Η διαμόρφωση του θεσμού του σύγχρονου ευρωπαϊκού πανεπιστημίου αποτελεί συνέπεια μιας μακράς ιστορικής πορείας, οι καταβολές της οποίας εντοπίζονται στον ευρωπαϊκό Μεσαίωνα και τις αρχές των Νεότερων Χρόνων. Τα πνευματικά κινήματα της Αναγέννησης και της θρησκευτικής Μεταρρύθμισης άσκησαν πολύπλευρες επιδράσεις στα ανώτατα εκπαιδευτικά ιδρύματα της εποχής, τα οποία ειαήλθαν σε μία φάση παρακμής στα τέλη του 17ου αιώνα. Η αυξανόμενη εξάρτηση των πανεπιστημίων από τη βούληση της πολιτικής εξουσίας κορυφώθηκε στα τέλη του Ancien Régime: η φθίνουσα πορεία της οργανωτικής αυτοτέλειας των ανώτατων ιδρυμάτων ανε- κόπη στις αρχές του 19ου αιώνα, με το μεταρρυθμιστικό όραμα του W. von Humboldt. Ακολούθησε μια περίοδος σχετικής ανάκαμψης, η οποία προετοίμασε το έδαφος μεταγενέστερων εξελίξεων: της σύνδεσης επιστήμης και έρευνας, της μετάβασης σε πανεπιστήμια-μαζών (και υποχώρησης του ελιτισμού του 19ου αιώνα), της κοινωνικής καταξίωσης του πανεπιστημιακού θεσμού. Προϋπόθεση επιτέλεσης του έργου των πανεπιστημίων στη σύγχρονη παγκοσμιότητα αποτελεί η διατήρηση της οργανωτικής και διοικητικής αυτονομίας τους, την οποία απειλεί να καταλύσει η διαφαινόμενη διαπλοκή των ιδρυμάτων προς μη αμιγώς επιστημονικά ενδιαφέροντα.
Η κρίση της πολιτικής φιλοσοφίας ως ιδιαίτερης μάθησης σχετίζεται με τους μετασχηματισμούς της δημοκρατίας στη νεωτερικότητα. Με βάση αυτή τη διαπίστωση, μπορούμε να διακρίνουμε δύο παραδόσεις μέσα στην πολιτική φιλοσοφία: η μία παράδοση επικεντρώνεται στην καταγωγική έννοια της διαβούλευσης- η δεύτερη, η οποία γεννήθηκε ως αντίδραση στην «αστική-φιλελεύθερη» εκδοχή της διαβού- λευσης, συνδέθηκε με τις θεωρίες της απόφασης. Πίσω από την ένταση μεταξύ των δύο παραδόσεων, αναγνωρίζουμε την αντίθεση του ορθολογισμού και του ιστορισμού η οποία χαρακτηρίζει την ύστερη δημοκρατική νεωτερικότητα. Στο πλαίσιο αυτό, συντελείται η μετεξέλιξη των όρων της διαβούλευσης και της απόφασης. Η διαβούλενση μειώνεται σε ορθολογική συζήτηση γνωμών και δοξογραφικό πλουραλισμό. Η «απόφαση», με τη σειρά της, τείνει να γίνει είτε μία βολονταριστική αυθαιρεσία είτε ένα εργαλειακό decision making. Στο εξής, η ανασυγκρότηση της πολιτικής φιλοσοφίας απαιτεί την ενσωμάτωση ενός δημοκρατικού και θεσμικού βολονταρισμού. Η πολιτική βούληση αναδεικνύεται έτσι σε κριτικό εργαλείο για τη «θεραπεία» της κρίσης της πολιτικής φιλοσοφίας. Εν προκειμένω, η διευρυμένη έννοια της διαβούλευσης -υ- περβαίνοντας τα επίπεδα της απλής διαπραγμάτευσης και γνωμοδότησης- επαναπροσδιορίζει ουσιαστικά το αντικείμενο της σύγχρονης πολιτικής φιλοσοφίας.
