"For a judiciary in a democracy, dispensing justice is not only about doing justice, but also about showing that justice is being done; it is about giving reasons and creating a "culture of justification". The question becomes how to nurture such a culture. A number of liberal democratic jurisdictions have answered this question in part with the adoption of the multi-step method of evaluating the constitutionality of legislative infringements on fundamental rights widely known as Proportionality Analysis. Under Proportionality Analysis courts must engage in a structured process of reasoning. This book deals with Gender Justice and Proportionality Analysis in India. The author argues that the Supreme Court of India should consider adopting Proportionality Analysis for the adjudication of the fundamental right to sex equality in Indian courts. The book includes an analysis of Canadian and South African Proportionality Analysis and makes some suggestions on how an Indian Proportionality Analysis could be generated using this comparative investigation. This book is devoted to analyzing contemporary capitalism both in Japan and in the world economy by using the theoretical framework of the French régulation theory and by revisiting the theory of civil society in postwar Japan. The Japanese theory of civil society proposed unique thinking about "freedom and equality" and "human rights" in the postwar era but could not help to come up with effective concepts for an economic analysis of that capitalism of the period. On the other hand, the régulation theory born in the 1970s is well known by its definition of postwar capitalism as Fordism, based on the elaboration of a new conceptual framework, but it soon proved unable to directly explain Japan's experience by that central concept of Fordism. Inspired by consideration of Japanese civil society and also by the regulationist framework, the author has forged new analytical concepts such as "companyism" to understand Japanese capitalism including the recent "lost decades", and he elaborates more carefully the concepts of "growth regime" and "institutional change" to grasp the dynamics of the world economy including today's neoliberal trend. The original benefits of the book consist in 1) reviving a Japanese theory of civil society in the postwar period, 2) applying the régulation theory to the analysis of contemporary Japan, and 3) offering theoretical reflections on the conception of the world economy. Consequently, the author pays special attention to the relationship between the political and the economic as well as regulationist tools and the theory of civil society's perspective. The principal message of the book is that capitalism or the market economy must be supported by a sound civil society.--

This book explores the intricate connection between the Single Market, characterized by the freedom of movement of goods, services, capital and labor within and across Europe, and the Digital Single Market, the virtual space that promotes freedom of movement of information and data. Both a result and catalyst of the Single Market, the Digital Single Market has become a different space from the Single Market, as the former is based on the application of information and communication technologies (ICTs), while the latter is the result of concerted actions and concessions by Member States in the European Union. The author argues that, similar to the Single Market, the Digital Single Market is an instrument, built by the influence of the Internet, which can provide a new means of socio-economic growth and development in Europe. While sharing many similar characteristics, the Single Market and the Digital Single Market diverge in important aspects, particularly with respect to policy. The research analyzes the interaction between policy actors, their influence in the European decision-making process, and their interests in order to establish a digital policy model, in comparison with market policy. Moreover, this volume considers the implementation process and the success of such initiatives under the current policy model, and puts forward policy recommendations. Ultimately, the author considers the utility of such research on digital policy, considering the current focus on migration, vulnerabilities to internal challenges (e.g., Brexit) and security threats, maintaining that the discussion of digital policies relates to an innovative vision of the European integration process and prospects for its future.

It provides a new set of historical GDP estimates for Spain from the demand and supply sides, and presents a reconstruction of production and expenditure series for the century prior to the introduction of modern national accounts. The author splices available national accounts sets over the period 1958-2015 through interpolation, as an alternative to conventional retropolation. The resulting national accounts series are linked to the historical estimates providing yearly series for GDP and its components since 1850. On the basis of new population estimates, the author derives GDP per head, decomposed into labour productivity and the amount of work per person, and placed into international perspective. The story of Christine Jorgensen, America's first prominent transsexual, famously narrated trans embodiment in the postwar era. Her celebrity, however, has obscured other mid-century trans narratives - ones lived by African Americans such as Lucy Hicks Anderson and James McHarris. Their erasure from trans history masks the profound ways race has figured prominently in the construction and representation of transgender subjects. In this book, the author identifies multiple intersections between Blackness and transness from the mid-nineteenth century to present-day anti-Black and anti-trans legislation and violence. Drawing on a deep and varied archive of materials - early sexological texts, fugitive slave narratives, Afro-modernist literature, sensationalist journalism, Hollywood films - the author attends to how slavery and the production of racialized gender provided the foundations for an understanding of gender as mutable. In tracing the twinned genealogies of Blackness and transness, this book follows multiple trajectories, from the medical experiments conducted on enslaved Black women by J. Marion Sims, the 'father of American gynecology, ' to the negation of Blackness that makes transnormativity possible. Revealing instances of personal sovereignty among Blacks living in the antebellum North that were mapped in terms of 'cross dressing' and canonical Black literary works that express Black men's access to the "female within," this book concludes with a reading of the fate of Phillip DeVine, who was murdered alongside Brandon Teena in 1993, a fact omitted from the film Boys Don't Cry out of narrative convenience. "This book examines the attitudes of political, military and non-state actors towards the idea of a UN Emergency Peace Service, and the issues that might affect support of the establishment of this service in both theory and practice. The United Nations Emergency Peace Service (UNEPS) is a civil society-led idea to establish a permanent UN peacekeeping service to improve UN peace operations as well as to operationalise the emerging norm of the 'responsibility to protect' civilians from atrocity crimes. The UNEPS proposal has received limited support. The author argues that interest in, and support for, the UNEPS proposal is determined by government perceptions that such a service would erode state sovereignty, the extent to which the principles of the proposal are consistent with actors' views on the world and perceptions on whether UNEPS will realistically be capable of contributing to the workings of the UN and regional peacekeeping systems in areas that are seen to be deficient. The book makes a case for localising the UNEPS proposal and the author suggests that UNEPS' architects might consider developing a less ambitious proposal as a first step to creating a rapidly deployable service with the mandate to prevent atrocity crimes. It examines various alternatives towards this end and concludes that, because the UNEPS proposal is intricately linked to the UN, trust in the world organisation is an essential ingredient in generating support for the idea.
