CRISIS EN BOLIVIA Los enfrentamientos de civiles de la región autonomista de Pando y los partidarios del proyecto estatista e indigenista de Evo Morales suponen un nuevo peldaño en la escalada de violencia por la que asciende el país andino desde hace varios años. Desde el pasado jueves, estos enfrentamientos han dejado un saldo de más de treinta muertos, cientos de heridos y desaparecidos.Frente a esta situación de crisis, la Unión de Naciones Suramericanas: UNASUR (creada el 23 de mayo de 2008), se reunió el pasado el lunes en Santiago de Chile con miras de alcanzar una posición común para poner fin al conflicto. La UNASUR salió airosa de su primera prueba de fuego al acordar en la cumbre extraordinaria de jefes de Estado de la región una contundente respuesta de apoyo al Gobierno democrático del presidente de Bolivia, Evo Morales, y al rechazar todo intento de golpe de Estado en el país andino. From Richard Nixon to the Israel lobby, the late Republican Congressman Paul Norton "Pete" McCloskey Jr. challenged the most powerful elements of the ruling class on the American people's behalf.On September 29, 1927, McCloskey was born in San Bernardino, California. He was raised in South Pasadena. After graduating high school in 1945, McCloskey joined the Navy and attended Occidental College as well as the California Institute of Technology. In 1950, he graduated from Stanford with a Bachelor's degree.When the Korean War began, McCloskey joined the Marines where he led a rifle platoon in a bayonet charge to take a strategic hill. He won the Navy Cross, the Silver Star, and two Purple Hearts. He remained a Marine Reserve officer for several years thereafter. In 1953, McCloskey earned his law degree from Stanford and became a deputy district attorney in Alameda County until 1954.Subsequently, from 1955-1967, he practiced general and environmental law in Palo Alto, while giving lectures on legal ethics at the Santa Clara and Stanford law schools. He was inspired to enter politics after he saw President Jack Kennedy give a speech in 1963 during a conference regarding civil rights.In a 1967 special election necessitated by the death of Rep. J. Arthur Younger, McCloskey won his seat representing the San Mateo district in Congress. With the Vietnam War already raging, McCloskey ran as an antiwar candidate defeating the beloved film star and his fellow Republican Shirley Temple Black along with the Democrat Roy Archibald.While serving seven terms in Congress, McCloskey became the first GOP representative to both oppose the war – including by calling for a repeal of the despicable Gulf of Tonkin Resolution which ostensibly authorized the unconstitutional war – and demand Nixon's impeachment.In 1972, he fought a quixotic battle attempting to unseat Nixon for the GOP nomination for President, arguing "I'll probably get licked, but I can't keep quiet." He won 19.7 percent of the vote against Nixon at the New Hampshire primary. McCloskey was emphatic, "To talk, as the president does, of winding down the war while he is expanding the use of air power is a deliberate deception."He was prevented from speaking against Nixon and the war at the Republican National Convention that year as a result of a rule written by John Ehrlichman, his old friend and law school debate partner, stating a candidate could not get to the floor with fewer than 25 delegates. McCloskey only had one.In 1975, he traveled to Cambodia to observe the mass destruction left by the massive US bombing campaign. Yale's Ben Kiernan, a leading historian on Cambodia, estimates the US dropped approximately 500,000 tons of bombs on the country between 1969-1973. According to the BBC, "the number of people killed by those bombs is not known, but estimates range from 50,000 to upwards of 150,000."Then-National Security Advisor Henry Kissinger approved nearly 4,000 bombing raids on Cambodia between 1969-1970. He infamously stated during a declassified 1970 telephone conversation "It's an order, it's to be done. Anything that flies, on anything that moves. You got that?"McCloskey condemned the atrocities committed in Cambodia, declaring that Washington had unleashed "greater evil than we have done to any country in the world, and wholly without reason, except for our benefit to fight against the Vietnamese."In the early 1980s, McCloskey began criticizing the immense power and pervasive influence of the Israel lobby on American foreign policy. He supported then-chairman of the Palestine Liberation Organization Yasser Arafat. His position was that Palestinian militancy and resistance, including the use of terrorism, was a reaction to the brutality of the illegal Israeli occupation, ongoing since 1967, in the West Bank and Gaza.He vehemently opposed Israel's expansion of Jewish-only colonies in the territory intended by the United Nations as land for a future Palestinian state. He advocated for the implementation of UN resolutions which declared the so-called settlements illegal. McCloskey even put forward a resolution to withhold $150 million in US aid to Israel in order to pressure Tel Aviv to remove the settlements.Facing intense backlash from the American Israel Public Affairs Committee (AIPAC), McCloskey ultimately withdrew his amendment. After Israel, under the leadership of Likudnik Prime Minister Menachem Begin, passed its 1981 Golan Heights annexation law, he denounced the move as an "aggressive and imperialistic action." In response to this violation of Syrian sovereignty, McCloskey also implored Congress to rescind the $2.2 billion in US taxpayer money Tel Aviv was due to receive in 1982-1983."Until Congress is willing to stand up to Israel, every time that we step back and deliver them F-16s, or accept the bombing of downtown Beirut, we will accept whatever they want to do," McCloskey thundered. AIPAC poured money into his opponents' campaigns and he was unseated during the 1982 election."In 1982, McCloskey lost to future governor Pete Wilson in a primary election for the U.S. Senate. He told The Times that his controversial positions on Israel might have contributed to his defeat," the Los Angeles Times reports. "He has been supportive of the Palestinian people's plight since the late 1970s," Helen McCloskey, his longtime press secretary whom he married in 1982, told the outlet. "Of course, now that is very relevant," she added.Even after leaving politics, McCloskey continued to oppose the Israel lobby and its depredations against the American people. As Paul Findley, the former Illinois congressman and McCloskey's co-founder of the Council for the National Interest, has written:AIPAC's endeavors did not stop McCloskey from seeking out justice in issues related to the Middle East. In 1993, the district attorney of San Francisco released 700 pages of documents implicating the Anti-Defamation League of B'nai B'rith, a major Jewish organization that calls itself "a defender of civil rights," in a vast spying operation. The targets of the ADL operation were American citizens who were opposed to Israel's repression of Palestinians and to the South African government's policy of apartheid. The ADL was also accused of passing on information to both governments. After experiencing "great political pressure," the district attorney dropped the charges, prompting victims to file a suit against the ADL for violation of their privacy rights. They chose Pete McCloskey as their attorney.McCloskey and his clients, two of whom were Jews who had been subjected to spying after criticizing Israeli policy in the occupied territories, revealed an extensive operation headed by ADL undercover operative Roy Bullock, whose files contained the names of 10,000 individuals and 600 organizations, including thousands of Arab Americans and national civil rights groups such as the NAACP. Much of Bullock's information was gained illegally from confidential police records. In April 2002, after a nine-year legal battle, McCloskey won a landmark $150,000 court judgment against the ADL.During the second Iraq War, McCloskey also highlighted the heavy influence of the Likud as well as the neoconservatives in spearheading the push for Washington's illegal and disastrous invasion.In a 2005 interview with Scott Horton, host of Antiwar Radio and now editorial director of Antiwar.com, McCloskey rebuked the arguments for the war and excoriated the neocons proliferating throughout the George W. Bush administration,We killed a lot of people [in Vietnam], we killed a million Vietnamese, 55,000 Americans, and wounded four or five times that many in a war we shouldn't have fought in the first place… [And in the case of Iraq,] it's the same problem. I don't know how you earn the love and affection and the minds and hearts of the ordinary Iraqi when you're blowing up his houses and killing his relatives… [Paul] Wolfowitz, and [Douglas] Feith, and this man [Richard] Perle, and John Bolton appointed to the UN [ambassadorship], those men have considered Israel almost as the 51st state. Of course, now they're pushing to take out Iran. Well why are we wanting to take out Iran? And our refusal to comply with the United Nations and now trying to appoint Bolton as our representative to the United Nations sends a signal to the world that whatever Israel does the United States is going to support, including Israel's known possession of atomic weapons… And the only reason we take these policies is because the [lobby] through AIPAC has scared every congressman into fearing they'll lose their seat if they in any way vote against Israel.In a sense, McCloskey's antiwar career came full circle in 2014 when he visited North Korea. While there, he met with a fellow veteran from the opposite side of the battle, a retired three-star general who had also been wounded. "I told him how bravely I thought his people had fought, and we embraced… We ended up agreeing that we don't want our grandchildren or great-grandchildren to fight, that war is hell, and there's no glory in it," McCloskey said.Last week, the former congressman passed away at his home in Winters, California as a result of congestive heart failure, according to family friend Lee Houskeeper. With well over $30 trillion in debt, most of our lawmakers happily continue robbing the American people to fund the American Empire.McCloskey's example and legacy is one to emulate if we desire to avoid full-scale war with any of the current White House's favored targets: Beijing, Moscow, Pyongyang, or Tehran. Last Thursday, the Supreme Court struck down President Biden's student loan forgiveness program, finding that it was not plausibly authorized by statute and that the State of Missouri had standing to challenge the program via a state‐created loan‐servicing entity