The globalization process represents a constant challenge to public administrations that are used to stability and lack of dialog with the society. Nowadays administrative law must redefine old institutions, looking forward better inclusion and communication with citizens, allowing democratic practices according with the social demands. In order to analyse the complexity of these changes within the public administrations, in this paper we are going to study the challenges brought by globalization process, and them we will verify the restrictions that can appear on public administrations at the moment of transform the old institutions of power within the States, especially for the delivery of information to the knowledge society. ; El proceso de globalización representa un constante desafío para la administración pública, acostumbrada a la existencia de estructuras estables y poco dispuestas al dialogo con la sociedad. En la actualidad el derecho administrativo debe constantemente revaluar sus viejas instituciones, buscando mayor inclusión y comunicación con la ciudadanía, para permitir practicas más democráticas conformes a las diversas demandas de las sociedades. Introduction : the new frontiers of EU administrative law and the scope of our inquiry
European Papers posted in e-Journal 24.11.2017 ; This article introduces our study into the operation of administrative law in EU external relations by introducing its general themes and fields of study. It starts by characterising the EU as a global actor and by illustrating how EU administrative law has developed in general, and in the area of external relations in particular. It then moves to examine the instrumental role that administrative law plays in advancing the EU's external policy objectives, and the difficulties involved, following from the general way in which many of these objectives have been defined. Building on Bovens' definition of accountability, we lay down a main framework for studying accountability in this context, and its different dimensions studied in the individual articles: legal, political, financial, administrative and social. This article then provides a general comparison of administrative action in the area of external action, building on general typologies of EU administrative action, with a view to laying the ground for an examination of the extent to which external relations is special. Finally, it closes with a brief introduction to one of the key themes in this Special Section: the scope of institutional discretion, and its link to the overall accountability of EU action in this area.

The French Council of State: Its Role in the Formulation and Implementation of Administrative Law

In order to understand the nature, evolution, and basic conceptions of French administrative law, it is essential to study the role of the Conseil d'État, the supreme administrative tribunal. Creative and dynamic, often even bold, the jurisprudence of this remarkable body remains nevertheless prudent and fundamentally evolutionary. One would search in vain for the major principle of French administrative law in the legislative texts; they have been developed by the jurisprudence of this Council as it proceeds, by a series of successive decisions, from specific cases to ultimate yet flexible generalizations, establishing basic legal concepts not only by the skillful interpretation of texts, but also by creative construction when the texts are silent. Together with its doctrinal achievements, the Council's usus fori or judicial practice forms a flexible source of principles applicable to specific cases. The legislator may regulate according to circumstances and the necessities of the moment, without concerning himself with general principles or even conforming rigorously to those created by jurisprudence and theory. But the administrative judge, in administering justice, performs a genuinely creative task and establishes bases for legal thought.
