The occupation of Crimea by the Russian Federation as well as the six-year war in eastern Ukraine were the main reasons for the termination of the Great Treaty between our state and Russia.These challenges to Ukraine and all international security as well require the search for adequate answers to change the situation, first of all the cessation of the war and the return of 408 km of the Ukrainian-Russian border.The platform for finding a common solution to the existing challenges is the Minsk Agreements, which were signed on September 5, 2014 by Ukraine, Russia, representatives of the DPR and LPR and a representative of the OSCE.The article examines the prerequisites for signing these agreements, the state of their implementation in 2014-2015, and later – from 2015 to 2019 with the participation of the representatives of Ukraine, Russia, Germany and France.The analysis and generalization of the normative documents developed in the course of joint work in the "Norman format" is carried out.The problems of implementation of the agreements signed by Petro Poroshenko, who was the President of Ukraine, were emphasized.An analysis of the assessments of the agreements of September 5, 2014, which are contained in the works of many authors, reviewers of various media, as well as the provisions and assessments of Vladimir Horbulin, given in his works.It was concluded that, despite the negative attitude of many politicians and scholars to the Minsk agreements, the signed document was necessary in order to:- first, to suspend the offensive of Russian troops after Ilovaisk;- secondly, to regroup the Armed Forces of Ukraine and strengthen defensive positions;- thirdly, to involve the leading countries of Europe and the world in solving the problems in the East of Ukraine.At the same time, the author fully agrees with V. Horbulin that there are only two ways in Ukraine: either to become a strong state, or to face a real danger of absorption. ; Окупація Криму РФ, а також шестирічна війна на Сході України стали головною причиною припинення Великого договору між нашою державою та Росією.Ці виклики Україні і всій міжнародній безпеці вимагають пошуку адекватних відповідей на зміну ситуації, в першу чергу припинення війни та повернення 408 км українсько-російського кордону.Платформою для пошуку спільного вирішення існуючих викликів є Мінські угоди, які були підписані 5 вересня 2014 року Україною, Росією, представниками ДНР та ЛНР і представником ОБСЄ.У статті досліджено передумови підписання цих угод, стан їх виконання у 2014-2015 рр., а також пізніше – з 2015 по 2019 рр. за участі представництва України, Росії, Німеччини і Франції.Здійснено аналіз і узагальнення нормативних документів, що розроблені в процесі спільної роботи у нормандському форматі.Наголошено на проблемах виконання угод, підписаних Петром Порошенком, що був Президентом України.Зроблено аналіз оцінок домовленостей від 5 вересня 2014 року, які містяться в роботах багатьох авторів, оглядачів різних ЗМІ, а також положень і оцінок Володимира Горбуліна, наведених у його працях.Зроблено висновок, що, незважаючи на негативне ставлення до Мінських угод багатьох політиків і науковців, підписаний документ був необхідний для того, щоб:- по-перше, призупинити наступ російських військ після Іловайська;- по-друге, перегрупувати Збройні Сили України та зміцнити оборонні позиції;- по-третє, залучити до вирішення проблем на Сході України провідні країни Європи та світу.У той же час автор повністю згоден з В. Горбуліним про те, що в України є лише два шляхи: або стати сильною державою, або зіштовхнутися із реальною небезпекою поглинання.

Based on the gray zone concept the potential of mediation as an alternative conflict management and dispute resolution is assessed. Based on color, the "gray zone" metaphor is a conceptual framework for exploring the complex nature of contemporary conflicts, which outwardly resemble a "neither war nor peace" situation. It has been clarified that the gray zone concept, common in Western political science, comes from US intelligence documents and is used to describe conflicts in general, phases of conflict, operational environments or tactics resorted to by participants in various types of conflicts (conventional, hybrid, etc.). To test the hypothesis of the ineffectiveness of mediation in the "gray zone," we chose the conflict in eastern Ukraine, which, although it crossed the threshold of the "black zone" in 2014, remains a fragment of the "gray zone" in relations between Russia and the West. The existence of a "gray zone" in the conflict in Donbass has been proven based on criteria formed by other researchers, mainly concerning the composition of participants and tactics of struggle. It has been established that the gray zone creates unfavorable conditions for mediation. It shows how participants, and their proxies can use mediation to control the actions of their adversaries and thus fuel the conflict without crossing the threshold of war. The assessment of the potential of mediation in the "grey zone" includes the behavior of the conflict participant (the Russian Federation), which positions itself as a "mediator"; the characteristics of the regional international organization (OSCE) as mediator; the structure (Normandy format, TKG) and mediation tools; the negotiating positions of participants in the negotiation process and the status of implementation the agreements reached on the settlement. It is proved that the resolution of the "grey zone" conflicts depends on bilateral or multilateral negotiations between the "great states" which have sponsored non-state actors responsible for the main grey zone ...

