Статья содержит анализ Директивы Европейского Парламента и Совета 2006/123 по услугам на внутреннем рынке. В работе рассматриваются основные поправки,внесенные в первоначальный проект Директивы; раскрывается содержание принципа страны происхождения; определяется сфера действия Директивы и закрепленного в ней принципа свободы предоставления услуг. Особое внимание уделено статье 16 Директивы. Рассматриваются принципы,при соблюдении которых государства-члены вправе осуществлять правовое регулирование деятельности по предоставлению услуг поставщиками,учрежденными на территории другого государства-члена. На основании проведенного исследования делается попытка оценить значение Директивы для процесса либерализации предоставления услуг. ; The article contains the analysis of the Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on Services in the Internal Market. The study discusses the main amendments to the preliminary draft of the directive; elicits the content of the country of origin principle; determines the scope of the directive and of the freedom to provide services. A particular attention is paid to article 16 of the Directive. The author examines the principles, that the member states following them may perform the legal regulation as to rendering services to the providers, established on the territory of another member state. Having performed the research, the author makes an attempt to assess the relevance of this Directive as to the liberalization in providing services.

The experience of the harmonizing the norms of the national legislation and the Directive 2001/84/EC provisions in countries such as the United Kingdom, Austria, Spain, the Netherlands has been researched.The relevance of the study lies in the need for European integration processes for Ukraine. Euro integration processes today are one of the most priority directions of Ukraine's development. Harmonization of the national legislation with the legislation of the European Union is a priority task. Harmonization of Ukraine's intellectual property legislation in this regard is an important part of the current reforms. The article 190 «Resale right» of the Association Agreement between the European Union and its Member States, of the one part, and Ukraine, of the other part is correlated with the provisions of Directive 2001/84 of the European Parliament and of the Council of 27 September 2001 on the on the resale right for the benefit of the author of an original work of art.Taking into account modern reforms in intellectual property, it is reasonable to study the experience of foreign countries on the implementation of provisions of Directive 2001/84/EC, since the resale right is quite controversial and current issue.

Розглянуто механізм оформлення законного переміщення пам'яток історії та культури з меж митної території та на територію України. ; В статье исследуется развитие правового механизма вывоза, ввоза и возвращения культурных ценностей из Украины в ЕС. Рассмотрены механизм оформления законного перемещения памятников истории и культуры из пределов таможенной территории и на территорию Украины.Директиву 93/7 ЕЭС принято с целью упростить процесс возвращения культурных ценностей нелегально вывезенных с территории государств-членов ЕС. Украина все еще является культурной загадкой, феноменом на международной арене, поэтому, возникает необходимость в налаживании совершенного правового механизма вывоза, ввоза и возвращения культурных ценностей незаконно вывезенных с территории государства-члена ЕС.Главный принцип Директивы 93/7 ЕЭС предусматривает, что уполномоченные органы государств-членов ЕС придерживаются установленной процедуры, которая упрощает процедуру возврата культурных ценностей. Государство-член ЕС обязано по требованию другого государства ЕС провести поиск соответствующей культурной ценности и выяснить личность владельца. Цель Директивы 93/7/ЕЭС заключалась в обеспечении физического возвращения предметов культуры в государства-члена с территории которой упомянутые предметы были незаконно вывезены, независимо от имущественных прав, применяются к таким предметам. ; The article explores the development of the legal mechanism for the export, importation and return of cultural property from Ukraine to the European Union. The mechanism of registration of the legal movement of historical and cultural monuments from the limits of the customs territory and to the territory of Ukraine is considered.The directive 93/7 EEC was adopted in order to simplify the process of returning cultural property to illegally exported from the territory of the EU member states. Ukraine is still a cultural mystery, a phenomenon in the international arena, therefore, there is a need to establish a perfect legal mechanism for the export, importation and return of cultural property illegally exported from the territory of an EU member state.The main principle of the Directive 93/7 EEC provides that the authorized bodies of the Member States adhere to the established procedure, which simplifies the procedure for returning cultural property. A member state of the EU is obliged at the request of another EU state to search for the corresponding cultural value and find out the identity of the owner.The purpose of Directive 93/7/EEC was to ensure the physical return of cultural objects to a Member State from whose territory the objects mentioned were illegally exported, regardless of property rights, applied to such objects.The scope of this Directive is to be extended to all cultural objects which a Member State classifies or defines in accordance with national law or administrative procedures as part of national treasures of artistic, historic or archaeological value. This Directive should therefore cover items of historical, paleontological, ethnographic, numismatic interest or scientific value, whether they belong to state or other collections, or whether they are separate objects, irrespective of the origin they are from planned or illegal excavations, provided that they have been classified or designated as national values. In addition, cultural objects classified or designated as national values should no longer fall into categories or meet the thresholds for their age and / or financial value in order to be returned in accordance with this Directive.

