This thesis draws attention to the role of international law and norms in constituting different normative categories of membership in international society. Particular attention is paid to the notion of state crime, which can be seen to underlie the practice of international norm-enforcement and which is in tension with the traditional understanding of sovereignty. This tension is highlighted in contemporary international society, which is increasingly defined by the principles of universality and the rule of law. The politics and potential problems of normative boundary-drawing are viewed in light of the English School theory of International Relations. The theoretical framework allows the identification of certain criteria for assessing the appropriateness of international norm-enforcement in a given case. The research question is concerned with the extent to which such criteria are met in case of the UN Security Council sanctions on Iran, and the implications of this for the future strategy in the Iranian nuclear issue, and also for the non-proliferation regime and international society more generally. The research material consists mainly of speeches held by UN Security Council members and Iran in 2006—2009, which are interpreted hermeneutically, based on the theoretical framework and the background discussion. A key finding is that the punitive approach in the Iranian nuclear issue has not only been unsuccessful in promoting non-proliferation, but it has also intensified the underlying political conflicts and created obstacles for finding a compromise solution. It is argued that a clarification of goals and conflict management approach is needed to deal with the dispute. This, however, requires a paradigm shift on two levels: on the one hand, the US and Iran should overcome enmity in their bilateral relations, and on the other hand, the demands and assumptions behind the UN Security Council and other sanctions should be reconsidered. More specifically, a new approach requires moving away from the analogy of crime and policing to a more symmetrical notion of dispute settlement among states. The Iranian case shows that non-proliferation cannot be achieved only through governance and coercion, especially in cases where the legal process of norm-enforcement disguises an escalating political conflict. What is needed instead is conciliatory diplomacy and impartial recognition of security dilemmas, which can be extremely difficult in a situation where the legitimacy of the potential proliferator has been questioned through normative exclusion. ; Väitöskirja käsittelee normeihin perustuvaa ulossulkemista kansainvälisessä politiikassa. Se kiinnittää huomiota siihen, että normit eivät ainoastaan luo järjestystä asettaen rajoja valtioiden toiminnalle, vaan ne myös määrittävät jäsenyyttä ja ulkopuolisuutta kansainvälisessä yhteisössä. Ulossulkemisen taustalla vaikuttaa kansalliseen analogiaan perustuva valtiorikollisuuden ajatus, joka on ristiriidassa perinteisen suvereniteettiperiaatteen kanssa. Tämä ristiriita on korostunut nykymaailmassa, jossa valtioiden legitimiteetin nähdään yhä enemmän riippuvan erilaisten normien noudattamisesta. Normeihin mukautuvien kansainvälisen yhteisön jäsenten ja norminrikkojien välisen rajanvedon poliittisuutta ja siihen liittyviä ongelmia tarkastellaan väitöskirjassa englantilaisen koulukunnan teorian kautta. Teoreettisen kehikon avulla on mahdollista määritellä tiettyjä ehtoja, joiden avulla voidaan arvioida normien toimeenpanon mielekkyyttä yksittäisissä tapauksissa. Tähän liittyy myös tutkimuskysymys, joka pohtii YK:n turvallisuusneuvoston asettamien pakotteiden perusteita sekä niiden vaikutuksia Iranin ydinohjelmaa koskevassa kiistassa ja laajemmin kansainvälisessä yhteisössä. Empiirinen osuus keskittyy YK:n turvallisuusneuvoston jäsenten ja Iranin vuosina 2006—2009 pitämiin puheisiin, joita tulkitaan hermeneuttisesti teoreettisen kehikon sekä ydinkiistan taustoja käsittelevän aiemman keskustelun valossa. Keskeinen johtopäätös on, että YK:n turvallisuusneuvoston pakotepolitiikka ei ole edistänyt diplomaattisen ratkaisun löytymistä, vaan se on päinvastoin osaltaan kärjistänyt kiistan taustalla olevia poliittisia konflikteja ja vaikeuttanut kompromissin löytämistä. Väitöskirjassa korostetaan tavoitteiden selkiyttämisen sekä kompromissiin perustuvan konfliktinratkaisun tärkeyttä kiistan selvittämiseksi. Tämä puolestaan edellyttää vedettyjen rajalinjojen purkamista sekä perustavanlaatuista muutosta niin Iranin ja Yhdysvaltain kahdenvälisissä suhteissa kuin monenkeskisen diplomatiankin tasolla: siinä kun Iranin ja Yhdysvaltain tulisi pyrkiä pääsemään vihollisuusparadigman yli, Iranin ydinkiistaa hoitavan YK:n pysyvistä jäsenistä ja Saksasta koostuvan ns. P5+1 -ryhmän olisi harkittava uudelleen pakotetoimien taustalla olevia vaatimuksia ja olettamuksia. Keskeistä kummassakin tapauksessa on siirtyminen valtiorikollisuuden analogiasta symmetrisempään valtioiden väliseen konfliktinratkaisuun. Iranin tapaus osoittaa, ettei ydinaseiden leviämisen estäminen voi tapahtua pelkästään hallinnan ja pakottamisen kautta, varsinkin kun normien toimeenpano peittää alleen poliittisen konfliktin. Se vaatii myös sovittelevaa diplomatiaa ja puolueetonta turvallisuusdilemmojen tunnustamista, mikä on erityisen vaikeaa tilanteessa jossa mahdollisen uuden ydinasevallan legitimiteetti on kyseenalaistettu ulossulkemisen kautta.

Which types of international institutions display higher ability to change states' behaviour? This article assesses the relative environmental effectiveness of a management-based ('soft') and an enforcement-based ('hard') international agreement: the United Nations Sofia Protocol and a European Union directive. Using difference-in-differences analysis, we find that the European Union directive is more effective in inducing emissions reductions than the United Nation's Sofia Protocol. We propose that the European Union's enforcement capacity is a likely driver of the directive's effectiveness. The article makes two contributions to existing literature. First, we provide causal evidence on the relative importance of overlapping international institutions in regulating environmental policy outcomes, elucidating how an apparent emissions-reducing effect of a 'soft' United Nations Protocol is in fact driven by the existence of overlapping 'hard' European Union regulation. Second, we demonstrate how states' enthusiasm for emissions regulations can explain the relative effectiveness of soft and hard law institutions.

Toxic torts are product liability cases dealing with alleged injuries due to chemical or biological hazards such as radiation, thalidomide, or Agent Orange. Toxic tort cases typically rely more heavily than other product liability cases on indirect or statistical proof of injury. There have been numerous theoretical analyses of statistical proof of injury in toxic tort cases. However, there have been only a handful of actual legal decisions regarding the use of such statistical evidence, and most of those decisions have been inconclusive. Recently, a major case from the Fifth Circuit, involving allegations that Benedectin (a morning sickness drug) caused birth defects, was decided entirely on the basis of statistical inference. This paper examines both the conceptual basis of that decision, and also the relationships among statistical inference, scientific evidence, and the rules of product liability in general.

Focusing on issues raised by the U.N. Working Group on Indigenous Peoples, this study reveals the obstacles to self-determination for these peoples in all parts of the world. The author argues, using both legal and social theory, that the right of self-determination can be available to indigenous peoples, and proposes measures that the UN might institute to oversee the realization of this right.