Τα τελευταία χρόνια η Ε.Ε. έχει αναλάβει αξιοσημείωτες πρωτοβουλίες προκεμένου να διαμορφώσει μια Ευρωπαϊκή Πολιτική Ασφάλειας και Άμυνας, στα πλαίσια του δεύτερου «πυλώνα» της ΚΕΠΠΑ. Το άρθρο αυτό επιχειρεί να αξιολογήσει τη στρατιωτική πτυχή αυτών των πρωτοβουλιών. Το ερώτημα που θέτει και προσπαθεί να απαντήσει είναι κατά πόσο πραγματώνεται η βούληση της Ε.Ε. να παράγει και να προβάλλει ασφάλεια με τη χρήση στρατιωτικών μέσων στα Δυτικά Βαλκάνια. Η ανάλυση, λοιπόν, των στρατιωτικών επιχειρήσεων ειρήνης στη Βοσνία και την ΠΓΛΜ δείχνει ένα κενό «βούλησης-εφαρμογής», μια σημαντική διάσταση μεταξύ της πολιτικής βούλησης της Ε.Ε να αναλαμβάνει δράσεις επιβολής ή διατήρησης της ειρήνης και του επιχειρησιακού τρόπου με τον οποίο εφαρμόζονται αυτές στο πεδίο. Το κενό αυτό, που το άρθρο προτείνει να αποτελέσει τη βάση μιας διαφορετικής εννοιολογικής προσέγγισης του ρόλου της Ε.Ε ως «προμηθευτή ασφάλειας», παράγεται και αναπαράγει την ιδιόμορφη διαλεκτική υπερεθνικότητας και διακυβερνητισμού που καθορίζει τη δυναμική της ευρωπαϊκής συσσωμάτωσης. Η ανάλυση φανερώνει επίσης ότι αυτές οι στρατιωτικές επιχειρήσεις αποτέλεσαν πεδίο αξιολόγησης και εξέλιξης της ίδιας της Ευρωπαϊκής Πολιτικής Ασφάλειας και Άμυνας.
agriculture is now at a crossroads. It must now meet the expectations of society in terms of environmental protection and move towards a multifunctional model. One of the key instruments of European rural development policy, the second pillar of the CAP, is the granting of agri-environmental aid, i.e. payments to farmers who voluntarily undertake, for a limited period of time, to implement environmentally-friendly farming practices which exceed the level of mandatory requirements. The purpose of this report is to present the agri-environmental scheme applicable in the Walloon Region and to assess, as far as possible, the advantages and disadvantages of preserving and managing the environment in agriculture. After recalling the legal framework, I shall discuss the principles governing agri-environmental aid. I shall then develop the main building blocks and mechanisms designed to ensure their effectiveness. Finally, we will assess their effectiveness and relevance in the light of their environmental objectives. ; L'agriculture est aujourd'hui à la croisée des chemins. Strong public finances are the prerequisite for rebuilding confidence in the state's capacity to act and are key to long-term growth and the creation of favourable employment conditions. The lack of confidence in the sustainability of public finances in some Member States was one of the main triggers of the crisis in the euro area. Many neighbouring countries decided, some even before the so-called 'debt crisis', to introduce debt cap mechanisms in their legislation. Others took firm political commitments which have been maintained over time, the results of which we see today. Among these countries, we will carefully analyse five of them: Sweden, United Kingdom, Switzerland, Chile and Germany. ; Unas finanzas públicas sólidas son el requisito previo para la reconstrucción de la confianza en la capacidad del Estado para actuar y son fundamentales en el crecimiento a largo plazo así como para la creación de condiciones de empleo favorables. Η ανίχνευση - αναγνώριση του ψεύδους αποτελεί διακαή πόθο του ανθρώπου από αρχαιοτάτων χρόνων. Με τους αιώνες, διαφορετικές μέθοδοι έχουν επινοηθεί για την ανίχνευση της εξαπάτησης. Μερικές είναι χαμηλής τεχνολογίας, όπως η εξειδικευμένη αναγνώριση των εκφράσεων του προσώπου, ενώ άλλες υψηλότερης τεχνολογίας, με μέσα και μηχανήματα, όπως ο επονομαζόμενος πολυγράφος ή «ανιχνευτής ψεύδους», μια συσκευή που σχεδιάστηκε στις αρχές του 20ου αιώνα για να εντοπίζει φυσιολογικές αλλαγές του ανθρώπινου οργανισμού, κυρίως μέσω καταγραφής της αύξησης της εφίδρωσης, του καρδιακού παλμού και της αρτηριακής πίεσης, με σκοπό την αναγνώριση του ψεύδους και εφαρμογή σε τομείς όπως, η δικαιοσύνη, ο στρατός και οι μυστικές υπηρεσίες.