Заснована на кольорі, метафора «сірої зони» є концептуальним підґрунтям для дослідження складної природи сучасних конфліктів, які зовні нагадують ситуацію «ні війни, ні миру». Уточнено, що поширений у західній політичній науці концепт «сірої зони» походить з документів розвідувальних служб США і використовується для опису конфліктів загалом, окремих фаз конфлікту, операційного середовища або тактик, до яких вдаються учасники у різних типах конфліктів (конвенційних, гібридних тощо). Для перевірки гіпотези про неефективність медіації у «сірій зоні» було обрано конфлікт на сході України, який хоча і перетнув поріг «чорної зони» у 2014 р., але залишається фрагментом «сірої зони» у відносинах між РФ та Заходом. Наявність «сірої зони» у конфлікті на Донбасі було доведено на основі опрацьованих іншими дослідниками критеріїв, які в основному стосуються складу учасників і тактик боротьби. Встановлено, що «сіра зона» створює несприятливі умови для медіації. Показано, як учасники та їх довірені особи (проксі) можуть використовувати посередництво для контролю дій своїх супротивників і у такий спосіб підживлювати конфлікт, не перетинаючи порогу війни. Оцінка потенціалу медіації у «сірій зоні» включає поведінку учасника конфлікту (РФ), який позиціонує себе як «посередника»; особливості регіональної міжнародної організації (ОБСЄ) як медіатора; структуру (Нормандський формат, ТКГ) та інструменти посередництва; переговорні позиції учасників переговорного процесу та стан виконання досягнутих домовленостей з врегулювання. Доведено, що вирішення конфліктів «сірої зони» залежить від двосторонніх або багатосторонніх переговорів між «великими державами», які спонсорують недержавних акторів, відповідальних за основну діяльність «сірої зони» на тактичному рівні.

The article presents a discourse-analysis a set documents which have different origins are related to policy-making the conflict resolution and the restoration of peace in eastern Ukraine. The focus of the analysis is the Ukraine draft law "The principles public policy in transition", which has approved by the Cabinet of Ministers of Ukraine and currently has registered in parliament. The framework of the analysis is based on media reports, which have formed the communication of this document, and the currently signed political agreements on the settlement of the conflict with the participation of Ukraine and Russia. The myth of "non-compliance with the Minsk agreements" which is spread in the Russian and pro-Russian media is more common message than another media-reports. It has been proved that this myth is derived from the strategic myth of "the non-alternative nature of the Minsk agreements as a peaceful settlement of the conflict in Donbas." Dissemination of media-reports about ignoring or inconsistency the draft text law on the transition period with the Minsk agreements is aimed to discrediting the efforts of the Ukrainian authorities to offer alternatives the conflict resolutions in Donbas or to expand the negotiations operational field under the Minsk agreements. The production and promotion of opposing myths is a sign of the willingness of both sides the conflict to continue the struggle in both the information and political spaces. As a result, it undermines the potential of negotiations, adds arguments in favor of unilateral action or forceful resolution of the conflict, increases the polarization in Ukrainian society, which is forced to decide between the extreme options in choosing a public policy to «ORDLO» (temporarily occupied territories of Ukraine). The draft law on the transition period reflects the public sentiment is characteristic of the acute phase of the conflict, with a low level of willingness to compromise and awareness of the usefulness of the negotiation process. ; У статті здійснено дискурс-аналіз комплексу різних за походженням документів, що стосуються вироблення політики врегулювання конфлікту і відновлення миру на сході України. У фокусі аналізу знаходиться проєкт закону України «Про засади державної політики перехідного періоду», схвалений Кабінетом міністрів України і наразі зареєстрований у парламенті. Рамку аналізу було обрано на основі медіа-повідомлень, які формують комунікацію зазначеного документу, та підписаних на даний момент політичних угод з питань врегулювання конфлікту за участі України та Росії. Серед різних медіа-повідомлень було обрано міф про «невідповідність Мінським угодам», поширений у російських та проросійських ЗМІ. Доведено, що цей міф є похідним від стратегічного міфу про «безальтернативність Мінських угод як мирного врегулювання конфлікту у Донбасі». Поширення медіа-повідомлень про ігнорування або невідповідність тексту законопроєкту про перехідний період Мінським угодам націлене на дискредитацію зусиль української влади запропонувати альтернативні варіанти врегулювання конфлікту на Донбасі або розширити оперативне поле переговорного процесу в рамках Мінських домовленостей. The establishment and activities of the Joint Center for Control and Coor- dination (JCCC) for ceasefire and adjustment of the separation line have not been described andanalyzedin the scientific literature. This body was created according to the decision of the tripartite contact group with the purpose of ceasefire, adherence to the security regime in the conflict zone, preventing the