiated two proceedings against the German government for having contravened the European treaty by not having effectively transposed into national law the European framework to tackle money laundering and terrorist financing.11 In response to this wave of criticism, some important changes have been made.12 With specific regards to penal law, the legislature has amplified the scope of the money laundering offence and the sphere of criminal liability in order to improve the effectiveness of the existing legislation.13 Yet the continual expansion process has raised legal challenges that could constitute an obstacle for the effective enforcement of the measure. With regards to international legislation, scholars have often criticized the ineffectiveness of the anti-money laundering regime to not be able to achieve its goals and thus to be only appearance of public action. 14 While there is theoretical support for the perception that policies have contributed to a decrease in the incidence of money laundering, there is no evidence that this goal has actually been achieved.15 The official discourse describes the regime as a crucial tool to prevent and combat money laundering, and lawmakers have been focusing on expanding the reach of anti-money laundering laws. This work however takes a critical approach towards the existing legal framework and presents the view that questioning the effectiveness of the money laundering offence is essential before expanding the scope of the existing legal framework.16 On the background of the reflections based on the sociolegal framework that sets the definition of legal effectiveness with specific respect to criminal law, and on the critical literature on the inadequateness of the international anti-money laundering system to eliminate the targeted activity recalled in the introduction, the hypothesis underlying the case study is the following: Article 261 Gcc may be an example of a symbolic legislation, whose latent functions prevail on its declared functions. In particular, it is hypothesised that the law is an example of a 'compromise-law' that satisfy all parties taking part in the law-making process, thanks to the vagueness of the wording that allows a broad range of possible interpretations, and also thanks to the actual ineffectiveness, which pleases those who were contrary to the introduction of the provision. It is here necessary to recall the considerations on the 'legislator' being an heterogeneous group of parties not only constituted of members of the Parliament but often also by external actors, who can influence more or less transparently the law making-process. While the manifested function of tackling money laundering has in fact remained in the background, the thesis hypothesises that other latent goals have been pursued. It is further hypothesised that the 'law inaction' is part of a process of decriminalisation that intentionally grants impunity to a certain group of actors, in this case those laundering money, while giving the appearance that the practice is not accepted by law by labelling it as criminal. By using the concept of function, the study focuses on eventual conflicting interests emerging throughout the policy-making process and/or being displayed through the implementation of the provisions. In order to verify these hypotheses the research proceeds with a case study that aims at empirically assessing the sociolegal effectiveness of Article 261 Gcc. In particular, by applying the 'elastic' definition of effectiveness, the following chapters analyse the law-making process, the level of acceptance by legal scholars, the implementation, and the opinions of legal experts and professionals. The methodology adopted is qualitative. The research consists of a case study that includes a documental research, a qualitative analysis of statistical data and the conduction of interviews with privileged observers and legal actors. The study is a macro-sociological assessment of the effectiveness of a criminal legislation through the analysis of the motives that have triggered lawmakers to enact the current legal framework and the practical effects of the 'law in action'17 and of the 'law inaction'.18 Thanks to the use of sociological conceptual tools, as the ones of function, symbolic effectiveness, power, labelling, and legal culture, the research critically approaches the legal framework. In addition, the sociolegal perspective allows us to take into account the multidisciplinary nature of the phenomenon of money laundering and of its countermeasures and the diverse conflicting interests at play. The work has been conducted by a single person and not by a team of researchers; this has imposed a limit on the interviewing sample and the impossibility of undertaking, along with the qualitative analysis of the provision, a qualitative analysis of the jurisprudence and a quantitative analysis of the case law. In addition, criminal provisions have a deterrent purpose, yet in certain cases it is almost impossible to quantify the deterrence effect of those provisions, as in the case of the money laundering offence, and this represents a shortcoming of the current research. Official numbers are highly problematic, this element, despite impeding an objective quantification of the phenomenon, can represent a partial result for the qualitative analysis, because it highlights the complexity of the matter. The anti-money laundering regime is constantly evolving, and this would require continuously updating the assessment, instead the research provides a picture of the current situation. Yet the work offers the reader an instrument to critically interpret also possible changes in the wording of the money laundering offence that may be made following the