Πρόσφατες προσπάθειες για την ανίχνευση του ψεύδους επικεντρώθηκαν σε μετρήσεις της εγκεφαλικής δραστηριότητας. Η προσέγγιση αυτή, σε αντίθεση με τις προηγούμενες μεθόδους που ανίχνευαν τη συναισθηματική διέγερση, ανιχνεύει φυσιολογικές αλλαγές που σχετίζονται με γνωστικές διαδικασίες κατά τη διάρκεια της εξαπάτησης και επομένως, σύμφωνα με τους υπέρμαχους της τεχνικής, θα μπορούσε, κατ' αρχήν, να ανιχνεύσει τη διαδικασία της ίδιας της εξαπάτησης. Την πιο γνωστή μέθοδο για τον εντοπισμό μιας «νευροφυσιολογικής διαφοράς μεταξύ εξαπάτησης και αλήθειας» στον εγκέφαλο αποτελεί η Λειτουργική Απεικόνιση Μαγνητικού Συντονισμού (ΛΑΜΣ) (functional Magnetic Resonance Imaging f-MRI), μια μαγνητική αποτύπωση, ουσιαστικά, του εγκεφάλου που δείχνει ότι, η εξαπάτηση βρίσκεται στον προμετωπιαίο φλοιό, ακριβώς πίσω από το μέτωπο. Ωστόσο, αυτές οι προσεγγίσεις «χαρτογράφησης» του εγκεφάλου, πόσο ακριβείς και αξιόπιστες είναι για την εξαγωγή ασφαλών συμπερασμάτων σχετικά με την ανίχνευση του ψεύδους; Ποιες οι ηθικές, νομικές, θρησκευτικές και επιστημονικές προεκτάσεις του ζητήματος από την «εισβολή» των επονομαζόμενων νεύρο-επιστημών για την αναγνώριση του ψεύδους σε προσωπικά δεδομένα, ατομικές ελευθερίες, στο δικαίωμα της σιωπής και μη αυτοενοχοποίησης και στην «ελευθέρα βούληση» του ανθρώπου;Κρίσιμα ερωτήματα, που εξετάζονται στην παρούσα εργασία, σε μια προσπάθεια προσέγγισης της ανίχνευσης του ψεύδους στον εγκέφαλο και των προκλήσεων - προβληματισμών επί του ζητήματος που δύναται να καθορίσει μελλοντικά τον τρόπο που αντιλαμβανόμαστε την ανθρώπινη κοινωνία ; Lie detection and recognition has been an ardent human desire since ancient times. Over the centuries, various methods have been devised to detect fraud. Some methods are low-tech, like the recognition of specialized facial expressions, while others use devices, such as the polygraph or "lie detector" designed in the early 20th century, which measure changes in human body like sweating, heart rate and blood pressure, in order to detect the lie. These methods have various applications in areas such as justice, the military and the secret services. Recent attempts to detect falsehood have focused on measuring brain activity. This approach, unlike previous emotional arousal methods, detects physiological changes associated with cognitive processes during deception and therefore, according to the proponents of the technique, could detect the process of deception itself. The most well-known method of detecting a "neurophysiological difference between deception and truth" in the brain is functional Magnetic Resonance Imaging (fMRI), an MRI brain scan which reveals that deception is located in the prefrontal cortex, just behind the forehead.However, how accurate and reliable are these "brain mapping" approaches to detect lies? What are the moral, legal, religious and social issues arising from the "invasion" of so-called neuroscience into personal data, individual freedom, and the right of non-self-incrimination and the "free will" of human beings? Critical questions, addressed in this paper, in an attempt to approach lie detection in the brain and the challenges - concerns that may determine the way we perceive human society in the future.
International audience The current regulations concerning atmospheric pollutant discharge by incinerators, and the determination of public authorities to do away with waste dumps as of the beginning of the next decade are leading to a heavy demand for new installations. Areas which still use the dump method will have to equip themselves with purpose-built plants, and incinerators built more than twenty years ago will in many cases have to make way for more efficient units which meet the requirements of the legislators. In all, more than 200 new installations should be erected within the next ten years in France alone. The market prospects are even greater in Europe as a whole, since the problem of waste disposal exists under very much the same conditions in neighbouring countries.
