En 2011 se modificó el artículo 83 del Código Contravencional de la Ciudad de Buenos Aires, que afectó las actividades de los vendedores ambulantes instalados en el Microcentro por cuanto se reguló que la venta en la vía pública sería considerada contravención, aun tratándose de venta por mera subsistencia, siempre y cuando ésta constituyese una competencia desleal al comercio establecido. Este estudio pretende dar cuenta del accionar de los actores intervinientes en los procesos que convirtieron dichas actividades en una contravención. Se situará históricamente los sucesos que dieron lugar a esta mutación, indagando en las prácticas de los actores inmersos en los mismos, en la manera que las autoridades se representan los cambios a nivel político, económico y social, y en cómo esas consideraciones intervinieron en la materialización de la actual redacción de la Ley 1.472. La hipótesis que atraviesa este trabajo sostiene que la consolidación de un arte de gobierno neoliberal constituye el punto a partir del cual puede efectuarse semejante modificación, así como el despliegue de tecnologías de gobierno que apuntan al uso restrictivo del espacio público respecto de las poblaciones de "manteros" y "artesanos". From then on, selling products on the street would be considered a misdemeanor, even for cases of sellers who saw themselves compelled to exercise this economical activity alleging mere subsistence. This study seeks to explain the actions of the actors involved in the processes that made these activities a violation. To begin with, we will situate the historical events that lead to this mutation, investigating the practices of actors involved in them, the way the authorities conceived their own representations regarding changes in political, economic and social levels, and how these considerations intervened in the passing of the current transcription of Act N°1472. The hypothesis that crosses this paper argues that the consolidation of a neoliberal art of government is the starting point at which such a change can be produced, as well as the deployment of governmental technologies aimed at restricting use of public space for groups of "manteros" and "artisans". This PhD thesis is the outcome of three-year doctoral study of corporate social responsibility (CSR) and stakeholder engagement in the water sector. This study contributes to new knowledge about water companies formed as hybrid organisations in the aftermath of the new public management (NPM) era worldwide. Today we see different hybrid organisations of water companies around the world that have either been fully privatised or quasi-privatised. Quasiprivatisation in Denmark means that water utilities are still perceived as natural monopolies, which has not made them into for-profit driven companies. Instead a simulated market and state regulation has been introduces with annual, national benchmarking to set a price cap as an upper limit for the consumer-price of water. Similar systems are seen in fully privatised water companies in the United Kingdom, the United States, and partially in South Africa. However, here the water companies are typically owned by private companies and not established as municipalityowned limited liabilities1 as in Denmark and elsewhere in Scandinavia. This PhD thesis proposes new models and principles and corporate social responsibility and stakeholder engagement of these water companies. The findings of the study suggest a new definition of a colonising logic of CSR competing and coexisting with the regulators' colonising logic of NPM. Through the study and definition of these logics as colonising the water sector this PhD theisis provides an understand of new perspectives of how CSR is enacted through stakeholder engagement and how the logic of CSR frames the top managers' claim: "We are CSR!" (Interview B, March 2011) and the consequences of this logic. Both the logic of CSR and the logic of NPM is found to be based on the materials that the water companies are organised around, namely water. Water is perceived as a natural good that should ideally be free and plentiful for all citizens around the world. However, the competition between the two colonising logics stems from another material, namely the money or price that providing clean and pure water for all are allowed to cost the citizens. Through the dialectical interaction of these in terms of material practices between producing water and infrastructure to distribute it and collecting money as a payment for it and the regulation of this, this PhD thesis proposes a new definition of the role of materials and material practices underlying several institutional logics such as the institutional logic of capitalism, state, democracy, family, religion/science, profession, and corporation (Friedland & Alford, 1991; Thornton et al., 2012; Friedland, 2013).