that would lose tens of millions of dollars in fees if the program took effect. This post will explain why Cato filed its own, now‐moot challenge to the loan forgiveness program, followed by some thoughts on the increasingly pernicious role of "avoidance doctrines" such as standing, ripeness, and mootness in public‐policy litigation. The great miltitary strategist Sun Tzu famously said that the acme of skill in war is to subdue the enemy without fighting. For government lawyers, the acme of skill is to shield unlawful policies from judicial review by persuading courts that there is some procedural bar against challenging them. Last week, the Supreme Court rebuffed the Biden administration's attempt to employ that precise stratagem to forestall a judicial determination as to whether the president has the power to forgive nearly half‐a‐trillion dollars worth of student loans without express congressional authorization. Surprising no one, the Court's answer to the substantive question was a resounding "no." But constructing a legal challenge that would ensure the judiciary reached the merits of that question was a dicey proposition. Why? One word: standing. In brief, standing is a court‐created rule that says only certain people can challenge a given policy in court. To have standing, the would‐be plaintiff must have suffered a concrete injury that was caused by the policy at issue and can be fixed (or "redressed") by the courts. Thus, for example, I do not have standing to challenge the Justice Department's sweetheart plea deal with Hunter Biden, both because I've not been personally injured by it (mere outrage is insufficient) and because there's really nothing the courts can do about DOJ's propensity for coddling VIPs. Like so many judge‐made legal rules, however, standing is both amorphous and prone to abuse. It's amorphous because it lacks clear doctrinal parameters and can be easily enlarged or constricted as a matter of judicial whim. And of course that makes it prone to abuse, since judges can simply declare that a given plaintiff either does or does not have standing depending on whether they do or don't want to reach the merits of the case at hand. To be clear, not all standing inquiries represent such an exercise in procedural roulette, but an increasing number of them do—particularly as poliymakers become more conscious of their ability to defeat judicial review through strategic legerdemain. Thus, the key question in the loan‐forgiveness case was not so much the legality of the program itself, but instead whether the Biden administration and its lawyers could persuade the judiciary that the executive branch can expend nearly half‐a‐trillion dollars in unappropriated funds without causing a sufficiently concrete injury to confer standing on any individual or entity affected by that program. As we learned last Thursday, the answer is no. But boy, was it close. Without delving too much deeper into federal standing doctrine, the basic problem here was that the Supreme Court has generally rejected the concept of "taxpayer standing"—that is, the idea that any given person who pays taxes can sue the government simply because it is (arguably) spending that revenue unlawfully. Accordingly, when President Biden announced his intent to forgive student loans without express congressional authorization, there was a scramble among people and groups who opposed that policy to identify a concrete and individualized theory of standing that might pass muster with a judiciary that tends to be more comfortable rubber‐stamping challenged government programs than striking them down—especially when they involve things like the proper scope of federal power, economic regulations, property rights, or tax policy. As noted, Missouri and a handful of other states led with the theory that a blanket student loan forgiveness policy would deprive them of fees generated by their respective loan‐servicing entities. Another suit was filed by two college graduates from Texas who challenged the Department of Education's failure to follow proper administrative procedures, which they said might have resulted in better debt‐forgiveness terms for each of them. At the time, it was unclear whether either of those standing arguments would prove viable, and additional complaints were filed by other groups, each asserting a different theory of standing. This included a lawsuit brought on Cato's behalf by the New Civil Liberties Alliance, which alleged that Biden's blanket loan forgiveness program would prejudice non‐profit employers like Cato, for whom Congress had created a more targeted policy called the Public Service Loan Forgiveness Program that was designed to give non‐profits a recruiting edge by providing loan‐forgiveness to their employees after ten years. Whether legitimate or illegitimate from a policy perspective, the advantage conferred on charitable employers by that program would be eliminated by across‐the‐board debt forgiveness, which represents a cognizable injury that is redressable by the courts—et voila: standing. As it turns out, the Supreme Court held unanimously that the two Texans lacked standing to challenge Biden's loan forgivness program while ruling 6–3 that the states (or at least one of them, which is all that mattered) did have standing. Bottom line, it was a close call, and it was fortunate that Cato and others were waiting in the wings with their own unique—and potentially more persuasive—standing theories. But those other cases, including Cato's, are now moot in light of the Court's decision to find standing in the states' challenge and strike down Biden's loan forgiveness scheme. In retrospect, the half‐dozen lawsuits filed against that program may seem like overkill. But as a colleague at my first law firm used to say of a judge in one of his cases, "You never know on any given day what's going to get his attention: Will it be the red rubber ball, the shiny metal object, or the baby rattle? So you bring 'em all." And so it is when seeking to overcome the slew of avoidance doctrines routinely deployed in public‐policy litigation by government lawyers like ink from a fleeing squid. If standing, ripeness, and mootness can fairly be compared to a game of craps—and they can—then it makes sense for both sides to get as many chips on the table as possible. If that sounds like hyperbole, consider the following examples, which represent merely the barest hint of the jaw‐dropping bad faith with which avoidance doctrines are asserted by government lawyers and employed by judges to make potentially troublesome cases go away: Cato v. SEC (DC Cir. 2022). This case involved a First Amendment challenge to the SEC's policy of imposing a lifetime gag order on defendants in civil enforcement actions as a condition of settlement. Cato sued on behalf of an author who wrote a memoir about being caught up in that process that it was unlawful for him to publish due to the gag order. As a would‐be publisher of that work, Cato asserted the well‐established theory of third‐party standing, but the DC Circuit held that the "redressability" requirement for standing was not met on the premise that all of the challenged gag orders had been incorporated into judicially enforceable consent decress around the country that judges in DC were powerless to disturb. Besides being incorrect on the law, that holding was based on a demonstrably false factual premise: Contrary to the DC Circuit's completely baseless assertion—that was supported nowhere in the pleadings or the record because it was false—all gag orders (including the very one at issue in this case) had not been incorporated into judicially enforceable consent decrees—a fact that Cato pointed out repeatedly throughout the litigation and again in its petition for rehearing, which the DC Circuit ignored. Parker v. Heller (DC Cir. 2007). Another example of standing gamesmanship from the DC Circuit arose in the Second Amendment challenge to the District of Columbia's gun laws brought on behalf of six DC residents by me, former Cato board chair Bob Levy, and Alan Gura. In blatant and acknowledged disregard for Supreme Court precedent, the DC Circuit invoked its special law of standing for guns and held that five of the six plaintiffs lacked standing because they had not yet violated the law and received a specific threat of prosecution—actions that are never required in any other setting to establish standing. Only Dick Heller was ultimately found to have standing because he had made an entirely futile attempt to register a handgun in DC and was denied—an act that the DC Circuit risibly (but correctly, as a matter of circuit precedent) held supplied an alternative basis for standing. Alvarez v. Smith (2009) and NY State Rifle & Pistol Ass'n v. City of New York (2020). These are both examples of "strategic case mooting," a common practice whereby government lawyers will vigorously defend an unconstitutional policy in the lower courts and then moot the case if it looks like the challengers might win on appeal and thereby establish favorable precedent. Alvarez was a challenge to Illinois' unconstitutional civil forfeiture procedure, which the state defended below but then mooted when the case got to the Supreme Court by returning the plaintiffs' unlawfully seized vehicles. NY State Rifle & Pistol involved a challenge to a New York City ordinance that severly constrained people's ability to move a lawfully registered pistol from one location to another (e.g., from an apartment in Manhattan to a cabin in upstate New York), which the City defended vigorously in the lower courts but then repealed immediately after the Supreme Court granted certiorari, in a transparent (and ultimately successful) effort to derail the case. So much for all the assertions the government made in the lower courts about the supposed importance of the law, the momentous safety issues involved, etc.—all of which turned out to be cynical, disingenuous prattling. As suggested above, the list could go on almost indefinitely. But the takeaway is this: When it comes to the willingness of government lawyers and judges (a wildly disproportionate number of whom were themselves courtroom advocates for government before taking the bench) to employ standing, ripeness, mootness, and other "avoidance doctrines" in order to derail challenges to plausible allegations of unlawful government action, there is no bottom. And that's why Cato joined the fray over President Biden's unlawful student loan forgiveness scheme—not because there was ever any doubt about the merits; but instead to help make it as difficult as possible for the judiciary to sweep that unlawful power grab under the rug with the handy‐dandy standing‐broom.
