Changing Chapter II of the Constitution of Ukraine "Rights, freedoms and duties of man and citizen" two changes seems to be appropriate. Firstly, it is adviced to reduce the list of rights and freedoms. Secondly, there might be a sense to reduce the detalization in the articles about individual rights and freedoms. This will allow to achieve better harmonization of national legislation with the legal positions of the EuropeanCourt of Human Rights. ; При пересмотре раздела II Конституции Украины «Права, свободы и обязанности человека и гражданина» целесообразным представляется сокращение перечня прав и свобод и уменьшение уровня конкретизации при изложении отдельных прав и свобод. Это будет иметь позитивный эффект для правовой системы в целом и будет способствовать евроинтеграционным процессам в Украине в части гармонизации национального законодательства с правовыми позициями Европейского суда по правам человека. ; У разі перегляду розділу ІІ Конституції України «Права, свободи та обов'язки людини і громадянина» доцільним уявляється скорочення переліку прав і свобод та зменшення рівня конкретизації при викладенні окремих прав і свобод. PROTECTION OF THE RIGHTS OF MAN AND OF THE CITIZEN STANDARDS OF PUBLIC LAWO. P. SVITLYCHNYY, Doctor of Law SciencesNational University of Life and Environmental Sciences of Ukraine The purpose of this paper is the theoretical analysis of peculiarities of protection of rights and lawful interests of individuals by public law.The origins of public law starts from the time of Ancient Rome. In judicial practice and jurisprudence of Rome was distinguished two branches of law – public «jus publiсum» and private law «jus priwatum».The emergence of legal process and legal procedure, largely associated with the emergence of the state court in Rome, which occurred together with the formation of the government, as was and remains an integral part of the state apparatus. In General, the Roman law is a generally accepted basis for modern law, which was transformed and continues to transform itself depending on the location, time, traditions, political views of each country.In modern terms, the basis on which formed the legal regulation of the rights and interests of the person under which such rights and interests need legal regulation, there is the constitutional basis for the rule of law. The most important subjective rights and freedoms enshrined in Section II «Rights, freedoms and duties of man and citizen» of the Constitution. The analysis of the articles of the Constitution of Ukraine gives grounds to divide the fundamental rights and freedoms: personal (articles 27-35, 51-52); political (articles 36-40); economic (articles 41-45); social (articles 46-49); environmental (article 50); cultural (articles 53-54). Provided in these articles of the Constitution, the list of fundamental rights and freedoms are implemented with the greatest completeness and efficiency. Most of them have an absolute character, i.e. not only inalienable, but shall not be restricted. This group of rights and freedoms provides for the inadmissibility of any infringement of state bodies, public organizations, officials for life, health, freedom, honour and dignity of the person and the inadmissibility of arbitrary deprivation of life. However, the norms of article 65-68 of the Constitution is fixed and duties of citizens within the limits specified in the Constitution and other norms of the legal order. Legal regulation of the obligations of the person is carried out using appropriate techniques or methods for the replication of state coercion.State coercion is one of the legal means of ensuring the proper implementation of the rights and interests of the person and depending on the objectives, justification and application can be divided into the funds of liability for improper performance of duties and remedies for violation of rights.Based on the characteristics of state coercion, it is determined as a method of state influence on the consciousness and behavior of subjects on the property of the participants of legal relations to prevent crime, punishment and correction of offenders, restoration of violated rights, which apply irrespective of the will and desires of obliged entities.Shows shows that modern public law is designed to protect the rights and legitimate interests of the person. In the basis of subjective public rights, it is easy to see safeguards for the use of the specific capabilities to perform legally significant acts at its own discretion in guaranteed respectively innername aspects of the organization and realization of socially important human relationships. From private subjective right of a public character is that in relationships in which they are formed and implemented, Zobov asarnow party, except for the bearer of these rights, as a rule, is the bearer of public authority of the subject of authority.The analysis of scientific developments and regulations, gives grounds to assert that in modern conditions of social legal state, one of the main tasks of administrative law of Ukraine is as complete as possible implementation of legal principles in the sphere of public law relations of the rights and freedoms of man and citizen, as well as effective protection of the legitimate rights and legitimate interests of man and citizen in case of violation by public authorities, their officials in position of authority corresponding to the current legislation. Introduction and equality in human relations with officials of public authorities must be at the core of modern administrative law, which requires rethinking some of the key scientific and theoretical foundations of doctrine administrative law as an independent branch of the Ukrainian legal science.
