The history of legal proceedings in Ukraine in the early modern time is rather poorly researched. The author of this article argues that one of the topics that should be considered is the work of the executioner. Executioner was one of the most important persons for the success of the search. For a long period of time, it was through torture that it was possible to receive information from the offenders and to reveal the crimes. However, the figure of the executioner did not receive attention in the works of the Ukrainian scholars.The article attempts to consider the main aspects of the work of the executioner in the Hetmanate in the middle of the 18th century. It should be noted that "executioner's craft" was widespread throughout the European continent. Therefore, this paper considers some aspects of the functioning of this profession in Europe (time and cause of occurrence, service and additional duties of the executioner, attitude towards them, duration of performance of official duties).The study also analyzes the position of the executors in the legal sources of the Hetmanate. In the Statutes of the Lithuania, the profession of the headman is almost devoid of attention. However, in the Laws by Which the Little Russian People Are Judged, the interrogation process, the use of tortures, the procedure for the execution of the death penalty and the amount of the salary of the executioner are regulated. It is worth noting that in the Hetmanate, the hangman was not the only person who tortured the thieves. The books of city governments cited that the punishment of offenders was made by city servants, but the death penalty remained in the hands of the executioner.In the middle of the 18th century, there were 11 executioners in the Hetmanate: one person in each regimental city and one in Hlukhiv. Basically, the former thieves became the executioners. There were occasions when prisoners from jail sent letters to the regimental offices with a request to approve them as hangmen. In this way, criminals tried to avoid punishment for the committed crimes. Despite the substantial income (from 17 to 20 rubles per year) and the amnesty granted by the authorities, the hangmen continued breaking the law. The biggest problem for the authorities was the escaping of the executioners, which considerably slowed down the trial. The article is focused on the problem of the essence, forms, methods and limits of social control in the Postmodern society. The article contains an analysis of the views of the most famous scientists who laid the foundations of modern understanding of social control, and the author's proposals for the application of such views in the XXI century society. The main thesis of this study is that modern social control is more insightful, subtle and comprehensive (primarily due to its greater manufacturability). Therefore, there is a real danger of losing freedom in the Postmodern society. The article emphasizes the importance for the political science of the XXI century of the works of the French philosopher Michel Foucault and the American sociologist Stanley Cohen on the essence of social control on the example of the concept of punitive city, which serves as a model of modern society of technological social control. The article contains an analysis of transformation of different models of social control with the corresponding characteristics of each model. The article analyzes the application of the categories introduced by Michel Foucault in the XXI century ("rank", "exam", "discipline") and focuses on the relevance of such categories. The article provides practical examples of "encroachment on liberty" (such as mass surveillance cameras and information databases) and the dissemination of more insightful social control in the field of criminal justice. Attention is paid to examples of the application of the concept of Net Widening in national criminal justice systems. Attention is also paid to the "crisis of the rehabilitation ideal", which occurred after the publication in 1971 of the work of the American sociologist Robert Martinson. The article concludes that freedom is a kind of power. Power is seen not as a negative category associated with coercion, but as a positive category associated with the unlimited realization of the human's will in the society, without harm to themselves and others. Therefore, from this point of view, the classical formal approach to social control as a natural consensus, which emerged from nowhere and from nowhere, should be taken critically. Modern society is a society of subtle and transparent, but at the same time rigid power, which does not tolerate the power of truly free people. The main conclusion of this study will be the aggravation of the issue of voluntary renunciation of freedom in favor of "security", or, better said, the combination of "security" with "comfort" in accordance with the requirements of a globalized consumer society. ; Стаття присвячена проблемі сутності, форм, методів та меж соціального контролю у суспільстві Постмодерну. Стаття містить аналіз поглядів найбільш відомих вчених, які заклали підвалини сучасного розуміння соціального контролю, та авторські пропозиції щодо застосування таких поглядів у суспільстві ХХІ століття. Головню тезою цього дослідження є те, що сучасний соціальний контроль є більш проникливим, тонким та всеосяжним (передусім в силу своєї більшої технологічності), а відтак існує реальна небезпека втрати свободи у суспільстві Постмодерну. У статті робиться наголос на важливості для політичної науки ХХІ століття праць французького філософа Мішеля Фуко та американського соціолога Стенлі Коена щодо сутності соціального контролю на прикладі концепції карального (пунітивного) міста, яке служить моделлю сучасного суспільства технологічного соціального контролю. У статті міститься аналіз трансформації моделей соціального контролю з відповідними характеристиками кожної моделі. Стаття аналізує питання застосування у ХХІ столітті категорій, запроваджених Мішелем Фуко («ранг», «іспит», «дисципліна») і фокусує увагу на актуальності таких категорій. У статті надаються практичні приклади «посягання на свободу» (як-то камери відеоспостереження, інформаційні бази даних, розширення типології та класифікації девіантів) та поширення більш проникливого соціального контролю у сфері кримінальної юстиції. Окрема увага приділена прикладам застосування концепції net widening у національних системах кримінальної юстиції. Окрема увага приділяється «кризі реабілітаційного ідеалу», що настала після публікації у 1971 році праці американського соціолога Роберта Мартінсона. Стаття містить висновок, що свобода – це влада. Влада не як негативна категорія, пов'язана з примусом, а як категорія позитивна, пов'язана з необмеженою реалізацією своєї волі у суспільстві таких же вільних людей, без шкоди для себе та оточуючих. Тому з цієї позиції класичний формальний підхід до соціального контролю як до природнього консенсусу, який з'явився невідомо як і невідомо звідки, має сприйматися критично. Сучасне суспільство – це суспільство тонкої, прозорої, проте водночас жорсткої влади, яка не толерує владу дійсно вільних людей. Головним висновком цього дослідження буде саме загострення проблематики добровільної відмови від свободи на користь «безпеки», або, краще сказати, поєднання «безпеки» з «комфортом» відповідно до вимог споживацького глобалізованого суспільства.

Стаття присвячена висвітленню Голокосту в м. Рівне. Нажаль, крім розстрілів в урочищі Сосонки в листопаді 1941 р., інші випадки екстермінації євреїв в академічній л-рі висвітлені дуже мало, а деякі локації знищення не вказані. В сучасній історіографії Голокосту всі факти вбивства євреїв в Рівному ще не досліджені, що є своєрідною білою плямою. У спробі локалізувати такі місця, в статті наведені свідчення жертв (євреїв), спостерігачів (не євреїв), німців та поліцейських (катів). Першими жертвами нацистської окупації в місті стали жителі, що гинули через бомбардування та авіанальоти. Влітку 1941 р. євреї стали жертвами розстрілів. Їх початкова ліквідація відбувалася в контексті боротьби з «жидо-більшовизмом», коли вбивали тих, хто підтримував попередню владу та тих, хто був здатен очолити опір – чоловіків та інтелігенцію. Впродовж всього періоду німецької окупації євреї знаходили свою смерть в рівненських таборах військовополонених Шталаг 360, в місцевій в'язниці, в урочищі Видумка. Великим місцем вбивства та захоронення стала вул. Біла, куди звозили жертв звідусіль. Серед виявлених невідомих сторінок історії рівненського гетто – вбивство немісцевих віденських євреїв під час його ліквідації. Наявна ймовірність серед бранців гетто Рівного євреїв з Рівненського району. Члени судово-медичної експертизи НДК, що розслідували злочини окупантів в м. Рівне та Рівненській області дійшли висновків, що знищення цивільних громадян та військовополонених у м. Рівне провадилось шляхом масових розстрілів з автоматів та кулеметів, умертвління чадним газом, – у «машинах-душогубках», в окремих випадках людей живими закопували в могилах. Частину розстріляних людей, зокрема в кар'єрах біля с. Видумка, спалювали на зазделегідь підготовлених і пристосованих майданчиках. В багатьох випадках, зокрема на трупах з могил на вул. Біла виявлено сліди зовнішнього насильства, що свідчить про фізичне знущання над жертвами до їх смерті. Виокремлення точних кількісних втрат єврейського населення Рівного в названих локаціях – надважке завдання. Ми можемо оперувати лише 17,5 тис. розстріляних жертв Голокосту в Сосонках, однак в інших локаціях, де євреї були вбиті разом з українцями, поляками тощо – це зробити неможливо. Наведена раніше дослідниками інформація про кількість в 22–23 тис. вбитих під час Голокосту євреїв в місті, на наш погляд, з розвитком досліджень повинна бути змінена в бік збільшення. ; The article is devoted to the coverage of the Holocaust in Rivne. Unfortunately, apart from the shootings in the Sosonky tract in November 1941, other cases of the extermination of Jews are covered very little in the academic literature, and some locations of extermination are not specified. In modern historiography of the Holocaust, all the facts of the murder of Jews in Rivne have not yet been investigated, which is a kind of white spot. In an attempt to locate such places, the article presents the testimonies of victims (Jews), observers (non-Jews), Germans and police officers (executioners). The first victims of the Nazi occupation in the city were residents who died in the bombing and air raids. In the summer of 1941, the Jews became victims of shootings. Their initial elimination took place in the context of the struggle against "Jewish Bolshevism" when those who supported the previous government and those who were able to lead the resistance - men and intellectuals - were killed. Throughout the German occupation, Jews found their deaths in the Rivne prisoners of war camps Shtalag 360, in the local prison, in the Vydumka tract. Among the discovered unknown pages of the history of the Rivne, the ghetto is the murder of non-native Viennese Jews during its liquidation. There is a possibility that Jews from the Rivne district are among the prisoners of the Rivne ghetto. Members of the forensic medical examination of the National Palace of Culture, which investigated the crimes of the occupiers in Rivne and Rivne region, concluded that the destruction of civilians and prisoners of war in Rivne was carried out by mass shootings with «killer machines», killing with carbon monoxide, іn some cases, people were buried alive in graves. Identifying the exact quantitative losses of the Jewish population of Rivne in these locations is a very difficult task. We can cover only 17.5 thousand Holocaust victims in Sosonky, but in other locations where Jews were killed along with Ukrainians, Poles, etc., it is impossible to do so. The information given earlier by researchers about the number of 22,000 to 23,000 Jews were killed during the Holocaust in the city, in our opinion, should be changed in the direction of research.