The issue of the regulation of artificial intelligence (AI) is one of the significant challenges faced by the EU at present. Most researchers focus on the substantive scope of AI regulation, including state law, ethical norms and soft law. In addition to the substantive and legal scope of the regulation, it is worthwhile considering the manner of such regulation.1 Since AI is an algorithmic code, it seems correct to regulate (restrict) AI not so much with traditional law established in natural (human) language as with one implemented into algorithms. They may operate as a tool supporting traditional legislation (RegTech), but it is possible to go further with the issue and create regulation algorithms which implement the law as the effective law. Often when Native nations assert their treaty rights and sovereignty, they are confronted with a backlash from their neighbors, who are fearful of losing control of the natural resources. Yet when both groups are faced with an outside threat to their common environment -- such as mines, dams, or an oil pipeline -- these communities have unexpectedly joined together to protect the resources. Some regions of the United States with the most intense conflicts were transformed into areas with the deepest cooperation between tribes and local farmers, ranchers, and fishers to defend sacred land and water. Professor Zoltán Grossman explores this evolution from conflict to cooperation through place-based case studies in the Pacific Northwest, Great Basin, Northern Plains, and Great Lakes regions during the 1970s through the 2010s. These case studies suggest that a deep love of place can begin to overcome even the bitterest divides

Over the past two decades authoritarian regimes in many parts of the developing world, as well as in East/Central Europe, have been replaced by democracies. This paper looks at the issue of democratization from a gender perspective. While many of the problems afflicting the 'new democracies' (such as the elitist character of political parties, and the failure of the state to guarantee civil and political rights or make a significant dent in poverty) affect all citizens, they are manifested and experienced in gender-specific ways. Women's persistent exclusion from formal politics, in particular, raises a number of specific questions about how to reform democratic institutions, since these institutions are not automatically gender-equitable. In a democratic polity citizens are presumed to have equal rights, opportunities and voice in the governance of the public domain. All versions of liberal democracy link the right to vote with the right to stand for office. Yet women are hugely under-represented in national assemblies and governments. Women's political invisibility is particularly striking in those countries where their political mobilization contributed to the demise of authoritarianism and the transition to democracy. The suppression of the conventional political arena under authoritarian rule very often shifts the political centre of gravity to 'movement-type activities' and gives prominence to women's political mobilization. What very often unites the disparate groups constituting the women's movement in these contexts is their commitment to bringing about a change in government. Nevertheless, social, political and ideological heterogeneity of women's groups, tensions between the feminist and the feminine streams, and divisions over strategy foreshadow future difficulties in forging political coalitions and aggregating interests to effect change in more 'normal' times. The new wave of democratization has not had a feminizing affect on the parliaments and the governments of the new democracies. Deeply entrenched barriers exclude women from meaningful participation in political parties. In the post-transition period, the more established political parties in countries like Brazil and Chile have remained remarkably resistant to women's participation. Newly formed parties of the left have been more accessible to women, though participation in these smaller parties may arguably produce more symbolic than real benefits. The masculine construction of political authority makes it extremely difficult for women to be elected into office without some form of electoral engineering, such as quotas or reserved seats. The adoption of quotas and reserved seats for women by the South African ANC and the Ugandan NRM, which dominate politics in their respective countries, has produced a significant increase in women's political profile. But given the lack of any realistic political options for women outside these two parties, women's political leverage vis-à-vis the party hierarchy remains strictly limited. Besides the issue of political equality and democratic justice, the argument for increasing women's representation in decision-making bodies also hinges very often on an implicit assumption that women can, more effectively than men, contribute to the formulation of woman-friendly policies because they are somehow better able to represent women's interests. But this is a controversial assumption. Questions continue to be raised about how such a diverse group as 'women' can find meaningful representation in the polity in the absence of procedures for establishing what the group wants or thinks, and in the absence of mechanisms for keeping the 'representatives' accountable to their constituents. Questions have also been raised as to why the growing presence of women in politics (in some contexts) is not translating into substantive change toward policies capable of making a positive impact on the lives of ordinary women. Given the limited success to date in feminizing political parties and getting women elected, it is not surprising that other strategies are also needed for bringing women's interests into the policy-making process. One such strategy is to enter and work directly through the public administration. Democratic transitions, however restricted, represent propitious moments for making interventions because the state is potentially more fluid than at other times. But this space is often limited because of the top-down, elitist nature of the transition. Moreover, the ability of those working on the 'inside' to push for change on a sustained basis depends less on having an institutional space per se, and much more on the relationships with autonomous women's organizations on the 'outside' that they are able to establish and exploit. But it is very often difficult to establish effective inside-outside relationships-popular women's movements and groups, in particular, may feel alienated from the 'women's machineries' in the public administration and from the women who staff these units. They may also deliberately distance themselves from public authorities because of recent experiences of corruption and co-optation. Moreover, the creation and staffing of women's spaces within the state may in itself weaken the women's movements outside the state. Although in some contexts the state has incorporated the participants and the banners of the women's movements, it has been extremely difficult for those on the 'inside' to translate even the watered-down goals of the movement into concrete policies capable of making a positive impact on the lives of female citizens. The efforts to induce change have been patchy and, in the realm of public expenditure decisions, extremely difficult. This is in part due to the lack of effective pressure from an organized women's constituency (noted above) that can articulate a coherent set of issues and priorities for policy attention, and monitor its adoption and implementation by state agencies. It is also due to the disabling environment in which women bureaucrats find themselves. The deliberate attempt to create insulated technocracies, as is currently occurring in some countries and some areas of policy, has serious implications for democratic consolidation. While gender bureaucrats well-versed in economic analytical skills may be able to contribute to what goes on inside insulated technocracies (in ministries of finance, for example), this can hardly substitute for open public debate enabling women's groups and networks, along with other social groups, to scrutinize economic decisions and policies that affect the well-being of their constituents. But women's machineries and women parliamentarians have had more significant impact in some critical areasraising the legitimacy of violence against women as a political issue; enhancing women's awareness of their existing rights through civic education; and facilitating social legislation on highly significant issues such as divorce, child custody, domestic violence, and reproductive health and rights, which address very fundamental aspects of women's oppression. But here again, success in raising these controversial issuesand maybe even legislating for themhas gone hand in hand with a failure of the state (the judiciary and the police, in particular) to guarantee such important individual civil rights across national territories and for all social strata. One cross-cutting concern in the post-transition period is that the national women's movements have been stripped of their most competent cadres, as leaders and key organizers have been drawn into the new state institutions representing gender issues, into political parties and into parliament. Another common concern is the 'NGO-ization' of women's movements, especially through donor-driven, poverty alleviation programmes. Together, it seems, they have contributed to the weakening of both national women's movements and the cross-class alliances that some had managed to forge. The formalization provoked by the proliferation of NGOs and the competition for funds has several problematic implications. Self-reliance and self-help, which characterize this model of social provisioning, can be euphemisms for reliance on the unpaid work of women (who are recruited by NGOs in voluntary and secondary positions). Moreover, politically these projects seem to have taken away the advocacy and campaigning element of local participation. The perennial issue of feminist autonomy continues to preoccupy members of women's movements-whether 'in' or 'out' of the mainstream institutions. Given the dangers of co-optation by the state or party in power, there is a distinct need for maintaining some autonomous space for interest articulation and aggregation. But at the same time, by taking an autonomous path, women's groups and movements also run the risk of becoming politically isolated-hence the need for a politics of engagement with the mainstream. Ultimately, the long-term viability and effectiveness of the women's movement depends on its ability to work at different levels and in different arenas-both 'inside' and 'outside' the mainstream-forging strategic insider-outsider alliances. This message is sometimes lost on advocates of 'mainstreaming' who see the process of institutional change as a purely technocratic exercise of tinkering with institutions in a political vacuum. To be effective and sustainable, the two sets of strategies need to go hand in hand.