У статті досліджуються покоління прав людини в контексті їх прямого впливу на формування конституційно-правового статусу людини і громадянина.
Метою статті є дослідження ролі і впливу поколінь прав людини на становлення та трансформацію конституційно-правового статусу людини і громадянина.
Наукова новизна. Наведені у своїй логічній послідовності аргументи актуалізують та об'єктивізують проблематику поколінь прав людини та її вплив на динаміку правового статусу людини в контексті його розширення та вдосконалення в умовах розвитку правової демократичної державності, що несе в собі могутню гуманістично-гуманітарну складову. Визначено, що покоління прав людини формуються в доктрині конституційного права держав та в міжнародному праві в історичній ретроспективі з метою акцентування уваги держав та міжнародного співтовариства на особливій значущості відповідних груп прав, актуалізації їх визнання, легалізації, охорони, захисту, реалізації та гарантування.
Висновки. Системний аналіз наведених поколінь прав людини свідчить, що всі вони, по-перше, органічно вписуються і відображають гуманістичні та гуманітарні засади сучасної концепції прав людини. По-друге, з виокремленням кожного з нових поколінь прав людини фактично виникає новий підхід до особистості, причому не тільки як до природної істоти, а як до належного суб'єкта права та суб'єкта правового статусу. Відносно останнього ракурсу, який фактично є метою дослідження, що проводиться, треба зазначити, що такий висновок має суттєве методологічне та праксеологічне значення, що підтверджується діяльністю як національних держав, так і всього міжнародного співтовариства по активізації процесів нормування, нормативізації, нормопроектування, нормотворчості у сфері прав людини на міжнародному універсальному та державному рівнях. По-четверте, така діяльність не носить механічний характер, вона характеризується релятивістсько-комплексним та творчим підходом, коли нові права людини модернізують її конституційно-правовий та міжнародний статус у бік його розширення та вдосконалення – але не безсистемно, хаотично, а демонструючи наявність чіткої гуманістичної управлінської парадигми, що скерована на: а) адекватну нормативізацію таких прав людини; б) створенням системи нормативно-правового (конституційного) супроводження та забезпечення таких прав, з метою їх практичної реалізації; в) «вписуванням» відповідних прав людини та громадянина, що входять до категорії поколінь прав людини, до єдиної узгодженої системи конституційних прав, що, своєю чергою, г) напряму впливає на розширення і вдосконалення конституційно-правового статусу людини і громадянина, допомагаючи у закріпленні механізмів їх реалізації та гарантованості на національному законодавчому, а також на міжнародному договірно-нормативному рівнях.

