The definition of authorities and the order of their acquirement by legislative bodies and executive power are considered in the article. The legitimacy of authorities in case of their acquirement by these bodies as well as the origin of authorities from the Ukrainian nation are under attention. The power considered as a characteristic element of authorities and the local government bodies and their official individuals possess such attribute as authoritativeness. It attests the genesis of this phenomenon, its origin from nation power. Nation as a source of power possesses this power in top extent and as a carrier of sovereignty concentrates main public functions. In civilized civil society they are allocated between country and other institutions depending on domains, on things of competence and on the extent of the obligatory of their authorities. The Main Law of Ukraine defines also the order of government formation. If parliament gets authority concerning the fulfillment of power directly from electors – the citizens of Ukraine, then the Cabinet of Ministers of Ukraine as the as supreme body of executive power receives necessary authority from Verhovna Rada of Ukraine, as it administered to accomplish the laws of Ukraine accepted by Verhovna Rada, having in mind that these laws are not only to define the order of government activity but also to establish its rights, duties and the circle of competence. Hereby, Verhovna Rada of Ukraine delegates the part of authorities received from Ukrainian nation – Ukrainian citizens of all nationalities, expressing sovereign will of nation to the Cabinet of Ministers of Ukraine. State power authorities in the domain of executive power along with responsibility for their fulfillment are allocated in order determined by the Constitution and laws of Ukraine. However, it is important that citizens of Ukraine can directly accredit the bodies of executive power to fulfill certain functions of state government adopting laws by referendum. Therefore in first case the indirect delegacy of authoritative authorities happens, in another – delegacy is direct. Hereby, the general rule of acknowledgement of the legitimacy of authorities to the body of legislative or executive power, or functionary is that they both acquire authorities on the basis of the adherence of all demands of legislation and act in the manner determined in it. ; В статті розглядаються поняття повноважень та порядок їх набуття органами законодавчої і виконавчої влади. The basis for constructing scientific models of constitutional and legal status of judges should put the following provisions: First, constitutional and legal status of judges should not be considered outside the context of the constitutional powers of man and citizen, meaning and scope of rights, fundamental freedoms and duties enshrined in the Constitution of Ukraine, which is the foundation, foundation special legal status of judges;Secondly, the Law of Ukraine "On the Judicial System" has given judges the status of official state (judicial) authorities, indicating the need to take into account the peculiarities of the legal status of this category of persons in determining the structure and nature of the legal elements of constitutional and legal status of judges.Thus, the constitutional and legal status of judges of courts of general jurisdiction is the system of general, fundamental principles by which the Constitution and other laws determined the actual position of judge in the state and society. In other words, the constitutional and legal status of judges of courts of general jurisdiction, including rules of the Constitution and other sources of constitutional law and requires further research to disclose the content and nature of this legal category.An important aspect of the study of constitutional and legal status of judges of courts of general jurisdiction is to analyze its structure. As for the structure of constitutional and legal status of the subjects of constitutional and legal relations, among the lawyers there is no unity of opinion on the range of its main components. Thus, proponents of a narrow approach to include such elements only rights and obligations, sometimes competent subjects of constitutional law and consider this phenomenon as one of the main means of influencing the constitutional right to social relations. For example, a lawyer VY splinter sees the most important feature of the legal status of the subjects of constitutional law is that they integrate the rights and obligations of entities that meet their social role in the mechanism of democracy, reflecting the common purpose, unity law as a member of the constitutional relationship, that is, combining different types of subjects of this branch of law in the whole system. ; Розглянуті основні визначення конституційно-правового статусу суддів судів загальної юрисдикції. Article deals with problem of the participation of the municipalities in tax administration in the Republic of Lithuania.The purpose of the article is clarify how municipalities may participate in tax administration in the Republic of LithuaniaThe methodology of the research includes the analysis