Economic decision-making in the European Union suffers at the highest corporate echelons from a lack of diversity, especially for what concerns gender representativeness. This article seeks to contribute to the corporate gender quota debate, reinvigorated by the recent European Commission's Proposal aiming to introduce quotas in boardrooms, by taking some national experiences as a starting point. It will reveal the existence of a plethora of perspectives and introduce a reference to industrial relations, borrowing from corporate governance theory. The article focuses on three selected countries, representing different models of addressing corporate gender imbalance: the United Kingdom, Spain and France.
Τα τελευταία τριάντα χρόνια στην Ιταλία τα ζητήματα σχετικά με το τέλος της ζωής ανήκουν στα πιο αμφισβητούμενα στο πεδίο του Βιοδικαίου. Αναδεικνύοντας κρίσιμα ηθικά, νομικά και πολιτικά διλήμματα, δίχασαν βαθιά την ιταλική κοινωνία, την επιστημονική κοινότητα και τον πολιτικό κόσμο. Σε αυτό το περιβάλλον, το ιταλικό κοινοβούλιο προτίμησε τη σιωπή, ανοίγοντας έτσι τον δρόμο για τη νομολογία των δικαστηρίων. Εκείνη είναι που σταδιακά καθόρισε το νομικό πλαίσιο για την αντιμετώπιση πολλών αιτημάτων αναγνώρισης της ελευθερίας αυτοκαθορισμού και της ανθρώπινης αξιοπρέπειας στην τελευταία φάση της ζωής. Στο άρθρο αυτό επιχειρείται, πρώτα, μια παρουσίαση αυτής της νομολογιακής εξέλιξης, με αναφορά σε τρεις αποφάσεις-σταθμούς, στις οποίες βασίζεται η νομική αντιμετώπιση της υποβοηθούμενης αυτοκτονίας. Στη συνέχεια, παρουσιάζεται ειδικά η υπόθεση Cappato, που προετοίμασε το έδαφος για την ιστορική απόφαση του συνταγματικού δικαστηρίου της Ιταλίας 242/2019, με την οποία κρίθηκε αντισυνταγματική η ποινικοποίηση της υποβοηθούμενης αυτοκτονίας από το άρθρο 580 του ιταλικού Ποινικού Κώδικα. Το δικαστήριο τόνισε ορισμένες κρίσιμες προϋποθέσεις που αποκλείουν εν προκειμένω την ποινικοποίηση: την αυτόνομη, ελεύθερη βούληση του ενδιαφερόμενου προσώπου, τον αναπότρεπτο χαρακτήρα της ασθένειας, την ανάληψη θεραπευτικής προσπάθειας για τη σωτηρία της ζωής, την αδυναμία του προσώπου να υποφέρει σωματική και ψυχική ταλαιπωρία και την διανοητική του ικανότητα να αυτοκαθορίζεται. Μεταξύ των πολλών σχετικών νομικών ζητημάτων, η πρόσφατη υπόθεση Trentini ανέδειξε την ανάγκη ανάλυσης του όρου της θεραπευτικής προσπάθειας, που πρέπει να περιλαμβάνει τη φαρμακευτική αγωγή, αλλά και κάθε άλλο μέσον σωτηρίας της ζωής. Συμπερασματικά, το άρθρο επιχειρεί να μελετήσει τη διάδραση μεταξύ νομοθετικής και δικαστικής λειτουργίας στην αντιμετώπιση αυτών των ζητημάτων σε αναφορά με τα σημαντικότερα ζητήματα ερμηνείας των σχετικών συνταγματικών διατάξεων, συμπεριλαμβανομένων των πρωτοβουλιών νέας νομοθεσίας που έχουν εκδηλωθεί, καθώς επίσης και της διενέργειας πιθανού δημοψηφίσματος. ; In the last three decades, the dilemma of End-of-Life is one of the most disputed bio-juridical questions Italy is confronting with. By raising highly sensitive ethical, legal and political dilemmas, it has deeply divided the Italian society, the scientific community and the political arena. In the context of a raging controversy, the Italian Parliament has opted for silence. Thus, an evolutive, judicial route has marked the legal frame in response to numerous, concrete demands of recognition of the freedom of self-determination and value of dignity in the final phase of life. In this review article, an overview of the judicial evolution of the complex mosaic of end-of-life issues will be firstly offered through three cases, pillars on which the latest judicial evolution on assisted suicide lays its foundations. Secondly, the issue of assisted suicide will be singularly addressed through the examination of the Cappato case which has outlined the path for the historical ruling of the Italian Constitutional Court, no'242 of 2019 on the constitutional illegitimacy of the crime of assistance to suicide under article 580 of the Italian Criminal Code. Precisely, the Court has pointed out several, concurrent requirements in presence of which an active conduct directly connected with suicide is not criminally relevant: the autonomous and free formation of the individual will, the irreversible nature of the disease, the ongoing practice of a life-saving treatment, the intolerability of the physical or psychological sufferings and the mental capacity to self-determination. Among the numerous, emerging, interpretative questions, the latest Trentini case, in which the requirement of life-saving treatment has been interpreted as inclusive of pharmacological therapy and of every material, sanitary life-saving assistance, will be further evaluated. Conclusively, a cross section of the fragile interplay between the legislative power and the judiciary power will be depicted in reference to the main open interpretative questions related to the enforcement of the constitutional ruling and a portrait of the upcoming scenerios, as the existing legislative drafts and the prepositive referendum question, will be concisely examined.