resumption of combats. There are control points and monitoring groups within the JCCC along the col- lision line for urgent resolution of the tasks assigned to the Joint Center. Information on ceasefireviolations and otherbreachesfrom the side ofthe Rus- sian occupation forces and supported by themillegal armed groups, as well as violations from the Ukrainian side, reaches the Special Monitoring Mission of the Organization for Security and Cooperation in Europe (SMM of the OSCE). This bodyverifies provided information and publishes reports on the performedwork on its web–site in in English, Ukrainian and Russian. In this way, the information is communicated to the public not only of our country, but to the whole World. The unilateral withdrawal of the Russian Federation from the JCCC was per- ceived negatively in the World. Ukraine and the European Union call the Russian Federation to return its military personnel to work within this format. The repre- sentatives of illegal armed groups in the occupied territories, who unjustifiably and by their own decision assumed the powers of the JCCC, do not have such pow- ers. At the same time this is a gross attempt to legitimize both illegal pseudo–state entities and the Russian military presence in the territory of Ukraine. At the same time,the JCCC operates only in Ukraine–controlled territory, in non–controlled areas activities of the SMM of OSCE face counteracting. ; Розкрито засади створення і функціонування Спільного центру і його роль у дотриманні Мінських угод, які діють в особливих районах Донецької і Луганської областей.

The article highlights the contemporary challenges of armed aggression against Ukraine, analyzes the basic provisions of the Great Treaty with Russia, compares the format of bilateral relations between Ukraine and Russia since independence. According to the research of experts, politicians, and in particular academician Vladimir Horbulin, conclusions were drawn and the stages of deterioration of bilateral relations were outlined. The examples of the culmination of the relations between the two parties are given, in particular, the consequences for Ukraine and the EU of the gas wars 2006-2009 are analyzed. The stages of tension increase in the context of the Black Sea Fleet presence in Sevastopol are traced, which eventually led to the annexation of Crimea. The author gives specific examples of Russia's application of a comprehensive approach to Ukraine using the available levers of influence in the energy, economic, social, political and humanitarian fields. It was emphasized that the intensity, nature and purpose of the practical actions of the Russian Federation towards Ukraine had the strategic purpose of establishing a protectorate over our country and achieving a strategic goal, namely the territorial division of Ukraine and the inclusion of the South and East in the Russian Federation. The task was to set up a puppet government in the territory of Central Ukraine and to distinguish it from the Western part of our state as the main "troublemaker". Based on the above arguments, based on the findings of experts Vladimir Horbulin and Alexander Litvinenko, the author predicts the further development of Ukrainian-Russian relations on the eve of the meeting of the President of Ukraine in the Normandy format on the situation in the East of Ukraine and in the energy sector. At the same time, the author fully shares the experts' opinion that there are only two ways in Ukraine at the turn of 2020-2025: either to become a strong state or to face a real danger in the future. ; У статті висвітлюються сучасні виклики збройної агресії проти України, аналізуються базові положення Великого договору з РФ, порівнюється формат двосторонніх відносин між Україною та Росією з часів отримання незалежності до сьогодення. За результатами досліджень експертів, політиків, і зокрема академіка Володимира Горбуліна, зроблено висновки та окреслено етапи погіршення зазначених відносин. Наводяться приклади кульмінації у відносинах двох сторін, зокрема аналізуються наслідки для України та ЄС «газових воєн» 2006-2009 рр. Простежуються етапи зростання напруги в контексті перебування Чорноморського флоту РФ у Севастополі, що в кінцевому підсумку привело до анексії Криму. Автор наводить конкретні приклади застосування Росією комплексного підходу щодо України з використанням наявних важелів впливу в енергетичній, економічній, суспільно-політичній та гуманітарноінформаційній сферах. Наголошено, що інтенсивність, характер і цільова спрямованість практичних дій РФ стосовно України мали стратегічну ціль встановлення протекторату над нашою державою і досягнення стратегічної мети, а саме територіального розділу України та включення Півдня і Сходу до складу Російської Федерації. В подальшому ставилися завдання створення маріонеткового уряду на теренах Центральної України і відмежування від західної частини нашої держави як основного «порушника спокою». На підставі наведених аргументів, що базуються на висновках експертів Володимира Горбуліна та Олександра Литвиненка, автор прогнозує подальший розвиток українсько-російських відносин. Разом з цим автор повністю поділяє висновок експертів про те, що в Україні на рубежі 2020 2025 рр. є тільки два шляхи: або стати сильною державою, або зіштовхнутися з реальною небезпекою в перспективі.

