CIVIL SERVANTS AS A SPECIAL SUBJECTS OF CORRUPTION CRIMES ; ДЕРЖАВНІ СЛУЖБОВЦІ ЯК СПЕЦІАЛЬНІ СУБ'ЄКТИ КОРУПЦІЙНИХ ЗЛОЧИНІВ
This article highlights particularities and issues related to characteristic and classification of public servants as specific subjects of corruption crimes. The adaptation of the civil service to the standards of the European Union necessitates both a rethinking of a number of theoretical provisions of the civil service institute and improvement of its legal regulation. At the same time, it is necessary to state that there is a low level of institutional development of the civil service, imperfection of the legal and legal base of civil service, low level of the system of training of civil servants, specialization and improvement of their qualification. Considering that the modern civil service legislation does not meet the level of maturity of the society, the strategic course of the state for the implementation of European standards of government, does not ensure the stability and prestige of the civil service, strict compliance with the requirements of political neutrality of civil servants, compliance with the law against the law Of particular importance is the need to create an effective system of new approaches to the processes of civil service functioning. The problems that arise in the process of civil service in Ukraine need to be addressed urgently, and the democratic changes that are taking place in the country are new approaches to the civil service, its progress in the context of European integration, and increased accountability for improper performance or over-ex officio. Corruption is a negative phenomenon that impedes the functioning of the state apparatus, restricts the constitutional rights and freedoms of the individual and citizen, violates the principles of the rule of law. Corrupt practices destroy the moral and ethical values of society, undermine the authority of the country and discredit the state at the international level. Thus, the article deals with the notion of an official and public servants, subjects of corruption crimes, a theoretical and legal analysis of the provisions of the criminal legislation governing the criminal liability of public servants for committing corruption offenses. The analysis of the legislation shows that civil servants cannot be the subjects of corruption offenses in the private sphere of management, and, based on the provisions of the Criminal Code of Ukraine, civil servants can not be classified as persons providing public services, which significantly narrows the scope of their criminal liability for corruption. ; У статті висвітлюються особливості та проблемні питання кримінальної відповідальності державних службовців як спеціальних суб'єктів корупційних злочинів. Адаптація державної служби до стандартів Європейського Союзу зумовлює необхідність як переосмислення цілої низки теоретичних положень державної служби, так i вдосконалення її правового регулювання. Водночас доводиться констатувати, що спостерігається низький рівень інституційного розвитку державної служби, недосконалість нормативно-правової бази проходження державної служби, низький рівень підготовки держслужбовців, спеціалізації та підвищення їх кваліфікації. Оскільки сучасне законодавство про державну службу не відповідає рівню зрілості суспільства, стратегічному курсу держави на впровадження європейських стандартів урядування, не забезпечує стабільності та престижності державної служби, суворого дотримання вимог щодо політичної нейтральності державних службовців, дотримання законодавства щодо запобігання та протидії корупції, то особливого значення набуває потреба y створенні ефективної системи нових підходів до процесів функціонування державної служби. Проблеми, які виникають в процесі проходження державної служби в Україні, потребують невідкладного вирішення, a демократичні перетворення, що відбуваються в країні, ń нових підходів до державної служби, її проходження в умовах євроінтеграції та посилення відповідальності за неналежне виконання або перевищення службових обов'язків. Корупція є негативним явищем, яке перешкоджає функціонуванню державного апарату, обмежує кон-ституційні права i свободи людини та громадянина, порушує принципи верховенства права. Корупційні прояви знищують морально-етичні цінності суспільства, підривають авторитет країни та дискредитують державу на міжнародному рівні. Отже, y статті розглянуто поняття «службова особа», «державні службовці», «суб'єкти корупційних злочинів», проведено теоретико-правовий аналіз положень кримінального законодавства, які регулюють кримінальну відповідальність державних службовців за вчинення корупційних злочинів. Аналіз законодавства показує, що державні службовці не можуть бути суб'єктами корупційних злочинів у приватній сфері управління. З огляду на положення КК України державні службовці не можуть бути віднесені до категорії осіб, які надають публічні послуги, що значно звужує коло підстав їх кримінальної відповідальності за корупцію.
