Міжнародний Білль (Хартія) як доктринальна аксіома у сфері адміністративної відповідальності
Досліджено міжнародні договори у галузі основних прав і свобод людини, які є невід'ємною частиною національного законодавства у сфері адміністративної відповідальності. Исследованы международные договора в области основных прав и свобод человека, которые являются неотъемлемой частью украинского законодательства в сфере административной ответственности. Today, human rights have gained the values that belong to the entire international community and have been justified in international law as a legal standard to which all peoples and nations must strive. As a result, the complex of international documents (Universal Declaration of Human Rights 1948, the International Covenant on Economic, Social and Cultural Rights, and the International Covenant on Civil and Political Rights, adopted by the United Nations in 1966, the its Optional Protocol) constitutes the International Bill of Rights (or the Charter of Human Rights). The purpose of this article is to study international treaties in the field of fundamental human rights and freedoms on the subject of their compliance with the institute of administrative responsibility of Ukraine, which are an integral part of domestic legislation. In the article, it is shown that the basic international human rights treaties proclaim the general protection of civil, political, social, economic and cultural rights guaranteed to every human being. Along with this, in order to increase the effectiveness of the legal protection of human rights, the subject of the criterion was laid as the basis for further UN norm-setting. Thus, there were special human rights treaties that provide for the protection of certain categories of persons. It has been established that legal standards are established in the spheres of legal regulation, in which it is necessary to typify the behavior of the relevant subjects in order to eliminate legal violations, gaps or collisions or «prepare» of a certain sphere of public relations for a higher level of unified regulation.
