Розкривається питання про можливість обмеження реалізації прав і свобод людини і громадянина, виходячи з норм міжнародних актів та національного законодавства України. Розглядаються підстави обмеження реалізації прав і свобод людини, аналізується сукупність умов правомірності обмеження реалізації прав і свобод, відома як «трискладовий тест». Досліджується та розкривається зміст таких елементів цього тесту, як законність, тобто закріплення можливості обмеження реалізації прав і свобод у законодавстві, при цьому вказується на вимоги щодо якості та доступності закону, виходячи із принципу правової визначеності; легітимна мета такого обмеження та необхідність запроваджених обмежень у демократичному суспільстві. Вказані цінності, з метою захисту яких і відбувається обмеження реалізації прав і свобод, а також звертається до аналізу принципу пропорційності, що має бути застосований при здійсненні обмеження прав і свобод людини, вказуючи при цьому, що заходи щодо обмеження прав особи мають бути співрозмірними тим суспільним відносинам та іншим цінностям, що захищаються шляхом відповідного обмеження. Досліджуються підходи до регулювання питання обмеження реалізації прав і свобод людини в Конституції України та Конвенції про захист прав людини і основоположних свобод, аналізується практика Європейського суду з прав людини щодо вказаної проблематики. Метою статті є аналіз конституційно-правового регулювання права на вищу освіту в сучасних державах Європи та США.
Наукова новизна полягає у дослідженні конституційно-правових аспектів регулювання права на вищу освіту в сучасних демократичних державах та, на основі аналізу положень конституцій і відповідного законодавства зарубіжних країн, виділенні конституцій тих держав, у нормах яких зміст права на вищу освіту закріплений найбільш повно, а також конституцій, у яких відбулося формальне його закріплення.
Висновки. Кожною державою, представленою у дослідженні, пройдено власний шлях розбудови та становлення системи вищої освіти і правового визнання та регулювання права на вищу освіту. Слід констатувати, що поряд із підтримкою загальносвітових тенденцій розвитку вищої освіти, визнанням пріоритетності забезпечення та гарантування права на вищу освіту, у більшості зарубіжних країн збережено національну особливість та самобутність системи вищої освіти. Підтримка національних традицій вищої школи задекларована у конституційно-правових актах ряду зарубіжних країн.
Спираючись на загальні світові стандарти та принципи закріплення та забезпечення прав людини, більшість демократичних держав визнає на конституційному рівні світськість вищої освіти та її відділення від релігії, рівність та доступність здобуття вищої освіти без дискримінаційних обмежень, здобуття вищої освіти відповідно до здібностей кожного.
Аналіз засвідчив активну діяльність держав щодо забезпечення різноманітності форм та видів здобуття вищої освіти, що, в першу чергу, позитивно відображається на можливості реалізації особою свого права на вищу освіту.
Конституалізація питань, пов'язаних із забезпеченням якості вищої освіти, законодавче запровадження механізму мобільності у сфері вищої освіти як основного елементу досягнення наукового, індустріального, інформаційного прогресу дає підстави вести мову про пріоритетне положення вищої освіти в процесі формування державної політики більшості зарубіжних держав.

The article deals with the problems of the current state and prospects of transformation of constitutional and legal regulation of governance in Ukraine, which is considered as a process of systematic interaction of active participants (stakeholders) of public power and public administration.Suggestions are made about the need for innovative approaches to the transformation of public power, based on the new paradigm of governance in Ukraine – the paradigm of good governance. The author's position on the renewal of public power, governance in various spheres of modernization of the Constitution of Ukraine is offered.The characteristic of innovations of the constitutional legal regulation which is connected with the initiatives of the President of Ukraine and the Parliament of Ukraine is given.It is concluded that the current state of constitutional regulation of governance in Ukraine is characterized by the presence of considerable problems regarding the effective functioning of constitutional law institutions, systematic updating of the Basic Law. This dictates the need to determine the prospects for further transformation of the said regulation and its acceleration.The fundamental principles of constitutionalism, principles and constitutional procedures must be adhered to.The implementation of the constitutional, political and legal renewal of public power and governance in Ukraine should envisage a comprehensive transformation of the system of government in doctrinal and applied aspects. It is also expedient to define the concept of systematic renewal, modernization of the Constitution of Ukraine, without which attempts to reform the Basic Law become problematic. This article presents a comparative analysis of the provisions of the Constitution of Ukraine and the Law of Ukraine "On Court Fees".The author emphasizes that the Constitution of Ukraine establishes an axiological basis for the legal regulation of the court fees and, at the same time, defines the relevant categories of cases, access to judicial protection in which should not be the subject to significant restrictions or should not be limited at all, namely in the cases of: challenging the decisions, actions or omissions of public authorities, local governments and officials; protection of the right to own property; protection of honour and dignity and business reputation; free access to the information about the state of the environment, the quality of food and household items, and others. The court fee in the constitutional justice is also singled out, which is substantiated by the special procedural and essential nature of the constitutional complaint. The author disputes the possibility of implementation of the court fee for filing a constitutional complaint, the doubtfulness of which is explained by the normative form of the constitutional complaint that does not provide a direct review of the court decision. Emphasis is placed on the provisions of the Constitution, which support the need to reform the existing concept of regulation of court fees, in particular the change in access to appeals and cassation appeals from progressive to the regressive court fee rate. It is emphasized that the Law of Ukraine "On Court Fees" does not fully comply with the Constitution of Ukraine. It is concluded that the Constitution of Ukraine provides the individualization of the amount of court fees that should depend on the stage of the proceedings, the category of the case, and the relevant range of entities that should be exempt from the court fees. ; Статтю присвячено порівняльному аналізу положень Конституції України та Закону України «Про судовий збір».