Wie lassen sich öffentliche Unternehmen auf Bundes-, Länder- und kommunaler Ebene erfolgreich steuern, leiten und überwachen? Antworten auf diese Fragestellung fanden hochkarätige Referenten und Teilnehmer auf der ersten Speyerer Tagung zu Public Corporate Governance am 22. und 23. April 2013. Der von Frau Univ.-Prof. Morner herausgegebene Tagungsband fasst die fundierten Beiträge der Referenten zusammen und zielt insbesondere darauf ab, Stellhebel einer erfolgreichen Steuerung aufzuzeigen. Im Vordergrund stehen mitunter kodifizierte Aspekte des Beteiligungs- und Risikomanagements sowie einer erfolgreichen Unternehmensführung. Zudem sind in den Beiträgen Empfehlungen und Anregungen aufgezeigt, wie sich Kodizes und gesetzlichen Regelungen realisieren oder verbessern lassen. Dabei ist behandelt, nach welchen Grundsätzen Aufsichtsratsmitglieder handeln sollten, wie sie ihre Rolle auszugestalten haben und welche Haftungsrisiken zu beachten sind. Der Tagungsband gibt ferner die von Herrn Rudolf X. Ruter moderierte Diskussion beispielsweise dazu wieder, inwieweit sich Erkenntnisse der privaten Corporate Governance auf den öffentlichen Sektor übertragen lassen. Die Ergebnisse der Tagung richten sich sowohl an Vorstände, Geschäftsführer und Aufsichtsratsmitglieder als auch an Entscheidungsträger in öffentlichen Unternehmen und der öffentlichen Verwaltung.

It was hypothesized that morale level as measured by a self-rating scale would vary as a function of the subject's own definition of morale. During the week of their graduation from training, 560 Naval aviation trainees were administered an anonymous questionnaire that, among other things, asked them to give their own definition of morale. They were then instructed to note the morale of their own group in advanced training on a ten-point scale with their own definition as a frame of reference. A content analysis of the definitions was made, and three definition areas were identified. These can be described briefly as task oriented, group oriented, and feeling oriented. Mean morale rates were obtained for the subjects falling in each of the definition categories. Significant differences among this array of means were demonstrated. The task oriented group yielded the highest mean, with group oriented and feeling oriented following in that order. Hypotheses for further study were developed. In April 2020, a debate broke out over whether the Liaison Office of the Central People's Government in the Hong Kong Special Administrative Region (LOCPG HK) and the Hong Kong and Macau Affairs Office of the State Council (HKMAO) have the authority to comment on Hong Kong's Legislative Council affairs under Article 22 of the Basic Law of the Hong Kong SAR. In response to this debate and to review the divergent interpretations of Article 22 of the Basic Law by China mainland and Hong Kong commentators, this research examines the legislative history, original intention of Article 22, and its relationship with relevant Chinese law and policies. It argues that the LOCPG HK and the HKMAO are not subject to Article 22 of the Basic Law. Furthermore, these agencies' involvement in Hong Kong issues should be regarded as exercising their lawful authority to supervise Hong Kong's internal affairs rather than as "interference". It advocates that to reduce the conflict in interpretation between Mainland and Hong Kong legal communities, textual analysis, systematic content analysis, and the Chinese legal system should be the bases of future interpretation and application of the Hong Kong Basic Law.