The first half of the 20th century is known in the history as the period of global human tragedies. Ukrainian people underwent many severe trials. Revolutions, civil wars, famine, political repressions killed millions of Ukrainian people.The author of the article set an objective to make a research of one of the little-known pages from the history of Zhytomyr region national minorities – the repression of the Polish inhabitants in the 30s of the 20th century made by Soviet power , technology and methods of conduct of such policy. The object under research is the common tragic destiny of Ukrainian and Polish people from village Brusyliv in the period of "Great terror" in Zhytomyr region (July 1937-November1938).Earlier unknown archive materials concerning the national aspect of political repressions in Ukraine became the basis of the research. ; Pierwsza połowa XX wieku pozostała w historii jako okres tragedii ludzkości globalnej skali. Losy narodu Ukrainy historia wypróbowała chyba najciężej i najbardziej dotkliwie. W ogniu rewolucji, wojny domowej, głodów, represji politycznych zostało zniszczono miliony obywateli Ukrainy.Autor artykułu postawił cel zbadać jedną z najmniej znanych stron historii mniejszości narodowych Żytomierżczyzny – represje władz radzieckich przeciwko ludności polskiej w latach 30-ch XX wieku, technologie i metody przeprowadzenia tej polityki. Obiektem badania jest wspólne tragiczne losy ukraińskiej i polskiej wsi Bułdyczów pod czas "Wielkiego terroru" na Żytomierżczyźnie (lipiec 1937 – listopad 1938). Bazą źródłową jest wcześniej nieznane materiały archiwalne oraz badaniapoświecone narodowemu aspektu politycznych represji na Ukrainie. ; Автор статті поставила за мету дослідити одну з маловідомих сторінок з історії національних меншин Житомирщини – репресії радянськї влади проти польського населення у 30-х роках ХХ-го століття, технологіюта методи проведення цієї політики. Об'єктом дослідження стала спільна трагічна доля українців та поляків с. Булдичів в добу «Великого терору» на Житомирщині (липень 1937 р. – листопад 1938 р). Джерельну основу праці становлять раніше невідомі архівні матеріали та дослідження, присвячені національному аспекту політичних репресій в Україні.