[SPA] El objetivo principal de esta tesis es desarrollar una propuesta ética e interactiva de gobernanza que permita la sostenibilidad de las comunidades de pescadores. Mediante la revisión de la literatura se han detectado seis problemas principales: la salud de las poblaciones de peces, las pérdidas económicas de la pesca, la justicia social, el empleo y su calidad, la seguridad alimentaria y la calidad de la gestión. Estos problemas suponen un reto para todos los actores sociales involucrados en el sector pesquero (agentes de gobierno, pescadores, empresas, científicos, ONGs, consumidores y comunidad) cuyas actuaciones tienen un impacto relevante en la conservación y mejora del sistema social y natural que forman la pesca. Por esta razón, en los últimos años se está produciendo un cambio en la ordenación de la actividad con el objetivo de que la triada Estado-Mercado-Sociedad Civil participe de forma equilibrada en los procesos y decisiones de gobierno desarrollados para reducir su vulnerabilidad. Dicho cambio sigue el paradigma de la gobernanza, que sustituye a la gestión tecnócrata y economicista tradicional para avanzar hacia un modelo más inclusivo, sensible, flexible y prudente que aporte soluciones responsables a la crisis de la pesca y aceptando los altos niveles de incertidumbre que genera la diversidad, complejidad y dinamismo inherentes a la misma. No obstante, existen diferentes estudios que muestran un conjunto de debilidades que impiden la transición desde el modelo de gestión tradicional hacia la gobernanza. Con el propósito de avanzar hacia la sostenibilidad de las comunidades de pescadores, en este estudio se articulan la teoría de la gobernanza interactiva con la dimensión ética de la pesca. De acuerdo con la literatura, el marco sigue una estructura formada por tres niveles (u órdenes) de toma de decisiones. El primer orden se centra en un contexto donde las personas y las organizaciones interactúan con el fin de identificar y resolver los problemas diarios de las comunidades de pescadores y crear oportunidades sociales. El segundo orden está relacionado con el desarrollo de las instituciones, con el fin de crear procesos que resuelvan los problemas de sostenibilidad de las comunidades de pescadores y de la pesca. Para terminar, desde el tercer orden (o meta-gobernanza) se aporta un fundamento ético a los procesos y actuaciones que forman la pesca mediante el estudio de las imágenes, valores y principios de buena gobernanza. Una vez desarrollado el marco teórico, el estudio empírico se ha centrado en el primer orden. Para ello, se ha utilizado el caso de estudio de la pesca en la Comunidad Autónoma de la Región de Murcia (CARM) y, particularmente, de las comunidades de pescadores del litoral del Campo de Cartagena. Siguiendo distintas fuentes de información y técnicas de análisis, el estudio tiene como fin aportar un conocimiento valioso para resolver los problemas existentes y desarrollar oportunidades sociales en esta área mediante tres niveles de análisis. En primer lugar, se realiza un estudio a nivel autonómico sobre la sostenibilidad de las comunidades de pescadores y se establecen unas prioridades de gestión para solucionar la problemática existente en el sistema a gobernar y de gobierno de la pesca en la CARM, así como de las interacciones entre ambos. Los resultados muestran la necesidad de avanzar hacia el paradigma de la gobernanza para aportar soluciones viables, equitativas y soportables que garanticen la sostenibilidad de la pesca a largo plazo. En segundo lugar, se lleva a cabo un estudio a nivel local sobre el estado de las comunidades de pescadores de Cartagena y San Pedro del Pinatar. En ambos casos de estudio se muestra como existen actividades, activos y capacidades de los pescadores que son vulnerables a los cambios que se están produciendo en la pesca y que requieren de medidas urgentes para garantizar la sostenibilidad de los medios de vida de los pescadores. Asimismo, se destaca la importancia de conservar y mejorar el bienestar sociocultural de los pescadores para mantener la cohesión de la comunidad y la viabilidad de las estrategias de pesca en las dos áreas estudiadas. Finalmente, se desarrolla un análisis comparativo para identificar las similitudes y disparidades existentes entre ambos casos de estudio y las modalidades de pesca. Dicho análisis indica una mayor vulnerabilidad en el área de Cartagena, existiendo en esta área una diversidad, complejidad y dinamismo mayor que en el área de San Pedro del Pinatar. Por lo tanto, ambos casos de estudio requieren de soluciones distintas para resolver sus problemas de sostenibilidad, aunque existen riesgos y amenazas comunes que pueden abordarse conjuntamente mediante una mayor cooperación entre sus pescadores e instituciones. Para terminar, la tesis presenta las principales conclusiones teóricas y empíricas alcanzadas. [ENG] The main objective of this thesis is to develop an ethical and interactive governance proposal that allows the sustainability of fishing communities. Previously, the main obstacles and threats to the sustainable development of fisheries are studied. Six main problems have been identified through the review of the literature: Health of the fish populations, economic losses, social justice, quality of employment, food safety and the quality of management. These problems represent a challenge for all the social actors involved in fishing (government agents, fishers, companies, scientists, NGOs, customer and community) whose actions have a relevant impact on the conservation and improvement the social and natural fishery system. In the last years, there is a change in management of fisheries that aim of the State-Market-Civil Society triad participating in the processes and decisions oriented to reduce their vulnerability. This change follows the paradigm of governance, which replaces the traditional technocratic and economistic management to a more inclusive, sensitive, flexible and prudent model that provides sustainable solutions to the fishing crisis and manage responsibly their diversity, complexity and dynamism. However, there are different studies that show a set of weaknesses that impede the transition from the traditional management to governance paradigm. With the purpose of advancing towards the sustainability of fishing communities, this study articulates the theory of interactive governance with the ethical dimension of fishing. Following the interactive governance literature, the framework follows a structure formed by three levels (or orders) of decision-making. The first order is focused in identify and solve the daily problems of fishing communities and create social opportunities on a context where people and organizations interact. The second order is related to institutional arrangements to develop processes that solve the sustainability problems of fishing. Finally, from the third order (or meta-governance), an ethical basis is provided to the processes and actions of governance than involved to all social actors through the study of images, values and principles of good governance. Once the theoretical framework has been developed, the empirical study has focused on the first order. We use the case study of fisheries in the Autonomous Community of the Region of Murcia (CARM) and, particularly, the fishing communities of the coast of Campo de Cartagena. Following different sources of information and analysis techniques, the study provide valuable information to solve sustainability problems and develop social opportunities in this area through three levels of analysis. Firstly, an autonomous analysis to the sustainability about fishing communities is developed and management priorities are established to solve the existing problems in the system to govern and government system, as well as the interactions between both. The results show the need to