Наведено аргументи, що Конституція України встановлює аксіологічну основу для нормативного регулювання інституту судового збору та поряд із цим визначає відповідні категорії справ, доступ до судового захисту в котрих не повинен мати значних обмежень або й не мати таких зовсім, а саме у справах щодо: оскарження в суді рішень, дій чи бездіяльності органів державної влади, органів місцевого самоврядування, посадових і службових осіб; захисту права власності; захисту честі та гідності і ділової репутації; вільного доступу до інформації про стан довкілля, про якість харчових продуктів і предметів побуту та інших. The purpose of the article is theoretical-legal research of the constitutional right to entrepreneurial activity in order to clarify its essence, subject and object composition, to identify the peculiarities of implementation and guarantees of this right. Methods. To achieve the research goal, dialectical, formal-legal, comparative-legal, system-structural, logical-semantic and other methods of scientific cognition have been used. Results. The essence and content of the constitutional right to entrepreneurial activity have been analysed. The content of this right is defined as the totality of an entrepreneur's powers that are necessary for his/her achieving a specific goal – certain economic and social results and obtaining profit. The subject composition of the constitutional right to entrepreneurial activity has been examined. The shortcomings of establishing this right in Section II of the Constitution of Ukraine have been identified. The expediency of further development of the constitutional provision on subjects of the right to entrepreneurial activity in the framework of the Commercial Code of Ukraine has been emphasized. The concept and attributes of entrepreneurship as an object of the right to entrepreneurial activity have been elucidated. New ways of developing the institution of entrepreneurship and means of effectively ensuring the exercise of the constitutional right to entrepreneurial activity have been proposed. The role of guarantees of the constitutional right to entrepreneurial activity has been studied to ensure its effective enforcement. Conclusion. The introduction of amendments to the Constitution of Ukraine regarding the right to entrepreneurial activity is proved to be unreasonable. In order to ensure the stability of the legal status of an entrepreneur, instead of updating the constitutional regulations, it has been proposed to improve practical guarantees, methods and mechanisms of implementing the right to entrepreneurial activity within the framework of the Commercial Code of Ukraine. The significance of the Constitutional Court of Ukraine has been substantiated for ensuring the understanding of the content and peculiarities of the implementation of the constitutional right to entrepreneurial activity and further development of legislative regulation in accordance with the constitutional principles. The main factors that hinder the development of entrepreneurship in Ukraine in the current conditions have been singled out as follows: - the infringement by state and local authorities of the guarantees of the constitutional right to entrepreneurial activity enshrined in the Constitution of Ukraine and legislation; - excessive administrative pressure on business entities; - poor economic incentives for the effective development of the entrepreneurial institution; - insufficient attention to the issues of preparing for entrepreneurial activities in educational institutions. The necessity to conduct further scientific research in the direction of minimizing the harmful impact of these factors on the development of entrepreneurship in Ukraine has been substantiated. ; Мета статті. Теоретико-правове дослідження конституційного права на підприємницьку діяльність для з'ясування його сутності, суб'єктного та об'єктного складу, виявлення особливостей реалізації та гарантій такого права. Методи. Для досягнення мети дослідження використані діалектичний, формально-юридичний, порівняльно-правовий, системно-структурний, логіко-семантичний та інші методи наукового пізнання. Результати. Проаналізовано сутність та зміст конституційного права на підприємницьку діяльність. Зміст такого права визначено як сукупність правомочностей підприємця, які йому необхідні для досягнення визначеної ним мети – певних економічних і соціальних результатів та одержанняприбутку. Досліджено суб'єктний склад конституційного права на підприємницьку діяльність. Виявлені недоліки фіксації такого права у розділі ІІ Конституції України. Наголошено на доцільності подальшого розвитку конституційного положення щодо суб'єктів права на підприємництво у рамках Господарського кодексу України. З'ясовано поняття та ознаки підприємництва як об'єкта права на підприємницьку діяльність. Запропоновані нові шляхи розвитку інституту підприємництва та засоби ефективного забезпечення реалізації конституційного права на підприємницьку діяльність. Досліджено роль гарантій конституційного права на підприємницьку діяльність для забезпечення ефективної його реалізації. Висновки. Обґрунтовано недоцільність внесення змін до Конституції України щодо права на підприємницьку діяльність. Запропоновано для забезпечення стабільності правового статусу підприємця замість оновлення