Este estudo avaliou fatores epidemiológicos para infecção pelo HCV associados ao compartilhamento de instrumentos cortantes e perfurantes em candidatos à doação de sangue (CDS) na cidade de Belém, Pará, Amazônia Brasileira. Duas definições de infecção pelo HCV foram utilizadas: positividade por anti-HCV detectada por EIA, e HCV-RNA detectado por PCR. CDS infectados e não-infectados preencheram questionário sobre possíveis fatores de risco associados com o compartilhamento de instrumentos cortantes e perfurantes. As informações foram avaliadas usando regressão logística simples e múltipla. Entre maio e novembro de 2010, 146 (1,1%) indivíduos com anticorpos anti-HCV e 106 (0,8%) com HCV-RNA foram detectadas entre 13.772 CDS em Belém. Os fatores de risco associados à infecção pelo HCV baseado em resultados de EIA (modelo 1) e PCR (modelo 2) foram: uso de agulhas e seringas esterilizadas em casa, uso compartilhado de lâminas em casa, compartilhamento de lâminas em barbearias, salões de beleza, etc., e compartilhamento de material de manicure e pedicure. Os modelos de infecção pelo HCV associados com o compartilhamento de instrumentos cortantes e perfurantes devem ser considerados pelas autoridades de saúde local e regional e de países com práticas culturais semelhantes, a fim de fornecer informações uteis para direcionar estratégias e políticas públicas de controle da transmissão do HCV. ; This study evaluated epidemiological factors for HCV infection associated with sharing perforating and cutting instruments among candidates for blood donation (CBD) in the city of Belém, Pará, Brazilian Amazon. Two definitions of HCV infection cases were used: anti-HCV positivity shown by EIA, and HCV-RNA detection by PCR. Infected and uninfected CBD completed a questionnaire about possible risk factors associated with sharing perforating and cutting instruments. The information was evaluated using simple and multiple logistic regressions. Between May and November 2010, 146 (1.1%) persons with anti-HCV antibodies and 106 (0.8%) with HCV-RNA were detected among 13,772 CBD in Belém. Risk factors associated with HCV infection based on the EIA (model 1) and PCR (model 2) results were: use of needles and syringes sterilized at home; shared use of razors at home, sharing of disposable razors in barbershops, beauty salons etc.; and sharing manicure and pedicure material. The models of HCV infection associated with sharing perforating and cutting instruments should be taken into account by local and regional health authorities and by those of other countries with similar cultural practices, in order to provide useful information to guide political and public strategies to control HCV transmission.

This thesis focuses on the construction of the poor consumer figure in France. Specifically, we are interested in the mechanisms underlying the sense of belonging to the consumption society in the case of working poor people. Inspired by Michel Foucault's works, we are looking at the decisive historical role of consumption and market actors in the shaping of specific forms of governmentality. To this end, we have conducted a historical research in order to understand the transformations of the representations of poor people in France since the 1950s. In parallel, we have completed long interviews and collages with 16 working poor people in France, in order to understand their interpretation of this belonging. Our interpretive analysis reveals that working poor's consumption discourses are produced around the notion of responsibilization. Responsibilization appears as a Foucaldian dispositif which is influencing three senses of belonging of these people to the consumption society: a legitimate one, a competent one and a moderate one. We conclude this research with a discussion on the implications of responsibilization in the working poor's process of construction of social link. It reveals implications for the companies and public organizations which are more and more willing to "target" poor consumers. ; Cette thèse porte sur la construction de la figure du consommateur pauvre en France. Plus spécifiquement, nous nous intéressons aux mécanismes qui sous-tendent le sentiment d'appartenance à la société de consommation pour les travailleurs pauvres. En nous inspirant des travaux de Michel Foucault, nous mettons à jour la manière dont la consommation et les acteurs du marché ont un rôle historiquement décisif dans la construction de formes de gouvernementalité. A cet effet, nous avons conduit une recherche historique afin de comprendre les transformations des représentations sur les pauvres en France depuis les années 1950. Parallèlement, nous avons réalisé des entretiens longs et des collages auprès de 16 travailleurs pauvres en France, afin de comprendre leur interprétation de cette appartenance. Notre analyse interprétative révèle que les discours de consommation des travailleurs pauvres sont structurés autour de la notion de responsabilisation. La responsabilisation agit comme un dispositif au sens foucaldien, qui influence trois types d'appartenance de ces individus à la société de consommation : une appartenance légitime, une appartenance compétente et une appartenance modérée. Nous concluons cette recherche par une discussion sur les implications de la responsabilisation sur le processus de construction de lien social des ravailleurs pauvres. Nous mettons en valeur les implications de cette analyse pour les entreprises et certains organismes publics qui sont aujourd'hui de plus en plus enclins à « cibler » les consommateurs pauvres.