move towards the paradigm of governance to provide viable, equitable and supportable solutions to stimulate the sustainability of fishing in the long term. Second, a study is focused at the local level and asses the state of the fishing communities of Cartagena and San Pedro del Pinatar. In both cases of study are identified vulnerable activities, assets and capacities to the changes in the activity and that require urgent measures to achieve the sustainability of fishers´ livelihoods. In addition, the study shows the importance of preserve and improve the sociocultural wellbeing to improve the sustainability of fishing communities. Finally, a comparative analysis is developed to identify the similarities and disparities between the two case studies. This analysis indicates a greater vulnerability in the area of Cartagena compared to San Pedro del Pinatar. Therefore, both case studies require different solutions to solve their sustainability problems, although there are common risks and threats that can be solved together through greater cooperation between fishers and institutions. In the last chapter, the thesis presents the main theoretical and empirical conclusions reached. Sullivan, the first woman from Missouri to serve in the United States House of Representatives, was born Leonor Alice Kretzer, August 21, 1902, in St. Louis. She attended public and private schools in St. Louis, including Washington University. Prior to her marriage, Mrs. Sullivan pursued a business career and eventually became the director of the St. Louis Comptometer School. She married Missouri Congressman John B. Sullivan on December 27, 1941, and served as his administrative assistant and campaign manager until his death in January, 1951. Following her husband's death, Mrs. Sullivan unsuccessfully attempted to win the local Democratic party's nomination to succeed Congressman Sullivan in the special election. The seat was lost to a Republican candidate. In 1952, Leonor K. Sullivan running on her own, without party support, defeated six opponents in the primary election to become the Democratic nominee for the Third Congressional District. In the general election, she defeated her Republican opponent and recaptured the seat once held by her husband. Mrs. Sullivan represented the Third Congressional District until her retirement in 1976. While in Congress, Leonor K. Sullivan was known as a champion of consumer issues and she had a key role in enacting legislation to improve the quality of food. The Poultry Inspection Law and the Food Additives Act are just two of her important triumphs. As chairman of the Subcommittee on Consumer Affairs of the House Committee on Banking and Currency, Mrs. Sullivan was responsible for the Consumer Credit Protection Act of 1968, which included the Truth in Lending Act, and the Fair Credit Reporting Act of 1970. Mrs. Sullivan also authored the original food stamp plan to distribute government surplus food to the needy and she worked to solve the housing problems in our cities. At the time of her retirement, she was the senior member of the House Committee on Banking, Currency, and Housing. She was a member of the National Commission on Food Marketing, 1964-66; the National Commission on Mortgage Interest Rates, 1969; the National Commission on Consumer Finance, 1969-72; and she helped found the Consumer Federation of America in 1966. Mrs. Sullivan served as chairman of the House Committee on Merchant Marine and Fisheries. Her support of the American Merchant Marine earned her the American Maritime Industry's Admiral of the Ocean Seas Award (AOTOS) in 1973. The men and women who served in the Coast Guard and the Merchant Marine continuously honored Mrs. Sullivan for her support, understanding, and dedication. Always active in waterways projects, she fought to allow the 51 year old DELTA QUEEN to continue as an overnight excursion vessel. Mrs. Sullivan's work as chairman of the Subcommittee on Panama was especially important as she became involved with the political, economic, and social challenges of the Canal Zone and the people who lived and worked there. Leonor K. Sullivan worked hard for St. Louis. She sponsored legislation to fund the development of the Jefferson National Expansion Memorial on the St. Louis Riverfront, to keep St. Louis a well managed port city on the Mississippi trade route, and to preserve the buildings so important to the history and heritage of St. Louis. Wharf Street has been renamed Leonor K. Sullivan Boulevard to honor her support of the Gateway Arch project and the Jefferson National Expansion Memorial. Following her retirement, Mrs. Sullivan returned to her river bluff home which overlooked the Mississippi River. She remained active in civic affairs, serving on numerous boards and committees. She became a director of Southwest Bank, chairman of the Consumer Advisory Council to the Board of Governors of the Federal Reserve System, a member of the Board of Directors of Downtown St. Louis, Inc., a member of the Lay Advisory Board of Mount St. Rose Hospital and Rehabilitation Center, and she sponsored a consumer award program through the Better Business Bureau. Mrs. Sullivan was always in demand as a featured speaker at business, educational, and social functions. In 1980, Mrs. Sullivan married Russell L. Archibald, a retired vice president of the American Furnace Company. Mr. Archibald died March 19, 1987. Leonor K. Sullivan died, in St. Louis, on September 1, 1988. SULLIVAN COLLECTION Before her retirement, Leonor K. Sullivan made arrangements to donate her congress ional papers, correspondence, and memorabilia to St. Louis University Law Library. Mrs. Sullivan chose St. Louis University Law Library because her husband, Congressman John B. Sullivan (1897 -1951 ), was a graduate of the law school, having received his LL. B. degree in 1922, and his LL. M. degree in 1923. In 1965, Mrs. Sullivan founded a scholarship at St. Louis University for young women interested in studying political science. The collection covers Mrs. Sullivan's 24 years in the U.S. House of Representatives and is arranged according to her own subject headings. In this way, the materials provide insight into the way her office files and correspondence were organized. Mrs. Sullivan was known as one of the hardest working members of Congress and the wealth of materials in her collection attests to this. She had a tremendous concern for the average American family and much of her work dealt with their needs. Mrs. Sullivan often said the · best legislative ideas came from constituents, so she read every letter ever sent to her. Not only did she learn how the voters felt about current issues, but where there were problems which needed to be current issues. Papers from Leonor K. Sullivan's years as a member of the House Merchant Marine Committee and the Banking and Currency Committee provide background information for much of the legislation proposed during the period. Mrs. Sullivan was known as a consumer advocate long before such a position was popular and her efforts to improve the quality of food, drugs, and cosmetics are well documented. Materials are also available on Mrs. Sullivan's struggle for credit protection for the consumer, truth-in-lending, and fair credit reporting. Mrs. Sullivan was a strong supporter of the American Merchant Marine, the U.S. supervision of the Panama Canal, and the development of America's inland waterways. Her collection includes in-depth information on all these areas. Local St. Louis concerns are well represented in Leonor K. Sullivan's papers. She spent untold hours on the development of the Gateway Arch, the Jefferson National Expansion Memorial, and the port of St. Louis. She worked hard to maintain and increase the river traffic which is so important to St. Louis. After her retirement, Mrs. Sullivan continued to receive letters from former