On July 22, 2002, Governor Gray Davis signed AB 1493 into law. This law requires that the California Air Resources Board (CARB) propose rules that would reduce greenhouse gas emissions of light duty vehicles in California. The goal of this study was to provide insight into industry and consumer response to government regulations, especially as they might relate to future regulations that reduce greenhouse gas emissions from vehicles. This report addresses industry and consumer behavior with respect to emissions, safety, and energy use in the U.S. and Europe over the past few decades. We created and analyzed a large data set of vehicle characteristics, sales, and prices, vehicle financing practices, and exogenous factors such as income, for the period 1975-2003, and supplemented the data analysis with case studies of the introduction of oxidation and three-way catalysts, air bags, and hybrid electric vehicles in the US; and diesel cars in Europe. We found that costs imposed on vehicles due to US emissions and safety regulations have been significant — somewhere between $2500 and $4000 per vehicle. These costs represent up to 1/3 of vehicle price increases since the 1970s. Whether one considers these costs to be large or small, they had little discernible effect on industry performance and activities. The cost increases have been largely accommodated within normal business and market planning processes of companies.

Die Dissertation setzt sich zuerst mit der Frage auseinander, ob der " Einstiegsarrest"~als atypische Form des Jugendarrests de lege lata zulässig ist. Anschließend wird erörtert, ob die gesetzliche Verankerung dieser Sanktionsform rechtmäßig und zweckmäßig ist. Nach der Einleitung (S. 11 - 14) wird in Teil 1 (S. 15 - 54) die Bedeutung des Begriffs " Einstiegsarrest"~geklärt. Dabei werden die Begriffe " Einstiegsarrest im engeren Sinne", der ausschließlich die Kombination von Jugendarrest mit der Aussetzung der Verhängung der Jugendstrafe nach § 27 JGG erfasst, und " Einstiegsarrest im weiteren Sinne", der zusätzlich die Verbindung des Arrests mit der Aussetzung der Vollstreckung der Jugendstrafe nach § 21 JGG oder mit der " Vorbewährung" (§ 57 I 1 Var. 2 JGG) umfasst, eingeführt (S. 15 - 17). Anschließend befasst sich die Dissertation mit der Geschichte und den Grundlagen des Jugendarrests (S. 17 - 22), bevor die verschiedenen Formen des Jugendarrests dargestellt werden (S. 23 - 32). Als Bestandteil des Einstiegsarrests im engeren Sinne wird dann der Schuldspruch nach § 27 JGG angesprochen (S. 32 - 41). Im Anschluss daran werden § 21 JGG (S. 42 - 48) und das Institut der " Vorbewährung"~(S. 49 - 51) behandelt, da sie Bestandteile eines Einstiegsarrests im weiteren Sinne sein können. Zur Abrundung von Teil 1 und zur Veranschaulichung des Verhältnisses, in dem die einzelnen Komponenten, aus denen sich der Einstiegsarrest zusammensetzt, zueinander stehen, wurde ein Stufenmodell der Sanktionen im Jugendstrafrecht entwickelt (S. 52 - 54). In Teil 2 (S. 55 - 84) wird geklärt, ob die Verhängung eines Einstiegsarrests de lege lata zulässig ist. Das geltende Recht lässt eine Koppelung des Jugendarrests mit § 21 JGG ebenso wenig zu wie eine Verbindung mit der " Vorbewährung", da beide Kombinationsformen gegen § 8 II 1 JGG und gegen § 13 I JGG verstoßen (S. 55 - 57). Der Schwerpunkt der Ausführungen in Teil 2 liegt auf der umstrittenen Frage, ob de lege lata Arrest mit dem Schuldspruch nach § 27 JGG kombiniert werden darf. Zunächst wird herausgearbeitet, dass die Anordnung eines solchen Einstiegsarrests im engeren Sinne nicht gegen den Wortlaut des § 8 II 1 JGG verstößt (S. 58 - 61). Auch ein Verstoß gegen § 13 I JGG wird nicht festgestellt (S. 62 - 69). Anschließend wird gezeigt, dass der Grundsatz der Einspurigkeit freiheitsentziehender Sanktionen, der möglicherweise aus § 8 II 1 JGG oder § 13 I JGG ...