of Constitution and legislation of Republic of Lithuania, system analysis, logical-analytical method.Results, scope of it's application. The existence of a unified state tax system, does not mean that the administrative-territorial unit (municipality) do not possess certain powers upon the introduction of taxes and (or) in the regulation of their collection. So, municipalities obtain part of the revenue by taxes, which rates are established by the councils of municipalities, not exceeding statutory dimensions, etc. Participation of municipalities in tax administration bases on the provisions of the Constitution on the law of the administrative territorial units to self-government and to have their own budget.Elements of centralization and decentralization, based on the recognition of the single state tax system, are combined in Lithuania in the determination of tax competence.The tax legislation of the Republic of Lithuania almost does not provide for local governments to participate in the tax collection process or in monitoring their collection.Tax laws provide the right to local authorities to refine (adjust) the individual elements of taxes, although the establishment of these elements remain the exclusive right of bodies of the state (central) authorities. Besides, local authorities have the right to establishment and the provision of common and individual tax benefits, the right to use the incomes received in the form of taxes, etc.Conclusions. Local authorities are involved in the process of tax regulation and possess a certain autonomy in this area – the Council of the municipality has the right to adjust tax rates and provide tax incentives at the expense of its budget. In exercising such rights, local self-government bodies detail the provisions of the tax laws. For this reason, any research of power needs preliminary explanations regarding its subject and the introduction of distinctions to narrow the problematic field. The first distinction in this research is the opposition of power and violence, which allows focusing on one of the traditions in interpretations of the legitimacy of public power. The second distinction in the understanding of power is between approaches of atomism (individualism) and holism (collectivism). This is the distinction between intelligent and selfish individuals who pursue private interests and individuals (also intelligent, but not extremely selfish), who are aimed at achieving the common good. It is noted that the legitimacy of power cannot be justified by the potential threat of the use of violence; therefore the only source of it is the support of citizens. Only public power can be legitimate. The third distinction is the subject of this research: the analysis of the features of liberal, republican and discursive traditions in the treatment of publicity, public sphere (space), legitimacy of public power, etc. The research of publicity or public sphere was initiated in the liberal tradition. The representatives of the liberal tradition stressed the need for openness, rationality, and criticism in relations between power and citizens. The representatives of the republican tradition continued the research of public sphere and public power in terms of inclusiveness (inclusion) in the ruling process of the majority of citizens, their equality to choose and be elected. They reminded that democracy is, first and foremost, a «shared cause» for all citizens. Public sphere is characterized by the versatility and the competitiveness of citizens who possess civil (republican) virtues.In the works of the German researcher J. Habermas, who argues with the liberals and the republicans, the normative ideal of publicity (or «public sphere» in the English translation of the Habermas's term «Offentlichkeit») is presented in terms of the discursive approach.Thus, the prerequisite for the legitimacy of public power is democratic elections, the result of which gives winners the right to power; the legitimacy of public power is substantiated in the moral and political discourse; the process of ensuring the legitimacy of public power requires communication based on rational arguments between power and citizens.To sum up, the legitimacy of public power is created and reproduced as a result of rational interaction in the public sphere between power and citizens. This allows overcoming both the selfishness of individuals and the compulsion of the state. ; У статті досліджується проблема легітимності публічної влади. The article reveals the institutional and organizational dimensions of the legitimacy of public power.In the context of the Weberian tradition of understanding the legitimacy of order, it is determined that ensuring the legitimacy of individual political actors – individuals and organizations – is impossible without the legitimacy of the conventional and legal order. It is noted that not only the distinction between institutions and organizations, but also the refusal to reduce the whole organizational diversity of the "state" to a single actor is of utmost importance for ensuring the legitimacy of public power.It is emphasized that democratic rules of the political game