The problem of human rights has not lost its relevance since the French Revolution and the United States' victorious struggle for independence. It became especially topical in the years of the Second World War. At each of these historical frontiers, significant legal acts were adopted to guarantee human rights and freedoms. But in the second decade of the XXI century, this problem arose with new acuteness. Ter- rorist attacks, separatism, illegal migration have become a real challenge to international law and order. Unfortunately, these threats have not escaped Ukraine either. The conflict of principles of human rights and state sovereignty has led to numerous conflicts. Their heavy consequences forced politicians and experts to focus on the fact that the prevailing the secular interpretation of human rights and freedoms' concept foundation results critical failures. So, there is a task to reveal the true existential sources of human rights and freedoms concept. In addition to the practical political and legal aspect, this issue also has a significant scientific philosophical and law significance.The article aims to reveal the role of the Christian tradition in the formation and development of human rights and freedoms concept.This research opposes the radical secularist views and argues that human rights and freedoms, which was recognized by international law 70 years ago as a result of UN Universal Declaration of Human Rights adoption, have their roots in God's Law. This law was notified by Moses 1300 years before Christ, but the Gospel became their real genuine spiritual source. Christ's commandments of love and charity addressed not only to their neighbors, but also to persecutors and offenders, laid the humanistic value foundation of the human rights system. Acceptance of human as God's creation, which has a mission of salvation through Christ, determines the core definition of human rights and freedoms concept - human dignity. The starting point in the theoretical substantiation of human rights provenance is the concept of natural law, initiated by the famous Catholic theologian Thomas Aquinas. According to Aquinas, natural law derives from God's law. The logic of Thomism caught up with Protestant philosophers dialectically led jurisprudence from the general Christian concept of natural law to natural rights and human rights. So, they are objective and independent of the other people's actions or inaction. Protestantism has put individual freedom at the head of Christian values. At the same time, the Christian tradition proceeds from the fact that freedom without responsibility and love leads to the loss of freedom. This thesis was thoroughly substantiated by Immanuel Kant, and was philosophical formulated in his famous categorical imperative. Endeavor to solve the dilemma of the co-relation between freedom and responsibility led Christian thinkers to the necessity of substantiating the cardinal virtue - justice. The category of justice logically generated the concept of equality, which is the cornerstone of human rights and freedoms concept. Other fundamental provisions, including non-discrimination norms, come from it. Christian respect for human dignity and the aspiring for equality naturally give rise to such a basic principle of human rights concept as solidarity, which is most characteristic of Orthodoxy, and embodied in the norms that proclaim the right to a decent standard of human being. Thus, a holistic Christian tradition is the primary source of all three generations of human rights. This fruitful source continues to supply the value content of human rights and freedoms concept, which is the kernel of international and civilized states' legal systems. ; У статті порівнюються принципи і норми, закріплені у Загальній Декларації прав людини та інших базових міжнародно-правових актах, які гарантують права і свободи людини, із біблійними заповідями. Показано, що теологічні та філософські концепції томізму, кальвінізму і кантіанства, обґрунтувавши фундаментальні цінності природного права, справедливості, рівності, людської гідності, свободи та відповідальності, заклали фундамент розумінню прав людини як об'єктивних невідчужуваних сутностей. Охарактеризовані особливості трактування прав і свобод людини у католицькій, протестантській і православній традиціях. Робиться висновок про те, що кожна з християнських конфесій зробила свій внесок у генезу усіх трьох поколінь прав людини. Доводиться, що сучасний концепт прав і свобод людини має джерелом християнську духовну традицію.
The concept and meaning of human rights and freedoms is really relevant today. It is their proper understanding that determines the lawful conduct of citizens, their observance of the law, the exercise of their rights and the performance of their duties. Our state has been developing and changing for many years, and at the same time the people's legal understanding is changing. However, it is important that the legislation clearly and easily outlines and clarifies the issues under consideration. After all, only by accurately understanding one's place in society will a person be able to diligently adhere to the tasks assigned to him. However, we should not forget that people are quite different from each other and everyone has their own understanding and needs. In today's society, people are increasingly remembering their rights but forgetting their responsibilities. Human rights are granted not to be abused, but to respect and respect the rights of one's state without forgetting human morality and mutual respect for others. Responsibilities