Happiness is defined as the degree to which a person enjoys his or her life-as-a-whole. Accordingly 'Gross National Happiness' is defined as the degree to which citizens in a country enjoy the life they live. Individual happiness can be measured by self-report on a single standard question. Hence Gross National Happiness can be measured by the average response to such questions in general populations surveys. Survey data on average self-report of happiness can be combined with estimates of life-expectancy based on civil registration. The resulting index denotes how long and happy people live in a country and can be expressed in a number of Happy-Life-Years (HLY). Comparison across present day nations shows huge differences on this indicator, HLY varying between 63 (Switzerland) and 21 (Moldavia). About 80% of these differences can be explained by variation in societal characteristics, such as economic development, political democracy and mutual trust. HLY varies also over time. During the last decade it rose in western nations but plunged in the former Soviet nations. Résumé L'intégration « à la française » a toujours mis l'accent sur la mixité précoce, la fréquentation maximale des espaces sociaux ordinaires pour favoriser la participation sociale des personnes handicapées. La normalisation maximale projetée vise un idéal d'assimilation. Les personnes handicapées ayant investi le sport dans cette logique se sont engagées dans des pratiques en club ordinaire, s'efforçant de jouer le jeu de « l'identique ». Une étude clinique menée au travers d'un protocole longitudinal sur une période de dix ans expose le cas d'une jeune sportive paraplégique, et retrace une trajectoire marquée par une volonté permanente de normalisation soutenue par l'environnement familial. Une analyse qualitative de l'évolution psychologique, sociale, sportive et professionnelle de cette jeune femme, entre 22 et 32 ans fait apparaître que la logique d'assimilation, incorporée comme ligne de conduite, a produit des effets pervers qui ont entravé le processus d'intégration sociale et conduit le sujet à des conflits de représentations qui débouchent sur une situation bloquée. L'étude permet de mettre en évidence les interactions entre représentation de soi, identité sociale, représentations du sport et de ses différentes modalités de pratique (sport de loisir, sport de haut niveau, pratique intégrée, pratique entre pairs), et souligne les effets singuliers produits par la logique d'assimilation dans le cas étudié. Elle met en évidence les processus par lesquels le sport, classiquement présenté comme espace de socialisation et d'intégration, peut paradoxalement mener à l'isolement social.

Dans l'Union européenne (UE), divers services environnementaux fournis par le secteur agricole, de la biodiversité au paysage, sont rémunérés par les mesures agro-environnementales (MAE). Un modèle microéconomique relie l'adoption d'une ou plusieurs MAE à la demande de travail agricole à surface égale. Les résultats économétriques, basés sur un échantillon de 1 638 agriculteurs de huit pays de l'UE, montrent qu'un accroissement de la rémunération des MAE conduirait à un accroissement de la demande de travail. Cet effet global est cependant très contrasté selon les types et les combinaisons de MAE. C'est l'adoption conjointe de diverses MAE qui demande le plus de travail par hectare, en particulier l'association de mesures visant la réduction des intrants polluants avec des mesures d'entretien du paysage. Du point de vue qualitatif, les résultats montrent que la production jointe de biens environnementaux requiert un niveau minimal de formation générale et agricole plus élevé que la seule production agricole.

