Abstract:The article examines the problematic politics of expertise in the formation of international legal rules in the field of heritage, looking specifically at international conventions made under the auspices of UNESCO. The article shows that, even within this seemingly small and cohesive universe, there is a lot of room for disagreement, and much of it can be traced back to what Laurajane Smith has called "the Authorized Heritage Discourse" (AHD). The AHD is responsible for the dichotomization of heritage between intangible and tangible, as heritage professionals strive to hold on to and expand their self-created professional legitimacy and importance. Heritage professionals, in striving to maintain their relevance, tend to create self-referential regimes that exclude heritage holders and communities. I argue that lawyers, because of their own professional tendencies, might be in a position to offer a counterpoint to rule by experts in international cultural heritage management.

Internationaler Wettbewerb ist heutzutage eher der Normalfall als eine Ausnahmeerscheinung für viele Unternehmen. Um unter den verschärften Wettbewerbsbedingungen langfristig überleben zu können, bedarf es von Unternehmensseite der Genese adäquater internationaler strategischer Verhaltensweisen. Alexander Upitz verfolgt die Fragestellung, über welche internationalen Wettbewerbsstrategien Pioniere und Follower zum jeweiligen Markteintrittszeitpunkt in Auslandsmärkte eintreten. Aufgrund des geringen Forschungsstandes reflektiert der Autor die bestehende Literatur umfassend und kritisch. Im Besonderen stellt er die heterogenen Forschungsansätze zur Abgrenzungskontroverse detailliert gegenüber. Über die Modellierung von Pionier- und Followermerkmalen sowie ihrer unterschiedlichen externen Wettbewerbssituationen werden Implikationen für das strategische Verhalten abgeleitet. Als Ergebnis erklärt der Autor mittels eines differenzierten Bezugsrahmens Gemeinsamkeiten und Unterschiede internationaler Wettbewerbsstrategien von Pionieren und Followern in Auslandsmärkten. Auf dem Hintergrund der historischen Entwicklung der internationalen Beziehungen und der weitgehenden Veränderungen der Weltpolitik diskutiert der Beitrag die Frage, ob man angesichts der Tendenzen noch von "Internationalen Beziehungen" sprechen kann. Die Anwesenheit von neuen Strukturen und Prozessen erfordert einen neuen Begriff, z.B. das Konzept der post-internationalen Politik, mit dem auch der Übergang von der Moderne zur Postmoderne beschrieben werden kann. Am Beispiel von Lateinamerika wird verdeutlicht, dass die postmodernen Perspektiven besonders gut geeignet sind, die Veränderungen, die in den internationalen Beziehungen stattgefunden haben, zu verstehen und sich gut in die klassischen Debatten der internationalen Studien (Idealisten versus Realisten, Traditionalisten versus Szientisten sowie Neorealisten) einfügen. Abschließend geht es um die Auswirkungen der strukturellen Veränderungen im internationalen System nach dem Ende des Kalten Krieges auf Lateinamerika und die Etappen seiner internationalen Einbindung. International energy law embodies a matter of keen interest that affects the daily lives of citizens in developing and developed countries worldwide. Among numerous other effects, international energy law influences gas prices, wages, employment rates and domestic market regulations. The weight of these direct consequences of international energy law and policy led to the creation of this year's symposium topic. The goal of this year's symposium is to identify issues arising from various international energy laws as well as to understand the effects that recent international events, including the fall of Enron, the creation of NAFTA and the political unrest in the Middle East, have had on the formulation and implementation of international energy law. The papers in this issue examine the corporate, political, social, legal and other factors impacted by energy law and policy across the globe. Each article in the symposium issue addresses cross-cutting issues relating to the field of international energy law, in the hopes that every country may draw lessons from successful laws or policies as well as mistakes made.