constituents and friends. She was active in civic affairs and her opinion on current issues was frequently solicited. On Monday, Facebook, Instagram, and WhatsApp owner Meta said that it was going to ban a number of Russian state media outlets, including RT (formerly Russia Today). "After careful consideration, we expanded our ongoing enforcement against Russian state media outlets: Rossiya Segodnya, RT and other related entities are now banned from our apps globally for foreign interference activity," Meta said in a statement. This occurs just days after the Biden administration announced sanctions against RT. United States Secretary of State, Antony Blinken said that Russian media entities "are no longer merely fire hoses of Russian propaganda and disinformation. They are engaged in covert influence activities aimed at undermining American elections and democracies, functioning like a de facto arm of Russia's intelligence apparatus."In its own statement, the State Department said "The United States supports the free flow of information. We are not taking action against these entities and individuals for the content of their reporting, or even the disinformation they create and spread publicly. We are taking action against them for their covert influence activities."Those covert activities, the agency charged, include RT employees allegedly working with Russian intelligence services to influence the election in Moldova, as well as to crowdfund weapons and supplies for the Russian military in Ukraine, among other activities.Earlier this month the Department of Justice announced the seizure of 32 web domains it said were linked to the Russian government-directed foreign malign influence campaigns in violation of U.S. money laundering and criminal trademark laws. Two former employees of RT were indicted for their links to a U.S. media platform designed to covertly spread Russian disinformation via American influencers, according to the DOJ.Despite Meta chief Mark Zuckerberg's recent lamentations over what he called government pressure to censor posts relating to the pandemic during the COVID era, he is likely still smarting from two previous presidential election cycles in which Facebook was accused of not doing enough to manage Russian bots and misinformation (a problem that has been hotly debated for its actual impact on the elections).Meanwhile, during an interview with MSNBC on Tuesday, Hillary Clinton was asked whether the U.S. government was doing enough to combat the kind of Kremlin-directed propaganda cited in the recent indictments. She suggested that government censorship was also necessary to combat Russian misinformation, even positing that Americans might be criminally charged for proliferating it."I also think there are Americans who are engaged in this kind of propaganda," she said. "And whether they should be civilly or even in some cases criminally charged is something that would be a better deterrence, because the Russians are unlikely, except in a very few cases, to ever stand trial in the United States."The Quincy Institute's Marcus Stanley pointed out the ironies last week in a report about the House passing an authorization for $1.6 billion for a program that would allow the U.S. government to pursue its own potentially covert information operations via foreign media and civil society sources to combat Chinese "malign influence" globally.Stanley points out that in addition to potential foreign blowback from such legislation, "another problem raised by the proposed legislation is the possibility that anti-Chinese propaganda financed by this program will flow back into the American media space and influence American audiences, without any disclosure of its initial source of funding." Washington is more than happy to participate in covert message management, all while Antony Blinken claims that aggressive moves against Russian media entities are "shining a bright light on what the Kremlin is trying to do under the cover of darkness."In other Ukraine war news this week: The New York Times reported on Tuesday that Moscow's troops have been engaging in a counter-offensive in Kursk, reclaiming a few villages and threatening Ukraine's ability to hold onto the territory it has seized. At the same time, Russian soldiers in Ukraine have continued advancing on the eastern Ukraine city of Pokrovsk, which is a strategic hub for Ukraine's forces, and if lost would greatly impact Kyiv's ability to move men and supplies to the front and take away a key buffer for central Ukraine. This comes after Putin ordered all Kursk territory to be returned to Russia by October first. The number of Ukrainians and Russians killed or wounded has reached around one million according to the Wall Street Journal. A Ukrainian estimate placed Ukrainian deaths at 80,000 and wounded at 400,000. Russian casualties are estimated to be as high as 600,000 dead and wounded. This staggering number is bound to have long-term effects on both nations, especially as Russia and Ukraine have seen population declines in recent years. As Western powers discuss the possibility of allowing Ukraine to send long-range missiles further into Russian territory, Vyacheslav Volodin, speaker of Russia's lower house of parliament affirmed that such an action would be extremely antagonistic. According to Reuters, Volodin said "What the European Parliament is calling for leads to a world war using nuclear weapons," on Telegram. In this week's Sept. 17 State Department briefing:State Department spokesman Matthew Miller was asked whether the Biden Administration would be announcing anything regarding White House approval for the use of American-made long-range missiles in attacks deep inside of Russia. Miller said no. When asked if the administration felt there was an urgency for a decision soon, given Ukraine's need to improve its position on the battlefield, Miller responded by saying the administration wants to "make sure that with everything that we provide them there's a strategic rationale for doing so.""There is no one capability that ultimately, by itself, is the magic wand that is decisive in this conflict," he added. "There are a number of different capabilities that taken together can help Ukraine win this war, and that's what we continue to provide them, and we will continue to assess whether there are additional capabilities, additional tactics, additional techniques that we ought to provide to them. And when we assess that it is in their interest and the interests of the United States to do so, we'll do so."
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาและทำ ความเข้าใจปรากฏการณ์ ของภาวะผู้นำ ที่มีประสิทธิผลของผู้บริหารใน โรงเรียนดีเด่นและผลกระทบที่เกิดขึ้น ผู้วิจัยได้เลือกพื้นที่ที่ศึกษาแบบเจาะจง 3 แห่ง ซึ่งเป็นโรงเรียนในสังกัดสำ นักงาน เขตพื้นที่การศึกษาประถมศึกษาในภาคตะวันออกเฉียงเหนือ ประกอบด้วย โรงเรียนขนาดเล็ก กลาง ใหญ่ ผู้วิจัยศึกษา และเก็บรวบรวมข้อมูลด้วยตนเอง โดยวิธีการสัมภาษณ์เชิงลึก การสังเกตและจดบันทึก การวิเคราะห์เอกสาร และการ สนทนากลุ่มย่อย โดยเก็บข้อมูลจากบุคลากรหลักในโรงเรียนและผู้เกี่ยวข้อง ใช้เทคนิคการตรวจสอบข้อมูลแบบสาม เส้า เพื่อเป็นการยืนยันความเชื่อมั่น และความเที่ยงตรงของข้อมูล จากแหล่งและชนิดของข้อมูล รวมทั้งความถูกต้อง ที่เชื่อถือได้ผลการวิจัยพบว่า1. คุณลักษณะภาวะผู้นำที่มีประสิทธิผลของผู้บริหารในโรงเรียนดีเด่นประกอบด้วย 1) ด้านวิสัยทัศน์ มีทักษะ การวางแผนเพื่ออนาคต แสวงหาความรู้อย่างต่อเนื่อง กระตุ้นให้เกิดความคิดสร้างสรรค์ การแลกเปลี่ยนเรียนรู้ เป็นผู้นำการเปลี่ยนแปลง การมีอิทธิพลอย่างมีอุดมการณ์ การสร้างแรงบันดาลใจ การกระตุ้นทางปัญญา และการ คำนึงถึงความเป็นปัจเจกบุคคล 2) ด้านความรู้และทักษะ มีทักษะทางเทคโนโลยีที่ดี จัดการข้อมูลสารสนเทศ และ ใช้สื่อสังคมออนไลน์เพื่อการศึกษา มีทักษะการจัดองค์กร มีความรู้และทักษะในภาระงาน นิเทศ ติดตาม และเยี่ยม ชั้นเรียนสม่ำเสมอ และสามารถบริหารจัดการความขัดแย้งได้ดี 3) ด้านบุคลิกภาพ มีความฉลาดทางอารมณ์ น่าเชื่อ ถือศรัทธา กระทำตนเป็นแบบอย่าง