Internationale Schiedsgerichte können auf inhärente Befugnisse zurückgreifen, soweit dies zur Realisierung gerichtlicher Kernfunktionen unbedingt erforderlich ist. Davon kann auch eine Befugnis zur Wiederbefassung mit Teilentscheidungen (reconsideration of partial decisions) erfasst sein. Es werden die Rechtsqualität und Wirkungen von Teilentscheidungen, die nach einer bifurcation ergehen, eingehend erörtert und vorgeschlagen, das Verhältnismäßigkeitsprinzip zur Herleitung konkreter inhärenter Befugnisse heranzuziehen. Ein Kapitel widmet sich der besonderen Problematik von Teilentscheidungen unter der ICSID Convention und den ICSID Arbitration Rules und zeigt Möglichkeiten zur Wiederbefassung (reconsideration) nach Maßgabe dieser Regelwerke auf.

Background: Major host countries of international students such as Australia, Canada, New Zealand, the UK, and the US have introduced post-study work rights as a strategic policy to both enhance their destination attraction and support international students' post-graduation work experiences. While this policy is generally welcomed by both host institutions and international students, little is known about the support mechanism for the growing cohort of international student graduates who stay in their countries of study on temporary graduate visas, especially in relation to major concerns such as post-graduation work, visa application, and migration pathways. Objective: This article fills an important gap in the existing literature. It aims to assess the role of universities in supporting their international alumni on temporary visas. Research Design: It is derived from a study that includes 50 interviews with university staff, agents, and international graduates. It uses positioning theory as a conceptual framework. Results: The findings of the study raise concerns about the scope of university advice. It reports loopholes which legitimize the practices of migration agents to the conditions that enable them to exercise their exclusive rights in providing work-migration nexus advice to international students and graduates, making this cohort vulnerable to exploitation of unethical agents. The study provides the evidence base to develop recommendations for related stakeholders in improving the post-graduation experiences of international student graduates who remain in the host countries on temporary visas.

In 1908 the second volume of the American Journal of International Law featured a piece by Lassa Oppenheim entitled The Science of International Law: Its Tasks and Method. Oppenheim began his article by noting, apparently with some approval, that the first volume of AJIL, stacked with articles only by Americans, had "shown to the world that America is able to foster the science of international law without being dependent upon the assistance of foreign contributors." Concerned, however, that students were "at first frequently quite helpless for want of method [and] mostly plunge into their work without a proper knowledge of the task of our science, without knowing how to make use of the assertions of authorities, and without the proper views for the valuation and appreciation of the material at hand," Oppenheim sought to bring "the task and the method of this our science into discussion in this Journal." What followed was a comprehensive exposition of his views on the purposes of international law and the methods available to lawyers and scholars for approaching the problems they face.

The United States at the dawn of the twentieth century was just beginning to comprehend the influence it could have on the international scene. It had no desire to become involved in the European power politics that had produced, in the lifetimes of many Americans then living, the Crimean War, the Franco-Prussian War and the essentially European Boer War in South Africa. Nevertheless, a distinct strain of expansionism could be found in American foreign policy. The belief was stirring in those concerned to establish a nonviolent world order that the interaction of nation-states would benefit from exposure to American values, American economic dynamism and the lessons to be drawn from the American federal experience. This belief, combined with a deep aversion to what was seen as essentially a European proclivity for settling disputes by resort to war, motivated some of the more influential participants in the American peace movement. That movement, in turn, gave birth to the American Society of International Law.

Der Ausbau erneuerbarer Energien spielt eine zentrale Rolle bei der Eindämmung des Klimawandels und kann gleichzeitig ein Element für nachhaltige wirtschaftliche Entwicklung sein. Staatliche Maßnahmen zur Förderung erneuerbarer Energien haben in einigen Ländern zu einer Veränderung der Strommärkte durch zunehmende Stromerzeugung aus erneuerbaren Energiequellen geführt. Bisher fehlen empirische Untersuchungen darüber, weshalb staatliche Eingriffe und Fördermaßnahmen in einigen Ländern erfolgreicher waren als in anderen. Im Ländervergleich ist die Wirkung von Förderprogrammen für erneuerbare Energien daher oft unklar. Neben der Veränderung nationaler Strommärkte hat der Ausbau erneuerbarer Energien zur Entwicklung eines Industriezweigs geführt, der die notwendigen Technologiekomponenten erzeugt. Während einige Länder diese Güter sehr erfolgreich produzieren und exportieren gibt es eine Debatte darüber, welchen Einfluss umweltpolitische Regulierung auf die Wettbewerbsfähigkeit der Fertigungsindustrie in einzelnen Ländern hat. Trotz der steigenden Bedeutung von erneuerbaren Energien bleiben Struktur und Ursachen des internationalen Handels mit entsprechenden Technologiegütern bisher unklar. Diese Dissertation befasst sich mit einer Reihe von Fragen in Bezug auf die Wirkung von Politikmaßnahmen zur Förderung erneuerbarer Energien. Im Fokus stehen insbesondere die Auswirkungen von Fördermaßnahmen auf den Ausbau der Erzeugungskapazität auf nationalen Märkten, sowie auf den internationalen Handel mit entsprechenden Technologiekomponenten. Mikro-ökonometrische Ansätze werden genutzt, um die Wirksamkeit von Einspeisetarifen und Renewable Portfolio Standards auf Kapazitäts- und Erzeugungsentwicklung in EU-Ländern und US-Bundesstaaten zu schätzen. Dabei werden länderspezifische Unterschiede der politischen Stringenz, Politikgestaltung und die Wirkung zusätzlicher Politiken besonders berücksichtigt. Darüber hinaus wird der internationale Handel mit Solar- und Windenergiekomponenten betrachtet. Durch eine Analyse der Exporte von OECD Ländern und China wird die Wirkung der Politik für erneuerbare Energien auf Wettbewerbsfähigkeit und damit den bilateralen Handel identifiziert. Methodisch trägt diese Dissertation zur Diskussion über die Rolle von länderspezifischen Effekten in der angewandten mikro-ökonometrischen Literatur und zur Identifizierung korrekter Schätzer unter Berücksichtigung von Null-Beobachtungen und Heteroskedastizität bei. ; Renewable energies are a critical element in containing climate change while sustaining economic development. The expanded introduction of renewable energy policies changed electricity markets due to increasing renewable electricity capacity and generation. Although some are convinced that policies have worked in selected markets, conclusive evidence on the effect of renewable energy policies remains unclear and is still debated. In addition, the change in national electricity systems is accompanied by the development of a dynamic industry sector providing the necessary technology components for renewable electricity production. While some countries are particularly successful in exporting renewable energy technology components, there is debate on the effect of environmental regulation on a country's manufacturing industry competitiveness. Furthermore, in this particular sector, structure and drivers of international trade remain unclear. This dissertation addresses a number of questions regarding the effect of renewable energy policies on renewable electricity supply expansion and international trade in necessary technology components. An econometric approach is taken to estimate the effectiveness of renewable energy policies on renewable energy capacity and generation development in EU countries and U.S. states. Feed-in tariffs and renewable portfolio standards are analyzed while controlling for country differences in policy stringency, policy design and supplementary policies. Analyzing OECD country and Chinese exports of solar and wind energy technology components the effect of renewable energy policy on determining country competitiveness and, thus, bilateral trade is identified. Methodologically, this dissertation contributes to the discussion on the role of country specific effects in applied micro-econometric cross country comparison as well as to the selection of proper estimators under the existence of zero trade flows.