also play an important role in society, because it is on their dignified and fair performance that our society is built, which begins with each of us in the first place. It is worth noting that only when human rights are built on its moral values, including dignity, justice, honesty, mutual assistance, we will be able to revive in people their strength and the spirit of the people. Natural law really plays an important role in the life of each of us. However, each of us determines for himself what is a necessary value for his normal existence. Since human rights are the highest social value, some natural norms should be introduced into positive law, which should change society for the better. However, changes must be made not only in the rules of positive law, but everyone must improve themselves through the rules of natural law. ; Поняття та значення прав і свобод людини і справді є актуальним у наш час. Саме від правильного їх розуміння залежить правомірна поведінка громадян, дотримання ними законів, використання своїх прав та виконання покладених обов'язків. Наша держава розвивається і змінюється впродовж багатьох років, разом із цим змінюється і праворозуміння людей. Проте важливо, щоб саме у законодавстві було чітко й доступно окреслено та роз'яснено розглядувані питання. Адже тільки точно розуміючи своє місце в суспільстві, людина зможе старанно дотримуватись покладених на неї завдань. Проте не варто забувати, що люди між собою досить різні і в кожного є своє розуміння і свої потреби. У теперішньому суспільстві люди все частіше згадують про свої права, проте забувають про свої обов'язки. Права людині надаються не для того, щоб вона ними зловживала, а для того, щоб дотримувалась та поважала права своєї держави та не забувала при цьому про людську моральність та взаємоповагу стосовно інших. Обов'язки ж посідають також важливе місце у суспільстві, адже саме на гідному та справедливому їх виконанні побудоване наше суспільство, яке насамперед починається з кожного з нас. Варто зазначити, що тільки тоді, коли права людини будуватимуться на її моральних цінностях, серед яких -гідність, справедливість, чесність, взаємодопомога, ми зможемо відродити в людей їхню силу й дух народу. Природне право і справді відіграє важливу роль у житті кожного з нас. Проте кожен з нас сам для себе визначає, що для нього є необхідною цінністю для нормального існування. Оскільки права людини є найвищою соціальною цінністю, варто вносити в позитивне право деякі природні норми, що мало б змінити суспільство на краще. Проте зміни повинні вноситись не тільки в норми позитивного права, а кожен сам повинен вдосконалювати себе за допомогою норм природного права.
The right of citizens to meet peacefully and to hold meetings, rallies, marches and demonstrations is prescribed by Art. 39 of the Constitution of Ukraine. Participation in such public activities could be regarded as a form of direct and independent expression of the people's will, as well as the reaction of a society to the actions of the state. In order to prevent a conflict between the society and state, as well as disunity between them, the state should not ignore above-mentioned people's activities. The specified right belongs to the subjective person' srights, the principal purpose of which is to influence the state bodies for solving the most important society-state issues by coordinating and forming the citizens' opinion and the way of its expression, as well as an element of democracy, a mode of participation in the management of state and local affairs. At the same time, it should be noted that such meetings may not always have the nature of political events, and the mentioned right is not always the political one.The vast majority of specialists in the field of law, in particular, the constitutional law, regards the aforementioned right as a type of citizens' political rights that belong exclusively to Ukrainian citizens who have reached 18 years of age and have acquired full legal personality (with some exceptions concerning the right to association in public (non-political) organizations and the right to individual and collective appeals), and express the content of legal relationship between the individual and the state.However, not all scientists agree with the fact that mentioned right belongs exclusively to citizens of a certain state.The right to peaceful assembly is one of the inalienable, inherent rights in a democratic world. It should be noted that resembling rules are accommodated in the acts of international law, as the part of national legislation, in particular, the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights. Furthermore, the international documents establish it as the right of any person, not only the citizen's one. This right is an inalienable one of every person that is provided for both foreigners and stateless persons, hence the subject matter should be considered not as political rights of citizens, but as civil rights of people. Therefore, the appropriate amendments should be made to the current legislation of Ukraine and, primarily, to the Constitution of Ukraine. ; Статтю присвячено визначенню місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина.На основі проведеного аналізу думок фахівців з питань конституційного права, конституційних положень та міжнародних документів щодо місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина наголошується, що вказане право варто розглядати не як політичне право громадян, а як одне з особистих, громадянських прав людини.Запропоновано внесення відповідних змін до статті 39 Конституції України.
