ABSTRACT This article introduces the Brazilian experience of fighting corruption through specialized courts, presenting their creation, main characteristics, and convergences and divergences in comparison with the well-known case of the specialized court of Indonesia. The study proposes an analytical model of the specialized anti-corruption courts' institutional design. It adopts a qualitative approach using content analysis based on reports issued by multilateral agencies, legislative and judicial documents, and interviews. While in Brazil, specialized courts receive great notoriety and resources, in Indonesia, courts are neglected in terms of financial and human resources, recruitment, supervision, and support. Different from Indonesia, the process of creating specialized courts was endogenous in Brazil, controlled and conducted by members of the judiciary in courts and lobbying other government branches. The internal movement around the policies to address corruption and the direct connection between judges and international organizations led to the executive's support and legislation change in Congress.

International audience ; À l'heure où les métropoles sont dans un tourbillon de rapports de forces, de contradictions et d'innovations, nous faisons l'hypothèse que ce sont d'abord les capacités de médiation politique et de régulation publique qui sont mises à l'épreuve et qui constituent la grande promesse des concordes à venir. Les « médiateurs » du moment métropolitain sont les acteurs en capacité d'incarner et de formuler les représentations d'un futur partagé. Ce sont des réformateurs au sens social-démocrate : ils transforment les défis collectifs en politiques publiques autour de compromis responsables. Nous plaidons pour que cette conception du dialogue social, qui donne aux « corps intermédiaires » une place délibérative cardinale, regagne l'agenda des métropoles sur trois enjeux en particulier : la complexité des politiques publiques à mettre en partage, l'extrême diversité des acteurs qui font l'effervescence métropolitaine, enfin l'interterritorialité conflictuelle et dynamique qui relie les pouvoirs locaux entre eux.

This research focuses on a positive, and previously largely unknown, implication of United Nations (UN) peacekeeping: better environmental quality. While maintaining international peace and security remains the main goal of peacekeeping operations, we contend that they can also be linked to environmentally friendly outcomes. Mission mandates and UN policies increasingly comprise actions that potentially promote environmental quality. At the same time, positive side effects on the environment materialize due to the cooperation with and activities of other UN bodies. The empirical analyses, also correcting for the likely non-random assignment of peace missions and employing several alternative outcome measures, suggest that UN peace missions are indeed substantively associated with better environmental quality. This research has important implications for our understanding of peacekeeping operations, and it contributes to the literatures on the (unintended) consequences of peacekeeping as well as environmental politics.

Seit 1999 existiert das MIL-HDBK 1823, die us-amerikanische Leitfaden zur Erstellung einer Probability of Detection (POD; Fehlerdetektionswahrscheinlichkeit). Obwohl das Dokument als internationaler Stand der Technik angesehen wird, ist die allgemeine Anwendung in der ZfP-Praxis von einigen Nachteilen begleitet: 1. Die beschriebenen POD's bilden ausschließlich die Grundlagen-POD ab, jeweils mit nur einem Fehlerparameter und einem Signalparameter. Modernere Ansätze werden hier nicht adressiert. 2. Die aktuelle Version verzichtet fast vollständig auf konkrete mathematische Formulierungen. 3. Die Richtlinie richtet sich hauptsächlich an die militärische Luftfahrt. 4. Das Dokument ist nur in englischer Sprache verfügbar. Mit Hilfe eines BMWi-Förderprojekts wird ein weiterführendes Regelwerk auf Basis der MIL-HDBK 1823 unter deutscher Federführung erarbeitet, welches die Anwendung der POD-Berechnung auf eine breitere Basis stellt und die oben genannten Nachteile der MIL-HDBK 1823 behebt. Das vorgestellte Projekt "normPOD" wird eine normative, branchenübergreifend einsetzbare Beschreibung des Vorgehens bei der Berechnung einer POD zur Zuverlässigkeitsbewertung zerstörungsfreier Prüfungen entwickeln. Hierbei wird Klarheit über unterschiedliche POD-Ansätze geschaffen und anhand praktischer Beispiele aus Maschinenbau und Bauwesen ein Leitfaden für den Praxiseinsatz erarbeitet. Das Poster gibt einen Überblick über die geplanten Arbeiten innerhalb des Projekts und lädt die Beteiligten der DGZfP-Jahrestagung zur Diskussion ein, um eine breite Basis und Akzeptanz für die entwickelten Berechnungsverfahren zu schaffen, insbesondere in Hinblick auf ZfP 4.0 und Digitalisierung.