Вместе с тем, несмотря на экономическую целесообразность расширения патентной охраны на область биотехнологии, ряд положений Директивы продолжает подвергаться резкой критике со стороны как научного сообщества, так и гражданского общества до настоящего времени. В статье анализируются наиболее спорные и противоречивые нормы Директивы и их последствия. Основное внимание автор уделяет нормам о патентоспособности биотехнологических продуктов, об объеме предоставления патентной охраны и интерпретации критерия промышленной применимости, а также исключениям из патентоспособности по основаниям морали и публичного порядка. = The Biotech Directive was adopted in 1998 with the main aim to harmonize patent legislation in the EU and to spur innovation in the biotechnology sector by confirming the patentability of biotechnological inventions on the EU level. Nevertheless, despite the economic rationale of expanding patent protection on biotechnological products, a number of the Directive provisions are still criticized by academic community and civil society. This article attempts to analyse and evaluate the most contentious provisions of the Directive and their negative implications. It primarily focuses on the patentability of biotechnological inventions, on the scope of protection granted and the interpretation of the industrial application criterion, and, finally, on the exclusions from patentability on morality and «ordre public» grounds.

Автор статьи исследует и дает краткую характеристику содержания предшествующих актов,регулировавших отношения в данной сфере. ; The article is devoted to the research of Directive 2009/73/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC which became a new stage of reforming European natural gas market. The author also refers to the previous legislation having regulated the relations in this area.
In the article explores the protection of intellectual property rights in the European Union. Attention is paid to the provisions Directive 2004/48/EC On the protection of intellectual property rights. The application of this Directive 2004/48/EC is studied as at the general European level, and the features of the legal application of the directive in the legislation of individual EU member states are studied. In this article says that the main goal of this Directive is to create an effective mechanism for the protection of intellectual property rights in the common European space (EU), for the further development of an innovative economy. The analysis of the peculiarities of enforcement practice in the implementation of the EU-2004/48/EU Directive in certain EU member states (Hungary, Austria, etc.), identifies the main issues related to the application of the provisions of the above-mentioned Directive, in particular, points to the different understanding of «additional payments» in some EU member states: Germany, Czech Republic. There is in practice the question of the question of how to obtain the creator of supplementary payments (compensation). So, in Austria, the Czech Republic, Germany, Romania, the basis for determining the amount of additional compensation is double the amount of royalty. In 2016, the European Commission prepared a new report on the enforcement of intellectual property rights in EU member states. In this report, the Commission emphasizes that the IPR procedures contained in EU/2004/48 have greatly contributed to raising the level of protection of intellectual property rights in the EU, contributing to the creation of a unified legal framework. The report also states that the Directive is consistently and effectively integrated into the right of EU member states. Now (o date), the provisions of EU/2004/48 Directive have been implemented in virtually all EU member states. For example, in Latvia — the Law «On Trademarks and Geographical Names» (as of 010.010.2016), the Law «On Patents» (as of 01.01.2016), the Law «On Copyright» (as of 01.01.2014) ; in Lithuania — the Law «On Industrial Designs» IX-1181 (as of July 1, 2008); Romania — Law «On the Protection of Industrial Property Rights» No. 280/2005; Spain — The Law «On Protection of Intellectual Property and the Settlement of Simplification of the Application of EU Procedures» No. 19/2006 of 05.06.2006, as well as the corresponding amendments were made to the Law of Spain «On Civil Procedure» No. 1/2000 of January 7, 2000; Greece — Law on Transfer of Technologies, Removals and Innovations No. 1733/1987; Hungary — Law on the Protection of Trademarks and Geographical Indications.An analysis of the implementation of the Directive leads to the conclusion EU / 2004/48 Directive has become widely implemented in the European space and is an actual document for EU member states in their system of legal protection of intellectual property rights. ; В статье исследуются правовые и организационные вопросы реализации Директивы 2004/48/ЕС «Об обеспечении защиты права интеллектуальной собственности» как на общеевропейском уровне, так и в национальном законодательстве отдельных стран-членов ЕС. Указывается, что основной целью указанной Директивы является создание эффективного механизма защиты права интеллектуальной собственности на едином европейском пространстве (ЕС), для дальнейшего развития инновационной экономики. В статье осуществлен анализ правоприменительной практики Директивы 2004/48/ЕС в отдельных странах-членах ЕС. Вказується, що наразі основні положення Директива ЄС 2004/48/ЕС знайшли втілення в законодавстві більшості країн-членів ЄС, зокрема: Іспанії, Латвії, Литві, Угорщині тощо.
The article is devoted to the issues related to the regulation and protection of copyright and related rights on the Internet of both citizens of Ukraine and European Union. The peculiarities of enforcement of copyright and the rights of information users' on the Internet were analyzed. In the course of the study, it was concluded that copyright owners, publishers, distributors of information and Internet users operate within one information system, which determines the interconnection of the subjective composition of legal relations of all Internet users and the need for simultaneous equal legal regulation of these legal relations. The article also focuses on the main purpose of the directive - protection of rights of printed editorials, reducing the gap between the benefits of Internet platforms and content creators, encouraging cooperation between these two groups, creating special conditions and exceptions to copyright for text and information analysis. The directive reflects innovations: the provision of direct copyright to publishers for the use of their publications by online platforms (news aggregators), which led to the term «hyperlink tax», as well as the condition that websites that host user-generated content take effective and proportionate measures to prevent the unauthorized placement of copyrighted content or are responsible for the actions of its users. ; Стаття присвячена проблемам та питанням, пов'язаним із захистом авторських та суміжних прав у інтернет-просторі як для користувачів – громадян країн Європейського Союзу, так і для громадян України. Проаналізовані особливості реалізації авторських прав та прав користувачів інформації, розміщеної в інтернеті. Унаслідок дослід- ження зроблений висновок про те, що власники авторських прав, видавці, поширювачі інформації та користувачі інтернету діють у межах однієї інформаційної системи, що обумовлює пов'язаність і залежність суб'єктного складу правовідносин усіх користувачів інтернету та необхідність одночасного рівномірного правового регулювання цих правовід- носин. Також у статті акцентовано увагу на основній меті директиви – захисті друкованих видань, скороченні розриву між вигодою, яку отримують інтернет-платформи та творці контенту, заохоченні до співпраці цих двох груп, створенні особливих умов та винятків з авторського права для аналізу тексту та інформації. Директивою відображено новації: надання видавцям прямого авторського права на використання їхніх публікацій інтернет- платформами (агрегаторами новин), що обумовило термін «податок на гіперпосилання», а також умову, щоб вебсайти, які розміщують створений користувачами контент, приймали ефективні та пропорційні заходи щодо недопущення несанкціонованого розміщення захище- ного авторським правом контенту або несли відповідальність за дії своїх користувачів.