should not just be declared by individual political players, but be recognized by the majority of citizens as at the level of convictions, and be implemented at the levels of daily life and political activity. This means that the social convention on the implementation of democratic institutions should become legitimate for all social activities and social relations. Using the Weberian category of "octroying", another legitimate way of establishing a new order for the post-authoritarian regimes is demonstrated. It is noted that artificially established institutions (the rules of the game that operate in the societies of consolidated democracy) are often not effective in the post-Soviet space and do not always contribute to the legitimacy of power. At the same time, the "constitutionalization" of the political process, even if it takes place through a vote in the parliament or is passed in a referendum, does not ensure the automatic establishment of democracy and legitimacy of public power.Based on the distinction of institutions and organizations (D. North), there are shortcomings in both electoral democracy and the octroying of the legal order in terms of the theory of legitimacy. It is determined that one of the main tasks for post-Soviet societies is to establish the legitimacy of the democratic order, without which the transition from the electoral democracy to the consolidated one cannot be completed.The necessity of simultaneous institutional and organizational political transformations to ensure the legitimacy of the social order and public power under conditions of democratization in Ukraine is substantiated. ; У статті досліджуються інституційний та організаційний виміри легітимності публічної влади.У контексті веберіанської традиції розуміння легітимності порядку визначено, що забезпечення легітимності окремих політичних акторів – індивідів та організацій – неможливе без легітимності конвенціонального та правового порядку. The article is devoted to determining the role and place of international organizations and institutions in the law-making process in Ukraine. The concept of law-making is analyzed and defined system of its subjects; the stage of law-making process is highlighted; the directions and results of participation of international organizations in the national law-making process are described.The author finds that international organizations tend to join the law-making process at the stage of elaboration and elaboration of the bill by conducting an expert examination, conducting consultations in support of the relevant reforms, and participating in monitoring the implementation of the adopted legislation. As an appropriate organization on the basis of an international agreement or constituent instrument, the Ukrainian side (the subject of the drafting of the bill, national experts, etc.) may initiate the participation of an international organization or institution in the law-making process.Based on the analysis, a conclusion is drawn on the role and place of international organizations and institutions in the lawmaking process in Ukraine ; Стаття присвячена визначенню ролі та місця міжнародних організацій у правотворчому процесі в Україні. The article is devoted to the analysis of the transformation of the constitutional and legal status of the prosecutor's office in independent Ukraine, from its Soviet model with broad control and supervisory powers to the prosecutor's office of a democratic, rule of law state, its place in the modern system of public authorities.In the article, the analysis of modern reform processes in the system of the national prosecutor's office is combined with the coverage of models in the latest world constitutional and legal practice to different branches of power, and from that place the role and importance of the prosecutor's office in the system of state power. In scientific constitutionalism, there are several options for attributing a prosecutor's office to a particular branch of state power, or even defining it as a separate body of state power. The option of attribution of the prosecutor's office to the executive power system has been successfully implemented in the states making practice of the USA, Denmark, France, the Netherlands, Germany, Austria, Poland, and Sweden.The model of including the prosecutor's office in the legislative branch has the right to life, but it has not become widespread. Contrary to this model, the prosecution's attribution to the judiciary became a reality in Spain, Bulgaria, Croatia and other countries. In the Constitution of these states, the provisions on prosecutorial authorities and the regulation of their activities are contained in the sections of the judiciary. In addition to these basic options for determining the constitutional status of the prosecutor's office, there are others that are less common.The problem of determining the position of the prosecutor's office in the system of distribution of state power in Ukraine was one of the constant topics of discussion, on which various concepts and long-standing scientific and theoretical disputes were raised. The Revolution of Dignity in 2014 stimulated the development