Розкривається питання про можливість обмеження реалізації прав і свобод людини і громадянина, виходячи з норм міжнародних актів та національного законодавства України. Розглядаються підстави обмеження реалізації прав і свобод людини, аналізується сукупність умов правомірності обмеження реалізації прав і свобод, відома як «трискладовий тест». Досліджується та розкривається зміст таких елементів цього тесту, як законність, тобто закріплення можливості обмеження реалізації прав і свобод у законодавстві, при цьому вказується на вимоги щодо якості та доступності закону, виходячи із принципу правової визначеності; легітимна мета такого обмеження та необхідність запроваджених обмежень у демократичному суспільстві. Вказані цінності, з метою захисту яких і відбувається обмеження реалізації прав і свобод, а також звертається до аналізу принципу пропорційності, що має бути застосований при здійсненні обмеження прав і свобод людини, вказуючи при цьому, що заходи щодо обмеження прав особи мають бути співрозмірними тим суспільним відносинам та іншим цінностям, що захищаються шляхом відповідного обмеження. Досліджуються підходи до регулювання питання обмеження реалізації прав і свобод людини в Конституції України та Конвенції про захист прав людини і основоположних свобод, аналізується практика Європейського суду з прав людини щодо вказаної проблематики. It was revealed that human rights are one of the most commonly used concepts in modernjurisprudence, which is still hotly debated among scholars today. Also, the interest in human rights concepts is easy toexplain in view of the socio-economic restructuring taking place in Ukraine. It has been shown that in a well-orderedsociety, the people certainly benefited from the fact that their elites undertook certain political commitments. However,he did not have any natural or human rights that he could oppose to unjust leadership. For centuries, there has beena process of gradual recognition of individual freedom and restriction of government power. We can state that rightsand freedoms in the form in which they are presented at the present stage, did not arise immediately, but have passeda long way of historical development. The process of formation of the considered categories is systematized accordingto various criteria. Such, in particular, are: the time of emergence of certain rights and freedoms, their purpose, humanaffiliation to this state. These criteria are organically interrelated, so it is advisable to analyze them in combination.The importance of the system of public authorities in the field of human rights was revealed. They showed thatevery society had its own ideas of justice, dignity and respect. And in almost every ancient community of people there was a view that its leaders must rule wisely and be guided by the interests of the common good. They found that humanrights are essential, inalienable rights that belong to him from birth. And they can exist regardless of whether they arerecognized by the state or not, enshrined in law or not, and regardless of the connection of their carrier with a particularstate. Inalienable rights include the right to life, security, property, personal integrity and others. According to worldpractice, many people in the world do not have the status of a citizen (stateless persons are stateless), which means thatthey have human rights, but do not have the rights of a citizen. The role of the judiciary and law enforcement agenciesin the mechanism of protection of human and civil rights in a democratic society was revealed. ; У статті йдеться про різноманітні підходи щодо сутності та особливостей поняття права людини, які висвітлюються в історико-правових та юридичних джерелах. Розкрили, що права людини – одне із найбільш уживанихпонять у сучасному правознавстві, навколо якого і в наш час відбуваються гострі дискусії серед учених. Такожінтерес до концепцій прав людини легко пояснити з урахуванням соціально-економічної перебудови, що відбувається в Україні. Показали, що в добре упорядкованому суспільстві народ неодмінно користався з того, що йогоеліта брала на себе певні політичні зобов'язання. Проте у нього не було жодних природних чи людських прав, яківін міг би протиставляти несправедливому керівництву. Століттями проходив процес поступового визнання індивідуальної свободи та обмеження влади уряду. Можемо констатувати, що, права і свободи в тому вигляді, якомувони представлені на сучасному етапі, виникли не відразу, а пройшли досить тривалий шлях історичного розвитку. Процес становлення розглянутих категорій прийнято систематизувати за різними критеріями. Такими,зокрема, є: час виникнення тих чи інших прав і свобод, їх призначення, приналежність людини до цієї держави.Вказані критерії органічно взаємопов'язані між собою, а тому їх аналіз доцільно проводити у комплексі.Виявили значення системи органів державної влади в сфері забезпечення прав людини. Показали, що кожнесуспільство мало свої уявлення про справедливість, гідність і повагу. І майже в кожній давній спільноті людейіснувала точка зору, що її провідники повинні правити мудро та керуватися при цьому інтересами загального добробуту. Виявили, що права людини - це істотні, невідчужувані права, які належать їй від народження.І вони можуть існувати незалежно від того, визнає їх держава чи ні, закріплює їх на законодавчому рівні або ні,а також незалежно від зв'язку їх носія з тією чи іншою державою. До невідчужуваних прав відносяться правона життя, безпеку, власність, особисту недоторканість та інші. Як свідчить світова практика, у світі багато людейне мають статусу громадянина (особи без громадянства - апатриди), а це значить, що вони володіють правамилюдини, але не мають прав громадянина. Розкрили роль судових та правоохоронних органів у механізмі захиступрав людини і громадянина в демократичному суспільстві.