Despite the concept of development came from the Classic and Neo-classic economics. (BARQUERO, 1997), at the beginning it was a rason to establish the economic reforms introduced by the United Nations when the Second World War finished. Nowadays, almost 70 years after the scientific, psychological and political studies of development began, development it is not considered just as an economic issue, otherwise it reflects the global concerns about future of people One of the math components when we refers to land occupancy is development, because from it use and occupancy forms depend most of the growth tendencies of surrounding communities, and taking into account our current economic model, it clearly links this expansion with Capitalism. Since 1993, Quito became a Metropolitan District incorporating 33 rural parishes to its jurisdiction and therefore their public policies and land development. Since 1945 and many years afterwards, it was based on the "Jones Odriozola Plan" (FAO, 1998), this research was proposed in order to address the issue of the use and occupancy of rural land in the parish of Tumbaco. ; A pesar de que el concepto de desarrollo tiene sus raíces en la economía clásica o neo-clásica (Barquero, 1997) y que en su inicio fue razón de las políticas económicas planteadas desde las Naciones Unidas después de la Segunda Guerra Mundial, hoy en día después de casi 70 de años de exploraciones científicas, sociológicas y políticas el desarrollo ya no es un tema únicamente económico sino que se ha convertido en el eje transversal de las preocupaciones mundiales sobre el porvenir de los pueblos. Uno de los componentes matemáticos del desarrollo es el suelo, puesto que de su uso y ocupación se configuran gran parte de los destinos y tendencias de las comunidades que en ellos habitan y que dentro del sistema capitalista actual necesariamente se vinculan con el tema del crecimiento. Dado que desde 1993 Quito se convirtió en Distrito Metropolitano incorporando a 33 parroquias rurales a su jurisdicción y por lo tanto a sus políticas públicas de desarrollo y de ordenamiento territorial, que por varios años han sido desarrolladas a partir de conceptos urbanos desde la publicación en 1945 del "Plan Jones Odriozola" (FAO, 1998)1; se planteó esta investigación con el fin de abordar la problemática de uso y ocupación del suelo rural de la parroquia de Tumbaco frente a estas políticas y al desarrollo.

Los sistemas de potencia son conjuntos de redes e instalaciones que ofrecen un servicio público de suministro de energía eléctrica esencial para la sociedad y su economía. Una falla en estos sistemas tiene repercusiones de índole económica, ambiental, política o social. Luego de los atentados terroristas del 11 de Septiembre en los Estados Unidos, ha aumentado la importancia de determinar la vulnerabilidad de los sistemas eléctricos de potencia mediante la implementación de metodologías para su análisis. En este trabajo se propone una nueva metodología de análisis de vulnerabilidad de sistemas de potencia. La metodología toma en cuenta aspectos del Proyecto VEGA de Salmeron, Wood y Baldick, y de la Tesis de Evaluación del Riesgo de Tranchita. Se utiliza la Lógica Difusa tipo 2 para modelar la incertidumbre tanto en variables lingüísticas como en variables numéricas. Las variables lingüísticas modelan los factores del entorno geográfico mientras que las variables numéricas modelan los parámetros del sistema de potencia. La metodología implementa un modelo de optimización binivel entera-mixta. En el nivel inferior se minimizan los costos asociados a la generación de energía y a la penalidad por deslastre de carga (objetivo del operador del sistema), mientras que en el nivel superior se maximiza el daño en el sistema de potencia representado por el deslastre de carga (objetivo del atacante). ; Abstract. A Power System is a set of networks and assets offering a service of public nature essential for society and its economy. A single fault in a component of the electrical system may have negative economic, environmental, political or social effect on society. After September 11th terrorist attacks in the United States has increased the importance of assessing the