конституційної регламентації вдосконалювати практичні гарантії, способи і механізми реалізації права на підприємницьку діяльність у рамках Господарського кодексу України. Аргументовано важливість Конституційного Суду України для забезпечення розуміння змісту та особливостей реалізації конституційного права на підприємницьку діяльність і подальшого розвитку законодавчого регулювання відповідно до конституційних принципів. Виділено головні чинники, які заважають розвитку підприємництва в Україні в сучасних умовах, а саме: -порушення органами державної влади та місцевого самоврядування гарантій конституційного права на підприємницьку діяльність, закладених в Конституції України і законах; - надмірний адміністративний тиск на суб'єктів господарювання; -низький рівень економічних стимулів для ефективного розвитку інституту підприємництва; -недостатня увага до питань підготовки у закладах освіти до зайняття підприємницькою діяльністю. Обґрунтовано необхідність здійснення подальших наукових досліджень у напрямку мінімізації шкідливого впливу зазначених чинників на розвиток підприємництва в Україні.
The purpose of the article is theoretical-legal research of the constitutional right to entrepreneurial activity in order to clarify its essence, subject and object composition, to identify the peculiarities of implementation and guarantees of this right. Methods. To achieve the research goal, dialectical, formal-legal, comparative-legal, system-structural, logical-semantic and other methods of scientific cognition have been used. Results. The essence and content of the constitutional right to entrepreneurial activity have been analysed. The content of this right is defined as the totality of an entrepreneur's powers that are necessary for his/her achieving a specific goal – certain economic and social results and obtaining profit. The subject composition of the constitutional right to entrepreneurial activity has been examined. The shortcomings of establishing this right in Section II of the Constitution of Ukraine have been identified. The expediency of further development of the constitutional provision on subjects of the right to entrepreneurial activity in the framework of the Commercial Code of Ukraine has been emphasized. The concept and attributes of entrepreneurship as an object of the right to entrepreneurial activity have been elucidated. New ways of developing the institution of entrepreneurship and means of effectively ensuring the exercise of the constitutional right to entrepreneurial activity have been proposed. The role of guarantees of the constitutional right to entrepreneurial activity has been studied to ensure its effective enforcement. Conclusion. The introduction of amendments to the Constitution of Ukraine regarding the right to entrepreneurial activity is proved to be unreasonable. In order to ensure the stability of the legal status of an entrepreneur, instead of updating the constitutional regulations, it has been proposed to improve practical guarantees, methods and mechanisms of implementing the right to entrepreneurial activity within the framework of the Commercial Code of Ukraine. The significance of the Constitutional Court of Ukraine has been substantiated for ensuring the understanding of the content and peculiarities of the implementation of the constitutional right to entrepreneurial activity and further development of legislative regulation in accordance with the constitutional principles. The main factors that hinder the development of entrepreneurship in Ukraine in the current conditions have been singled out as follows: - the infringement by state and local authorities of the guarantees of the constitutional right to entrepreneurial activity enshrined in the Constitution of Ukraine and legislation; - excessive administrative pressure on business entities; - poor economic incentives for the effective development of the entrepreneurial institution; - insufficient attention to the issues of preparing for entrepreneurial activities in educational institutions. The main forms, institutional mechanisms and problems of the implementation of direct democracy in Slovak Republic are analyzed in the article. The Constitution establishes the following forms of direct democracy in Slovakia: referendums, petition campaigns and the removal of the President from office (national level); community gathering, local referendum and regional referendum (level of territorial self-government).The main focus is on the peculiarities of constitutional regulation and the political functioning of the referendum. The referendum is held in Slovak Republic at national, regional and local level. The experience of holding the Slovak referendums testifies to the low turnout of citizens. In 1993-2015, there were eight national referendums, but only one in 2003 was recognized as validKey issues, which essentially complicate the procedure of the referendum conducting, have been determined. It is concluded that the referendum institute in Slovak Republic has often been used to achieve narrow political goals. The politicization of the referendum is connected with the political parties, the struggle between the authorities and the opposition.The article shows the reasons for the lack of interest of citizens in implementing the mechanisms of direct democracy in Slovak Republic.Development of direct democracy is considered as a key prerequisite for further democratization of Slovakia's political system. The need to improve the legal regulation of direct democracy and referendums in Slovak Republic is also stressed in the article. ; У статті проаналізовано основні форми, інституційні механізми і проблеми реалізації прямої демократії в Словацькій Республіці. Основна увага зосереджена на особливостях конституційного регулювання та політичного функціонування інституту референдуму. Зроблено висновок, що інститут референдуму в Словаччині часто використовувався для досягнення політичних цілей. Політизація референдуму пов'язана з партіями, боротьбою між владою і опозицією. Акентовано увагу на причинах слабкого зацікавлення громадян в реалізації механізмів прямої демократії в Словацькій Республіці.