Inhaltsangabe: Die Bedeutung des Geschäfts- oder Firmenwertes erlangt einen immer größeren Stellenwert. Dies ist zum einen die Folge eines rapiden weltweiten Anstiegs der Anzahl von Unternehmenszusammenschlüssen. Zum anderen wird die Kluft zwischen der Marktkapitalisierung respektive dem Marktwert eines Unternehmens und dessen bilanziellen Eigenkapital immer größer. Bei der Übernahme von Mannesmann durch Vodafone belief sich der Goodwill sogar auf ca. 180 Mrd. Euro. In vielen Bilanzen nimmt der Geschäfts- oder Firmenwert mehr als die Hälfte der Bilanzsumme ein und erreicht nicht selten die Höhe des bilanziellen Eigenkapitals. Aufgrund dieser zentralen Bedeutung können schon geringe Änderungen in der Goodwill-Bilanzierung zu weitreichenden Auswirkungen auf die Darstellung der Vermögens- und Ertragslage führen und z.B. ansonsten wünschenswerte Unternehmenszusammenschlüsse begünstigen oder verhindern. Nachdem das FASB im Juni 2001 die für die Bilanzierung des Goodwills entscheidenden neuen US-amerikanischen Standards SFAS 141 "Business Combinations" und SFAS 142 "Goodwill and Other Intangible Assets" verabschiedet hat, hat das IASB im Rahmen der ersten Phase des eigenen Projektes "Business Combinations" am 5.12.2002 den Exposure Draft (ED) 3 "Business Combinations" veröffentlicht, der IAS 22 (revised 1998) ersetzen soll. Dem ED 3 liegt u.a. die Zielsetzung des IASB zugrunde, eine Annäherung der internationalen Rechnungslegungsvorschriften herbeizuführen. Wesentliche Änderungen ergeben sich dadurch für die Bilanzierung von immateriellen Vermögenswerten und die Durchführung von Impairment Tests für den Goodwill. Die Fassungen dieser betreffenden IAS-Standards IAS 36 "Impairment of Assets" und IAS 38 "Intangible Assets" wurden überarbeitet und ebenfalls als Entwürfe ED-IAS 36 und ED-IAS 38 veröffentlicht. Die Veröffentlichung des endgültigen International Financial Reporting Standards (IFRS) ist für März 2004 geplant. Das Ziel der vorliegenden Arbeit besteht darin, den Ansatz, die Behandlung und den Ausweis des aus der Kapitalkonsolidierung resultierenden Geschäfts- oder Firmenwertes nach dem deutschen Handelsgesetzbuch (HGB), nach den United States Generally Accepted Accounting Principles (US-GAAP) und nach den International Accounting Standards (IAS) zu untersuchen. Einleitend wird dabei auf den Begriff, die Komponenten und die Bedeutung des Goodwills eingegangen. Im Folgenden werden die Regelungen in den drei Rechtskreisen getrennt voneinander analysiert und im Anschluss an einen Gesamtrechtsvergleich einer kritischen Würdigung unterzogen. Den Schwerpunkt der Arbeit bildet die außerplanmäßige Abschreibung (Wertminderung) des Geschäfts- oder Firmenwertes. Die Auswirkungen der Neuregelungen beschließen die Diskussion.