Vulnerability of Power Systems to intentional attacks. In this thesis a new methodology for assessing Power System Vulnerability to intentional attacks is proposed. This new methodology takes into account aspects from Salmeron, Wood and Baldick VEGA Project and from Tranchita Risk Assessment Thesis. Type-2 Fuzzy Logic Systems are used to model the uncertainty of linguistic and numerical variables. Linguistic variables model geographical variables of the power system area. Numerical variables model power system parameters. The new methodology implements a mixed-integer optimization model. In the lower level generation costos plus load sheading penalties are minimized in the electrical network (system operator's objective). In the upper level load shedding resulting from the attack is maximized in the system (attacker's objective). ; Maestría

Los términos verdad y veracidad, verdadero y veraz, son, más allá de sus indudables similitudes, radicalmente diversos. En el ámbito de la información, tanto en su dimensión jurídica cuanto en su dimensión ética, "verdad" y "verdadero" han sido desplazados por "veracidad" y "veraz" como elementos nucleares del derecho a la información. ¿Es este desplazamiento una mutación casual, irrelevante, intrascendente? Lo que pretende este artículo es probar que en modo alguno se trata de una cuestión menor, accidental o incidental. Muy por el contrario, obedece a razones de singular calado, que se trataran de analizar. Para ello, me aproximaré a los conceptos de "verdad" y "veracidad" examinando con la necesaria brevedad su evolución. Una vez hecha esa aproximación, trasladaré ambos conceptos al ámbito de la información, en su dimensión teórica primero y en su aplicación práctica después, centrándome para ello en la jurisprudencia del Tribunal Constitucional español y en cómo ha construido y dotado de contenido el concepto de veracidad informativa, examinando sus efectos más notorios. Abstract: The terms "truth" and "truthfulness – veracity", "truthful" and "verified", are, beyond their doubtless similarities, radically different. In the sphere of information, both in its legal and its ethical dimensions, "truth" and "truthful" have been replaced by the terms "truthfulness" and "verified" as central elements of the right to be informed. Is this replacement coincidental, irrelevant or insignificant? The aim of this article is to demonstrate that by no means this is a minor, incidental or a trivial issue. On the contrary, said mutation responds to very specific reasons which will be examined in the following pages. In order to do so, I will analyze the concepts "truth" and "truthfulness" by briefly tracing back their origins and evolution. Once this is done, I will apply both terms to the sphere of information, firstly in its theoretical dimension, and secondly in its practical implementation, by focusing on the jurisprudence created by the Spanish Constitutional Court and how it has built and given content to the concept of "informative truthfulness". Finally, this paper will analyze the impact of this phenomenon in different areas. El presente artículo tiene por objeto analizar la experiencia de los territorios declarados libres de transgénicos en Costa Rica, como respuesta al conflicto socioambiental desencadenado por la aprobación estatal para la introducción y siembra de cuatro especies de maíz transgénico en el país. Este aval se dio pese a la abierta oposición de autoridades locales, grupos de base comunitaria, organizaciones ecologistas y ambientalistas y universidades públicas. Particularmente, el gobierno local de Abangares fue uno de los primeros en pronunciarse en contra de la autorización de la CTNBio, iniciándose así, junto con otras autoridades locales, la campana nacional "Territorios Libres de Transgénicos", donde los municipios, en el ejercicio pleno de su autonomía han tomado una decisión histórica, a partir de la cooperación entre los involucrados y la generación de consenso comunitario, que permitió puntualizar la preocupación de los movimientos sociales, las personas vinculadas a los municipios y las autoridades locales, sobre el impacto de los modelos extractivos que dependen de sustancias que potencialmente