In the international political arena dogmas & ideologies are back as shown by their resurgence in many domestic policies. In several parts of the world, polarization has emerged again as a leading force. Globalization has offered an opportunity for a more interdependent world. In reality, however, globalization has brought a new world, a world of asymmetry. Asymmetry questions the simplistic image of "one superpower", where the "large" had influence over the "small". Maybe the anti-globalization movement has missed part of this phenomenon: the empowerment of the "small" to attack & affect the "large". By enumerating several examples, the author supports his claim that without touching US soil an enemy could harm the US. He concludes that the extremes in every society are able to project a vision while the majority of the "non-dogmatic" are unable to articulate their own vision. In such an atmosphere of conflict the extremes seek confrontation because the majority's ability to form coalitions, disseminate their values, & marginalize the extremes is impeded. E. Sanchez
This dissertation contains three essays on monetary policy, dynamics of the interest rates and spillovers across economies. In the first essay I examine the effects of monetary policy and its interaction with financial regulation within a micro-founded macroeconometric framework for a closed economy with a heterogeneous banking system, facing a period of low interest rates. I analyse the interplay between monetary policy and banking regulation and study the role of agents' expectations for the effectiveness of unconventional monetary policy tools. In the next essay, I argue that openness is crucial for understanding the dynamics of the term structure. In an empirical application, I show that my model of the term structure fits well the yield curve in-sample and has a sound ability to forecast interest rates out-of-sample. The model accounts for the expectations hypothesis, replicates the forward premium anomaly and reconciles the uncovered interest rate parity implications. The last essay is concerned with the dynamics of co-movement among macroeconomic aggregates and the degree of convergence or decoupling amongst economies. The model includes measures of financial and trade-based interdependencies and incorporates feedback between macroeconomic variables and time-varying weights. The findings point at the importance of asset price movements and financial linkages. ; In meiner Dissertation beschäftige ich mich mit aktuellen Fragestellungen der internationalen und monetären Makroökonomie. Das erste Kapitel zielt auf die Analyse der Effekte der Geldpolitik und ihrer Wechselwirkung mit der Bankregulierung im Rahmen eines mikroökonomisch fundierten Modells für die geschlossene Wirtschaft mit heterogenem Banksektor ab, die sich in einer Periode von niedrigen Zinsen befindet. Der Originalbeitrag bezieht sich auf die Analyse des Zusammenspiels zwischen Geldpolitik und Bankregulierung, und insbesondere auf die Untersuchung der Rolle von Erwartungsbildung bezüglich der künftigen Politik der Zentralbanken im Hinblick auf Effektivität der nicht konventionellen geldpolitischen Instrumente. Im nächsten Kapitel beschäftige ich mich mit einem der Transmissionsmechanismen für die Geldpolitik, der Zinsstrukturkurve, und belege, dass Offenheit der Wirtschaft von entscheidender Bedeutung für das Verstehen der Dynamik der Zinssätze ist. Insbesondere untersuche ich, wie die von innen und von außen kommenden makroökonomischen Faktoren in einer offenen Wirtschaft die Bewegungen der Zinsstrukturkurve und der Risikoprämien beeinflussen. Das letzte Kapitel beschäftigt sich mit Modellierung der Dynamik der makroökonomischen Größen zwischen verschiedenen Ländern, d.h. mit dem eigentlichen Prozess, der die Dynamik der Makrofaktoren aus dem zweiten Kapitel bestimmt. In diesem Teil meiner Dissertation bearbeite ich die Fragestellung, ob die Länder oder Ländergruppen in wirtschaftlicher Hinsicht dazu tendieren zu entkoppeln oder ob sie aufgrund zunehmender Globalisierung konvergieren.

It is an essential mode of liability for core international crimes because it reaches out to senior political and military leadership. These persons do not usually engage in direct offending, yet in the context of mass atrocities they are often more culpable than foot soldiers. The Statutes of the ad hoc tribunals, hybrid courts and the International Criminal Court expressly provide for different forms of complicity, and domestic legal systems recognize it in one form or another. This is in contrast with alternative modes of liability implied from the Statutes to address the situations with multiple accused removed from the scene of the crime / (in)direct co-perpetration, extended perpetration and the joint criminal enterprise.