The article examines the problem of the development of the doctrine of natural human rights and its implementation in the constitutional acts of the Ukrainian National Republic of 1917-1918. Following article explains the reasons for the changes in relation to the problem of protecting natural human rights at the beginning of the twentieth century. The leaders of the Ukrainian Central Rada were well aware that the revival of national statehood is impossible without a clear legal definition of the status of a citizen of Ukraine. This problem became especially urgent after the proclamation of the third Universal, when the announcement of the revival of the Ukrainian state took place. The Ukrainian government stood up to protect human life and dignity, freedom of speech, press, religion. The citizens of the country were guaranteed certain political and social rights without distinction of gender and age of citizens. But introducing innovative views for that time, members of the Ukrainian Central Rada found it difficult to finally resolve the issue of applying the "labour principle". It actually introduced inequality of citizens of the state on the basis of their social-class origin, what is a blatant violation of the basic principle of the constitutional state - the equality of all citizens before the law. Some of the decisions implemented in the constitutional acts of the UNR, such as, for example, the introduction of the nationalization of land, private factories, factories and banks, when the private owner remained defenceless against the state, cannot be called legal. The content of many constitutional acts issued by the UCR contains provisions on the protection of the rights of representatives of national minorities, and this is not accidental, because the UNR was well aware of the need to resolve the "national question" as one of the most difficult in the country. But on the way to the successful development of the doctrine of the protection of fundamental human and civil rights in the Ukrainian National Republic were not only such factors as a lack of lawyers and low legal awareness of citizens of the country. The real restriction of human and civil rightsin the Ukrainian National Republic was introduced by the command of the German occupation forces against the will of the Ukrainian legitimate government. ; У статті досліджено питання розвитку доктрини природного права людини та його реалізації в конституційних актах Української Народної Республіки 1917-1918 років. У статті були пояснені причини змін у ставленні до проблеми захисту природних прав людини на початку ХХ ст. Керівники Української Центральної Ради добре розуміли, що відродження національної державності є неможливим без чіткого юридичного визначення статусу громадянина України. Особливо актуальною ця проблема стала після проголошення Третього універсалу, коли відбулось оголошення про відродження Української держави. Українська влада встала на захист життя людини та її гідності, свободи слова, друку, віросповідання. Громадянам країни гарантувались певні політичні і соціальні права без різниці статі та віку громадян. Але впроваджуючи новаторські для того часу погляди, члени Української Центральної Ради вагалися стосовно остаточного вирішення питання застосування «трудового принципу». Він фактично впроваджував нерівність громадян держави за ознаками їх соціально-класового походження, що є відвертим порушенням основного принципу правової держави - рівності усіх громадян перед законом. Частина рішень, реалізованих у конституційних актах УНР, таких, наприклад, як запровадження націоналізації землі, приватних фабрик, заводів і банків, коли приватний власник лишався беззахисним перед державою, неможливо назвати правовими. Зміст багатьох конституційних актів, виданих УЦР, містить положення щодо захисту прав представників національних меншин і це невипадково, бо в УНР добре усвідомлювали необхідність врегулювання «національного питання» як одного з найскладніших у державі. Але на заваді успішного розвитку доктрини захисту основних прав людини і громадянина в Українській Народній Республіці постали не тільки такі чинники, як брак правників та низька правова обізнаність громадян країни. Реальне обмеження прав людини і громадянина в Українській Народній Республіці було запроваджено командуванням німецьких окупаційних військ всупереч волі українського легітимного уряду.