The article underlines the conceptual look at the role and place of constitutional law in the system of EU law and provides its complex characteristics according to formal and material conditions. The work is based on the hypothesis that the role and place of the constitutional law in the system of EU law are similar to those characterizing the similar field in any national law system, democratic state, with features stipulated by the supranational nature of this system of law. It`s substantiated an opinion that the formation of the EU law as an autonomous supranational system of law includes not only the accumulation and integration of the corresponding set of legal acts, but also its gradual differentiation with selection of individual branches and institutions. The leading role in the EUlegal system, as well as in national legal systems, is occupied by the constitutional law, owing primarily to its subject of legal regulation. Attention is payed to the fact that after the failure of the common European constitution draft, the term "constitution" in the EU legal system is used exclusively in the substantive sense, and the constitution itself is unwritten (multi-source, combined), like the British one. At the same time, the system of sources of EU constitutional law is characterized by diversity and consists of three levels (subsystems) that regulate the fundamental political and legal relations associated with European integration: primary law, secondary law, common law and case law. It is noted that the core of the subject of EU constitutional law consists of two blocks of public relations: a) relations determining the institutional and functional organization of public authority in the EU; b) relations characterizing the foundations of the legal status of an individual in the EU. These basic political and legal relations are the matrix that determines the formation and development of the relevant general institutions of the EU constitutional law. The example of the constitutional foundations of EU civil society demonstrates that the process of segregation of some institutions in the branches structure of the EU constitutional law continues. At the same time, in general, the structuring of constitutional and legal institutions in the EU repeats the genesis of national constitutional law, at least the one that took place in the states of continental Europe. Attention is payed to the fact that the training of legal professionals in Ukraine must meet the challenges that legal education in the context of European integration. One of the important steps in this direction should be the introduction into the educational process of law schools in our country of disciplines devoted to certain branches of EU law, including the EU constitutional law as the leading branch of this legal system. ; У статті висвітлюється концептуальне бачення ролі та місця конституційного права в системі права ЄС, надається його комплексна характеристика за формальними та матеріальними критеріями. В основу роботи покладено гіпотезу про те, що роль і місце конституційного права в системі права ЄС є аналогічними, тим, що характерні для відповідної галузі в будь-якій національній системі правої, демократичної держави, з особливостями, зумовленими наднаціональним характером цієї системи права. Обґрунтовується думка, що формування права ЄС як автономної наднаціональної системи права передбачає не тільки накопичення й інтеграцію відповідного нормативного масиву, але й поступову його диференціацію з виокремленням певних галузей та інститутів. Провідну роль у системі права ЄС, як і в національних правових системах, посідає конституційне право, що зумовлено передусім його предметом правового регулювання. Звертається увага на те, що після провалу проєкту загальноєвропейської конституції термін «конституція» щодо правової системи ЄС вживається тільки в матеріально-правовому сенсі, а сама конституція є неписаною (багатоджерельною, комбінованою), на зразок британської. Водночас система джерел конституційного права ЄС характеризується багатоманітністю і складається з трьох рівнів (підсистем), що регулюють основоположні політико-правові відносини, пов'язані з європейською інтеграцією: первинного права, вторинного права, звичаєвого права і прецедентного права. Зазначається, що ядро предмета конституційного права ЄС становлять два блоки суспільних відносин: а) відносини, що визначають інституційно-функціональну організацію публічної влади в ЄС; б) відносини, що характеризують основи правового статусу особи в ЄС. Ці базові політико-правові відносини виступають тією матрицею, що зумовлює формування і розвиток відповідних генеральних інститутів конституційного права ЄС. На прикладі конституційних засад громадянського суспільства ЄС демонструється, що процес виокремлення в галузевій структурі конституційного права ЄС окремих інститутів триває. Водночас загалом структурування конституційно-правових інститутів в ЄС повторює ґенезу національного конституційного права, принаймні ту, що мала місце в державах континентальної Європи. Звертається увага на те, що підготовка фахівців-правників в Україні має відповідати тим викликам, що постають перед юридичною освітою в умовах євроінтеграції. Одним із важливих кроків на цьому шляху має стати запровадження в навчальний процес юридичних вишів нашої держави навчальних дисциплін, присвячених окремим галузям права ЄС, зокрема й конституційному праву ЄС як провідній галузі цієї системи права.