The Interfriches network - carried by an interdisciplinary collective - was created in 2019 to bring together human, social and environmental scientists and practitioners on the common object of urban wastelands. Involving architects, geographers, urban planners, ecologists, sociologists, politicians, artists, it seeks to reflect on the role of wastelands in the making of the city in different contexts. Based on a workshop on a third place (i.e. a place of social bonding, emancipation and collective initiatives) in the suburban Paris, this paper puts collective methodological questioning into dialogue. What does an interdisciplinary workshop including collective surveys allow to capture about an occupied urban wasteland? We aim to make a reflexive analysis of the frameworks and limits of this commoning experience."

La reconnaissance faciale, par exemple, est très utilisée et acceptée dans les pays d'Asie-Pacifique, moyennement acceptée en Europe et plutôt rejetée aux Etats-Unis ou plusieurs villes et états l'interdisent.Dans cet article, nous proposons une réflexion sur quelques-unes de ces nouvelles technologies (reconnaissance faciale, objets connectés), leur utilisation, l'acceptabilité des utilisateurs (bénéfices et craintes suscités), le respect de l'éthique et de l'intimité des individus et comment les préserver.

In late imperial Russia, peasants were placed in an extremely difficult situation. The terms of the 1861 Emancipation had left them short of land and highly indebted to the government. Their rate of population growth was extremely high, and as Russia entered the demographic transition, it increased even more. The government was intent on a policy of rapid industrialization, which was ultimately to be paid for by large grain exports. This already strained situation was further complicated by three additional factors. Both the changing level of international grain prices and the weather-induced fluctuations in grain yields were external factors capable of applying severe shocks to the peasantry, and little could be done to affect their impact. The third factor was the effectiveness of the tsarist administrative machin-ery for levying taxes on the peasants and providing them with relief (Wheatcroft 1991: 128). © 2021 'Uchitel' Publishing House.

International audience ; Les fuites de données au repos sont malheureusement courantes et en augmentation, entrainant des pertes de profits pour les entreprises ou le non-respect de confidentialité de données personnelles sensibles. La récente montée en puissance des micro-services, en tant que paradigme de déploiement extensible, impose également la sécurisation du trafic. Un processus métier peut être modélisé sous la forme d'un workflow : le propriétaire des données interagit avec des sous-traitants pour réaliser une séquence de tâches. Dans cet article, nous montrons comment ces workflows peuvent être appliqués tout en limitant l'exposition des données. En suivant les principes du zero-trust, nous proposons une infrastructure utilisant l'isolation fournie par les micro-services pour mettre en oeuvre un workflow, dans une preuve de concept disponible en ligne. Nous vérifions ensuite que les politiques de sécurité sont correctement appliquées, et estimons le coût supplémentaire induit par les dispositifs de sécurité.

In the summer of 2017, the young group Arran coordinated a series of protests in Barcelona and other Spanish cities to denounce the negative effects of global mass tourism. These acts of dissent fueled a heated public debate in both Spanish and international press, mainly due to the 'radical' tactics employed by the demonstrators. Following the narratives about these protest acts across a diversity of media outlets, this article identifies the complex power struggles between the different actors involved in the discussion on the benefits and externalities of global mass tourism, offering an extensive analysis of the political uses of the term 'turismofobia' (tourismphobia) and a revisited interpretation of the notion of the 'protest paradigm'. This qualitative analysis was based on more than 700 media texts (including news articles, op eds and editorials) collected through the database Factiva, from January 2014 to December 2017.