publication of this work. The outcomes of the critical study on the reasons and effects of the current legislation can be used as a starting point for further research; the methodology set for the empirical analysis can be applied to assess the effectiveness of following developments. The structure of the thesis is the following: The first chapter presents the theoretical sociolegal framework and provides an operational definition of the concept of effectiveness that directs the empirical research. At the end the chapter describes the methodology of the qualitative research. Chapter two traces the genesis of the money laundering offence, as well on an internal, European and domestic level. The chapter analyses legislative intents, parliamentarian debates and other external contributions as declarations of intents and opinions through a desktop-study. The third chapter is dedicated to the doctrinal debate about the money laundering offence regulated in the German penal code. In particular the chapter highlights the controversial issues that have emerged through the abundant legal scholarship production, which might affect the effectiveness of the money laundering offence. Chapters four and chapter five present the empirical research. The fourth chapter analyses the quantitative data of the implementation of the money laundering offence from a qualitative perspective. The last chapter presents the results of the interviews. The main outcomes of the research are that the interests expressed more or less manifestly from the actors taking part in the initial phase of the creation of the anti-money laundering regime were strongly conflicting with each other. One representative example is the question whether to use the policy also to tackle large scale tax evasion or to leave proceeds deriving from fiscal crimes outside of the regime. Very different justifications were given for the criminalisation of money laundering at different stages. Often the declared motives did not correspond to the real goals of the actors taking part in the law-making process. The rhetoric connected to the seriousness of the drug issue was the manifest function of the new criminalisation of money laundering. However, other latent goals, for instance, the desire of financial institutions to clean their reputation and gain customs confidentiality or the interest of some governments to curb tax evasion were already present during this initial phase. Another controversial issue concerns the fact national states have adopted anti-money laundering measures under the pressure of the FATF, which is led by most industrialised countries.19 Despite lacking democratic legitimation, the FATF has imposed worldwide a brand new regime of criminalisation, prevention and enforcement. The legal framework has been used to address ever-new challenges, and this expansion process has been coupled by a rhetoric that scholars have defined the securitisation rhetoric.20 The most recent function manifestly attributed to the anti-money laundering legal framework, that is, in short, the protection of the soundness of the financial system. Especially in times of financial insecurity, the tendency of hardening laws against economic crimes increases. Having previously deregulated the financial system to enhance economic liberties, legislatures resort to criminal law to control illegality in the economy. As a response to the European financial crisis of 2007-2011, legislatures, instead of rethinking the approach towards the protection of the global finance, called for a tightening of economic crimes regulations. The European discourse on money laundering has mostly been related to the destabilisation of the market, the abuse of capitals' movement liberty, the disintegration of the internal economy. But, why was the EU so keen on imposing a common standard for the criminalisation of money laundering, without even enjoying competence in penal matters? The introduction of a common anti-money laundering control policy served to a latent function, namely to the purposes of the creation of the 'Single Market', by way of avoiding that Member States would have adopted measures inconsistent with the completion of the Internal Market, while taking action to protect their own national economies from money laundering.21 This was done by avoiding that domestic regulations implemented for protecting national economies from the infiltration of ill-gotten capital could have hampered the freedom of movement of capital within the European borders. The tension emerges, also in the wording of the most recent EU money laundering Directives, due to lack of Community action against money laundering could lead Member States, for the purpose of protecting their financial systems, to adopt measures which could be inconsistent with completion of the single market.22 There are thus conflicting interests between the claim for regulation to avoid the infiltration of illicit capital, and the demand for deregulation to foster the free market. The European legislature, however, did not declare completely this intention and justified, instead, the imposition of anti-money laundering rules given the threats posed by money laundering to the financial system and thus to society. According to this critical approach, the criminalisation of money laundering turns out to be more of a political tool aimed at achieving governance within the EU, while being presented to the public as an essential intervention to guarantee security and well-being. Once again, thus, the declared goals of the lawmakers did not correspond with the real intentions. It is especially in the interest of a research on the law's effectiveness to unveil functions that were undeclared, in order to evaluate the outcomes