ponen en peligro la salud de las personas y los animales, así como el equilibro de los ecosistemas, de ahí la necesidad de hacer prevalecer el Principio Precautorio, en aras de garantizar el derecho a la salud y el acceso a un ambiente sano y ecológicamente equilibrado por encima de los intereses económicos empresariales.AbstractThis article aims to analyze the experience ofthe territories that have declared themselvesGMOs-free in Costa Rica, in response to thesocio-environmental conflict provoked by thestate approval for the introduction and plantingof four species of transgenic corn in the country.This approval came despite the opposition fromvarious sectors, such as local authorities, community-based groups, environmental organizationsand public universities.Particularly, the Abangares local governmentwas one of the first to speak out against the authorizationof CTNBio, beginning with other localauthorities the national campaign "GMOs FreeTerritories", in which the municipalities, in theexercise of their autonomy have taken a historicdecision, based on cooperation among the peopleinvolved and the building of community consensus,which allowed point out the concern of socialmovements, people linked to the municipalitiesand local authorities on the impact of extractivemodels dependent on substances potentiallyharmful to the health of people and animals, aswell to the balance of ecosystems, hence the needto make prevail the Precautionary Principle, inorder to guarantee the right to health and theaccess to a healthy and ecologically balancedenvironment above corporate economic interests.Keywordstransgenic organisms, municipality,municipal autonomy, community consensus,social movements.

This dissertation proposes a fundamental reassessment of guilt in twentieth-century American literature. I claim that guilt ought to be understood not so much in relation to the Holocaust or the history of U.S. race relations as in relation to the state. In readings of Mary McCarthy, Richard Wright, J. D. Salinger, Arthur Miller, and Saul Bellow, as well as the early Superman comics and fiction and criticism that invoke Fyoder Dostoevsky's work, this project demonstrates how authors of fiction and popular culture mobilize feelings of responsibility and guilt to symbolize anxieties over the diminished role of the state as a vehicle for public relief. As the federal government jettisoned burdens that it had borne since the Depression, the writers in question depict various mechanisms employed by individuals to absorb state burdens and to compensate for the reduced availability of state-backed relief. With renewed emphasis on existential categories such as guilt, freedom, and anxiety, I trace tensions at the core of mid-twentieth-century narratives that situate them squarely within the problematics of antistatism. The figure of the statesman emerges in the late thirties and early forties as the main inheritor of state burdens. Mary McCarthy's The Company She Keeps (1943), Jerry Siegel and Joe Shuster's early Superman comics (1938-1942), and Richard Wright's "The Man Who Lived Underground" (1942) can be read, I suggest in Chapters One and Two, as extended ruminations on how statesmen conceive their function of rendering aid to others as increasingly oppressive in direct correlation with the curtailment of federal relief initiatives. Chapter Three pauses to consider a strain of writing that celebrated antistatist sentiments by invoking (and thereby misreading) Fyodor Dostoevsky as a proponent of the guilty conscience. The first attempt of its kind to chronicle Dostoevsky's influence on an array of prominent American intellectuals, this chapter utilizes my knowledge of Russian to expose a dimension of Dostoevsky's work that is far less antistatist than his readers have presumed. Chapters Four and Five look at Arthur Miller's Death of a Salesman and Saul Bellow's Seize the Day and conclude that the celebration of antistatism found in the previous chapter did not last for long. In excavating latent discontents from Miller's and Bellow's work, I reveal a critique of antistatism implicit in guilty musings from the fifties that has gone unnoticed due to abiding Cold War biases.