It was emphasized that the intensity, nature and purpose of the practical actions of the Russian Federation towards Ukraine had the strategic purpose of establishing a protectorate over our country and achieving a strategic goal, namely the territorial division of Ukraine and the inclusion of the South and East in the Russian Federation. The task was to set up a puppet government in the territory of Central Ukraine and to distinguish it from the Western part of our state as the main "troublemaker". Based on the above arguments, based on the findings of experts Vladimir Horbulin and Alexander Litvinenko, the author predicts the further development of Ukrainian-Russian relations on the eve of the meeting of the President of Ukraine in the Normandy format on the situation in the East of Ukraine and in the energy sector. At the same time, the author fully shares the experts' opinion that there are only two ways in Ukraine at the turn of 2020-2025: either to become a strong state or to face a real danger in the future. ; У статті висвітлюються сучасні виклики збройної агресії проти України, аналізуються базові положення Великого договору з РФ, порівнюється формат двосторонніх відносин між Україною та Росією з часів отримання незалежності до сьогодення. За результатами досліджень експертів, політиків, і зокрема академіка Володимира Горбуліна, зроблено висновки та окреслено етапи погіршення зазначених відносин. Наводяться приклади кульмінації у відносинах двох сторін, зокрема аналізуються наслідки для України та ЄС «газових воєн» 2006-2009 рр. Простежуються етапи зростання напруги в контексті перебування Чорноморського флоту РФ у Севастополі, що в кінцевому підсумку привело до анексії Криму. Автор наводить конкретні приклади застосування Росією комплексного підходу щодо України з використанням наявних важелів впливу в енергетичній, економічній, суспільно-політичній та гуманітарноінформаційній сферах. Наголошено, що інтенсивність, характер і цільова спрямованість практичних дій РФ стосовно України мали стратегічну ціль встановлення протекторату над нашою державою і досягнення стратегічної мети, а саме територіального розділу України та включення Півдня і Сходу до складу Російської Федерації. В подальшому ставилися завдання створення маріонеткового уряду на теренах Центральної України і відмежування від західної частини нашої держави як основного «порушника спокою». На підставі наведених аргументів, що базуються на висновках експертів Володимира Горбуліна та Олександра Литвиненка, автор прогнозує подальший розвиток українсько-російських відносин. Разом з цим автор повністю поділяє висновок експертів про те, що в Україні на рубежі 2020 2025 рр. є тільки два шляхи: або стати сильною державою, або зіштовхнутися з реальною небезпекою в перспективі.

Cognitive framing, understood as managing by social agents within their discursive practices of cognitive frames in order to achieve certain political goals, is a part and parcel of any international conflict settlement, taking into account the very social nature of the latter. At the same time, the existing narrative models of conflict regulation provide an opportunity for successful investigation and modification of seman- tic matrices of the parties' positions, as within informational and psychological operations. Therefore, the study of cognitive frames and their respective reframing, which changes the semantic dimension of a con- flict, allows it to be resolved more quickly and effectively. However, despite the largely neutral semantics of the negotiation process within the Minsk-1 and Minsk-2, as well as the "Normandy format", discursive practices of both Ukraine and Russia of the highest political level today are filled with numerous confrontational cognitive frames. The latter signifies about an active phase of a semantic war between the two parties, which is currently hampering the efficient settlement of the ongoing inter- national conflict. Which, in turn, requires the parties to develop more efficient frames for sufficient transformation of the semantic dimension of the Russia-Ukraine international conflict and its subsequent settlement. ; У статті актуалізується роль когнітивного фреймінгу як одного з інструментів врегулювання міжнародних конфліктів, спрямованого на видозміну картин світу відповідних сторін. Проведено паралель між реалізацією даного методу та інформаційно-психологічними операціями. Зроблено наголос на значенні когнітивного фреймінгу в переговорних процесах щодо врегулювання міжнародних конфліктів. Охарактеризовані окремі особливості керування сприйняттям в рамках Мінських угод початку 2015 року в порівнянні з дискурсивними практиками вищих посадових осіб України та Російської Федерації.