The basic features of the functioning and application of European law for the safety of low voltage equipment, radio and telecommunications equipment are discussed in this paper. The main regulations materials of the European Union on safety for low voltage equipment, radio– and telecommunications equipment (Directive 2014/35/EU, Directive 2014/53/ЕU and Directive 1999/5/EC) are considered and analyzed. The main regulation materials for waste utilization of electrical and electronic equipment (Directive 2002/96/EC and Directive 2011/65/EU) are considered and analyzed also. As a result, the main features of the functioning of the Directive are identified and appropriate recommendations for their applying are given. ; Рассмотрены и проанализированы материалы основных нормативных документов Европейского Союза по безопасности низковольтного оборудования, радио- и телекоммуникационного оборудования и аппаратуры (Директива 2014/35/ЕU, Директива 2014/53/ЕU и Директива 1999/5/ЕС). В том числе рассмотрены и проанализированы материалы нормативных документов, регламентирующих вопросы утилизации электрического и электронного оборудования и ограничения использования в нем некоторых вредных веществ (Директива 2002/96/EC, и Директива 2011/65/EU). The article explores the provisions of the Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market and the question of the adaptation of Ukrainian legislation to its provisions. It highlights importance of the Directive provisions for the development of national law on fair compensation to authors and performers for the use of works and performances. ; В статті досліджуються положення Директиви 2019/790/ЄС про авторське право в єдиному цифровому ринку та питання адаптації законодавства України. Зазначається істотність положень Директиви для розвитку національного законодавства щодо виплати справедливої винагороди авторам та виконавцям за використання творів та виконань.