in a more critical way. Also from the analysis of the national law-making process emerged divergent opinions and expectations relating to the criminalisation of money laundering. The Parliamentarians debate that took place with regard to the introduction of the money laundering offence and other instruments to tackle drug-trafficking shows that the discussion was deeply embedded in the political-historical context. Given that Germany was just reunified after a period of two dictatorial regimes, the hearing gives the impression that lawmakers felt the responsibility of creating a new legal system against such historical background. In order to balance the very different legal cultures, the divergent approaches had to be compromised. The introduction of a new crime was particularly delicate due to the discriminatory and arbitrary use of criminal labels by the previous dictatorial regimes. Therefore, delegates would not easily give up on fundamental rights for the cause of persecuting criminals. The legislation can be seen as an attempt to balance the need to adopt more effective measures to tackle crime and the necessity of respecting the rule of law and creating a 'militant democracy'. Yet, given the external pressure of the FATF, the EU and of the media, the text was less of a compromise and rather a ratification of 'internationally' accepted standards. The rule of law was not the only issue emerged in the initial phase of the political debate. Controversial opinions were raised also with regard to the questions of the mens rea and the interest protected by the new criminal provision: Certain political parties supported the broadest criminal liability to ensure an effective prosecution of money laundering, other parties were worried that a widespread liability would have been cumbersome for the economic system. Moreover, along with the expansion of the international criminal legal framework to fight against money laundering, also the scope of Article 261 Gcc was extended to include ever-new predicate offences. From the analysis of the doctrinal debate, it emerged that legal scholars have revealed technical hindrances that hinder the provision's legitimacy and thus hamper a positive integration of the act in the criminal legal system. In addition, given that most controversial issues are caused by the wording of the offence, the chapter seems to uphold the idea of an intentional potential decriminalisation of money launderers. The wording of Article 261 Gcc has the potential of frustrating some of the intentions expressed by the legislature in occasion of the adoption of the provision. While the vague formulation of the money laundering offence was thought to tackle ever-new emergencies and has been justified by legislatures as necessary to ensure a more effective fight against money laundering, it has also raised issues that, far from being purely dogmatic, have undermined the acceptance of such law. If law makers have designed the offence in a broad way to allow the criminalisation of conducts that could not have been prosecuted by the existing offences before, the large discretion left to prosecutors, has resulted in a cumbersome element for the prosecution of money laundering. In addition, criminalising the reckless conduct without envisaging a specific criminal liability for security positions has widened the scope of the offence to the point that the law has missed its function of isolating criminals by criminalising gate-keepers' activities. In addition it emerged that there are some open questions with regard to the wording of the offence, for example the question of the interests protected by Article 261 Gcc. On one side a state intervention is considered necessary to contain the impact of economic misbehaviours to protect citizens, on the other side it is important to limit the resort to criminal law only for safeguarding individual or collective situations and not for defending an existing economic structure. The economic system may, in fact, not be considered as a collective interest that needs protection. Also, safeguards provided by penal law need to be substantial and not symbolic, because they urge to change a given situation of inequality, where criminals can profit from illegal practices while legitimate economic actors undergo unfair competition. From the doctrinal analysis it has instead emerged that the legislator seemed to be more interested in drafting a symbolic legislation that can be hardly integrated in the legal system and that raise strong challenges. Lawmakers have been focusing on expanding the reach of anti-money laundering in order to improve its effectiveness, yet without providing legitimacy for such expansion. One of the most meaningful fact observed in the qualitative analysis of statistical data is that organised crime and 'gross money laundering' are not persecuted through Article 261 Gcc. This fact can be inferred by the low number of convictions pursuant to Article 261 (4),23 by the low number of money laundering proceedings categorised as organised crime and by the low number of investigations in the field of money laundering, tax crimes and economic crimes recorded by public prosecutors offices in 2013, where more than one person was involved (18 %). Yet, this does not mean that the criminal justice system does not act against them, but rather that it uses other tools to achieve the goal. While the low conviction rate for serious money laundering cases could be also a symptom of a high degree of deterrence of the provision, it seems that law enforcement uses the money laundering charge as a fallback for authorities who are unable to acquire sufficient evidence in a preliminary phase for the predicate crime and necessitate further information