The International Criminal Court (the Court) in The Hague, in fulfilling its mandate to put an end to impunity for the perpetrators of the most serious international crimes of concern to the international community as a whole, is neither able nor intended to investigate all situations of crisis across the world. Selectivity is unavoidable for the operation of this international organization. However, the authority of the Prosecutor of the Court to select and prioritize a situation over other situations is not unfettered. This book studies the situation selection regime at the International Criminal Court. In doing so, it first clarifies the notion of situation under the constituent instrument of the Court, the Rome Statute. In addition to this conceptualization, through describing the situation selection process and criteria, the Court's law, policies and practices in this regard are examined. Dealing with the misunderstanding of the Court's selectivity, this book reads the situation selection regime from the lens of expressivism. The article presents a top-down approach to the study of the empirical legitimacy of international institutions. It starts from the observation that international institutions' representatives are engaged in various strategies aimed at cultivating generalised support. The article asserts that such strategies should be taken into account to gain deeper insights into the legitimation process of international institutions. To systematise these legitimation efforts and facilitate their empirical analysis, the article introduces the concept of legitimation strategies, which are defined as goal-oriented activities employed to establish and maintain a reliable basis of diffuse support. An analytical differentiation between three types of legitimation strategies is introduced depending on the addressees of legitimation strategies, that is, member state governments, international institutions' staff, and the wider public. The applicability of the concept and the relevance of legitimation strategies for international institutions' communication, behaviour, and institutional design is demonstrated by an empirical analysis of the G8's and the IMF's reaction to legitimation crises in the recent past of both institutions. In addition, the case studies suggest that a balanced set of legitimation strategies that takes into account the legitimacy concerns of all three constituencies is more likely to be successful in improving legitimacy perceptions.

This study demonstrates the extensive protection that international law provides to human rights even in the most serious of emergencies when they are particularly vulnerable. Based on a meticulous analysis of preparatory works and practice under the International Covenant on Civil and Political Rights, as well as the American and European Conventions on Human Rights, and with a special chapter on the International Labour Organisation's approach to international labour standards and emergencies, this book shows that respect for the rule of law and the concept of a democratic society are controlling parameters in any valid limitation on the enjoyment of human rights. It further shows that respect for human rights and the operation of institutions such as the Legislature and Judiciary are crucial to enabling societies to address and eventually remedy the root causes of emergency situations. The study recommends possible directions for the development of case law and suggests some practical means to help ensure that international legal requirements are in fact respected in emergencies

This book gives a comprehensive account of the British Idealist approach to international relations from the 1880s to 1930s. In an attempt to historically contextualise the shifts in several British Idealists' approaches to the nature of international relations and human rights, it focuses on their reflections on the Second Boer War, the Great War and the League of Nations. The ensuing discussion offers valuable insights into British Idealists' evolving approaches to the topics of imperialism, cosmopolitanism, internationalism, multiculturalism and human rights. While the pioneering Idealists like T.H. Green and Bernard Bosanquet are acknowledged as those who set the tone of discussion on these central issues, works by minor British Idealists such as J.S. Mackenzie, J.H. Muirhead, Henry Jones, R.B. Haldane and H.J.W. Hetherington reveal British Idealism's capacity for adaptation to novel ideational positions under adverse international conditions.