of the current stage of the constitutional process and the introduction of amendments to the Constitution in the area of justice, which paved the way to reform of the prosecutor's office in Ukraine. Article 131 of the Constitution of Ukraine, which regulates the constitutional and legal status of the prosecutor's office, enshrined a new normalization of the bodies of the prosecutor's office, their place in the system of public authorities. Constitutional changes resulted in the exclusion of Section 7 of the Constitution of Ukraine "Prosecutor's Office" from the Basic Law, and Article 131 took its new place in Section 8 of the Constitution of Ukraine "Justice". Further development and clarification of the constitutional and legal status of prosecutorial authorities is acquired in the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019. The Law introduces a new structure of the prosecutor's office, clarifies the law of the Prosecutor of Ukraine, the maximum number of employees of the prosecution bodies is determined, the requirements regarding the attestation of employees of the prosecution bodies are specified ; Статья посвящена анализу трансформации конституционно-правового статуса прокуратуры в независимой Украине, от ее советской модели с широкими контрольно-надзорными полномочиями в прокуратуру демократического, правового государства, ее место в современной системе органов государственной власти.Анализ современных реформаторских процессов в системе отечественной прокуратуры объединенн с освещением моделей прокуратуры в новейшей мировой конституционно-правовой практике ее места, роли и значения прокуратуры в системе государственной власти. В научной конституционалистики существует несколько вариантов отнесения прокуратуры к той или иной ветви государственной власти или вообще определения ее в качестве отдельного органа государственной власти. Вариант отнесения прокуратуры к системе исполнительной власти успешно реализован в государственном строительстве США, Дании, Франции, Нидерландах, Германии, Австрии, Польши, Швеции.Имеет право на свою жизнь модель включения прокуратуры в законодательную ветвь власти, но она не получила широкого распространения. В противоположность этой модели отнесения прокуратуры к судебной ветви власти стало реальностью в Испании, Болгарии, Хорватии и других странах Европы. В конституции этих государств положения об органах прокуратуры и регламентации их деятельности содержатся в разделах о судебной власти. Кроме указанных основных вариантов определения конституционно-правового статуса прокуратуры существуют и другие, но менее распространенные.Проблема определения места прокуратуры в системе разделения государственной власти в Украине была одной из постоянных дискуссионных, в отношении которой выдвигались различные концепции и велись длительные научно-теоретические споры. Революция Достоинства 2014г. стимулировала развитие современного этапа конституционного процесса, и внесения изменений в Конституцию в части правосудия, открыла путь для реформирования прокуратуры в Украине. Статья 131 Конституции Украины, нормирующая конституционно-правовой статус прокуратуры закрепила новый статус органов прокуратуры, их место в системе органов государственной власти. Конституционные изменения сопутствовали исключению раздела VП Конституции Украины «Прокуратура» из Основного Закона, а статья 131 получила свое новое место в разделе VШ Конституции Украины «Правосудие». Дальнейшего развития и уточнения конституционно-правовой статус органов прокуратуры получил в Законе Украины «О внесении изменений в некоторые законодательные акты Украины относительно первоочередных мер по реформе органов прокуратуры» от 19 сентября 2019 Законом вводится новая структура органов прокуратуры, уточняются и расширяются права Генерального прокурора Украины, определяется максимальное количество работников органов прокуратуры, конкретизируются требования, по аттестации работников органов прокуратуры и тому подобное ; Стаття присвячена аналізу трансформації конституційно-правового статусу прокуратури в незалежній Україні, від її радянської моделі із широкими контрольно-наглядовими повноваженнями до прокуратури демократичної, правової держави, її місця в сучасній системі органів державної влади.У статті аналіз сучасних реформаторських процесів в системі вітчизняної прокуратури поєднано із висвітленням моделей в новітній світовій конституційно-правовій практиці до різних гілок влади, а від так місця ролі і значення прокуратури в системі державної влади. На противагу цій моделі віднесення прокуратури до судової гілки влади стало реальністю в Іспанії, Болгарії, Хорватії та інших країнах. В Конституції цих держав положення про органи прокуратури та регламентацію їх діяльності містяться в розділах про судову владу. Крім зазначених основних варіантів визначення конституційно-правового статусу прокуратури існують й інші, які менш поширені.