otherwise not accessible. The charge of money laundering allows investigators to access the vast amount of information recorded pursuant to the GwG, which would not be otherwise accessible. Yet, after the investigative phase, prosecutors seem to prefer to modify the charge and opt for indictment for predicate offences instead. The law seems to be effective to the extent that it facilitates the initial investigations, while it does not serve directly the function of punishing money launderers. Besides having a substantial nature, the provisions seem to have a procedural function. It can be inferred that prosecutors find particularly difficult to bring evidence against organised money launderers also due to the fact that professional offenders do not leave traces. From the scarce use of Article 261 Gcc for tackling organised criminality, it can be inferred that the measure is not serving for one of the purposes declared by the legislature when introducing the offence. In addition, it can be hypothesised that other measures may be more suitable to tackle 'gross money laundering'. Given the high number of STRs filed and the low number of money laundering charges and of convictions deriving from the STRs since the introduction of the laws, it can be assumed that the system has been anyway maintained because it still provides some sort of benefits. It can be hypothesised that one benefit is the number of information provided to law enforcement agencies. This amount of recorded information is helpful not only to support further indictments, but also to increase the personnel awareness about the ever-changing money laundering techniques and schemes. Again the effect of the 'law in action' differs in respect to the declared legislative intentions, which justified the criminalisation of money laundering with the necessity of tackling organised crime's economic power. By spelling out this function, the assessment on the effectiveness of the law - as the possibility of collecting information - can be positive. Yet, this effect could be considered a social cost rather than a benefit. On a theoretical side, many scholars see the recording of personal information by private actors as an infringement of the right to privacy.24 On a more practical side such mechanism imposes significant costs on the designated businesses and professions that are in charge of collecting the data.25 When compared to the effective outcomes of the preventive regulations, in terms of law enforcement results, this aspect does not seem to win a cost-benefit analysis, as showed in the quoted researches. If one considers the advantages in terms of information collected, the policy may be considered worth the burden imposed, instead. However, the fact that the laws would have an effective impact on the long run on the fight against money laundering and organised crime may be seen as a diminished deterrence effect, because perpetrators would have the time to adapt to the new laws and find new ways of circumventing them. A collateral effect of the long-run effectiveness of the policy hypothesised on the basis of the outcomes of the research on the implementation is the fact that perpetrators could take advantage of the initiated but not completed cases, by acquiring knowledge about law enforcement strategies and thus develop subterfuges to elude them. On the contrary, it seems that the legislature is always running after to cope with the offenders' ever-new strategies. In fact, regulations about a new sector are updated when there is evidence that there is a risk of money laundering in that specific sector. Yet, offenders might have already moved their laundering activities to another sector. On the assumption that the inclusion of the reckless conduct would have potentially criminalised daily activities, a focus was posed on the number of convictions related to Article 261 (5) Gcc26 to verify the target of the criminal provision. Since 2005 a high number of convictions have been actually referring to reckless money laundering. This shows that the offence is used to punish primarily 'petty money laundering'. This fact can also be inferred from the relevant number of money laundering cases to the detriment of senior citizens, signalled by the FIU in the recent years. Also the fact that a significant number of STRs is filed in relation to the 'financial agents' phenomenon' is a symptom that the preventive mechanism targets more 'small fishes' rather than big perpetrators. Individuals convicted for the reckless conduct may be even victims of a fraud perpetrated by criminal networks. However, the criminal network acting behind the offender remains undetected. If on the one side it cannot be claimed that such offenders, given the lower degree of culpability should not be punished at all, on the other side this effect of the law involves a change of paradigm. The money laundering offence was initially introduced with the goal of tackling serious crimes. The observed effect, however, changes the function and the nature of the law, so that Article 261 Gcc could be considered rather a 'blue collar crime' more than a 'white collar crime'. From the analysis on the quality of STRs filed to the FIU, it can be inferred that certain designated professions and businesses are very reluctant in filing STRs, despite their notably exposure to money laundering risks. The list of designated professions and businesses has been amplified over the years exactly with the goal of facing this transfer of crime from one area to the other. Yet some professionals, such as legal advisors, do not report them, although they possess the capacity of recognising illicit transactions. The fact that some sectors do not actively participate in the effort of preventing