The nascence of independent Ukraine caused the reasons for radicalrethink of historical past. The uprising of scientific studies devoted to the eraof Soviet communism became an important consequence of it. The processof creating a democratic society in Ukraine is impossible without careful scientific research of communism essence, its genesis, development and the reasons for crisis as well as the degradation.Despite the research-workers' efforts to reveal Soviet totalitarianism,we still have to find out lots of aspects to understand why people's liveswere the forfeit for their illusions. It is topical for both a realistic perceptionof a historical experience, as well as a preventing the recurrence of suchmistakes and tragedies nowadays and in the future.It is possible to state the mentioned and previously unknown factsand materials taken from regional histories and putting regionaldocumentation into circulation had a great effect on the research quality. Itis changed into a clarification and, maybe, even into the explanation ofcertain ideas about the nature of the repressive actions during «The GrandTerror» regime in 1937-1938.The author of the article stresses that repressive mechanism didn'tfunction on its own. The exact repressive tasks were on the people whoworked in the sphere of a national security, and mostly on people who werein charge of regional NKVD departments. In case of Zhytomyr region, it wasL. Yakushev (Babkin) and G. Vyatkin. Sad inferences of their activities areshown in the thesis. They were the men who ordered their subordinates tofabricate affairs in order to gain success by all manner of means.The article is based on previously unknown archive materials anddescribes the organizational and directive roles of people who were thedepartments' heads of Zhytomyr region NKVD and put into action Stalin'spolicy of «The Grand Terror». The article aim is to attempt to cover the formation, organization and activities of the Inter-Party Secretariat for the Fight for Amnesty of Political Prisoners in Interwar Poland in 1926–1928 (on the example of Volyn and Eastern Galicia). Research methodology is based on the use of general and special historical scientific methods including problem-chronological, synchronous, diachronic, comparative-historical, etc. Main results: the article reveals the causes and prerequisites of the creation, content and results of activities of the Inter-Party Secretariat for the Fight for Amnesty of Political Prisoners in Interwar Poland in 1926–1928 in Volyn and Eastern Galicia; clarifies the organizational structure of the researched institution, as well as its transformation during the short-term functioning; shows the activities of the Inter-Party Secretariat for the Fight for Amnesty of Political Prisoners in Interwar Poland; describes the repressive action of the authorities to counteract the activity of the investigated institution; regional peculiarities of its activity are highlighted. Conclusions: during the short-lived activities the Inter-Party Secretariat for the Fight for the Amnesty of Political Prisoners organized the broad campaign in Poland aimed at releasing political prisoners in the Second Polish Republic, which drew considerable attention to this issue both inside and outside the Polish state and undoubtedly influenced the adoption by parliament the amnesty law in 1928. Practical meaning: the basics and factual material can be used for further research on the modern history of Ukraine and Poland, Polish-Ukrainian relations in the XX century and may also interest historians of law. Originality: conditioned by the coverage of poorly researched topics, as well as the introduction into the scientific circulation of previously unknown archival materials from the archives of Ukraine and the Republic of Poland, in particular the Polish Central Archives of Modern Records in Warsaw. Scientific novelty: for the first time in the national historiography was investigated the formation, organization and activity of the Inter-Party Secretariat for the Fight for Amnesty of Political Prisoners in Interwar Poland (on the example of Volyn and Eastern Galicia) in 1926–1928. This article is focused on the problem of studying the phenomenon of prison privatization and the political and economic aspects of the functioning of modern multinational prison corporations. The issue of transferring the penitentiary function of the state to private actors with the subsequent transfer of this function to the supranational level is at the heart of this study. A separate object of study of this article is a complex political and economic dualistic process, which is characterized by both the opposition between transnational prison corporations and nation states, and the coexistence of the above entities at the same time. The article focuses on the problem of morality of modern tendencies of supranationalization of penitentiary policy and civilizational values that drive transnational prison corporations. A special place in the article is occupied by the position on the transformation of transnational prison corporations into quasi-state entities with appropriate attributes, functions and powers. The article also contains the author's analysis of the problem of transition from the state to the private sector of power to use force (including physical coercion). On the other hand, the variety of numerous modern forms of social control leads to the original competition "bullet against armor" in the context of the nation-state's opposition to transnational business, where the efforts of nation-states to maintain control over it resembles attempts to hold water in the palm. In the Western world, prison privatization and the supranationalization of the prison business is an almost commonplace phenomenon that is phenomenal for the post-Soviet countries, making this area of research in Ukraine even more relevant and topical. This author's study should be seen not only as an analysis of the transfer of power from the nation state to transnational private actors. The focus of the study is the question of the profound transformation of the "power of punishment". ; Ця стаття присвячена проблемі дослідження феномену в'язничної приватизації та політико-економічним аспектам функціонування сучасних транснаціональних в'язничних корпорацій. У центрі цього дослідження перебуває проблематика передачі пенітенціарної функції держави приватним акторам з подальшим винесенням цієї функції на наднаціональний рівень. Окремим об'єктом дослідження цієї статті є комплексний політико-економічний дуалістичний процес, який водночас характеризується як протидією між транснаціональними в'язничними корпораціями й національними державами, так і одночасно вимушеним співіснуванням зазначених вище суб'єктів. У статті робиться висновок, що для сучасного західного світу в'язнична приватизація та наднаціоналізація в'язничного бізнесу – це майже буденне явище, яке для країн пострадянського простору є феноменальним, ще надає ще більшої актуальності цьому напрямку досліджень в Україні. Це авторське дослідження варто сприймати не лише як аналіз переходу влади від національної держави до транснаціональних приватних акторів.