Inhaltsangabe:Einleitung: Kaum ein Gewerbe konnte sich über so lange Zeit und über alle Krisen hinweg halten wie die Prostitution. Aber auch kaum ein Gewerbe, das einen nicht zu vernachlässigenden Erfolg zu verzeichnen hat, ist von der Gesellschaft derart geschmäht. Gerade heute, in Zeiten von sexueller Präsens allerorts, mutet der ambivalente Umgang mit dem "ältesten Gewerbe der Welt" seltsam an. Die Prostitution und die Damen und Herren, die dieses Gewerbe ausüben, beziehungsweise in Anspruch nehmen, dienten unzähligen Büchern aller Genres, von wissenschaftlich bis belletristisch, als Vorlage und Material. Immer wieder wurde auf allen Wegen versucht, herauszufinden, warum Frauen ihre Körper verkaufen und was Männer dazu bewegt, sich die Illusion von Liebe und Zuneigung zu erkaufen. Auch das Fernsehen, füllt seine Abendprogramme nach 22:00 Uhr ständig mit dem voyeuristischen Blick ins Milieu, streng getarnt unter dem Deckmantel objektiver und wissenschaftlicher Reportagen. Es wird einen Glauben gemacht, die Prostitution und die Damen, die diesem Beruf nachgehen, seien ein ganz normaler Bestandteil der Gesellschaft, der nun endlich auch als ein solcher akzeptiert werde. In der Bevölkerung mag dies sogar der Fall sein. Solange man selbst nicht tangiert wird, ist es dem einzelnen prinzipiell tatsächlich egal, welchen Beruf eine Dame ausübt. Manchmal geht die Akzeptanz sogar weiter und endet in wahrer Toleranz. Sieht man sich die Entwicklung des Umganges mit der Prostitution an, so muss man allerdings sehr bald feststellen, dass der größeren Toleranz der Bevölkerung eine veraltete und keineswegs tolerante Umgangsweise der Behörden gegenübersteht. Eine Dame, die offiziell der Prostitution nachgeht, dies vielleicht sogar als Haupttätigkeit ausführt, hat eine Unmenge von Pflichten gegenüber den Behörden zu erfüllen und kann kaum Rechte nutzen. Steuern darf eine Prostituierte zahlen, weil sie ein "normales" Gewerbe ausübt, das dazugehörende Gewerberecht, darf die Dame allerdings nicht in Anspruch nehmen, da sie es aufgrund der Sittenwidrigkeit ihrer Tätigkeit nicht nutzen darf, dies sei nur ein Beispiel. Die Notwendigkeit der Existenz der Prostitution wird zwar eingesehen und das Überdauern vieler Jahrhunderte und Jahrtausende zeigt auch, dass der Bedarf immer da war und immer da sein wird, dennoch ist es verwunderlich, dass man eigentlich nie einen Kunden, einen Gast oder Freier findet, der offen zugibt, die Dienste der Damen zu nutzen. Die Gesellschaft schämt sich, trotz aller anders lautenden Behauptungen, der Prostitution. Nur so lässt sich erklären, warum die Prostitution immer noch in die Randgebiete der Städte verdrängt wird. Wie die Situation der Prostituierten in den Großstadtmetropolen aussieht, wurde häufig und aufs Ausführlichste beschrieben, wie sich die Situation in einer Stadt wie Augsburg gestaltet, soll die folgende Arbeit darstellen.

The paper empirically explores the factors that could have accounted for the generally declining aid effort (defined as the generosity ratio, or the share of GDP given as aid) of bilateral donors over the last three decades. Annual panel data over 1970-2000 period for the 22 DAC members are used in a series of regressions. The findings suggest the existence of progressivity of aid in relation to donor income. There is also evidence of the economies of scale, in the sense that the share of aid in income decreases with growth in the size of donor country population. Domestic pro-poor tendency also appears to enhance donor generosity, and a positive 'peer pressure' effect is also observed. In addition, the extent of military adventurism of the donor is observed to have enhanced aid effort, just as also the size of government. But no discernible effect is detected for fiscal balance. On the political front, a greater number of checks and balances in the political system as well as the existence of polarization and fractionalization within the government are found to have enhanced aid effort while fractionalization within the opposition has the opposite effect. On the other hand, no discernible and consistent effect of ideological orientation of government is detected. Finally, the movement in the aid effort over time is found to differ between the G7 and non-G7 donors.