money laundering, by allowing criminal proceedings to enter the legitimate economy, may lead to a general ineffectiveness of the system, because it can significantly hinder the capacity of the whole anti-money laundering system to respond to the ability of offenders to move their field of activity there where the law is lax. The provision does generate some instrumental effects by punishing offenders and by triggering a cooperation directed at signalling suspicious transactions between the obliged entities and law enforcement. However, some of the effects do not seem to completely fulfil the legislature's declared goals. For example the chapter seems to prove wrong the legislature's expectation of tackling the grey area by punishing gate-keepers or the attributed function of eliminating organised and serious crime. Given the high costs of implementation highlighted by the cost-benefits analyses, the rather low outcomes seem to be insufficient to fulfil the legislature's goals. Since it is sufficient that without latent functions it would be impossible to explain the adoption and maintenance of a legal act,27 it can be concluded that the intents declared by lawmakers do not satisfy the reasons why the provision was introduced. This opens up the hypothesis that Article 261 Gcc is an example of a symbolic legislation, which has been enacted with the purpose of compromising a complex parliamentarian debate. The analysis of the law-making process has revealed the existence of different expectations attributed to the introduction of Article 261 Gcc. Expectations that were conflicting with each other had to be negotiated and were compromised through the formulation of a vague offence that allowed different interpretations. Yet, the implementation of the law has led to the re-emersion of some of the conflicting situations. In addition, given that the policy regulates a complex and multifaceted issue new conflicts have emerged through its enforcement. The effects triggered by the norm can be indeed perceived positively or negatively by the different actors involved. In particular five principal conflicting situations have surfaced from the interviews. The first issue is the role played by external actors in the law-making process and the constant influence exercised by those actors in the process of updating the policy. The imposition of a US American approach to money laundering control through the role of the FATF has also been highlighted in the second chapter. Specifically, some scholars see the development of a global prohibition regime fostered by the US in the diffusion of anti-money laundering law. According to this literature, the powerful state creates an international regime focussed on achieving its own goals through global acceptance triggered by the securitisation rhetoric and compliance processes imposed through the menace of exclusion by international business relations. The second conflict that emanates from the words of the respondents is the one of the demand for criminal law to face financial misbehaviours and the necessity of limiting the tendency of expanding criminal law on the background of a situation of financial instability. Given the previous deregulation of the market, policy makers need to control and sanction economic abuse in order to protect fair competition and law-abiding individuals. On the other hand, the state needs to respect fundamental principles, such as the rule of law and the principle of ultima ratio that imposes a restriction of the use of criminal law in situations in which no other measures are suitable. This conflict has already been raised along the formulation of the money laundering offence with regards to the question of the interests protected by the law. Despite the legislator tying to limit the scope of the offence by attributing to Article 261 Gcc the protection of the administration of justice and of the interests protected by the predicate offences, this explanation was not considered suitable to the peculiarity of the offence. Indeed, shortly after the enactment, legal scholarship and the judiciary entered in a vivid debate in order to identify more suitable interests protected by the law, among them the financial and economic system under different perspectives. However, as chapter three shows, no solution could be found. In fact, the question concerning the suitability of criminal law to tackle illicit financial flows is perceived in the current research as still unsolved. The matter does not only concern money laundering control. On the contrary, it is a fairly widespread issue that has recently emerged due to the tendency of hardening economic crimes on the background of a situation of financial instability. The third conflict can be summarised as the following: on the one hand the policy being required to interfere with the personal sphere of suspected money launderers; on the other hand private institutions being interested in protecting their relations with loyal and trusted customers. Therefore, they are reluctant to give law enforcement the possibility to interfere too much in their business. The interest manifested by the private sector involved in the prevention of money laundering seems thus to collide with the legislative intent of preventing the infiltration of dirty money by way of preventing gate-keepers to help money launderers. The clash emerges at a micro-economic level and is triggered by the fact that the anti-money laundering policy demands an active participation by private sector in the detection of suspects. Private actors, are not appropriate to bear the burden of detecting offenders, moreover they need to protect the relationships with customers by avoiding unnecessary interferences. At the same time, the