Cet ouvrage analyse la manière dont des stratégies nationales de lutte contre l'effet de serre peuvent se déterminer en fonction des positionnements cognitifs et éthiques des États nationaux au regard de scénarios climatiques mondiaux. Sont ainsi distinguées les approches cognitives de type « prédictif », « thomiste » ou « symétrique », croisées avec des positionnements éthiques désignés comme « égocentrique », « altruiste-dynastique, « solidariste intragénérationnel », « altruiste cosmopolitique » et « universaliste kanto-millien ». Pour évaluer ces configurations on suppose que les choix faits par un État s'appuient sur une évaluation des dommages climatiques associés à différents scénarios de concentration de gaz à effet de serre. Les indicateurs centraux utilisés sont la valeur actuelle du dommage entraîné par l'émission d'une tonne de CO2 et le niveau du taux d'actualisation. Dans ce cadre classique où se met à l'épreuve le concept de dommages pour appréhender des phénomènes de long terme, l'évaluation détermine quelles configurations cognitivo-éthiques justifient la cible du « Facteur 4 » en 2050 : il en existe un nombre réduit, relevant soit d'un « altruisme cosmopolitique (international et intergénérationnel) », soit d'un « universalisme kanto-millien », si cette cible est choisie en fonction du seul problème climatique. En postulant qu'une valeur de 100 € / tCO2 en 2030 est un point de passage obligé vers le « Facteur 4 »en 2050, de tels choix éthiques impliquent la reconnaissance d'une valeur actuelle 2010 d'un niveau élevé pour le dommage entraîné par l'émission d'une tonne de CO2e (au moins 53 € / tCO2, soit un ordre de grandeur supérieur au prix 2013 du carbone sur le marché ETS) et l'adoption d'un taux d'actualisation caractéristique qui, dépendant des configurations étudiées, ne saurait être plus élevé que 3,25 %. De telles valeurs doivent être considérées comme des conditions logiques à respecter pour tous les choix dérivés et en particulier lorsqu'il s'agit de déterminer la meilleure trajectoire intertemporelle de réduction des émissions. Autre résultat : en prenant en compte l'incidence de la date d'émission sur le dommage climatique, il s'avère qu'« altruisme cosmopolitique » et « universalisme kanto-millien » conduisent à des recommandations strictement opposées quant au profil de la meilleure trajectoire temporelle de « consommation » d'un budget d'émissions fixé pour la période 2011-2050 : le premier demande de concentrer les émissions en début de période et le second de débuter par un « choc de réduction ». Au total aucune des configurations justifiant la cible du « Facteur 4 » ne s'accorde avec l'application simple d'une règle de Hotelling qui ferait progresser la valeur de la tonne de CO2 au taux d'actualisation standard pour l'investissement public.

Effective today, the system of local self-governance is needed to be reformed. Local government is one of the most important institutions of modern society. Today it is both a form of self-organization, and – as well as - an integral part of civil society, the level of public authorities (instrument of democratic participation of citizens in the management of common affairs) and the element of market economic system (filling in the gaps of the market in the provision of services to the residents and the coordination of economic activity). At the present stage of development of all branches of government arises a question of the necessity of the modern state theory and practice improvement, induced transformations in the political system. There is a need to establish an efficient system of local government and self-government can take control of the social, economic and industrial activities in the region to improve the level and quality of life of the population of the Republic of Belarus. ; Действующая сегодня система органов местного управления и самоуправления нуждается в реформировании. Местное самоуправление представляет собой один из важнейших институтов современного общества. Сегодня оно является одновременно формой самоорганизации граждан и – в этом качестве – составной частью гражданского общества, уровнем публичной власти (инструментом демократического участия граждан в управлении общими делами) и элементом рыночной экономической системы (восполняя пробелы рынка в части оказания услуг жителям и координации хозяйственной деятельности). На современном этапе развития всех ветвей власти возникает вопрос необходимости совершенствования теории и практики современного государства, вызванного трансформациями в политической системе общества. Назрела необходимость в создании эффективной системы органов местного управления и самоуправления, способных взять под свой контроль социальную, экономическую и производственную деятельность региона с целью повышения уровня и качества жизни населения Республики Беларусь. ; Діюча сьогодні система органів місцевого врядування та самоврядування потребує реформування. Місцеве самоврядування являє собою один з найважливіших інститутів сучасного суспільства. Сьогодні воно є одночасно формою самоорганізації громадян і - в цій якості - складовою частиною громадянського суспільства, рівнем публічної влади (інструментом демократичної участі громадян в управлінні загальними справами) і елементом ринкової економічної системи (заповнюючи прогалини ринку в частині надання послуг мешканцям та координації господарської діяльності). На сучасному етапі розвитку всіх гілок влади постає питання необхідності вдосконалення теорії та практики сучасного державотворення, викликаного трансформаціями в політичній системі суспільства. Назріла необхідність у створенні ефективної системи органів місцевого врядування та самоврядування, здатних взяти під свій контроль соціальну, економічну і виробничу діяльність регіону з метою підвищення рівня та якості життя населення Республіки Білорусь.