In the article the content and essence of the right to rest of a person and a citizen are analyzed. The classification of types of such constitutional law is investigated. В статті аналізується теоретична неспроможність та практична безперспективність існуючих в науці і глобальній політиці протиставлень прав людини правам народу (нації) з метою утвердження верховенства прав людини. Авторське бачення вирішення проблеми співвідношення тих і інших прав обґрунтовується за методологією двоякої істини. В статье анализируется теоретическая несостоятельность и практическая бесперспективность существующих в науке и глобальной политике противопоставлений прав человека правам народа (нации) с целью утверждения верховенства прав человека. Авторское видение решения проблемы соотношения тех и других прав обосновывается по методологии двойственной истины. Вместо возможной опасности губительного для человечества столкновения цивилизаций в критикуемом варианте решения проблемы формулируются критерии гармонизации осуществления прав человеком и народом (нацией) как двух взаимозависимых частей верховенства права в национальном и глобальном масштабах.Ключевые слова: права человека, права народа, верховенство права, двойственная истина. The purpose of the author's research of the problem is to overcome the prevailing in science and political-legal practice of contradistinction of the individual human rights to the collective rights of the people, the nation. Critically analyzing the theoretical insolvency and practical futility of this approach, the author justifies an alternative solution of the problem. It presupposes the harmonization of the exercise of the individual rights with the collective rights of people as two parts of one social whole in accordance with the doctrine of the dual nature of truth. As a result, the author formulates the criteria for achieving such harmonization: the creation of social conditions for the formation of a majority of the middle class as a part of people's «qualitative personality» and a «qualitative people (nation)»; overcoming the tendency of bureaucratization of state and public life, undermining the rights and freedoms of individuals and nations alike; the observance of the rule of law by all entities of national law on the basis of unity during the exercise of their rights and obligations, without interferience with the rights and freedoms of other actors, both individual and collective; observance of the rule of law by all entities of international law on the basis of mutual respect and consensus regarding the civilizational and national characteristics of legal systems; оvercoming the tendency of a growing gap in the levels of development of countries and gradually equalizing the quality of their lives as the basis for harmonization the rights of people and the rights of peoples in a global scale.Key words: human rights, the rights of the people, the rule of law, the dual truth.
The article is devoted to the study of the types of international judicial institutions and their role in ensuring theright to judicial protection. It is noted that the Manila Declaration provides for a judicial settlement of disputes andarbitration. The International Court of Justice is the principal judicial organ of the United Nations. The InternationalCriminal Court is the permanent body with jurisdiction over persons responsible for particularly serious crimes, inaddition to national criminal jurisdictions. The Inter-American Court of Human Rights is an independent, conven-tional body whose function is to protect human rights in the states of North and South America. The Arab Court ofHuman Rights has not yet begun its work, although the Court's mandate allows States parties to lodge complaints.The African Court of Human and Peoples' Rights is an independent body whose purpose is to protect human rightsin African countries. The jurisdiction of the European Court of Human Rights extends to all matters of interpretationand application of the Convention for the Protection of Human Rights and Fundamental Freedoms and its protocols.The Court of Justice of the European Union interprets EU law and provides for the settlement of disputes by the EU'snational government-institutions. It is emphasized that regional judicial institutions are designed to protect the rightsand freedoms of man and citizen. They are part of a subsidiary human rights protection mechanism that can be applied once all national remedies have been exhausted. Recourse to the International Court of Justice or arbitration isnot an unfriendly act in relations between states, but on the contrary indicates the use of peaceful means of dispute settlement. Unlike other international courts, only international criminal tribunals can be joined in a single proceeding. ; Статтю присвячено дослідженню питання видів міжнародних судових установ та їх ролі в забезпеченні права на судовий захист.