privatisation of crime control is questionable also from a governance point of view. It seems therefore that the public interest in persecuting crimes through having access to personal information from the private sector only marginally collides with the interest of protecting the right to privacy. Businesses and professions are predominantly interested in not interfering with their clients and in not bearing the burden of detecting offenders. The issue was also addressed during the national Parliamentarian debate, with regards to the degree of mens rea required for money laundering criminal liability. Making everybody taking part in economic or financial activities actively participating in the monitoring of the economic system under the threat of criminal liability for negligent money laundering was considered harmful for the business market. The same debate has been picked up by legal scholarship too. Yet, it seems that, despite the law being the result of negotiations, the question is still open. The fourth issue consists of discording opinions with regards to the opportunity of including tax evasion as predicate offence for money laundering. On one hand there is the interest of tackling tax evasion through the anti-money laundering regime, on the hand the concern of keeping the two phenomena distinct in order to avoid an overrating of money laundering. Since the genesis of the anti-money laundering policy, some actors taking part in the international law-making process, opposed the labelling of 'black money', naming money deriving from tax violations, as 'dirty money', indicating all proceeds of crime typically committed by organised crime. This distinction was based on the perception that tax-related offences were less serious and less harmful than capital flight and were advocated by financial centres in order to maintain a good reputation while still granting peculiar financial services, such as bank secrecy. This issue is a good example of the labelling theory, to the extent that it shows how a practice that was firstly not considered criminal enough to amount to a predicate offence for money laundering, has become part of the scope of the anti-money laundering regime on the basis of a political decision of labelling it as such. Respondents of the current research show to have different perceptions of the degree of the seriousness of tax laws violations and thus about the appropriateness and necessity of tackling them under the umbrella of the anti-money laundering policy. Again, the matter, which seemed to have been resolved through the negotiations on an international and European level, is still being debated at national level. The last two contrasting interests are the necessity of regulating the flows of money and the free movements of capitals in a neoliberal economy. The question is intrinsic in the nature of money laundering, which is a phenomenon that happens at the interface between legality and illegality. Regulations that facilitate the licit exchange of goods, capitals and services do also facilitate the flow of ill-gotten gains; there are thus conflicting interests between the public interest of persecuting crime and the claims for less regulation in a free market economy. From the interviews surfaced that not only opinions on the effectiveness of the law differ, but the very concept of effectiveness is perceived differently among the interview partners. Perceptions about how effective the anti- money laundering policy is appear to be similar among respondents belonging to the same experts' group. In particular, given the fact that the policy triggers many preliminary investigations, investigators work on a daily basis with the provision. This led to their opinion on the implementation of the legislation being rather positive. Positive opinions have common ground: they assert that the policy is not a simple one to implement, however, they believe that the legal practice has found its way through. On the contrary, defence attorneys specialised in economic crimes do not receive a significant amount of clients suspected for money laundering. For this reason they tend to have a rather negative opinion on the policy's effectiveness, also driven by the perception that the policy is not able to achieve the indirect goals. The diverse concepts of effectiveness provided by disciplines close to the sociology of law and the different definitions of effectiveness given by sociologists of law turn out to be useful here. Particularly the notions of 'efficiency' and of 'efficiency regardless of the goals' are proved very useful to interpret the respondents' opinions. Efficiency, is according to the administrative legal approach, the optimal relation between the goals achieved and the instruments used. A subcategory of this concept is the efficiency calculated through a cost-benefit analysis, of which some examples have been presented in the fourth chapter, which defines efficiency as the functioning of a legal order without assessing the goals achieved. This type of analysis focuses on the correctness of the operating system since the purpose of the system is its own existence. It refers to a whole legal order rather than to a specific single provision. Given that the anti-money laundering policy constitutes a legal order, due to the diverse regulations involved and the competent authorities created in order to achieve the goals of the policy, this notion can be applied. In the field of administrative legal theories, the first chapter has focussed on the approach that considers the (in)effectiveness of a law depending on its (failing) enforcement. A high degree of compliance of the anti-money laundering legislation might correspond to a high level of effectiveness of the policy