Проблема визначення місця прокуратури в системі розподілу державної влади в Україні була однією з постійних дискусійних тем, щодо якої висувалися різні концепції та велися тривалі науково-теоретичні суперечки. Революція Гідності 2014р. стимулювала розвиток сучасного етапу конституційного процесу та внесення змін до Конституції в частині правосуддя, що відкрило шлях для реформування прокуратури в Україні. Стаття 131 Конституції України, що унормовує конституційно-правовий статус прокуратури закріпила нове унормування органів прокуратури, їх місця в системі органів державної влади. Конституційні зміни спричинили виключення Розділу VП Конституції України «Прокуратура» з Основного Закону, а стаття 131 набула свого нового місця в Розділі VШ Конституції України «Правосуддя».Новий Закон України «Про прокуратуру» від 14 жовтня 2014 р. уточнив конституційно-правовий статус, завдання та функції прокуратури. Подальшого розвитку та уточнення конституційно-правовий статус органів прокуратури набув в Законі України «Про внесення змін до деяких законодавчих актів України, щодо першочергових заходів із реформи органів прокуратури» від 19 вересня 2019 р. The article is devoted to the analysis of the transformation of the constitutional and legal status of the prosecutor's office in independent Ukraine, from its Soviet model with broad control and supervisory powers to the prosecutor's office of a democratic, rule of law state, its place in the modern system of public authorities.In the article, the analysis of modern reform processes in the system of the national prosecutor's office is combined with the coverage of models in the latest world constitutional and legal practice to different branches of power, and from that place the role and importance of the prosecutor's office in the system of state power. In scientific constitutionalism, there are several options for attributing a prosecutor's office to a particular branch of state power, or even defining it as a separate body of state power. The option of attribution of the prosecutor's office to the executive power system has been successfully implemented in the states making practice of the USA, Denmark, France, the Netherlands, Germany, Austria, Poland, and Sweden.The model of including the prosecutor's office in the legislative branch has the right to life, but it has not become widespread. Contrary to this model, the prosecution's attribution to the judiciary became a reality in Spain, Bulgaria, Croatia and other countries. In the Constitution of these states, the provisions on prosecutorial authorities and the regulation of their activities are contained in the sections of the judiciary. In addition to these basic options for determining the constitutional status of the prosecutor's office, there are others that are less common.The problem of determining the position of the prosecutor's office in the system of distribution of state power in Ukraine was one of the constant topics of discussion, on which various concepts and long-standing scientific and theoretical disputes were raised. The Revolution of Dignity in 2014 stimulated the development of the current stage of the constitutional process and the introduction of amendments to the Constitution in the area of justice, which paved the way to reform of the prosecutor's office in Ukraine. Article 131 of the Constitution of Ukraine, which regulates the constitutional and legal status of the prosecutor's office, enshrined a new normalization of the bodies of the prosecutor's office, their place in the system of public authorities. Constitutional changes resulted in the exclusion of Section 7 of the Constitution of Ukraine "Prosecutor's Office" from the Basic Law, and Article 131 took its new place in Section 8 of the Constitution of Ukraine "Justice". Further development and clarification of the constitutional and legal status of prosecutorial authorities is acquired in the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019. The Law introduces a new structure of the prosecutor's office, clarifies the law of the Prosecutor of Ukraine, the maximum number of employees of the prosecution bodies is determined, the requirements regarding the attestation of employees of the prosecution bodies are specified ; Статья посвящена анализу трансформации конституционно-правового статуса прокуратуры в независимой Украине, от ее советской модели с широкими контрольно-надзорными полномочиями в прокуратуру демократического, правового государства, ее место в современной системе органов государственной власти.Анализ современных реформаторских процессов в системе отечественной прокуратуры объединенн с освещением моделей прокуратуры в новейшей мировой конституционно-правовой практике ее места, роли и значения прокуратуры в системе государственной власти. В научной конституционалистики существует несколько вариантов отнесения прокуратуры к той или иной ветви государственной власти или вообще определения ее в качестве отдельного органа государственной власти. Вариант отнесения прокуратуры к системе исполнительной власти успешно реализован в государственном строительстве США, Дании, Франции, Нидерландах, Германии, Австрии, Польши, Швеции.Имеет право на свою жизнь модель включения прокуратуры в законодательную ветвь власти, но она не получила широкого распространения. В противоположность этой модели отнесения прокуратуры к судебной ветви власти стало реальностью в Испании, Болгарии, Хорватии и других странах Европы. В конституции этих государств положения об органах прокуратуры и регламентации их деятельности содержатся в разделах о судебной власти. Кроме указанных основных вариантов определения конституционно-правового статуса прокуратуры существуют и другие, но менее распространенные.