The purpose of this research was to determine how regular exercise impacted leadership scores on two multi‐rater leadership assessment instruments – the Executive Success Profile® (ESP), and the Campbell Leadership IndexTM (CLI). Since 1997, data have been collected from over 600 senior‐level executives attending Leadership at the Peak, a five‐day course at the Center for Creative Leadership. Prior to attending, the participants completed a health and physical activity questionnaire that included questions about their exercise, dietary and smoking habits and assessment data were collected from both the participants and their observers. After they arrived at the program, fitness professionals collected additional data including percent body fat, blood‐pressure and exercise routine. The health data were compared with the results of the ESP and CLI. These instruments required a self‐assessment of performance on various leadership indices along with parallel ratings by an observer group of bosses, subordinates and peers. The results indicated that the observers rated exercisers significantly higher than the non‐exercisers on many of the ESP and CLI scales. The weighted averages of all the scales for both instruments were also significantly higher for the exercisers. Further, the bosses also rated smokers lower on 14 out of 22 ESP scales compared with those who had never smoked. Overall, these data indicate that engaging in regular exercise is positively correlated with how others rated executives on various leadership indices.

An independent review for the British government has concluded that the development of a cattle vaccine against Mycobacterium bovis holds the best long-term prospects for tuberculosis control in British herds. The development of complementary diagnostic tests to differentiate between vaccinated and infected animals is necessary to allow the continuation of test-and-slaughter-based control policies alongside vaccination. Vaccination with M. bovis bacillus Calmette-Guérin (BCG), the only available vaccine, results in tuberculin purified protein derivative sensitivity and has shown varying vaccine efficacies in cattle. Thus, identification of more-specific reagents to distinguish between vaccination and infection, as well as the identification of subunit vaccine candidates for improved tuberculosis vaccines, is a research priority. In the present study, we applied comparative genomics to identify M. bovis-Mycobacterium tuberculosis antigens whose genes had been deleted in BCG Pasteur. In total, 13 open reading frames (ORFs) from the RD1, RD2, and RD14 regions of the M. tuberculosis genome were selected. Pools of overlapping peptides spanning these ORFs were tested in M. bovis-infected (n = 22), BCG-vaccinated (n = 6), and unvaccinated (n = 10) control cattle. All were recognized in infected cattle, with responder frequencies varying between 16 and 86%. In particular, eight highly immunogenic antigens were identified whose potentials as diagnostic reagents or as subunit vaccines warrant further study (Rv1983, Rv1986, Rv3872, Rv3873, Rv3878, Rv3879c, Rv1979c, and Rv1769).

This article attempts to shed light on the rise & development of political parties & party systems in the CEECs. It begins with outlining the main features of party & party system development in Poland since 1989 seen in the context of different stages of postcommunism. The aim is to present a broad overview & to reach a better understanding of the changes in parties & party systems in CEECs -- & especially in Poland. The first more general overview will be followed by a more detailed study of the trade union Solidarity, the election alliance AWS, & the party formation RS AWS. As we shall see, the debate on the role of Solidarity has been intense & many-sided. Over the last 22 years, Solidarity can be considered as a trade union, an anticommunist liberation movement, a broad anticommunist movement party, a cartel-type party with governmental responsibilities, & after the 2001 election, as a party & trade union without representation in the Sejm. At the 2001 national election AWS lost representation in the Sejm. A variety of explanations has been put forward. One of the major arguments in this article is that explanations of the evolution of Solidarity has to be found on the structural & institutional as well as on the policy level &, maybe most significantly, on the actor-behavioral level due to the anarchic culture on the Right. 90 References. Working Paper no. 3 ; Arguably, no region in the world has benefited more from the globalization of the world economy over the last thirty years than East Asia. At the same time, the prevailing wisdom has been that they have not benefited from globalization to the same extent. The present paper shows that the differences in economic performance between East Asia and Latin America can be attributed in part to differences in their linkages with the global economy. It goes on to show that different corporate activities can represent different types of foreign investment. Data from a survey of manufacturing multinationals active in the Asia-Pacific region shows that the determinants of foreign investment differ by activity. This indicates that nations interested in attracting different corporate activities might wish to adopt different policy mixes. The results indicate that investments in infrastructure and managerial capabilities can contribute to an economy's ability to attract a broad range of corporate activities. Results on tariffs and capital controls do not support the Washington consensus that greater openness will lead to greater investment.