The structure, status and characteristics of intellectual capital in Ukraine are investigated in this article. The main factors that hinder the development and using in the economy of intellectual capitalare determined. The low level of funding of scientific, technological and innovation activities in the country, the low level of state involvement in these processes, and lack of activity of enterprises and organizations, small effectiveness and policy inconsistency and lack of motivation mechanism of efficient using of domestic intellectual potential are proved. The necessity of involvement in the development of the intellectual capital of the entire community of the country, including the consolidation efforts and cooperation of educational, scientific and industrial areas, public and government authorities are justified. The organization of a systematic evaluation of intellectual capital regions of Ukraine using its current level of monitoring is proposed, it may allow more balanced and reasonable planning and implementing science, technology and innovation activity in the country. ; В статье исследована структура, состояние и особенности развития интеллектуального капитала в Украине. Определены основные факторы, сдерживающие формирование и использование в отечественной экономике интеллектуального капитала. Доказано низкий уровень финансирования научной, научно-технической и инновационной деятельности в стране, минимальное участие государства в этих процессах, а также недостаточную активность предприятий и организаций, незначительную результативность, непоследовательность политики государства и отсутствие механизма мотивации эффективного использования отечественного интеллектуального потенциала. Обоснована необходимость привлечения к процессу развития интеллектуального капитала всего сообщества страны, в частности консолидацию усилий и сотрудничество образовательной, научной и производственной сферы, общественности и государственных органов власти. Предложено организовать систематическую оценку интеллектуального капитала регионов Украины с использованием мониторинга его текущего уровня, что позволит более взвешенно и обоснованно планировать и реализовывать научную, научно-техническую и инновационную деятельность в государстве. ; У статті досліджено структуру, стан та особливості розвитку інтелектуального капіталу в Україні. Визначено основні чинники, що стримують формування та використання у вітчизняній економіці інтелектуального капіталу. Доведено низький рівень фінансування наукової, науково-технічної та інноваційної діяльності в країні, мінімальну участь держави в цих процесах, а також недостатню активність підприємств і організацій, незначну результативність та непослідовність політики держави і відсутність механізму мотивації ефективного використання вітчизняного інтелектуального потенціалу. Обгрунтовано необхідність залучення до процесу розвитку інтелектуального капіталу всієї спільноти країни, зокрема консолідацію зусиль та співпрацю освітньої, наукової та виробничої сфери, громадськості та державних органів влади. Запропоновано організувати систематичну оцінку інтелектуального капіталу регіонів України з використанням моніторингу його поточного рівня, що дозволить більш виважено і обґрунтовано планувати і реалізовувати наукову, науково-технічну та інноваційну діяльність в державі.