Проблема определения места прокуратуры в системе разделения государственной власти в Украине была одной из постоянных дискуссионных, в отношении которой выдвигались различные концепции и велись длительные научно-теоретические споры. Революция Достоинства 2014г. стимулировала развитие современного этапа конституционного процесса, и внесения изменений в Конституцию в части правосудия, открыла путь для реформирования прокуратуры в Украине. Статья 131 Конституции Украины, нормирующая конституционно-правовой статус прокуратуры закрепила новый статус органов прокуратуры, их место в системе органов государственной власти. The article is devoted to the actual scientific problem - the protection of human rights and freedoms by the judicial authorities, their priority in this process. It provides an analysis of international legal acts, devoted to this problem. It is stressed, that the success of judicial administration in the performance of justice depends on many factors, and especially on the regularity of the procedural form of resolving disputes in court and on the universality of the nature of the "procedural order". Compliance with the procedural guarantees of the administration of justice is a prerequisite for its implementation and proper consideration of court cases. The procedural guarantees of observance of human rights in the administration of justice include: courteousness of the court, transparency, openness of court proceedings, efficiency of justice, participation of the people in its implementation, competition of the parties in court proceedings, etc.Particular attention is paid to the specifics of guarantees of observance of human rights in criminal justice and analysis of normative and legal acts that establish the basic principles and guarantees of observance of human rights and their classification on: international legal acts, constitutional acts (constitutional or basic laws), legislative acts (first of all separate laws and codes).There are two groups of guarantees of the observance of human rights in the administration of justice. These are procedural guarantees, which are almost completely equated with the principles of justice and procedural safeguards for the observance of human rights in the administration of justice. Both of these guarantee groups are closely interrelated and none of them can be effectively applied without the other. However, the second group of guarantees includes a more detailed list of legal rules that already apply to specific cases (order, terms, etc.) in relation to one or another type of legal proceedings.Comparison of the procedural rights of the victim and the accused has been made, and the emphasis has been made on impossibility of limiting the procedural rights of the accused. Unlike civil, administrative and constitutional justice, a characteristic feature of criminal justice is that it guarantees not only at the stage of judicial review, but also at the stages preceding it ; Статья посвящена актуальной научной проблеме - защите прав и свобод человека органами судебной власти, приоритетном их месту в этом процессе. Предоставляется анализ международно-правовых актов посвященных данной проблеме. Отмечается, что успешность выполнения судебной властью функции правосудия зависит от многих факторов, особенно от регламентированности процессуальной формы разрешения споров в суде и на универсальности характера «процессуального порядка». Taking into account sheer quantity of censoring and filtering practices that are applied in the Ukrnet in the last four years, it is important to analyze the impact that such measures make on the international image of Ukraine.The most worrying trend is the relatively recent inclination of Ukrainian authorities to copy approaches of their adversaries when it comes to restriction of Internet freedom. The author believes that Ukrainian authorities should abandon the «tit for tat» approach and refrain from further engagement into fruitless competition with the Russian authorities and Russian proxies on «Whose list of blocked sites is bigger?» basis. It would be wise to limit the actual blocking initiatives to a handful of most prominent Russian Internet-corporations and some of Russian propaganda outlets. In other words, the emphasis should be put on promotion of Ukrainian channels of information, instead of restricting access to the Russian ones. In such a way Ukraine should be able to mitigate the negative impact that Russian subversive and restrictive tactics in the cyber space make on the country's international image ; У статті представлена спроба проаналізувати сприйняття міжнародними правозахисними організаціями спроб уряду України та псевдо-державних утворень на окупованих територіях сходу України застосувати механізми цензурування та блокування інформації в українському сегменті Інтернету в контексті збройного конфлікту між Україною та Російською Федерацією.
