INSTITUTIONS OF GALICIA AS PART OF AUSTRIA AND AUSTRIA-HUNGARY (MID-NINETEENTH – EARLY-TWENTIETH CENTURY) ; ДЖЕРЕЛЬНА БАЗА ДОСЛІДЖЕННЯ НАМІСНИЦТВА ТА ІНШИХ ІНСТИТУТІВ МІСЦЕВОГО УПРАВЛІННЯ ГАЛИЧИНИ У СКЛАДІ АВСТРІЇ ТА АВСТРО-УГОРЩИНИ (СЕРЕДИНА ХІХ – ПОЧАТОК ХХ СТОЛІТЬ)
The information source of the research of the vicegerency and other local (regional) government bodies consists of: brevets, decrees, the highest rulings, edicts, resolutions, orders, regulations and letters with instructions from the Emperor of Austria and his government, regulations and writs of the Ministry of Internal Affairs, Local Defence, Religion and Education, State Finances, Trade, Railway Lines, Agriculture, Justice and the Ministry of Public Works, regulations of the vicegerent and vicegerency, rescripts of the vicegerency presidium, internal reminders and notifications, usually addressed to the elders of Galicia powiats and leaders of one or several vicegerency departments, letters to the vicegerency from elders, police directors and other civil servants, along with resorts with private requests from public servants and local residents to the vicegerency.A vast amount of documents used in the research is published in Universal Newsletter of Laws of the State and Government for the Austrian Empire.Some texts of regulatory enactments of central and local authorities can be extracted from unofficial legislation authorial collections that are grouped not according to the chronological approach, but according to the branch one (for example, constitutional legislation wasregulated by professor S. Starzhynskyi, professor F. Kasparek was responsible for the research and regulation of the administrative legislation, health legislation was regulated by the group of authors).Full-scale information regarding the manning of the vicegerency is contained in so called shematyzms.As far as archival materials are concerned, the most of them that enlighten the functioning of the Galicia Vicegerency and other governing authorities and bodies are contained in the Ukrainian Central State Historical Archive in the city of Lviv (Ukrainian TsDIAL). The biggest fund of the archive № 146 is called the same, «Galicia Vicegerency». This fund contains almost two hundred thousand acts, it embraces the period from 1448 – 1934. Each act contains from one (seldom) to several tens, and sometimes even hundreds of separate historical documents that reflect the functioning of the vicegerency and means of its conduct of business.Therefore, the research of the institution of the vicegerency in 1849–1918 has a substantial (yet unregulated) information source that has been collected for more that seventy years. Some regulatory enactments that concerned the functioning of the Galicia Vicegerency in Ukraine were not found, yet the existing recordsare sufficient for the full-scale legal analysis of the indicated authority. ; З метою удосконалення історико-правових знань про джерельну базу дослідження місцевих інститутів влади й управління Галичиною у складі Австрії та Австро-Угорщини (середина ХІХ – початок ХХ століть) досліджено найвагоміші першоджерела, якими австрійський уряд регулював діяльність намісництва та сейму у Галичині, повітових урядів та численних органів, що входили до складу намісництва (різних кваліфікаційних комісій, Дирекції допоміжних установ тощо), а також органів, якими керував намісник чи його заступник, до керівних органів яких входили представники намісництва (Крайової шкільної ради, Крайової фінансової дирекції тощо). Результати проведеного дослідження дають підставу стверджувати, що джерела, які регулювали діяльність органів влади у Галичині публікували регулярно, зберігаються у бібліотеках та архівах Львова, однак досі систематизовані (за окремими винятками) лише за хронологічним принципом, що утруднює, а в деяких випадках унеможливлює, пошук потрібного акту нормативно-правового змісту.