«Representation» is a complex scientific concept which includes legal, political, economic and historical aspects. For a comprehensive review of this phenomenon in the work were used monographic studies, work materials of representative organizations of the bourgeoisie, periodic and journalistic literature of late XIX – early XX centuries, and also were studied approaches to the definition of this concept in political science, economics, civil and business law. Given the interdisciplinarity of this phenomenon, in article is analyzed the history of formation of representative organizations of the bourgeoisie in post-reform period, are selected the basic factors, which have influence on this process. Formation of representative structures of the economic elite is considered as a two-way process: on the one hand - the government's interest in obtaining of the expert evaluation of the business community about state of development of branches of economics and possible ways to improve the efficiency of the economy; on the other hand – the initiative themselves of Industrialists and entrepreneurs in the creation of effective mechanisms to influence government decisions. During the analysis of the historical conjuncture in article are characterized bodies of representative of an official nature (committees of trade and manufactures, Exchange Committees), is showed their difference from private bodies of representation (congresses, advisory firms, societies, etc.). Particular attention is paid to the attitude of contemporaries (representatives of the government, general public, the entrepreneurs) to the representative corporations, is presented their assessment of the role and the significance of the entrepreneurial alliances in industrial development of the second half of the XIX – the beginning of XX centuries. Also are considered value judgments of historians of different historical periods (pre-revolutionary, Soviet, contemporary) relatively of the degree of influence as representative organizations, as the bourgeoisie itself in condition of monarchical rule. The article concludes about direct dependence of these preferences from the position of the author and about dominant worldview concept in one or the other period of time. Is underlined the key importance of the system of representation in conditions, when decisions had to be made quickly and financial flows had to be directed to perform specific tasks. ; «Представництво» є комплексним науковим поняттям, що включає юридичні, політологічні, економічні та історичні аспекти. Враховуючи міждисциплінарність цього явища, у статті проаналізовано історію становлення системи представницьких організацій буржуазії в пореформений період, виділено основні фактори, що впливали на цей процес. Особливу увагу приділено ставленню сучасників (представників влади, громадськості, самих підприємців) до представницьких корпорацій, подано їхню оцінку ролі та значення підприємницьких союзів у промисловому розвитку другої половини ХІХ – початку ХХ ст.

The paper illuminates the specifics of implementing social functions in the transition states (whereas Ukraine belongs to this type of state). The author substantiated position that the specifics of political relations influence on the development and the realization of social function in transition states is caused by volatility of democratic traditions of public administration and the lack of stable political consensus on key aims, state's assignment and prospects of its political and social development. This paper outlines the main properties of transition states that have an impact on the implementation of social function. It was found which impact on social functions of the state has the instability of each selected types of social systems. The author defined the mechanisms of neutralization of the negative event's affect (economic, political and legal nature) that objectively are able to reduce the efficiency of the social function or block the implementation of this function at all. ; В статье освещена специфика реализации социальной функции в государствах переходного типа, поскольку Украина относится именно к этому типу государств. Обосновано положение, что специфика воздействия политических отношений на развитие и реализацию социальной функции в государствах переходного типа обусловлена неустойчивостью демократических традиций государственного управления, а также отсутствием устойчивого политического консенсуса по основным задачам государства, а также перспектив ее политического и социального развития. Указаны основные свойства государств переходного типа, влияющие на реализацию социальной функции. Выявлено, какое именно влияние на реализацию социальной функции государства имеет неустойчивость каждого из выделенных типов общественных систем. Определены механизмы нейтрализации влияния негативных явлений (экономического, политического и правового характера), которые объективно способны снизить эффективность реализации социальной функции, или же вообще заблокировать реализацию данной функции. ; У статті висвітлено специфіку реалізації соціальної функції у державах перехідного типу, оскільки Україна відноситься саме до цього типу держав. Обґрунтовано положення, що специфіка впливу політичних відносин на розвиток і реалізацію соціальної функцій у державах перехідного типу зумовлюється неусталеністю демократичних традицій державного управління, а також відсутністю стійкого політичного консенсусу щодо основних цілей, завдань держави, а також перспектив її політичного і соціального розвитку. Зазначено основні властивості держав перехідного типу, які впливають на реалізацію соціальної функції. Виявлено, який саме вплив на реалізацію соціальної функції держави має неусталеність кожного з виділених типів суспільних систем. Визначено механізми нейтралізації впливу негативних явищ (економічного, політичного і правового характеру), які об'єктивно здатні знизити ефективність реалізації соціальної функції, або ж взагалі заблокувати реалізацію даної функції.