มีความเป็นผู้นำ มีเจตคติที่ดีต่อการทำงาน ยืดหยุ่นปรับตัวได้อย่างเหมาะสม 4) ด้านคุณธรรมจริยธรรม ปฏิบัติตนตามหลักคุณธรรมจริยธรรมและบรรทัดฐานที่ดีของสังคม รวมทั้งมาตรฐานและจรรยา บรรณวิชาชีพครู คำนึงถึงประโยชน์ส่วนรวม มีจิตสาธารณะ มีความรับผิดชอบต่อตนเองและสังคม ทำงานยึดหลัก กฎหมาย แนวปฏิบัติของทางราชการ มีความคิดทัศนคติและจินตนาการเชิงบวก มีความยุติธรรม คำนึงถึงการอยู่ร่วมกันอย่างมีความสขุ 5) ด้านการจัดการเรียนรู้ให้ความสำคัญกับผู้เรียนสูงสุด จัดกิจกรรมที่หลากหลาย มีทักษะอำนวย การวางแผน และดำเนินงานให้สำเร็จ บริหารหลักสูตรสอดคล้องกับสภาพผู้เรียนชุมชน และท้องถิ่น มีความรู้และทักษะ ในการพัฒนาครู ส่งเสริมวัฒนธรรมการเรียนรู้ตลอดชีวิต ฝึกปฏิบัตินักเรียนให้มีพื้นฐานจิตใจที่ดีนำไปสู่การเรียนรู้ที่มี คุณภาพ นำสื่อ นวัตกรรม เทคโนโลยีใหม่ ๆ มาใช้ในการเรียนรู้ 6) ด้านการพัฒนาทีมงาน มีมนุษยสัมพันธ์ที่ดี มีทักษะการสื่อสาร มีกลยุทธ์การสร้างทีมงาน มีความเป็นประชาธิปไตย มีกลวิธีจัดการกับงานและเพื่อนร่วมงานที่ดี และมีกระบวนการปลูกฝังภาวะผู้นำ และ 7) ด้านการพัฒนาชุมชนและการมีส่วนร่วม มีศักยภาพเข้าใจบริบทของชุมชน สร้างความสัมพันธ์กับชุมชนอย่างเป็นระบบ มีเทคนิคการระดมทรัพยากรทางการศึกษา จัดกิจกรรมที่ตอบสนอง ต่อความสนใจและความต้องการของชุมชนให้บริการทางสังคมได้อย่างมีประสิทธิภาพ2. ผลกระทบที่เกิดจากการภาวะผู้นำที่มีประสิทธิผลของผู้บริหารในโรงเรียนดีเด่น ประกอบด้วย 1) ผลกระทบ เชิงบวก (1) ด้านนักเรียน พบว่า มีวัฒนธรรมการเรียนรู้ตลอดชีวิต มีระเบียบวินัย มีจิตสาธารณะ รักความเป็นไทย สุภาพเรียบร้อย สามัคคี มุ่งมั่นในการทำงาน ใฝ่เรียนรู้ มีสุขภาพกายสุขภาพจิตที่ดี อยู่ร่วมกัน บนความแตกต่างทางวัฒนธรรม (2) ด้านผู้บริหารครูและบุคลากร พบว่า มีความพึงพอใจในงาน มีความก้าวหน้า ในวิชาชีพ การเป็นแบบอย่างที่ดี การทำงานเป็นทีม มีความสุขในการทำงานมีความสำเร็จในการพัฒนาวิชาชีพ ครู และการเป็นบุคคลแห่งการเรียนรู้ (3) ด้านโรงเรียน พบว่า โรงเรียนมีชื่อเสียงเป็นต้นแบบของนวัตกรรม ทางการศึกษา ต้นแบบคุณธรรมนำ ความรู้ องค์กรแห่งการเรียนรู้ ศูนย์กลางการบริการประชาชน และโรงเรียน สุจริต (4) ด้านผู้ปกครองและชุมชน พบว่า มีความพึงพอใจ ความรู้สึกรับผิดชอบร่วมกันระหว่างบ้านวัดและ โรงเรียน ตอบสนองความต้องการของชุมชน 2) ผลกระทบเชิงลบ (1) ด้านนักเรียน พบว่า ภาระความรับผิดชอบ ของผู้นำ นักเรียนเพิ่มขึ้น ทำ ให้ไม่มีเวลาร่วมกิจกรรมอื่น ๆ ของโรงเรียนส่งผลให้บางคนมีทักษะทางกีฬา ทักษะ ทางศิลปะและดนตรีน้อย บางส่วนขาดทักษะด้านมนุษยสัมพันธ์ นักเรียนนอกเขตบริการมีเวลาอยู่กับครอบครัว น้อยลง (2) ด้านผู้บริหาร ครู และบุคลากร พบว่า ครูไม่ได้สอนเต็มเวลา มีภาระความรับผิดชอบต่องานและภาระ การบริหารจัดการชั้นเรียนเพิ่มขึ้น เกิดความเครียด ผู้บริหารมีเวลาบริหารจัดการโรงเรียนน้อยลง มีปัญหาในการ บริหารจัดการทีมงาน (3) ด้านโรงเรียน พบว่า มีภาระทางงบประมาณเพิ่มขึ้น ความจำ เป็นในการคงสภาพของ โรงเรียน มีภาระในการบริการชุมชน การติดตามตรวจสอบงบประมาณ และการบริหารจัดการการเงินบัญชี และ พัสดุมีปริมาณเพิ่มขึ้น (4) ด้านผู้ปกครองและชุมชน พบว่า การมีทัศนคติเชิงลบกับการระดมทรัพยากร เยาวชน บางส่วนใช้สื่อ เทคโนโลยีในทางที่ไม่เหมาะสม การมีกฎเกณฑ์ ระเบียบในชุมชนเพิ่มขึ้น และค่าใช้จ่ายเพิ่มขึ้น The Effective Leadership of Outstanding School Adminnistrators : Multi – Case Studies.Surachit Piungam1) Watana Suwannatrai2) Sawat Pothiwat3) and Somkiat Palajit4)1) Department of Leadership in Educational Administration, Faculty of Education, Sakon Nakhon Rajabhat University2,),3) Asst. Three schools under the offices of primary educational service area in the Northeast consisting of: a small school, a medium-sized school and a large school. Data were collected by the researcher through in-depth interviews, observation and recording, document analysis, focus group through key personnel in schools and those concerned, The triangular technique was employed to confirm reliability and validity of data from sources and types of data to be reliable.The findings were as follows:1. The characteristics of effective leadership on: 1) Vision included obtaining skills, future planning, searching for continuous knowledge, motivating creative thinking, exchanging knowledge and skills, change agent, idealized influence, inspirational motivation, intellectual stimulation, individualized consideration, 2) Knowledge and skills, good skills on technology, managing information communications and technology ,applying online media for education, obtaining skills on organizational management, obtaining skills on managerial management, gaining knowledge on job performance, supervision, monitoring regular visiting of classroom as well as being able to manage conflict. 3) Personality comprised obtaining emotional quotient, being respectable, being a model for others, owning leadership, having good attitudes toward job, being flexible and adjustable. 4) Morality consisted of behaving in accordance with moral and ethical principles and decent norms of society as well as standards and code of conduct on teaching profession, being aware of collaborative benefits, obtaining public-mindedness, obtaining responsibilities to self and society, working stuck up to laws, regulations, and guidelines of civil service, owning negative attitudes and imagination, obtaining justice with caring for collaborative happy living, 5) Learning management included paying ultimate attention to learners to live happily, conducting diverse activities, owning managerial skills, planning, and performing to achieve the goals set, managing the curriculum consistently with the learners, communities and localities, obtaining knowledge to for professional development of teacher, promote cultures of lifelong learning, training students to gain good mind leading to quality learning, applying modern media, innovation, technologies in learning. 6) Teamwork development comprised obtaining good human relationship, skills and communications, strategies on effective teamwork building, being democratic, obtaining strategies on job management and colleague management as well as owning process on embedding leadership. 7) Community and participation included obtaining potential in understanding the community context, building relationship with the communities systematically, owning techniques in mobilizing educational resources, conducting activities to meet the interests and needs of the communities as well as servicing the communities with effectiveness.2. The effects originated from the effective leadership of the school administrators comprised: 1) On positive effect (1) On students : obtaining lifelong cultures, disciplines, public-mindedness, Thainess, decent behaviors, striving to working, eagerness for learning, good health both physical and mental health, living on differences of cultures. (2) On admininistrators, teachers and personnel : obtaining job satisfaction, professional advancement, being a good model, teamwork, happiness in working, achievements in developing teaching profession, being a person of learning. (3) On school : being place of fame, being a modelon educational innovation, being a model in morality leading knowledge and learning organization, (4) On parents guardians and communities: obtaining satisfaction responsibilities among homes temples and schools and meet the needs of the communities 2) On negative effect (1) On students : more responsibilities for student leader, lack of time for school extra activities, art and music, some students with lack of human relationship skills, those living out of the service areas having less time spent with families. (2) On adminnistrators, Teachers and personnel: teachers did not teach at the full load, working loads of increasing classroom management, administrators spending less time in the schools, more responsibilities and frustration, on management of teamwork. (3) On school : task on budgeting, retention of school status, workload of community service, increasing monitoring on budget, management of finance, accountancy and procurement, (4) On parents, guardians and communities: obtaining negative attitudes on resource mobility, some young people obtaining undesirable behaviors on using media and technology, obtaining more regulations, and orders in the communities, and increasing expenses as well.