There are many criteria which determine whether a city is a good capital. Ecological considerations lead us to place more emphasis on one criterion in particular, i.e. the more or less central location of the capital within the territory. Which European city meets this criterion best? Is the choice of Brussels as capital of the European Union likely to withstand the growing importance of this criterion and the continued enlargement towards the east? In order to answer these questions, this article defines four centres of gravity – 'diplomatic', 'demographic', 'metropolitan' and 'civic' – using new databases and computation techniques. Within the framework of the EU-27, Prague comes first from a 'diplomatic' point of view, Frankfurt from a 'demographic' point of view, Luxembourg from a 'metropolitan' point of view and Brussels from a 'civic' point of view. In a maximalist scenario of enlargement towards the east, this group is replaced by Vienna, Munich, Strasbourg and Brussels. The fourth criterion – which is the most favourable to Brussels – is also, on the surface, the most unstable. This article ends with a discussion of the mechanisms which are likely to ensure that Brussels will keep the 'civic centrality' imparted to it historically by chance.
Report of Mercosur countries on the breakdown of the constitutional order in the Republic of Paraguay, expressing the firm hope that the ongoing electoral process in the country will lead to the full normalisation of its institutional life and reiterates the firm commitment to take action against any breach of democratic order in the region. It also deals with decisions to be taken on human rights in Latin America. as in the first COVID-19 epidemic wave in 2020, communications from the Ministry of Health and the press warn us that hospitals in France are saturated or about to be saturated. In several French regions, surgical operations are deprogrammed. The caregivers, who are remobilised even when they are ill, show signs of exhaustion or even strike. What do we know about hospital tension? The purpose of this note is to clarify how it is measured, to clarify how the hospital stress indicator is constructed, based on the analysis of its national and regional trends. This leads us to highlight the role of this indicator in the policies put in place in times of epidemic. To this end, we will discuss four questions. How has hospital tension evolved since the beginning of the pandemic? Does it have major regional disparities? How is hospital stress calculated? What does this indicator of hospital stress not say? ; Comme lors de la première vague épidémique de Covid-19 en 2020, les communications du Ministère de la santé et la presse nous alertent sur le fait que les hôpitaux de France sont saturés ou sur le point de l'être. Dans plusieurs régions françaises, des opérations chirurgicales sont déprogrammées. Les soignants, remobilisés même lorsqu'ils sont malades, montrent des signes d'épuisement, voire se mettent en grève. Que savons-nous de la tension hospitalière ? In this short paper I ask to what extent the sharp contrast between the political and the comprehensive, on which political liberals such as Rawls and Quong place primary emphasis, caters to a truly "political" conception of liberalism. I argue that Quong's own take on this point is more distinctively "political" than Rawls's, in that it assigns far less weight to citizens' comprehensive doctrines. Indeed, I suggest that Quong's exclusion of comprehensive doctrines (exemplified by his worries about an "overlapping consensus") has more radical implications than Quong himself seems to think. In doing so, I offer a streamlined version of Quong's critique, which encompasses two more or less direct criticisms of Rawls's doctrine of the overlapping consensus. I will call them the "sincerity objection" and the "liberal objection".