Small states are on the edge of the fault lines of the ripples and shake-up of the liberal order, which was the anchor to multilateralism, influence in global institutions, and the free flow of goods, capital and data. In this post-hegemonic cycle of international relations, geo-strategic choices facing small states are blurred, and diplomacy must be practised during a period of flux in power relations and a changing political geography among nations. This trend has been accentuated by the coronavirus (COVID-19) pandemic, changing the development and political landscapes more dramatically, as well as shifting the geo-strategic options open to all countries, but extremely limited to small states. Die vorliegende Studie untersucht die Auswirkungen der Umsetzung Schweizer Kartellpolitik bzw. der Entscheidungen der Schweizer Wettbewerbskommission auf die Aktienrenditen der davon betroffenen Unternehmen. Über einen Zeitraum von mehr als 20 Jahren entschied die Schweizer Wettbewerbskommission in über 130 Fällen, die knapp 500 Parteien involvierten. Vorliegend wurden ausschliesslich börsenkotierte Unternehmen oder gegebenenfalls Unternehmen mit börsenkotierten Muttergesellschaften untersucht. Die analysierte Stichprobe umfasst 31 börsenkotierte Unternehmen in 50 Entscheiden (d.h. n = 50). Eine negative Bewertung des Ereignisses wird die Rendite, also den erwarteten Ertrag, den ein angelegtes Kapital in einem bestimmten Zeitraum erbringt, negativ beeinflussen. Am Entscheidungstag der WEKO liegt die abnormale Rendite bei 0.06 Prozent für alle Unternehmen. Über ein Fenster von zwanzig Tagen (–10,10) beträgt sie –0.63 Prozent. Separiert man den Entscheidungstyp und kontrolliert folglich für Entscheide, die negativ sind (d.h. Verhaltensänderungen [mit Sanktionen]), sieht man eine negative Rendite, die bei –0.3 Prozent am dritten und am achten Tag vor der Entscheidung liegt. Im Gegensatz zu vergleichbaren Studien in den USA und Europa erkennt man relativ niedrige negative Renditen auch bei Entscheidungen zur Veränderung. Generell stellt sich hinsichtlich der eher geringen Veränderung der Bewertung des Aktienmarkts die Frage, ob Investoren keine Veränderung des Verhaltens nach negativen Entscheiden erwarten, Sanktionen zu niedrig sind, um abschreckend zu wirken, ob der Schweizer Markt zu klein ist, um international Anerkennung in Aktienmarktbewertungen zu finden oder ob Entscheide vollumfänglich antizipiert werden.

This article traces a transition in the aspirations of social justice on global scale. The 'welfare world' vision of global justice, as it was captured most prominently by the proposals for a New International Economic Order in the mid-1970s, is contrasted with the contemporary ambitions of 'supply chain ethics', which seek to infuse transnational corporations with social responsibilities. These visions differ drastically in their ambitions, their epistemologies, and the role they reserve for the state but share a structural outlook on issues of social justice. Following the theme of the Special Issue, the shortcomings and the potential of the current supply chain ethics agenda in addressing the 'human problems' associated with corporate irresponsibility are reviewed. The paper suggests that mediating between structure and agency in a way that recontextualises the democratic principle is necessary to challenge power asymmetries in global regimes of production.

Article 234 is exceptional regarding its wording and placement in the United Nations Convention on the Law of the Sea (UNCLOS), as well as in its historical background. The Arctic provision has given rise to divergent interpretations regarding the conditions for invoking it, the limitations on the authority under Article 234, and its spatial scope of application. It has served as a justification for specific legislation adopted by Canada and Russia that has been opposed by the United States. The article, describes as a "textbook example of finding a compromise in international treaty negotiations," was negotiated directly and privately, among these three states during the Third United Nations Conference on the Law of the Sea (UNCLOS III). This article describes the historical background to Article 234 and sheds new light on the negotiating process that led to the adoption of the provision.

The People's Republic of China ('China') has adopted legislation threatening to invade the Republic of China ('Taiwan') if the latter declares independence. Threats of force are prohibited by the UN Charter Article 2(4) and equivalent customary international law. This article proceeds along two apparently contradictory strands. On the one hand, the prohibition probably does not apply to non-State entities such as the Republic of China. One the other hand, the ICJ stated in the Nuclear Weapons opinion that 'if the use of force itself in a given case is illegal […] the threat to use such force will likewise be illegal'. If the Republic of China declares independence it will become a State, making a PRC invasion illegal. Therefore, the PRC's current threats should also be illegal. The best way to resolve this apparent paradox is to say that the ICJ's 'Nuclear Weapons principle' must be nuanced.
