A CRITICAL REEXAMINATION OF PREVALENT ASSUMPTIONS IN INTERNATIONAL LITERATURE IS PRESENTED. THE TRADITIONAL MODEL OF THE INTERSTATE SYSTEM, WHICH GIVES THE NATIONSTATE A PROMINENT PLACE AS ACTOR & UNIT OF ANALYSIS & CONCEIVES OF THE INTERNATIONAL SYSTEM AS A COLLECTIVITY OF STATES AIMING AT EQUILIBRIUM, HAS BEEN GENERALLY ACCEPTED BY SCHOLARS (IE BALANCE OF POWER THEORY). DEVELOPMENTS IN INTERNATIONAL REALITY SEEM TO CONTRADICT THESE ASSUMPTIONS. THEY ARE SUMMARIZED IN THE CONCEPTS OF THE 'NUCLEAR AGE' & THE 'TRANSNATIONAL SYSTEM' & COMBINED IN THE NOTION OF INTERDEPENDENCE CHARACTERIZING THE PRESENT INTERNATIONAL SYSTEM. THESE DEVELOPMENTS POINT TO THE INCREASING CONVERGENCE OF RATIONAL & INTERNATIONAL POLITICS. IN RECENT INTERNATIONAL RELATIONS LITERATURE, THE TRADITIONAL HORIZONTAL, TERRITORIALLY-BASED ORGANIZATION OF THE POLITICAL PROCESS IS CONTRASTED WITH ITS INCREASINGLY VERTICAL, TRANSNATIONAL CHARACTER, WHILE AT THE SAME TIME THE EQUILIBRIUM MODEL OF INTERNATIONAL POLITICS IS SUPERSEDED BY A VIEW OF THE INTERNATIONAL SYSTEM BASED ON RELATIONS OF DOMINANCE & SUPREMACY. THESE NEW INSIGHTS ARE COMBINED IN A MODEL OF A WORLD POLITICAL SYSTEM THAT IS GLOBAL IN ITS GEOGRAPHICAL DIMENSION. HA.

Since the birth of Louise Brown in 1978, the first human baby resulting from in vitro fertilisation (IVF), developments in reproductive medicine have opened up new opportunities to solve problems related to sterility/infertility and to avoid the transmission of serious genetic diseases to offspring. This article evaluates some challenges to human rights protection arising from medically assisted procreation (MAP), with particular reference to artificial insemination from a donor (AID) and preimplantation genetic diagnosis (PGD). It analyses the regulation of MAP at the international, regional and domestic level. Specific attention is paid to two landmark judgments of the European Court of Human Rights (ECtHR) on MAP (S.H. v. Austria and Costa and Pavan v. Italy), with a special focus on the interpretation of the concept of family and private life contained therein and on the effects of the ECtHR rulings on the Italian legal order. It concludes that national legislation concerning MAP should be minimal, i.e. should afford substantial freedom and autonomy to the couples in their procreative choices, in accordance with their right to respect for private and family life.

Im Fokus der meisten Publikationen zum internationalen Terrorismus stehen Menschenrechtsfragen (gezielte Tötungen, Gefangenenlager, Terrorlisten, Folter, Datenschutz, Einschränkung von Freiheitsrechten etc.). Umfassend untersucht sind also die (negativen) Folgen der Terrorismusbekämpfung. Der vorliegende Band, der auf eine Ringvorlesung des Walther-Schücking-Instituts für Internationales Recht an der Christian-Albrechts-Universität zu Kiel 2015/2016 zurückgeht, ergänzt diese wichtige Debatte und analysiert den Schritt davor. Im Zentrum steht die Frage nach der Effektivität der völker- und europarechtlichen Instrumente zur Terrorismusbekämpfung. Nach der Klärung von Grundfragen werden die existierenden Instrumente aufgearbeitet und daraufhin untersucht, ob sie (noch) geeignet sind, um den modernen Terrorismus des 21. Jahrhunderts zu bekämpfen. Im Ergebnis zeigt sich ein gemischtes Bild: Trotz teils umfassender Normierung bleibt Raum für zum Teil erhebliche Verbesserungen. »The Fight against Terrorism by Means of Public International and European Union Law« Most publications on the fight against international terrorism concentrate on its negative impacts, especially on its consequences for human rights protection. The present volume complements these important debates by asking a different question: Are the existing means of public international and European Union law effective and appropriate to fight the modern forms of terrorism in the 21st century? Sind diese (noch) geeignet, um den modernen Terrorismus des 21. Jahrhunderts wirksam zu bekämpfen? Kerstin von der Decken (née Odendahl) is Professor for Public Law, Public International and European Law as well as Director of the Walther Schücking Institute for International Law. From October 2004 to January 2011, she held the Chair of Public International and European Law at the University of St. Gallen (Switzerland). She was elected member of the Academy of Sciences and Humanities in Hamburg in 2015. From July 2016 until June 2018 she was Dean of the Law School of the University of Kiel. Her main areas of research are International Cultural Heritage Law, International Human Rights, International Dispute Settlement, International Environmental Law, and International Peace and Security. Prof. Dr. Kerstin von der Decken (geb. Odendahl) ist Inhaberin des Lehrstuhls für Öffentliches Recht mit Schwerpunkt Völkerrecht, Europarecht und Allgemeine Staatslehre an der Universität Kiel sowie Geschäftsführende Direktorin des Walther-Schücking-Instituts für Internationales Recht. Davor war sie von 2004 bis 2011 Professorin für Völker- und Europarecht an der Universität St. Gallen, Schweiz. Ihre Forschungsschwerpunkte liegen bei den Grundlagen des Völker- und Europarechts sowie dem internationalen Umwelt,- Kultur- und Sicherheitsrecht.