Organ and tissue donation is a societal issue that demands the positive engagement of all stakeholders in civil society for its successful implementation and for achieving its goal of allowing "more lives to be saved and improve the quality of others"1 The publication of a White Paper and the launching of a public consultation, before legislating on the matter, can actually motivate individuals, associations and institutions to look at the current practice and see what is at stake and what is the reasonable way forward to improve it. The Government's initiative is a major step forward especially as it sets to regulate a practice that has been carried out in Malta for many years. The objective of the whole exercise is certainly good, since an adequate supply of tissues and especially organs will make a big difference to people who need them to stay alive or to improve the quality of their life. This position paper, which has been prepared at the request of the Maltese Episcopal Conference by a group that includes experts in the field of clinical medicine, psychology, philosophy and theology, is a response to the Government's call to all stakeholders in society to participate in the development and formulation of a healthcare policy on organ and tissue donation. The paper contains the following five sections: 1. The Current Policy: The current practice of organ and tissue procurement compares very well with that of other EU Member States. According to a recent study, Malta places second in the EU for organ donation. Moreover, statistical information shows that the present system is functioning well and, accordingly, provides a sound basis for further development. Therefore, a new legislative framework should improve rather than overhaul the current system. 2. Organ Donation as an Act of Giving: A person's decision to donate his/her organs should always be an expression of uncompelled generosity and altruism since it is an act of giving. One cannot receive a gift from the other if the other has not freely consented to the giving. Without that free consent, the practice becomes taking and getting rather than giving and receiving organs. Since the first successful transplant procedure in the early fifties, the Catholic Church has explicitly supported both living organ donation and the procurement of organs from the dead. Organ donation is justified by the principles of charity and solidarity. The system that safeguards the dimension of gift in the act of organ donation is the opt-in system. On the contrary, the opt-out system precludes the person from expressing freely his/her decision to donate his/her tissues and organs, thus undermining the dimension of gift that requires the explicit and free informed consent of the human person. In an opt-out system there is the risk that what should be considered as a "donation" loses its significance as an act of giving and can also be interpreted as lacking in the respect (pietas) that the living ought to give to the deceased. 3. Ethical Issues: The paper raises the following five ethical issues: i) The paradigm of ownership used in both the opt-in system and the opt-out system is inadequate since the body is neither the property of the individual nor that of the State. The body is rather the mode in which we are present to each other and communicate with each other. ii) Tissue and organ donations from living persons may be justified solely for therapeutic reasons, taking into account various clinical factors as specified by the Oviedo Convention, such as urgency, the probability of successful transplant surgery given the patient's condition, the prospect that the organ will thrive and the order of priority of the request. iii) The commercialization of the human body is against the human dignity and integrity of the human person. Financial remuneration should therefore be prohibited. vi) The ethical principles framed by the Live Organ Transplant Advisory Committee (LOTAC) – to which the White Paper refers – should form part of the criteria of live organ transplants. v) The allocation of organs should be based on distributive justice. Clear guidelines should be drawn up with regard to eligibility and relative need of patients on renal replacement therapy. 4. Concerns: The following five concerns are raised: i) An opt-out system distorts the nature of organ donation as a gift and may create fear in peoples' mind on perceiving that the State is taking ownership rights over their bodies. ii) The criteria to ascertain the death of a human person must be clear. . The brain death principle, to be understood as the death of the whole brain (brain and brain stem), is by far (according to medical and scientific knowledge to date), the most adequate to determine the death of a human person since the complete and irreversible loss of all the functions of the brain and brain stem mark the end of the person's life as a living organism. iii) The practice of retrieving organs from non-hearth beating bodies raises the ethical issue of when to withdraw artificial respiratory support. iv) The issue of the age threshold of consent to register as organ donors requires more thought. The proposal that twelve-year-olds should be considered legally competent to become an organ or tissue donor is not in line with psychological findings and does not reflect legal provisions in Malta on matter related to minors. v) The harvesting of organs from anencephalic newborns raises a serious ethical issue concerning the applicability of brain-death criteria. 5. Recommendations: The concept of organ donation, being a voluntary gift, must be retained and protected. Thus, the new legislation should strengthen the opt-in system. The document offers the following set of recommendations that spell out the measures that need to be taken: i) to promote the opt-in system ii) to manage it more effectively iii) to ensure an on-going review. ; non peer-reviewed
Effective judicial protection and due process of law are fundamental rights which are collected by the State Political Constitution. This means, that any person has the right to have justice done when it goes to court through a process, where we provide a set of rights and guarantees in its development, and that the decision is effective. Within the content of due process has the plurality of instances, which is accessed through the impugned resources that afforded us by the procedural system.The parties may request, or the court of its own motion may clarify the obscure concepts or correct material errors, numerical and spelling mistakes that may exist in the decisions they make. Similarly, the parties may ask the judge to complete (integrated) resolution in respect of controversial issues unresolved in the judgment.Our Civil Procedure Code regulates the issue of clarification, through two specific items: 406 and 407. The first regulates the clarification itself, and the second, the correction of judicial decisions. The clarification contains only one supposed, and is related to the presence of some obscure or dubious concept. While correcting of judicial decision includes: materials, numerical, spelling and also the possibility of complete resolution with a controversial issue unresolved errors in judgment.The deadlines for clarification and correction of judicial decisions are the same to file impugned resources. As such, it may not restrict the fundamental right of the defendant to use another instance to review the judicial decision, whether clarification or correction thereof is pending. The reasonable and sensible, to assert the right to file impugned resources is made within the framework of freedom, security and full knowledge of the judgment to be questioned, is that first the clarification and correction are resolved. In that sense, the deadline for filing the appeal should run from the date of notification of the decision or denies access and correction requested clarification.The arguments used to justify a decision regarding the deadline for filing the appeal in court seat, are perfectly valid to justify the same solution in the case of administrative decisions and arbitral awards. Accompanied by our Arbitration Law, Legislative Decree No. 1071, Article 58, that expressly regulates the issue of clarification and correction of arbitral award, establishing time limits applicable to answer them and to the arbitral tribunal to resolve them. And in Article 64, when it refers to the annulment process, says that the action for annulment brought before the competent Superior Court within twenty (20) days following the notification of the award days. When is sought rectification, interpretation, integration or exclusion of the award had been made or initiated by the arbitral tribunal, the appeal must be filed within twenty (20) days of notification of the final decision on these issues, or the expiration of the term to solve without the arbitral tribunal has ruled. ; La tutela jurisdiccional efectiva y el debido proceso, son derechos fundamentales que están recogidos por la Constitución Política del Estado. Significa ello, que todo justiciable tiene el derecho a que se le haga justicia, cuando acude al órgano jurisdiccional, a través de un proceso, donde se le brinden un conjunto de derechos y garantías en su desarrollo y que lo resuelto sea efectivo.Dentro del contenido del debido proceso tenemos la pluralidad de instancias, que se accede a través de los recursos impugnatorios que nos brinda el sistema procesal.Las partes pueden solicitar, o de oficio el juez puede aclarar los conceptos oscuros o corregir los errores materiales, numéricos y ortográficos que pudieran existir en las resoluciones que emiten. Igualmente, las partes pueden solicitar al Juez que complete (integre) la resolución respecto de puntos controvertidos no resueltos en la sentencia.Nuestro Código Procesal regula el tema de la aclaración, a través de dos artículos específicos, 406 y 407, regulando en el primero, la aclaración propiamente dicha y en el segundo, la corrección de la resolución. La aclaración, contiene un único supuesto y es el relativo a la presencia de algún concepto oscuro o dudoso; mientras que en la corrección existen los supuestos de corrección de errores materiales, numéricos, ortográficos y, además, la posibilidad de completar la resolución con algún punto controvertido no resuelto en la sentencia.Los plazos para la aclaración y corrección de resoluciones, son los mismos que rigen para los recursos de impugnación. Siendo así, no se podría limitar el derecho fundamental que tiene el justiciable para recurrir a otra instancia a que se revise la decisión, si es que está pendiente la aclaración o corrección de la misma. Lo razonable y sensato, para que el derecho a impugnar lo haga valer en el marco de libertad, garantía y de conocimiento cabal de la resolución que se va a cuestionar, es que primero se resuelva la aclaración y corrección. En ese sentido, el plazo para interponer el recurso de impugnación debe correr a partir de la fecha de notificación de la resolución que accede o deniega la aclaración y corrección solicitadas. Los argumentos esgrimidos para justificar una decisión respecto del plazo para interponer el recurso de impugnación en sede jurisdiccional, son perfectamente válidos para justificar la misma solución tratándose de resoluciones administrativas y de laudos arbitrales. Con la atingencia que nuestra la Ley de Arbitraje, Decreto Legislativo Nº 1071, en el artículo 58 regula expresamente el tema de la aclaración y corrección de los laudos, estableciendo plazos para interponerlos, para contestarlos y para que el tribunal arbitral los resuelva; y, en el artículo 64, cuando se refiere al trámite del recurso de anulación, señala que el recurso de anulación se interpone ante la Corte Superior competente dentro de los veinte (20) días siguientes a la notificación del laudo. Cuando se hubiere solicitado la rectificación, interpretación, integración o exclusión del laudo o se hubiese efectuado por iniciativa del tribunal arbitral, el recurso de apelación deberá interponerse dentro de los veinte (20) días de notificada la última decisión sobre estas cuestiones o de transcurrido el plazo para resolverlos, sin que el tribunal arbitral se haya pronunciado.