with respect to its direct function, but at the same time to a rather low level of effectiveness with regards to its indirect purposes. The way to evaluate the degree of effectiveness is therefore also different. While compliance with legal provisions is calculated through a quantitative assessment of the processes in force and of the functioning of the system, the achievement of the indirect functions is measured on the impact of the policy. Interview partners have different perceptions about the indirect functions of the legislation too. This reflects, once again, the fact that the policy was a result of a compromise between different expectations and that the legislator was not able to limit the scope of its application to a particular goal. The different expectations and intents, which already emerged in the doctrinal debate about the legally protected interests, appears again in the different perceptions of the interviewees. The respondents were asked about the legislation's effectiveness with regards to one of the indirect functions, namely the capacity to deter organised crime. The legislator enacted the money laundering offence in the context of the fight against drug trafficking and other forms of organised crime, thus Article 261 Gcc's expressed rationale is the prevention and repression of organised crime. Finally, a relevant outcome regards the respondents' opinions on article 261 Gcc's latent symbolic function. Some of them agree with this. Others strongly oppose the hypothesis. They argue instead that the policy has instrumental effects on their daily practice, which cannot be defined as purely symbolic. According to most respondents, the law cannot be defined as symbolic, because it has led to instrumental effects. In the first place information gathered thanks to the GwG is used to start preliminary investigations under Article 261 Gcc. Secondly, the structure enacted to comply with the anti-money laundering policy is attainable and is visible and cannot be denied. Thirdly, the law is considered necessary because it labels a deviant behaviour. In particular, despite the fact that investigations do not lead to a conviction for money laundering they allow investigators to collect information in support of criminal cases for the predicate offences or to start a preliminary investigation for a predicate offence. In this sense, the function of the 'law in action', despite being questionable, is objectively instrumental. However, the fact that the law serves the purpose of tackling predicate offences through the support of investigations does not exclude the hypothesis that the law was enacted to pursue latent functions too. According to the sociologist Aubert, it is not necessary that the latent goal is the only one that plays a role, but it is necessary that the other purposes would not explain the analysed phenomenon completely. Indeed, in the opinions of those who exclude the symbolic function, yet the results achieved through compliance do not legitimate the burden imposed by the legislation. In other words, it seems that they recognise that the purpose of compliance cannot completely explain the policy makers' motivation, which re-opens the doors for the hypothesis of the existence of latent functions. In fact, such a demanding policy cannot be accepted for the sole purpose of re-enforcing the action of the criminal justice system in tackling predicate offences. On the other hand, compliance with the policy in terms of building of a structure and of expertise does not automatically mean fulfilling the policy's purpose. Particularly the creation of new professionalism, has been interpreted by scholars as a sign given to the public that the policy has produced certain effects. In conclusion, on the background of the research's outcome, the paper tries to reply to the question: (How) can the effectiveness of the money laundering offence be improved? While technical hindrances can (and perhaps) will be removed through legal reforms, 28 the inherent political economic and financial conflicting interests that impede a higher level of effectiveness are more difficult to solve. In contemporary industrialised economies there is a complicated and sometimes shifting boundary between legitimate and illegitimate transactions. This is particularly exacerbated in the context of financial capitalism, which 'subordinates the capitalist productive process to the circulation of money and monetary assets and hence to the accumulation of money profits'. Since the very beginning, determining the boundary between an area defined as 'criminal' and the space of 'legality' has been controversial. In fact, money has a neutral nature, pecunia non olet, making profit, irrespective of the monies' origin, is a very strong interest for both private and public entities, which collides with the one of eliminating illicit financial flows. In other words criminal policy goals diverge from purely economic interests. While one can assume the justice and correctness of the current financial system, and thus describes money laundering as harmful because it interferes with the existing economic order, one can also assume that the capitalist system leads per se to injustice and inequality, and that money laundering is actually embedded in this profit-oriented system and represents just the darker side of the capitalist economy. A compromised viewpoint is the one that describes money laundering as an accepted collateral effect of the capitalist system, that is to say 'a certain amount of illicit financial flows may be considered an acceptable price to pay for a market where free mobility of capital is guaranteed'. In other words, money laundering is intrinsic in or at least exacerbated by the capitalist system.
